The Board of County
Supervisors of Roanoke County, Virginia,
met this day in open session at the Salem-Roanoke County Civic Cente
in Salem, Virginia, this being the fourth Tuesday and the second
I
regular meeting of the month of January.
Members present:
Chairman Lawrence E. Terry, Vice-Chairman Edward C.
Park, Jr., Supervisors May W. Johnson, Robert E. Myers, and Paul B. Matthews.
Chairman Terry called the meeting to order at 6:00 p.m. and announced that
opening business will include only routine matters; public hearings and other
agenda items will not begin until 7:00 p.m.
Chairman Terry then recognized Dr. Nancy M. Welch from the Health Department
and she presented a report regarding the lack of an adequate amount of fluoride
in the Roanoke County area water system. Dr. Welch presented a proposed program
to have the elementary school children use a solution with fluoride in a

"swishing" method once each week in order to get an adequate fluoride treatment
for their teeth care.
Drs. Robert G. Donnelly and Richard E. Smith of Virginia
Western Community College presented their views in relation to studies done for
this program used in other areas. Dr. Welch asked the Supervisors to consider
this program in the next school budget.

At 6:25 p.m. on motion of Supervisor Johnson and a unanimous voice
vote, the Board went into executive session to discuss personnel and legal
matters.
At 7:04 p.m. by motion of Supervisor Park and a unanimous voice vote,
the Supervisors reconvened in open session.
Chairman Terry recognized John M. Chambliss, Jr., Director of Finance,

who offered the invocation.
The Pledge of Allegiance to the flag was recited
in unison.
Chairman Terry then introduced the new Hollins Magisterial District
Supervisor, Mr. Paul B. Matthews and the new secretary to the Board of
Supervisors.

On motion of Supervisor Matthews and a unanimous voice vote, the
minutes of the regular meeting December 11, 1979; the Special meeting December
27, 1979, and the Organizational meeting January 2, 1980, were approved as

APPLICATION OF DONALD RAY DEAN FOR A SPECIAL
EXCEPTION TO PARK A MOBILE HOME ON A l6-ACRE TRACT

The Board of Zoning Appeals did not hold it's regular meeting
scheduled for January 16, therefore, the Board did not receive a report on
variances. Mrs. Johnson moved that the Board should defer this application
to the next meeting, which motion was adopted by the following recorded vote.

Since the Board of Zoning Appeals did not hold it's regular
meeting scheduled for January 16, the Board did not receive a report on
variances and Mr. Myers made a motion to defer this application until the next
meeting which motion was adopted by the following recorded vote.

IN RE: APPLICATION OF BOTETOURT JAYCEES FOR A RAFFLE PERMIT
Chairman Terry asked if there was anyone present representing
the Botetourt Jaycees. Mr. G. M. Looney was present in the audience to represen

the Jaycees. County Attorney, James E. Buchholtz, advised that although the
name of the group desiring the raffle permit is the Botetourt County Jaycees,
their meeting place is located in Roanoke County and the Roanoke County
Supervisors have the authority to issue the requested permit since the raffle
will be conducted in Roanoke County.
Supervisor Myers made a motion that the application be approved,
which motion was adopted by the following recorded vote.

REQUEST OF E. L. and o. S. MEEKS FOR A "SPECIAL
USE PERMIT" FOR THE PURPOSE OF A LANDFILL ON THEIR
PROPERTY LOCATED AT LEMON TREE ROAD (ROUTE 709)
IN THE VINTON MAGISTERIAL DISTRICT
Chairman Terry asked if there was anyone present to represent

or object. No one responded. Supervisor Park asked County Planner, Timothy
Gubala, of the Planning and Zoning Department to come forward. Mr. Gubala stated
that he had informed the Meeks' of this meeting, but since it was not officially
a public hearing,adjoining property owners had not been notified. Mr. Park then
made a motion that this item be passed over until later in the meeting, which
motion was adopted by a unanimous voice vote.
IN RE:
REPORT ON ROANOKE COUNTY COURT SERVICE UNIT
County Administrator, William F. Clark, presented his report
to the Board regarding the services and funds available should the state be
asked to assume operations for the local Court Service Unit.

RESOLUTION NO. 2487 REQUESTING THE STATE DEPARTMENT
OF CORRECTIONS TO DEVELOP AND OPERATE A COURT
SERVICES UNTI IN THE COUNTY OF ROANOKE

BE IT RESOLVED by the Board of Supervisors of Roanoke
County as follows:
1. That the County Administrator be, and he hereby is, authorized
and directed to advise the State Department of Corrections that the Board of
Supervisors of Roanoke County, after due consultation with the Juvenile and
Domestic Relations Court's Judges for the County of Roanoke, requests the
Department to establish a State-operated Court Services Unit for Roanoke
County; and
2. That the Clerk be, and he hereby is, directed to forthwith forward
attested copies of this resolution to the Director of the Department of

Corrections in Richmond, Virginia.
Supervisor Myers then made a motion that the prepared resolution
be adopted, which motion was adopted by the following recorded vote:

IN RE:
REPORT ON COUNTY COURTHOUSE EXPANSION
County Administrator, William F. Clark, presented his
report which asks the Board to authorize our entering into an agreement with
VVKR Partnership to provide a schematic design of space and costs in relation-

ship to the proposed building expansion.

RESOLUTION NO. 2488 AUTHORIZING AND DIRECTING
THE COUNTY ADMINISTRATOR TO ENTER INTO A CERTAIN
AGREEMENT ON BEHALF OF THE COUNTY OF ROANOKE
WITH VVKR PARTNERSHIP TO PROVIDE CERTAIN
ARCHITECTURAL SERVICES TO THE COUNTY OF ROANOKE
UPON CERTAIN TERMS AND CONDITIONS
BE IT RESOLVED by the Board of Supervisors of Roanoke
County as follows:
1. That the County Administrator be, and hereby is, authorized and
directed to enter into a certain contractual agreement on behalf of the County
of Roanoke with VVKR Partnership to provide certain consultant services relating
to a proposal for the detailed expansion and renovation of the Roanoke County
Courts facilities to provide a programmed and schematic design of space relation-

ships and probable costs of such expansion and renovation; and
2. That such contract shall be upon form approved by the County Attorney
and shall contain provision that the work provided for shall be completed not
later than 8 weeks following the execution of such contract, at a fee not to
exceed $35,000.00, a portion of which shall hereafter be credited to the County
upon completion of the final design of such expansion/renovation.
A motion was made by Supervisor Johnson to adopt the prepared
resolution whcih motion was adopted by the following recorded vote:

IN RE:
REPORT ON HOLLINS PUBLIC SAFETY BUILDING
County Administrator, William F. Clark, presented his
report which includes two phases of study and design to be performed by VVKR
Partnership in relation to the new Hollins Public Safety Building.
The Board
agreed that the cost of such preliminary work should be credited toward any
final work prepared by VVKR Partnership in connection with the proposed
building.

RESOLUTION NO. 2489 AUTHORIZING AND DIRECTING
THE COUNTY ADMINISTRATOR TO ENTER INTO A CERTAIN
AGREEMENT ON BEHALF OF THE COUNTY OF ROANOKE
WITH VVKR PARTNERSHIP TO PROVIDE CERTAIN

BE IT RESOLVED by the Board of Supervisors of Roanoke County
1. That the County Administrator be, and hereby is, authorized and

directed to enter into a certain contractual agreement on behalf of the County
of Roanoke with VVKR Partnership to provide certain consultant services relating
to a proposal for development of the County's North 11 property in two stages;
to-wit, (a) conceptual design and architectural style for the County Adminis-
trative Center, and (b) construction drawings for the Hollins Public Safety
Building and site development plans; and
2. That such contract shall be upon form approved by the County
Attorney and shall contain provision that the work provided for in stage (a)
above shall not exceed $5,500.00, and the work provided for in stage (b) above
shall not exceed the total sum of $48,837.00 without additional authorization
of the Board.
Mr. Myers made a motion that the prepared resolution be adopted,

Mr. Clark also suggested that these citizen committees be given carte
blanche to gather information appropriate to their endeavors from our County
staff. Supervisor Johnson moved that all three committees, composed as
listed by the County Administrator, be appointed and that they be thanked
for accepting such appointment. Her motion was adopted by a unanimous voice
vote.

IN RE:
FINANCIAL STATEMENT FOR SIX-MONTH PERIOD
ENDED DECEMBER 31, 1979.
John M. Chambliss, Jr., Director of Finance, submitted the
report for said period which was accepted and filed with the minutes of this
meeting. He then distributed to each Supervisor a calendar for preparation of
the 1980-81 budget, which has already been given to County departments.

REQUEST FOR FOUR ADDITIONAL EXTENSIONS TO THE
GARDEN CITY TRANSMISSION MAIN PROJECT
W. L. Rossie, Jr., County Utility Director, explained to
the Supervisors the report and provided background information on the project.
After consideration of the Board, Mr. Park moved that the Board approve the
report, copy of which is filed with the minutes of this meeting, which motion
was adopted by the following recorded vote:

IN RE:
RESOLUTION NO. 2490 WAIVING CERTAIN REQUIREMENTS
OF THE ROANOKE COUNTY WATER ORDINANCE IN REGARD
TO CERTAIN PROPERTIES
BE IT RESOLVED by the Board of Supervisors of Roanoke County

as follows:
1. That that certain provision of the Roanoke County Water Ordinance
as contained in Section 20.1-5 of the Roanoke County Code as same relates to
the installation of fire hydrants in certain residential areas of the County,
by requiring strict compliance therewith would impose an undue hardship on
Lots 1, 2, and 3, Section 8, Woodlands, is hereby waived as to said Lots 1, 2,
and 3, Section 8, of the Woodlands; and
2. That the Clerk of the Board of Supervisors be, and hereby is,
directed to forthwith forward an attested copy of this resolution to the
record owners of Lots 1, 2 and 3, Section 8, of the Woodlands.

165 gpm. Supervisor Park moved that the Board request transfer of the William
Byrd property to the County Board of Supervisors, which the Board concurred

RESOLUTION NO. 2492 ACCEPTING A CERTAIN BID
MADE TO THE COUNTY OF ROANOKE FOR THE
PURCHASE OF 90 DOZEN SOFTBALLS TO BE USED
BY THE COUNTY DEPARTMENT OF PARKS AND
RECREATION.
BE IT RESOLVED by the Board of Supervisors of Roanoke
County as follows:
1. That that certain bid of Graves Humphreys of Roanoke in the total
amount of $3,326.40 for 90 dozen softballs to be used by the Roanoke County
Department of Parks and Recreation, upon all and singular the terms and
conditions of the invitation to bid, the specifications of the County of
Roanoke, Virginia, the bidder's proposal and the provisions of this resolution be
and the same is hereby ACCEPTED; and

That the County Administrator be, and he is hereby, authorized
and directed to issue the requisite purchase order in the name of Graves
Humphreys of Roanoke for the purchase of said softballs; and
3. That all other bids for the purchase of said softballs are hereby
rejected and the County Clerk is directed to so notify such bidders and express
the County's appreciation for such bids.

Supervisor Matthews moved that David G. Dillon be reappointed

Supervisor Matthews moved that Norman Eugene Jarrett be

Supervisor Myers asked that a resolution be prepared thanking
Mr. E. R. Bowery, Jr., for serving as the County's Representative on the
Salem-Roanoke County Civic Center Commission. Mr. Myers then moved that
Mrs. Lela Spitz, Route 4, Salem, Virginia, be appointed for a 4-year
term replacing Mr. Bowery on the Civic Center Commission, which motion

was approved unanimously.

APPOINTMENT TO THE HIGHWAY SAFETY COMMISSION
Supervisor Matthews moved that James E. Barlow be reappointed
for another term, which motion was approved unanimously.

APPOINTMENT TO MENTAL HEALTH SERVICES OF THE ROANOKE
VALLEY BOARD OF DIRECTORS
Supervisor Johnson asked that since Mr. Hebert is not eligible for
reappointment he be sent a letter thanking him for his previous services.
She then moved that Dr. Andrew A. Slemp, 5704 Penquin Drive, Roanoke,
Virginia, be appointed to the Board of Directors of the Mental Health

Services of the Roanoke Valley, which motion was approved unanimously.

APPOINTMENT TO THE PLANNING COMMISSION
Supervisor Matthews asked that this appointment be continued.
He also advised that he presently had no candidate for an appointee from
Hollins District on the Library Board and asked that this also be
continued.

APPOINTMENT TO THE LIBRARY BOARD
Supervisor Park moved that Ann Wade (Mrs. Douglas), 1025
Howell Drive, Vinton, Virginia, be appointed to serve on the Library Board
from the Vinton District, which motion was approved unanimously.

UNFINISHED BUSINESS
RESOLUTION NO. 2493 WAIVING THE REQUIREMENTS
OF THE ROANOKE COUNTY WATER ORDINANCE IN
REGARD TO CERTAIN PROPERTY LOCATED IN ROANOKE
COUNTY ADJACENT TO THE CORPORATE LIMITS OF
THE CITY OF SALEM
BE IT RESOLVED by the Board of Supervisors of Roanoke
County as follows:
1. That the provisions of the Roanoke County Water Ordinance as con-
tained in Section 20.1-5 of the Roanoke County Code be, and they hereby are,
waived insofar as the same relates to the provision of service only as same
relates to that certain piece, parcel or tract of land situate, lying and being
in the County of Roanoke adjacent to the corporate limits of the City of Salem,
the same being known and designated as Woodbridge Subdivision property of

Westclub Corporation; provided, however, this waiver shall in no way obviate
the construction standards of Roanoke County Water Ordinance in relation to
any water system constructed or developed in said subdivision; and
2. That the Clerk to the Board of Supervisors be, and he hereby is,
directed to forthwith transmit an attested copy of this resolution to the
appropriate officer of Westclub Corporation.
Supervisor Myers moved that the prepared resolution be adopted,
which motion was approved by the following recorded vote:

IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS

Supervisor Park reminded those present that at the workshop recently
held at the Peaks of Otter, consideration had been given to hiring of a grants-
man for Roanoke County and he asked County Administrator Clark if the matter
was being looked into. Mention was made that the former County Planner had been
responsible for filing of certain grants, and the present County Planner was
asked if his workload would allow him to accept this additional responsibility.

Mr. Gubala responded that he and his staff were currently involved in revision
of two County ordinances in addition to their normal duties, and that he did not
feel he would be able to devote to the grantsman position the time or necessary
expertise. Mr. Park then asked Mr. Clark to continue investigating the possi-
bility and to report back to the Board when he had recommendations to make.
IN RE:
RESOLUTION NO. 2494 AUTHORIZING THE ISSUANCE
OF $2,900,000 JAIL BONDS OF ROANOKE COUNTY,
VIRGINIA, AND PRESCRIBING SOME OF THE DETAILS
OF SAID BONDS AND AUTHORIZING THE ISSUANCE
OF BOND ANTICIPATION NOTES IN ANTICIPATION
OF THE SALE OF SAID BONDS.

WlIEREAS, a majority of the qualified voters of Roanoke County voting
at an election duly called and held on November 8, 1977, were in favor of the
contracting of debt and the issuance of bonds of said County of the principal
amount of $2,900,000 of bonds for the purpose of financing the cost of a jail
facility, and an order was duly entered on January 31, 1978, in the Circuit
Court of said County authorizing the Board of Supervisors of said County to pro-
ceed to carry out the wishes of the voters of said County; and
WHEREAS, the Board of Supervisors desires to authorize the issuance

of said bonds and to prescribe some of the details thereof and provide for the
issuance of bond anticipation notes in anticipation of the sale thereof; NOW,
THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows:
(1) Roanoke County shall issue its bonds of the principal amount of
$2,900,000 pursuant to the provisions of the Public Finance Act (Chapter 5 of
Title 15.1 of the Code of Virginia, 1950, as amended) and in accordance with
the proposition approving the issuance of said bonds adopted by a majority of
the qualified voters of said County voting at an election held on November 8,
1977. The moneys raised by the issuance of said bonds shall be used to finance
the cost of a jail facility for Roanoke County, including the acquisition of
real estate.
Said Bonds shall be designated "Jail Bonds", shall be dated and

shall be payable in installments as may be determined by the Board of Supervisors
of Roanoke County by resolution adopted prior to the issuance thereof.
(2) Both principal of and interest on the bonds shall be payable at
Paying Agents to be designated by the Board of Supervisors prior to the issuance
thereof, in any coin or currency of the United States of America which at the

time of payment is legal tender for the payment of public and private debts.
Said bonds shall bear the facsimile signature of the Chairman of the Board of
Supervisors and shall be signed by the County Treasurer and a facsimile of the
official seal of said Board shall be imprinted upon said bonds. The interest

coupons to be attached thereto shall be authenticated with the facsimile
signature of said Chairman.
(3) Said bonds and the interest coupons representing the interest
payable thereon shall be in substantially the following form:

(4) For the payment of the principal of and the interest on the bonds
authorized by this resolution as the same shall become due, the full faith and
credit of Roanoke County, Virginia, are hereby irrevocably pledged, and each year
while any of said bonds shall be outstanding there shall be levied and collected
in accordance with law, an annual valorem tax upon all taxable property in said
County subject to local taxation sufficient in amount to provide for the payment
of the principal of and the interest on said bonds as such principal and interest
shall become due, which tax shall be in addition to all other taxes authorized
to be levied in said County.
(5) The sum of $2,900,000 shall be borrowed by Roanoke County in
anticipation of the receipt of the proceeds of the sale of the bonds authorized
to be issued for the purpose of financing the cost of a jail facility which was
approved by the qualified voters of Roanoke County voting at said election held
on November 8, 1977. Negotiable notes each designated "Jail Bond Anticipation
Note" shall be issued for the sums, or portions thereof, so borrowed.

Each such note shall be dated on or about the date of its issuance and
shall be payable within two years, provided that on or after such maturity date,
any such note may be extended from time to time; provided, further, that no
such extension shall be payable later than five years from the date of issuance of
the original note issued to finance the respective purpose for which bonds have
been authorized. Each such note shall bear interest from its date at a rate
which shall not exceed the maximum rate of interest at the time allowed by law.
Such interest shall be payable at the maturity of the note. Each of said notes
shall be signed by the Chairman of the Board of Supervisors of Roanoke County
and by the County Treasurer of Roanoke County and the seal of the County shall
be impressed on such note.

(6) Such notes shall be issued by the Chairman of the Board of
Supervisors of Roanoke County and the County Treasurer of Roanoke County from
time to time in such denominations and bear such rate of interest payable at such
places of payment at such time, within the provisions of this resolution, as
they shall determine. The power to make such determination is hereby delegated
to the Chairman of the Board of Supervisors and the County Treasurer. A report
of each sale of notes shall be made by the aforesaid officials to the Board of
Supervisors promptly after each transaction.

(7) The Clerk of the Board of Supervisors is hereby directed to file
a certified copy of the resolution entitled "RESOLUTION AUTHORIZING THE ISSUANCE
OF $2,900,000 JAIL BONDS OF ROANOKE COUNTY, VIRGINIA, AND PRESCRIBING SOME OF
THE DETAILS OF SAID BONDS AND AUTHORIZING THE ISSUANCE OF BOND ANTICIPATION
NOTES IN ANTICIPATION OF THE SALE OF SAID BONDS", adopted by the Board of
Supervisors on January 8, 1980 with the Circuit Court of Roanoke County in order
to comply with the provisions of the Public Finance Act.

Supervisor Johnson moved for adoption of a prepared resolution on jail bonds
and the motion was adopted by the following recorded vote.
AYES: Mr. Terry, Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Matthews.
NAYS: None
Supervisor Johnson asked the Coordinator of Fire and Emergency Services,
Robert N. Monroe, about radio monitors for the Clearbrook rescue squad. He
agreed that this equipment is needed and advised that funds for it's purchase
will be included in the 1980-81 budget proposals.

Supervisor Johnson asked the County Administrator to have Parks and
Recreation Director prepare a report on whether the facilities at Penn Forest
School field could be made into an outdoor recreation complex for use by
County citizens as well as the school, said complex to include football and
soccer fields and tennis courts. She also suggested that the possibility of
getting a grant to pay for such development be investigated.
Mrs. Johnson advised those present that bill is being introduced by
State Senator Dudley J. Emick which would allow counties to appoint school
board members and she suggested that anyone who could go to the session of
General Assembly at which this bill would be considered, to indicate approval
and agreement. She also asked the County Attorney to provide the Supervisors with
a schedule of when various bills are to be considered by the General Assembly.

Chairman Terry then read aloud a letter from Valley Metro, addressed
to the Chairman of the Board of Supervisors, indicating their interest in and
willingness to provide bus service anywhere in the County if subsidized.
Supervisor Johnson commented that she had heard no figure quoted for the cost of
such subsidy. The County Administrator mentioned that he had received a copy

of the Valley Metro letter and that it stated a study was being made and that
the costs would be available upon request.
Chairman Terry asked Mr. Clark
to contact the City of Roanoke and get cost information.
Supervisor May Johnson read aloud the proclamation dated January 16,
I 1980, naming January 21, 1980 as "Suzy Mink Day."
Copy of the proclamation is filed with the minutes of this meeting.
At this point in the meeting, Supervisor Park asked if either Mr. E. L.
or Mr. O. S. Meeks had arrived. There was no response and Mr. Park then moved
that their application for a "Special Use Permit" be deferred until the next
regular meeting of the Board.
