The Board of County Supervisors of Roanoke County, Virginia, met
this day in open session at the Salem-Roanoke County Civic Center in Salem,
I
Virginia, this being the second Tuesday and the first regular meeting of the
month of Harch.
Hembers present: Chairman Lawrence E. Terry, Vice Chairman Edward
C. Park Jr., Supervisors Hay W. Johnson, Paul B. Hatthews, and Robert E. Hyers.
Chairman Terry called the meeting to order at 6:00 p.m. and Supervisor
Johnson immediately made a motion for the Board to go into Executive session
to discuss real estate, personnel, and legal matters; which motion was adopted
by the following recorded vote.

At 7:10 p.m. the Supervisors reconvened and the meeting was called

to order by Chairman Terry.
Chairman Terry recognized Rev. William F. HcHahan, Locust Grove Church,
Salem, Virginia, who offered the invocation and the pledge of allegiance to the
Flag was recited in unison.

Supervisor Park made a motion to approve the minutes of the meeting
of February 26, 1980, whi~h was approved by unanimous voice vote.

Chairman Terry explained to those in attendance that the Board of
Supervisors would recess and convene as the Public Service Authority Board in
order to discuss the proposed increase of the sewer rate.
At 7:55 p.m. the Board of Supervisors reconvened.

Chairman Terry recognized Gordon Chappell, Utilities Comptroller,
who presented a graphic study to show the necessity for the rate increase for
water in the County. He recommended the 25% increase, beginning April 1, 1980
as proposed, in order to continue service and cover the cost of new construction
projects in the area. Mr. Chappell explained that the proposed increase is
equal to 4% per year since there has not been an increase since 1974.

At this point,Chairman Terry asked for comments from the public on
the proposal.
Mrs. Lawrence Mundy asked if new water lines are to be installed in
the Starmount area. Mr. Rossie, Director, Public Service Authority, stated
that it was in last year's budget, and that it will take approximately three
more months to get the project going. Supervisor Park stated that this is one
of the reasons for the proposed rate increase.
An unidentified citizen from the Summerdean area stated that last
year he was on the City of Roanoke water system with good services, and that
they had a surplus of water funds but since being annexed, after only three
months he finds the County asking for a rate increase and he was very much
opposed to such an increase.
Mr. Rossie, at the request of Chairman Terry, gave a brief background
report as to when and where the various water sources were acquired by the
County. He also referred to the inflated cost of materials with which to
construct new projects.
Mrs. Mildred Mitchell from the Sun Valley area, expressed her
opposition to the increase.
Mr. Steve Emick stated that he would like to know specifically what
the increased rate would be used for. He was told by the Board the entire
25% increase would be used for operating expenses.
Mr. Jimmy Holland, S. W. County, stated that his brother, who is a
building contractor, has not had an increase of 25% for his building costs, and
feels that this amount is out of line.
Supervisor Myers moved that the base rate be $2.00 per month and
$1.15 for each additional 1,000 gallons, rather than $1.00 which would amount to
an increase of 15%.
Mr. Rossie stated that the proposal of 15% would affect proposed
projects for water service.

Mr. Jack Wright, Auditor for the Public Service Authority, suggested
that if a 15% rate is enacted that it also be placed on the base rate in order
to secure more revenue.
Supervisor Park suggested that the base rate be $2.25 and $1.15 for
each additional 1,000 gallons.
Supervisor Johnson stated we would need another rate increase if the
15% proposal was adopted, therefore, it would mean another public hearing on the
matter again next year.
Supervisor Matthews moved to amend the advertised ordinance to read
that the base rate for residential customers be $2.25 and $1.15 for each
additional 1,000 gallons, which motion was adopted by the following recorded
vote.

Supervisors Myers, Park, Matthews, Terry and Johnson.

At this point, 8:35 p.m., Chairman Terry called for a short recess.
At 8:45 p.m. the Board reconvened in open session.
Chairman Terry asked if there were any questions regarding the
commercial rate proposal. No one responded.
Gordon Chappell, Utilities Comptroller, explained that the current
base rate for commercial customers is $5.00 and the proposed increase is $6.25
base rate for 3,000 gallons and $1.25 for each additional 1,000 gallons.
Supervisor Park made a motion that the rates remain as proposed; which
was adopted by the following recorded vote.

MISCELLANEOUS CHARGES
Mr. Chappell explained the purpose for each of the following
miscellaneous charges:
(1) Re-check reading of meter--$5.00--This charge is made to the
customer when he requests the County to re-read his meter and it is found to
be in order.
(2) Investigation for 1eakage--$10.00--This amount is charged to the
customer when he requests the County to check for a leak in his water lines and

none is found.
(3) Meter Test--$5.00--This amount is charged when a customer
requests the meter to be checked to see if it registers properly and said
meter is found to be in proper working condition.
(4) Round trip for meter turn-off/turn-on for non-payment--$25.00--
In the event a customer fails to pay his monthly payment for water service, and
the County turns off the meter to his residence, then this charge is made for
the trip to and from the water meter for such action.
(5) Special request to discontinue or turn on service for other
than non-payment--$7.00 per trip--This charge is for customers who might
temporarily turn off water to a residence, such as rental property.
(6) Re-set meter if meter was pulled for non-payment--$20.00--
In the event that a customer, whose water service has been discontinued by the
County, should turn on the meter himself, the County might in that instance pull
the meter to avoid such action by the customer, and it would then charge a
$20.00 fee for re-setting the meter.
(7) Annual charge of $150.00 per hydrant to be assessed by the
County Water Department.
The question was asked by the Board who would pay
this charge and Mr. Chappell responded that owners of privately owned hydrants
would be charged.
Supervisor Park moved that the rates for all miscellaneous charges
be adopted as stated; said motion was adopted by the following recorded vote:

Mr. James Buchholtz, County Attorney, reminded the Board that it would
be necessary to adopt the amended resolution for the base rate of $2.25 and
$1.15 for each additional 1,000 gallons.
ORDINANCE NO. 2518 AMENDING SECTION 27.1 RATES, OF CHAPTER
20.1, WATER OF THE ROANOKE COUNTY CODE AND PROVIDING FOR AN
EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That Chapter 20.1 Water of the Roanoke County Code, as amended,
be and it is hereby amended by amending Section 27.1 Rates to read and

Section 27.1 Rates. The following rates and charges for water
service shall apply where water service is provided by the County: (a)

Chairman Terry asked if anyone was present to support the request,
Mrs. Holdren responded. Mr. Terry then asked if anyone was opposed to the
request, Mr. Newman E. Via Jr., came forward and stated that he represented the

neighbors to the property in question and that they were opposed to the mobile
home being placed. He submitted to the Board letters in opposition and photos
of the area in question. Several people from the audience came forward to join
in the discus3ion and voice their opinion as to the opposition.
After much discussion, Supervisor Myers moved that the request be
denied, which motion was adopted by a unanimous voice vote.

WHEREAS, your Petitioners, the Planning Commission of Roanoke County,
Virginia, by motion, did petition the Board of County Supervisors to rezone
a tract of land located in the Hollins Magisterial District and containing
7.224 acres, more or less, from Industrial District M-2 to Agricultural
District A-I in order to allow the existing residential subdivision to become

a conforming use under Chapter 21 (Zoning) of the Code of Roanoke County; and
WHEREAS, the petition was referred to the Planning Commission by
the County Administrator; and
WHEREAS, after due legal notice, the Planning Commission did hold a
public hearing on said request on February 19, 1980 at which time, all parties
in interest were given an opportunity to be heard; and
WHEREAS, after full consideration of said request, the Planning
Commission did recommend to the Board of County Supervisors that the request
be approved; and
WHEREAS, after due legal notice, the Board of County Supervisors
did hold a public hearing on said request on March 11, 1980, at the Salem-
Roanoke County Civic Center, at which time all parties in interest were given

WHEREAS, after full consideration, the Board of County Supervisors is

line of Owens S. 77deg. 14' E. 312.7 feet to a point
on the line of right-of-way of the west side of the
Virginia Railway corner to Owens; thence with the
line of the right-of-way of the Virginian Railway
approximately according to the following courses
S. 18 deg. 52' W. 800.0 feet; S. 25 deg. 51' W. 59.0
feet to a stake; thence along other lands of James
D. Poff N. 71 deg. 30' W. 190.0 feet to a stake
in the east right-of-way line of the Norfolk and

Linda F. Steele, Esquire, acknowledged her presence as representing attorney
in support of the request. Ms. Steele stated that this request had been
approved previously but the Highway Department requested it be refiled and
posted in three places along the highway in question.

Supervisor Johnson moved that the final order be approved.
PETITION OF TANGLEWOOD MALL, INC. **
FINAL ORDER
WHEREAS, on the 5th day of March, 1980, the Board gave notice of
the intention to abandon Secondary Route 795 (Bernard Drive), from Route
904 to Route 419, a distance of 0.10 miles, pursuant to Section 33.1-151 of
the Code of Virginia of 1950, as amended; and
WHEREAS, the matter was duly considered on the 11th day of March,
1980 and no public hearing was requested the Board has determined that no

public necessity exists for continuance of the said section of Secondary road as
a public road and that the welfare of the public will be served best by
abandoning such section of road.
NOW, THEREFORE, BE IT RESOLVED: That Secondary Route 795 (Bernard
Drive), from Route 904 to Route 419, a distance of 0.10 miles, be and the same

hereby is, abandoned as a public road pursuant to Section 33.1-151 of the Code
of Virginia of 1950, as amended.

REQUEST FROM LEAGUE OF WOMEN VOTERS OF THE *

INFORMATION BOOKLET CONTAINING PERTINENT *
INFORMATION ABOUT GOVERNMENT ELECTED AND *
APPOINTED OFFICIALS. *

Chairman Terry recognized Barbara Creasey, representing the League
I
of Women Voters of the Roanoke Area, who explained that the League plans to
publish a booklet for distribution with financial and other pertinent information
regarding our elected and appointed officials of the Roanoke area. Their
request is for funds of $175.00 from each of the four local governments.
County Administrator, William F. Clark, responding to a question from
the Board stated that the sample booklet appears to contain much the same
information as the annual report published by the County.
After some discussion, Supervisor Johnson moved that the resolution
be adopted on the condition that each of the other three governments give an
equal amount to the League. Supervisor Myers stated his desire to an addendum
to the motion of Supervisor Johnson requiring the County Administrator to
review for accuracy, the information to be published by the League.

REFERRALS TO PLANNING COMMISSION
(1) Petition of Fekas Homes, Inc. requesting rezoning from RE
to M-2 of 1.422 acre on the southwest side of a 30-foot
road (extension of Underhill Avenue, S. E.) about 11 feet
outside the City/County corporate line and near it's
intersection with 16th Street, S. E. in Vinton District.
Rezoning is requested to provide for construction of an
office building and the storage of construction equipment.

(2) Petition of Roy C. Woods requesting rezoning from RE to B-2
of 0.5 acre on the south side of U. S. Route 221, about 300
feet east from it's intersection with Route 707 in the Back
Creek area of Windsor Hills District. Rezoning is requested
so the petitioner may add onto his existing business, Floors
by Roy C. Woods.
(3) Petition of Ralph Patrick, Margaret R. Patrick, Mary Thelma
Patrick, and The Virginia Assembly Church of God requesting
rezoning from R-l to R-3 of 17.5 acres on the west side of
Hawthorne Road, east of the C & P Telephone Company offices
on Airport Road and adjacent to Shenandoah Homes nursing home
in Hollins District. Rezoning is requested so that an adult
care facility may be built and operated.
(4) Petition of Doris J. Payne requesting rezoning from B-1
to B-2 of a tract containing 0.391 acre + or - and located
on the west side of old Cave Spring Road (old Route 221) in
Windsor Hills District. The existing dwelling (at 4555
Old Cave Spring Road) presently houses Payne Painting Company
and, if the rezoning is allowed, will be sold and used
for establishment of an antique shop and rare book store.

(5) Petition of W. W. Sink requesting rezoning from R-l to A-I
of about 18 acres lying on the east and west sides of Enon
Drive and including four lots fronting on Carvin Street in
Walrond Court in Hollins District. Rezoning is requested to
allow use of the property for agricultural purposes; the
petitioner advises it is unsuitable for residential use.

REPORT
County Administrator, William F. Clark, presented to the Board
a report, filed with the minutes of this meeting, regarding the present
procedure for renewal of mobile home permits. The Board of Supervisors had
previously requested a complete report in order to determine if the renewals
could be handled administratively rather than by public hearing. After some
discussion, Supervisor Myers moved that the present procedure be continued.

six-year plan for secondary roads in Roanoke County. Representatives of the
Virginia Department of Highways and Transportation have requested a meeting
to discuss these proposals and the Supervisors agreed on March 19, at 4:00
p.m. in the County Administrator's Conference Room.
Administrator Clark stated that the volunteer fire chiefs desire
a meeting with the Board to discuss the capital improvements bond issue. The
Board agreed on March 27 at 7:30 p.m. at a location to be determined.

INTO THE PAY AND CLASSIFICATION PLAN AND THE
PERSONNEL-MANAGEMENT RELATIONS SYSTEM OF THE
COUNTY OF ROANOKE
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That the employees of the Clerk of the Circuit Court of Roanoke

County, the Clerk having heretofore requested in writing that her employees
be accepted into the pay and classification plan and the personnel-management
relations system of the County of Roanoke, as fully set-forth in Chapter 13 of
the Roanoke County Code, be and such employees hereby are accepted into the
pay and classification plan and the personnel-management relations system of
the County of Roanoke; and
2. That all and singular the terms, provisions and conditions of the
pay and classification plan and the personnel-management relations system of
the County of Roanoke as fully set forth in Chapter 13 of the Roanoke County
Code shall from and after the adoption hereof be applicable to each of the
employees of the aforesaid office; provided, however, that the Clerk and the
two (2) Chief Deputies of said office shall be and remain unclassified

employees; and provided further, that the fees collected by said office shall
be and remain the sole source of funds for the operation of said office absent
specific appropriation by the Board of Supervisors as made and provided by law.

THE COUNTY ADMINISTRATOR TO ENTER INTO A CONTRACT
WITH THE SUCCESSFUL BIDDER
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
1. That that certain bid of Cavalier Equipment Company of Roanoke,

Virginia, in the amount of $13,402.56 for one dump truck, upon all and
singular the terms and conditions of the invitation to bid, the specifi-
cations of the County of Roanoke, Virginia, the bidder's proposal and the
provisions of this resolution be, and the same is hereby ACCEPTED; and
2. That the County Administrator be, and he is hereby authorized
and directed to enter into a contract with Cavalier Equipment Company of
Roanoke, Virginia, for said dump truck; and
3. That all other bids for the purchase of said dump truck are
hereby REJECTED and the County Clerk is directed to so notify such bidders

IN RE:
REPORTS AND INQUIRIES OF THE BOARD MEMBERS
Supervisor Park stated that Tim Gubala, County Planner, has a report
regarding the proposed Crestview Apartments by Robert N. Bradley and Associates,
to be located on Route 24, Vinton, Virginia. He stated his opposition to such
a proposed project for low income housing.
Supervisor Matthews moved that the entire Board should be on record
as being opposed to the project; approved by unanimous voice vote.
Supervisor Myers asked Gene Robertson, County Engineer, to look
at the sight distance situation on Beaumont Road and the Old Hollins Road.
Chairman Terry read aloud a proclamation to the Virginia Employment
Commission regarding the employment of retired or senior citizens; approved by
unanimous voice vote.
IN RE:
HEARING OF CITIZENS ON PUBLIC MATTERS
Mr. T. M. White stated that he attended a meeting of citizens in
regard to the Northside Tennis Courts and would like to report to the Board
that the condition of said Courts is very bad. He stated an immediate need
to have repairs done to the Courts. Mr. Robertson, County Engineer, said
bids for resurfacing these courts are due in by March 25.
Mr. Darrell Branstetter stated a desire to have a road, Highway 888,
paved. He stated that he had been trying since 1957 to have said road paved
but had been unable to get a response from the County. Supervisor Johnson
advised him that the County did not own roads and therefore had no authority
to pave a road but she would contact the proper persons with his complaint.
