The Board of Supervisors of Roanoke County, Virginia, met this
day in open session at the Roanoke County Administration Center, Roanoke,
Virginia, this being the fourth Tuesday and the second regular meeting of
the month of January, 1983. The roll was taken.

CALL TO ORDER
Chairman May W. Johnson officially called the meeting to order
at 3:00 p.m. and entertained a motion to enter into executive session

pursuant to the Code of Virginia, Section 2.1-344 (a), (1), (2), (4), and
(6) to discuss personnel, real estate, industrial development, and legal
matters. The motion by Supervisor Nickens was carried by the following
roll call vote:

John R. Hubbard, Superintendent of Publ ic Facil ities Department,
presented a report on the use of the Community Room. Chairman Johnson
requested the County Administrator, Donald R. Flanders, and the County
Attorney, James E. Buchholtz, to develop a definition of pol itical party
so that such organizations could be allowed use of the facility.
A report
and resolution spelling out the use and rules will be presented at a
subsequent Board meeting.

Timothy W. Gubala, Superintendent of the Department of Development,
reported on the soil erosion ordinance update. A State law change in 1981
establ ished authority for development of a new state soil and erosion
handbook. Regulations set forth in it suggest that our ordinance be brought
into conformity with the State Code. The amendments were reviewed with
the County Attorney and will be legally advertised for publ ic hearing
March 8, 1983.
Timothy W. Gubala reported on the proposed zoning ordinance for
Town Houses For Sale. Supervisor Burton requested that when an article
is referred to in a report that a copy of that article be attached to the
report for reference. In Section 21 - Heights,"multi-family dwellings"
and "high-rise apartments" should read "condominiums.11 An ordinance will
be prepared for a March 8, 1983, publ ic hearing.
John M. Chambl iss, Supervisor of the Department of Fiscal
Management, reported on shift differential for law enforcement personnel
and referred to Sheriff o. S. Foster's letter to Donald R. Flanders dated
July 23, 1982. One item that was not put into effect but that was
addressed by the Board concerned shift differential for law enforcement
personnel. This morning Sheriff Foster suggested to Mr. Chambl iss that the
Board hold this in abeyance until he investigated the situation and
submitted a report. Supervisor Johnson asked Mr. Chambliss to figure out
the difference between the 5% differential and a flat amount of increase
to be calculated as of January 1 and report for a future work session.
County Board appointments to various committees, commissions, and
boards were then reviewed. Supervisor Nickens will replace Supervisor
Burton on the Bid Committee, and Supervisor Burton will replace Supervisor
Myers on the Cablevision Committee. Supervisor Minter will replace
Timothy W. Gubala on the Fifth District Employment and Training Consortium
if an excessive amount of time is not required to serve on this committee.

After discussion, on motion by Supervisor Nickens the resolution
was adopted accepting the bid of Kay Uniforms for a period of one year for
the Sheriff and Fire Departments.
RESOLUTION NO. 83-12.a ACCEPTING A CERTAIN BID MADE TO THE
COUNTY OF ROANOKE TO FURNISH UNIFORMS FOR THE SHERIFF'S DEPART-
MENT AND THE FIRE DEPARTMENT FOR A ONE YEAR PERIOD
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That that certain bid of Kay Uniforms in an amount not to
exceed $32,400, being the lowest and best bid received to furnish uniforms
for the Sheriff1s Department and the Fire Department for a one year period,
upon all and singular the terms and conditions of the invitation to bid,
the specifications of the County of Roanoke, the bidder's proposals, and

the provisions of this resolution, be, and the same hereby is, ACCEPTED;
and
2. That the County Administrator is hereby authorized and directed
to enter into a contract upon a form approved by the County Attorney for
this service; and
3. That all other bids for this service are hereby rejected and
the County Clerk is directed to so notify such bidders and express the
County's appreciation for the submission of their bids.

After discussion on motion by Supervisor Nickens the following
resolution was adopted which authorizes the County Administrator to enter into
an agreement with the Fifth District Planning Commission to assist Roanoke
County in updating its Zoning Ordinance.
RESOLUTION NO. 83-12.b AUTHORIZING THE COUNTY ADMINISTRATOR TO
ENTER INTO A CERTAIN AGREEMENT WITH FIFTH PLANNING DISTRICT
COMMISSION FOR THE PURPOSE OF UTILIZING THE FIFTH PLANNING
DISTRICT PLANNING TEAM FOR THE PURPOSE OF ASSISTING THE COUNTY
IN UPDATING THE COUNTY.S ZONING ORDINANCE
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
I. That the County Adminstrator be, and hereby is, authorized and
directed to enter into a certain agreement on behalf of Roanoke County
with the Fifth Planning District Commission, which agreement shall
contain provision for util ization of the Fifth Planning District planning

team to assist the County of Roanoke in updating the County's existing
zoning ordinance; and
2. That such agreement shall be executed on behalf of the County
of Roanoke by the County Administrator upon form approved by the County

CITIZENS COMMENTS
Mr. David Helmer, President of the Roanoke Transportation Museum,
asked for the Board's support at the 1983 Session of the Virginia General
Assembly to make the Museum the official transportation museum of Virginia.
On motion by Supervisor Minter the following resolution was adopted:
A RESOLUTION requesting the 1983 Session of the General Assembly
to adopt a resolution designating the Roanoke Transportation Museum as the
official transportation museum of the Commonwealth of Virginia.
WHEREAS, the Roanoke Transportation Museum which was founded in
1963 is operated by the Roanoke Transportation Museum, Inc., a non-profit
corporation.
WHEREAS, the museum is the largest transportation museum in the
South and the home of liThe Pride of the N&W," the Class J steam locomotive;
WHEREAS, each year the Transportation Museum serves thousands of
visitors from throughout the Commonwealth and from neighboring states;
WHEREAS, designation of the Transportation Museum as the official
transportation museum of the Commonwealth would serve to publicize the many
fine services of the transportation Museum.
THEREFORE, BE IT RESOLVED by the Board of the County of Roanoke
that:

John Apostolou, representing Charles H. Burton, appeared again
after the County Board at its October 12, 1982, session had referred the
original petition back to the Planning Commission which had petitioned that a

10.12 acre tract of land on Dent Road be rezoned from R-1 to R-3 in order to
construct condominiums. Ronald L. Ferguson, 6436 Pendleton Drive, N. W.,
Roanoke, Virginia, was recognized and presented a statement objecting to the
rezoning of the Burton Property. Supervisor Minter moved that the request for
the rezoning of the property be denied.
Supervisor Myers made a substitute motion that the matter be delayed.
The motion was defeated by the following roll call vote:

IN RE:
REPORTS OF OFFICERS, DEPARTMENTS, AND COMMITTEES
County Attorney - James E. Buchholtz requested that his report on
del inquent tax collections be held over.
The Firearms Ordinance requested from Sheriff O. S. Foster will
brought before the Board at the March 8 meeting.
At the request of the Board, Mr. Buchholtz obtained a clarification
from the Attorney General regarding the statute concerning the Board
establ ishing members salaries. He reported that he did not concur with the
opinion rendered dated January 11, 1983, and recommended that the Board direct
him to secure clarifying statutory law language. At this time Supervisor
Myers presented the following motion:
IIPrior to July 1, 1982, the Board, recognizing that the salary
of Board Members had been constant since 1975, determined to pay
its members, for fiscal 1982 - 1983, the salary provided for by the
Code of Virginia. The precept ion of the Board in 1982 was that the
demand on members' time had significantly and substantially increased
since 1975. This action of the Board was completely open in the
budgetary process.
Since an issue has lately been raised regarding this action
of the Board, and because the code provisions regarding supervisorsl
salaries are unclear and subject to various interpretations, the
members of this Board would far rather donate the extra time
required to serve the people of Roanoke County, than to have
further discussion and debate over an issue that can only divert
attention from the truly important issues which confront the
Board at this time.
Consequently, I move that the salaries for Board Members
for fiscal 1982 - 1983 be the same as paid for the prior fiscal year
and that proper adjustments be made in the supervisorsl salary
account.11

On motion by Supervisor Nickens, the County Attorney was
requested to prepare an appropriate petition to institute rezoning procedures
for the Mountain View Farms Property from R-l to M-1.
The motion was

County Administrator - County Administrator, Donald R. Flanders,
will continue to improve the format of the Board Agenda upon approval of
the Board.
Mr. Flanders reported he received a letter from the Virginia Tech
School of Business in which Dr. Giegold stated the Business School is
anxious to establ ish an intern program with Roanoke County in the areas of
finance, personnel, and data processing. The County Administrator will
continue to work with Dr. Giegold and obtain a report and make recommendations
to the Board as to how this action can be carried out in the future.
Chairman Johnson and Donald R. Flanders attended a State budget
hearing and participated in a publ ic hearing requesting that the counties
be given equal opportunity to impose a meal tax.
A meeting has been scheduled fro February 10 with Mr. Buchholtz,
members of the staff, and the Highway Department staff to review the
Colonial and Ogden Road problems.
The Administrator reported he has met with Mr. Bayes Wilson, of
the School Board, to discuss the possibility of four sites for dispensing
and monitoring gas usage. This will be pursued as work on the budget
commences.
On motion by Supervisor Nickens, approval was granted to extend the
option with Fral in & Waldron on the East County Property more particularly
described as follows to August 1, 1983:
RESOLUTION NO. 83-13 AUTHORIZING THE COUNTY OF ROANOKE TO
ENTER INTO A CERTAIN ADDENDUM TO OPTION TO EXTEND A CERTAIN

fifty-seven (57) days, at no additional cost to the County; and
2. That the County Administrator is hereby authorized and directed

authorizing the submission of a grant application for a water supply
evaluation study was adopted:
RESOLUTION NO. 83-14 AUTHORIZING THE SUBMISSION OF A GRANT
APPLICATION THROUGH THE VIRGINIA COMMUNITY DEVELOPMENT BLOCK
GRANT PROGRAM AS A JOINT APPLICATION OF ROANOKE COUNTY AND THE
CITY OF SALEM FOR A WATER SUPPLY EVALUATION STUDY
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That a certain grant application filed as a joint app1 ication
of Roanoke County and the City of Salem seeking a grant of $25,000 for a
water supply evaluation study be, and such grant application hereby is
approved and authorized to be submitted; and
2. That such application shall be executed on behalf of Roanoke
County by the County Administrator upon form approved by the County
Attorney and shall contain, among other provisions, that the County and
the City of Salem shall participate to the extent of Twenty-five Hundred
Dollars ($2,500), One Thousand Two Hundred Fifty Dollars ($1,250) each;
and
3. That an attested copy of this resolution shall be forwarded
along with said grant application to the Virginia Community Development
Block Grant Program.

County Administrator recommended to the Board that to improve our
prioritization a 10% local match be assigned ($2,500) to reflect our intent
in cooperative funding of this important project. The City of Salem has
agreed to underwrite one-half of this amount with the County. On motion
by Supervisor Minter and carried by the following roll call vote, the
appropriate resolution was adopted for the County Administrator to sign
and submit the Block Grant Appl ication.

vote it was recommended that the Board continue to regulate electronic game

refinish the outside surface and paint fourteen refuse trucks be, and
same hereby are, REJECTED; and
2. That the County Administrator be, and hereby is, directed to

Chairman Johnson next called on Superintendent of Schools,
Bayes Wilson, who requested an appropriation of $150,000 ($75,000 each
to Mt. Pleasant and Vinton Elementary Schools) to construct additions.

Chariman Johnson requested that a letter be sent to all of the
County legislators requesting that applications on file at the State for
use of the literary funds be grandfathered on the basis of the date the
appl ication was received.
Superintendent of Fiscal Management, John Chambl iss, presented an
appropriation resolution in the amount of $858 representing the low bid
to secure carpet for the stage area in the Administration Center. On
motion by Supervisor Minter the following resolution was adopted.

IN RE: APPOINTEMENTS
On motion by Supervisor Nickens and carried by a unanimous voice
vote, Mrs. Mary Barksdale was selected as the Roanoke County Representative

to the Roanoke Area Health Council until August 31, 1984, to fill the
unexpired term of Carolyn V. Pence.
On motion by Supervisor Nickens and carried by a unanimous voice
vote, Mrs. Barbara Higgins was appointed as a Roanoke County Representative
from theWindsor Hill District to the Community Services Board of the Mental
Health Services of Roanoke Valley for a three-year term beginning
January 1, 1983, and ending January 1, 1986.
Mr. James E. Barlow will be contacted by the Clerk to see if
he is will ing to serve another three-year term as the Hollins Magisterial
District Representative to the Transportation and Safety Commission
beginning January 1, 1983.
Supervisor Minter requested that the staff check all his future
appointments to see if the person currently serving is willing to be

reappointed.
On a suggestion by Timothy W. Gubala and carried by a unanimous
voice vote, it was agreed that the appointment of Gary J. Minter to replace
Timothy W. Gubala as the Roanoke County representative on the Fifth
District Employment and Training Consortium be carried over, as Mr. Minter
feels it is necessary that he check into how much time will be involved.
On motion by Supervisor Nickens and carried by a unanimous voice
vote, Mr. Gary L. Stewart was reappointed as a Roanoke County Representative
from the Catawba Magisterial District to the Air Pollution Advisory and
Appeals Board for a four-year term beginning November 12, 1982, and ending
November 12, 1986.
On motion by Supervisor Nickens and carried by a unanimous voice

vote, Mr. Wilmore T. Leffel I was reappointed as a Roanoke County
Representative from the Vinton Magisterial District to the Building Code
Board of Adjustments and Appeals for a four-year term beginning
December 12, 1982, and ending December 12, 1986.
Chairman Johnson reappointed Mr. Robert L. Price, Jr. to serve
another four-year term beginning October 24, 1982, and ending
October 24, 1986, as a Roanoke County Representative from the Cave Spring

Supervisor Myers requested that Mr. George E. Seib be contacted
to see if he is will ing to serve another four-year term as a Roanoke County
Representative from the Catawba Magisterial District to the Roanoke
Industrial Development Authority.
On motion by Supervisor Myers and carried by a unanimous voice
vote, Dr. Herbert Keaton will serve as a County at large member of the Salem-
Roanoke County Civic Center Commission. The three-year term commences
February 12, 1983, and ends February 12, 1986.
On motion by Supervisor Nickens and carried by a unanimous voice
vote, Items 10, 11, 12, and 13 on the Appointment Agenda will be held
until a future meeting.
IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS.
Supervisor Nickens would I ike the staff to look into costs of
membership fees and subscriptions. He also inquired about a key machine,
postage reimbursement, and the Big Hill Chromium Problem. John Hubbard is
to check into this. Supervisor Nickens also questioned the possibility of
a second shift at the County Bus Garage to service County vehicles, i.e.,
painting and sandblasting. Supervisor Nickens moved that the Board concur
with the County Administrator's recommendation to have Mr. Ed Fitzgerald
be responsible for disposing of damaged vehicles and parts. The motion
was carried by a unanimous voice vote.
Supervisor Myers questioned the status of the Westward Lake Dam
situation, and Mr. Hubbard indicated he had not received a response from the
State as to their assuming responsibil ity in the matter.
Supervisor Minter requested a report be prepared by the staff
outl ining problems, the options, and any actions we might need to take
regarding an EPA Air Pollution Report which stated the Valley air was not
pure. Donald R. Flanders indicated that there was an error made on the
Federal level, and that the EPA has issued a corrected report stating that
air in the Valley meets EPA safety standards.

Supervisor Minter would like the Staff to consider a flat cost of
living raise to County employees in I ieu of a percentage increase. John
Chambliss was asked to prepare a report on this.

Some inquiries were received concerning assessments. A motion was
made by Supervisor Minter to appoint a ten-person volunteer committee to
study the general concepts of assessments and answer any questions the people
may have. The motion was defeated by the following roll call vote:

Supervisor Minter requested the Assessor and the Superintendent of
the Department of Fiscal Management prepare a report on the need for a

OWNED PROPERTY
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
I. That James Michaels be, and hereby is, authorized to remove
from certain County owned property; to-wit, the property known as
the "Mountain View Farms'l tract located on old Hollins Road in Roanoke
County, a certain antique door mirror, the same having been installed by
Mr. Michael IS grandfather when the aforesaid Mountain View Farms tract
was the Michaels1s homeplace; and
2. That the Clerk to the Board shall forthwith certify a true copy

of this resolution to Mr. James Michaels.

Mr. Fuqua answered questions concerning the 911 emergency telephone

service. Representative Steve Agee has presented a bill in the legislature to
obtain funding for the 911 service and has asked for immediate support.

RESOLUTION NO. 83-20 REQUESTING SUPPORT OF AMENDMENTS TO
SECTION 58-587.2 TO ALLOW LOCAL GOVERNMENTS TO IMPOSE A TAX
THAT WOULD ALLOW FOR THE RECOVERY OF THE ACQUISITION AND
INSTALLATION OF ANCilLARY CONTROL CENTER COMMUNICATIONS
EQUIPMENT FOR ROANOKE COUNTY
WHEREAS, the General Assembly of Virginia, during its regular 1982
session, passed Section 58-587.2 enabl ing local ities to impose a tax to
recover the initial capital and installation costs of establ ishing E-911
emergency telephone service; and
WHEREAS, this enabl ing legislation did not provide for recovering
the recurring charges for ancillary control center communications
equipment and charges associated with providing E-911 service; and
WHEREAS, now that the Chesapeake and Potomac Telephone Company has
the capabilities for providing this service, the Board of Supervisors of
Roanoke County is desirous of requesting the General Assembly of Virginia
to amend Section 58-587.2 of the Code of Virginia, as amended to date,
to allow jurisdictions of the Commonwealth of Virginia to afford this
essential service to citizens by recovering acquisition and installation
costs, as well as ancillary control center communications equipment and
related charges.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of
Roanoke County, Virginia, that the General Assembly of Virginia, through
its representatives, be requested to support amendments to Section 58-
587.2 to allow local governments to impose a tax that would allow for
the recovery of the acquisition and installation of ancillary control
center communications equipment and then to reduce such tax when said
capital and installation costs have been fully recovered to the level
necessary to offset only recurring system costs, including costs for
operation and maintenance.
BE IT FURTHER RESOLVED that certified copies of this Resolution be
forwarded to the County of Roanoke's representatives in the General
Assembly, the City of Salem, the City of Roanoke, and the Town of Vinton.
