Special Meeting
Board of County Supervisors
March 5, 1980

This meeting held for the purpose of conducting a public hearing on

whether to request the Circuit Court of Roanoke County to enter an order
setting a referendum on the question of the method of appointing the Roanoke
County School Board.
The meeting was called to order at 7:00 p.m. by Chairman Lawrence Terry,
with all Supervisors, County Attorney and County Administrator present.
Mr. Terry requested the County Attorney explain the purpose of the public
hearing; after which he opened the floor for public comment.
Mr. Torn Farrell, resident of Roanoke County and speaking as an individual,
spoke in favor of the School Trustee Electoral Board and suggested that if
citizens wanted a referendum on the question, they could ask for such by
petition.
Mrs. Julia Reynolds, speaking on behalf of Roanoke County Council of PTA's

spoke in favor of holding a referendum.
Mr. Ron Adkins, citizen of Roanoke County and speaking as an individual,
spoke in favor of holding a referendum.
Mr. Rick Harvey, citizen of Roanoke County, asked if a referendum would
be binding on the Board of Supervisors, and he was advised yes.
The County Attorney was requested to read, in it's entirety, the prepared
resolution for the information of those in attendance at the meeting.
Mr. Richard Evans, a citizen of Roanoke County, and speaking as an
individual, said he favored the method of appointment of the School Board by
the Board of Supervisors and supports the referendum.
Ms. Chelsey Patrick, representing the Oak Grove PTA, spoke in favor of
holding a referendum and also expressed the hope that there would be an open
exchange of information on the pros and cons of appointing the School Board

prior to the referendum.
Mrs. Athena Burton, resident of Roanoke County, recommended that there
be a School Board member for each election district in the County and that
their terms be concurrent with the terms of the Board of Supervisors.
Supervisor Johnson moved that the prepared resolution be adopted.

At 7:45 p.m. on motion of Supervisor Myers and a unanimous voice vote, the
Board went into Executive Session to discuss legal matters.
At 7:50 p.m. on motion of Supervisor Myers and a unanimous voice vote, the
Board reconvened in open session.
Chairman Terry called for roll call vote on the previous motion of

RESOLUTION NO. 2517 REQUESTING THE CIRCUIT COURT OF ROANOKE
COUNTY TO ENTER AN ORDER SETTING A REFERENDUM AS MADE AND
PROVIDED BY SECTION 22-79.4 OF THE CODE OF VIRGINIA OF 1950,
AS AMENDED
WHEREAS, the Board of Supervisors of Roanoke County has heretofore
recognized that many of the residents of Roanoke County have expressed
the desire to have the School Board of Roanoke County appointed by the
Board of Supervisors of Roanoke County; and
WHEREAS, the Board of Supervisors determines that it is desirable
to have a referendum on the question of the method of appointment of the
School Board of Roanoke County as made and provided by Section 22-79.4
of the Code of Virginia of 1950, as amended; and I
WHEREAS, the Board of Supervisors held a public hearing on the
question of the method of the appointment of the School Board of Roanoke
County as made and provided by law on the 5th day of March, 1980, at
7:00 p.m. at the Salem-Roanoke Valley Civic Center.
NOW, THEREFORE BE IT RESOLVED by the Board of Supervisors of Roanoke County
that said Board does respectfully request the Circuit Court of Roanoke County
to make an Order requiring the Judges of election on the day fixed by the Order
to open a poll and take the sense of the qualified voters of the County on the
question of the method of election of the School Board of Roanoke County.
BE IT FURTHER RESOLVED that the Clerk of the Board is hereby directed to
certify a copy of this Resolution and to present it to the Judge of the Circuit
Court for the County of Roanoke.
BE IT FINALLY RESOLVED that the Clerk of this Board is hereby directed to

file a certified copy of this Resolution with the Clerk of the Circuit Court
for the County of Roanoke.
On motion of Supervisor May W. Johnson and adopted by the following
recorded vote.

Supervisor Myers made a motion that the Board withdraw it's previous
request for legislation introduced permitting the Board of Supervisors to
appoint School Board members, and to thank our legislators in the General
Assembly for their assistance in this regard, and said motion was approved by
the following recorded vote.

At 7:53 p.m. on motion of Supervisor Myers and a unanimous voice vote,
the Board went into Executive Session on the request of County Attorney,
James Buchholtz, to discuss legal matters.
At 8:30 p.m. on motion of Supervisor Myers and a unanimous voice vote,
the Board reconvened and immediately adjourned.
