The Board of Supervisors of Roanoke County, Virginia met this day at the
Roanoke County Administration Center, this being the second Tuesday and the first
regularly scheduled meeting of the month of May 2006.
IN RE:
CALL TO ORDER
Chairman Wray called the meeting to order at 3:08 p.m. The roll call was
taken.

Mr. Mahoney advised that Supervisor Church had requested the addition
of a closed meeting pursuant to the Code of Virginia Section 2.2-3711 A (5) discussion
concerning a prospective business or industry where no previous announcement has
been made.
Mr. Mahoney further advised that Supervisor Altizer had requested the
addition of a closed meeting pursuant to the Code of Virginia Section 2.2-3711 A (1)
discussion regarding the appointment of personnel, namely a representative to serve on
the Western Virginia Water Authority.
There was a consensus of the Board to add the closed meetings.

Ms. Loope advised that the Mennel Milling Company is constructing a
73,000 square foot mill off Starkey Road. The County recently received a letter from the

contractor for Mennel, T. E. Ibberson Company, requesting a waiver of the noise
ordinance under Section 13-23, Undue Hardship Waiver, from Monday, June 12,
through Sunday, June 25, 2006. Ms. Loope stated that the reason for the request is to
expedite construction activities which will include two concrete pours: one for the silos
and one for the flour mill. Each structure will require the concrete to be continuously
poured over a 24-hour period with no interruptions. This is necessary due to the
specific nature of this type of construction and the height of the individual structures.
Ms. Loope indicated that during this time, concrete trucks will be entering from Benois
Road versus the Commonwealth Industrial Park area, which should have the least
impact on the surrounding neighbors.
Ms. Loope advised that all parties understand the potential impact of this
request and are sensitive to the concerns of neighboring homes and businesses. She
noted that early in the planning stage, the County, along with Mennel Milling, held two
community meetings to educate and inform the businesses and citizens in the area
about the project and related construction plans. Ms. Loope advised that in this
instance, the County will be providing written notification to inform citizens and
businesses of the planned 24-hour construction schedule. County staff continues to
work with Mr. Mennel and his team of contractors, engineers, and management, to limit
the impact on surrounding neighbors to the extent possible. She stated that given the
special type of construction, a 24-hour concrete pour is necessary for the project to
move forward and staff is recommending approval of the request due to the limited time

frame and the fact that there is no other way to complete construction of these facilities.
Ms. Loope advised that representatives of the company and the contractor were present
at the meeting to answer any questions.
Supervisor Wray requested that the following areas be notified of the
dates of construction: all residents on Meadowlark Road, any streets that run off 'of
Meadowlark Road, and residents in the Crescent Heights area. He also requested
approval of the draft letter before it is sent to the residents and that he be provided a
listing of all residents who will receive the notice.
Supervisor Wray questioned what would happen if bad weather interferes
with the construction. Jason Eng, T. E. Ibberson, advised that construction will continue
regardless of weather. He stated that the only instance in which the job would be shut
down would be due to severe lightning. Supervisor Wray questioned if this time frame
is sufficient to complete construction of the project. Mr. Eng stated that a problem could
occur that would shut down the project; however, they feel confident that this time frame
is sufficient to complete the work.
Supervisor Wray requested an explanation of the type of noise that will be
heard and the type of process that will occur. Mr. Eng stated that there will be typical
construction sounds such as back-up alarms on trucks, concrete pumping, operation of
cranes, vibrating of forms, etc. Supervisor Wray inquired if the back-up alarms are
required by law. Mr. Eng responded in the affirmative.

Supervisor Wray questioned how many workers will be on the job site.
Mr. Eng stated that there will be 75 people per shift with two 12-hour shifts per day.
Supervisor Wray stated that granting a waiver of the noise ordinance is
part of what is required to complete construction of this facility, and he asked that the
citizens work with the County and understand the necessity of granting the waiver. He
requested that the contractor attempt to complete the construction as expeditiously as
possible.
Supervisor Wray moved to adopt the resolution. The motion carried by

RESOLUTION 050906-1 GRANTING A WAIVER UNDER SECTION 13-
23 OF THE ROANOKE COUNTY CODE TO THE PROVISIONS OF THE
COUNTY'S NOISE ORDINANCE, ARTICLE II. NOISE OF CHAPTER
13: OFFENSES - MISCELLANEOUS OF THE ROANOKE COUNTY
CODE
WHEREAS, T. E. Ibberson Company, the general contractors for the
construction of a new flour mill for Mennel Milling on Benois Road in Roanoke County,
has requested a waiver of the County's noise ordinance as contemplated under Sec.
13-23. Undue hardship waiver. to permit construction activity related to pouring
concrete for the new mill tower and annex beginning on June 12, 2006 and ending June
25,2006; and
WHEREAS, Section 13-23 of the Roanoke County Code establishes certain
standards for the Board of Supervisors to grant waivers from the provision of the
Roanoke County Noise Ordinance, Article II. Noise of Chapter 13: Offenses _
Miscellaneous to avoid undue hardship upon consideration of certain factors set forth in
subsection (b) of Sec. 13-23 and after making certain alternative findings.
BE IT RESOLVED by the Board of Supervisors of the County of Roanoke,
Virginia, as follows:

1. In making its determination as to whether to grant the requested waiver to the T.
E. Ibberson Company from the County's noise ordinance, the Board of
Supervisors has considered the following factors:
a. The time of day the noise will occur and the duration of the noise:
Beginning not earlier than 1 :00 a.m. on a Monday, June 12, 2006, for not
more than fourteen (14) days and ending not later than 11 :00 p.m. on
June 25, 2006;
b. Whether the noise is intermittent or continuous: The noise produced
during the process of the monolithic concrete slip form operation is a 24-
hour continuous process of placing rebar and pouring concrete into forms
and jacking the forms as the concrete sets until the proper elevation has
been reached. This must be a continuous process to avoid cold joints and
to avoid compromising the structural design of the buildings.
c. The extensiveness of the noise: Although, the noise will be extensive,
these structures are designed to be constructed with a monolithic slip form
pour. Mennel does not have any other option to build these structures.
The technical and economic feasibility of bringing the noise into
conformance with the noise ordinance: There are no practical ways to
construct these two structures other than the proposed 24-hour
continuous process known as the monolithic concrete slip form operation;
d. Other matters related to the impact of the noise on the health, safety and
welfare of the community and the degree of hardship resulting from
enforcement of the ordinance: The concrete delivery trucks will use the
Benois Road entrance, delivering concrete to the site, night and day,
throughout the duration of the slip form operations. This will average one
concrete truck every 20 minutes. There will also be one concrete pump
truck placing the concrete and a crane for lifting materials to the slip deck.
e. The extent to which the noise is necessary and incidental to the
commercial and industrial use generating the sound: The noise to be
generated by this phase of construction of the Mennel Mill facility is normal
and expected for this type of operation.
2. The Board of Supervisors makes the following finding: Compliance with the
provisions of the County's noise ordinance concerning the specific act of noise
disturbance by construction machinery or operations under subsection (1) of Sec.
13-21. Specific acts as noise disturbance. or under the provision of Sec. 13-20.
General prohibition. would produce serious economic hardship for T. E. Ibberson
Company without producing any substantial benefit to the public either living in
the area of this construction or generally.
3. That the provisions of Sec.13-21. Specific acts as noise, subsection (1) and Sec.
13-20. General prohibition. of Article II. NOISE of Chapter 13. OFFENSES-
MISCELLANEOUS be WAIVED for a period of fourteen (14) days from June 12,
2006 until June 25, 2006.

4. This Waiver is granted specifically to T. E. Ibberson Company, its officers,
employees and agents for construction related activities at the Mennel Mill site
located on Benois Road in Roanoke County, Virginia.
5. That this Waiver may only be extended upon written application and approval by
the Board of Supervisors.
6. That this Resolution shall be in full force and effect from its passage.

FIRST READING OF ORDINANCES

easement to Verizon Virainia. Inc. on orooertv owned ~ the

Public Safety Center. Catawba Maaisterial District. (Dan
O'Donnell. Assistant County Administrator)
Mr. O'Donnell reported that this is an easement to install, operate,
maintain, inspect, and eventually remove the necessary communications systems
(including the burying of cable wires, vaults and conduits, as well as related above-
ground facilities) to a 10' wide service easement for the new Public Safety Center on
Cove Road. He stated that this is a routine easement that is required to install phone
service to the E-911 center. He indicated that a more detailed map will be provided at
the second reading of this ordinance which will more clearly illustrate the location of the
easement. He advised that staff recommends approval of the first reading of the
ordinance.

Supervisor Church moved to approve the first reading and set the second

2. First readina of an ordinance to aoorooriate funds for the fiscal
year 2006-2007 budaet and aooroyal of the Classification Plan for
fiscal year 2006-2007. {Brent Robertson. Director of Manaaement
and Budaetl
Mr. Robertson stated that the fiscal year 2006-2007 budget was presented
to the Board of Supervisors on April 25, 2006. A public hearing was held on that date to
receive written and oral comment from the public concerning the proposed budget and
fiscal year 2007-2011 Capital Improvement Program (CIP). He advised that the budget
appropriation ordinance for fiscal year 2006-2007 was included in the Board's agenda
packet. Mr. Robertson stated that the total County budget, including the Roanoke
County schools budget, totals $324,759,012. This includes all inter-fund and intra-fund
transfers totaling $84,852,828; the budget net of transfers is $239,906,184. He advised
that staff recommends approval of the first reading of the 2006-2007 budget
appropriation ordinance and also recommends approval of the classification plan for
2006-2007. He stated that the second reading of the appropriation ordinance and
resolution adopting the budget is scheduled for May 23, 2006; however, there is still not

a budget at the state level. He advised that as we approach that date, there may be a
decision to delay adoption of the budget dependent upon action at the state level.
Supervisor Church questioned if funds for Explore Park have been
identified separately. Mr. Robertson stated that this will be presented at the second
reading of the appropriation ordinance.
Supervisor Wray requested that Mr. Robertson provide information
regarding the internal services charges to the General Fund. Mr. Robertson advised
that this is the Information Technology (IT) and Communications Department and noted
that there is an increase of $465,000. This increase is due to the following factors: (1)
three new positions; (2) the school transfer for IT operations was slightly reduced this
year and the County had to absorb more of those costs; and (3) increases in insurance
and overall operational costs of the IT and Communications Departments.
Supervisor McNamara moved to approve the first reading of the 2006-
2007 budget appropriation ordinance, to set the second reading for May 23, 2006, and
to approve the Classification Plan for fiscal year 2006-2007. The motion carried by the

IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Church: (1) He thanked Mr. Hodge and Rick Burch, Chief of
Fire and Rescue, for their assistance regarding the Schwallenberg family. He stated
that it is his understanding that a concerted effort is being made to alleviate potential
occurrences of a similar nature in the future. He indicated that the local governments
are working together and noted that other homes close to the boundary line are likely in
a similar situation. He advised that the Schwallenberg family is appreciative of the
efforts being made, and he requested that Mr. Hodge keep him posted on this situation.
Mr. Hodge advised that staff is working with Botetourt County to identify properties that
are on the boundary line and to work out an arrangement for advanced life support
(AlS) calls to be run from the nearest station. Mr. Hodge thanked Supervisor Church
for calling this to the attention of everyone involved. (2) He referenced complaints
regarding tall grass and extended appreciation to Bill Richardson, Planner I, for his
efforts in dealing with zoning violations. He asked that citizens be considerate of their
neighbors and mindful of the ordinances that are in place and designed to keep the area
beautiful. (3) He thanked the residents of North lakes for their participation in local
government. He wished a speedy recovery to King Harvey, President of the North
lakes Civic league. (4) He thanked Jim Gauldin, Roanoke County resident, who sent a
breakdown of his County real estate taxes since 1965 to the Board members. He
stated that everyone in Roanoke County takes the evaluation of real estate seriously,
and he noted that increasing taxes are associated with increasing property values. (5)

He thanked Paul Mahoney, County Attorney, for filing the necessary legal papers to
assist residents in the Red Lane Extension area. (6) He thanked Joanne Montgomery
for her work with the Glenvar teams.
Supervisor Flora: He extended his congratulations to the parents of
students who are graduating from college this month, and he referenced the recent
graduations which have occurred in the area. He advised that he will be out of town
over the weekend to attend graduation ceremonies.
Supervisor McNamara: (1) He congratulated students who continue to
attend college and stated that this is an exciting time of year for young adults due to
proms, graduations, etc. (2) He advised that a community meeting was held recently
regarding a proposed rezoning in the Bridle Lane/Stoneybrook area. He indicated that
the developer is addressing some of the concerns raised and will likely come forward
with a revised proposal. He voiced appreciation to the developer, counsel, neighbors,
citizens, and staff who have worked on this project.
Supervisor Wrav: (1) He thanked County staff for their participation in the
Clearbrook event where the time capsule that had been buried for 50 years was
opened. He stated that items have been gathered for inclusion in the time capsule
which will be re-buried for an additional 50 years. He extended appreciation to the staff
for their work with the community. (2) He thanked Teresa Hall, Public Information
Officer, for her assistance with the media and for providing assistance to the Board.

At 4:58 p.m., Supervisor Wray moved to go into closed meeting pursuant
to the Code of Virginia Section 2.2-3711 A (3) discussion or consideration of the
acquisition of real property for public purposes; Section 2.2-3711 A (5) discussion
concerning a prospective business or industry where no previous announcement has
been made; and Section 2.2-3711 A (1) discussion regarding the appointment of
personnel, namely a representative to serve on the Western Virginia Water Authority.

WORK SESSIONS
IN RE:
1:. Work session to discuss law enforcement resconse = businss
and community colicino. (Paul M. Mahoney. County Attorney:
Ray Lavinder: Chief of Police)
The work session was held from 5: 12 p.m. until 5:35 p.m.
Mr. Mahoney advised that this work session was scheduled at the request
of Supervisor Altizer and that the goal is to continue the County's successful community
policing initiatives while at the same time including more involvement with the business
community. He advised that increases in response calls to several businesses
throughout the County have been noted, and the Police Chief and his staff have

developed a program to monitor these activities and establish criteria for intervention
based on the types and numbers of calls. They will be working in conjunction with the
crime prevention office and business community to prevent these types of activities. He
stated that if this approach is not successful, the County will utilize the more traditional,
legal options available to them through either the Commonwealth's Attorney or County
Attorney's Office to address these recurring problems. Mr. Mahoney advised that there
are existing provisions in the State Code that would allow the County to take court
action through a declaration of a public nuisance to address these problems; however,
this would be used as a last resort. Staff would prefer to utilize community policing, the
crime prevention office, business watch program, and interaction with the business
community to address the problems before they get out of hand.
In response to an inquiry from Supervisor Wray, Mr. Mahoney advised
that the public nuisance provision in the State Code can cover many different types of
problems. He referenced the approach being used by the City of Norfolk to deal with
problems related to crack houses and further advised that this legislation has also been
used to address environmental nuisances. He stated that the County would be giving a
slightly different definition to common law public nuisance where there is a broad array
of problems reflected through police response (Le., fights in parking lots or the business
establishment; assaults; or other criminal activity). Mr. Mahoney indicated that Chief
Lavinder and his staff will monitor these calls and provide a report to the Board. The
report will be based on an inter-agency approach and will include data from the

following sources: responses for criminal activities; building and fire code enforcement;
health department issues; zoning violations; and law enforcement. He noted that many
of these businesses have multiple problems that need to be addressed I and the County
would use the public nuisance legislation to have the court order the business to take
steps to fix the problems.
In response to a further inquiry from Supervisor Wray, Mr. Mahoney
advised that it is difficult to quantify the costs associated with responding to these types
of calls. He stated that there will be a long-term benefit to the County in terms of
improved health and safety of the community and business environment if we invest the
time required to deal with the issues.
Supervisor Altizer indicated that he requested this work session as a
result of information he received when he rode with police officers on patrol recently.
He stated that he spoke with the officers to obtain a "street perception" of what is
occurring in Roanoke County. He advised that it is appropriate for the Board to be
proactive regarding a culture that he feels is beginning to develop. He advised that he
supports developing a plan throughout the County that will allow the Police Department
to monitor and proactively deal with businesses that have abnormally high activity. He
noted that closing down a business would be a last resort.
Supervisor Flora inquired if this approach is meant to address businesses
that are facilitating criminal activity, or businesses that happen to be located in an area
that make it convenient for criminal activities to occur. Mr. Mahoney stated that the

point is not to target specific businesses; rather, the goal is to gather data and meet with
business owners to evaluate whether the business is a facilitator of the activity or
whether they are unaware of the magnitude of the problems and are willing to work with
the County to address the issues. Mr. Mahoney advised that a key step in this process
is meeting with the business owners to share the data, explain the problem, and
suggest possible solutions. He noted that certain kinds of businesses, however, provide
a more fertile environment for illegal activity to occur.
Supervisor McNamara stated that the Police Department knows how to
best utilize their resources. He noted that large retailers are some of the major users of
police resources; however, if there are laws being violated, the County should proceed
with enforcement action.
There was a consensus of the Board to move forward with the staff

RESOLUTION 050906.3 CERTIFYING THE CLOSED MEETING WAS
HELD IN CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened
a closed meeting on this date pursuant to an affirmative recorded vote and in
accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by
the Board of Supervisors of Roanoke County, Virginia, that such closed meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of
Roanoke County, Virginia, hereby certifies that, to the best of each members
knowledge:
1. Only public business matters lawfully exempted from open meeting
requirements by Virginia law were discussed in the closed meeting which this
certification resolution applies, and
2. Only such public business matters as were identified in the motion convening
the closed meeting were heard, discussed or considered by the Board of Supervisors of
Roanoke County, Virginia.
On motion of Supervisor Church to adopt the resolution, and carried by the
