The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the fourth Tuesday, and the
third regularly scheduled meeting of the month of November, 1985.

Mr. Elmer C. Hodge, County Administrator, introduced Mr.
Timothy Gubala, Superintendent of the Department of Development,
who introduced Ms. Sue Palmer, Community Development Coordinator.
He reported that Ms. Palmer has been employed by the County to
work on the Hollins Community Development project.

has committed $10,000 to assist in the production of a project
for the development of Happy Hollow Gardens; and

NEW BUSINESS
1. Department of Development - Request for Emergency
Mobile Home Permit - Mr. Rob Stalzer, Director of Planning,
presented a report to the Board of Supervisors concerning
the placement of federally owned mobile homes for temporary
emergency housing. He reported that these mobile homes would be
provided for those persons that cannot find alternate permanent
or temporary rental or owner-occupied housing if their homes
had been destroyed in the flood. These mobile homes will be
I
provided by the Federal Emergency Management Agency (FEMA) as
emergency quarters. They will be located in the following order
of preference:
1. Pads will be leased in existing commercial mobile
home parks.
2. Mobile homes will be placed on private individual
lots for persons who lost homes, but only in areas that are not
within the 100-year flood plain.
3. A group facility will be developed on
publicly-owned land that is served by utilities and adequate
transportation.
Each mobile home will be provided at no cost to the

occupant for up to one year. If adequate housing has not been
found within twelve months, the State of Virginia may offer the
unit at a fair market rent for an additional six months. If the
occupant cannot prove that a good faith effort is being made to
secure permanent housing, the mobile home will be removed by the

appropriate agency. The Federal Emergency Management Agency will
allow the mobile homes to be purchased by the occupant at the end

of the twelve-month period. Approximately 15 percent of the
units are purchased. FEMA will not consummate the sale until all
local zoning and building codes have been complied with.
To expedite the placement process, FEMA has requested
that the Zoning Administrator and Building Official waive certain
zoning and building requirements: special exception process;
zoning district requirements; setback requirements; contractor
licensing and bonding; building permit requirements and fees;
inspection requirements; power connection procedures; tap fees
for sewer, water, and natural gas.
Mr. Stalzer also reported that the Division of
Planning, Zoning, and Grants staff will propose a future
amendment to the mobile home provision of the zoning ordinance
I
which will define the emergency use of these types of dwellings.
Mr. Stalzer reported that FEMA estimates the placement
of 50 mobile homes in the County. Mr. Stalzer has requested that
the representatives of FEMA contact the Zoning Administrator and
the Building Official 24 hours before placement of a mobile home.
The Board requested that an additional paragraph be
added to the proposed ordinance stating that these mobile homes
shall be placed within the County for a maximum period of 20
months from the date of the ordinance unless that placement is in
compliance with the existing County ordinance in effect at that
time.
Supervisor Brittle moved to approve the emergency

ordinance with the requested amendment.
AN EMERGENCY ORDINANCE 85-220
AUTHORIZING THE WAIVER OF CERTAIN
COUNTY REQUIREMENTS FOR THE PLACEMENT
OF MOBILE HOMES
WHEREAS, many homes in Roanoke County were damaged or
destroyed by the November 4, 1985 flood; and

WHEREAS, many of the residents of those homes are
unable to locate alternate or substitute housing; and
WHEREAS, the Federal Emergency Management Agency can
I
provide mobile homes as emergency shelter for said persons but
that certain local rules, regulations and ordinances must be
waived in order to provide such shelter for these persons.
BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Superintendent of Development is hereby
authorized to waive those zoning and buildings requirements
imposed by existing County ordinances in order to expedite the
placement of mobile homes within Roanoke County for the purpose
of providing emergency temporary shelter for those residents
whose permanent dwellings were damaged or destroyed by the
November 4, 1985 flood.
2. That this waiver includes certain zoning and

building requirements, specifically: special exception process,
zoning district requirements, setback requirements, contractor
licensing and bonding, building permit requirements and fees,
inspection requirements, power connection procedures, tap fees
for sewer, water and natural gas.
3. That the placement of any mobile homes under the
provisions of this ordinance shall be allowed only for a maximum
period of time not to exceed twenty (20) months, unless such
placement complies with the provisions of all County ordinances
in effect at that time; and
4. That in order to immediately provide for the
property, an emergency is declared to exist and this ordinance
I
welfare and safety of the citizens of Roanoke County and their
shall take effect from and after the date of its adoption, and
that the authority to waive said requirements shall be effective
for only sixty (60) days from the date of adoption.

2. Department of Fiscal Management - Report on Water
and Sewer Rate Proposals - Mr. John Chambliss, Superintendent of
the Department of Fiscal Management, reported on the water and
sewer rate proposals. A copy of his report is included in the
packet of the Deputy Clerk. The staff recommended that the Board
direct staff to settle the 1984-1985 audited results from
accumulated monies and to proceed with the public hearing
scheduled for December 10, 1985, to provide adequate rates to
fund the anticipated 1985-1986 costs instead of the original
estimate by the City of Roanoke.
Supervisor Nickens moved that the staff execute a
settlement and advertise for a public hearing on December 10,

3. Department of Public Facilities - Flood Damage
Reduction Studies by the Army Corps of Engineers - John Hubbard,
Superintendent of the Department of Public Facilities, reported
that under the authority of the 1948 Flood Control Act, Section
205, as amended, the Army Corps of Engineers may conduct flood
damage reduction projects upon request. These projects are
performed in three phases: a reconnaissance study, a detailed
study, and construction. The reconnaissance study is performed

at no cost to the locality. The detailed study must be funded
with 50 percent local funds or in-kind services. The
construction will be shared on a 25 percent local basis. Mr.
Hubbard and his staff recommended that studies be requested for
the following streams and in the following priority:

RESOLUTION NO. 85-222 AUTHORIZING FLOOD
DAMAGE REDUCTION STUDIES BY THE U. S. ARMY
CORPS OF ENGINEERS
WHEREAS, the County of Roanoke, Virginia, has suffered
severe damages from past and recent floods along several Roanoke
River tributaries; and
WHEREAS, the Roanoke County Board of Supervisors remains
very concerned with past, and the possibility of future, flood
damages along these areas.
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County Board

of Supervisors does hereby authorize the County Administrator to
request the U. S. Army Corps of Engineers to initiate and
complete the necessary Flood Damage Reduction Studies authorized
under Section 205 of the 1948 Flood Control Act, as amended,
and/or the Roanoke River Basin Authority on the following Roanoke
River tributaries as prioritized:
1. Tinker Creek
2. Mason Creek
3. Peters Creek
4. Mud Lick Creek
5. Back Creek

Sheriff o. S. Foster and his department for their receipt of the

Award for Excellence. Sheriff Foster was present to accept the
resolution.

RESOLUTION 85-223 RECOGNIZING SHERIFF O.
S. FOSTER AND HIS DEPARTMENT IN THE
WINNING OF AN AWARD FOR EXCELLENCE
WHEREAS, on November 20, 1985, Sheriff o. S. Foster was
presented with an "Award for Excellence" by the Pedestrian
Protection Program; and
WHEREAS, this will mark the second time that the
Roanoke County Sheriff's Department has been presented with this
award; and

WHEREAS, this award was won in competition with 184
other cities and counties of similar population; and
WHEREAS, the award recognizes that during 1985 there
were no pedestrian deaths in Roanoke County; and
WHEREAS, the award further recognizes the many
pedestrian safety education programs initiated by the Sheriff's
Department as well as the vigorous enforcement of pedestrian
safety laws.
NOW, THEREFORE, BE IT RESOLVED that the Board of
Supervisors of Roanoke County recognizes Sheriff o. S. Foster and
his department in the winning of an Award for Excellence from the
Pedestrian Protection Program and in the continued high levels of
safety and law enforcement provided in all areas for the citizens

of Roanoke County.

RESOLUTION 85-224 OF APPRECIATION FOR LT.
M. G. WINSTON OF THE ROANOKE COUNTY
SHERIFF'S DEPARTMENT
WHEREAS, M. G. Winston first organized the Roanoke
County Sheriff's Department Special Weapons and Tactics Team in
1974; and
WHEREAS, through Lt. Winston's leadership as commander
of the SWAT team this group has progressed to a point of
recognized excellence; and
WHEREAS, the training provided by Lt. Winston has been
I
directly responsible for the minimal number of injuries sustained
by those pursued or ultimately arrested by the SWAT team; and
WHEREAS, Lt. Winston has recently resigned his position
of commander of the SWAT team and will continue to serve Roanoke
County in the Detective Division.
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County
Board of Supervisors recognizes the fifteen total years of
service rendered to Roanoke County by M. G. Winston, his
outstanding organization, leadership and dedication to the
Sheriff's Department SWAT team during the past eleven years and
looks forward to the continued high level of professionalism,
skill and commitment as he continues his work in the Detective

Chairman McGraw presented a resolution of appreciation
to Mr. Lee B. Eddy for his service to Roanoke County. Mr. Eddy
was not present and had earlier requested the Deputy Clerk to
mail this resolution to him.
Supervisor Burton moved to approve the prepared
resolution.
RESOLUTION 85-225 OF APPRECIATION TO MR. LEE EDDY
WHEREAS, Lee Eddy was first appointed to the Fifth
Planning District Commission in August of 1982 and has served as
the Chairman from October, 1983, until October, 1985; and
WHEREAS, during his tenure on the Fifth Planning
District Commission, he did establish a finance committee to
review the budget and financial expenditures of the Fifth
Planning District Commission; and
WHEREAS, he has also served in the following
capacities: Chairman of the Metropolitan Planning Organization,
vice-Chairman of the Virginia Assooiation of Planning District
Commissions, member of the Advisory Commission for the National
Association of Regional Councils, delegate to the National
Association of Regional Councils Annual Meeting, and member of
the Western Virginia Development Company.
NOW, THEREFORE, BE IT RESOLVED that the Board of
Supervisors of Roanoke County does recognize Lee Eddy for his
outstanding contribution to the quality of life in Roanoke
County.
AND FURTHER expresses its thanks for his dedication and
conscientious service to the citizens of Roanoke County, the
Fifth Planning District Commission and all of Western Virginia.

Chairman McGraw presented a proclamation recognizing
the 44th anniversary of the attack on Pearl Harbor to Mr. Harry
Guilliams.

I
WHEREAS, December 7, 1985 will mark the 44th anniversary of
the attack on Pearl Harbor, Territory of Hawaii; and
WHEREAS, this anniversary is a reminder of the vigilance and
preparedness which our nation must maintain; and
WHEREAS, we owe a great debt to those members of the Armed
Forces who lost their lives in that attack, and also to those who
survived and aided in carrying out their duties to the ultimate
victory.
THEREFORE, BE IT RESOLVED that the Roanoke County Board of
Supervisors, hereby proclaims the 7th day of December, 1985, as
PEARL HARBOR REMEMBRANCE DAY

December 1985 as Christmas Seal Month to Cheryl Ann Robinson,
Christmas Seal Ambassador, Mr. and Mrs. Beardon, Public
Information Chairpersons and Ms. Emma Jean McDermott, Regional
Director of the American Lung Association.

WHEREAS, the American Lung Association of virginia, Roanoke
Region, is an organization that promotes lung health; and
WHEREAS, the activities of this association include many
programs and services which include Freedom From Smoking Clinics,
problems, and the Family Asthma Programs; and

adult and child lung disease problems, second-hand smoke health
WHEREAS, additional services are made possible by support
groups for patients suffering with chronic obstructive pulmonary
disease and persons who have quit smoking, patient assistance,
and school health education programs; and

WHEREAS, funds also support research at the state and
national levels for the purpose of preventing and controlling

lung disease.
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County Board
of Supervisors, in cooperation with the American Lung Association
of Virginia, hereby proclaims December, 1985, as
CHRISTMAS SEAL MONTH.
IN RE:
CITIZENS COMMENTS AND COMMUNICATIONS
1. Progress Report by the Mental Health Services of
the Roanoke Valley - Mr. Fred Roesell, Executive Director, and
Mr. Tom Chapman, Director of Administration, presented a report
to the Board of Supervisors to advise them of the activities of
the Mental Health Services.

2. Request from Roanoke Valley Cablevision, Inc., for
Approval of Transfer of the Franchise Rights, Ownership, and
Operating Control of the Cable Television System - Mr. Bob Glenn,
attorney for Roanoke Valley Cablevision, was present to answer
any questions the Board might have. Mr. Glenn had earlier
submitted a report to the Board of Supervisors. A copy of this
report is included in the packet of the Deputy Clerk.
Supervisor Nickens moved to refer this matter to the
Regional Cablevision Committee. The motion carried by the
following roll call vote:

REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Nickens requested an Executive Session.
Supervisor McGraw - announced that the Emergency
Services Staff is planning a barbecue on December 14, 1985, at
4:30 p.m. at the Cave Spring fire station for all volunteers and
staff members who helped during the flood. He also announced
that the employee Christmas luncheon would be December 12, 1985,
Holiday Inn Airport from 11:00 a.m. to 2:00 p.m.
