Good afternoon and welcome to our meeting for May 9, 2006. Regular meetings are
held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings are
held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule
will be announced. The meetings are broadcast live on RVTV, Channel 3, and will be
rebroadcast on Thursdays at 7:00 p.m. and on Saturdays at 4:00 p.m. The meetings
are now closed-captioned. Individuals who require assistance or special arrangements
to participate in or attend Board of Supervisors meetings should contact the Clerk to the

SUMMARY OF INFORMATION:
Aaron Blomberg, a junior at Glenvar High School (GHS), won the 140-pound State Group A
Wrestling Championship on March 4, 2006, at the Salem Civic Center with a 13 to 4
decision over his opponent. Mr. Blomberg ended the season with a record 47 wins and 4
losses while winning his last 22 regular season bouts and all 9 post-season bouts. In
addition to the State Championship, Mr. Blomberg won the Titan Toughman, Bison Duels,
and War of the Westlers tournaments during the regular season and the Three Rivers
District and Region C titles in the post season.
Mr. Blomberg and his parents are expected to attend the meeting. Also expected to attend
are Tom Hall, Assistant Superintendent of Personnel; Curtis Hicks, GHS Principal; and
Jamie Soltis, GHS Wrestling Coach.

SUMMARY OF INFORMATION:
The Commonwealth of Virginia has declared the week of May 14 through 20, 2006 as
Business Appreciation Week. This week honors all business community leaders and
partners for their daily contributions to the Commonwealth. Locally each community is
encouraged to participate in Business Appreciation Week and Roanoke County has done
so for many years. The Governor will host a breakfast in Richmond that will honor the
state's existing businesses, and Roanoke County wishes to take this opportunity to officially
recognize the contributions of our business partners.
Doug Chittum, Director of Economic Development, will accept the proclamation in
appreciation and recognition of the Roanoke County business community.

WHEREAS, the County of Roanoke is pleased to have a thriving base of business
and industry to support and strengthen the local economy; and
WHEREAS, these businesses provide essential employment opportunities for the
citizens of the County of Roanoke; and
WHEREAS, these businesses provide local revenues from which the entire local
citizenry benefit; and
WHEREAS, these businesses also make significant contributions in our
communities to promote educational opportunities for our children and promote a variety of
civic activities which increase the quality of life of the area; and
WHEREAS, the week of May 14 through 20, 2006, has been designated as
Business Appreciation Week; and
WHEREAS, Roanoke County participates in the activities of the Roanoke Regional
Chamber of Commerce, the Salem-Roanoke County Chamber of Commerce, the Vinton

The Roanoke County Fire & Rescue Department is requesting that the Board adopt the
attached proclamation declaring the week of May 14 through 20, 2006, as Emergency
Medical Services Week. Emergency Medical Services Week brings together local
communities and medical personnel to publicize safety and honor the dedication of those
who provide the day-to-day lifesaving services of medicine's "front line."
Present to accept the proclamation will be Fire and Rescue Chief Rick Burch and EMS
Battalion Chief Dustin Campbell.

WHEREAS, emergency medical services is a vital public service; and
WHEREAS, the members of emergency medical services teams are ready to
provide lifesaving care to those in need 24 hours a day, seven days a week; and
WHEREAS, access to quality emergency care dramatically improves the survival
and recovery rate of those who experience sudden illness or injury; and
WHEREAS, the emergency medical services system consists of emergency
physicians, emergency nurses, emergency medical technicians, paramedics,
firefighters, educators, administrators and others; and
WHEREAS, the members of emergency medical services teams, whether career
or volunteer, engage in thousands of hours of specialized training and continuing
education to enhance their lifesaving skills; and
WHEREAS, it is appropriate to recognize the value and the accomplishments of
emergency medical services providers by designating Emergency Medical Services
Week.

The Roanoke County Building Commissioner is requesting that the Board adopt the
attached proclamation declaring the week of May 7 through 13, 2006, as Building Safety
Week. This year's theme, "Building a Safer World Together", encourages all citizens to
raise their awareness of building safety and to take appropriate steps to ensure that the
places where they live, work, play, and learn are safe.
Arnold Covey, Director of Community Development, and Joel Baker, Building
Commissioner, will be present to accept the proclamation.

2006, AS BUILDING SAFETY WEEK IN THE COUNTY OF ROANOKE
WHEREAS, through our continuing attention to building safety, we enjoy the comfort
and peace of mind of structures that are safe and sound; and
WHEREAS, building safety and fire prevention officials are at work year round to
guide the safe construction of buildings; and
WHEREAS, the dedicated members of the International Code Council, including
building safety and fire prevention officials, architects, engineers, builders and others in the
construction industry, develop and enforce codes to safeguard Americans in the buildings
where we live, work, play and learn; and
WHEREAS, the International Codes, the most widely adopted building safety and
fire prevention codes in the nation, are used by most U.S. cities, counties and states.
These modern, building safety codes also include safeguards to protect the public from
natural disasters that can occur such as hurricanes, snowstorms, tornadoes, wildland fires
and earthquakes; and
WHEREAS, Building Safety Week, sponsored by the International Code Council
Foundation, is an excellent opportunity to educate the public and to increase public
awareness of the role building safety and fire prevention officials, local and state building
departments, and federal agencies play in protecting lives and property; and
WHEREAS, this year's theme, "Building a Safer World Together," encourages all
Americans to raise our awareness of building safety and to take appropriate steps to
ensure that the places where we live, work, play and learn are safe; and
WHEREAS, this year, as we observe Building Safety Week, we ask all Americans to
consider projects to improve building safety at home and in the community, and to
recognize the local building safety and fire prevention officials and the important role that
they play in public safety.

At the April 25 Board of Supervisors meeting, Chairman Wray requested that the Board
recognize the staff in the Clerk's Office by designating the week of April 30 through May 6,
2006, as Municipal/County Clerk's Week. Since 1969, the International Institute of
Municipal Clerks (IIMC), a professional non-profit association comprised of 10,000
members internationally, has sponsored Municipal Clerk's Week to increase the public's
awareness of the role of municipal clerks and the services the provide for local government
and the community.
Accepting the proclamation will be Diane Childers, CMC, Clerk to the Board; Brenda
Holton, CMC, Deputy Clerk to the Board; and Mary Brandt, Office Support Specialist.

WHEREAS, the Office of the Municipal/County Clerk, a time honored and vital part
of local government exists throughout the world; and
WHEREAS, the Office of the Municipal/County Clerk is the oldest among public
servants; and
WHEREAS, the Office of the Municipal/County Clerk provides the professional link
between the citizens, the local governing bodies, and agencies of government at other
levels; and
WHEREAS, Municipal/County Clerks have pledged to be ever mindful of their
neutrality and impartiality, rending equal service to all; and

SUMMARY OF INFORMATION:
The County recently received the attached letter from the Mennel Milling Company (T.E.
Ibberson Company, contractor), requesting a waiver of the noise ordinance under Section
13-23 "Undue hardship waiver," from Monday, June 12 through Sunday, June 25,2006.
As the letter explains, the construction entails two concrete pours, one for the silos and one
for the flour mill. Each structure will require the concrete to be continuously poured over a
24 hour basis, with no interruptions. This is necessary due to the specific nature of this
type of construction, in addition to the height of the individual structures.
During this time, concrete trucks will be entering from Benois Road, which should have the
least impact on surrounding neighbors. All parties involved understand the potential impact
of this request and are sensitive to the concerns of neighboring homes and businesses.
The County has held two community meetings to educate and inform the businesses and
citizens who live and work in the area about the project and the related construction
schedule. Written notification will also be provided to inform the citizens of the 24 hour
construction schedule upon adoption of this resolution.
Given this special type of construction, there is no way to avoid the 24 hour concrete pour.
Mennel must be granted a waiver to the noise ordinance in order for the project to move
forward.
FISCAL IMPACT:
This request does not have any fiscal impact.
AL TERNATIVES:
None
STAFF RECOMMENDATION:
Staff recommends approval of this request given that it is for a limited timeframe and due
to the fact that there is no other way to complete the construction of these facilities. Staff
will continue to work with Don Mennel and his team of contractors, engineers and
management to limit the impact on surrounding neighbors to the extent possible.

Dear Mr. Hodge,
T. E. Ibberson Company, the General Contractor of the above referenced project, are requesting a
waiver to the Roanoke County noise ordinance under Sec. 12-23 "Undue Hardship Waiver." The
waiver is requested for a two week time period beginning Monday, June 12J 2006 and ending
Sunday, June 25, 2006 for the two monolithic concrete pours '~Slipform" of the new mill tower and
annex. The need for the waiver was discussed with county officials on January 5, 2006 during the
Pre-Construction Meeting and also mentioned at both public meetings held at the Cave Springs
Elementary School.
A monolithic concrete slip foon operation is a 24-hour contjnuous process of placing rebar and
pouring concrete into forms and jacking the forms as the concrete sets until the proper elevation
has been reached. This must be a continuous process once the slip has started to primarily avoid
cold joints and avoid compromising the structural design of the buildings. A cold joint would allow
moisture seepage, bug infestation of the structure and could compromise the structural integrity of
the building. Since the structure will be used to produce a food grade product, we cannot have
cold joints in the structure. Also, cosmetically the starting and stoppjng will create a pattern on the
structure unacceptable by the owners.
We are scheduled to begin the slip form mill tower on June 12 with estimated completion on June
18 at an elevation of 110'. The annex will begin immediately following completion of the mill tower
slip with completion estimated by Sunday, June 25 at an elevation of 140'. We must adhere to the
above dates as we have contracted with a slip-form labor company for the additional 140-150
people required for this period. Since they specialize in slip-form operations, they must be
scheduled months ahead of the date needed to insure their availability. Any delays or
postponements of the slip foon operation will set the project back several months as the slip crew
schedules are made months in advance.
During this 2-week period, concrete delivery trucks will be using the Benois Road entrance to
deliver concrete to the site both day and night throughout the duration of the slip form operations.
Our concrete requirements for both of these slips will average approximately 24 CY/hour or one
concrete truck approximately every 20 minutes. There will also be one concrete pump truck placing
the concrete and a crane for lifting materials to the slip deck.
T. E. Ibberson realizes this situation may be frustrating for the neighboring residents on the short
teon and we will strive to minimize the noise, but since these structures are designed to be a
monolithic slip fonn pour we do not have any other options to build these two structures.

NOISE ORDINANCE, ARTICLE II. NOISE OF CHAPTER 13: OFFENSES-
MISCELLANEOUS OF THE ROANOKE COUNTY CODE
WHEREAS, T. E. Ibberson Company, the general contractors for the construction of
a new flour mill for Mennef Milling on Benois Road in Roanoke County, has requested a
waiver of the County's noise ordinance as contemplated under Sec. 13-23. Undue
hardship waiver. to permit construction activity related to pouring concrete for the new mill
tower and annex beginning on June 12,2006 and ending June 25, 2006; and
WHEREAS, Section 13-23 of the Roanoke County Code establishes certain
standards for the Board of Supervisors to grant waivers from the provision of the Roanoke
County Noise Ordinance, Article II. Noise of Chapter 13: Offenses - Miscellaneous to avoid
undue hardship upon consideration of certain factors set forth in subsection (b) of Sec. 13-
23 and after making certain alternative findings.
BE IT RESOLVED by the Board of Supervisors of the County of Roanoke, Virginia,
as follows:
1. In making its determination as to whether to grant the requested waiver to the T. E.
Ibberson Company from the County's noise ordinance, the Board of Supervisors has
considered the following factors:
a. The time of day the noise will occur and the duration of the noise: Beginning
not earlier than 1 :00 a.m. on a Monday, June 12, 2006, for not more than
fourteen (14) days and ending not tater than 11 :00 p.m. on June 25, 2006;
b. Whether the noise is intermittent or continuous: The noise produced during
the process of the monolithic concrete slip form operation is a 24-hour
continuous process of placing rebar and pouring concrete into forms and
jacking the forms as the concrete sets until the proper elevation has been
reached. This must be a continuous process to avoid cold joints and to avoid
compromising the structural design of the buildings.
c. The extensiveness of the noise: Although, the noise will be extensive, these
structures are designed to be constructed with a monolithic slip form pour.
Mennel does not have any other option to build these structures.
d. The technical and economic feasibility of bringing the noise into conformance
with the noise ordinance: There are no practical ways to construct these two
structures other than the proposed 24-hour continuous process known as the
monolithic concrete slip form operation;
e. Other matters related to the impact of the noise on the health, safety and
welfare of the community and the degree of hardship resulting from
enforcement of the ordinance: The concrete delivery trucks will use the
Benois Road entrance, delivering concrete to the site, night and day,
throughout the duration of the slip form operations. This will average one
concrete truck every 20 minutes. There will also be one concrete pump truck
placing the concrete and a crane for lifting materials to the slip deck.

f. The extent to which the noise is necessary and incidental to the commercial
and industrial use generating the sound: The noise to be generated by this
phase of construction of the Mennel Mill facility is normal and expected for
this type of operation.
2. The Board of Supervisors makes the following finding: Compliance with the
provisions of the County's noise ordinance concerning the specific act of noise
disturbance by construction machinery or operations under subsection (1) of Sec.
13-21. Specific acts as noise disturbance. or under the provision of Sec. 13-20.
General prohibition. would produce serious economic hardship for T. E. Ibberson
Company without producing any substantial benefit to the public either living in the
area of this construction or generally.
3. That the provisions of Sec.13-21. Specific acts as noise, subsection (1) and Sec.
13-20. General prohibition. of Article II. NOISE of Chapter 13. OFFENSES-
MISCELLANEOUS be WAIVED for a period of fourteen (14) days from June 12,
2006 until June 25, 2006.
4. This Waiver is granted specifically to T. E. Ibberson Company, its officers,
employees and agents for construction related activities at the Mennel Mill site
located on Benois Road in Roanoke County, Virginia.
5. That this Waiver may only be extended upon written application and approval by the
Board of Supervisors.
6. That this Resolution shall be in full force and effect from its passage.

SUMMARY OF INFORMATION:
Verizon Virginia Inc., acting through its subcontractor, T.E.C., Inc., has requested an
easement for the installation, operation, maintenance, inspection and removal of a
communications system, including burial of cable, wires, vaults and conduits as well as
related above-ground facilities, and a 10-foot wide service easement, centered on the
installed system, on the property of Roanoke County at the site of the County's new
Public Safety Center. These installations and related equipment are necessary to bring
telephone service to the Public Safety Center for the operation of the County's
Emergency 911 Center. Therefore, the easement is a necessary component of the
construction and equipping of this facility.
STAFF RECOMMENDATION:
Staff recommends approval of the first reading and that the second reading be
scheduled for May 23, 2006.

ORDINANCE AUTHORIZING CONVEYANCE OF AN EASEMENT TO

TELEPHONE SERVICE TO NEW PUBLIC SAFETY CENTER IN THE
CATAWBA MAGISTERIAL DISTRICT
WHEREAS, Roanoke County is constructing a new Public Safety Center on
Cove Road and requires telephone service to this building; and,
WHEREAS, Verizon Virginia Inc. (Verizon) requires a right-of-way and easement
for installation, maintenance, inspection and removal of a communications system along
with a Service Easement ten feet (10') in width through the Roanoke County property,
designated on the Roanoke County land records as Tax Map #036.16-01-11.1 and
located at 5925 Cove Road, Roanoke, Virginia, in the Catawba Magisterial District; and,
WHEREAS, the proposed right-of-way will serve the interests of the public and is
necessary for the public health, safety, and welfare of citizens of the County of
Roanoke.
THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That pursuant to the provisions of Section 18.04 of the Roanoke County
Charter, the acquisition and disposition of real estate can be authorized only by
ordinance. A first reading of this ordinance was held on May 9, 2006, and a second
reading was he'd on May 23, 2006.
2. That pursuant to the provisions of Section 16.01 of the Charter of
Roanoke County, the interests in rea' estate to be conveyed are hereby declared to be
surplus, and are hereby made available for other public uses by conveyance to Verizon
Virginia, Inc. for the provision of telephone service, also designated as a communication
system, in connection with Roanoke County's construction of the new Public Safety
Center at 5925 Cove Road, Roanoke, Virginia, in the Catawba Magisterial District.
3. That donation to Verizon Virginia Inc. of an easement and right-af-way for
placement of a communication system and related above-ground equipment, and a "10'
Service Easement, the centerline of which shall be the communications system facilities
as installed", on the County's property (Tax Map #036.16-01-11.1) extending from Cove
Road in the Catawba Magisterial District as shown on Verizon Drawing No. BCC-88604-
R, a copy of which is attached hereto as Exhibit A, is hereby authorized and approved.
4. That the County Administrator, or Joseph B. Obenshain, Senior Assistant
County Attorney, is hereby authorized to execute such documents and take such further
actions as may be necessary to accomplish this conveyance, all of which shall be on
form approved by the County Attorney.
5. That this ordinance shall be effective on and from the date of its adoption.

SUMMARY OF INFORMATION:
The fiscal year 2006-2007 budget was presented to the Board of Supervisors on April 25, 2006.
A public hearing was held on April 25, 2006 to receive written and oral comment from the public
concerning the proposed budget and fiscal year 2007-2011 Capital Improvements Program.
Attached for your approval is the Budget Appropriation Ordinance for fiscal year 2006-07.
The total County budget is $324,759,012. This includes all inter-fund and intra-fund transfers.
The budget net of transfers is $239,906,184.
STAFF RECOMMENDATION:
The format of the appropriation ordinance conforms to the reporting basis used at year-end in the
Comprehensive Annual Financial Report. This presentation allows the same level of budget
comparison as is required by Generally Accepted Accounting Principles for financial reporting
purposes. This format will also consistently apply the appropriation on a fund basis for County
funds as has been used to appropriate School funds in the past.
Staff recommends approval of the first reading of the 2006-2007 fiscal year budget appropriation
ordinance. Staff also recommends approval of the attached Classification Plan for fiscal year
2006-2007. The second reading and resolution adopting the budget is scheduled for May 23,
2006.

WHEREAS, upon notice duly published in the newspaper, a public hearing was
held on April 25, 2006 concerning the adoption of the annual budget for Roanoke
County for fiscal year 2006-07; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, approved
said budget on May 23, 2006, pursuant to the provisions of Section 13.02 of the
Roanoke County Charter and Chapter 25 of Title 15.2 of the 1950 Code of Virginia, as
amended; and
WHEREAS, the first reading of this appropriation ordinance was held on May 9,
2006, and the second reading of this ordinance was held on May 23, 2006, pursuant to

2. That the County Administrator may authorize or delegate the authorization of
the transfer of any unencumbered balance or portion thereof from one department to
another.
3. That all funded outstanding encumbrances, both operating and capital, at
June 30, 2006, are re-appropriated to the 2006-07 fiscal year to the same department
and account for which they are encumbered in the previous year.
4. That appropriations designated for capital projects will not lapse at the end of
the fiscal year but shall remain appropriated until the completion of the project or until
the Board of Supervisors, by appropriate action, changes or eliminates the
appropriation. Upon completion of a capital project, staff is authorized to close out the
project and transfer to the funding source any remaining balances. This section applies
to appropriations for Capital Projects at June 30, 2006, and appropriations in the 2006-
07 budget.
5. That all school fund appropriations remaining at the end of the 2005-06 fiscal
year not lapse but shall be appropriated to the School Capital Fund in fiscal year 2006-
07 as follows:
a.) Two-thirds of the year end balance in the school operating fund will be allocated
to the Major School Capital Reserve;
b.) One-third of the year end balance in the school operating fund, not to exceed
$1,000,000, will be allocated to the Minor School Capital Reserve;
c.) If the one-third allocation to the Minor School Capital Reserve exceeds
$1,000,000, the excess will be added to the Major School Capital Reserve.
6. That all General Fund unexpended appropriations at the end of the 2005-06
fiscal year not lapse but shall be re-appropriated, as provided by Resolution 122104-4,
as follows:
a) 400/0 of these unexpended appropriations shall be transferred to the un-
appropriated Minor County Capital Fund Reserve;
b) 600/0 of these unexpended appropriations shall be re-appropriated to the same
department for expenditure in fiscal year 2006-07.
7. That all General Fund revenues collected in excess of appropriated revenues
shall be re-appropriated, as provided by Resolution 122104-5, as follows:
a.) Revenues in excess of budget will first be allocated to the General Fund Un-
appropriated Balance, until the maximum amount for the current year is met, as
specified in the General Fund Un-appropriated Balance Policy, as adopted by
Resolution 122104-2;
b.) The remainder of revenues in excess of budget will then be allocated to the
Major County Capital Fund Reserve
8. Rescue fees collected by the Fire & Rescue Department in excess of
budgeted amounts will be re-appropriated and allocated to the Fire and Rescue Capital
Reserve.
9. That Two Million Dollars from the Unappropriated Fund Balance is hereby
appropriated to a Reserve for Contingency for unanticipated or emergency expenditures
that may arise during the 2006-07 fiscal year; and money allocated to the Reserve for
Contingency must be appropriated by the Board of Supervisors before such money may
be expended.
10. This ordinance shall take effect July 1, 2006.

SUMMARY OF INFORMATION:
The County Attorney's Office requests that the second reading for the approval of the
lease renewal agreement with Cisco Systems, Inc., be continued until the May 23,
2006, Board meeting to permit necessary revisions to the Telecommunications
Addendum for the rooftop antennas and equipment used by Cisco. In reviewing the
documents for the second reading, it was apparent that the previous Addendum was
out-of-date and did not reflect the County's ownership of the Salem Bank & Trust

SUMMARY OF INFORMATION:
Mr. Altizer requested this work session for the Chief of Police and County Attorney to
brief the Board of Supervisors on the activities of the Roanoke County Police
Department in responding to complaints about criminal activity occurring on the
properties of various businesses in Roanoke County. The goal of the Police
Department is to continue its community policing initiatives and to include more
involvement with the business community.
It appears that certain kinds of criminal activity are occurring on certain business
properties. This criminal activity generates a number of calls for response by County
police officers.
Chief Lavinder and his staff are developing a program to monitor these activities;
establish criteria for police response and intervention based upon the types of calls and
seriousness of the alleged offenses; early intervention by the Crime Prevention Office to
assist the business community in responding and preventing these criminal activities
through the Business Watch program; and coordinating with the Commonwealth's
Attorney and the County Attorney to utilize the courts to address recurring problems.
