IN RE: CALL TO ORDER Chairman Nickens called the meeting to order at 3:07 I p.m. The roll call was taken. MEMBERS PRESENT: Chairman Harry C. Nickens, Vice-Chairman, Athena E. Burton, Supervisors Minter, Brittle, and McGraw MEMBERS ABSENT: None. IN RE: EXECUTIVE SESSION Supervisor Brittle moved to go into Executive Session pursuant to Virginia Code Section 2.1-334 (a) (1), (2), (4), and (6). The motion carried by a unanimous voice vote. I IN RE: OPEN SESSION Supervisor McGraw moved to return to Open Session. The motion carried by a unanimous voice vote. Work Session - Set Off Debt Collection Act Program for the County of Roanoke - John Chambliss, Superintendent of Fiscal ---- ~ ~ ~t2Q ~~ þ~ October 23, 1984 Management and Alfred C. Anderson, Treasurer of Roanoke County presented the work session to the Board. The purpose of this act is to use taxpayers' refunds from the State to pay any debts I of these taxpayers owed to State, any State agency, or local governments. Each State, State agency, or locality must file with the Department of Taxation for recovery. The Treasurer, as the Set-Off Debt Coordinator, will file for such recovery on behalf of the County. The fee charged by the Department of Taxation for this service will be included as a portion of the debt and will be treated as a filing fee or as legal expenses. Claims will be filed based on delinquent real estates taxes, personal property taxes, parking tickets, and terminated utility accounts. At the close of the next fiscal year, a report on the success of the act will be filed with the Board of Supervisors. Supervisor Minter moved for approval of the act. The motion carried by a unanimous voice vote. I Work Session - Land Use Assessments - The Board approved a draft of the ordinance and requested that it be advertised for public hearing for the November 13, 1984 Board of Supervisors Meeting. Work Session - Report to amend the Roanoke County Code Concerning Antique Vehicles - John Chambliss, Superintendent of Fiscal Management, presented the changes to the Board of Supervisors. Supervisor Minter moved that the ordinance be published for public hearing for the November 13, 1984, Board of Supervisors Meeting. Work Session - Briefing on the Upcoming JLARC Highway Hubbard, Superintendent of Public Facilities, handed out packets I Meeting to be Held November 2, 1984, at Blacksburg - John regarding funding of JLARC to the Supervisors and Mr. Flanders to take to their meeting with the legislators. IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS ----- ~ ~ October 23, 1984 223 I Supervisor Burton - Asked about solution of Roselawn Road problem. Staff reported that they are working with the Highway Department. Supervisor Burton also requested monthly fiscal reports to be placed in agenda packets. Supervisor Minter - Requested forms for park clean-up project. Paul Mahoney, County Attorney, has already prepared forms. I Supervisor Brittle - Reported that over 10,000 children in Roanoke County have been fingerprinted under Operation Fingerprint. Supervisor McGraw - Reported that he had met with the citizens in the Catawba area regarding the use of the Catawba School as a community center. The citizens are making every effort to devise a plan that will reduce remodeling costs. Supervisor McGraw also suggested that negotiations and studies be started again since vinton and Roanoke County have rejected the Valley First study. Supervisor Nickens - No report. IN RE: REPORTS OF CONSTITUTIONAL OFFICERS No report. IN RE: REPORTS OF OFFICERS, DEPARTMENTS AND COMMITTEES I 1. Personnel - No report. 2. County Attorney - No report. 3. Department of Public Facilities - Superintendent John Hubbard gave an oral report on various building improvement needs. Mr. Hubbard also reported on the fire hydrant situation in Farmingdale South. The staff recommends installation of three fire hydrants but there is no allocation in the budget. The ~ -~ i' r~x ~° October 23, 1984 Board advised Mr. Hubbard to meet with Tommy Fuqua, Coordinator of Fire and Emergency Services, and then report back to the Board Mr. Hubbard also reported on the easement on Route 897. Supervisor Brittle moved the prepared resolution. RESOLUTION 84-180 AUTHORIZING THE COUNTY ADMINISTRATOR TO ACCEPT THE CONVEYANCE OF AN EASEMENT ACROSS THE PROPERTY OF DAVID E. AND VIRGINIA L. KIDD TO ROANOKE COUNTY'S STARKEY WELL #1 BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the County Administrator be, and hereby is, authorized and directed to accept the conveyance of an easement across the property of David E. and Virginia L. Kidd to Roanoke County's Starkey Well #1; and 2. That the General Appropriation Resolution of Roanoke County, Virginia, adopted June 12, 1984, be, and same hereby is, amended as follows to become effective October 23, 1984: DESCRIPTION Class: Fund: Department: Expenditure Utility Easements Unappropriated Balance - Water ACCOUNT NUMBER 92-6-09107-71100 92-6-09107-99999 INCREASE (DECREASE) $2,000 ($2,000) Upon motion of Supervisor Brittle and the following recorded vote: AYES: Supervisors Burton, Minter, Brittle, McGraw, Nickens. NAYS: None 4. Department of Development - Arnold Covey, Development Review Coordinator, presented Site Plan Bond Policy. The staff recommended that the policy be approved as presented. Supervisor Burton moved to approve the Site Plan Bond Policy with the understanding that items on pages 7 and 8 will be reviewed by staff. The motion carried by a unanimous voice vote. Department of Fiscal Management - Superintendent, John Chambliss, reported that the audit field work had been completed and there was a deficit in the Refuse Operation for the Utility Fund in the amount of $295,418.00 and a cash balance from accumulated depreciation and other cash sources of approximately $185,780.00 for a net deficit of $109,638.00. Staff suggests that $111,000.00 be appropriated from that balance to the Utility Fund to offset the deficit. Supervisor McGraw moved to approve the prepared resolution. Mr. Flanders has received report on the Comparison of Financial Assistance and Special Services for Economic Development. He noted that Virginia only provides I one service, the Industrial Revenue Bonding Program. Mr. Flanders also reported that he and John Hubbard, Superintendent of Public Facilities, Supervisor Brittle, and Paul Mahoney, County Attorney have been meeting with various engineering firms to serve Roanoke County, Roanoke City, vinton, and Salem in the development of a water resource for the next 55 years and are proposing the retention of Hayes, Seay, Mattern and Mattern in the amount of $1,983,000.00. The staff recommends the approval of the prepared resolution. Supervisor Brittle moved for approval to hire the firm of Hayes, Seay, Mattern & Mattern. The motion carried by a unanimous voice vote. NAYS: None RESOLUTION 84-183.A ACCEPTING CERTAIN BIDS MADE TO ROANOKE COUNTY SET FORTH AS FOLLOWS BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That those certain bids set forth as follows in the I following words and figures be, and hereby are, accepted, upon all and singular the terms and conditions of the invitation to bid, the specifications of the County of Roanoke, the bidder's proposals, and the provisions of this resolution, to-wit: A. Contract to construct and deliver one (1) 5,000 gallon hydro-pnuematic tank to be placed in service at the Deer Run Well storage facilities - Richmond Engineering Company - $6,954.00. B. Purchase of one (1) metal trench box to be placed in service by the utilities Division - James River Equipment and Supply Company - $3,335.00. C. Repairs to be made to the ladder truck assigned to the Hollins Fire Department - American LaFrance Service Center - $8,838.00. D. Purchase of two (2) printing terminals - Hewlett Packard - $6,622.20. I 2. That the County Administrator is hereby authorized and directed to execute the necessary documents on behalf of Roanoke County upon a form approved by the County Attorney; and 3. YES: Supervisors Burton, Minter, Brittle, McGraw, and Nickens YS: None Supervisor Minter suggested that Roanoke County contact someone from Virginia Tech or the University of Virginia to conduct the study for the local governments since Valley First had been voted against by vinton and Roanoke County. Supervisor Brittle moved that Items F-2 be received and filed and that Item F-5 be voted on by roll call vote. RESOLUTION 84-184 AUTHORIZING THE EXECUTION OF A CONTRACT WITH APPALACHIAN POWER COMPANY FOR ELECTRIC ENERGY I BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the County Administrator is hereby authorized to execute an agreement on behalf of the Roanoke County Board of Supervisors with Appalachian Power Company for a three year term, said term expiring June 30, 1987, for electric energy. This ~ 230 October 23, 1984 agreement provides a rate schedule for the sale of electricity to governmental authorities; and 2. That the previously executed street light contract I based on Appalachian Power Company's January 1, 1983, rate schedule shall continue at those rates for the period specified in said contract. Upon the expiration of the street light contract the newly negotiated street light rates shall then become effective; and 3. That said contract shall be upon form approved by the County Attorney. On motion of Supervisor Brittle and the following recorded vote: AYES: Supervisors Minter, Brittle, McGraw, and Nickens NAYS: None ABSTAINED: Supervisor Burton IN RE: PROCLAMATION AND RESOLUTIONS I Chairman Nickens presented a resolution of appreciation to J. R. Bateman. Supervisor Brittle moved for approval of the prepared resolution thanking J. R. Bateman for his service on the Roanoke County Planning Commission. RESOLUTION 84-185 EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO J. R. BATEMAN FOR HIS SERVICE ON THE ROANOKE COUNTY PLANNING COMMISSION WHEREAS, J. R. Bateman was appointed to the Roanoke County Planning Commission and served thereon with distinction from July, 1982, through October, 1984; and has served as Vice I Chairman from January, 1984, to the present; and WHEREAS, J. R. Bateman has submitted his resignation from the Planning Commission in order to secure the benefits of enhanced career opportunities; and - ~ -, October 23, 1984 2 ').. 1 ~}ì WHEREAS, J. R. Bateman has been a loyal and hardworking member of the Planning Commission and his accomplishments include I substantial assistance in the up-date and revision of the Comprehensive Plan and Zoning Ordinance as well as being instrumental in developing the first mission statement for the Roanoke County Planning Commission. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County and the citizens of Roanoke County express their deepest and heartfelt appreciation to J. R. Bateman for his brief but productive tenure and service on the Planning Commission and it is with regret that his resignation from the Planning Commission is hereby accepted; further that his service and advice will be sorely missed; finally, that the Board and citizens wish J. R. Bateman further success in his new endeavors. I On motion of Supervisor Brittle and the following recorded vote: AYES: Supervisors Burton, Minter, Brittle, McGraw, and Nickens NAYS: None Chairman Nickens presented a proclamation declaring the week of November 11, 1984 thru November 17, 1984 as American Education Week to Mr. David Rowe, Chairman of the Roanoke County School Board, Mr. Bayse Wilson, Superintendent of the Roanoke County Schools, and Ms. Shelby Thomason, Vice-President of the Roanoke County Education Association. David Rowe extended an invitation to all Board members and citizens to tour the schools during that week. Chairman Nickens also presented a proclamation I declaring Wednesday, October 24, 1984, as United Nations Day. Chairman Nickens also noted that Roanoke County has received an award for excellence by the Roanoke Valley Clean Valley Council. IN RE: CITIZENS COMMENTS AND COMMUNICATIONS - ~ "...- 2;j 2 October 23, 1984 Donald R. Flanders, County Administrator, introduced Ms. Beverly Waldo, Program Manager of Girl Haven, an adolescent local governments and the offices will be temporarily housed at I home for girls. Girl Haven is a cooperative effort of all the the Roanoke County Administration Center. Supervisor Brittle introduced Donald witt who will be nominated to fill the unexpired term of Mr. J. R. Bateman on the Roanoke County Planning Commission. Supervisor Brittle moved that the Board of Supervisors approve his appointment effective November 1, 1984 through December, 1987. The motion carried by é unanimous roll call vote. Mrs. Audrey Phelps, 3213 Rasmont Avenue, SW, Roanoke, Virginia, submitted a petition to Supervisor Burton, regarding the building of an apartment complex in the Crestwood Park Development. The proposed and approved access to this development is off of Rasmont Avenue and does not seem to meet I Highway Department standards since it appears to be a one lane road. Supervisor Burton checked with the Department of Highways and discovered that the only way to deny an ingress or egress wa~ on the basis of sight distance and this particular ingress/egres~ met all those requirements. Mr. William L. Woody, 3234 Ledgewood Avenue, SW, Roanoke, Virginia, reported that he has had to call at least fou times to have mud cleaned up from the ingress/egress on Rasmont Road. He also reported on the danger of the ingress/egress and that there have been several close calls as far as accidents haVE been concerned. Supervisor Burton moved that this matter be referred to staff. The motion carried by a unanimous voice vote I IN RE: PUBLIC HEARINGS - Petition of Friendship Manor Apartment Village Corporation requesting rezoning from B-2 to R-3 of a tract containing 3.12 acres ~ 233 October 23, 1984 I and located on the northerly side of Hershberger Road in the Hollins Magisterial District. Planning Commission recommends denial. Held over from October 10, 1984. APPROVED Michael Smeltzer, appeared before the Board of Supervisors on behalf of Friendship Manor Apartment Village Corporation. Mr. Steve Rice, an employee of Friendship Manor and a major part of its development and Mr. Eldon Karr, the architect who has been working on the design were also present. NOW, THEREFORE, BE IT RESOLVED AND ORDERED that at this meeting of the Board of Supervisors of Roanoke County, Virginia, held on the 23rd day of October, 1984, the said County Zoning Ordinance be, and the same is hereby amended so as to reclassify the property described in said amended petition from Business I District B-2 to Residential District R-3, in order that said property might be more fully and reasonably used, the said property being located in the County of Roanoke, State of Virginia and more particularly described on Exhibit A attached hereto. EXHIBIT A 3.12 acres to be reclassified as residential district R-3, and more particularly described as follows: I BEGINNING at a point on the easterly side of Florist Road, NW, at a point 325 feet northwest of an iron pin designated as No. 4 on the hereinafter mentioned plat; thence N. 240 14' 56" W. 197 feet to a point; thence leaving Florist Road, N. 610 42' 12" E. 520 feet to a point; thence S. 90 27' 01" E. 354 feet to a point; thence S. 790 33' 00" W. 445 feet to the place of BEGINNING, and being as more particularly shown on an addition to the plat dated December 20, 1977, made by Buford T. Petition of Wanda Kettleson requesting rezoning from R-l (Residential) to R-E (Residential Estates) and a Special Exception for a mobile home located on a 3.93 acre tract located on the northeast side of Route 692 0.9 miles south of its intersection with Elbert Drive in the Windsor Hills Magisterial District REQUEST WITHDRAWN C. John Renick, Jr. appeared before the Board of I Supervisors on behalf of Wanda Kettleson. Mr. Renick reported that Ms. Kettleson has found a trailer within the size requirements of the trailer that was recently removed and is now protected by the Grandfather Clause. Because she was able to find a trailer which met standards to allow compliance under the Grandfather Clause, she withdrew her request. IN RE: APPOINTMENTS Supervisor Burton moved to appoint John N. Lampros to the Management Advisory Council. Supervisor Minter moved to appoint Mr. Ed Ginch to the Management Advisory Council. I Chairman Nickens moved to appoint Mr. Thomas T. Palmer to the Management Advisory Council. The motions carried by a unanimous voice vote. IN RE: EXECUTIVE SESSION ~ ~ October 23, 1984 235 I Supervisor McGraw moved to go into Executive Session pursuant to the Code of Virginia, Section 2.l-344(a) ( 1 ) , ( 2 ) , and ( 6 ) . The motion carried by a unanimous voice vote. IN RE: OPEN SESSION Supervisor Brittle moved to return to Open Session at 10:15 p.m. The motion carried by a unanimous voice vote. IN RE: ADJOURNMENT Supervisor Minter moved to adjourn at 10:45 p.m. until 7:30 a.m. Thursday, October 25, 1984, to consider going into I Executive Session.
