The Board of County Supervisors of Roanoke County, Virginia, met
this day in open session at the Salem-Roanoke County Civic Center in Salem,
Virginia, this being the fourth Tuesday and the second regular meeting of the
month of January.
Members present: Chairman Robert E. Myers, Vice Chairman Lawrence
E. Terry, and Supervisors May W. Johnson, Edward C. Park, Jr. and T. M. White.

CALL TO ORDER:
Chairman Myers called the meeting to order at 7:00 p.m.
IN RE:
INVOCATION
Invocation was offered by Rev. Roy Davis, Retired United Methodist
Minister from the Holston Conference, and the Pledge of Allegiance was
offered in unison.
IN RE:
APPROVAL OF MINUTES:
Supervisor Terry stated he had two corrections for the minutes of th
meeting of January 13, 1981; (1) He advised regarding a matter of Resolution
#2765 on page 336 of the minutes, to add the purpose of his abstention, being
that his wife is employed by Appalachian Power Company; and (2) regarding
Resolution #2766 on page 337 of the minutes, that it be noted he voted in
favor of the waiver of the Water Ordinance due to the 600' distance from
the line to the house. These additions were made.
On motion of Supervisor Terry and a unanimous voice vote, the
minutes were approved as corrected.

The following list of reports were submitted to the Board for their
information only and no action required:
(1) Departmental Activities Report for December 1980.

#25448 adopted by the City Council January 5, 1981 authorizing

Creek Water supply development.

#25450 authorizing dismissal of pending litigation in the
matter of Roanoke County Public Service Authority vs. City
of Roanoke and LaChateau of Franklin Road, Inc. vs. Roanoke
County Public Service Authority, et aI, and the disbursement
of an escrow account in connection with ~u~h litigation.
On motion of Supervisor Johnson and a unanimous voice vote, all of
the above were received and filed.

DISTRICT R-3 A TRACT OF LAND KNOWN AS LOTS 6, 7, and 8, * APPROVED
BLOCK 8, MAP OF CAPTAIN'S GROVE IN THE HOLLINS MAGIS- *
TERIAL DISTRICT. *
Mr. Tomaras was present to support this request. No one appeared
in opposition. This rezoning requested so that three duplex dwellings may
be constructed thereon.
FINAL ORDER
NOW, THEREFORE BE IT ORDERED that the aforementioned tract of land,
more particularly described below, be rezoned from Residential District
R-l and Business District B-2 to Residential District R-3.
BEING Lots 6, 7, and 8, Block 8, according to the
Map of Captain's Grove property of Captain's Grove
Corporation, made by David Dick, C.E. and S. dated
December 10, 1958, which Map is of record in the
Clerk's Office of the Circuit Court of the County
of Roanoke, Virginia, in Plat Book 4, Page 6.
BE IT FURTHER ORDERED that a copy of this Order be transmitted to
the County Planner, and that he be and hereby is directed to reflect that
change on the Official Zoning Maps of the County.

IN RE:
COMMUNICATION FROM TINKER MOUNTAIN WORKSHOP REQUESTING
COUNTY TO CONTINUE SPONSORING SEVEN (7) HANDICAPPED
CLIENTS. ADDITIONAL FUNDS NEEDED.
Mr. Bob Thomas and John Wade, Executive Director, appeared to
support this request for funds in the amount of $9,100.00. Mr. Thomas
informed the Board that Tinker Mountain works with the handicapped in order
that they may be self-supporting. He advised that low-level funds from the
State have been reduced from $12,000 per month to $8,000.00 and that these
funds will run out in April, 1981. He further stated that Tinker Mountain
will be requesting funds from all local localities since at least half of thei
funds are generated through their own efforts.
Mr. Park moved to hold this matter over until the next meeting and
the Board may visit Tinker Mountain Workshop prior to the meeting; adopted
by unanimous voice vote.

COMMUNICATION FROM COUNTY WELFARE BOARD SOLICITING INPUT
CONCERNING THE TITLE XX SERVICES FOR! jROANOKE COUNTY/SALEM AREA.

On motion of Supervisor Johnson and a unanimous voice vote, this
communication was received and filed.
IN RE:
COMMUNICATION FROM ROANOKE AREA CHAPTER OF THE VIRGINIA
SOCIETY OF CERTIFIED PUBLIC ACCOUNTANTS REGARDING DUE
DATES OF PERSONAL PROPERTY RETURNS.
The Board advised that the Chairman of the Certified Public
Accountants Association met with Wayne Compton, Commissioner of Revenue,
to discuss this matter and no action by the Board is required at this time.

REPORTS OF DEPARTMENTS, OFFICERS AND COMMITTEES
COUNTY ADMINISTRATOR
REPORT - BINGO AND RAFFLE PERMIT REGULATIONS
Administrator Clark advised the Board that in 1973 an Ordinance
was passed regulating bingo games and raffles in Roanoke County. Since
that time, this Ordinance no longer conforms with the State Code. Therefore,
a sample draft is submitted and a request to advertise a public hearing
regarding the up-date of this Ordinance.
On motion of Supervisor Johnson and the following recorded vote,
the hearing was authorized to be advertised and held February 24, 1981.

IN RE:
REPORT -- TINKER CREEK INTERCEPTOR - CERTIFICATE OF EXEMPTION
RESOLUTION NO. 2778 AUTHORIZING EXECUTION OF A CERTIFICATE
OF EXEMPTION FOR THE TINKER CREEK INTERCEPTOR PROJECT.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the County of Roanoke is hereby authorized to execute the
Certificate of Exemption for the Tinker Creek Interceptor Project which
will allow the County to permit the contractor to purchase.materials
without paying State sales and use taxes thereby enabling the County to
benefit from reduced bids; and
2. That the County Administrator is hereby authorized to execute
the appropriate exemption form.

IN RE:
APPALACHIAN POWER COMPANY EASEMENTS
Appalachian Power Company has requested the County to grant two
easements in order to provide power to two sites; there is no cost to the
County for these easements.
(1) Easement to the Tanglewood Pump station located off Ogden
Road to provide power service to that pump.
(2) Contract with Appalachian to allow installation of an
electrical service line across our easement to LaBellevue Well 117. Appa1achi
previously tried to get easement from the owner of the property but was
denied access so they are using our easement and access in order to begin
construction.

Administrator Clark also requested an Executive session at the end
of the meeting to discuss legal matters.

DIRECTOR OF FINANCE:
REPORT - ANIMAL CLAIM OF MRS. R. A. PHELPS
John Chambliss, Director of Finance, informed the Board of a claim
from Mrs. Phelps whereby she requests $111.00 as restitution for three pigs,
approximately eight weeks old, which were killed by dogs on November 26, 1980.
Mr. Chambliss stated the policy adopted by the Board in 1979,
recommends a settlement in this claim of $20.00 for each pig.
On motion of Supervisor Johnson and the following recorded vote,
the claim was approved in the amount of $60.00,according to policy.

Mr. Chambliss submitted a Summary of Appropriations report which
was received and filed.

REQUEST TO ADD POAGES MILL DRIVE AND MILL RUN ESTATES INTO THE
STATE HIGHWAY SYSTEM
On motion of Supervisor Terry and the following recorded vote, it
was approved to request Mill Run Circle from Poages Mill Drive 0.25 miles
to end be added to the State Highway System; and Poages Mill Drive from its
intersection with State Route 694 0.69 miles to end.

IN RE:
BID COMMITTEE
REPORT - BID: FOOT BRIDGE FOR WALROND PARK
A letter from Cunningham Associates, Inc. was received and
submitted to the Board by Ed Fitzgerald, Purchasing Supervisor, regarding
this bid. (Letter filed with minutes of this meeting).
Attorney Buchholtz informed the Board that the County sent out
invitations for bids of this item and two were received, (1) Larry Halsey
and Associates $6,464.00 and (2) Cunningham Associates, Inc. $7,328.00.
The bid from Cunningham Associates provides for delivery within 60 days at
$7,328.00,for delivery in from 60 to 120 days at $6,262.00. On the other
hand, the bid from Larry Halsey and Associates for $6,464.00 is for delivery
within 60 days after they receive the order. The problem with the Cunningha
bid is the legal implication that the Recreation Department cannot give an
exact delivery date at this time. Once they schedule delivery they have to
order and deliver within a specified time,and it appears with the bid of
Cunningham and Associates, that they submitted an alternative bid and if the
schedule for de1~very is from 60 to 120 days then, the price is $6,262.00,
but if scheduled under 60 days then the price is $7,328.QO. The clear bid
from Larry Halsey and Associates is for delivery within a 60 day period.
If we accept the bid from Cunningham and Associates, and depending on the
time of delivery, we might be accepting the bid of $7,328.00 which is the
higher bid. On that basis, it would appear that the bid from Larry llalsey
and Associates for $6,464.00 is in the best interest of the County and
without the potential for costly legal problems.
RESOLUTION NO. 2779 ACCEPTING A CERTAIN BID MADE TO THE
COUNTY OF ROANOKE FOR ONE SELF-WEATHERING FOOT BRIDGE TO BE
ERECTED AT WALROND PARK.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That a certain bid of Larry Halsey and Associates of Greensboro,
North Carolina, being the lowest conforming bid, in the amount of $6,464.00
for the purchase of one self-weathering foot bridge to be erected at
Walrond Park, upon all and singular the terms and conditions of the
invitation to bid, the specifications of the County of Roanoke, the
bidder's proposal and the provisions of this resolution, be, and the

same is hereby ACCEPTED; and
2. That the County Administrator beJ and he hereby is authorized
and directed to enter into a contractJ upon a form approved by the

RESOLUTION NO. 2780 ACCEPTING A CERTAIN BID MADE TO THE
COUNTY OF ROANOKE FOR VALVES AND HYDRANTS FOR STARMOUNT
REPLACEMENT.
BE IT RESOLVED by the Board of Supervisors of Roanoke CountYJ
Virginia~ as follows:
1. That a certain bid of Warner Supply Corporation, being the
lowest conforming bidJ in the amount of $3J041.16 to furnish valves and
hydrants for the Starmount ReplacementJ upon all and singular the terms
and conditions of the invitation to bid, the specifications of the
County of Roanoke, the bidder's proposal and the provisions of this
resolution, be, and the same is hereby ACCEPTED; and
2. That the County Administrator be, and he hereby is authorized
and directed to enter into a contract, upon a form approved by the
County Attorney, with Warner Supply Corporation for this purchase; and
3. That all other bids for said purchase are. hereby REJECTED and
the County Clerk is directed to so notify such bidders and express the
County's appreciation for submitting such bids.

RESOLUTION NO. 2781 ACCEPTING A CERTAIN BID MADE TO THE
COUNTY OF ROANOKE FOR FURNISHING AND INSTALLING THE PUMP AT
THE NORTH LAKES WELL #7.

BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That a certain bid of Nelson-Roanoke Corporation, being the
lowest conforming bid, in the amount of $5,011.00 for furnishing and
installing the pump at North Lakes Well #7, upon all and singular the
terms and conditions of the invitation to bid, the specifications of the
County of Roanoke, the bidder's proposal and the provisions of this
resolution, be, and the same is hereby ACCEPTED; and
2. That the County Administrator be, and he hereby is authorized
and directed to enter into a contract, upon a form approved by the
County Attorney, with Nelson-Roanoke Corporation for this work; and
3. That all other bids for this work are hereby REJECTED and the
County Clerk is directed to so notify such bidders and express the
County's appreciation for submitting such bids.

IN RE:
REPORT - RECOMMENDATION TO CANCEL ORDERS TO MOTOROLA FOR RADIOS
Mr. Fitzgerald stated we have been in contact with Motorola for
10 months and these radios do not meet specifications and the Company has
not given satisfaction on the radios, therefore, it is recommended this
order from Motorola be canceled. A full report is filed with the minutes
of this meeting.
Representatives from Motorola were present and recognized by
Chairman Myers. Mr. Jim Clark and Mr. Aydlette state that therB:wasa proble
in getting the engineering problem worked out in order to meet the County's
specifications and it has taken some time but feel they now can meet those
specifications. Chairman Myers informed the representatives tha.t this has
been going on for some time and feels it would be advantageous to cancel
this order. It is recommended by the Bid committee to purchase a like
number of radios from the Virginia Department of Purchases and Supplies as
a replacement for the canceled units. These radios are equivalent to the
units now in service in County vehicles.

RESOLUTION NO. 2782 CANCELING A CERTAIN ORDER FOR CERTAIN
RADIOS HERETOFORE PLACED BY THE COUNTY PURSUANT TO BIDS
RECEIVED BY THE COUNTY PURSUANT TO INVITATION TO BID WITH
SPECIFICATIONS.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the County having heretofore placed three separate purchase
orders; to-wit, P.O. U17050, P.O. U17l04 and P.O. #17287, for the
purchase of certain radios contracted to be supplied by Motorola Commun-
ications and designated Bid RC79-29 submitted in 1979 pursuant to invitation
to bid based on certain specifications required by the County of Roanoke,
which said radios conforming to such specifications have not to date
been delivered by Motorola Communications, the aforesaid purchase orders
along with Bid RC79-29 hereinabove set out be, and the same is hereby
CANCELED; and
2. That an attested copy of this resolution be forthwith forwarded
to Motorola Communications by the County Administrator.

PURCHASE OF MOBILE RADIOS
RESOLUTION NO. 2783 AUTHORIZING THE PURCHASE OF
TWENTY-ONE MOBILE RADIOS FROM THE VIRGINIA DEPARTMENT
OF PURCHASES AND SUPPLIES.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That the County of Roanoke is hereby authorized and directed to
purchase twenty-one mobile radios at a cost of approximately $125.00 each
for a total cost not to exceed $2,625 from the Virginia Department of
Purchases and Supplies; and
2. That the County Administrator is hereby authorized to execute the
necessary documents upon a form approved by the County Attorney for this
purchase.

IN RE:
REPORT - COMBINED PURC}~SE OF FOOD FOR JAIL
WITH ROANOKE COUNTY SCHOOL BOARD.
RESOLUTION NO. 2784 AUTHORIZING THE COUNTY OF ROANOKE TO
PURCHASE FOOD AND RELATED ITEMS NEEDED IN THE ROANOKE COUNTY,
SALEM JAIL FROM CERTAIN VENDORS.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the County of Roanoke is authorized to purchase food and
related items from Swift and Company, Frigid Freeze and Roanoke Restaurant
Service, said vendors having been awarded low bids from the Roanoke
County School Board for the purchase of these items; and
2. That the County of Roanoke is hereby authorized to in the
future conduct a similar joint bid with the Roanoke County School Board
for the purchase of food and related items for the Roanoke County, Salem
Jail.

IN RE:
REAL ESTATE ASSESSOR:
REPORT-BOARD OF EQUALIZATION
Andy Clingenpeel, Assessor, reminded the Board that he was directed
to survey other surrounding localities in reference to compensation of
boards of equalization, and a report of those findings was submitted (filed
with the minutes of this meeting). On his recommendation the following
resolution was adopted.
Chairman Myers directed that the Commission be informed that no
mileage expenses will be reimbursed.
RESOLUTION NO. 2785 AUTHORIZING COMPENSATION AND REIMBURSEMENT
FOR MILEAGE AND EXPENSES TO BE PAID TO THE BOARD OF EQUALIZATION
APPOINTED TO SERVE FOLLOWING THE 1980 REASSESSMENT.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That this Board does hereby authorize that compensation and
reimbursement for expenses be granted to those persons appointed by the
Circuit Court of Roanoke County to positions on the Board of Equalization
of real estate assessments. Each member will be compensated at the rate

$75.00
per diem. All other out of pocket expenses incurred
of
by the members of the Board in fulfilling their duties will be reimbursed
on a cost basis; and
2. That the County Administrator is hereby directed to maintain a
record of the amount of time spent by each member in his service on the
Board of Equalization and, further, to keep a record of all expenses
incurred by each member of the Board.

IN RE:
ADDITIONAL EMPLOYEE FOR THE COMMISSIONER OF REVENUE
Wayne Compton, Commissioner of Revenue, informed the Board that it
would be advantageous to the County to hire an Account Clerk I for his office
in order to collect funds which may be outstanding and with present conditions
there is not enough manpower to check on all properties owned by businesses.
He feels the additional income would more than compensate for the salary of
a new employee. Upon approval Chairman Myers asked for a report back to
the Board at the end of the fiscal year.
RESOLUTION NO. 2786 CREATING AN ACCOUNT CLERK I POSITION IN
THE COMMISSIONER OF REVENUE'S OFFICE.
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That a new position of Account Clerk I be created in the Commissione
of Revenue's Office; this position to start at Step 20 A and become
effective March 1, 1981; and
2. That funds are presently available in the Commissioner of
Revenue's 1980-81 budget for this position.

IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor White stated he has three items to bring up. At a
meeting he held with citizens January 26th, he was informed that in the Sun
Valley area the Sheriff's Department does not patrol frequently. Administrat

Clark was directed to write Sheriff Foster and ask that more patroling be
done in that area.
Mr. White inquired of Administrator Clark regarding status of the
requested street light at Travilion and Stonington Road. Mr. Clark informed
him that he had spoken with Claude Reynolds of Appalachian and was assured
that all street lights requested on a list of June 10, 1980, including this
particular light, would be installed within a week.
Mr. White inquired of the County Engineer regarding a request for
highway markings near the school on Plantation Road. Mr. Robertson, Engineer,
informed him that we have received no response from the Highway Department
in connection with this request. Mr. White directed Administrator Clark to
write the Highway Department regarding this matter. He furthr stated the
County Engineer had written to Fred Altizer, Engineer with State Highway
Department requesting lines on the road in front of Mountain View School
and he has received no response. Mr. White directed Mr. Clark to \vrite Fred
Altizer and ask him to look into this matter as soon as possible. In that
letter request him to get with Gene Robertson, County Engineer, to see
about getting some stop signs on Orlando Avenue; approved by motion of
Supervisor White and a unanimous voice vote.
IN RE:
APPOIN11~ENT
Supervisor Terry appointed Robert W. Glenn, Jr., 6128 Plantation
Road N. W., as an Alternate Electrical Utility Representative on the
Electrical Examining Board to fill the unexpired term of William M. Mills,
which term expires June 30, 1981.
The members of the Board concurred with this appointment.
Supervisor Johnson stated that in such developments as Pebble
Creek, Timberline, Bent Tree and Stone Henge, there are no stop signs
leading into the public roads from these private roads. Since this is a
dangerous situation, she moved that Administrator Clark write a letter to
the developers and request they voluntarily install stop signs. If they
do not install the signs, she asked that the County look into getting the
signs erected.
Hotion was adopted by unanimous voice vote.

Supervisor Johnson expressed her gratitude at the return of the
hostages from Iran.
Chairman Myers presented Supervisor Terry with a plaque for his
service as Chairman of the Board for 1980. Mr. Terry thanked all the Board
members.

EXECUTIVE SESSION

IN RE:
CRESTVIEW TOWNHOUSES
RESOLUTION NO. 2787 AUTHORIZING THE ROANOKE COUNTY UTILITY
DEPARTMENT TO EXPEND FUNDS TO PROVIDE WATER SERVICE TO A
PROPOSED TOWNHOUSE DEVELOPMENT TO BE KNOWN AS CRESTVIEW TOWNHOUSES.
BE IT RESOLVED by the Board of Supervisors of Roanoke County~
Virginia~ as follows:
1. That this Board does hereby authorize the County Utility Department
to provide water service to a proposed townhouse development to be known
as Crestview Townhouses located on the Starkey Road and consisting of
160 residential units. This service is to be provided utilizing the
purchase of city water and the installation of additional pump and
equipment necessary to provide this service. In addition~ the County
Utility Department is authorized to construct a new well and necessary
connecting lines in the vicinity of the proposed development. Further~
that the Utility Department is authorized to pay up to one-half the
drilling cost of a new well to be developed on a site donated to the
County in fee simple by the developer; and which well will be connected
to the County system if deemed suitable for development and the developer
will be responsible for paying one-half of drilling cost of this new
well. The cost of these projects to the County is not to exceed $50~600.
2. That the County Administrator is hereby authorized and directed

to enter into any necessary agreements, upon a form approved by the
County Attorney, or to accept any conveyance which relates to this
project.

RESOLUTION NO. 2788 AUTHORIZING THE EXECUTION OF A RE-
IMBURSEMENT AGREEMENT FOR WATER AND SEWER SERVICE TO THE
PROPOSED CRESTVIEW TOWNHOUSES.
Virginia, as follows:
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
enter into reimbursement agreements for both water and sewer line extensions
1. That this Board does hereby authorize the County of Roanoke to
so that the lines to be installed as a result of the Crestview Townhouse proj t
will be of an adequate size to serve the entire drainage area in the
vicinity of the proposed Crestview Townhouses located on the Starkey
Road; and which will result in no cost to the County; and
2. That the County Administrator is hereby authorized and directed
to enter into such agreements with the developer of this project on forms
approved by the County Attorney.
