The Board of Supervisors of Roanoke County, Virginia, met this
day in open session at the Roanoke County Administration Center, Roanoke,
Virginia, this being the fourth Tuesday and the second regular meeting of
the month of February, 1983.
IN RE:
CALL TO ORDER - WORK SESSION
Chairman, May W. Johnson, called the meeting to order at 3:01 p.m.
The roll call was taken.
MEMBERS PRESENT:

Supervisors Athena E. Burton, Gary J. Minter

Chairman Johnson entertained a motion to enter into Executive
Session pursuant to the Code of Virginia, Section 2.1-344(a) (1), (2), and
(6) to discuss personnel, real estate, and legal matters. Supervisor Nickens
moved to enter into Executive Session, and the motion carried by a unanimous
voice vote.
Supervisor Minter immediately moved to return to Open Session in
order to give the County Treasurer, Alfred C. Anderson, an opportunity to
speak to the Board on a matter of publ ic concern. The motion carried by a
unanimous voice vote.
Mr. Anderson reported that Roanoke County is losing revenue due
to the failure of the City of Salem to meet its financial obI igations to the
County on time. This is causing loss of interest revenue due to inabil ity

to invest payments and also loss of revenue in the form of interest due to
the pull ing down of investments to pay County obI igations incurred for the
City of Salem. After discussion, Supervisor Minter moved that the County
Attorney be directed to investigate the contracts and determine the terms
and the dates payments are to be made by Salem.
Mr. Anderson also notified the Board that the revenue collection
of local sales tax was not the anticipated amount, and that it was $300,000

lower than expected. Chairman Johnson directed the County Attorney to look
into this to determine if any further action need be taken.
At 3:25 p.m. Supervisor Nickens moved to go into Executive Session
pursuant to the Code of Virginia, Section 2.1-344(a)(1), (2), and (6) to

discuss personnel, real estate, and legal matters. The motion carried by a
unanimous voice vote.
At 4:28 p.m. Supervisor Nickens moved to return to Open Session,
and the motion carried by a unanimous voice vote.
Mr. Edward A. Natt, representing Mr. Charles Saul, President of the
Industrial Development Authority of Roanoke County, Virginia, was present.
Mr. Natt requested that the Board establ ish an orderly procedure for processing
appl ications for industrial revenue bonds that would comply with the Federal
requirements to hold publ ic hearings. After a discussion of the procedures
to be implemented, Supervisor Burton moved that the format of the sample
resolution (Exhibit A) be accepted and that the resolution be adopted.
RESOLUTION NO. 83-30 AUTHORIZING THE INDUSTRIAL DEVELOPMENT
AUTHORITY OF ROANOKE COUNTY, VIRGINIA, TO HOLD PUBLIC HEARINGS

BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
WHEREAS, Section 103(k) of the Internal Revenue Code of 1954, as amended,
requires that a publ ic hearing be held before the issuance after
December 31, 1982, of "industrial development bonds" within the meaning of
such section; and
WHEREAS, the Board of Supervisors of the County of Roanoke, Virginia,
deems it appropriate that the Industrial Development Authority of Roanoke
County, Virginia, hold the necessary publ ic hearings on the industrial
development bonds it proposes to issue under the Virginia Industrial
Development and Revenue Bond Act:
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY
OF RONAOKE, VORGINIA:

1. The Board of Supervisors of the County of Roanoke, Virginia, until
further resolution of this Board, approves the holding of hearings required by
Section 103(k) of the Internal Revenue Code of 1954, as amended, by the
Industrial Development Authority of Roanoke County, Virginia, (the "Authority")
on all industrial development bonds proposed to be issued by the Authority.
2. This Resolution shall take effect immediately.

County Administrator, Donald R. Flanders, presented a travel pol icy
which would formal ize the rules and regulations regarding reimbursement for

travel and other expenses. After the Board reviewed the policy and made
recommendations for changes, it was noted by the County Administrator that
specifics as to reimbursement levels for expenses would be outl ined in a
separate resolution.
Superintendent of Publ ic Facilities, John R. Hubbard, reported on the
Janitorial Service Contract which requested that the existing contract be
amended to include three park and recreation offices. After discussion
concerning janitor services from the schools, Chairman Johnson asked John
Hubbard to talk to Mr. Homer Duff, of the School Board, to see what services
are required and make a comparison and bring it back to the Board.
At 6:05 p.m. Chairman Johnson called for a recess until 7:00 p.m.

RESOLUTION NO. 83-31.b AUTHORIZING THE COUNTY OF ROANOKE
TO EXECUTE A CERTAIN DEED OF EASEMENT GRANTING APPALACHIAN
POWER COMPANY AN EASEMENT ACROSS THE COUNTY'S ALGOMA WATER
TANK PROPERTY
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
I. That the County of Roanoke be, and hereby is, authorized to grant
a utility line easement to Appalachian Power Company across the County's
Agoma Water Tank property; said easement being fifteen feet in width and
being further described on a plat prepared by Appalachian Power Company
identified as Drawing No. R-1635-B and being more particularly described
in a deed of easement of record in the Clerk's Office of the Circuit
Court of Roanoke County; provided, however, the County of Roanoke shall
incur no financial 1 iability as a result of its execution of said deed of
easement and said deed of easement to be otherwise approved as to form by
the County Attorney; and
2. That the County Administrator is hereby authorized and directed to
execute the aforesaid deed of easement on behalf of the County of Roanoke.

Chairman Johnson asked for a motion to hold this over until March 8, 1983.

CITIZENS COMMENTS
Supervisor Minter introduced the recently selected Virginia Junior
Miss for 1983, Vickie Lyn Hicks, a Roanoke County resident and student at
Northside High School, and made a motion to adopt the following prepared
resolution:
RESOLUTION NO. 81-37 EXPRESSING CONGRATULATIONS TO MISS
VICKIE LYN HICKS FOR HER ACCOMPLISHMENT IN WINNING THE
JUNIOR MISS COMPETITION FOR THE STATE OF VIRGINIA FOR
1983

WHEREAS, Miss Vickie Lyn Hicks, a senior at Northside High School in
Roanoke County, Virginia, entered into the Junior MissPageantcompetition
at the several separate stages thereof; and
WHEREAS, Miss Vickie Lyn Hicks has, since her entry into such
competition, proceeded to successfully compete on a local, regional and
statewide basis; and

WHEREAS, Miss Vickie Lyn Hicks became Virginia1s Junior Miss for
1983 thus qualifying her for participation at the National Junior Miss
Competition in Mobile, Alabama in June of 1983; and
WHEREAS, as a result of winning the award as Virginia's Junior Miss
for 1983, Miss Hicks received a $3,000 scholarship along with scholarship
awards from several colleges and did further win first place awards for
physical fitness and for creative and performing arts in the statewide
competition.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of
Roanoke County, Virginia, as follows:
1. That the Board does hereby express its deepest and most prideful
congratulations to Miss Vickie Lyn Hicks for the honors brought to the
County of Roanoke, her family and the citizens of the Roanoke Valley
through her accomplishments in winning the Junior Miss Competition for
the State of Virginia for 1983; and
2. That the Board does further express its most sincere hope for
Miss Vickie Lyn Hicks successful continuation of her triumphs through the
National Junior Miss Competition to be held in Mobile, Alabama, in
June, 1983.

Mr. Stephen Emick, President of the Concerned Citizens of the
Verndale Area, petitioned the Board of Supervisors to take the following

1. Instruct the County Attorney to release to the petitioners
at the February 22, 1983, Supervisors' Meeting the status
of the legal ownership of the land in question as directed
previously by the Board of Supervisors at their meeting of
August 10, 1982.
2. Authorize funds to arrange for the immediate "temporarll
repairs to eliminate the current hazardous driving

conditions over that portion of Verndale Drive between
Plantation Road and Meadowcrest Street.
3. Take the appropriate actions to upgrade the above

Chairman Johnnson informed the citizens that the Board has
taken action and that the pot holes will be filled when the weather is
appropriate. Supervisor Nickens verified that it will be the County's
responsibility to put the road into temporary repair and keep pot holes filled
in the road on a temporary basis until it becomes a part of the State system
as a Rural Road Addition.
County Attorney, James E. Buchholtz, reiterated that ownership
of Verndale Road is partially vested in the State Department of Highways
and Transportation and partially in Roanoke County and that ownership is

not the real issue to be decided. The issue to be decided is who has the
responsibility to maintain the road. A publ ic agency does not have any
responsibil ity until the road meets the standards in order to be included
in the State Secondary System.
Supervisor Burton explained that the County does not have any
provisions for the maintenance of roads and that a special exception was
made in this case.
Two letters were received regarding the traffic problem at the
intersection of Plantation Road and U. S. Route 11. Superintendent of
Publ ic Facil ities, John R. Hubbard, reported that since the reconstruction
of Plantation Road has been delayed for approximately 18 months, an investi-
gation was being conducted to determine the need for installation of a traffic

signal at the intersection. On motion by Supervisor Burton, the letters from
Mr. Dan D. Oyler, Vice President and Director of Human Resources from
Dominion Bankshares Corporation, and Mr. T. Dalton Miller, Senior Vice
President/Operations Double Envelope Corporation, were received and filed.
The motion carried by a unanimous voice vote.

REPORTS AND INQUIRIES OF BOARD MEMBERS
1. Supervisor Myers - Absent.
2. Supervisor Minter - No report.
3. Supervisor Burton - Wanted to know the status of Westward Lake
Dam. County Administrator, Donald R. Flanders, replied that
the County is awaiting a letter from the state Water Control
Board turning the responsibil ity for addressing the problem
back to the County.
Supervisor Burton also requested a joint meeting of the
Board of Supervisors and the Planning Commission and the
Board of Supervisors and the School Board to communicate
mutual concerns in areas of understanding and cooperation.
County Administrator was directed by Chairman Johnson to
schedule a meeting after the first of March.
4. Supervisor Nickens referred to correspondence from Mr.
Homer Duff, of the School Board, which indicated the possibilit\
of making some facil ities available for vehicle maintenance
and repairs. Supervisor Nickens also requested a feasibility
study comparing the cost of contracting typewriter maintenance
with having County personnel maintenace of machines.
He also asked for an update on the chromium waste problem.
John Hubbard stated that there has not been any update from
EPA officials recently.
5. Supervisor Johnson asked for a report on the traffic light
at Ogden and Starkey Roads and the lights and signs at
Bernard Drive and Penn Forest Boulevard. John Hubbard stated
the street light and sign had been ordered.
REPORTS OF OFFICERS, DEPARTMENTS AND COMMITTEES
Sheriff o. S. Foster appeared before the Board and requested
that effective June 30, 1983, the County withdraw from participation in the
New River Pol ice Academy for the training of law enforcement personnel.
Supervisor Nickens moved for acceptance of the following prepared resolution:

RESOLUTION NO. 83-33 AUTHORIZING THE SHERIFF OF ROANOKE COUNTY TO
WITHDRAW THE ROANOKE COUNTY SHERIFF'S DEPARTMENT AS A PARTICIPANT IN
THE NEW RIVER POLICE ACADEMY EFFECTIVE JUNE 30, 1983
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as
fo 11 ows :
1. That the Sheriff of Roanoke County be, and he hereby is, authorized

to notify the New River Police Academy that the Sheriff's Department of
Roanoke County shall no longer participate in the training program
offered for the training of law enforcement personnel by the New River
Pol ice Academy from and after June 30, 1983; and
2. That the County of Roanoke shall from and after June 30, 1983,
cease to provide any funds for use for the purpose of training law
enforcement officers at the New River Police Academy; and
3. That all participation in said New River Pol ice Academy by
Roanoke County shall cease and terminate from and after June 30, 1983.

County Attorney - James E. Buchholtz requested an executive
session for the purpose of discussing a legal matter.
County Administrator - Presented the resolution authorizing the
Bid Committee to proceed with the purchase of a used automobile for the Youth
and Family Division of the Sheriff's Department. On motion by Supervisor
Burton, the following prepared resolution was adopted:
RESOLUTION NO. 83-34 AUTHORIZING THE BID COMMITTEE TO
ACCEPT CERTAIN BIDS MADE TO ROANOKE COUNTY, THE SAME TO
THEREAFTER BE APPROVED, RATIFIED, AND CONFIRMED BY THE BOARD
OF SUPERVISORS
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That in those instances where a specific appropriation has been

made by the Board of Supervisors for the purchase of used automobiles,
the Procurement Official of Roanoke County shall seek written proposals
from vendors of used automobiles to be offered to be sold to Roanoke
County; and
2. That upon receipt of such proposals, and recognizing the
instabi1 ity of the used automobile market, such proposals shall imme-

diately be presented to the bid committee which said bid committee shall
have authority to accept the lowest and best proposal made to the County
to supply the automobile meeting the needs of the County; provided,

however, the acceptance of any such proposal shall not incur for Roanoke
County the expenditure of a sum in excess of the specific appropriation
made for such purchase; and
3. That following the acceptance of such proposal by the Bid
Committee the same shall be presented to the Board of Supervisors at its
next succeeding regular meeting to be duly approved, ratified, and
confirmed as made and provided by law.

In accordance with the previous resolution, Supervisor Nickens

moved to adopt the following prepared resolution to purchase a 1981 Chrysler
for the Sheriff's Department:
RESOLUTION NO. 83-35 ACCEPTING A CERTAIN BID MADE TO THE
COUNTY OF ROANOKE FOR THE PURCHASE OF AN AUTOMOBILE FOR USE BY
THE ROANOKE COUNTY SHERIFF'S DEPARTMENT
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That that certain bid of National Car Rentals in the amount of
$5,025.00, being the lowest and best bid received for the purchase of a
1981 Chrysler automobile for use by the Roanoke County Sheriff's Department,
upon all and singular the terms and conditions of the invitation to bid,
the specifications of the County of Roanoke, the bidder's proposals, and
the provisions of this resolution, be, and the same hereby is, ACCEPTED;
and
I
2. That the County Administrator is hereby authorized and directed
to enter into a contract upon a form approved by the County Attorney for
this purchase; and
3. That all other bids for this purchase are hereby rejected and
the County Clerk is directed to so notify such bidders and express the
County's appreciation for the submission of their bids.

Donald R. Flanders presented a request from Salem Roanoke County
Civic Center to cost share the deficit from 1981 - 1983 and projected deficit
for the 1982 - 1983 year in the amount of $43,000. The City of Salem has
already supported this. Supervisor Myers, who is a member of the Salem
Roanoke County Civic Center Commission, supports partial payment of the
costs incurred last year and requested a study be conducted to find ways
to minimize the deficit for the current year. Mr. Flanders presented a
resolution authorizing a payment of $15,000. After discussion of expenses
of power and purchase of furniture which was not authorized in the budget,
Supervisor Nickens requested a meeting be held with the appropriate represent-
atives of the Civic Center to investigate the situation. On motion by
Supervisor Nickens, it was requested that no action be taken on the prepared
resolution until after a meeting is h1d. The motion carried by a unanimous

voice vote.
Mr. Flanders explained the necessity to install wiring and
electrical equipment for the computer terminals at the Courthouse. On
motion by Supervisor Burton, the following resolution was adopted:
RESOLUTION NO. 83-36 ACCEPTING A CERTAIN PROPOSAL MADE TO
THE COUNTY OF ROANOKE FOR WIRING OF COMPUTER TERMINALS FOR THE
VARIOUS CLERKS OF COURT IN THE ROANOKE COUNTY COURTHOUSE
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That that certain proposal of Noell Electric in the amount of
$2966.16, being the lowest and best proposal received for wiring of
computer terminals for the various clerks of court in the Roanoke County
Courthouse, upon all and singular the terms and conditions of the invitation

to bid, the specifications of the County of Roanoke, the bidder's proposals,
and the provisions of this resolution, be, and the same hereby is,
ACCEPTED; and
2. That the County Administrator is hereby authorized and directed
to enter into a contract upon a form approved by the County Attorney for
this work; and

Mr. Flanders suggested that the people interested in Cablevision
in Bridlewood attend the Cablevision Committee publ ic hearing for rate
increases since Bridlewood is not being considered again until 1984.
Supervisor Burton questioned why the considerable number of signatures on
the petition did not reflect adequate number of residences per mile to
justify installation of the Cablevision system.
County Administrator Donald R. Flanders reported the State
Legislature adopted a $1 surcharge on vehicles registration fees to be used

to fund emergency services. Mr. Thomas Fuqua, Fire and Emergency Services
Coordinator, has informed Mr. Flanders there will be a cash payback equal
to one-fourth of the vehicles registered; and since Roanoke County has
approximately 50,000 vehicles, the amount would be $12,500. Mr. Flanders
also stated that in addition, an amount up to 50% funding would be available
to fund capital projects from the surcharge. The County will be seeking
funding for an ambulance in the budget year.
The plaques have not yet been put up on the Fort Lewis and Hollins
Fire Stations. After change orders are presented for the lofts and lighting
at the two fire stations, a balance of approximately $10,000 will remain in
the Bond funds for fire station improvements.
Department of Development - Timothy W. Gubala reported that
Supervisor Minter had brought to the staff's attention that the Hitching

Post Home for Adults had trash on the property and that residents were
wandering about in the Hollins area. He requested that the Board authorize
the Zoning Administrator to prepare a zoning ordinance amendment so that in
the future homes for adults would be requi~ed to obtain a Special Exception
Permit. Supervisor Burton moved that the Planning and Zoning Departments
prepare the appropriate zoning ordinance amendment, bring it to the Board,
and then have a publ ic hearing on the matter. The motion carried by a
unanimous voice vote.

IN RE: APPOINTMENTS
Upon recommendation by Chairman Johnson, Supervisor Minter moved,
and the motion carried by a unanimous voice vote that Mr. Ted R. Powell, of
the Cave Spring Magisterial District, be reappointed to the Court Service Unit
Advisory Council/Youth and Family Services Advisory Board for another two-year
term effective March 22, 1983, and ending March 22, 1985.

On motion by Supervisor Nickens and carried by a unanimous voice
vote, Mr. Matthew Banks was selected as the County at large appointee to the
League of Older Americans for a one-year term beginning April 1, 1983, and
ending March 31, 1984.
On motion by Supervisor Minter and carried by a unanimous voice vote
Mr. B. Arnold Davis was appointed from the Holl ins Magisterial District for a
three-year term beginning January 1, 1983, and ending January 1, 1986, to
the Transportation and Safety Commission.
IN RE:
WORK SESSION - STREET LIGHT EVALUATION POLICY
John Hubbard explained the need for establishing a procedure to be
followed when street lights are requested. The procedure should be safety

oriented. Chairman Johnson requested that the last ten street lights
installed be rated on the charts which were provided by the Department of
Public Facilities as to the criteria being adequate. Mrs. Johnson asked that
a report be submitted to the Board on the results of the study.
Chairman Johnson then entertained a motion to enter into Executive
Session at 8:40 p.m. pursuant to the Code of Virginia, Section 2.1-344 (a),
