Good afternoon and welcome to our meeting for February 14, 2006. Regular meetings
are held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings
are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this
schedule will be announced. The meetings are broadcast live on RVTV, Channel 3,
and will be rebroadcast on Thursdays at 7:00 p.m. and on Saturdays at 4:00 p.m. The

SUMMARY OF INFORMATION:
On December 11, 2003, the Virginia Public School Authority ("VPSA") issued its School
Refunding Bonds (1997 resolution) Series 2003 D. With a portion of the proceeds of the
2003 D bonds, the VPSA refunded certain maturities of 8 different series of outstanding
pool bond issues involving 74 different localities.
The refunding bonds issued by VPSA are deemed used for the same purposes as the
original VPSA bonds being refunded (school capital construction expenditures). As long
as the proceeds of the refunded bonds continue to be used for good governmental
purposes under federal tax law, it will assure the VPSA's refunding bonds will remain tax
exempt.
We were notified in May 2005 that the lump sum refunding savings generated by this
refunding transaction were available to the localities. The County will receive $581,773.76
in VPSA refunding savings. The refunding proceeds must be spent by the School Board on
qualified school capital expenditures. In addition, to avoid arbitrage problems, the proceeds
must be spent within six (6) months of the receipt of the funds.
The schools are currently renovating Bonsack Elementary School at a cost of $2 million
with money from their Major School Capital Fund. The Schoof Board will use these
refunding savings toward the renovations at Bonsack Elementary School, thereby saving
funds in their Major School Capital Fund for other projects.
Since VPSA bonds are issued in the name of the County, it is necessary for the County to
adopt the attached resolution in order to complete the closing papers so that the schools
can obtain their savings.
FISCAL IMPACT:
The schools will receive $581,773.76 (and possible some additional interest earnings) from
the VPSA refunding sale. They will use this money to fund a portion of the current
renovations to Bonsack Elementary School. This will allow them to save the same amount
of funds from their Major School Capital Fund for other capital projects.
STAFF RECOMMENDATION:
Staff recommends the following:
1. Adopting the attached resolution which approves the execution of the necessary
documents for the Schools to receive $581,773.76 in VPSA refunding savings,
2. Appropriating the $581 ,773.76 (pus any interest earnings) savings to the renovations at
Bonsack Elementary School

RESOLUTION AUTHORIZING THE EXECUTION AND DELIVERY OF A
CONTINUING DISCLOSURE AGREEMENT IN CONNECTION WITH
THE ISSUANCE BY THE VIRGINIA PUBLIC SCHOOL AUTHORITY OF
ITS SCHOOL FINANCING BONDS (1997 RESOLUTION) REFUNDING
SERIES 2003 D, A PORTION OF THE PROCEEDS OF WHICH
REFUNDED THE COUNTY OF ROANOKE GENERAL OBLIGATION
SCHOOL BONDS, SERIES 1992, SERIES 1993 C, REFUNDING
SERIES 1994 A AND SERIES 1995A; AND AUTHORIZING ANY OTHER
ACTIONS NECESSARY TO ACHIEVE THE OBJECTIVES
CONTEMPLATED HEREBY
WHEREAS, the Virginia Public School Authority (the "Authority") pursuant to (i) a
bond resolution adopted on August 13, 1987, as amended and supplemented (the
"1987 Resolution"); (ii) a bond resolution adopted on June 26, 1991, as amended,
restated and supplemented (the "1991 Resolution"); and (iii) a bond resolution adopted
on October 23, 1997, as amended, restated and supplemented (the "1997 Resolution")
issued bonds (respectively, the "1987 Resolution Bonds", the "1991 Resolution Bonds"
and the "1997 Resolutìon Bonds") for the purpose of purchasing general obligation
school bonds of certain cities and counties within the Commonwealth of Virginia;
WHEREAS, the Authority used a portion of the proceeds of certain 1987
Resolution Bonds to purchase certain duly authorized and issued general obligation
school bonds of the County of Roanoke, Virginia (the "County") designated the County
of Roanoke General Obligation School Bonds, Series 1988 A and Series 1989 ("Prior
Local School Bonds");
WHEREAS, the Authority has issued under the 1987 Resolution several series of
1987 Resolution Bonds designated as "School Financing Bonds (1987 Resolution) 1992
Series B" (the "Series 1992 B Bonds"), "School Financing Bonds (1987 Resolution)
1993 Refunding Series B" (the "Serìes 1993 B Bonds") and "School Financing Bonds
(1987 Resolution) 1993 Series C" (the "Series 1993 C Bonds");
WHEREAS, the Authority has issued under the 1991 Resolution a series of 1991
Resolution Bonds designated as "School Financing Bonds (1991 Resolution) Series
1995 A" (the "Series 1995 A Bonds");
WHEREAS, the Authority refunded certain 1987 Resolution Bonds with a portion
of the proceeds of its Series 1993 B Bonds and, in connection therewith, the County
exchanged its Prior Local School Bonds with a duly authorized and issued general
obligation school bond designated the County of Roanoke General Obligation School
Bond, Refunding Series 1994 A (the "1994 A Local School Bond");

WH EREAS, the Authority used a portion of the proceeds of the Series 1992 B
Bonds, Series 1993 C Bonds and Series 1995 A Bonds to purchase certain duly
authorized and issued general obligation school bonds of the County designated the
County of Roanoke General Obligatìon School Bonds, Series 1992, Series 1993 and
Series 1995A (together with the 1994 A Local School Bond, the "Local School Bonds");
WHEREAS, the Authority refunded its Series 1992 B Bonds, Series 1993 B
Bonds, Series 1993 C Bonds and Series 1995 A Bonds ("Refunded Bonds") with a
portion of the proceeds of its Virginia Public School Authority School Financing Bonds
(1997 Resolution) Refunding Series 2003 D (the "Refunding Bonds") issued pursuant to
the 1997 Resolution;
WHEREAS, the Authority in refunding the Refunded Bonds has pledged the
Local School Bonds for the benefit of the holders of bonds issued under its 1997
Resolution;
WHEREAS, the Authority is required to assist the underwriters (the
"Underwriters") of the Refunding Bonds with their duty to comply with Securities and
Exchange Commission ("SEC") Rule 15c2-12 (the "Rule");
WHEREAS, the Authority has requested the County to execute a Continuing
Disclosure Agreement in order for the Authority to assist the Underwriters in complying
with the Rule, and;
WHEREAS, the Board of Supervisors of the County of Roanoke, Virginia
considers it to be advisable for the County to fulfill the request of the Authority to
execute a Continuing Disclosure Agreement;
NOW, THEREFORE BE IT RESOLVED by the Board of Supervisors of the
County of Roanoke, Virginia:
1. ContinuinQ Disclosure Aqreement.
The Chairman of the Board of Supervisors, the County
Administrator and such officer or officers as they may designate are hereby authorized
to enter into a Continuing Disclosure Agreement substantially in the form attached as
Appendix A hereto, containing such covenants as may be necessary in order for
compliance with the provisions of the Rule, and any other documents the Authority
deems necessary to comply with the SEC rules and any Internal Revenue Service rules
and regulations regarding maintaining the tax-exempt status of the bonds.
2. Use of Proceeds Certificate.
The Chairman of the Board of Supervisors, the County
Admìnistrator and such officer or officers as they may designate are hereby authorized
to enter into a Use of Proceeds Certificate substantially in the form attached as
Appendix B hereto, containing such covenants as may be necessary in order for

compliance with any Internal Revenue Service rules and regulations regarding
maintaining the tax-exempt status of the bonds.
3. Further Actions.
The members of the Board and all officers, employees and agents
of the County are hereby authorized to take such action as they or anyone of them may
consider necessary or desirable in connection with the execution and delivery of the
Continuing Disclosure Agreement and the Use of Proceeds Certificate and maintaining
the tax-exempt status of the bonds, and any such action previously taken is hereby
ratífied and confirmed.
4. Effective Date.
This resolution shall take effect immediately.

SUMMARY OF INFORMATION:
The petitioner, Boone Homes, Inc., (formerly Boone, Boone and Loeb, Inc.) is the current
owner of the subject property and requests that the Board of Supervisors vacate, quit-claim
and release the described existing variable width drainage easement and accept the
dedication of a new variable width drainage easement. The existing variable width
drainage easement crossing Lot 1, Section 1, was originally dedicated to the public by
subdivision plat recorded in Plat Book 27, Page 64. The new variable width drainage
easement would cross the property of Boone Homes, Inc. on Lot 1, Section 1, Deveoncroft
subdivision, located at the intersection of Longview Road and Belcroft Court.
The petitioner would like to place a sign for the subdivision at the corner of Longview Road
and BeJcroft Court; however, the County of Roanoke will not allow a structure to be placed
in an existing drainage easement. Therefore, the petitioner requests that the existing
variable width drainage easement be vacated and a new variable width drainage easement
be dedicated in order to place the sign on that corner. County of Roanoke staff has
reviewed and approved the amendment to the stormwater drainage piping and structures
and does not see the petitioner's request to have an adverse impact on the drainage in that
locatJon.
FISCAL IMPACT:
Boone Homes, Inc. will be responsible for all costs associated with the partial vacation of
the variable width drainage easement and the recordation of the ordinance.
ALTERNATIVES:
1. Approve the first reading of the proposed ordinance to vacate the drainage easement
shown on the attached plat and set the second reading for February 28, 2006.
2. Decline approval of the vacation of the drainage easement as shown on the attached
plat.
STAFF RECOMMENDATION:

WHEREAS, by an approved subdivision plat recorded in the Clerk's Office of the
Circuit Court of Roanoke County, Virginia, in Plat Book 27, page 64, Boone, Boone and
Loeb, as owner of the property designated on the Roanoke County Land Records as
Tax Map No. 86.01-13-01, conveyed to the Board of Supervisors of Roanoke County,
Virginia, a variable width drainage easement as depicted on 'PLAT SHOWING

WHEREAS, Boone Homes, Inc., is the current owner of Lot 1, Section 1,
Devoncroft, and the subject property is located at the intersection of Longview Road
and Belcroft Court, public rights-of-way in the Windsor Hills Magisterial District and is
now designated upon the Roanoke County Land Records as Tax Map No. 86.01-13-01;
and,
WHEREAS, the Petitioner, Boone Homes, Inc.. as the current owner of this
property, has requested that the Board of Supervisors vacate, quit-claim and release

the above-described existing variable width drainage easement and accept the
dedication of a new variable width drainage easement (as shown on Exhibits A and B
attached hereto); and,
WHEREAS, this vacation will not involve any cost to the County and the affected
County departments have raised no objection; and,
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That pursuant to the provisions of Section 18.04 of the Roanoke County
Charter, the acquisition and disposition of real estate can be authorized only by
ordinance. A first reading of this ordinance was held on February 14, 2006, and a
second reading was held on February 28, 2006.
2. That pursuant to the provisions of Section 16.01 of the Charter of
Roanoke County, the subject real estate (portion of public utility easement) is hereby
declared to be surplus and the nature of the interest in real estate renders it unavailable
for other public uses.
3. That, subject to the following conditions, the vacation, quit-claim and
release of an existing variable width drainage easement across property of Boone
Homes, Inc. on Lot 1, Section 1, Devoncroft subdivison, located at the intersection of
Longview Road and Selcroft Court in the Windsor Hills Magisterial District of the County
of Roanoke, designated as "EX. VARIABLE WITH DRAINAGE EASEMENT P.B. 27,
PG.64" on Exhibit A attached hereto, is hereby authorized and approved.

4. That, subject to the following conditions, the acceptance of a new variable
width drainage easement across property of Boone Homes, Inc. on Lot 1, Section 1
Devoncroft subdivison, located at the intersection of Longview Road and Belcroft Court
in the Windsor Hills Magisterial District of the County of Roanoke, designated as "NEW
VARIABLE WITH DRAINAGE EASEMENT" on Exhibit B attached hereto, is hereby
authorized and approved.
5. That Petitioner, Boone Homes, Inc. shall be responsible for all costs and
expenses associated herewith, including but not limited to, all costs associated with the
establishment of an alternative drainage system, surveys, publication, and recordation
of documents; and,
6. That the County Administrator, or an Assistant County Administrator, is
hereby authorized to execute such documents and take such actions as may be
necessary to accomplish this vacation, quit-claim, and release, all of which shall be on
form approved by the County Attorney.
7. That this ordinance shall be effective on and from the date of its adoption,
and a certified copy of this ordinance shall be recorded in the Clerk's Office of the
Circuit Court of Roanoke County, Virginia, in accordance with Section 15.2-2272(2) of
the Code of Virginia, 1950, as amended.

SUMMARY OF INFORMATION:
CBI Developers, LLC, the developers! owners of The Village of Tinker Creek, Section 1 are
requesting the relocation of an existing 15' public utility easement between Lots 76 and 77
as dedicated in Plat Book 26, Page 11, The Village of Tinker Creek, Section 1, and as
shown on the attached plat. The relocation involves the vacation of the exísting 15' public
utility easement and dedication of a new 15' public utility easement between Lots 76 and
77, as shown on the attached plat. This action allows CBI Developers, LLC to place the
easement down the centerline of the common property line which allows better utilization of
the property.
Local utility companies have been notified of the proposed easement vacation and
dedication and none had any objections.
FISCAL IMPACT:
The costs and expenses associated herein, including but not limited to publication, survey
and recordation costs, shall be the responsibility of CBI Developers, LLC.

ALTERNATIVES:
1. That the Board of Supervisors vacate the existing 15' public utility easement and accept
the dedication of the new 15' public utility easement, as shown on the attached plat.
2. That the Board of Supervisors do not vacate the existing 15' public utility easement and
not accept the dedication of the new 15' public utility easement as shown on the
attached plat.

WHEREAS, CBI Developers, LLC, is the current owner of both Lots 76 and 77,
The Village of Tinker Creek, and the subject properties are located on Greenville Place,
a private right of way and off of Flora Farm Drive, a public right-of-way in the Hollins
Magisterial District and is now designated upon the Roanoke County Land Records as
Tax Map Nos. 27.20-3-76 and 27.20-3-77; and,
WHEREAS, the Petitioner, CBI Developers, LLC, is the current owner of these
properties and has requested that the Board of Supervisors vacate, quit-claim and
release the above-described existing 15' public utility easement (PUE) and accept the
dedication of a new 15' public utility easement (PUE) (as shown on Exhibit A attached
hereto); and,
WHEREAS, this vacation will not involve any cost to the County and the affected
County departments have raised no objection; and,
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That pursuant to the provisions of Section 18.04 of the Roanoke County
Charter, the acquisition and disposition of real estate can be authorized only by
ordinance. A first reading of this ordinance was held on February 14, 2006, and a
second reading was held on February 28,2006.
2. That pursuant to the provisions of Section 16.01 of the Charter of
Roanoke County, the subject real estate (portion of public utility easement) is hereby
declared to be surplus and the nature of the interest in real estate renders it unavailable
for other public uses.
3. That, subject to the following conditions, the vacation, quit-claim and
release of an existing 15' public utility easement across property of CSI Developers,
LLC, parts of Lot 76 and Lot 77, The Village of Tinker Creek, located on Greenville
Place, a 32' private right-of-way in the Hollins Magisterial District of the County of
Roanoke, cross-hatched and designated as "15' WIDE PUBLIC UTILITY EASEMENT

aforesaid Clerk's Office in Plat Book 26, page 11, is hereby authorized and approved.
4. That, subject to the following conditions, the acceptance of a new 15'
public utility easement between Lots 76 and 77, The Village at Tinker Creek, property of
CBI Developers, LLC, located on Greenville Place, a 32' private right-ot-way in the
Hollins Magisterial District of the County of Roanoke, cross-hatched and designated as
UNEW 15' WIDE PUBLIC UTILITY EASEMENT" on Exhibit A attached hereto,
recorded in the aforesaid Clerk's Office in Plat Book 26, page 11, is hereby authorized
and approved.
5. That Petitioner, F&W Community Development Corporation, shall be
responsible for all costs and expenses associated herewith, including but not limited to,
all costs associated with the establishment of an alternative drainage system, surveys,
publication, and recordation of documents; and,
6. That the County Adminìstrator, or an Assistant County Administrator, is
hereby authorized to execute such documents and take such actions as may be
necessary to accomplish this vacation, quit-claim, and release, all of which shall be on
form approved by the County Attorney.
7. That this ordinance shall be effective on and from the date ot its adoption,
and a certified copy of this ordinance shall be recorded in the Clerk's Office of the
Circuit Court of Roanoke County, Virginia, in accordance with Section 15.2-2272(2) of
the Code of Virginia, 1950, as amended.

SUMMARY OF INFORMATION:
This ordinance authorizes the acceptance of a conveyance from the County
School Board of Roanoke County of approximately 28.71 acres of real estate
known as the ''Taylor Property" located on Merriman Road.
The School Board purchased this property in 1993 for $240,000 plus various
closing costs and expenses. The Board of Supervisors transferred $275,000 to
the School Board from the 1993 General Obligation Bonds in order to pay for this
property acquisition.
On December 14, 2005, the School Board adopted a resolution declaring this
property to be surplus and authorizing the conveyance of thìs property to the
Roanoke County Board of Supervisors.
In July 1998, Engineering Consulting Services Limited (ECS, Ltd.) was hired to
provide wetlands delineation on this property. Subject to a survey and
confirmation by the U. S. Corps of Engineers, ECS, Ltd. determined that
approximately 7 acres of this property were identified as wetlands. In 2005, the
Board of Supervisors retained Engineering Concepts, Inc. to prepare a site
feasibility study for the South County Library Project. It concluded that the

buildable area of this property is limited due to extensive flood plane and
topographic constraints.
The 1992 deed (Deed Book 1389, Page 869) to the School Board includes the
following conditions and restrictions:
1. Withìn one year from the date of this deed, the party of the second part
shall plant a buffer of evergreen trees as close as feasible to any adjoining
property of any party of the first part or their successor(s) in interest. Prior to
commencing any actual development or construction upon this property, the
party of the second part shall erect a six-foot chain link fence along such
boundary line just inside this buffer line of trees upon the property of the party of
the second part.
2. The party of the second part agrees that it shall comply with all current
Roanoke County zoning or other ordinance requirements regarding permissible
lighting levels in effect at the time of any development or construction of school
facilities or parks/playground facilities on this property. The party of the second
part further agrees that a major component of any architectural design and site
planning efforts related to the development of this parcel will be directed towards
minimizing the peripheral effects of lighting for such development.
3. The party of the second part agrees that it shall allow Frederick E. Taylor,
Jr., or his designee, a reasonable time, not to exceed one year from the date of
this deed, to remove a riding ring and associated fixtures from this property.
Finally, it appears that Hurley Ward is using a portion of this property for stable
and horseback riding activities. There is no written lease; however, she pays
$300 every 3 months and provides the School Board with proof of insurance.
STAFF RECOMMENDATION:
The first reading of this ordinance was held on January 24. 2006. Staff
recommends that the Board favorably consider the adoption of this ordinance at
second reading.

ORDINANCE TO ACCEPT THE CONVEYANCE OF APPROXIMATELY
28.71 ACRES OF REAL ESTATE LOCATED ON MERRIMAN ROAD
FROM THE ROANOKE COUNTY SCHOOL BOARD TO THE BOARD
OF SUPERVISORS, CAVE SPRING MAGISTERIAL DISTRICT
WHEREAS, the Board of Supervisors and the Roanoke County School Board
entered into a Memorandum of Understanding in December of 2005 providing for the
conveyance of approximately 28.71 acres of real estate (Tax Map No. 97.05-1-26) from
the School Board to the Board of Supervisors; and
WHEREAS, at their meeting on December 14, 2005, the County School Board
declared the above-mentioned 28.71 acre parcel of real estate to be surplus property,
thus allowing the Board of Supervisors to obtain ownership of the property upon
approval of this ordinance and recordation of a deed; and
WHEREAS, Section 18.04 of the Roanoke County Charter directs that the
acquisition and conveyance of real estate interests be accomplished by ordinance; the
first reading of thìs ordinance will be held on January 24, 2006, and the second reading
will be held on February 14, 2006.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the acquisition from the County School Board of Roanoke County of
an approximate 28.71 acre parcel of real estate, is hereby authorized and approved.

2. That the County Administrator or Assistant County Administrator are
hereby authorized to execute such documents and take such actions on behalf of
Roanoke County in this matter as are necessary to accomplish the acquisition of this
real estate, all of which shall be approved as to form by the County Attorney.

WHEREAS, the Roanoke County School Board has determined that it has no further
use for approximately 28.71 acres of unimproved real estate it owns fronting on Crystal Creek
Drive comprising all of Roanoke Tax Map Parcel #97.05-1-26; and
WHEREAS, the School Board desires to transfer the Property to the Roanoke County
Board of Supervisors pursuant to § 22.1-129A of the Code ofVìrginia.
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County School Board,
pursuant to § 22.1-129A of the Code of Virginia, hereby declares the Property to be surplus;
and
BE IT FURTHER RESOLVED that a copy of this Resolution, signed by the Chainnan
and certified by the Clerk, shall be filed with the Clerk of the Circuit Court of Roanoke
County; and
BE IT FURTHER RESOLVED that the Division Superintendent is authorized to
execute an agreement on behalf of the Roanoke County School Board with the Roanoke
County Board of Supervisors relating to the transfer ofthe Property, a copy of such agreement
is attached hereto as Attachment A; and
BE IT FURTHER RESOLVED that the Chairman and the Clerk are authorized to
execute a deed and such other documents and to do such other things as may be necessary to
transfer title to the Property to the Roanoke County Board of Supervisors.

This Memorandum of Understanding between the Roanoke County
Boord of Supervisors (Board of Supervisors) and the County School Board of
Roanoke County (School Board) states the intent of the School Board to

of the 1993 general obligation bonds. the Board of Supervisors transferred
to the "School Board the sum of $275,000. The School "Board utilized this
t~ to pay for the acquisition of the Taylor property.

1. Length of Service Award Program (LOSAP) for Fire and Rescue
The following four-year terms expired on January 1,2006: (1) Leon Martin, Volunteer

Squad; and (4) Brian Garber, Volunteer Member at Large.
Members of the LOSAP are recommended by the Volunteer Fire and Rescue Chiefs

available regarding these appointments.
2. Roanoke Regional Airport Commission
The four-year term of Jane Mitliron expired on February 10, 2006. Ms. Milliron is no

3. Virginia Western Community College Board

SUMMARY OF INFORMATION:
Deputy Sheriff Etter retired on February 1 , 2006, after twenty-five years and six months of
service in the Sheriff's Office. Sergeant Custer retired on February 1, 2006, after twenty-
two years and three months of service in the Police Department. They have each
requested that their resolution be mailed since they are unable to attend a Board meeting.
STAFF RECOMMENDATION:
It is recommended that the Board approve the attached resolutions and direct the Deputy
Clerk to mail them to the retirees with the appreciation of the Board members for their many
years of service to the County.

WHEREAS, Jane O. Etter was employed by Roanoke County on August 1,1980, as
a physician's assistant in the Sheriff's Office; and
WHEREAS, Deputy Sheriff Etter also served as Deputy Sheriff - Corrections
Paramedic prior to her promotion to Deputy Sheriff - Assistant Records Supervisor on
September 21,1998; and
WHEREAS, Deputy Sheriff Etter retired from Roanoke County as a Deputy Sheriff-
Inmate Records on February 1, 2006, after twenty-five years and six months of service; and
WHEREAS, Deputy Sheriff Etter, through her employment with Roanoke County,
has been instrumental in improving the quality of life for its citizens.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County expresses its deepest appreciation and the appreciation of the citizens of Roanoke
County to JANE O. ETTER for more than twenty-five years of capable, loyal, and dedicated

WHEREAS, Jerry W. Custer was employed by Roanoke County on November 16,
1983, as a Deputy Sheriff Patrol Officer in the Sheriff's Office after serving as an Auxiliary
Deputy Sheriff; and
WHEREAS, Sergeant Custer was one of the original members of the Police
Department which was established in 1990; and
WHEREAS, Sergeant Custer advanced to the rank of Sergeant in the Police
Department in 1992 and served as the Property Sergeant and Patrol Sergeant until his
retirement; and
WHEREAS, Sergeant Custer had many talents that he willingly shared with the
Department including a natural construction ability and the capacity to visualize a
completed project prior to its completion; and
WHEREAS, Sergeant Custer was involved in the construction of the Police Firing
Range, the Driver Training Center, and various other projects for the Department; and
WHEREAS, Sergeant Custer was named Officer ofthe Year in 1986 and nominated
for Roanoke County Employee of the Year in 1987; and
WHEREAS, Sergeant Custer retired from Roanoke County on February 1, 2006,
after twenty-two years and three months of service; and
WHEREAS, Sergeant Custer, through his employment with Roanoke County, has
been instrumental in improving the quality of life for its citizens.

SUMMARY OF INFORMATION:
Roanoke County has been awarded funds in the amount of $89,713.00 administered by
Virginia Department of Emergency Management under the State Homeland Security Grant
Program. These funds are to assist in preparedness and to help guard against acts of
terrorism. The Homeland Security funds are distributed through the Virginia Department of
Emergency Management to various County departments for specific equipment designated
in the grant guidelines. The funds will be split between Fire and Rescue and Police
Department purchases, but the grant will be administered through the Fire and Rescue
Department.
FISCAL IMPACT:
These funds do not require a County match in funding.
ALTERNATIVES:
None
STAFF RECOMMENDATION:
Staff recommends adoption of the attached resolution and authorizing that a certified copy
accompany the grant application for the grant award. Staff also recommends the
appropriation of the grant funds in the amount of $89,713.00 to the Fire and Rescue

RESOLUTION DESIGNATING THE APPLICANTS AGENT, THE
ACCEPTANCE OF THE 2005 HOMELAND SECURITY GRANT AND
APPROPRIATION OF GRANT MONIES
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia that
Elmer Hodge, County Administrator or his designee, is hereby authorized to execute for
and in behalf of the Roanoke County, a public entity established under the laws of the
State of Virginia, this application and to file it in the appropriate State Office for the
purpose of obtaining certain Federal financial assistance under the ODP, National
Domestic Preparedness Office Grant Program (s), administered by the Commonwealth
of Virginia.
That, Roanoke County, a public entity established under the laws of the
Commonwealth of Virginia, hereby authorizes it agent to provide to the Commonwealth
and to the Office of Justice Programs (OJP) for all matters pertaining to such Federal
financial assistance any and all information pertaining to these Grants as may be
requested.
FURTHER, the Board of Supervisors of Roanoke County authorizes the
acceptance of said grant monies in the amount of $89,713.00 and authorizes the
appropriation of said monies for the purposes authorized in the grant application.

SUMMARY OF INFORMATION:
Roanoke County Fire and Rescue requests that the Board accept and appropriate the
following grants:
1. The Virginia Department of Health, Office of Emergency Medical Services, awarded the
Fire and Rescue Department a partial purchasing grant #WVC04/12-05 totaling
$42,500.00 to purchase an ambulance. The new ambulance is to replace an existing
ambulance serving Roanoke County and the Town of Vìnton. The partial matching
funds would be split between Roanoke County and the Town of Vinton.
2. The Virginia Department of Health, Office of Emergency Medical Services, awarded the
Fire and Rescue Department a partial purchasing grant #WVC04/12-05 totaling
$7,089.00 to replace one cardiac monitor. The new monitor will replace old technology
in cardiac defibrillation practices.
FISCAL IMPACT:
1. The Roanoke County Fire and Rescue Department and the Town of Vinton have
budgeted funds for the partial purchase that the state requires for the grant. Roanoke
County will supply partial funding totaling $21,250.00 and the Town of Vinton will supply
partial funding totaling $21,250.00.

2. The Roanoke County Fire and Rescue Department has budgeted funds for the
$7,089.00 partial purchase that the state requires for the grant.
ALTERNATIVES:
The Department will not be able to purchase the new ambulance without the funds from the
state (grant # WVC04 /12-05) and the department will not be able to purchase the new
cardiac monitor without the funds from the state (grant # WVC04 /12-05)
STAFF RECOMMENDATION:
Staff recommends the acceptance and appropriation of grant funds in the amount of

This consent agenda item involves acceptance of the following easement conveyed to the
Board of Supervisors of Roanoke County for a new variable width drainage easement in the
Hills at Castle Rock subdivision in the Windsor Hills Magisterial District of the County of

Donation by Park Place Developers, Inc., of a drainage easement, variable in
width, across property situated along Srahma Road and Castle View Court.
The location of said easement is shown on a plat entitled "Plat Showing New
Variable Wídth Drainage Easement (445 S.F.) situated within Lot 1 'The Hills
at Castle Rock' (P.B. 29, Pg. 114) being granted by Park Place Developers,
Inc. to The County of Roanoke for Public Use" dated December 5, 2006,
prepared by Lumsden Associates, P.C., a copy of which is attached as
Exhibit A.
The location and dimensions of this easement have been reviewed and approved by the

This time has been set aside for a work session to hear the results and recommendations of the
Capital Improvements Program (CIP) Citizens Review Committee for capital planning for
FY2007-2011. The committee began their process in October by agreeing on procedures,
objectives, guiding principles, and evaluation criteria. Work continued through the fall and
winter with the committee hearing presentations on submitted capital needs and conducting site
visits to view requests for capital upgrades and replacements. A report outlining the
committee's prioritization of capital needs and recommendations has been finalized.
This time has been set aside to review the final report of the committee and to discuss the
findings and recommendations with committee members.

A Capital Improvements Program (CIP) is a multiyear management and fiscal planning tool to
assist in identifying, prioritizing, financing and constructing public improvements. As most
governments realize, the list of potential capital proj ects far exceeds available funding. Proposed
capital projects support different community goals and often benefit particular constituent
groups; therefore, a methodology is needed that attempts to balance diverse and sometimes
competing community values and needs.
On an annual basis, the Board of Supervisors selects a committee of citizens to evaluate and
prioritize submitted capital projects and make recommendations for Board consideration in the
capital planning process. The Committee agrees upon guiding principles, goals, and objectives
(listed in Appendix); then interviews departmental staff and conducts site visits to understand
specific projects.
Results of Evaluation
During development of last year's CIP (FY2006-20l0) the Board of Supervisors adopted a listing
of "approved" projects that were scheduled over the 5 year planning period and tentative funding
was identified for each project. This year's Committee (FY2006-2007) reviewed these projects as
part of their evaluation process and recommends these approved projects remain at the highest
priority for implementation over the next 5 year planning period. These approved projects are
reported as Previously Approved Projects on the Capital Project Prioritization summary (page 4).
The Committee prioritized all other capital project requests by applying a set of evaluation
criteria to each individual project. The Committee used 12 separate criterion to score projects
using values important to the community that were derived from previously adopted plans,
policies (i.e. Community Plan), and statements articulated by the Board of Supervisors. After
scoring was completed by committee members, each project's average score was calculated and
listed in numerical order with the highest score representing the greatest priority. The Levell
projects represent capital needs that have the highest perceived community value, but have no
identified funding associated with them. The Committee has identified Levell capital projects
as follows:

· Mt. Pleasant Library Relocation
· Glenvar Library Expansion
· Brambleton Recreation Center Renovations
· Regional Storm Water Management & Flood Control
· Parks & Recreation Land Bank

Committee Recommendations
While charged with developing a citizen-based prioritization of existing capital needs, the
Committee also discussed and reached consensus on a number of capital programming
recommendations for the Board to consider:
· Long Range Capital Planning.
o Comprehensive Planning-In order to make effective capital planning decisions
for the entire county, School and water/sewer needs should be integrated with the
current CIP process.
o Linkage to Other Planning Processes-Integration of all formal planning
processes must occur to adequately plan for capital needs of the community, not
only for the 5 year planning horizon of the CIP, but many years beyond.
· Land Banking. Land banking can be a responsible, cost-effective way to ensure that
public agencies acquire future sites under the most desirable terms, without operating
under a burden of tight time frames. Given the scarcity of available undeveloped land,
the County should identify opportunities to purchase land where future public facilities
can be located.
· Capital Maintenance. Continue to increase the funding of capital maintenance to a level
that will not only protect the County's current capital investments, but will also reduce
future capital requests (as deferred maintenance grows into capital needs).
· Capital Financing. Given the extent of capital needs a significant, recurring funding
stream is essential.
o Dedicated Funding-At a minimum, current funding levels must be maintained.
Increased funding is necessary to realistically meet current and future capital
requirements.
o Financing Options-Consideration of all financing options is important. Pay-as-
You-Go financing is fiscally conservative, but also has disadvantages. Grants,
impact fees, GO bonds, and other sources are all viable financing options.

The ranking of individual projects was determined by over-all average score, where the highest
score was the top ranked project and the lowest score was the bottom ranked project. Knowing
the scoring criteria gives greater weight to community "needs" (i.e. public safety) when
compared to community "wants" (i.e. library or parks and recreation), the Committee's opinion
was that a healthy community provides its citizens with a good mix of both wants and needs.
Page 9 of the report presents ranked projects in 4 categories: Public Safety, Technology, Quality
of Life, and Service Infrastructure.

Information presented in the Capital Project Prioritization report represents the general
consensus of the members of the CIP Review Committee. While consensus information related
to the Committee's task is presented, Committee members' individual comments about specific
projects and capital planning in general are included in the Appendix.

Recommendations
Long-term capital planning and the need to fund critical capital assets is one of the most important
functions undertaken by local government. All levels of government - federal, state, and local-
struggle to replace aging capital assets, meet new needs, and make decisions whether existing assets
are still required. Ongoing delivery of services can be assured only if adequate consideration is
given to capital needs. In order to implement an effective capital plan, the CIP Review Committee
recommends several options that should be considered by the Board of Supervisors and staff.
While the following recommendations are recurring themes from CIP Review Committees in prior
years, they continue to be the focus of discussion among current committee members and are
important to ensure Roanoke County's capital needs are met.
Long Range Capital Planning
Comprehensive Planning
It is important to note that current capital planning efforts of Roanoke County do not include 2
important components - Roanoke County Schools and the Western Virginia Water Authority. The
Committee understands the legal separation of functions from the Board of Supervisors, but these
entities represent a significant factor when considering the over-all infrastructure needs of Roanoke
County and its residents. It is difficult to consider capital needs in a comprehensive manner when
the methods for identifying and prioritizing projects for each entity is prepared independent of one
another. A more comprehensive approach would be more efficient and effective.
Linkage to Other Planning Processes
The CIP is an important component of a locality's overall planning process and should be
developed in conjunction with the comprehensive plan, annual budget process, strategic plan and
other long-range planning initiatives. For the most part, CIP submissions address capital needs as
they exist today - future needs for facilities, expansions, and upgrades playa lesser role in the
document. To adequately plan for future capital requirements, the CIP process should be more
closely associated with long-range planning initiatives that project population trends, residential
growth, and commercial development along with the types and levels of services that are
anticipated.

Land banking can be a responsible, cost-effective way to ensure that public agencies acquire future
sites under the most desirable terms, without operating under a burden of tight time frames. Given
the scarcity of available undeveloped land, the County should identify opportunities to purchase
land where future public facilities can be located. Population shifts and demographic changes will
cause alterations in the level and types of services our citizens will demand in the future and the
County must be in a position to deliver these services.

Capital Maintenance
Consistent with prior CIP Review Committees, capital maintenance continues to be a concern.
With increasing demand for services, increasing costs, and relatively flat operating budgets
maintenance is often deferred; however, putting off maintenance has a long-term cost impact and
also impacts service to the residents. A number of projects presented to the Committee, most
notably Parks & Recreation, Libraries, and Fire & Rescue, had the character of on-going repair and
maintenance requests that evolved into capital requests.
While it is important to increase the level of funding for capital maintenance in order to protect
investments already made, it is equally important to identify and fully fund the maintenance
requirements for new capital projects currently in the planning stages.
Capital Project Financing
Dedicated Funding
The Committee acknowledges the positive steps taken by the Board of Supervisors over the last
several years in developing funding alternatives for the County's capital requirements, which
include a joint funding agreement between the County and Schools and dedication of General Fund
operating revenues for specific County projects. Given the extensive listing of capital needs it is
important to not only maintain current funding levels, but to increase dedicated funding for capital
proj ects in order to not fall further behind.
Other Financing Options
All financing options should be considered and assessed. Based on recent history and current plans,
the County's primary financing option for capital is cash (Pay-as-You-Go). While this method has
many advantages, care should be taken to ensure adequate reserves (cash balances) are maintained
as a cushion against unexpected revenue shortfalls, emergencies, or other purposes. Grants, impact
fees, tax increment financing bonds, public private partnerships, and general obligation bonds also
offer advantages for certain projects.

Library: Mt. Pleasant Library Relocation

· The Mt.Pleasant Library's low circulation and attendance is directly related to the minimal hours (12) that
it is open in one week. A new facility would provide better hours, and location which would have a direct
effect on the usage.
Library: Glenvar Library Expansion

· The program generates approximately $3,000,000 for every $1,000,000 invested. It addresses short and
long term flood issues in the Roanoke Valley. By identifying the flood plains and moving homes and

· This is a very necessary project that will reduce the cost of flooding, as unusual amounts of storm water
occur.
Parks & Recreation: Parks & Recreation Land Bank

developments is a way of providing for the future. This is also an Economic Development tool.

First Team Auto Mall a price to purchase station 5 that could help fund a new Station 5 in a central
location somewhere between the proposed location and the existing location, maybe the intersection of
Williamson Rd. and Plantation Rd. this would provide easy access to 1-81, north and south on Williamson
Rd. and Plantation to the city line.

communities based on the availability of adequate recreational greenspace. The Roanoke Valley is well on
its way in this arena with the valley greenway system. Completion of the eastern section of the Roanoke
River Greenway shows Roanoke County's commitment to the overall greenway project.
· This is an opportunity to showcase the Roanoke Valley area, and should be pursued strongly.
· By completing the greenway's plan to link the trails together, outside exercise would be promoted amongst
the community. Providing local trails will encourage the area to exercise and increase their health.

In April 2001 , the Board approved Phase I of the Fire and Rescue Department's improved
staffing plan that implemented career coverage for four 24/7 Advanced Life Support (ALS)
ambulances and required the addition of 20 new paramedic/firefighters. In January 2002,
Phase II was presented and the Board approved 15 new paramedic/firefighters and the
Clearbrook jointly staffed station project with the City of Roanoke, which resulted in 24/7
fire and rescue coverage in the Route 220 corridor. During this time, the Board also
approved the implementation of the fee for ambulance transport program.
Phase III of the enhanced staffing plan was approved in January 2004. The Board
provided for 10 new personnel: four to operate a 24/7 ALS ambulance at Masons Cove;
three positions to serve as a 24/7 fire engine driver at Hollins; and three to operate an ALS
ambulance at Catawba during weekdays.
In November 2005, Phase IV of the enhanced staffing plan was approved. The Board
approved the addition of 12 personnel: four to operate a 24/7 fire engine at Hollins; four to
operate a 24/7 ALS ambulance at Mount Pleasant; and four to operate a 24/7 ALS
ambulance at Back Creek. In addition, enhanced mutual aid agreements with Roanoke
City were finalized.

As the next step toward accomplishing our strategic goals and objectives, the Fire and
Rescue Department has developed a three-year staffing and station plan. In this work
session, the department will present this proposal and outline its benefits and fiscal impact.
To address concerns with call volume and coverage, the department will present station
plans that include a request for a new station and staffing and training personnel.

Some condominiums, townhouses and patio homes in Roanoke County are designed in
such a manner that dumpsters must be used for trash collection. Since the County does
not offer dumpster service, the homeowners' associations contract with private vendors for
that service. There are also condominiums, townhouses and patio homes in the County
which are designed with large enough roads and storage space for cans, and are served
with regular once/week automated service by the Solid Waste Division. The County does
not serve cluster developments, as that is specifically prohibited in the cluster ordinance.
In 1999, the Board of Supervisors agreed in work session to reimburse these organizations
for a portion of the cost of this dumpster service since these developments pay residential
real estate taxes but do not receive trash service. No methodology for doing this was ever
determined, and the County has been reimbursing based on individual requests from the
organizations. The amounts vary considerably, depending on the number of dumpsters
and the individual contracts. Last year, Roanoke County paid $25,555 to reimburse the
associations for collection service.
In an attempt to make the payments more equitable, the Solid Waste Division is proposing
to standardize the payments to the associations. Staff has reviewed three possible
solutions:
..
1. Reimburse condominiums for the cost of pickup based on the County's contract price
for pickup of dumpsters, which is currently $23.88 per pickup. Assuming one pickup per
week, per dumpster, as currently maintained by the condominiums, the County would
pay $22,351 annually to the condomíniums. Please see Attachment 1.
2. Amend the County's dumpster pickup contract to include pickup for condominiums,
essentially outsourcing this portion of solid waste píckup. Please see Attachment 2,
which makes the following assumptions:
· The standard of pickup is once per week per household.
· Units in these complexes tend to be smaller than single family households with
fewer residents, and a 48 gallon trash can would be adequate to serve the weekly
trash needs.
· An 8 yard dumpster holds the equivalent of 32 48-gallon trash cans, so that one
dumpster should serve every 32 units.
· The new contract contínues the rate of $23.88 per pickup
3. Revisit the plan for providíng dumpster service with County equipment and personnel.
Several years ago, the Board held a worksession on the feasibility of providing this
service at county and school facilities, as well as at the condominiums. Those figures
showed a break even point in year three of the program.
Staff has met with representatives from some of the condominiu m associations, and it was
generally agreed that a methodology that was based on a formula usíng the number of
units per development would be the most equitable allocation. The representatives also
favored the County contracting for the service (Attachment 2), so that the associations
would be relieved of the paperwork related to trash pickup, unless they needed more
pickups than provided by the formula.
Staff will continue to refine the proposafs and discuss them further at the work session.

WHEREAS. the Board of Supervisors of Roanoke County, Virginia has convened a
