The Board of County Supervisors of Roanoke County, Vir ginia, met this
day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia,
this being the fourth Tuesday and the second regular meeting of the month.

Members Present: Chairman Robert E. Myers, Vice-Chairman R. Wayne
Compton, Supervisors C. Lawrence Dodson, May W. Johnson, and E. Deal Tompkins.
Chairman Myers called the meeting to order at 7:08 p.m. and recognized
Reverend William Murdock, Fort Lewis Christian Church, who offered the invocatio .
The Pledge of Allegiance to the flag was given in unison.

On the motion of Supervisor Johnson and the unanimous voice voice of
the Board, the minutes of the regular meeting of April 26, 1977, the special
meeting of May 3, 1977, and the regular meeting of May 10, 1977 were approved as
spread.

FINAL ORDER
WHEREAS, a public hearing was held on April 19, 1977, on the proposed
request after notice thereof was duly published in the "Roanoke Times & World
News", a newspaper published in the County of Roanoke, under date of April 6,
1977 and April 13, 1977, as required by Section 15.1-431 of the said Code of
Virginia, and duly certified by the publisher of said paper; and this Board hav g
duly considered the same, it is accordingly hereby ORDERED that the County
Zoning Ordinance be, and the same is hereby, amended to grant a grant a Special
Exception in order for the petitioner to operate a used car lot on said pro-
perty for the sale of automobiles and small pickup trucks, with a minimum of
repair work be granted for a period of five (5) years.
It is further ordered that the Clerk of this Board forthwith certify
a copy of this Order to the Secretary of The County Planning Commission and to
any other party in interest desiring a copy thereof.
The above resolution was adopted on motion of Supervisor Compton.

proposed, and Public Hearing thereon, have been advertised and posted in accor-
dance with law.

IN RE:
ORDINANCE NO. 1773 AMENDING SECTION 19.8 OF THE ROANOKE COUNTY CODE
TO PROVIDE FOR TAX RELIEF FOR CERTAIN DISABLED PERSONS

WHEREAS, the Board of County Supervisors of Roanoke County deems cer-
tain amendments to the Roanoke County Code to be necessary in the best interest
of the health, safety, and general welfare of the citizens of Raonoke County; aI~
WHEREAS, a Notice of Intention to amend the Roanoke County Code as
proposed, and Public Hearing thereon, have been advertised and posted in accor-
dance with law.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Supervisors of
Roanoke County, that the Roanoke County Code be amended as follows:
Section 19.8. Exempton of real property tax on property of certain elderly or
disabled persons.
(a) Generally. The Commissioner of Revenue shall, upon application
made and within limits as hereinafter provided, order exemption of tax on real
property owned and occupied as the sole dwelling house or a person or persons
not less than 65 years of age or of a person or persons determined to be perma-
nently and totally disabled as hereinafter set out, upon the terms and conditio s
hereinafter set out.

The owner or owners claiming such exemption shall file annually with
the commissioner of revenue an affidavit setting out an identification of the
taxable real estate, the names of the persons occupying such real estate, that
the total combined income of the owners and relatives living in the dwelling on
such property for the preceding calendar year did not exceed ten thousand dolla s,
and that the total combined net worth of such owners and relatives as of the
thirty-first day of December of the immediately preceding calendar year did not
exceed thirty-five thousand dollars. Such affidavit shall be filed not later
than the first day of May of each year. Any false statement made in connection
with the filing of an application under this section shall constitute a misde-
meanor, punishable by fine not exceeding one hundred dollars.

The commissioner of revenue shall make further inquiry of persons
seeking such exemption as may be reasonably necessary in determining the quali-
fications therefor. Such further inquiries shall be answered under oath. No
person or persons receiving public assistance, other than medical assistance of
any form, shall be eligible for the within provided exemption. All information
received by the commissioner of revenue in connection with any application for
such exemption shall be deemed to be confidential and shall not be revealed othe
than in the official administration of this section.

A person shall be determined to be permanently and totally disabled if
he is so certified by the Social Security Administration, or if such person is
not eligible for Social Security, a sworn affidavit by two medical doctors
licensed to practice medicine in the Commonwealth, to the effect that such perso
is permanently and totally disabled and is further found by the commissioner of
revenue to be unable to engage in any substantial gainful activity by reason of
any medically determinable physical or mental impairment or deformith which can
be expected to result in death or can be expected to last for the duration of
such person's life.
For the year 1977, the applications for tax relief for the disabled
shall be received until September 1, 1977 and, if eligible, the relief granted
shall be credited to the second half of the 1977 real estate tax payment.
Subsections (b) and (c) shall remain in full force and effect as pre-
viously adopted.
This amendment to take effect May 24, 1977.

PUBLIC HEARING - 208 STUDY

The notice from the State Water Control Board advising of a public
hearing to be held on Wednesday, June 15, 1977, at 7:30 p.m. in Roanoke City
Council Chambers to receive comments on the 208 Areawide Waste Treatment Manage-
ment Plan was for information of the Supervivors and is filed with the minutes
of this meeting.

FIREWORKS DISPLAY PERMIT - HILLS DEPARTMENT STORE #54
Supervisor Dodson moved that the application of Hills Department Store
#54 (Cave Spring Corners) for a permit to conduct a fireworks display on July 4,
1977, in a field fronting on Garst Mill Road be approved.

IN RE:
GLADE CREEK SEWER INTERCEPTOR
I
Mr. C. Richard Cranwell, Attorney, appeared before the Board on behalf
of Fralin & Waldron, Inc. and requested the Supervisors to recommend to the
Public Service Authority to proceed with construction of the Glade Creek sewer
interceptor. Messrs. Fralin, Waldron and others interested in development of
the Glade Creek area were also present.
After considerable discussion, Supervisor Tompkins moved that the
Public Service Authority be urged to give immediate consideration to proceeding
with construction of the Glade Creek sewer interceptor and that said Authority
report back to the Board by the June 28, 1977 meeting.

CITIZEN REQUESTS FOR FORNER CHIEF OF 115 FIRE STATION IN HOLLINS
A corrnnunication and petition signed by certain citizens in the Hollin
and North Roanoke County area requesting a resolutionand plaque in honor of the
late Eugene Honaker, former Chief of 115 Fire Station in Hollins was before the
Board.
Supervisor Compton moved that the County Attorney be directed to pre-
pare a resolution for the Board's next regular meeting and that a plaque be
placed in the Hollins Fire station honoring the late Mr. Honaker, the cost of
which to be provided by the County.

IN RE:
NOTICE OF INTENTION TO M1END SECTION 17-17 OF THE ROANOKE COUNTY CODE
BE IT RESOLVED by the Board of County Supervisors of Roanoke County
that a public hearing be held on June 28, 1977 at 7:00 p.m. at a regular meeting
pf the said Board at the Salem-Roanoke County Civic Center, at which time it wil
~e moved that the Roanoke County Code be amended as follows:
Section 17-17. Installation of improvements or filing of performance bond re-
quired prior to recording
All physical improvements required by the provlslons of this article
for the subdivision as platted shall have been installed therein and thereon at
the expense of the subdivider prior to the recordation of the final plat; pro-
vided however, that in lieu of the actual installation of the physical improve-
nents, the subdivider shall have submitted and have approved an acceptable form
of agreement and bond with corporate surety, or in lieu of said bond an acceptab e
letter of credit from a lending institution; said bond or letter of credit to be
in an amount equal to the total cost of such improvements and guaranteeing that
the required improvements will be installed within a designated length of time.
The form of agreement, designated length of time, bond and surety or letter of
credit, and choice of guarantee shall be prescribed by the Board of County
Supervisors, as it may require, according to the nature and extent of the improv -
ments to be made.

This amendment to take effect on June 28, 1977.
The Clerk of this Board is directed to publish the proposed amendment
and notice of hearing thereon as required by law, pursuant to Section 15.1-504
of the 1950 Code of Virginia, as amended, once a week for two consecutive weeks
in the Roanoke Times World News, a newspaper having a general circulation in
Roanoke County.
Said proposed amendment and notice of hearing thereon shall be publish d
and posted at the front door of the Roanoke County Courthouse.
A copy of the proposed amendment is on file in the Clerk's Office of
the Circuit Court of Roanoke County and at the County Executive's Office at 302
East Main Street, in Salem, Virginia.
On motion of Supervisor Compton and adopted by the unanimous voice

DEPARTMENTAL ACTIVITIES REPORTS
The departmental activities reports for the month of April, 1977, as
submitted by the County Executive, were for information of the Supervisors and
are filed with the minutes of this meeting.
IN RE:
RESOLUTION NO. 1775 AUTHORIZING THE CONVEYANCE OF A PARCEL OF REAL
ESTATE TO THE COMMONWEALTH OF VIRGINIA
WHEREAS, the Board of County Supervisors is the owner of a parcel pf
land situate near the intersection of Routes 628 and 629 in the northerly portio

of Roanoke County, said land being used as a part of the Roanoke County water
system; and
WHEREAS, the Commonwealth of Virginia, Department of Highways, has
indicated a need to acquire a small portion of said land for use in the widening
and improvement of said routes and has offered to the County the sum of $428.00
as compensation for said land and easements, which consideration is deemed to be
a fair market value of said real estate; and

WHEREAS, the Board desires to authorize the conveyance of said pro-
perty for the consideration hereinabove set out.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby authorizes the conveyance to the Common-
wealth of Virginia, Department of Highways, of a 0.003 acre parcel of land toge ~er
with 0.012 acres in permanent easements and 0.058 acres in temporary constructi(~
easements for the consideration of $428; said land being situate on State Route
628 and 629 in Roanoke County and being a portion of a parcel of land utilized ir
the County water system; the particular parcel being conveyed having no effect
upon the use of the property by the County.
BE IT FURTHER RESOLVED that the County Attorney request the Circuit
Court pursuant to statute to authorize this sale of County property.
BE IF FURTHER RESOLVED that upon approval by the Circuit Court, the
Chairman and the Clerk be, and they are hereby authorized and directed to execu ~
a deed for said property as approved by the County Attorney.

TIRE SLICER
I
On motion of Supervisor Dodson and the unanimous voice vote of the
members, the Board concurred with the recommendation of the County Executive an<
accepted the offer of the Regional Landfill to purchase the County's tire slice,
which has become surplus equipment since the closing of the Dixie Caverns land-
fill, for the sum of $4,165.06.
IN RE:
COUNTY RECREATION LEAGUE YOUTH FOOTBALL PROGRM1

In a report to the Board, the County Executive advised that a meeting
was recently held by the County Recreation staff which included coaches, parent ,
and representatives from Vinton and Raonoke County connected with the youth foo ~
ball program. The County Executive noted that presently, seven-year-old young-
sters are participating in the County's peewee league. He further noted that
although there is not unanimous opinion, there seems to be considerable sentime t
in favor of eliminating weight requirements and forming youth football leagues
based on age only.
Mr. Dwight Bogle, President of the Cave Spring Recreation Foundation,
opposed the age only requirement and requested the Board to abide by its presen
policy. Mr. Tom Johnson, Vinton Recreation Director, spoke in favor of elimina
ting seven-year-olds and eliminating weight restrictions and basing the leagues
strictly on age categories in two-year increments.
After considerable discussion, Supervisor Johnson moved that seven-
year-old boys and girls no longer be eligible to participate in the contact
sports of football and soccer, but that the present policy regarding weight and
age remain the same.

Supervisor Tompkins offered a substitute motion that the Board concur
~n the recommendation of the County Recreation Department that beginning with th
upcoming fall leagues (1) seven-year-old boys and girls no longer be eligible to
participate in the contact sports of football and soccer, and (2) that the leagu ~
be organized on the basis of age only, exclusive of any former weight restrictio ~.

RESOLUTION NO. 1776 RELATING TO THE PAYMENT BY THE COUNTY OF CERTAIN
COSTS FOR COVERAGE UNDER THE VIRGINIA SUPPLEMENTAL RETIREMENT SYSTEM
WHEREAS, County employees are presently covered by the Virginia Supple
mental Retirement System which requires the payment by the County of a contribu-
tion for all employees covered; and
WHEREAS, the County did not pay employer costs for employees covered
for the period from July 1, 1959 through July 1, 1963 and the County Board now
desires to pay said costs provided the employees covered would pay their require
share in accordance with the provisions of law.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board does hereby agree to pay its share of the employe
costs for the participation of any eligible officer or employee of Roanoke
County to be credited with prior service in the Virginia Supplemental Retirement
System for said employees' service with the County for the period commencing
July 1, 1959 through July 1, 1963, provided that such employee pays to the Vir-
ginia Supplemental Retirement System within one year from the date of this
resolution, said employee's contribution which would have been paid if the ser-
vices rendered qualified for coverage and had been included under the Virginia
Supplemental Retirement System during such period.

DEPARTMENT OF FINANCE - REQUEST TO FILL VACANCY
Supervisor Tompkins moved that the Board concur with the recommendatio
of the County Executive and authorize filling of the vacancy in the Department 0
Finance which will result from the resignation of Alfred C. Anderson.

WEST COUNTY BRANCH LIBRARY
Mr. Kinsey and Mr. Frye of Kinsey, Shane, and Associates, appeared
before the Board and made a presentation and submitted the proposed floor plan
for the West County branch library.
After discussion and consideration thereof, Supervisor Tompkins moved
that the architects be authorized to proceed with the final plans for the West
County branch library and advertise for bids.

IN RE:
RESOLUTION NO. 1777 ACCEPTING A GRANT FOR A CAPITAL IMPROVEMENTS
PROGRAM FOR ROANOKE COUNTY
I
WHEREAS, the Board of County Supervisors of Roanoke County has hereto
fore authorized the filing of a grant for capital improvements program through
the Department of Housing and Urban Development; and
WHEREAS, the County has been informed that its grant application has
been approved pending acceptance thereof by the Board; and
WHEREAS, the Board desires to accept said grant and to proceed with
a capital improvements program with the funds provided.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby accepts a grant in the amount of $8,000.0
with a County contribution in the amount of $4,000.00, providing for a capital
improvements program in a total amount of $12,000.00.
BE IT FURTHER RESOLVED that the County Executive negotiate with the
appropriate agencies a contract providing for the terms and conditions under
which said grant will be accepted; said contract to be a three-party contract
with the local Planning District Commission, the appropriate State Agencies, an
the County.
BE IT FURTHER RESOLVED that the Board adopts as the work program to
be completed under said grant theprogram outlined on Exhibit 1 attached hereto
and incorporated herein.
BE IT FINALLY RESOLVED that the County shall use a combination of its
existing staff and the employment of specialized consultants to provide its
one-third in-kind contribution as required by law.

SHERIFF'S DEPARTMENT - CHIEF DEPUTY POSITION
Sheriff O. S. Foster appeared before the Board regarding the recent
death of his Chief Deputy, Major R. L. Chew. He advised that Major Chew had be n

County Attorney was directed to prepare a resolution honoring Major Chew for th

Sheriff Foster stated that he intended to transfer a County officer
nto a deputy sheriff position which will in effect be reducing personnel in his
iepartment by one, thereby saving the County approximately $18,000. He further
~dvised that he will assign each of his four Division Captains to serve in the
ole of his Chief Deputy for portions of each month until at least July 1, 1978,
by which time, he will decide to either continue this procedure or request autho
ity to designate someone as Chief Deputy.

SHERIFF'S DEPARTMENT - REQUEST TO FILL VACANCIES
Sheriff o. S. Foster appeared before the Board and requested authori-
zation to replace a deputy sheriff and dispatcher. Sheriff Foster advised that
the account clerk-keypunch operator had presently withdrawn her resignation.
Supervisor Tompkins moved that the Board concur with the request of
Sheriff Foster and fill the following upcoming vacancies, and further that the
! Sheriff be authorized to fill the accounting clerk-keypunch operator position,
should that position become vacant:
1. Replacement for Deputy Sheriff George W. Fore who will retire
June 30, 1977.
2. Replacement for Communications Dispatcher Ms. Carolyn Bowles
effective May 31, 1977.

IN RE:
RESOLUTION NO. 1786 WAIVING THE REQUIREMENTS OF THE ROANOKE COUNTY
WATER ORDINANCE IN REGARD TO CERTAIN PROPERTIES
WHEREAS, certain property owners have approached the Board of County
Supervisors of Roanoke County and requested that the water ordinance heretofore
adopted by said Board be waived in certain respects in order to provide that
water service to said properties may be provided by means other than Roanoke
County; and
WHEREAS, the Board is of opinion that in these particular instances,
because of the hardships created, that certain provisions of the water ordinance
should be waived.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby waives the requirements of the Roanoke
County Water Ordinance contained in Section 20.1-5 of the Roanoke County Code in
regard to the following described properties only, said waiver being based upon
a demonstration by the property owners that strict compliance with the provision
of the above section of the water ordinance would impose an undue hardship and
burden upon said property owners:

BE IT FURTHER RESOLVED that this Board shall authorize no further

Supervisor Compton moved that the following persons be appointed to a
committee to study ways of conserving energy: William F. Clark, County Executiv ;
George F. Ferrell, Director of Finance; Robert W. Hooper, County Planner; Robert
N. Monroe, Fire and Emergency Services Coordinator; Robert Don Chappell, Directo
of Engineering, PSA; Andrew Clinginpeel, Supervisor of Assessments; Richard H.
Trout, Purchasing Supervisor; Robert A. Franklin, Chief Building Inspector; and
G. Roy Nester, Superintendent of Public Works. Board Chairman Myers appointed
Supervisor R. Wayne Compton to serve as Committee Chairman.

Supervisor Johnson moved that Mrs. Richard Peery be reappointed to
serve as the Cave Spring District representative on the Roanoke County Highway
