The Board of Supervisors of Roanoke County, Virginia, met this

day in open session at the Salem-Roanoke County Civic Center in Salem,
Virginia, this being the fourth Tuesday and the second regular meeting
of the month of April.
Members present: Chairman Edward C. Park, Jr., Vice-Chairman
Athena E. Burton, and Supervisors May W. Johnson, Gary J. Minter and
Robert E. Myers.
Members Absent: None

At 6:00 p.m. Chairman Park called the meeting to order.

On motion of Supervisor Burton and a unanimous voice vote, the
Board immediately went into Executive session to discuss personnel, real
estate, and legal matters.

INVOCATION AND PLEDGE
Invocation was offered by Rev. Tom Jones from the Fort Lewis

April 27th was Student Government Day in Roanoke County and the
students from the Roanoke County School System who participated and were
in attendance at the meeting were introduced.

Supervisor Burton stated she would like to add to the minutes of
the meeting of April 13, 1982, relative to the request of Douglas Pedigo
T/A Wonderland Family Entertainment Center a main objection was the
proximity of the business to the Oak Grove School; Supervisor Burton moved

to approve the minutes; adopted by unanimous voice vote.

On motion of Supervisor Johnson and a unanimous voice vote, the

ORDINANCE NO. 3112 AMENDING SECTION 10-44. PAYMENT OF

PROPERTY TAX PREREQUISITE TO ISSUANCE OF ARTICLE V. COUNTY
VEHICLE LICENSES OF CHAPTER 10. MOTOR VEHICLES AND TRAFFIC
OF THE ROANOKE COUNTY CODE.
BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That Section 10-44. Payment of property tax prerequisite to
issuance. of Article V. County Vehicle Licenses be, and hereby is
amended to read and provide as follows:

No vehicle taxable under the provisions of this article shall be
licensed unless and until the applicant for such license shall have
produced satisfactory evidence that all personal property tax upon
the vehicle, trailer or semitrailer to be licensed, have been paid and
satisfactory evidence that any delinquent motor vehicle, trailer or
semitrailer personal property taxes owing have been paid which have been
properly assessed or are assessable against the applicant by the county.

IN RE:
REAL ESTATE TAX RATE
Administrator Flanders presented a synopsis of his budget message
and goals projected in the 1982/83 fiscal year budget. He noted the long
and short-term range plans, capital improvements, salaries and proposal
of revising the fee structure for specialized services.
Bayes Wilson, Superintendent, Roanoke County Schools, also
presented a brief synopsis of the school budget inclusions and reason for
some increases, i.e. 7% increase for employees' salaries and replacement
of some school buses with mileage in excess of 100,000 miles. He noted

the budget is increased only 8% which is 1% less than the cost of inflation.
Those citizens who spoke on behalf of the Virginia Taxpayers
Association favoring retention of the elementary Guidance Counselor positions
were Dr. Michael Sisk, Thomas Walls and Glenna Richardson.
Mrs. Charlsie Pafford, President, Roanoke County Council of
PTA's spoke in favor of the school budget as presented and expressed the
view that all requests in the budget were legitimate requests. She further
pointed out that in order to attract industry into the County which is a
major goal, that schools and education would be a much needed asset to the
people connected with industry.

Mr. Burks Anderson stated that in view of the schools allotting
I; money to purchase land adjacent to the William Byrd High School to construct
Ii a Junior High School, this seems to be out of line since student enrollment
is declining and the money could be used to work in the present school
- system.

Dr. Harry Nickens, School Board Chairman, explained that even
though they are concerned with maintaining the present schools and the
lowest tax rate, they are also concerned with the future. The School
Board decided that purchasing the available land is the wisest investment
of bond interest funds at this time. The interest accrued from the
School bonds can only be used for such projects, Dr. Nickens pointed out.
Mr. Winston Shelor, Sr. stated the Board should hold down taxes
for the benefit of retired citizens on fixed incomes, especially in view
of the fact that many people are losing their jobs and going bankrupt.

Mr. David Byrd expressed the viewpoint that it was unnecessary to
purchase 21 school buses at a cost exceeding $400,000 simply because they
have over 100,000 miles. He stated that if the buses are well maintained
they should last a considerable length of time. Mr. Byrd pointed out
that he has driven tractor-trailers, buses and other motor equipment and
was knowledgeable enough about such engines to know they would support
more mileage than 100,000 miles.
Brendan Wilkinson, President, West Texas Hollow Civic League,
stated they have studied the budget, including school budget, and desire
to learn about the financial situation in the County. Mr. Wilkinson
further stated the $1.08 proposed tax rate to be in line with current
inflation. The organization agrees to increase teachers salaries if they
are deserved, but feel there is room for reduction. The organization is
in favor of good education standards.

Ms. Ileada Ribble, representative, Virginia Taxpayers Association
of Roanoke Valley, thanked the Board for consideration of $1.08 as
proposed for the tax rate. She further stated the VTA has recommended
elimination of 19 guidance counselors and the purchase of the 21 school
buses.
Mr. Bob Johnson noted that the quality of education is very high
and that students from two-to-twenty-two years old have access to an

education. Mr. Johnson asked the Board to 'fully fund' the school budget.
He thanked the Board for holding the line on services and their cost.
Mr. Stan Reas informed the Board that as a taxpayer there were

some things he did not want the Board to spend money for, i.e. contributions
to "charity-type" organizations. He felt that if organizations wanted
contributions, they should ask the citizens directly because the Board
should not spend the taxpayers money as they see fit.
IN RE:
SCHOOL BUDGET
Supervisor Minter inquired of Director of Finance John Chambliss
how much the tax rate increased due to electric rates and the courthouse;
Mr. Chambliss informed that ll~ was necessary to cover those two items.
Supervisor Burton also explained that the motive for purchasing

the 21 school buses was due to the fact that after 10-12 years parts are
not available and some buses are used for spare parts for the same vintage
of these buses and also the problem with increasing electric bills.

Supervisor Burton further approved of the 7% raise for school
administration employees and for County employees. Supervisor Burton moved
to approve the school budget as recommended.

Supervisor Myers stated his view that the school board had tried

"somewhat harder this year to keep the school budget to a minimum and I
think the 7% increase in wages is a fair increase but with what's facing
us next year, in the loss of Salem as part of the County schools, we have
not done enough to bring about a reduction in this budget to help us
next year and I think we need to take some drastic steps because with a

tax increase this year and a tax increase next year, it's going to be a

burden on the homeowners that they can't stand and so I'll have to vote no.

REAL ESTATE TAX RATE
I
RESOLUTION NO. 3113 SETTING THE TAX LEVY ON REAL
ESTATE SITUATE IN ROANOKE COUNTY FOR THE CALENDAR
YEAR 1982.
BE IT RESOLVED that the levy for the twelve-month period beginning
January 1, 1982, and ending December 31, 1982, be, and it hereby is set
for a tax rate of $ 1.08
per ONE HUNDRED DOLLARS of assessed
valuation on all classes of taxable real estate and mobile homes as
classified by Section 58-829.3 of the 1950 Code of Virginia, as amended,
situate in Roanoke County.
Adopted on motion of Supervisor Johnson and the following recorded
vote.

Supervisor Myers commended Administrator Flanders on the budget
and keeping the rate as low as $1.08 which he thought a year ago would
be at least $1.20. Mr. Myers stated "I would like to vote yes on the $1.08
portion on what Mr. Flanders has done, but, I have voted no on the school
budget and therefore on the overall budget I must vote no."
Chairman Park commended the staff on the work they did in
preparing the budget and for holding the line to maintain what we now
have.

and no one appeared in opposition. The following Order was approved.
FINAL ORDER
NOW, THEREFORE, be it resolved and ordered that the division line

between original Lot 5 and original Lot 7, One Oak Road; and the division
line between original Lot 6 and original Lot 7, One Oak Road, and the
existing 15' wide public utility easement and drainage easement centered

along said division line; and a part of the division line between original
Lot 5 and original Lot 6, One Oak Road; all as shown on the Plat of One
Oak Road, recorded in the Clerk's Office of the Circuit Court of Roanoke
County Virginia, in Plat Book 9, page 128, be permanently vacated,
discontinued and eliminated.
AND, BE IT FURTHER ORDERED, that the Chairman of the Board of
Supervisors of Roanoke County is authorized and directed to enter into a
certain Agreement, which Agreement provides for the vacation of said lot
lines, public utility easements and drainage easements, pursuant to Section

PUBLIC HEARING SET - EXTENSION FOR TAXES RELATING TO MOBILE HOMES
The Clerk was directed to schedule a public hearing for May 25th
to extend the penalty date for taxes on mobile homes until June 20, 1982

PETITION FROM CITIZENS IN THE HOLLINS MAGISTERIAL DISTRICT

Supervisor Minter reminded the Board of a problem existing for
some 7 to 8 years with "Verndale" street in the Hollins District. Mr. Minter
noted that the condition of the road is extremely poor creating problems
for the heavily traveled thoroughfare. Mr. Minter further stated he had
~ written a letter to Gov. Robb and to Harold King, Commissioner of the

Highway Department to seek any assistance in relieving this problem.
Gene Robertson, County Engineer, pointed out that the developer,
w. E. Cundiff, says the problem is due to maintenance from the Highway
I
Department and the Highway Department has informed that the street was
never built to standard. Consequently, due to Mr. Minter's involving the
Commissioner, a delegation has arrived in the County today to inspect the
street and a report will be forthcoming.
IN RE:
RESOLUTION NO. 3114 AUTHORIZING THE COUNTY ADMINISTRATOR
TO ENTER INTO AN AGREEMENT TO PROVIDE A SALARY CONTINUATION
PROGRAM FOR COUNTY EMPLOYEES.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That, as an adjunct to the County's deferred compensation plan
coordinated and administered through the National Association of Counties,
a certain salary continuation plan for employees of the County and
members of the Board of Supervisors, which plan among other provisions
I
provides for enrollment of appropriate persons who choose to be enrolled,
be, and such plan is hereby approved; and
2. That the County Administrator is hereby authorized and directed
to enter into an agreement on behalf of Roanoke County with Security
Benefit Life Insurance of Topeka, Kansas to implement said salary
continuation plan, all of which shall be upon form approved by the
County Attorney.

RESOLUTION NO. 3115 REQUESTING ASSIGNMENT OF A STATE
HIGHWAY INSPECTOR FOR THE PURPOSE OF INSPECTING THE STREETS
IN SECTION 15 OF THE HUNTING HILLS SUBDIVISION.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That a State Highway Inspector be, and he hereby is, requested
to be assigned for the purpose of inspecting the streets in Section 15
of the Hunting Hills Subdivision in order that such streets may hereafter

be accepted into the State Secondary System; and
2. That the developer of Section 15 of the Hunting Hills Subdivision,
Old Heritage Corporation, shall be responsible to the County of Roanoke
for all sums required to be paid in and about such street inspections as

specified in the letter from Old Heritage Corporation dated April 12, 1982,
attached hereto and part of this resolution and official minutes of this
Board; and
3. That an attested copy of this resolution be forthwith forwarded
to the State Department of Highways and Transportation, Salem District,
and to Old Heritage Corporation, the same to be effective upon receipt of
an executed copy hereof, signed by the appropriate officers of Old Heritage
Corporation and filed in the office of the County Administrator.

SUPPLIES.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That a certain 400 megabyte disk drive be, and it hereby is,
authorized to be purchased for the Roanoke County/Roanoke County School
Board joint operation for data processing services through the State
contract of the Commonwealth of Virginia, Department of Purchases and
Supplies at a sum not to exceed $23,012.76; and
2. That a certain intelligent network processor be, and it hereby
is, authorized to be purchased for the Roanoke County/Roanoke County

School Board joint operation for data processing services through the
State contract of the Commonwealth of Virginia, Department of Purchases
and Supplies at a sum not to exceed $3,675.00; and

SCHOOL BOARD JOINT OPERATION FOR DATA PROCESSING SERVICES AND
ESTABLISHING AN EFFECTIVE DATE OF SUCH SALARY.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the position of Director of Data Processing for the Roanoke
County/Roanoke County School Board joint operation for data processing
services be, and it hereby is, established at a sum of $27,820.00 annually;
and

2. That the salary of said Director of Data Processing herein
established be, and it hereby is effective from and after January 1,
1982.

IN RE:
CITIZENS' LETTERS
Administrator Flanders informed the Board that pursuant to Board
directions a "Report to the Citizens" was prepared for the citizens and
mailed along with the personal property tax notices to the public.

Mr. Flanders also distributed "post cards" prepared for the
Supervisors to give citizens who have complaints. These cards may be
filled in and dropped in the mail to the County and complaints will be
followed up on.

IN RE:
SCHOOL ADMINISTRATION GRANT
Homer Duff, Director of Business and Finance, informed the Board

the school administration desires to apply for a grant in the amount of
$147,000 to establish cooperative services between Roanoke County, Craig
County, Botetourt County, Fr8nklin County and Roanoke City for autistic
children. It will be necessary to first have the money budgeted and
reimbursed, therefore, it was requested this amount be budgeted for same.

Resolution of Roanoke County, Virginia, adopted June 23, 1981 be, and is

RESOLUTION NO. 3119 APPROVING THE SUBMISSION OF A CERTAIN

AUTHORIZING THE ROANOKE COUNTY SCHOOL BOARD TO EXECUTE THE
NECESSARY DOCUMENTS FOR THIS GRANT APPLICATION.

1. That the energy conservation grant application submitted by the

50% local matching funds basis for technical assistance to continue an
energy conservation program for certain Roanoke County school facilities

1. That the energy conservation grant application submitted by the
Roanoke County School System for certain funds which are available on a

energy conservation program for certain Roanoke County school facilities
be, and the same hereby is, APPROVED, in that the Roanoke County School
Board is authorized to expend the 50% local share required from the
funds to be appropriated to it for the 1982-83 fiscal year; and

authorized to execute the necessary documents on behalf of Roanoke

EXTENSION AS REQUESTED BY THE COUNCIL OF THE CITY OF SALEM.
BE IT RESOLVED by the Board of Supervisors of Roanoke County~
Virginia~ as follows:
1. That~ pursuant to Section 21-9.7 (a) of the Roanoke County
Code~ the relocation of the west fork of Carvin's Creek begining adja-

cent to Dent Road (Route 623) approximately 0.14 miles from its inter-
section with Airport Road (Route 118) and extending approximately 1~225
feet as shown on Sheets 15 and 16 of the Runway 23 Extension~ Phase II
Plans, prepared by Delta Associates~ Inc. bearing date of April~ 1982,
be~ and such relocation hereby is approved in order that the construc-
tion of the Runway 23 extension may be undertaken by the Gity of Roanoke;
and
2. That an attested copy of this resolution be forthwith forwarded
to the Clerk of the City of Roanoke.

Mr. Will Estes from the State Water Control Board was on hand to
up-date the Board on the Roanoke River Upper Basin project. Mr. Estes

channel are: dropping 100 acres, more or less, of fill from lOa-year
flood plain and locating 100 acres, more or less, out of flood plain
(airport area suggested); and excavation in Niagara Reservoir; construction

techniques and material problems. More information will be provided as
the project progresses.
It was determined through discussion by the Board and Mr. Estes
that this project would not benefit Roanoke County.
IN RE:
RESOLUTION NO. 3123 ACCEPTING THE DONATION OF SEWER LINES
INSTALLED WITH THE DEVELOPMENT OF SECTION 5 OF HUNTING HILLS
AND AUTHORIZING THE COUNTY ADMINISTRATOR TO DULY AUTHENTICATE
SUCH ACCEPTANCE AS MADE AND PROVIDED BY LAW.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the offer of Old Heritage Corporation to donate the sewer
lines installed with the development of Section 5 of Hunting Hills to
the Board of Supervisors of Roanoke County, be, and hereby is accepted;

2. That upon receipt of a duly executed deed upon a form approved
by the County Attorney from Old Heritage Corporation, the County Admin-
istrator is hereby authorized to authenticate the acceptance thereof as
made and provided by Section 15.1-286 of the 1950 Code of Virginia, as
amended.

RESOLUTION NO. 3124 ACCEPTING A BID MADE TO THE COUNTY OF
ROANOKE TO FURNISH THIRTY-TWO PORTABLE TOILETS FOR THE ROANOKE
COUNTY RECREATION DEPARTMENT.

BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That a certain bid of Churchill's, Inc. in the amount of $7,904.00,
being the lowest and best bid received by the County, to furnish thirty-
two portable toilets for the Roanoke County Parks and Recreation Department,
upon all and singular the terms and conditions of the invitation to bid,

the specifications of the County of Roanoke, the bidder's proposal and
the provisions of this resolution, be, and the same hereby is accepted;
upon the condition that the original contract for same shall be for a
term ending June 30, 1982 in the amount of $3,328.00; and
I
2. That the County Administrator is hereby authorized and directed
to enter into an agreement with Churchill's Inc. upon a form approved by
the County Attorney, containing the express provision for termination
on June 30, 1982; provided, however, the County Administrator is further
authorized to execute an extension of said contract in a sum not to
exceed $4,576 from and after July 1, 1982, subject to appropriation of
such sum by the Board; and
3. That all other bids for this service are hereby rejected and
the County Clerk is directed to so notify such bidders and express the
County's appreciation for the submission of their bids.

RESOLUTION NO. 3125 AUTHORIZING THE PURCHASE OF SEVEN
DISASTER KITS FOR USE BY THE VARIOUS ROANOKE COUNTY RESCUE
SQUADS.

BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the purchase of seven (7) disaster kits for use by the
various Roanoke County rescue squads, at a cost of $300.00 each for a
total cost of $2,100.00, from the Western Virginia EMS Council, be, and
the same is hereby approved; and
2. That the County Administrator is hereby authorized and directed
to enter into contract with the Western Virginia EMS Council upon a form

approved by the County Attorney for this purchase.

Supervisor Myers appointed Jim Fentress, P. o. Box 7594, Roanoke,
Virginia, for a one-year term which was effective April 1, 1982 to March
31, 1982. Approved by unanimous voice vote.

Supervisor Burton stated her concern for lack of a branch post-

office in the southwest area of the County. Mrs. Burton said she would
like to get the consensus of the Board for petitioning the postal service
to place a branch office in that community. Supervisor Johnson noted that
she had previously asked about this problem and for Attorney Buchholtz to

look into the matter. County Attorney Buchholtz will prepare a resolution
to be submitted to U.S. Senators Byrd and Warner and Congressman Butler and
the Post Master General requesting the branch office be made available.

YOUTH AND FAMILY SERVICES
Supervisor Johnson informed of a letter from the Division of
Justice and Crime Prevention Department of Virginia to Capt. Michael
Kavanaugh in the Sheriff's Department regarding the County's Juvenile

Justice and Delinquency Prevention Act project. At the April 22nd meeting
of the Virginia Juvenile Justice and Delinquency Prevention Advisory Council
selected the Youth and Family Services project as one of the top six in
Virginia. The Board offered their congratulations and that communication

would be forthcoming regarding their acknowledgement and accomplishments.

EXECUTIVE SESSION
At 9:35 p.m. on motion of Supervisor Minter and a unanimous voice
vote, the Board went into Executive session to discuss personnel, real
estate, pending litigation.
