Chairman Johnson called the meeting to order at 11:20 a.m. The roll call

BUDGET WORK SESSION - EXECUTIVE SESSION
Chairman Johnson entertained a motion to go into Executive Session pursuant
to the Code of Virginia, Section 2.1-344(a), (1), (2), and (6) to discuss personnel, rea
estate, and legal matters. Supervisor Minter made the motion, and it carried by
unanimous voice vote.

At 1:45 p.m. the Executive Session was reconvened. Supervisor Robert E
Myers arrived at 2:55 p.m.

Westward Lake Dam - Mr. Frank Caldwell, of T. P. Parker & Son, outlined
the contents of the general evaluation report on Westward Lake Dam which was jointly
prepared by T. P. Parker & Son and Geotechnics, Inc. The report recommended
breaching the dam as the most economically feasible solution to eliminating the

current hazardous situation. Supervisor Myers moved to send a copy of the report to
the owner of the dam, Mr. Frank Sellers, and a letter advising him that he has ten. days
to begin correcting the problem. The motion carried by the following roll call vote:

ABSENT: Supervisor Burton
If no reply is received from Mr. Sellers, as he has not responded to any
County letters in the past, the County will begin correcting the problem and proceed
with filing suit in an attempt to recover the consultant's fees, legal fees, and the
construction costs.
Planned Parenthood - Mr. Ronald Kaminski, of Shenandoah Baptist Church,

read an appeal of the pastor, Robert L. Alderman, opposing the $5,000 budget request
from Planned Parenthood. Supervisor Nickens moved that Item H (titled Planned
Parenthood) be stricken from the Agenda, and the motion carried by a unanimous voice
vote.
Commissioner of Revenue - Wayne Compton appealed to the Board because
his office received approximately a 5% cut in operating funds from the State. Since
State cuts affect all Constitutional Officers, the Sheriff's Department, and the Clerk
of Circuit Courts, Supervisor Myers moved to organize a public luncheon for the Board
and all these people to meet with the local legislators to discuss the cuts and obtain
their recommendations and advise as to what the County can do.

The State also did not accept Mr. Compton's request for one additional
staff person. Mr. Compton has appealed the decision of the State Compensation Board

EXECUTIVE SESSION - SCHOOL BOARD
At 4:05 p.m. Supervisor Nickens moved to go into Executive Session pursuant
to the Code of Virginia, Section 2.1-344(a), (2), and (6) to discuss real estate and legal
matters with the Roanoke County School Board. The motion carried by a unanimous
voice vote.

RESOLUTION NO. 83-98.a CANCELING THE BOARD OF
SUPERVISORS' MEETING TO BE HELD ON July 26, 1983
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That the regular meeting of the Board of Supervisors scheduled for July
26, 1983 is hereby canceled; and
2. That all public hearings heretofore scheduled and advertised for July 26,
1983, shall be held August 9, 1983, without further advertisement as if same had
been duly advertised for August 9, 1983; and
3. That a duly attested copy of this resolution shall be published in the
newspaper having general circulation in Roanoke County on July 12, 1983 and July
19, 1983; and further posted on the front door of the Roanoke County Courthouse

THE COUNTY OF ROANOKE FOR INSTALLATION OF A BASE
AND MOUNTING ANTENNA FOR THE FIRE DEPARTMENT
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,

1. That that certain bid of Southeastern Electrical Contractors in the amount
of $3,911.00, being the best bid submitted for installation of a base and mounting
antenna for use by the County Fire Departments, upon all and singular the terms
and conditions of the invitation to bid, the specifications of the County of Roanoke,
the bidders proposals, and the provisions of this resolution, be, and the same hereby
is ACCEPTED; and
2. That the County Administrator is hereby authorized and directed to enter
into a contract upon a form approved by the County Attorney for this work; and
3. That all other bids for this work are hereby rejected and the County
Clerk is directed to so notify such bidders and express the County's appreciation

1. That the grant applications submitted by the Roanoke County Sheriff's
Department to the Virginia Department of Transportation Safety for the following
projects be, and same are hereby, APPROVED:
(a) Request for sixteen Alco-Sensor field breath test units.
(b) Request for a prevention/education program (driver/highway safety films
and brochures to take into Roanoke County Schools to educate school
aged children on the dangers of driving after drinking and also on the
benefits of passenger restraints.)
(c) Request for traffic records improvements.
(d) Request for radar unit for use by patrolmen with the Sheriff's Department.
2. That the County Administrator be, and hereby is, authorized to execute
the necessary contracts for these grant applications.
3. That the Clerk of the Board of Supervisors is hereby directed to forthwith

EXCEPTION TO PLACE A MOBILE HOME TO BE OCCUPIED
BY MICHAEL AND BONNIE JOURNELL ON A 2.25-ACRE

Hearing no opposition, Supervisor Nickens moved that the petition be

PETITION OF INEZ E. STUMP FOR A SPECIAL EXCEPTION
TO PLACE A MOBILE HOME ON A 5-ACRE TRACT LOCATED
OFF STATE ROUTE 221 SOUTH, LEFT ON STATE ROUTE 696
TO WHISTLER DRIVE (ROUTE 1499) .2 MILES PROPERTY ON
RIGHT IN THE WINDSOR HILLS MAGISTERIAL DISTRICT.
HELD OVER
Mr. Henry J. Meade, Jr., Route 7, Box 271, Roanoke, 24018 was present.
He first indicated that Route 1499, Whistler Drive is incorrect and that the correct
Route is 696. He supported granting the petition to Mrs. Stump.
Mr. J. Mark White, 6718 Oleander Circle, Roanoke, was present to speak
in favor of the petition. He represented the manufacturer of the mobile home.
Mr. J. B. Harrison, 7275 Whistler Drive, Roanoke presented a petition in
opposition to this mobile home because there is already a mobile home on this
particular property, and a second mobile home on the property would be in violation
of the County Code Section 21-21, Article 10, paragraph (h).
Mr. J. Mark White presented a letter of approval from a neighbor of
Mrs. Stump, Billie Kerfoot. He also had blueprints and a picture of the mobile home.

After discussion, it was determined that the staff did not know this was
to be the second mobile home on this property. Supervisor Minter moved to refer
this to the Chief Building Inspector for him to determine if this is actually a mobile

home. If it is, then Mrs. Stump will have to go to the Board of Zoning Appeals. If
this is determined to be a home, then Mrs. Stump will not have to come back to
the Board of Supervisors with this petition. The motion carried by a unanimous
voice vote.
Supervisor Nickens requested two items be added to the Application for
Special Exception to the Zoning Ordinance. (1) Is there another trailer/mobile home
on the parcel? (2) If the "New Mobile Home Block" is checked, designate the
identifying information from the seal of the mobile home which determines whether

The right to approve or disapprove the proposed plan shall rest wi th Hollins ColI ge

3. No building or structure above ground shall extend beyond the setback IiI ~s,
and it is hereby declared that the area between the setback lines, and it is her by

6. The form, content and location of all signs shall be submitted to and appro ed

7. Fuel oil storage tanks as a part of the heating equipment of any establishm nt
shall be located underground and at a depth and location in full compliance with r les
and regulations of any governmental agency or agencies having jurisdiction over ~ ch
matters. Bulk storage of all liquids, including gasoline or petroleum products on he
outside of buildings, shall be permitted only in locations which will not detract from he

11. Invalidation of anyone of these covenants or any part thereof by judgmen or

constructed on the 25.76 acres.
(6) All units constructed on the 25.76 acres shall be finished to grade.
(7) The lighting for the pool and tennis courts will be directed and screened to
minimize its penetration into the residential subdivisions known as North Ardmore
and Waterfall Lake.

Mr. Barry Lee Terry was present and indicated that he had a petition
containing 151 names supporting the petition for rezoning. The citizens present were
concerned about adequate parking and the additional traffic problems that might be

created on the corner of Brambleton and Custis Avenues. Mr. Frank Umberger expressed
these concerns on behalf of the citizens and presented a petition opposing the restaurant.
At the recommendation of Chairman Johnson, Supervisor Minter moved to refer this
back to the Planning Commission in order to more clearly define "family restaurant"
and to review the concerns of the citizens. Since B. T. Partnership had complied with
all the requirements for the petition to rezone, Supervisor Nickens made a substitute
motion that the petition be granted.

The citizens in the area of Plantation Road submitted a petition opposing
the tractor-trailer truck traffic in that area. Supervisor Minter moved that a letter
be sent to the Sheriff, the Highway Department, and the State Police requesting
that action be taken against trucks that are bypassing the weighing scales and going
into residential areas. The motion carried by a unanimous voice vote.

REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Myers - moved to increase the salaries of the Planning
Commission members $25 per month. The motion carried by the following roll call vote:

Supervisor Minter - moved that the Board instruct the County Attorney
to send letters to people owing delinquent taxes and outlining action that would be
taken against them if they did not pay. Supervisor Nickens made an addition to

describing what action can be taken against these people. The motion carried by
a unanimous voice vote.
Supervisor Minter moved that $100,000 be reallocated from the County
health insurance contingency fund to add three deputies to the Sheriff's Department,
one for each shift. After discussion concerning the self-funded health insurance
plan, Supervisor Minter moved that three road deputies be added, one for each shift
at a cost of $100,000; and that the budgeting of this amount can be discussed later.
Supervisor Myers pointed out that the Sheriff is not making this request. Chairman
Johnson questioned what the State maximum requirements are in this regard. The

County Attorney - James E. Buchholtz reiterated that guidelines have
been received from the Attorney General and V ACo regarding the establishment of
County Board Members' salaries. At the request of the Board of Supervisors, he
prepared a resolution with blanks to be filled in before adoption. He advised that
the salaries set can be paid to any Board Member elected for a four-year term
commencing from and/or after January 1, 1984. Supervisor Myers moved to set the
salary amounts at $4,800 for Board Members, $6,000 for the Chairman, and $5,200
for the Vice Chairman, and Supervisor Minter moved for the following prepared

The County Attorney will draft suggested legislation to try to synchronize the
salaries of the Board Members.
County Administrator - Donald R. Flanders, reported on the Work Session
results of the Westward Lake Dam situation, and Supervisor Myers again moved to
send a copy of the report to the owner of the dam, Mr. Frank Sellers, and a letter
advising him that he has ten days to begin correcting the problem. The motion
carried by a unanimous voice vote.
Congressman James Olin and Senator Paul Trible have expedited approval
to allow extension of water lines to the Big Hill area in regard to the ehromium
spill, and Mr. Flanders pointed out that this is a step forward in a project that was
started six or seven years ago.
A work session updating the progress on the work at the new courthouse
is scheduled for June 28.
A $64,000 preliminary grant application has been prepared for Federal
and State aid for landscaping County parks. A formal resolution will be brought to
the Board at the June 28 session regarding this.

into a thirty day option agreement dated June 14, 1983, with Morton C. Rosenberg
for the purchase of property known as Lots 5 and 6 of Mount Vernon Heights; and

That the County Administrator is hereby authorized and directed to
execute this option agreement on behalf of Roanoke County upon a form approved
by the County Attorney.

More than $34,000 has been cut by the State in the Commonwealth
Attorney's, the Commissioner of Revenue's, and the Treasurer's Offices. The cuts
in the Clerk of Circuit Court and the Sheriff's Department are not known yet. A
luncheon will be scheduled to meet with the six State Legislators in order to obtain
their advise on how the County should react to this problem.
The committee organized to microfilm and transfer existing records for
storage in the new Courthouse has requested the allocation of $160,000 for capital
improvements and $72,000 for salaries. Supervisor Nickens moved that a resolution
be prepared for the June 28 Board meeting authorizing the retention of two people on

a project basis for the length of time it takes to microfilm and prepare the records
for transfer to the new building. The motion carried by the following roll call vote:

At Mr. Flanders' request, Superintendent of the Department of Public
Facilities, John Hubbard, reported that additional parking and regrading and surface
treating of the road adjacent to the Mount Pleasant Fire Department would cost
approximately $3,500 to $4,000. Supervisor Nickens moved to proceed with this
work, and the motion carried by the following roll call vote:

The Fire and Rescue chiefs have requested decals for their employees'
pickup trucks. The differential between the auto decals and the pickup truck decals
would amount to approximately $600 additional in the Fire and Emergency Services
budget. Supervisor Myers moved that the request be granted, and the motion carried
by the following roll call vote:

Mr. John Hubbard distributed the 5-Year Capital Improvement Plan for
1983-1984, which listed Industrial Development, System Replacement, Health
Improvements, System Improvements, and Petitioned Improvements for water and
sewer projects. After reviewing the Plan, Mr. Flanders pointed out that the County
is paying for these projects, without any Federal or State assistance, through the
current rate structures and that future planning and teamwork among all departments
is necessary.
Since approximately $31,000 was designated for specific park projects,
the Department of Public Facilities recommended $14,000 for Waldron Park parking
and access, $14,000 for Ogden Senior Citizens Center additional parking and paving
of parking lot, and $3,000 for a contingency fund. Mr. Flanders also reminded the
Board that the local match for construction of Mount Pleasant and Stone bridge Parks

must come from the building contingency budget.
The Mental Health Services of Roanoke Valley requested $63,929. The
Board allocated $60,000. After receiving further information, Chairman Johnson
discovered that Mental Health Services received approximately $8 for every dollar
that the County gives and requested that the County increase the amount from
$60,000 to $63,929. Supervisor Minter moved for the increase, and the motion
carried by the following roll call vote:

A work session will be scheduled for the future for non-profit agencies
requests for money.
A report on memberships' dues and publications is being prepared and
will be brought to the Board at a future meeting.
Concerning the request for the cost of a mechanic to service County
vehicles at the School Board Garage, John Hubbard reported that it would cost
approximately $19,000 including benefits, and using our mechanic at the Roanoke
Street location would cost $16,000.
Supervisor Nickens requested the cost of adding two preconstructed/pre-
engineered bays across the street from the current County garage for the servicing
of vehicles. Supervisor Nickens moved for a written agreement and the assignment
of approximately $20,000 to be used in developing a plan with the School Board for
vehicle maintenance which would also include automated record keeping. The motion
carried by the following roll call vote:

amount of $150,000 for the 1983-84 budget year. The motion carried by the following

presented to Helen M. Tankersley expressing appreciation for her dedicated service

RESOLUTION NO. 83-105 EXPRESSING APPRECIATION TO
HELEN M. TANKERSLEY UPON HER RETIREMENT FOR HER
DEDICATED SERVICE TO ROANOKE COUNTY AND ITS
CITIZENS
WHEREAS, Helen M. Tankersley commenced employment in the public sector
on November 1, 1965, as an account clerk with the Roanoke County Sanitation
Authority; and
WHEREAS, Mrs. Tankersley, through most proficient performance, rose to the
position of Supervisor of Account Collections for the Roanoke County Public Service
Authority; and
WHEREAS, Mrs. Tankersley, as an Account Clerk III, became senior member
of the Roanoke County Billing and Collections Department upon dissolution of the
Authority on July 1, 1980, from which position she has determined to retire effective

June 30, 1983.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County as follows:
1. That the Board does express its deepest and most sincere appreciation
to Mrs. Helen M. Tankersley for her long and dedicated service to Roanoke County
and its citizens; and
2. That the Board does wish for Mrs. Tankersley a long, fruitful and happy
retirement; and
3. That an authenticated copy of this resolution, duly displayed, be forthwith
presented to Mrs. Helen M. Tankersley.

Department of Public Facilities - Superintendent, John Hubbard reported
that the Virginia Department of Highways and Transportation administers federal
funds to be matched by localities for construction projects on secondary highways.

If the Board wishes to participate in this revenue sharing, Mr. Hubbard recommended
a resolution requesting $11 ,812.83 be carried to the 1983-84 budget revenue sharing
fund account to be matched for the Plant Mix Program for Roanoke County. A list
of priorities is to be sent to the Highway Department. Supervisor Minter moved for
the following prepared resolution:
RESOLUTION NO. 83-106 REQUESTING THE VIRGINIA
DEPARTMENT OF HIGHWAYS AND TRANSPORTATION TO
UTILIZE CERTAIN FUNDS HERETOFORE APPROPRIATED BY
THE BOARD OF SUPERVISORS IN ITS SECONDARY ROUTE
PLANT MIX PROGRAM IN ROANOKE COUNTY
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That the Board of Supervisors of Roanoke County, having heretofore in
fiscal 1982-83 appropriated certain funds which together with matching highway

department funds totaled $11,812.33 to be utilized in the secondary route plant mix
program in Roanoke County, which said funds remain unexpended during fiscal 1982-
83; and
2. That the Board does hereby expressly request the Virginia Department of
Highways and Transportation to carryover the aforesaid $11,812.33 into the 1983-
84 fiscal year budget in the revenue sharing fund account thereof and in addition
thereto to match such funds as are simultaneously herewith or hereafter appropriated
by the County in an additional amount not to exceed $50,000; and
3. That a duly attested copy of this resolution be forthwith forwarded to
the Virginia Department of Highways and Transportation, Salem Residency Office.

#1 well lot. Supervisor Nickens moved for the following prepared resolution which

RESOLUTION NO. 83-107 AUTHORIZING THE COUNTY OF
ROANOKE TO EXECUTE A DEED OF EASEMENT GRANTING
C & P TELEPHONE CO. AN EASEMENT ACROSS THE PENN
FOREST #1 WELL LOT
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That the County of Roanoke be, and it hereby is, authorized to grant
an easement allowing a 19' x 10' buried cable easement over the Penn Forest #1
Well lot; provided, however, that the County of Roanoke shall incur no financial
liability as a result of its execution of this deed of easement, and this deed of
easement to be otherwise approved as to form by the County Attorney; and
2. That the County Administrator be, and hereby is, authorized and directed
to execute the aforesaid deed of easement on behalf of the County of Roanoke.

The high grass, weeds, and the abandonment of the building at Mountain
View Research & Technological Park has created an atmosphere for vandalism. It
would cost $4,500 to tear down the building, or another alternative would be to burn
it in a fire exercise. Supervisor Minter moved that the building be burned, and the
motion carried by a unanimous voice vote.
The original priorities set by the Board on April 12, 1983, for the Rural

Addition Program have been submitted to the State Highway Department. In order
to proceed with the construction while waiting for additional material to complete
the packages on Bradshaw Road and South Mountain Drive, a reprioritization of the
original list is being requested. Supervisor Minter moved for the reprioritization.

RESOLUTION NO. 83-109 RECOMMENDING CERTAIN
STREETS, HIGHWAYS, AND ROADS LOCATED IN ROANOKE
COUNTY BE TAKEN BY THE STATE DEPARTMENT OF
HIGHWAYS AND TRANSPORTATION AS RURAL ADDITIONS
AS MADE AND PROVIDED BY LAW
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That a certain portion of a certain street known as Mountain Park Drive
in the Westward Lake Estates Subdivision situate in the Catawba Magisterial District
extending from the terminus of State Secondary Route 1146 in a northerly direction
approximately 0.14 mile is hereby recommended as a rural addition pursuant to
Section 33.1-72.1 (C1) of the 1950 Code of Virginia, as amended; and
2. That a certain portion of a certain street known as an extension of State
Route 943 situate in the Cave Spring Magisterial District, being a section of such
road approximately 0.10 mile long to its end, is hereby recommended as a rural
addition pursuant to Section 33.1-72.1 (C1) of the 1950 Code of Virginia; and
3. That a certain portion of a certain street known as Eveningwood Lane
in the North Lakes Subdivision situate in the Hollins Magisterial District, being a
section of road running from North Lakes Drive to Summer Drive, is hereby
recommended as a rural addition pursuant to Section 33.1-72.1 (C1) of the 1950 Code
of Virginia, as amended; and
4. That a certain portion of a certain street known as Bradshaw Road in
the Mason Village Subdivision situate in the Catawba Magisterial District, being a
section of road approximately 948 feet in length between State Secondary Route
864 and John Robertson Road and thence, for turnaround purposes, along John
Robertson Road 25 feet in a northwesterly direction, is hereby recommended as a
rural addition pursuant to Section 31.1-72.1 (C1) of the 1950 Code of Virginia, as
amended; and
5. That a certain portion of a certain street known as an extension of State
Route 875 (South Mountain Drive) situate in the Cave Spring Magisterial District,
being a section of such road approximately 0.07 mile long to its end, is hereby
recommended as a rural addition pursuant to Section 33.1-72.1 (C1) of the 1950 Code
of Virginia, as amended; and

6. That those certain streets, to-wit: Airpoint Drive in the Airpoint Estates
Subdivision in the Windsor Hills Magisterial District in its entirety, and Airpoint

from the intersection of Airpoint Road and Orchard Drive to the intersection of
Airpoint Road and Airpoint Circle, are hereby recommended as rural additions pursuant

Department of Development - At the May 24, 1983, meeting of the Board
of Supervisors recommended rezoning for the surplus properties. Because the rezoning
may increase marketability to a prospective buyer, this matter has been referred to
the County Administrator to initiate the rezoning process.
In order to apply for an approximate $29,000 Air Pollution Control Grant,
Supervisor Minter moved for the following prepared resolution:

Work Session - Building Official's Job Description - Mr. R. A. Franklin

Work Session - 1983 Virginia Community Development Block Grant Program
Supervisor Minter moved to direct the Department of Development to proceed with the

application for funds for an industrial site development on West Ruritan Road and
the public hearing. The motion carried by a unanimous voice vote.

Work Session - Regulation of Homes for Adults The Zoning Ordinance is
to be amended to more clearly define the provisions, placements, and definitions of
homes for adults, hospitals, clinics, special care hospitals, nursing homes, and
residential human care facilities. Supervisor Minter moved to schedule the public
hearing, and the motion carried by a unanimous voice vote.
