The Board of County Supervisors of Roanoke County, Virginia, met this day
in open session at the Salem-Roanoke County Civic Center in Salem, Virginia, this
being the fourth Tuesday and the second regular meeting of the month of November.
Members present: Chairman May W. Johnson, Vice Chairman Robert E. Myers,
Supervisors R. Wayne Compton, Edward C. Park, Jr., and Lawrence E. Terry.
Chairman Johnson announced to those present that the meeting had already
been called to order at the six o'clock session at which time the Board went into
Executive Session and to which the Board will return later in the meeting. The
invocation was offered by The Reverend Edgar G. Petry, Oak Grove Church of the
Brethren. The Pledge of Allegiance to the flag was recited in unison.

IN RE:
PUBLIC HEARING ON REQUEST OF MRS. ETHEL TICKLE
BARTON FOR A SPECIAL EXCEPTION TO PARK A MOBILE
HOME TO BE OCCUPIED BY MRS. DREMA TICKLE CHURCH
(DAUGHTER) ON A I-ACRE TRACT LOCATED 450 FEET
SOUTHWEST OF STATE ROUTE 619 (WILDWOOD ROAD), 2,000
FEET NORTHWEST OF ITS INTERSECTION WITH STATE ROUTE
733 (RICHLAND HILLS DRIVE)
The request of Mrs. Ethel Tickle Barton for a special exception to park a
mobile home to be occupied by her daughter, Mrs. Drema Tickle was presented to
the Supervisors by Furman B. Whitescarver, Jr., Attorney.
Mr. Whitescarver advised those present that the property was rezoned from
R-l to RE at the November 13 meeting of the Board and that Mrs. Barton is now
requesting a special exception to park a mobile home so her daughter, who is
divorced, and children may occupy it. Mr. Whitescarver also advised that Mrs.

Church plans to build a home on the site but is not financially able to at the
present time. Mr. Whitescarver then noted that the petitioner proffered condition
at the November 13 meeting that the rezoning would be for a two-year period and
would revert to R-l at the end of that period, or if Mrs. Church moves within that
two-year period the mobile'home would have to be removed and the property would
revert to the R-l zoning. Mrs. Church and her children will be the only occupants
of the mobile home.

Mr. Whitescarver clarified that the property had to first be rezoned since mobile
homes are permitted only in RE and A-I districts and after the rezoning was
granted, a special exception must be granted to park the mobile home on the
subject property.
At this point, Chairman Johnson recognized Mr. Robert L. Foster of Route 5,

Box 121 (Wildwood Road), Salem, who appeared in opposition. Mr. Foster stated
that Mrs.Church did not have custody of her children and therefore her request
is not a hardship case. In response, Mr. Whitescarver advised that he is not
handling the domestic aspect of Mrs. Church's case, but he did note that any
custody matter is subject to change. Catawba District Supervisor Myers asked
Mr. Foster if the trailer would be visible from Wildwood Road; Mr. Foster respondel
in the affirmative. Mr. Myers advised that he had made an on-site investigation
and he could not see how the mobile home would be visible.
This concluded the public hearing and Supervisor Myers moved that the request
be approved subject to the provisions of the County Zoning Ordinance as it pertain3
to mobile homes, which motion was adopted unanimously.

PUBLIC HEARING ON REQUEST OF MRS. MARTHA C. JONES
FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON
A I-ACRE PORTION OF A 35.90-ACRE TRACT LOCATED OFF
THE NORTH SIDE OF STATE ROUTE 607, 0.4 MILE WEST OF
STATE ROUTE 711 IN THE WINDSOR HILLS DISTRICT

Chairman Johnson opened the floor for public comments and recognized Mrs.
Jones, who advised that she and her sister are presently residing in a house,
which is rather old and her sister had just recently purchased a new mobile home
which they plan to place on her property (Mrs. Jones owns approximately 36 acres).
Mrs. Jones stated that the mobile home would be a much nicer place to live than
the house. Mrs. Johnson asked Mrs. Jones how far the property is from the nearest
house. Mrs. Jones responded that there is approximately one quarter mile on
either side of the subject property.
At this point, Chairman Johnson recognized Mr. Frank Surface, who appeared in
40 to 45 feet from Mrs. Jones' property line). Mr. Surface advised that he was

opposition, and advised he is an immediate neighbor to Mrs. Jones (approximately
also representing four out of five adjoining property owners who oppose the reques
Mr. Surface stated that he feels that the money would be better spent on improving
the house and mainly opposed the request since the trailer is plainly visible from
his house and would be an eyesore and possibly devalue the surrounding property.

This concluded the public hearing and Supervisor Terry moved that the
request be denied, which motion was adopted unanimously.

PUBLIC HEARING ON REQUEST OF PEGGY MELTON SLOANE FOR
RENEWAL OF A SPECIAL EXCEPTION TO PARK A MOBILE HOME
OCCUPIED BY MRS. EMMA MELTON (MOTHER) ON A la-ACRE TRACT
LOCATED AT 6983 WOOD HAVEN ROAD, 0.8 MILE FROM PETERS CREEK

Chairman Johnson opened the floor for public comments and recognized Ms.
Sloane. No one appeared in opposition.
This concluded the public hearing and Supervisor Myers moved that the
renewal be approved beginning November 15, 1979, subject to the provisions of
the County Zoning Ordinance as it pertains to mobile homes, which motion
was adopted unanimously.

PUBLIC HEARING ON REQUEST OF MARY J. JOHNSON FOR RENEWAL
OF A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 2.79-
ACRE TRACT LOCATED AT THE END OF STATE ROUTE 777, 0.1 MILE
PAST THE END OF STATE MAINTENANCE IN THE CATAWBA DISTRICT
Chairman Johnson opened the floor for public comments. No spokesman for the

petitioner was present nor was anyone present in opposition.
This concluded the public hearing and Supervisor Myers moved that the
renewal be approved beginning November 11, 1979, subject to the provisions of
the County Zoning Ordinance as it pertains to mobile homes, which motion
was adopted unanimously.

Chairman Johnson opened the floor for public comments and recognized Furman
B. Whitescarver, Jr., Attorney, who appeared on behalf of the petitioners. No
one appeared in opposition.

Mr. Whitescarver noted that the Planning Commission did deny the request by
a three-two vote, although the County Planner did favorably recommend it. Mr.
Whitescarver then advised that Mrs. Munsey leases the property to George and
Dorothy Adams and Mr. Adams' wife, Dorothy, is a Palmist, which provides additiona
income. The Adams propose to operate a Palm Reading Studio in their residence.
Mr. Whitescarver noted the petition signed by approximately 20 persons in favor

of the request and also made note of the petition submitted with seven signatures
at the Planning Commission hearing opposing the request. Mr. Whitescarver then
advised that Mrs. Adams previously operated out of Franklin County for about 11
years with no problems. In conclusion, Mr. Whitescarver stated that the residence
is in Business B-2 and is such property that should be used for a business since

it is in a heavily travelled area.
Mrs. Johnson, who represents the Cave Spring District, advised that she has
received phone calls from certain people in the area opposing the request.
Supervisor Terry advised that he had received similar calls.
This concluded the public hearing and Supervisor Terry moved that the "Use
Not Provided For" permit be denied for the reason that;
While such permit is authorized to be issued pursuant to the County Code the
authority vested in the Board is to permit uses that are both similar and compa-
tible with other uses in the district. The use herein requested is neither
similar nor compatible to the other uses in the district effected except that the
use herein requested, for lack of a better descriptive term, would be a business,
which motion was adopted by the following recorded vote:

RAFFLE PERMIT - ROVANETTES BOOSTER CLUB
There being no opposition to the request of the Rovanettes Booster Club for
a raffle permit, Supervisor Park moved that the permit be issued for the period
November 27, 1979 through December 31, 1979, which motion was adopted unanimously.

IN RE:
REFERRALS TO PLANNING COMMISSION
In a report to the Board, the County Executive advised that the following
petitions for rezoning have been referred to the County Planning Commission
since the Supervisors' meeting on October 9, 1979:
(1) Petition of Frances E. Weaver for rezoning from R-l to B-2 of a 1.372-
acre tract on the north side of Hardy Road (Route 634), 2,400 feet west
from its intersection with Feather Road (Route 654). Rezoning is
requested to allow construction of a building to contain an archery range.
This tract of land is already the site of a grocery/hardware store being
operated under the County's "grandfather" clause; approval of the rezoning
would bring this store into conformity with the County's zoning regulations.
(2) Petition of the Trustees of the Goodwin Memorial Methodist Church for
rezoning from M-2 to A-l of a tract containing 1/8 acre on the north
side of Route 639, 1,200 feet east of U. S. Route 11/460 and 1.25 miles
east from the Montgomery County line. Rezoning is requested so that a
Sunday school room may be added onto the existing Church.
(3) Petition of Ronald C. Brooks for rezoning from A-l to M-l of three tracts
containing a total of 1.176 acres located on the southeast side of Babe
Louis Road (Route 603), opposite the Bonsack Ruritan Club building.
Rezoning is requested to allow operation of a wholesale warehouse.

RESOLUTION NO. 2438 ADVISING THE STATE DEPARTMENT
OF CORRECTIONS THAT THE BOARD OF SUPERVISORS OF
ROANOKE COUNTY ARE CONSIDERING REQUESTING THE DEPART-
MENT TO DEVELOP AND OPERATE A COURT SERVICES UNIT IN
THE COUNTY OF ROANOKE; AND REQUESTING SAID DEPARTMENT
TO ADVISE THE BOARD OF SUPERVISORS OF ROANOKE COUNTY AS
TO THE NATURE OF THE SERVICES THAT CAN BE PROVIDED THROUGH
A STATE-OPERATED COURT SERVICES UNIT FOR ROANOKE COUNTY
BE IT RESOLVED by the Board of County Supervisors of Roanoke County as
directed to advise the State Department of Corrections that the Board of
1. That the County Executive be, and he hereby is authorized and
Supervisors of Roanoke County are considering, after due consultation with the
Juvenile and Domestic Relations District Court's Judges for the County of Roanoke,
requesting said Department to establish a State-operated Court Services Unit for
Roanoke County; and

services which can be provided by the State Department of Corrections through

to execute, on behalf of the County of Roanoke, any and all grant documents

OF THE ROANOKE COUNTY PUBLIC SERVICE AUTHORITY
BE IT RESOLVED by the Board of County Supervisors of Roanoke County as

1. That the Board, having heretofore on June 27, 1979, purchased two
certain water companies; to-wit, Craighead Water System at a purchase price of
$425,000, and Utility Services Water System at a purchase price of $325,000, does
hereby ratify and confirm the purchase of said water companies at the purchase
prices herein set forth; and
2. That the County of Roanoke, having heretofore purchased, on behalf of
the Roanoke County Public Service Authority, a certain sanitary sewer system;
to-wit, Roanoke Sanitary Disposal Corporation at a purchase price of $500,000,
does hereby confirm and ratify said purchase on behalf of the County of Roanoke
and does hereby further ratify and acknowledge a loan from the County of Roanoke
to the Roanoke County Public Service Authority in the amount of $500,000; and
3. That an attested copy of this resolution be forthwith forwarded to the

FOR THE ROANOKE COUNTY PUBLIC SERVICE AUTHORITY UPON
CERTAIN TERMS AND CONDITIONS AND AUTHORIZING AND DIRECT-
ING THE COUNTY EXECUTIVE TO ENTER INTO A CONTRACT WITH
THE SUCCESSFUL BIDDER
BE IT RESOLVED by the Board of County Supervisors of Roanoke County as

1. That that certain bid of Dixon Contracting, Inc., in the amount of
$137,987.50 for ductile iron pipe for the Garden City Water System Project, upon
all and singular the terms and conditions of the invitation to bid, the specifica-
tions of the County of Roanoke, Virginia, the bidder's proposal and the provisions
of this resolution be, and the same is hereby, ACCEPTED; and
2. That the County Executive be, and he hereby is, authorized and directed
to enter into contract with Dixon Contracting, Inc., for said project; and
3. That all other bids for said project are hereby REJECTED and the County
Clerk is directed to so notify such bidders and express the County's appreciation
for such bids.

$30,559 for the purchase of a four wheel van type ambulance for the Cave Spring
Rescue Squad, upon all and singular the terms and conditions of the invitation to
bid, the specifications of the County of Roanoke, Virginia, the bidder's proposal

or the payment thereof is otherwise secured to the County in manner and form

REQUEST OF RICHARD R. HAMLETT, PRESIDENT OF
NORTHVIEW CORPORATION, FOR A CONDITIONAL USE
PERMIT UNDER SECTION 21-6 OF THE ROANOKE COUNTY
CODE TO OPERATE A LANDFILL ON PROPERTY OWNED BY
NORTHVIEW CORPORATION FRONTING ON ROUTE 419 AND
BOUNDED ON THE NORTH BY MCVITTY ROAD IN THE
WINDSOR HILLS DISTRICT

Mr. Hamlett was present and acted as spokesman for his company's request.
It was noted that this matter had been continued from several previous meetings
the first continuance was so that Mr. Hamlett along with County staff and repre-
sentatives from the State Highway Department could meet and work out the apparent
drainage problems that may exist by reason of granting such conditional use, and
the last continuance was at Mr. Hamlett's request, who advised that he was in the
process of having Buford T. Lumsden & Associates, land surveyors, do some engin-
eering on the proposed landfill site for drainage purposes. Mr. Lumsden was also
present at the meeting.
Chairman Johnson asked if anyone was present in opposition. Approximately
ten persons stood in opposition to this request. At this point, Supervisor
Compton asked Mr. Hamlett what he is proposing to use for fill material. Mr.
I
Hamlett advised that the biggest part of it is dirt. Mr. Compton then asked if
Mr. Hamlett needs a permit from the County for dirt and rocks and was advised
by County staff that he did not need approval from the County if he uses only
dirt and rocks. County Executive Clark clarified that the reason for the request
being before the Board was because the original request did constitute a landfill
under the County's ordinance. Mr. Clark then noted that if Mr. Hamlett wishes to
use just dirt and rocks the only approval he needs is that of the County's
Engineering Department for his grading and soil erosion control plan.
At this point, Chairman Johnson recognized Mr. Hamlett who stated that he
would be satisfied to use only dirt and rocks for fill material. In response
to a question raised by Supervisor Myers, Acting County Engineer Cerak advised
that the plan prepared by Buford T. Lumsden & Associates and submitted by
Mr. Hamlett is exactly what the County Engineer, Gene Robertson, wanted. He

did, however, note that Mr. Hamlett still needs approval from the State Highway
Department.

Chairman Johnson recognized Mr. Roger A. Lorder, 4390 Sheldon Drive, S. W.,
who advised that he resides on the north side of the proposed operation in
Cresthill #2 and opposes the request for several reasons, which Mr. Lorder had
stated at previous hearings on the matter. Most of the objections dealt with
the depositing of materials other than dirt and rocks.
Mr. William Brenton, President and representative of the Sugar Loaf Civic
League, asked if the drainage problems have been resolved and was advised by
Mr. Cerak that Mr. Hamlett's plans are consistent to that which is required
by the Engineering Department, but must be developed into more detailed
drawings before they are formally approved.
Following more discussion, Mr. Hamlett assured the Board that nothing other
than dirt and rock will be used for fill material; it was noted that Mr. Hamlett
must still obtain approval from the County's Engineer Department of an erosion
and siltation control plan.

RESOLUTION NO. 2455 AUTHORIZING AND DIRECTING THE COllliTY
EXECUTIVE TO ENTER INTO A CERTAIN LEASE AGREEMENT ON BEHALF
OF THE COUNTY OF ROANOKE LEASING APPROXIMATELY 5~lOO SQUARE
FEET OF ADDITIONAL SPACE IN THE FORMER SALEM THEATER BUILD-
ING UPON CERTAIN TERMS AND CONDITIONS
BE IT RESOLVED by the Board of County Supervisors of Roanoke County
as follows:
1. That the County of Roanoke be~ and it hereby is~ authorized to enter
into a certain lease agreement whereby approximately 5~lOO square feet of addi-
tional floor space~ being the third floor of the former Salem Theater Buildin~~
shall be leased to the County for additional office accommodations for various of
the departments of the County of Roanoke for a term to end April 5~ 1980~ with an
option to renew at a monthly rental not to exceed $1~900 during said term; and
2. That the County Executive be~ and he hereby is~ directed to enter into
written lease agreement between the County and the Lessor providing among other
conditions that six (6) inches of insulation or more be placed by Lessor in the
third floor ceiling and that storm windows be installed by Lessor; the same to be
upon form approved by the County Attorney.

to bring a delinquent tax proceeding against certain property situate and
the Town of Vinton, which motion was adopted by the following recorded

RECONVENEMENT OF MEETING
Chairman Johnson advised that she was reconvening the meeting to take a
revote on the motion regarding appointment of Charles H. Osterhoudt to bring a
delinquent tax proceeding against certain property.
Following some discussion, a recall vote was taken on the motion to
appoint Mr. Osterhoudt.
On a roll call vote, the Supervisors voted as follows, to-wit:

In accordance with the above action, Mr. Osterhoudt was not appointed to
