The Board of County Supervisors of Roanoke County, Virginia, met this
day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia,
this being the fourth Tuesday and the second regular meeting of the month.

Members Present: Chairman Robert E. Myers, Vice-Chairman R. Wayne
Compton, Supervisors C. Lawrence Dodson, May W. Johnson, and E. Deal Tompkins.
Chairman Myers called the meeting to order at 7:10 p.m. and recognized
Reverend C. Lawrence Dodson, Windsor Hills Baptist Church, who offered the
invocation. The Pledge of Allegiance to the flag was given in unison.

APPROVAL OF MINUTES
On the motion of Supervisor Johnson and the unanimous voice vote of
the members, the minutes of the regular meeting of June 14, 1977 were approved
as spread.
IN RE:
APPLICATION OF KINNIE LEE AUSTIN FOR A SPECIAL EXCEPTION TO PARK A
MOBILE HOME ON A 2-ACRE TRACT OWNED BY KINNIE C. AUSTIN AND LOCATED
AT THE END OF STATE ROUTE 678, 0.35 MILE WEST OF STATE ROUTE 804 IN
THE CLEARBROOK SECTION

Supervisor Johnson moved that the appl ication of Kinnie Lee Austin be
approved subject to the provisions of the County Zoning Ordinance as it pertains
to mobile homes.

IN RE:
SUBDIVISION BOND SURETIES

A pub] ic hearing was this date held on a proposed ordinance amending
Section ]7-]7 of the Roanoke County Code regarding subdivision bond sureties.
County Attorney Edward A. Natt briefly explained the ordinance.
At this point, Chairman Myers opened the floor for pub] ic comments.
Mr. Wilbur Tester, spokesman for Roanoke Va] ley Home Bui ]ders Association,
offered an amendment whereby a letter of escrow would be held until a subdivi-
sion is completed by the developer.
Supervisor Tompkins moved that the public hearing be continued to the
Ju]y ]2, ]977 Board meeting in order that the County Attorney may investigate th
va] idity of such a letter.

IN RE:
VIRGINIA WESTERN COMMUNITY COLLEGE - REQUEST FOR FUNDS

Supervisor Tompkins moved that the Board of County Supervisors appro-
priate the sum of $27,548 in the fiscal year of ]977-78 for site development and
architectural-engineering fees related to the new occupational-technical bui ]din
at Virginia Western Community College. This is an addition to the norma] appro-
priation of $]0,000 already approved by said Board. This additional money wi]]
be made available to the College when either (a) the education portion of the
State Bond Referendum is approved by the voters in the November b977 genera]
election, or (b) the General Assemb]y in the ]978 session appropriates the State
funds for the occupational-technical building. In the event that the education
portion of the State Bond Referendum should fail, and the Genera] Assembly fails
to appropriate State funds for this building in the ]978 session, the $27,548
wi]] remain in the Genera] Fund of Roanoke County.

On motion of Supervisor Tompkins and the unanimous voice vote of the
Board, the communication from Roanoke Va] ley Cab]evision, Inc. submitting Quar-
ter]y Progress Report covering construction of the Roanoke Valley Cablevision
System was this date received and fi led.

IN RE:
JAIL FACILITIES
Supervisor Compton read the following statement regarding the jail
situation:
STATEMENT
The Board is presently caught in a very complex situation concerning
the jai]. The voters of the County have twice defeated proposals presented to
them by the Board. The two proposals were varied in their ideas. The Courts
have now requested the Board to indicate what it intends to do in regard to a
jai] prior to July ]5.

It appears that there will be two jails in the Roanoke Val ley, one in
Roanoke and one in Salem. The choice has been made by the Board to locate the
jail in Salem. The Board spent many long hours studying the proposals presented
and the Board placed before the voters what it thought to be the best alternativ
The voters defeated this proposal. The Board feels it has done all it can to
present the question to the voters.
If at this time the Court feels compelled to proceed with ordering the
construction of a jai 1, the Board would follow the Courtls directive and would
have to make the necessary decisions in conjunction with this. While the Board
does not like to be placed under directives by the Court, we can certainly under
stand the position of the Courts and would respect such an order.
Supervisor Compton moved that the Board adopt the foregoing statement.
Supervisor Tompkins stated that as elected officials, it is the responsibility 0
the Board to make the decision on location of the jail, not the Court. Mr. Tomp ins
further stated that in all fairness to County citizens, the Supervisors need to
reconsider Roanoke City's current offer for use of their jail facilities. Super
visor Dodson stated that County services should not be fragmented, which is what
will happen if the County accepted the City's proposal. Sheriff O. S. Foster
appeared before the Board and stated that any savings which may occur by the
County accepting the Cityls proposal would be offset by transportation costs.
Supervisor Johnson stated that she is going to visit regional jails in Richmond
and Charlottesville to check their transportation expenses. Mr. Leonard Pick
stated that it is not necessary to have two jail facilities.
This concluded the discussion, and Supervisor Compton's motion was
adopted by the following recorded vote:

IN RE:
HOME FOR ADULTS - REQUEST OF MRS. ANNE F. STANLEY
Mrs. Anne F. Stanley appeared before the Board requesting compensatior
for care of two elderly out patients in private home.
After full discussion and consideration thereof, the Board took no
action, thereby denying the request since such a request would set a precedent.
A letter from Mrs. Stanley along with a report from the County Department of
Welfare are fi led with the minutes of this meeting.

DEPARTMENTAL ACTIVITIES REPORTS
The departmental activities reports for the month of May, 1977 were fc
information of the Supervisors and are fi led with the minutes of this meeting.
The County Executive requested permission to discuss two items concerr
ing the Public Service Authority and a request from the School Board for appro-
priation for a Youth Conservation Corp project. The Supervisors concurred with
the request.

WATER BUDGET
The County Executive advised that the Public Service Authority concurr d
in the County's water budget for fiscal year 1977-78.
IN RE:
GLADE CREEK INTERCEPTOR
The County Executive submitted, on behalf of the Public Service Autho
rity, a status report prepared by the Authority staff on the Glade Creek inter-
ceptor. He noted that as soon as certain pertinent information is finalized,
a more factual report will be submitted to the Supervisors. Mr. C. Richard
Cranwell, Attorney representing Fralin & Waldron, Inc., was also present at the
meeting.

IN RE:
ORDINANCE NO. 1816 AMENDING SECTION 8.1-4 OF THE ROANOKE COUNTY CODE
WHEREAS, the Board of County Supervisors of Roanoke County has hereto-
fore adopted a soil erosion and sediment control ordinance for Roanoke County; a d
WHEREAS, certain amendments to said ordinance must be made in order to
comply with the provisions of the Code of Virginia, as amended, by the 1977 Gene al
Assembly; and
WHEREAS, the Board of County Supervisors of Roanoke County deems it
necessary to adopt an emergency ordinance in order for said amendment to be
effective on July 1, 1977, and hereby declares an emergency to exist in order
that said amendment may take effect on July 1, 1977.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Supervisors of
Roanoke County that the following amendment to the Roanoke County Code be, and
it is hereby adopted:
Section 8.1-4 (a) (2)

Individual service connections; construction, installation, or maintenance of
electric and telephone utility lines; installation, maintenance or repair of an~
underground public utility lines when such activity occurs on an existing hard-
surfaced road, street or sidewalk provided such land disturbing activity is con
fined to the area of the road, street, or sidewalk which is hard-surfaced.
This amendment to take effect July 1, 1977.
BE IT FURTHER ORDAINED that pursuant to Section 15.1-504 of the Code
of Virginia, as amended, the Clerk of the Board is hereby directed to publish
this ordinance in the Roanoke Times-World News, a newspaper having general circL
lation in Roanoke County, once a week for two consecutive weeks and that it be
posted at the front door of the Roanoke County Courthouse.
BE IT FINALLY ORDAINED that this ordinance shall be in full force and
effect upon its passage.

NOTICE OF INTENTION TO AMEND SECTION 8.1-4 OF THE ROANOKE COUNTY CODE
BE IT RESOLVED by the Board of County Supervisors of Roanoke County
that a public hearing be held on August 9, 1977 at 7:00 p.m. at a regular meetir j
of the said Board at the Salem Roanoke County Civic Center, at which time it
will be moved that the Roanoke County Code be amended as follows:
Section 8.1-4 (a) (2)

RESOLUTION NO. 1817 APPROVING THE ESTABLISHMENT OF AN EMPLOYEES'
DEDUCTION FUND
WHEREAS, the County has had three trust funds for employee deductions
for internal purposes only; and
WHEREAS, the Director of Finance, in report to the Board dated June 28
1977, has recommended that effective June 30, 1977, the three funds be closed ou
and a new fund entitled Employees' Deduction Fund (81000) be established, the ne
fund will handle the contribution for FICA, VSRS Retirement, and Group Life
Insurance.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby approves the closing out of the following
funds: FICA Contribution Fund; VSRS Retirement Contribution Fund: Group Life
Insurance Contribution Fund, and the establishment of Employees' Deduction Fund
(81000) to handle the contribution of FICA, VSRS Retirement, and Group Life
Insurance, the County Executive to complete the necessary papers therefor.

RESOLUTION NO. 1818 ACCEPTING A BID FOR PORTABLE TRANSCEIVERS FOR USE
BY THE SHERIFF1S DEPARTMENT
WHEREAS, bids were opened at 10:00 p.m., March 10, 1977, on are-bid
of our request for twelve portable Radio Transceivers and accessories for use by
the Sheriff's Department; and
WHEREAS, funds were authorized under LEAA Grant 75-A 3565 with matchin
funds under line item 6-0306A-415; and
WHEREAS, the Purchasing Supervisor and the Finance Director, in report
to the Board dated June 28, 1977, have recommended that the bid be awarded to
Harris R. F. Communications, for 12 portable transceivers, 13 vehicle-mounted

battery chargers, 4 single-unit desk chargers, and 1 six-unit desk charger, in
the amount of $11,187.00; it is also recommended that approval be granted to
order 2 additional vehicular repeaters at a total cost of $1,768.80 from Harris

NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby awards the bid for portable transceivers
and accessories for use by the Sheriff's Department to Harris R. F. Communicatio s,

RESOLUTION NO. 1819 APPROVING THE PUBLISHING OF SUPPLEMENT No.5 TO
THE ROANOKE COUNTY CODE
WHEREAS, the County of Roanoke has been contracting with Michie Corpor
ation of Charlottesville, Virginia to publish supplements to the County Code,
the cost this year to be $1,325.00 for the publishing of Supplement No.5; and
WHEREAS, the Purchasing Supervisor and the Finance Director, in report
to the Board dated June 28, 1977, have recommended that a single source purchase
of $1,325.00 for publishing Supplement No.5 to the Roanoke County Code by the
Michie Company of Charlottesville, Virginia, be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby approves the single source purchase of
$1,325.00 for publishing Supplement No.5 to the Roanoke County Code by the

RESOLUTION NO. 1820 AUTHORIZING AN EMERGENCY PURCHASE OF A PACKER
CYLINDER FOR THE SANITATION DEPARTMENT
WHEREAS, one of the sanitation trucks suffered a broken packer cylinde ;
and
WHEREAS, the Purchasing Supervisor was authorized by the County Execu-
tive to issue an Emergency Purchase Order for $2,200.00 to obtain are-condition d
cylinder to Cavalier Equipment Corporation of Roanoke.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby approves the issuing of an Emergency Pur-
chase Order for $2,200.00 to obtain a re-conditioned packer cylinder for use by
the sanitation department to Cavalier Equipment Corporation of Roanoke.

IN RE:
RESOLUTION NO. 182] APPROVING AN ADVANCEMENT OF FUNDS TO THE PUBLIC
SERVICE AUTHORITY

WHEREAS, on June ]7, 1976, the Board of County Supervisors of Roanoke
County entered into an agreement with the Pub] ic Service Authority for the
operation and maintenance of the County's Water System; and
WHEREAS, Section 2 of the agreement provides for an advancement of
funds to the Authority as determined by the Authority's Auditor and the Director
of Finance for the County; and
WHEREAS, the Finance Director, in report to the Board dated June 28,
]977, has recommended that a $20,000 advance be given to the Pub] ic Service
Authority for the sole purchase of handling Water Operation expenditures through
out the year, the advance being a loan which must be repair when the Sewer Divi-
sion is merged into the County's operations, said advance to be made during the
first week of Ju]y, 1977 and to be reflected in the 1977-78 Budget.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby approves the advancement of $20,000 in
funds to the Publ ic Service Authority for the purchase of handling Water Operati n
expenditures throughout the year, the advance being a loan which must be repaid
when the Sewer Division is merged into the County's operations, said advance to
be made during the first week of July, 1977 and reflected in the 1977-78 Budget,
the County Executive is hereby authorized and directed to complete the necessary
papers for said transaction.

CLERK OF CIRCUIT COURT - REQUEST FOR RECORDING AND TRANSCRIBING
EQUIPMENT
Supervisor Johnson moved that the Board concur with the request of the
Clerk of Circuit Court and approve the purchase of a Dictaphone Transcriber Mode
#1043 at a cost of $2,928.10 from the Dictaphone Corporation of Roanoke as a
single source purchase.

IN RE:
ROANOKE COUNTY SCHOOL BOARD - ELEMENTARY ART AND GIFTED PROGRAMS
Mr. Arnold R. Burton, Superintendent, Roanoke County Schools, appeared
before the Board and read a letter addressed to the Supervisors responding to th
Supervisors' request that the School Board reconsider reinstating the elementary
art and gifted programs. The letter stated that the School Board is willing to
restore the programs with anticipated revenue with the provision that the Super-
visors cover any deficit which may arise. A full copy of the communication is
filed with the minutes of this meeting.
After full discussion and consideration thereof, the matter was con-
tinued to the July 12, 1977 Board meeting.

ROSECREST ROAD
I
Supervisor Johnson moved that the request of residents of Rosecrest
Road for permission to have the State to install curbing and guttering at their
expense be referred to staff to make the necessary arrangements and work out the
details with the residents of Rosecrest.

time to time as monies become available sums equal to, but not in excess of, the
appropriation made from the General Operating Fund for the period covered by the

IN RE:
SCHOOL BOARD APPLICANTS - CAVE SPRING DISTRICT REPRESENTATIVE
Preceding the regular meeting of the Board of County Supervisors sche-
duled for this date, the Supervisors held an informal public session to consider
applications for the position of the Cave Spring Magisterial District representa
tive on the Roanoke County School Board. Chairman Robert E. Myers, Vice-Chairma
R. Wayne Compton and Supervisors C. Lawrence Dodson and E. Deal Tompkins were
present during the session and aprticipated in the interviews. Supervisor May
W. Johnson was absent since she is an employee of the County School Board and by
law must abstain from voting on appointments to the School Board.
Chairman Myers presided over the informal public session, which began
at approximately 5:30 p.m., and conducted the interviews. Four of the five
applicants who had previously submitted re'sume1s, Mr. Robert G. Scogin, Mrs. Susa
B. Trotter, Mr. Arthur M. Whittaker, and Mr. Thomas S. Worrell were present.
Mrs. Jean A. Glontz was absent, but had written that she would be unable to atte d.
A question and answer session among the Supervisors and the applicants was then
held. No decision on the appointment was made at this session. Several citizen
and representatives of the news media were present.
During the seven o'clock regular session of the Board of County Super-
visors when consideration of the appointment of the Cave Spring Magisterial
District representative on the County School Board occurred, Chairman Myers
reiterated that the above-mentioned session was held and commended the four
applicants who were present at said session for their response to questions
asked by the Supervisors. He stated that all five applicants were qualified
candidates for the psotion and that the decision on the appointment would be ,a
difficult one.
At this point, Supervisor Johnson requested to be excused from any
discussion regarding the appointment, and left the room.
Supervisor Compton moved that Mrs. Jean A. Glontz be appointed as the
Cave Spring District representative on the Roanoke County School Board.
The motion was defeated by the following recorded vote:
AYES: Mr. Compton, Mr. Myers

Due to the foregoing tie votes, consideration of the appointment of tl ~
Cave Spring District representative on the Roanoke County School Board was con-
tinued to the July 12, 1977 meeting of the Board. The incumbent, Mr. Worrell,
will continue to serve on the School Board until such time as an appointment/
reapppointment is made by the Supervisors.

APPOINTMENT - PUBLIC SERVICE AUTHORITY

Supervisor Compton moved that Mr. E. Glenn Bowman be reappointed to
serve as a member of the Roanoke County Public Service Authority for a one-year
term covering the period June 30, 1977 through June 30, 1978.
