HomeMy WebLinkAbout11/10/1981 - Regular r 11-10-81 180 Board of Supervisors Salem-Roanoke County Civic Center Salem, Virginia November 10, 1981 The Board of Supervisors of Roanoke County, Virginia, met this day I in open session at the Salem-Roanoke County Civic Center in Salem, Virginia, this being the second Tuesday and the first regular meeting of the month of November. Members present: Chairman Robert E. Myers, Vice-Chairman Lawrence E. Terry and Supervisors Edward C. Park, Jr. and T. M. White. Members Absent: Supervisor May Johnson. IN RE: CALL TO ORDER Chairman Myers called the meeting to order at 6:00 p.m. IN RE: EXECUTIVE SESSION On motion of Supervisor Park and a unanimous voice vote, the Board I went into Executive session at 6:01 p.m. to discuss real estate, legal matters, and pending litigation. IN RE: CALL TO ORDER The meeting was again called to order by Chairman Myers at 7:00 p.m. IN RE: INVOCATION AND PLEDGE Invocation was offered by John Chambliss, Director of Finance, and the Pledge of Allegiance to the Flag was recited in unison. IN RE: APPROVAL OF MINUTES On motion of Supervisor Terry and a unanimous voice vote, the I minutes for the regular meeting of October 27, 1981 were approved as submitted and received in file. FINAL ORDER NOW, THEREFORE, BE IT ORDERED that the aforementioned tract of land, more particularly described below, be rezoned from Office and Residential I District B-1 to Business District B-2. Beginning at the iron pipe on the westerly side of Starkey Road (Virginia Secondary Route 904, formerly known as Route 119 or the Franklin Turnpike), which point is 203.8 feet, as measured along the westerly side of Starkey Road, from the south side of Penn Forest Boulevard (formerly the Floyd Road); thence with the westerly side of Starkey Road, S. 110 16' W. 110 feet to an iron pipe (the beginning point in the former description); thence with the northerly line of Lot 5, S. 840 36' W. 213.1 feet to an iron pin in the easterly line of Lot 9; thence with the easterly lines of Lots 9 and 11, N. 50 00' W. 106.74 feet to an iron pin; thence with the southerly lines of Lots 10 and 3, N. 840 55' E. 243.9 feet to the place of BEGINNING, and being Lot 4 as shown on the Map of Willow Dell, property originally owned by C. Adopted on motion of Supervisor Lawrence Terry and upon the following recorded vote: AYES: Supervisors Park, Terry, White and Myers NAYS: None ABSENT: Supervisor Johnson I IN RE: PUBLIC HEARING TO AMEND CHAPTER 4 OF THE COUNTY CODE RELATING TO THE OPERATION AND HOURS OF OPERATION OF PRIVATE SWIM CLUBS IN ROANOKE COUNTY. James Buchholtz, County Attorney, stated that some complaints have been received in relation to the lateness of the hours of operation for swim clubs in the County. He further explained the proposed amendment in comparisor with the current County code. The following amendment was adopted. ~ 11-10-81 184 IN RE: ORDINANCE NO. 3017 AMENDING C}~PTER 4. AMUSEMENTS OF THE ROANOKE COUNTY CODE BY THE ADDITION OF AN ARTICLE REGULATING PRIVATE SWIM CLUBS IN ROANOKE COUNTY. BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That Chapter 4. Amusements of the Roanoke County Code be amended I by the addition of a new article to govern the location, operation and hours of operation of private swim clubs as follows: CHAPTER 4. AMUSEMENTS Article VI. Private Swim Clubs Sec. 4-15. Location and Operation. Private swim clubs shall be located and operated in accordance with the zoning ordinance of Roanoke County. Licensing shall be as required by the Commissioner of Revenue and Virginia State Health Department. Sec. 4-16. Hours of Operation. Private swim clubs located in residentially zoned areas shall close no later than 10:00 p.m. weekdays and Sundays, and 11:00 p.m. Saturdays. This amendment to be of full force and effect from and after its passage. I Adopted on motion of Supervisor Terry and the following recorded vote. AYES: Supervisors Park, Terry, White and Myers NAYS: None ABSENT: Supervisor Johnson IN RE: INTRODUCTION OF THE COUNTY ADMINISTRATOR Chairman Myers introduced Don Flanders to the public and press as the new County Administrator for Roanoke County. Mr. Flanders was welcomed by all present. Mr. Flanders expressed thanks to the Board and stated he looks forward to working with the Board and Roanoke County. I IN RE: ASSISTANT COUNTY ADMINISTRATOR POSITION On motion of Supervisor Terry and the following recorded vote, Bruce Mayer was appointed Assistant County Administrator through Dec. 31, 1981 and at his present salary, and directed to assist Mr. Flanders during the transiti period. I I I , 11-10-81 185 AYES: NAYS: ABSENT: Supervisors Park, Terry, White and Myers None Supervisor Johnson IN RE: TAX ON BULK OIL SALES Bruce Mayer, Interim County Administrator, submitted a report and informed the Board of a local 1% sales and use tax currently applicable to the sale of bulk oil to the citizens of Roanoke County. Some surrounding localities have exempted this tax and consideration for removing this tax was requested for Roanoke County. Mr. Scott Blankenship of APB-Whiting Oil Co. and a representative from Webb Oil Corp. were in attendance and also asked the Board's consideratio in exempting this tax. Supervisor Park moved to advertise this matter for a public hearing on December 8, 1981; adopted by the following recorded vote. AYES: NAYS: ABSENT: Supervisors Park, Terry, White and Myers None Supervisor Johnson IN RE: REPORT ON BIG HILL RECREATION Darrell Shell, Director of Parks and Recreation, at the Board's request, presented a report on current recreation facilities in the Big Hill area of Roanoke County. Mr. Shell stated this area does not have any facilities available and informed of the possibility of some State and Federal funding so that a park and recreation facilities may be offered by the County. He had viewed four possible sites and recommended a park consisting of approximately 10 to 14 acres. Report is filed with the minutes of this meeting. Mr. Flanders informed of his meeting with some State agency people at the Homestead and confirmed that some funds will probably be available for this project. On motion of Supervisor Terry and the following recorded vote, Mr. Flanders and Mr. Shell were directed to investigate means of funding this project. r 11-10-81 186 AYES: Supervisors Park, Terry, White and Myers NAYS: None ABSENT: Supervisor Johnson IN RE: REQUEST OF TIMBERLINE CONDOMINIUM ASSOCIATION TO VACATE CERTAIN LOT LINES FOR THE SOUTHERN PINES SUBDIVISION I Bruce Mayer, Interim County Administrator, informed the Board that a recommendation should come from the Planning Dept. and this matter may be referred to the Planning Department. On motion of Supervisor Park and a unanimous voice vote, said petition was referred to the Planning Department for a recommendation. IN RE: RESOLUTION NO. 3018 AUTHORIZING THE COUNTY OF ROANOKE TO ENTER INTO AN AGREEMENT WITH APPALACHIAN POWER COMPANY FOR ELECTRICAL SERVICE TO THE SOUTHWOODS WELL NO.2. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the County of Roanoke is hereby authorized to enter into I an agreement with Appalachian Power Company for electrical service to the Southwoods Well No.2; the County's share of the construction costs not to exceed $1,131.00; and 2. That the County Administrator is hereby authorized and directed to execute this agreement upon a form approved by the County Attorney. AYES: Supervisors Park, Terry, White and Myers NAYS: None ABSENT: Supervisor Johnson IN RE: COMPREHENSIVE PLAN UPDATE Tim Gubala, County Planner, reviewed his report submitted on the I Comprehensive Plan Update. Three specific tasks were included in the update; namely, (1) a background inventory of the population, economy, natural and manmade environments (2) program of citizen involvement to exchange ideas and information (3) draft Comprehensive Plan for Planning Commission's review in June 1982. 1 11-10-81 187 I I I IN RE: FIFTH DISTRICT EMPLOYMENT AND TRAINING CONSORTIUM - PLANNING ADVISORY COUNCIL Tim Gubala conveyed to the Board a request from the Policy Board of the Fifth District Employment and Training Consortium for nominations for membership on the Planning Advisory Council to fill current vacancies. Mr. Gubala stressed the fact that local governments need to maintain a voice and role on the Planning Advisory Council and this is achieved through membership. Mr. Gubala suggested a school board member and Capt. Kavanaugh from the Sheriff's Dept. be nominated to fill two of the vacancies. No action was taken by the Board in regard to this matter. IN RE: "TEN COMMANDMENTS" Supervisor Terry voiced the motion to rescind the "10 Commandments" adopted by the Board earlier this year and to allow Mr. Flanders, County Administrator, to review and approve out-of-town travel requests. No blanket approval is intended for travel requests; adopted by a unanimous voice vote of the members present. ~ Mr. Flanders stated he would prepare a policy regarding travel requests and present to the Board for approval. IN RE: OUT OF TOWN TRAVEL On motion of Supervisor Park and a unanimous voice vote, the following travel request was approved: (a) Elizabeth Leah - Alexandria, Va. - Dec. 6-9, 1981 IN RE: RESOLUTION NO. 3019 ACCEPTING A CERTAIN BID MADE TO THE COUNTY OF ROANOKE FOR THE CONSTRUCTION OF A BUILDING TO HOUSE THE PUMPS AND RELATED APPURTENANCES FOR THE HUNTING HILLS BOOSTER STATION. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That that certain bid of Charles Graybill in the amount of $5,210.00 for the construction of a building to house the pumps and related appurtenances for the Hunting Hills Booster Station, upon all and singular the terms and conditions of the invitation to bid, the specifications of the County of Roanoke, the bidder's proposal and the provisions of this resolution, be, and the same is hereby r- 188 11-10-81 ACCEPTED; and 2. That the County Administrator is hereby authorized and directed to enter into a contract upon a form approved by the County Attorney for this construction; and 3. That all other bids for said construction are hereby I REJECTED and the County Clerk is directed to so notify such bidders and express the County's appreciation for the submission of their bids. I BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That Resolution No. 2992 dated October 13, 1981, awarding a bid to Oxford Building Service for janitorial services to various County , I I I " 11-10-81 ~1 , ' 189 , -- , , ' , " """ -c- . . , " buildings be amended to provide for a two year contract at a yearly price of $62,601.00; and 2. AYES: Supervisors Park, Terry, White and Myers NAYS: None ABSENT: Supervisor Johnson IN RE: RESOLUTION NO. 3022 RELIEVING THE INTERIM COUNTY ADMINISTRATOR OF HIS RESPONSIBILITIES AND DUTIES AND APPOINTING IN HIS PLACE AND STEAD A COUNTY ADMINISTRATOR. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Interim County Administrator be, and he hereby is relieved of the responsibilities and duties heretofore devolved upon him by the Board of Supervisors effective from and after the adoption of this resolution; and 2. That Donald R. Flanders be, and he hereby is appointed County Administrator of the County of Roanoke from and after November 10, 1981 at a salary of Thirty Three Thousand Dollars for such position for such period of time as may be determined by the Board of Supervisors of Roanoke County; and 3. That the current Interim County Administrator, Bruce E. Mayer, is authorized to cause his name to be signed to county payroll checks for the payroll period ending November 15, 1981; said authority shall be rescinded after completion of this single act.
