The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the second Tuesday, and the
first regularly scheduled meeting of the month of June, 1984.
IN RE: CALL TO ORDER
Chairman Nickens called the meeting to order at 3:20
p.m. The roll call was taken.

IN RE: EXECUTIVE SESSION
Supervisor McGraw moved to go into Executive Session
pursuant to the Code of Virginia, Section 2.l-344(a) (1), (2),
(4), and (6) to discuss personnel, real estate, location of a
prospective business or industry, and legal matters. The motion
carried by a unanimous voice vote.
IN RE: OPEN SESSION
Supervisor Minter moved to go into Open Session at 5:27
p.m., and the motion carried by a unanimous voice vote.

Work Session - Report on Community Development Block
~rants Director of Planning, Rob Stalzer, explained that the
staff's recommendation for the grant would be the Hollins
t:ommunity near Carvins Cove, based on the fact that "Sewer" is
~he State's top priority, and the region's #2 priority. There is
ßlso a possibility that the State will match funds next year.

DONATION OF WATER AND SEWER LINES
INSTALLED WITH THE DEVELOPMENT OF PENN
FOREST, SECTION 17, AND AUTHORIZING THE
COUNTY ADMINISTRATOR TO DULY AUTHENTICATE
SUCH ACCEPTANCE AS MADE AND PROVIDED BY
LAW
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the offer of Region Properties, Inc. to donate
the water and sewer lines installed with the development of Penn
Forest, Section 17 to the Board of Supervisors of Roanoke County
be, and hereby is, accepted; and
2. That upon receipt of a duly executed deed upon a
form approved by the County Attorney from Region Properties, Inc.

the County Administrator is hereby authorized to authenticate the
acceptance thereof as made and provided by Section 15.1-286 of
the 1950 Code of Virginia, as amended.

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That that certain proposal of Dr. Harry J. Minarik
for a one year contract effective July 1, 1984, to provide
physician's care to prisoners confined in the Roanoke
county/Salem Jail for a fee of $660.00 per month, upon all and
singular the terms and conditions of the invitation to bid, the
specifications of the County of Roanoke, the bidder's proposals,
and the provisions of this resolution, be, and same hereby is,

2. That the County Administrator is hereby authorized
and directed to execute the necessary documents on behalf of

in the Department of Fiscal Management be, and hereby is, increas-
ed from $2,500 to $5,000 as allowed by Section l5.l-548 of the
1950 Code of Virginia, as amended; and

clearing debris in Roanoke County to cover the cost of legal
advertising of such requests; and
2. That this fee shall be in full force and effect

SUBMISSION OF 1984-85 GRANT APPLICATION
BY THE ROANOKE COUNTY/SALEM AIR POLLUTION
CONTROL OFFICE
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
l. That the Roanoke County/Salem Air Pollution Control
Office be, and hereby is, authorized to submit a 1984-85 grant
application to the State Air Pollution Control Board for funding
to subsidize program costs for air monitoring, enforcement
activities, and industry inspections; and
2. That the County Administrator is hereby authorized
and directed to execute the necessary documents for this grant
application upon a form approved by the County Attorney; and
3. That an attested copy of this resolution be
included with the grant application and forwarded to the State
Air Pollution Control Board.

IN RE: CITIZENS COMMENTS AND COMMUNICATIONS
Mr. Steve Bowling, 4928 Pleasant Hill Drive, Roanoke,
requested that signs be erected indicating the dangerous
intersection at Route 22l, Ranchcrest Pleasant Hill Drive , and
Roselawn. Chairman Nickens directed that the the County
Administrator contact the Highway Department requesting further
technical study.

IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Brittle - no report.
Supervisor Burton requested Roanoke County citizens
be given approximately three days to one week priority
registration time for the County Parks & Recreation programs,
since the League of Older Americans publication advertising these
programs is distributed to the City residents before County
residents.
Supervisor McGraw - expressed thanks to Chairman
Nickens for his response to the Salem City Manager, Bill Paxton's
comments on reverse annexation in the "Salem Times Register."
Supervisor Minter - no report.
Chairman Nickens - advised the Board that County
Representative, H. E. Bowling, to the Mental Health Services of
the Roanoke Valley is resigning, and asked the Board to consider
a replacement.

DEPARTMENT AND AUTHORIZING THE COUNTY
ADMINISTRATOR TO EXECUTE THE NECESSARY
DOCUMENTS FOR THE GRANT APPLICATIONS
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
l. That the grant applications submitted by the
Roanoke County Sheriff's Department to the Virginia Department of
Transportation Safety for the following projects be, and same are
hereby, APPROVED:
a) Project to provide funds to conduct extra patrols
by uniformed officers during the holiday periods.
b) Project to provide funds to educate Roanoke County
residents in the benefits of using vehicle occupant
restraint devices.
c) Project to provide l75 (contract) school bus
drivers with the standard eight hour Defensive
Driving Course approved and adopted by the Highway
Traffic Safety Council.
2. That the County Administrator be, and hereby is,
authorized to execute the necessary contracts for these grant
applications; and
3. That the Clerk of the Board of Supervisors is
hereby directed to forthwith mail attested copies of this
resolution to the Virginia Department of Transportation Safety.

explained that the reason this was held over was to see if an
agreement could be reached between Mr. Lucas and his neighbors
regarding maintenance of the private road. She has been

informed that the neighbors would agree to a one-year extension
if Mr. Lucas did several things to repair the road. Pursuant to
her discussion with the Bankruptcy Court regarding the
implications of action taken by the Board, federal jurisdiction
regulates any money that Mr. Lucas would spend or any attempts
which would force him to move his home.
Elizabeth Belcher, Route 2, Box 26, Salem, an adjacent
landowner, requested that the permit be denied because because no
attempt has been made to build a home during the past four years.
Supervisor Burton moved that because of Mr. Lucas' financial
difficulties the permit be renewed for one year and
that construction of a dwelling take place during that time.

Supervisor Minter made a substitute motion to extend the permit
for a period of one year, and that during this time either the
mobile home must be removed or construction of a house is to
begin. The motion carried by the following roll call vote:

Mr. Mike, Smeltzer, attorney for the petitioner,
informed the Board that the purpose of the request is to
construct an office building for retail and wholesale
businesses including an automobile parts business. Mr. Bob
Freeman and Mr. Doug Freeman were present, The Board reviewed the
architect's rendering, and an amended site plan and letter from
Alton B. Prillaman indicating that the local residents would not
appear in opposition to the proposed rezoning were filed with the
Clerk. Mr. Smeltzer also pointed out that the hole between Route
419 and the subject property would be filled in and graded by his
client. The Department of Highways & Transportation has agreed
to a deceleration lane and a commercial entrance permit.
Mr. William M. Bean, 4026 Brambleton Avenue, Roanoke,
told the Board the property owners felt they were being taken
advantage of in previous rezonings. Mr. Bean requested that a
the rezoning conditions be presented to the property owners in
writing, and County Administrator, Doanld R. Flanders, provided
him with a written copy of the proffered conditions regarding
this particular rezoning.
Supervisor Brittle moved to grant the petition with the
fourteen proffered conditions:
FINAL ORDER
NOW, THEREFORE, BE IT RESOLVED AND ORDERED that at this
meeting of the Board of Supervisors of Roanoke County, Virginia,
held on the l2th day of June, 1984, the said County zoning
Ordinance be, and the same is hereby amended so as to reclassify
the property described in said Petition and being described in
Exhibit "A" attached hereto be reclassified from Residential
District R-l to Business District B-2 in order that said property
might be more fully and reasonably used, the said property being
located in the County of Roanoke, State of Virginia, with said
zoning being subject to the following conditions:

l. If rezoned, the Property will be developed in
accordance with the Amended Site Plan, except for such
modifications as may be required by the County as a result of its
site plan review process.
2. The Property will be screened by leaving a buffer
zone of existing trees around the site from ten (10) to fifteen
(l5) feet in width. Additional landscaping will be planted and
maintained if recommended by the Roanoke County Engineer or the
Zoning Administrator.
3. Facilities for the control of storm drainage shall
be constructed on the Property if such, in the opinion of the
Roanoke County Engineer, is necessary or desirable.
4. An access for ingress to and from Route 419 and the
residential properties located adjacent to the Property will be
provided to the owners of such properties.
5. The commercial entrance to the Property from Route
419 and the Petitioner's use of the Property adjacent to Route
419 will be in accordance with the Rules and Regulations of the
Virginia Department of Highways and Transportation.
6. All grading on the Property will be conducted in
accordance with an Erosion and Sediment Control Plan approved by
the Roanoke County Engineer.
7. The Petitioner agrees to convey a l5-foot wide
easement to those property owners using the presently existing
right-of-way across the subject property. This easement will be
parallel and adjacent to the existing gravel road and will be as
shown on the Amended Site Plan filed herewith.

8. The aforesaid l5-foot wide easement, together with
the existing road of approximately lO feet, will give a total
right-of-way of approximately 25 feet.
9. The Petitioner will be responsible for paving the
road to a width of l8 feet, 9 feet of which will be on either
side of the property line.
lO. Paving of the road will consist of prime and double
seal with a 6-inch base.
ll. The Petitioner and adjoining property owners will
have joint use of the road.
l2. The Petitioner and adjoining property owners will
jointly share the maintenance of the road. The Petitioner's
obligation to maintain the road shall be limited to the adjoining
property owners continued residential use of their respective
properties.
l3. The road to the Wright heirs property will be built
in accordance with the Amended Site Plan and will be constructed
as shown thereon. The new road will commence from the end of the
paving at the upper parking lot and will continue to and join the
existing road. The Petitioner agrees to do what is necessary to
alleviate any drainage problems with regard to the road. This
road will be a gravel base. The petitioner agrees to maintain
said road, but said maintenance shall not include snow or ice
removal over the gravel portion thereof. Furthermore, the
Petitioner's obligation to maintain the road shall be limited to
the Wright heirs continued residential use of their property.
l4. The Petitioner agrees to allow the adjoining
property owners to continue to use their presentiçht-of-way
across the subject property. The entrance to said right-of-way
and the right-of-way as they presently exist will be relocated so
as to accommodate the construction of the Petitioner's new
building on the subject property. The new entrance will be
relocated at a point agreeable and convenient to the Petitioner,
the American Oil Company, and the owners of those properties
using said right-of-way.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk of
this Board shall forthwith certify a copy of this resolution and
order to the Secretary of the Planning Commission of Roanoke
County, Virginia, and a copy to Hazelgrove, Dickinson, Rea,
Smeltzer & Brown, attorneys for the petitioner.

Superintendent of the Department of Development,
Timothy W. Gubala, requested that this be held over until the
second meeting in July in order to give his staff time to review
the ordinance. Supervisor Minter moved that the public hearing

PUBLIC HEARING TO AMEND THE METHOD OF
CALCULATION OF WATER AND SEWER CONNECTION
CAPACITY AND INSPECTION CHARGES.
RESOLUTION TO BOARD JUNE 26, MEETING
Superintendent of the Department of Public Facilities,
John Hubbard, explained there was a proposed amendment to the
County Code regarding capacity and inspection fees for water anë
sewer. The proposed revision will provide a more fair and

equitable means of calculating fees. There were no public

comments on the revised schedule which is based on meter size,
and the final resolution will be brought back to the Board at the
June 26, 1984 meeting, in order to give the Board ample time to
receive public comment.
ROANOKE RIVER INTERCEPTOR PROJECT:
ROANOKE COUNTY'S ACQUISITION OF CERTAIN
EASEMENTS UNDER THE PROVISIONS OF SECTION
l5.1-238(e) OF THE STATE CODE FOR THE
INSTALLATION OF A SANITARY SEWER LINE LOCATED
IN THE WESTERN SECTION OF THE CITY OF SALEM.
HELD OVER TO JULY 24, 1984, MEETING
John Hubbard outlined on a map the extent of the
project and the three easements on which final settlement has not
been negotiated. He requested that the Board authorize staff to
proceed with necessary condemnation procedures to acquire these
three easements.
Mr. Harold Montgomery, Route 7, Box 228, Salem, owner
of a small trucking company, requested that the easement continuE
along the road and not go through the middle of his property. HE
also indicated that he would not be able to expand his business
after the construction is complete and he would not be able to
operate his business during the construction time.
Mr. R. Kent Wright, Route 3, Box 470, Salem, told the
Board that he lives right on the river, and is concerned about
his well and the water lines to his house, apartment, and
swimming pool. He read a letter which he sent to Mr. Gene
Robertson, Engineering, outlining alternatives suggested by the
property owners.
Supervisor Minter asked if any alternative routes were
available such as going through Roanoke Electric Steel. John
Hubbard explained that this could be a consideration, and that
the other alternatives were either not feasible or too costly.
Mr. James B. Galbraith, 2144 Industrial Drive, Salem, adjacent
property owner to Mr. Montgomery's, questioned the relocation
changes made in the plans.

Personnel - Personnel Officer, Keith Cook, told the
Board that the Health Insurance study Committee recommended
coverage for Roanoke County Health Insurance be awarded to Blue
Cross-Blue Shield of Virginia (Richmond) effective July 1, 1984,
and that any pending claims with the current carrier, Lawrence
Musgrove Associates, be processed after that time. Supervisor
McGraw moved the following resolution:

PROPOSAL FOR GROUP HEALTH INSURANCE FOR
COUNTY EMPLOYEES OF ROANOKE COUNTY
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
l. That that certain bid of Blue Cross-Blue Shield 0
Virginia for group health insurance beginning July l, 1984, for a
one year period, upon all and singular the terms and conditions
of the invitation to bid, the specifications of the County of
Roanoke, the bidder's proposals, and the provisions of this
resolution, be, and same hereby is, ACCEPTED; and
2. That the County Administrator is hereby authorize 1
and directed to execute the necessary documents on behalf of

Roanoke County, all to be upon form approved by the County
Attorney; and
3. That the run-out expenses incurred but not paid a3
of June 30, 1984, be administered by Lawrence C. Musgrove

IN RE: RECONVENEMENT
The meeting reconvened at 9:40 p.m.
Personnel - Mr. Cook presented the resolutions
for classification and pay plan for the fiscal year July I, 1984.
This will incorporate a 5% increase for employees, and Mr. Cook
recommended an amendment to Grade l3 inserting an additional
position of Buyer in the Department of Procurement for a
three-month period starting July 1. Unclassified salaries are
attached. Supervisor Brittle moved the prepared resolutions with
the recommended change in Grade 13 and also removing Code 974,
Board of Social Service Members, for further consideration.

Timothy Gubala, Superintendent of Development reported
on the progress of a review of an erosion and sediment control
ordinance. The problem is that both the Department of
Development and Department of Public Facilities jointly
administer the ordinance. He would like a work session to
outline the responsibilities of each department.
Department of Public Facilities - John Hubbard,
Superintendent of Public Facilities announced that the County
Administrator would have to enter into a contract with the
Department of Highways and Transportation, authorizing them to
relocate utilities during the Plantation Road construction

that the firm of Woods and Rogers is completing the legal rel7ie~
of the deeds, covenants and surveys for the transfer of the
Public Service Center property to the County.

He reported that there was a preliminary meeting or
June 6th pertaining to the APCO negotiations. VACO advised 1hat
the County should continue to pay the electric rates at the
current levels pending conclusion of negotiations.
The County Administrator has mailed a questionnairE to
other counties asking their methodology in allowing their an mal
control officers to operate under the arrest powers of the s1ate
and county. A report will be brought back to the Board when all
questionnaires are returned.
IN RE: WORK SESSIONS
Primary System Highway Needs in Roanoke County - Jehn
Peters presented the tentative allocation plan for the PrimalY
System Highway needs. Supervisor Burton requested a compari~on
of figures of the previous 5 to 7 years compared to the
population formula used in the Salem District.
Mr. Peters
announced that prior to the allocation hearing, Roanoke Coun1y
was scheduled to received only three percent of the funds. ~he
present percentage is 17.4 percent. Legislatures from the Vélley
will be invited to attend the Allocation Hearing meeting on ~une
14, 1984. Supervisor Burton and John Peters will attend this
meeting.
Use of Federal Revenue Sharing funds for Highway
Programs - John Peters requested direction from the Board on how
the federal revenue sharing funds should be used throughout
Roanoke County, whether county-wide or magisterial district.
Supervisor Minter moved the adoption of the County-wide plan of
using federal revenue sharing funds for highway programs. ThE
roll call vote was as follows:

Bi-weekly Payroll Program - Superintendent John
Chambliss explained that County employees presently received

their pay semi-monthly or 24 times a year. Under this program
they will received their payroll check bi-weekly or 26 times a
year. In addition there will be a hold-back period of six day .
The employee may use accumulated sick days to buy this hold-ba k
period. Supervisor Burton moved implementation of the hold-ba k
period be phased in at staff's discretion, using the six sick
days and that employees be polled on their payment schedule.
