The Board of County Supervisors of Roanoke County, Virginia, met this
day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia,
this being the second Tuesday and the first regular meeting of the month.

Members Present: Chairman Robert E. Myers, Vice-Chairman R. Wayne
Compton, Supervisors C. Lawrence Dodson (arrived 7:18 p.m.), May W. Johnson,
and E. Deal Tompkins.
Chairman Myers called the meeting to order at 7:06 p.m. and recognized
Reverend Pattison, Emmanuel Lutheran Church, who offered the invocation. The
Pledge of Allegiance to the flag was given in unison.

On the motion of Supervisor Johnson and the unanimous voice vote of
the members present, the minutes of the regular meeting of May 24, 1977, were

In relation to the above request, Supervisor Dodson advised that the
applicant's son had contacted him by telephone and advised that he would be
unable to attend the hearing. There being no opposition and since this is a
renewal, Supervisor Dodson moved that the renewal application of Frank Hale be
approved effective July 27, 1977, subject to the provisions of the County Zonin(
Ordinance as it pertains to mobile homes.

PUBLIC HEARING ON PROPOSED BUDGET FOR THE COUNTY OF ROANOKE FOR FISCAL
YEAR COMMENCING JULY 1, 1977
A public hearing was this date held on the proposed budget for the
County of Roanoke for the fiscal year commencing July 1, 1977.
Chairman Myers opened the floor for public comments.
Mr. Bob Johnson, local representative of the Virginia Education Assoc-
iation, appeared before the Board regarding the restoration of the elementary
art and elementary and intermediate gifted programs which have been cut by the
County School Board, thereby eliminating seven teacher positions. Mr. Johnson
requested the Supervisors to earmark the anticipated excess monies toward the
programs. Chairman Myers advised that this excess money goes into the County1s
Contingency Fund for the upcoming fiscal year and without it, the County would
have no such fund. Certain of the teachers whose positions had been eliminated
were present at the hearing.
There being no further comments, the public hearing was closed and
Supervisor Compton moved that the Board adopt the budget for the County of
Roanoke for fiscal year commencing July 1, 1977 at its June 28, 1977 meeting.

CONDITIONAL USE PERMIT
Mr. Tom Key, Attorney, appeared before the Board on behalf of Mrs. R.
E. Richards, regarding Mrs. Richards request for a conditional use permit to
continue to operate a landfill on private property in the Back Creek area. Mr.
Key submitted pictures showing the area presently being filled.
Supervisor Tompkins moved that a public hearing be scheduled on the
request for the July 12, 1977 meeting of the Board providing the petitioner
submits all the necessary papers.

SALEM HISTORICAL SOCIETY
On motion of Supervisor Tompkins and the unanimous voice vote of the
members, the Board received and filed with gratitude the notification from the
Salem Historical Society that the County Courthouse has been selected as one of
a small number deserving citation as an outstanding landmark of this area and
concurred in the Courthouse being so designated.

the petitioners submit all the necessary papers.

IN RE:
RESOLUTION NO. 1787 ACCEPTING A GRANT FOR MENTAL HEALTH SERVICES AND
AUTHORIZING A CONTRACT THEREFOR
I
WHEREAS, the Board has heretofore authorized the employment of a
Supervisor of Special Populations within the County Department of Parks and
Recreation through the use of CETA funds; and
WHEREAS, a grant application has been made for the continuation of
said position and the County has received an offer of a grant in the amount of
$8,914.00 to be matched by a like amount from the County from in-kind services
presently included within the budget of the Department of Parks and Recreation;
and
WHEREAS, the Board desires to accept said grant offered and to autho-
rize the execution of a contract therefor.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby accepts a grant in the amount of $8,914.0
from the State Department of Mental Health/Mental Retardation; said grant to be
utilized for the employment of an individual within the Department of Parks and
Recreation to serve as a Supervisor of Special Populations; the County to pro-
vide from in-kind services a like amount of funds.
BE IT FURTHER RESOLVED that the County Executive be and he is hereby
authorized and directed to execute the contract accepting said grant.

CABLE TELEVISION
The report of the County Executive regarding the pending change in
Roanoke Val ley Cablevision was for information of the Supervisors and is filed
with the minutes of this meeting.

REFERRALS TO PLANNING COMMISSION
In a report to the Board, the County Executive advised that the fol low
ing petitions were referred to the County Planning Commission since the previous
Supervisors' meeting:
Petition of Gene D. Whitlow and Anne B. Whitlow for rezoning from B-2
to B-3 of a 1.549-acre tract located on the west side of U.S. Route
11-220 (Williamson Road), north of Abney Road and near the North-ll
Lanes so that the property may be used for selling repossessed auto-
mobiles and the issuance of a special exception.
Petition of Roger W. Smith and Carole P. Smith for rezoning from R-l
to B-2 of a 2.13-acre tract located on the northwest side of U.S.
Route 221 at its intersection with Pleasant Hill Drive so that the
existing building may be converted into office space for use by the
Steer House Restaurant.
Petition of Jerry W. Firebaugh and Sydney M. Berry, Jr. for rezoning
from R-l to B-1 of a 0.93-acre tract presently owned by Elbert W.
Carroll, Jr. and Frances D. Carroll and located on the south side of
Burlington Drive and east off old Peters Creek Road so that the peti-
tioners may use it for tfte operation of a firm of certified public
accountants.
Petition of Aylett B. Coleman and Fred P. Bullington for rezoning froIT
A-l to B-2 of a tract containing 42,726 square feet and located on the
north side of Route 419, approximately 250 feet east of Bernard Drive.
Park of this tract is already zoned B-2 and the petitioners wish to
have all of it classified as B-2 so it may be used for studios and
offices by a local radio station.

IN RE:
ORDINANCE NO. 1789 AMENDING THE ROANOKE COUNTY CODE BY THE ADDITION
OF A NEW CHAPTER 16.1 ENTITLED SOLICITATIONS
WHEREAS, the Board of County Supervisors of Roanoke County deems cer-
tain amendments to the Roanoke County Code to be necessary in the best interests
of the health, safety and general welfare of the citizens of Roanoke County.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Supervisors of
Roanoke County that the Roanoke County Code be amended as follows:
CHAPTER 16. I
SOLICITATIONS
Article I - Non-profit organization permits.
Section 16. I-I. Solicitations permit required; exception.
(a) It shall be unlawful for any person, organization or society re-
presenting a charitable non-profit organization or for any agent, member or re-
presentative thereof to solicit or offer to sell anything in Roanoke County by
use of any means unless a permit has been issued as provided in this chapter.
Solicitations and sales as included herein, shall only be deemed to include
solicitations and sales as included herein, shall only be deemed to include
sol icitations or sales on the streets, in any public or private place, by mail,
or by telephone. The provisions of this chapter shall not apply where the soli-
citation of any organization hereinabove described shall be conducted only among
the members thereof by other members thereof or officers thereof, voluntarily
and without remuneration for such sol icitation, or where such solicitation may
be in the form of collection or contributions as the regular exercises or ser-
vices of any church, religious society, lodge, benevolent order or fraternity or
similar organization, or of any branch thereof. Membership drives of any organi
zation, either among active or prospective members, shall not be considered to
be solicitations under the provisions of this chapter.
(b) A written application for a permit to solicit, or sell or to caus
a solicitation or sale to be made, for any cause as provided in the preceding
section shall be filed with the County Executive by the person, organization, or
society for whose benefit such solicitation is to be made. Such application
shall contain the fol lowing information:
(1) The name of the organization or person applying for a permit to
solicit and his address or its headquarters.
(2) The names and addresses of the principal officer or manager if
applicant is other than individual.
(3) The purpose for which any receipts derived from such solicitation
are to be used.
(4) The name of the person by whom the receipts of such solicitation
shall be received and disbursed.
(5) The name and address of the person who will be in direct charge
of conducting such sale or solicitation.
(6) An outline of the method to be used in conducting the sale or
solicitation.
(7) The time when such solicitation shall be made, giving the propOSE
dates for the beginning and ending of such solicitation, which time
period shall not exceed 60 days.
(8) A full statement of the character and extent of the charitable,
educational or philanthropic work being done by the applicant organi-
zation within the County.
(9) Such other information as may be required by the County ExecutiVE
in order for him to fully determine the kind, character and worthinesc
of the proposed solicitation and for the security of the County and
its inhabitants.
(c) Upon receipt of an application for non-profit organizations as
provided in the preceding section, the County Executive shall make or cause to
be made within a reasonable period of time such investigation as shall by him
be deemed necessary in regard thereto to determine that such proposed sale or
solicitation is in fact conducted for non-profit purposes.

(d) Upon approval of the application, the County Executive shall
issue a permit to an applicant to solicit, or to lawfully cause a solicitation
to be made, for any cause as provided in this section. No such permit shall in
any case be construed or be ~deemed to be an endorsement by the County or the
County Executive of any such solicitation or of the purpose for which the same
is made. In all cases where the County Executive declines to issue a permit,
the applicant shall upon request be granted a hearing by the Board.
Any permit approved and issued under this chapter shall be non-trans-
ferrable; proved, however, that this shall not prevent any permittee from using
any number of solicitors as required to conduct such.
Section 16.1-2. Revocation.
If, upon receipt of written information or upon his own investigation,
the County Executive shall find that any agent or representative of the holder
of a permit issued under Section 16.1-1 above is misrepresenting or making
untrue statements in the application, or that in any other way the solicitation,
or sale, has been conducted or is being conducted in a manner endangering the
health, 1 ife and property of the citizens of the County, and, not in conformity
with the intent and purpose of this chapter, or representing in any way that any
permit granted hereunder is an endorsement of such solicitation, then it shall
be his duty to revoke said permit; provided, however, that before any permit is
revoked, the County Executive shall given the permittee a minimum of twenty-four
hours' notice in writing that a hearing is to be had before the County Executive
and that at said hearing the County Executive shall ascertain the facts, and if
any reasons above set forth for revoking the permit are found to exist, the
permit shall be revoked by the County Executive.
Article I I - Solicitors.
Section 16.1-3. Sol icitation - Penalty.
It shall be unlawful for any person to engage in solicitation, as her
inafter defind, in the County in violation of any of the provisions of this
chapter. Any person found guilty of any such violation shall be punished for
each offense as provided in Section 16.1-10.
Section 16.1-4. Same--Fai lure to leave upon request.
No person shall engage in solicitation upon any premises or in any
dwelling house, apartment or other residence located thereon after having been
asked by the owner or occupant thereof to leave such premises or residence.
Section 16.1-5. Same--Posted premises and residences.
It shall be unlawful for any person to engage in solicitation upon an
premises or residence located thereon if such premises or residence is posted
against solicitation by means of a notice prominently displayed, upon which is
printed the legend:

Section 16.1-6. Same--Fraudulent and deceptive practices.
(a) No person who engages in solicitation shall use any plan, scheme
or ruse or make any statement which indicates or implies that the purpose of
such person's visit is other than to obtain orders for or to make sales of good
or services or obtain contributions.
(b) No person who engages in solicitation shall misrepresent the
right of a buyer of goods or services to rescind, or cancel a sale under the
provisions of law.
(c) It shall be unlawful for any person to knowingly make or perpe-
trate, or assist or aid in making or perpetrating, in any manner whatsoever,
any misstatement, deception or fraud in connection with any solicitation or
property or financial assistance for any purpose in the County.
Section 16.1-7. Same--Time limit.
It shall be unlawful for any person to engage in solicitation at any
time prior to 9:00 o'clock a.m. or after 10:00 o'clock p.m., local time.
Section 16.1-8. Same--Identification.
A solicitor shall disclose to the prospect at the outset his name
and the company and product or charitable organization he represents. He shall
not misrepresent the reason for his call nor say that he is calling in a non-
selling or nonsoliciting capacity. He shall carry and show upon request compan

or organization identification setting forth his name and the company or organi-
zation name and address.
Article III - General.
Section 16.1-9. Same--Definition.
For the purpose of this chapter, the term "solicitation" shall mean
and include anyone or more of the following activities:
(a) Seeking to obtain orders for the purchase of goods, wares, mer-
chandise, foodstuffs, services of any kind, character or description;
(b) Seeking to obtain prospective customers for application or pur-
chase of insurance of any type, kind or character; or
(c) Seeking to obtain subscriptions to books, magazines, periodicals,
newspapers and every other type of kind of publication; or
(d) Seeking to obtain contributions for charitable nonprofit organi-
zat ions.
Section 16.1-10. Penalty.
Any person, and in case of an organization or society, the agent or
representative thereof, violating any provision of this chapter, shall, upon
conviction, be punished by a fine not exceeding Fifty Dollars ($50.00) or by
imprisonment not exceeding thirty days (30), or both such fine and imprisonment.
Each day's continuance of any violation of this chapter shal I constitute a
separate offense.

Supervisor Tompkins moved that the Board of County Supervisor meet
with the five applicants for the Cave Spring Magisterial District representative
on the Roanoke County School Board at 5:30 p.m. on June 28, 1977 at the Salem-
Roanoke County Civic Center. The motion was adopted by the unanimous voice vote
of the members.
Supervisor Johnson advised that she would not attend the session, sine

COMMONWEALTH'S ATTORNEY'S SALARY

Supervisor Compton moved adoption of the prepared resolution rescindin
a previous resolution of the Board relating to the salary of the Commonwealth's
Attorney. Mr. John N. Lampros, Commonwealth's Attorney, appeared before the
Board regarding the proposed resolution. He stated that he understood the
Board'sposition on limiting salary increases in the coming year due to the
County1s financial condition, but opposed rescinding the prior resolution re-
lated to his salary.
After considerable discussion, Supervisor Compton withdrew his motion
and the Board took no action on the matter.
IN RE:
RESOLUTION NO. 1809 REMOVING THE POSITION OF COUNTY SHERIFF AND COUNT~
ATTORNEY FROM THE CLASSIFICATION AND PAY PLAN
WHEREAS, the Board of County Supervisors of Roanoke County has hereto
fore established a classification and pay plan for all employees of the County
including the County Sheriff and the County Attorney; and
WHEREAS, the Board is of opinion that the County Sheriff and the Count
Attorney should be removed from the pay plan inasmuch as said offices are direct y
responsible to the Board of County Supervisors and to the voters of the County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that the positions of County Sheriff and County Attorney be and
they are hereby removed and deleted from the classification and pay plan pre-

WHEREAS, the Board of County Supervisors is required to meet no less
than one time each month in regular session; and
WHEREAS, the Board of County Supervisors desires to cancel their regu-
lar meeting scheduled for July 26, 1977.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that the regularly scheduled meeting of said Board set for July
26, 1977, be, and it is hereby canceled.
BE IT FURTHER RESOLVED that any business set for the aforesaid meeting
be continued until the next regularly scheduled meeting of the Board of County

BE IT FINALLY RESOLVED that the Clerk of the Board be, and he hereby

RESOLUTION NO. 1812 HONORING THE SERVICE OF MAJOR ROBERT L. CHEW
WHEREAS, Major Robert L. Chew, who passed away on May 20, 1977, devote
many years to the betterment of law enforcement in the Roanoke County Area; whic
years included 32 years and 3 months as a State Trooper for the Commonwealth of
Virginia and four years and five months as a Deputy Sheriff for Roanoke County;
and
WHEREAS, the Board of County Supervisors of Roanoke County desires to
recognize the long devoted and meritorious service rendered by Major Chew in his
capacity as a law enforcement officer; and
WHEREAS, the exemplary manner in which Major Chew carried out his duti s
served as an example for other law enforcement officers in the County and throus -
out the Commonwealth.

Roanoke County that said Board hereby recognizes the long and dedicated service
of Major Robert L. Chew; Major Chew having served as a law enforcement officer

cated and professional manner in an attempt to enforce the laws of the Common-
wealth of Virginia and the County of Roanoke to the best of his ability.

IN RE: RESOLUTION NO. 1813 HONORING EUGENE "GENE" HONAKER
WHEREAS, the Citizens of the Hollins and North County Areas have
expressed a desire to the Board for the Board to honor the memory of Eugene
"Genell Honaker who passed away on January 18, 1977; and
WHEREAS, the Board desires to recognize the services of Mr. Honaker
who devoted 25 years of service to the County in a manner which went beyond tha
called for in his capacity; and
WHEREAS, Mr. Honaker was one of the most valuable servants ever to
serve the County performing duties in both an official and unofficial capacity
benefiting the Citizens of the Hollins and North County Areas.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby honors and commends the service of Eugene
"Gene" Honaker, former Chief of the Hollins Fire Station in Roanoke County, for
his 25 years of exemplary and meritorious service benefiting the Citizens in
Roanoke County.

Supervisor Compton moved that Mr. L. S. Waldrop be reappointed to serv

TAP BOARD OF DIRECTORS - APPOINTMENTS
Supervisor Johnson moved that Mr. E. Cabell Brand and Mrs. Elizabeth
W. Stokes be reappointed to serve as County representatives on the TAP Board of

June 14, 1980. The motion was adopted by the unanimous voice vote of the Board.
IN RE: MEADEWOOD DRIVE
Mr. Jerry C. Hayes, 6530 Bryant Circle, NW, appeared before the Board
and submitted a petition containing 50 signatures from residents of Garman Drive
Bryant Circle, and Domaco Drive opposing the connection of Meadewood Drive in
the Meadewood Subdivision to Bryant Circle which leads into Garman Drive, which
petition is filed with the minutes of this meeting.
