The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the fourth Tuesday, and the
third regularly scheduled meeting of the month of October, 1985.

Chairman McGraw called the meeting to order at 3:15 p.m.

CONSENT AGENDA
Supervisor Brittle requested that Items 5b, 7, 8, 12,
and 18 be removed from the Consent Agenda for discussion.
Supervisor Burton requested the removal of Items Sa, 9, 10, and
14 for discussion.
Item Sa - Hand Held Portable Radios - Supervisor Burton
I
felt that this item should be held for discussion until after
election day to see if the bond issue is approved by the voters.
High band radios will be purchased for the E91l System if the
bond referendum is approved.
Item 5b - Electronic Meter Reading System - Supervisor
Burton questioned if the funds to purchase this system would be

from the Unappropriated Balance. John Chambliss, Superintendent
of Fiscal Management, reported that the funds would be taken from
a rollover account from the unappropriated balance from Utility
Billing, not from the overall Unappropriated balance.
Item 7 - One for Life Funds - Supervisor Brittle
requested that this matter be held for discussion with the
Emergency Medical Services matter.
Item 8 - Legal Ad Placement and Effectiveness -
Supervisor Brittle reported that he felt that data was
insufficient to make a conclusion.
Item 9 - Data Processing Committee {Programmer
position} - Supervisor Brittle inquired about the funds for this
position. Supervisor Nickens responded that funds are in the
budget and that an effective date and approval to choose an
applicant form the application pool is needed.
Item 10 and 20 - Bulk Sewer Contract Sewage Rate and
Bulk Water Rate in Water-Sewage Agreement - Supervisor Burton
inquired as to the date these matters will be brought back to the
Board for their approval. John Chambliss reported that it will
probably be November 26, 1985.
Item 12 - Water and Sewer Line at Boone & Company
Office complex - Supervisor Brittle requested that this item be
removed for separate vote.
Item 14 - Collection Fees for Premium Refuse Service -
Supervisor Burton asked the media present to help the County
advise the public of these fees and rates and that this type of
service is available. John Hubbard, Superintendent of the
Department of Public Facilities, reported that applications will
be mailed to citizens upon request. Supervisor Brittle requested
that Mr. Hubbard distribute applications to the Ogden Senior
Citizens area.

Item 17 - Extra-Territorial Arrest Agreement - Sheriff
o. S. Foster commended the Board on their efforts in working out

this agreement with Roanoke City.
Item 18 - Deputy Sheriff II position in the Pay and
Classification Plan for 1986-1987 - Sheriff Foster reported that
this was only for approval of the concept and that the cost would
be minimal.
Supervisor Burton moved to approve the Consent Agenda
with the deletion of Items Sa, 7, and 12.

FOR AN ELECTRONIC METER READING SYSTEM TO
BE UTILIZED FOR UTILITY BILLING

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That that certain bid of Business Systems, Inc. of
Greenville, South Carolina in the amount of $25,905.00 for the
purchase of an electronic meter reading system to be utilized for
utility Billing, upon all and singular the terms and conditions
of the invitation to bid, the specifications of the County of
Roanoke, the bidder's proposals, and the provisions of this
resolution, be, and same hereby is, ACCEPTED; and
2. That the County Administrator is hereby authorized
and directed to execute the necessary documents on behalf of

Roanoke County, all to be upon form approved by the County
Attorney; and
3. That all other bids for this purchase are hereby
rejected and the Clerk is directed to so notify such bidders and
express the County's appreciation for the submission of their
bids.

1. That the offer of K & W Builders, Inc. to donate

the water and sewer lines serving Bear Ridge, Section One, to the

form approved by the County Attorney from the developers, the

REFUSE COLLECTION SERVICE

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That premium refuse collection service will be
provided to all residential households on an individual
application basis. The charge for premium refuse collection will

be a minimum of $5.00 per month and will include backyard service
up to 100 feet from the curbside pickup location; and
2. For each additional 100 feet or fraction thereof

over the initial 100 feet, an additional $4.00 charge will be
made. Premium refuse collection charge per month is as follows
for the distance indicated:
100 feet or less $5.00/month
101 - 200 feet 9.00/month
201 - 300 feet 13.00/month
301 - 400 feet 19.00/month
401 - 500 feet 2l.00/month
501 - 600 feet 25.00/month
601 - 700 feet 29.00/month
701 - 800 feet 33.00/month
801 - 900 feet 37.00/month
901 -1000 feet 41.00/month
($4.00 for each additional 100 feet)

3. That an application charge in the amount of $20.00
shall be made in advance together with proper application upon
forms provided by the County; and
4. That premium refuse collection charges shall be
paid in advance on a quarterly basis; and
5. That this resolution shall be effective November 1,
1985. These charges are subject to change from time to time by
the Board of Supervisors without notification.

negotiated an extra-territorial arrest agreement; and

WHEREAS, this agreement authorizes a city officer or
county deputy to effect an extra-territorial arrest and further

would grant said officer or deputy the same rights, powers and
authorities as he would possess in making an arrest in his own
jurisdiction.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of Roanoke County, Virginia, as follows:
1. That the Acting County Administrator is hereby
authorized to execute an extra-territorial arrest agreement on
behalf of Roanoke County with the City of Roanoke; and
2. That said agreement shall be effective on and after
November 1, 1985; and
3. That the Acting County Administrator is hereby
directed to deliver certified copy of this agreement to the

clerks and judges of Roanoke County.

ADDITIONAL COMPENSATION FOR THE COUNTY
ATTORNEY
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That Paul M. Mahoney, County Attorney, is hereby
granted additional compensation in the amount of $3,000 for the
additional duties and responsibilities he has undertaken since
the resignation of the former County Administrator. This sum is
based upon a calculation of $600 per month for five (5) months;

2. That this sum of money shall be paid in a lump sum
amount from the following line item account:

RELOCATION OF A SECTION OF AN EXISTING
ROAD AND THE ABANDONMENT OF A SECTION OF
ROAD

WHEREAS, Secondary Route 682 from Route 221 west to 0.22
miles west of Route 221 a total distance of 0.22 mile, has been
altered, and a new road has been constructed and approved by the
State Highway Commission, which new road serves the same citizens
as the road so altered; and
WHEREAS, certain sections of this new road follow new
locations, these being shown on the attached sketch titled,
"Changes in Primary and Secondary System Due to Relocation and
Construction on Route 221, Project 022l-080-l03,C50l, dated at
Richmond, Virginia March 21, 1985."
NOW, THEREFORE, BE IT RESOLVED: That the portion of

Secondary Route 682, Section 2, shown in red on the sketch
titled, "Changes in Primary and Secondary System Due to
Relocation and Construction on Route 221, Project
0221-080-103-C501, dated at Richmond, Virginia March 21, 1985," a
total distance of 0.22 mile be, and hereby is added to the
Secondary System of State Highways, pursuant to Section 33.l-229
of the Code of Virginia of 1950, as amended;
And further, that the section of old location, i.e., Section
1 colored blue on the aforementioned sketch, a total distance of
0.18 mile, be and the same hereby is abandoned as a public road,
pursuant to Section 33.1-155 of the Code of Virginia of 1950, as
amended.

1985 be, and hereby is, rescinded; and
2. That the Virginia Department of Highways and
Transportation is hereby requested to add a section of Verndale
Drive beginning at Meadowcrest Road continuing northeast on
Verndale Drive for 0.13 miles to Plantation Road, State Route
115, to the Secondary System of Roanoke County pursuant to
Section 33.1-229 of the Code of Virginia, 1950, as amended; and
3. That this Board does guarantee the Commonwealth of
Virginia and unrestricted right-of-way of fifty (50) feet with
necessary easements for cuts, fills, and drainage.

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That Resolution 85-157.B adopted September 24, 1985
be, and hereby is, rescinded; and

2. That the Virginia Department of Highways and
Transportation is hereby requested to add a certain portion of a
certain street known as Dwight Street and a dedicated turnaround
in the Dwight Hills Subdivision, Plat Book 3, Page 5, situate in
the Catawba Magisterial District including a previously dedicated
50 foot right-of-way that runs from Route 1818, 0.02 miles to the

northwest, to the Secondary System of Roanoke County pursuant to
Section 33.1-229 of the Code of Virginia, 1950, as amended; and
3. That this Board does guarantee the Commonwealth of

1. That Resolution No. 85-159 adopted on September 24,
1985 be, and hereby is, rescinded; and
2. That the Virginia Department of Highways and
Transportation is hereby requested to add a certain portion of a
certain street known as Bunker Hill Drive situate in the Cave
spring Magisterial District (including a previously dedicated
fifty (50) foot right-of-way) that runs from a point 0.05 miles
west of the intersection of Bunker Hill Drive and York Avenue a
distance of 0.05 miles, to the Secondary System of Roanoke County
pursuant to Section 33.1-72.1 (Cl) of the 1950 Code of Virginia,
as amended; and
3. That this Board does guarantee the Commonwealth of

Virginia an unrestricted right-of-way of fifty (50) feet with
necessary easements for cuts, fills, and drainage.
4. That this Board finds there is no speculative
interest involved in this project.

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That Resolution No. 85-l57.A adopted by the Board
of Supervisors on September 24, 1985 be, and hereby is,
rescinded; and
2. That the Virginia Department of Highways and
Transportation is hereby requested to add a section of road
beginning 0.02 miles southwest of Route #878, extending southwest
0.05 miles on Valley Avenue to Washington Road, continuing on

Washington Road 0.12 miles southeast to Summit Avenue, and a
l6-foot long turn around in the right-of-way of Summit Avenue, to
the Secondary System of Roanoke County pursuant to Section
33.1-229 of the Code of Virginia, 1950, as amended; and
3. That this Board does guarantee the Commonwealth of
Virginia an unrestricted right-of-way of fifty (50) feet with
necessary easements for cuts, fills and drainage; and

IN RE:
WORK SESSIONS
I
1. Fundinq Alternatives for Emerqency Medical Services
- Supervisor Brittle reported that he felt this is a necessary
service to be provided by the County. He suggested that to
immediately address the issue, that the Board consider using the
funds set aside for the internal auditor ($51,000.00) and the One
for Life funds ($12,490.00).
Supervisor Nickens inquired about the impact of the
Good Samaritan Act. County Attorney, Paul Mahoney, reported that
under §44-l46.23 of the Code of Virginia a provision is made for
immunity from liability for a variety of groups or individuals
who perform certain emergency services. Mr. Mahoney also
reported that he does not find a designation in coverage on

whether the position is paid or volunteer.
Supervisor Nickens also inquired about efforts to
recruit volunteers. Mark Light, Fire and Emergency Services,
reported that recruitment drives have been performed. The

Mr. Light reported that it takes volunteers two years to become
certified in the Life Support program.
Supervisor Nickens expressed his opposition to
government financing of this service but he is willing to look at
alternatives.
Supervisor Burton reported that she is aware of the
budget limitations but feels that the Board is limiting its
resources and expressed a desire to wait until the County
Administrator, Elmer C. Hodge, Jr., is actively working with the
County to address this matter.
Supervisor Nickens moved that the Board ask Tommy
Fuqua, Fire and Emergency Services Coordinator, and his staff to
develop a job description for the Administrative Supervisor and

paramedics and emergency medical technicians. Staff to proceed
with advertising for the position of the Administrative
Supervisor and bring a report back to the Board at the December
3, 1985, Board of Supervisors meeting. The motion carried by the

2. Report on Junk Vehicle Code - Mr. Jim Lehe,
Department of Development, presented a rough draft of the code to
the Board. Supervisor Burton inquired whether the Sheriff had
been involved in formulating this code. Mr. Lehe responded that
the Sheriff had been very involved in establishing this draft.

He also reported that most of the provisions are set by the State
Code and that the proposed ordinance presented to the Board is
almost identical to the code adopted by Fairfax County.
Supervisor Burton reported that she was concerned about
the clarity of the screening and shielding provision. She also
asked about the implications of the impoundment officer. Sheriff

Chairman McGraw introduced Mr. Danny Hylton of Glenvar
High School. He will be working with Mr. McGraw through May to
learn more about politics.

Supervisor Burton expressed a desire to extend an
invitation to neighboring localities to join in on discussions of
cooperative areas. She volunteered to serve on this committee
and suggested that it might be appropriate to assign that
responsibility to the Chairman and Vice-Chairman. Chairman
McGraw recommended a committee of eight, two persons from each
locality. The Board directed staff to send letters to localities
requesting their desire to meet and what areas of cooperation
they would like to discuss.

REPORTS OF CONSTITUTIONAL OFFICERS
Sheriff o. S. Foster was present to report to the Board

that he needs additional staff to cover the heavy traffic hours
on North Lakes Drive and Peters Creek Road. The hours of
heaviest traffic are from 7:30 a.m. to 7:50 am. Sheriff Foster
suggested that the same crossing guard at Northside High School
could work the intersection at Peters Creek Road and North Lakes

SINCLAIR BURKS FOR HIS TWELVE YEARS OF
SERVICE IN THE DIVISION OF CONSTRUCTION
BUILDING SERVICES
WHEREAS, Sinclair Burks was first employed in October
of 1973 as an electrical inspector in the Division of
Construction Building Services; and
WHEREAS, he later held the position of Chief Electrical
Inspector in Roanoke County; and
WHEREAS, during his tenure with the County he was also
awarded two letters of commendation from the Superintendent of

the Department of Development in recognition of his outstanding
contributions; and
WHEREAS, he earned the Employee of the Month Award in
the Department of Development in October of 1985; and
WHEREAS, he and his division received the Meritorious
Service Award in 1983.
NOW, THEREFORE, BE IT RESOLVED that the Board of
Supervisors and the citizens of Roanoke County express to
Sinclair their deepest appreciation for his twelve years of

Chairman McGraw stressed to the media and the public

the discussion of the airport, it was not the Board's intent to
build an airport in Bedford County.

Mr. Joe Sgori, 4362 Cresthill Drive, SW, Roanoke,
Virginia, reported on the safety hazard conditions on Cresthill
Drive. Mr. Sgori requested that the Board place a 3-way stop

sign at Cresthill Drive, Steele Road, and North Cross Road. Mr.
Sgori also reported that he has sent a request to the Virginia
Department of Highways and Transportation but Mr. Altizer
responded negatively to his request.
Supervisor Burton reported that she has already
suggested to Mr. Sgori that he send a copy of this letter and
response to Delegate Agee. Delegate Agee's response to
Supervisor Burton stated that the precedence does exist.
Supervisor Burton also reported that Sheriff Foster has scheduled
additional radar to be placed on that road.
Supervisor Minter requested that if a resolution is
adopted, it include a request for an explanation on why federal
regulations were stated to Mr. Sgori instead of state.
Supervisor Nickens inquired about the procedure to
close the road to through traffic. Supervisor Nickens also
suggested that a temporary solution of requesting the 3-way stop
sign with a potential of closing the road.
Supervisor Burton moved to spread a resolution urging
the Virginia Department of Highways and Transportation to erect a
3-way stop sign at the intersection of Cresthill Drive, Steele
Road, and North Cross Road. The resolution to state that federal
highway regulations do not regulate these roads. If the stop
sign approach fails, that the Highway Department look into
other alternatives including the closing of the road to through
traffic.

Transportation consider and suggest any other acceptable

resolution be spread in an amount not to exceed $10,000.00 from
the unappropriated balance and that funds be used for the items
addressed to Mr. Mahoney, Acting County Administrator and County

Hazardous Waste Siting Report. He reported that the response
time has been extended from October 25, 1985, to November 5, 1985

Hazardous Waste Siting Committee's proposed regulations with the

amendments suggested by the Fifth Planning District Commission
with an addition to require legal notice and posting at the site
that there is hazardous waste and that the proper official
offices be notified.

REGULATIONS OF THE HAZARDOUS WASTE
FACILITY SITING LAND
WHEREAS, the public review and comment period
pertaining to the regulations of the Hazardous Waste Facility
Siting Council expires November 4, 1985; and
WHEREAS, following the close of the comment period, the
Council will consider comments received by the public before
holding a meeting, scheduled for November 20, 1985, to approve

NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of Roanoke County, Virginia, as follows:
1. That the Hazardous Waste Facility Siting Council's
proposed regulations are acceptable with the following additions:
a. It is suggested that the Siting Council include
"proximity to a public drinking water supply" and "proximity to a
principal drinking water source aquifer" (as defined in Section
1.4 of the proposed regulations) in the list of Prohibited sites
and delete these areas from the Limited Site list.
b. It is suggested that the Siting Council study
the design and safety aspects of spill containment requirements
for each proposed project and set standards based on each
project's characteristics (e.g., proximity to development, site
quality, or type of waste stored). Regulations should be written
so that the Siting Council has the authority to require adequate
spill containment in situations where other existing regulations
I
would not be sufficient to protect public health and safety.
2. It is suggested that Siting Council require the
posting of the property before and during hazardous waste storage.
I
In addition, legal notices should be mailed to all adjoining
property owners and all appropriate local, state and federal
offices before any disposal occurs.

Service Center Master Plan. After presentation of maps and an

Administrative Analyst, to send a letter of appreciation to Mr.
Gentsch.

DISTRIBUTION OF ONE-FOR-LIFE FUNDS

prepared resolution.
WHEREAS, the General Assembly of the Commonwealth of
Virginia has imposed a fee of one dollar as part of the annual
registration fee for motor vehicles; and
WHEREAS, the funds derived from this fee shall be used
for emergency medical services purposes; and
WHEREAS, twenty-five percent of the funds so collected
shall be returned to the localities to provide funding for
training of volunteer or salaried emergency medical service
personnel of licensed, non-profit emergency medical services
agencies and for the purchase of necessary equipment and supplies
for use in such locality for licensed, non-profit emergency

medical and rescue services; and
WHEREAS, Roanoke County has received the sum of
$12,490.50 for these purposes.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of Roanoke County, as follows:

1. That these funds shall be distributed equally to
and among the eight rescue squads in Roanoke County, Virginia.

2. That these funds shall be expended by said rescue
squads only for the purposes set forth in the state Code.
Further, the rescue squads agree to provide such documentation as
may be deemed necessary by the Superintendent of Fiscal
Management to assure audit compliance with said State Code
provisions.
3. That the Rescue Squad Captains' Board and each
Rescue Squad Captain concurs in this matter.
On motion of Supervisor Nickens and the following recorded vote:
AYES: Supervisors Nickens, Minter, Brittle, Burton, and McGraw
NAYS: None
Mr. Mahoney also requested an Executive Session to
discuss real estate, personnel, and legal matters.
