The Board of Supervisors of Roanoke County, Virginia,
met this day in open session at the Roanoke County Administration
Center, Roanoke, Virginia, this being the second Tuesday, and the
first regular meeting of the month of January, 1984.

CALL TO ORDER
Chairman, Harry C. Nickens, called the meeting to order
at 3:04 p.m. The roll call was taken.

Supervisor McGraw moved to go into Executive Session
pursuant to the Code of Virginia, Section 2.1-344 (a) (1), (2),
and (6) to discuss personnel, real estate, and legal matters, and
the motion carried by a unanimous voice vote.

Supervisor Burton moved to go into Open Session at 4:12
p.m. and the motion carried by a unanimous voice vote.

IN RE:
WORK SESSION
Superintendent of Fiscal Management, John Chambliss,
presented a backgrounding session on the Reassessment Program
in Roanoke County. Mr. Chambliss covered the history of the
reassessment program; the table of organization of the assessment
office; the status of the 1985 reassessment program; and the
results of the 1983 reassessment program.

At 5:27 p.m. Supervisor Brittle moved to go into

The invocation was offered by Reverend Jay E. Luther,
of Locust Grove united Methodist Church. The Pledge of Allegiance
was recited by all present.

ELECTION OF VICE CHAIRMAN FOR 1984
Supervisor Minter nominated Supervisor Athena E. Burton
to serve as Vice Chairman of the Board of Supervisors for 1984.
Hearing no further nominations, Supervisor Brittle moved to close
the nominations. The motion carried by a unanimous voice vote.
Supervisor Athena E. Burton was elected by the following roll
call vote.

CONSENT AGENDA
Supervisor Brittle requested that Item 121 be
deleted from the Consent Agenda for clarification. Supervisor
Burton requested that Items 4, 10, 12, 16, 18, and 21 be
deleted from the Consent Agenda. Supervisor Minter moved the
following prepared resolution with the exception of the deleted
items.

Consent Agenda be, and hereby is, approved and concurred in as to
each item separately set forth in said section designated as
Items 1 through 23, inclusive, as follows:
l. Approval of Minutes - November 22, 1983.
2. Copy of December 7, 1983, letter mailed by the

who requested installation of a fire hydrant at

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That that certain bid of Virginia Police Equipment
Co. in the amount of $5,300.00, being the best bid submitted for
the purchase of twenty-five (25) protector shields to be
installed between the front and rear seats of police vehicles,·
upon all and singular the terms and conditions of the invitation
to bid, the specifications of the County of Roanoke, the bidder's

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the offer of Builders Investment Group, Inc.
to donate the water and sewer lines installed with the
development of Ruxton, Phase II, Section 3 to the Board of
Supervisors of Roanoke County be, and hereby is, ACCEPTED; and
2. That upon receipt of a duly executed deed upon a
form approved by the County Attorney from the developers, the
County Administrator is hereby authorized to authenticate the
acceptance thereof as made and provided by Section 15.1-286 of
the 1950 Code of Virginia, as amended.

Supervisor Burton then requested clarification of
Item 4 - League of Women Voters of the Roanoke area request
for $250 to print copies of "Facts for Voters". After discussion
Supervisor Burton moved that the request for funding be
acknowledged and held over for future budget deliberations, and
the motion carried by a unanimous voice vote.
Supervisor Burton expressed her question on Item 10
- Revenue Sharing Payments. She asked how much Roanoke County
expected to receive and if the money had been earmarked. The
County Administrator stated the County expected to receive
approximately $600,000 and that the money had not been designated
for any particular purpose.
Supervisor Burton questioned Item 12 - Financial
statements for period ending November 30, 1983 - concerning the
employee's health insurance premiums paid to the Administrator of
the Health Fund to cover claims which were current.

Supervisor Burton questioned Item 16 - Bid Report:
repairs to Clearbrook fire truck - could the County blacklist
suppliers of defective equipment. The County Administrator
stated that previous experience with certain suppliers would be
considered on future bids.

Supervisor Burton wanted to know which project was
being referred to on Item 18 - Virginia Water Projects _
The Superintendent of Public Facilities stated it was the
Clearbrook Project.
Supervisor Brittle questioned Item 21 - Roanoke
Valley Council on Community Services - what the action of the
Board would mean regarding the contract referenced in the letter
from the Roanoke Valley Council on Community Services. It was
clarified that the Board would be only receiving and filing the
communication.
Supervisor Burton moved to receive and file Items '4,
#10, '12, '18, '21 and the motion carried by a unanimous voice
vote.
Supervisor Burton moved to adopted the following
prepared resolution for Item 16:

Products, Inc. in the amount of $23,743.00, being the best bid
submitted to make structural improvements, repairs, and repaint
the 1977 model Hahn Tanker used by the Clearbrook Fire
Department, upon all and singular the terms and conditions of the
invitation to bid, the specifications of the County of Roanoke,
the bidder's proposals, and the provisions of this resolution,
be, and the same hereby is ACCEPTED; and
2. That the County Administrator is hereby authorized
and directed to enter into a contract upon a form approved by the
County Attorney for this service; and

PROCLAMATIONS AND RESOLUTIONS
Supervisor Minter moved to adopt the following
resolution:
RESOLUTION NO. 84-3 DECLARING THE FOURTH
WEEK OF JANUARY OF EACH ENSUING YEAR TO
BE COMMUNITY COLLEGE WEEK IN ROANOKE
COUNTY AND ENDORSING THE FOURTH WEEK OF
EACH ENSUING JANAURY AS COMMUNITY
COLLEGE WEEK WITHIN THE COMMONWEALTH
BE IT RESOLVED by the Board of Superviosrs of Roanoke
County, Virginia, as follows:
1. That Virginia's Community College System has for
years served the educational needs of the citizens of this state;
and
2. That the twenty-three community colleges in the
system make available a wide range of programs and services to
every citizen in Virginia at minimal cost; and
3. That in 1966 the Virginia State Legislature created
the department of and State Board for the establishment and

maintenance of a state-wide system of comprehensive community
colleges; and
4. That these institutions have provided hundreds and
thousands of Virginians with skills needed for good jobs, college
transfer courses, counseling services and a variety of cultural
services, serving more than 250,000 citizens each year; and
5. That the Community College System is entering into
an exciting new era, with a new chancellor, greater challenges,
and a new sense of mission; and
6. That it is appropriate that the people of Virginia
recognize the contributions of their community college, support
these institutions, and promote public awareness of the services
available to our citizens; and
7. That Virginia Western Community College has served
the region since 1966, providing accessible, low cost,
postsecondary educatioinal opportunities to citizens of Roanoke
County.

NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of Roanoke County, as follows:
1. That in order to promote and maintain that ideal
first put forth by Mr. Jefferson, who thought to better educate
the people and enable them to protect their newly gained rights
by creating institutions of higher learning within a day's
horseback ride; and
2. That the Board does hereby declare the fourth week
in Janaury of each year to be "Community College Week" in Roanoke
County; and
3. That the Board does hereby endorse the fourth week
of January of each ensuing year to be "Community College Week" in
the Commonwealth; and
4. That the County Administrator forthwith forward an
attested copy of this resolution for presentation to the
President of Virginia Western Community College.

APPRECIATION OF THE BOARD OF
SUPERVISORS OF ROANOKE COUNTY TO MAY
W. JOHNSON FOR HER SERVICE AS A MEMBER
OF THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY
WHEREAS, May W. Johnson was first elected to the Board
of Supervisors of Roanoke County from the Cave Spring Magisterial
District in 1974, and was successively reelected to the Board in
1975, 1977, and 1979; and
WHEREAS, Mrs. Johnson served the County of Roanoke
tirelessly and selflessly for a period of nine years devoting
many hours to the business of Roanoke County both as a member of
the Roanoke County Public Service Authority, prior to its
disso1utioin, and as a member, Vice Chairman, and, for three
.
terms, as Chairman of the Roanoke County Board of Supervisors, in
all of which capacities Mrs. Johnson served capably, bringing
distinction to both herself and the County.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of Roanoke County that the Board does express, on
behalf of itself and the citizens of Roanoke County, its most
genuine and heartfelt appreciation to May W. Johnson for her
service to Roanoke County and its citizens over the past nine
years, and does wish Mrs. Johnson continued success in all her
future endeavors, and further expresses the hope that she will
continue her interest in the affairs of Roanoke County.

RESOLUTION NO. 84-5 EXPRESSING THE
APPRECIATION OF THE ROANOKE COUNTY
BOARD OF SUPERIVISORS TO ROBERT E.
MYERS FOR HIS SERVICE AS A MEMBER OF
THE ROANOKE COUNTY BOARD OF
SUPERVISORS

WHEREAS, Robert E. Myers was first elected to the Board
of Supervisors of Roanoke County from the Catawba Magisterial
District in 1975 and was successively reelected to the Board in
1977 and 1979; and
WHEREAS, during the eight years Mr. Myers served on the
Board of Superviosrs of Roanoke County, he served two terms as
Chairman of the Board, and did at all times serve with
distinction, exhibiting significant ability to understand and
deal with matters affecting Roanoke County in a way which he
deemed to be in the best interest of all the citizens of Roanoke
County.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of Roanoke County that it does extend its most
sincere appreciation on behalf of both itself and the citizens of
Roanoke County to Mr. Myers for his eight years service on the
Board of Superivsors of Roanoke County, and does further wish for
Mr. Myers continued success in future and expresses the hope that
he will maintain his interest in the activities and well-being of
Roanoke County.

Proclamation to representatives of the Cave Spring Chapter of the
Jaycees represented at the meeting by John Hyatt, John Sledd,
Gary Minter, and Jim Clem.

PRO C LAM A T ION
I
WHEREAS, the Cave Spring Chapter of the Jaycees, an
affiliate of the National Jaycees, was chartered in Roanoke
County in 1963; and
WHEREAS, the Cave Spring Chapter of the Jaycees, in
conjunction with the National Jaycees, has, since its formation,
served as a community development organization and has engaged in
an extensive leadership development program to refine and promote
the business skills of young men for use in a practical manner in
Roanoke County; and
WHEREAS, it has been determined that the week of
Janaury 10 through 15 should be set aside as National Jaycee Week.
NOW, THEREFORE, I, Harry C. Nickens, Chairman of
the Board of Supervisors of Roanoke County, do hereby proclaim
the week of January 10 through 15 as
National Jaycee Week In Roanoke County
the Cave Spring Chapter of the Jaycees and the National Jaycees
for their many endeavors for the benefit of the citizens of
Roanoke County.
John Hyatt, on behalf of the Cave Spring Jaycees,
thanked the members of the Board of Supervisors for this
recognition and support.
IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS

Supervisor Burton moved to establish a Medal of
Valor to recognize those citizen volunteers in the County and
County staff members who have given outstanding service to their
fellow man and that the medals be presented at a public meeting
in recognition of the particular service rendered. The motion
carried on unanimous voice vote.
Supervisor Burton further nominated Sammy Robinson of
Roanoke County Fire Department #5 and David Lindsey of Roanoke
County Rescue Squad #5, who were involved in the rescue of two
people at a boating incident at Carvins Cove, to be the first
recipients of the Medal of Valor.

Mrs. Burton entered a request for the Muscular
Dystrophy Association for a raffle permit. She moved to grant
the raffle permit and waive the fee for such permit, and the
Mrs. Burton asked the staff to investigate dumping
of trash on 12 O'c10ck Knob Road.

Mrs. Burton asked the Superintendent of Fiscal
Management, John Chambliss, if it would possible to add the
previous fiscal year's percentages at the same particular date in
order to make comparisons. Mr. Chambliss stated he would
evaluate the request and report back to the Board.
Supervisor Minter - wished to bring to the attention
of the staff the U. S. Supreme Court requirement that all legal
documents be prepared on 8 1/2 x 11 inch paper so the staff could
begin preparing for this change.
Mr. Minter expressed his interest in creaating a County
position of County Internal Auditor for Roanoke County.
Supervisor McGraw - moved that appointments to
committees where the expiration date is December 31 be made in
the new year by the newly elected Board member. County Attorney
James Buchholtz reminded the Board that this matter had already
been referred to the Administration for a report. Supervisor
Minter wished to second Supervisor McGraw's motion. Supervisor
McGraw withdrew his motion until after the staff report becomes
available.

Mr. McGraw requested a study to determine the ongoing
need for parks and recreation facilities in the Catawba
Magisterial District. Supervisor Burton noted that the Board
previously recognized the inequities throughout the County
regarding certain facilities and directed the staff to develop
formulas for distribution of various facilities throughout the
County.

Supervisor McGraw moved that a copy of the Roanoke
County Code with amendments be placed in all County libraries,
and the motion carried by a unanimous voice vote. The County

Administrator was instructed to investigate the cost involved in
placing a copy in each library.
Supervisor McGraw submitted a request from the County

Planner, Rob Stalzer, concerning the possibility of expanding
the membership of the Planning Commission. Mr. McGraw moved
that a committee be established composed of two Supervisors and
the necessary staff members to investigate the possibility. The
County Attorney stated that the Code of Virginia did not restrict
the Planning Commission to a five-member membership and allows
for from five to fifteen members. The motion carried by a
unanimous voice vote. Chairman Nickens asked Supervisors Burton
and McGraw to serve on the committee with the appropriate staff.

Sheriff's Department as one of the six recipients in the State of
the Virginia Pedestrian Safety Award presented by the American
Automobile Association.

from Appalachian Power Company regarding County street lights.
Mr. Hubbard stated that Appalachian Power Company will report to
the County by January 31, 1984.
Supervisor Nickens read a letter from Mr. Ed Gentsch to
Mrs. May W. Johnson regarding water and sewer rates. Dr. Nickens

Chairman Nickens asked the other members of the RCEA who were

presented the 1982-1983 Annual Report for Total Action Against
Poverty for the Board's information. Mrs. Desper thanked this

Mrs. Betty Desper then spoke as a citizen of the
Catawba Magisterial District. She stated she was pleased to hear
Supervisor McGraw show concern for the Catawba Magisterial
District regarding inadequate park facilities and Mrs. Desper

needs and demands of the citizens of Roanoke county for

Department of Public Facilities - Superintendent,
John Hubbard, presented an oral report regarding flooding on
Bradshaw Road. Mr. Hubbard stated the matter had been
discussed with the Virginia Department of Highways and
Transportation and the Highway Department is looking into gettin
some money from a special maintenance fund not a part of the
County's secondary funds to replace the existing inadequate
culverts with a single span bridge. A further report will be
made when information is received from the Highway Department.
Mr. Hubbard then submitted a report on a dumping
problem at Mount Pleasant Boulevard and Route 116. This
problem has been discussed with the Department of Highways and
"No Dumping" signs have been placed at the site. The Highway
Department will be monitoring that site and seeding in the sprin .
Mr. Hubbard reported on the JLARC Study on

Maintenance and Construction Funds. He stated he had received
a draft of the final report of this study and felt the County
could support the findings of the study. Mr. Hubbard stated that
at a recent briefing JLARC indicated the needs and
recommendations of Roanoke County would not be addressed and that
the General Assembly probably would not take any action on this
report. He recommended a letter be sent to our area legislators
and also to local governments, regarding the JLARC
recommendations, particularly the allocation formula, to try to
bring about some type of action. Supervisor Burton moved to
concur with the staff recommendation of communicating with our
local legislators as well as other local governments, and the
motion carried by unanimous voice vote.
Mr. Hubbard's next report dealt with a change order to
the Roanoke River Interceptor to provide for relocation of
the proposed line to alleviate a problem of obtaining an easement
across the property of Salem Concrete Products. Supervisor
Burton moved the prepared resolution:

Revised Airport Noise Study. He stated the Airport Advisory
Commission recommended that Roanoke City apply for FAA and DOA
grants to initiate a soundproofing program. The study basically
indicated there were no noise problems in Roanoke County. He
stated, however, a new study might indicate a need for
soundproofing or the purchase of properties in Roanoke County.
Chairman Nickens expressed his disappointment that the study die
not reflect the problem of the Roanoke County citizens in that
area.
Department of Fiscal Management - Superintendent,

stated that the Sheriff's Department and the Commonwealth's
Attorney offices are investigating complaints that Mr. Turner's
development is disturbing gravesites. Mr. Gubala further stated
that Mr. Turner had received a copy of the Soil and Erosion
Ordinance and a copy of a letter from Mr. John Hubbard regarding
violations of that ordinance. Mr. Turner's deed does not mentio
the cemetary, however, past deeds do mention a one-quarter acre
cemetary on the property although it is not located on any survel,.
The highway department is investigating alleged damages to
bridges and roads as a result of the earth moving activities.

County Administrator - presented a memorandum
relative to the activities of the cooperative committee between
VACo/VML regarding telephone rates.
Mr. Flanders stated that a letter from Montgomery
County Administrator regarding a pump station which Montgomery
County Public Service Authority wishes to locate in Roanoke
County will be continued until the January 24 meeting.
The County Administrator recommended adopted of the
appropriation resolution needed to complete the Salem-Roanoke
County Civic Center close out.

the feasibility of establishing a Virginia Horse Center is in th~
process of selecting a location for the Virginia Horse Center;

2. That the Virginia Horse Center will be a year-roun~
facility hosting state, regional, and national equestrian shows
and events and offer horse sales and auctions as a permanent
feature; and
3. That the facilities will consist of 4,500-5,000

seat indoor show arena, 800-1,200 seat sales pavilion and stable
for 500 horses; and
4. That Virginia is one of the top horse producing
states in the country yet lacks adequate show and sales
facilities; and
5. That a site is available near Exit 43 (Hollins) of
Interstate Route 81 which provides unique visibility, excellent
ground transportation access for participants, and convenient ai
access for judges and spectators; and
6. That the Roanoke Valley has been host to the
largest horse show in Virginia over the past eleven years; and
7. That the eventual direct economic impact of the

Virginia Horse Center will be in excess of $10 million annually,
and its indirect economic impact is estimated at over $30 mil1icl
annually; and
8. That the Virginia Horse Center will serve as a
destination and as such enhance Valley-wide tourism income; and

Board urges organization of a Valley-wide committee including
representatives of the County and other municipal bodies and the
business community to make a study and in-depth report on the
matter.
Mr. Flanders made available to the media and public in
attendance at the meeting a schedule outlining the days the
County offices are closed and also the refuse collection schedule
for the information of the citizens.
Mr. Flanders called the attention of the Board to a
matter under Appointments regarding the Mental Health
Services of the Roanoke Valley Community Services Board. Mr.
Flanders advised the Board that due to a prior agreement with the
City of Salem, City of Roanoke, and Botetourt County, Roanoke
County would relinquish one of its seats on the Community
Services Board in order to allow Botetourt County full
representation. Therefore, only one appointee need be named to
this Community Services Board. Chairman Nickens suggested this
matter be held over to a future meeting.
Mr. Flanders recommended approval of a prepared
resolution adding positions to the staff of the County Assessor's

recipient of a $200,000 grant from the Commission on Recreation

Chairman Nickens notified the Board that, Mrs. Rebecca
Price, the representative from the vinton Magisterial District

representative on the Court Service Unit Advisory Council/Youth
and Family Services Advisory Board had resigned. Chairman
Nickens recommended Dr. J. Andrew Archer, 4039 Pebble Drive,
Roanoke, Virginia 24014 to serve as the Vinton representative
until the expiration of the two-year term which is March 22, 1984.
Supervisor Brittle moved to appoint Dr. Archer to fill the
unexpired term of Rebecca Price. The motion carried on a
unanimous voice vote.
Supervisor McGraw moved that Mrs. Paula Winstead be
appointed for a four-year term beginning January 1, 1984, to
serve on the Library Board from the Catawba Magisterial

Johnson be appointed to serve on the Roanoke County Planning
Commission from the Hollins Magisterial District for a
four-year term beginning in January, 1984. The motion carried on
a unanimous voice vote.
Supervisor McGraw requested that the Superintendent of
Fiscal Management investigate obtaining rubber magnetized signs

for their vehicles to identify them as Roanoke County vehicles
when being used on official County business.

Mr. Homer Duff of the Roanoke County School Board,
presented information about the Vehicle Service Facility.
The County Board received the Roanoke County School Board
approval of said facility and directed that a resolution be
prepared for the January 24 County Board meeting for the balance
to be taken from the1984-85 budget.
