The Board of County Supervisors of Roanoke County, Virginia, met this
day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia,
this being the second Tuesday and the first regular meeting of the month.

Members Present: Chairman Robert E. Myers, Vice-Chairman R. Wayne
Compton, Supervisors C. Lawrence Dodson, May W. Johnson, and E. Deal Tompkins.
Chairman Myers called the meeting to order at 7:0S p.m. and recognized
Reverend H. Fleet Powell, Jr., Colonial Presbyterian Church, who offered the
invocation. The Pledge of Allegiance to the flag was given in unison.
RENEWAL APPLICATION OF DANNY L. CLARK FOR A SPECIAL EXCEPTION TO PARK
A MOBILE HOME ON A 3.7-ACRE TRACT LOCATED ON THE EAST SIDE OF STATE
ROUTE 603, 1.2 MILES SOUTH OF U.S. ROUTE 11-460 IN THE KUMIS SECTION
Supervisor Johnson moved that the renewal application of Danny L. Clar
be approved beginning August 14, 1977, subject to the provisions of the County
Zoning Ordinance as it pertains to mobile homes.

At this point, Chairman Myers opened the floor for public comments.
~r. O. S. Foster, area landowner, spoke in opposition to the request stating tha
his deed will be null and void if the Supervisors vote to close the road.
After full discussion and consideration thereof, the public hearing wa
ontinued to the August 9, 1977 Board meeting and the County Attorney was directE8
o investigate the consequences, if any, should the Board desire to close said
oad.

A public hearing was this date held by the Board on the above rezoning
request. Mr. Michael K. Smeltzer, Attorney, appeared on behalf of the petitione 5.
Mr. Smeltzer described the property and explained that four employees would nor-
nally be working with a maximum of six employees working at anyone time. He
urther requested an amendment to be made to the request by changing the zoning
to B-1 instead of B-2 as originally requested. Mr. Smeltzer stated that no
hanges would be made in the existing bui lding and no large signs would be erectl~.
~e also called attention to the fact that there are businesses along Route 221
and to extend the zoning to B-1 is a logical extension of a business use for a
~ajor highway. Mr. Smeltzer then introduced Mr. Smith, petitioner, to the Super
~isors. Mr. Smith reiterated that there would be no changing of the appearance
pf the existing structure in any way.
Mr. Charles Cornelison, Attorney representing area residents in opposi
tion, submitted a petition signed by 100% of the families living on Pleasant Hi 1
Drive. He further asked those in opposition to the B-1 zoning to stand. Approx
mately 30 persons stood. He stated that Pleasant Hill Drive is rural living at
tis best and to allow commercial land in this area would reduce the value of the
property.
This concluded the public hearing and Supervisor Dodson moved that the
Board concur with the recommendation of the Planning Commission and deny the
rezoning.

IN RE:
SUBDIVISION BOND SURETIES
County Attorney Edward A. Natt advised the Board that to date he had
not received complete information regarding a suggested amendment made at the
previous Board meeting by Mr. Wi lbur Tester, spokesman for Roanoke Valley Home
Builders Association, whereby a letter of escrow would be acceptable until a
subdivision is completed by the developer.
At the request of the County Attorney, the public hearing on adoption
of an ordinance amending Section 17-17 of the Roanoke Code regarding subdivision
bond sureties was continued to the August 9, 1977 Board meeting.

IN RE:
REPORT ON VISITS TO RICHMOND AND CHARLOTTESVILLE JAILS
Supervisor Johnson read a memorandum addressed to the Board of County
Supervisors reporting on her recent visits to Richmond and Charlottesvi lIe jails
A full copy of the report is fi led with the minutes of this meeting.
In conclusion, Supervisor Johnson requested that another Supervisor wh
voted in the affirmative at the previous Board meeting when discussion of the
jail situation took place make a motion endorsing a joint jail faci lity with the
City of Salem.
Supervisor Compton moved that the Board go on record that it is their
intention to join with the City of Salem and construct a joint jai 1 facility in
the City of Salem on properties adjacent to the present Courthouse and adopt the
following resolution called for a bond referendum to be held the day of the
November general election:

RESOLUTION NO. 1827 AUTHORIZING THE ISSUANCE OF $2,900,000.00 OF GENER L
OBLIGATION BONDS OF ROANOKE COUNTY, VIRGINIA, AND PROVIDING FOR THE SU -
MISSION OF THE QUESTION OF THE ISSUANCE THEREOF TO THE VOTERS OF ROANO E
COUNTY
WHEREAS, the Board of County Supervisors of Roanoke County has hereto-
fore recognized the need for the construction of a new jail faci lity for Roanoke
County; and
WHEREAS, the Board of County Supervisors determines that it is advisab e
to contract a debt and issue bonds of Roanoke County in the aggregate amount and
for the purpose hereinafter set forth and to request the Circuit Court of the
County to make an Order as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby determines that it is advisable to contrac
a debt in an amount not to exceed $2,900,000.00 and to issue general obligation
bonds of Roanoke County of the maximum amount of $2,900,000.00, pursuant to the
Public Finance Act to finance the cost of a jail facility for Roanoke County,
including the acquisition of real estate, if any.
BE IT FURTHER RESOLVED that said Board respectfully requests the Circu t
Court of Roanoke County to make an Order requiring the Judges of Election on the
day fixed by the Order to open a polland take the sense of the qualified voters
of the County on the question of contracting such debt and issuing such bonds.
BE IT FURTHER RESOLVED that the Clerk of the Board is hereby directed
to certify a copy of this Resolution and to present it to the Judge of the Circu t
Court for the County of Roanoke.
BE IT FINALLY RESOLVED that the Clerk of this Board is hereby directed
to file a certified copy of this Resolution with the Clerk of the Circuit Court
for the County of Roanoke.

COUNTY BUDGETING PROCEDURES
Mr. Thomas F. Farrell appeared before the Board regarding alleged sur-
pluses in the County's budget. Mr. Farrell submitted a report to the Board, a

IN RE: JAIL FACILITIES
Roanoke City Resolution No. 23683 offering Roanoke County use of their
jail facilities, upon certain terms and conditions, and enclosing copy of a pro-
posed jail offer to the County was received by the Board and is fi led with the
minutes of this meeting.

GLADE CREEK SEWER INTERCEPTOR
On motion of Supervisor Johnson and the unanimous voice vote of the
Board, Roanoke City Resolution No. 23685 requesting the Board and/or PSA to
immediately submit to the State Water Control Board construction plans for the
segment of the Glade Creek Joint-use sewer interceptor located within the City
and to make immediate application for Step I I I, construction funding, upon
certain terms and conditions was this date received and fi led.

On motion of Supervisor Tompkins and the unanimous voice vote of the
Board, the communication from the State Department of Health advising of a serie
::Jf upcoming meetings to discuss and receive opinions on the "Resource Conservati<r
and Recovery Act of 1976" (RCRA) signed by the President on October 21, 1976, wa

Board, the Audit Reports on the General District Court and Juvenile and Domestic

On motion of Supervisor Compton and the unanimous voice vote of the
Board, notice from the State Division of Legislative Services of a public hearin
pn proposed legislation regarding conditional zoning on Monday, July 18 at 10:00
a.m. at Virginia Western Community College was this date received and filed.
The County Executive advised that he and the County Planner are going
to attend the meeting.

RESOLUTION NO. 1828 INCORPORATING CERTAIN EMPLOYEE COMMITTEE RECOMMEN-
DATIONS INTO ROANOKE COUNTY'S PERSONNEL POLICIES AND PROCEDURES
WHEREAS, an informal committee composed of Roanoke County employees wa
administratively appointed during 1975 and given the task of reviewing the Count 's
personnel policies and procedures and making recommendations for changes in such

WHEREAS, said committee has reported to the County Executive and has
recommended certain revisions and changes in the County's personnel policies and
procedures and the County Executive has, in his report to the Board of County
Supervisors dated July 12, ]977, recommended that the policy changes be imp]emen ed,
in which recommendation the Board concurs;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that the following changes to the County's existing personnel
policies and procedures be, and they are hereby, adopted:
(1) That County employees be allowed to take sick leave in one-quarter day or
two-hour increments and
(2) That new County employees be allowed to take off accrued sick leave during
their probationary period.

IN RE:
UNEMPLOYMENT COMPENSATION
In a report to the Board, the County Executive advised that under rece t
legislation enacted by the Congress of the United States, a]] local governmental
units wi]] be required to provide for unemployment conpensation for their employ es,
which could have a significant financial impact on the County. He further recom
mended that Roanoke County join with the many other local governmental units
throughout the country who are challenging the constitutionality of the Federa]]
mandated Unemployment Compensation Act and appropriate $5,000 towards the suit.

Mr. Bob Johnson, resident of the Town of Vinton, opposed using taxpaye 's
money to oppose the legislation.
Supervisor Tompkins moved that the Board adopt the prepared appropriat on
resolution contributing the sum of $5,000 as the County's cost in the pending
litigation.

ALLOCATION OF FUNDS TO VOLUNTEER FIRE COMPANIES
Supervisor Tompkins moved that the Board concur with the report submit ed
by the County Executive with regard to the al location of funds to volunteer fire

IN RE:
LAND FOR NEW FIRE STATION AT CATAWBA
Supervisor Tompkins moved that the Board concur with the report of the
County Executive and authorize notifying the State of Roanoke County's interest n
obtaining a long-term lease for a one-acre tract of land at the Catawba Hospital
for the future construction of a fire and rescue building. A full copy of the

REFERRALS TO PLANNING COMMISSION

In a report to the Board, the County Executive advised that the follow ng
petitions were referred to the County Planning Commission since the previous
Supervisors' meeting:
Petition of Mount Pleasant Lions Club for rezoning from B-2 to R-2 of
Lots 5, 6, and 7, Block I, revised map of Section I of Ellington Court
(northwest corner of Ellington Drive and Mayfield Drive, SE) so a dupl x
residence may be built thereon.
Petition of Ethel P. Stokes for rezoning from R-I to RE of 3.7 acres
at the rear of a 9.65-acre tract which fronts on Plantation Road and
extends back to Tinker Creek (property is across Tinker Creek from
property of Friendship Manor Apartment Village Corp.) so that Mrs.
Stokes may continue to lease space for the parking of a mobile home.
She wi II apply for a mobile home permit if rezoning is allowed.
In relation to the petition of Ethel P. Stokes, the County Executive
advised that he was in receipt of a communication from the petitioner's attorney
requesting permission to withdraw the petition for rezoning and a further reques
for refund of the $35.00 filing fee.

IN RE:
COUNTY BUDGET ALLEGATIONS
In response to certain allegations regarding the County's budget and
unreported surpluses, the County Executive stated that the County has had a con-
servative approach to budgeting in an effort to establish a good, sound financia
operation. He further stated that the County Administration stands firm on thei
current recommendations regarding County bugeting procedures.
Mr. George F. Ferrell, County Director of Finance, made a presentation
fr<Dm a report entitled "Summary of Conclusions - Allegations of June 27, 1977."
A full copy of the report is fi led with the minutes of this meeting.
Mr. Daniel A. Robinson, the County's Auditor, stated that the staff's
report is reasonable and concurred with the general outline of the report. Mr.
Robinson commended the County Administration for improving the County's financia
status over the past several years.

RESOLUTION NO. 1830 RECEIVING AND FILING THE 1975 REAL ESTATE AND
PERSONAL PROPERTY DELINQUENT LISTS AND AUTHORIZING THE DIRECTOR OF
FINANCE TO CONTINUE COLLECTION OF CERTAIN TAXES

WHEREAS, the provisions of the Code of Virginia require the Director 0
Finance to submit to the Board a list of 1975 real estate and personal property
delinquent taxes showing the transactions occurring during the last fiscal year; and
WHEREAS, the Code further provides that the Board may authorize the
Director of Finance to continue to attempt to collect certain unpaid personal
property taxes within certain statutory time limits which this Board desires to o.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that the 1975 Real Estate and Personal Property Delinquent Lists
be, and the same are hereby received and filed by the Board.
BE IT FURTHER RESOLVED that the Director of Finance be, and he is here y
authorized and directed to continue collection of unpaid personal property taxes
within the limitations of the statutes of the Code of Virginia.

RESOLUTION NO. 1831 AMENDING RESOLUTION NO. 1404 PREVIOUSLY ADOPTED B~
THE BOARD
WHEREAS, the Board of County Supervisors of Roanoke County did, on
January 2, 1976, adopt Resolution No. 1404 delegating to various individuals anc
departments the authority to sign checks originating in that department; and
WHEREAS, the Director of Finance, in report to the Board dated July 12
1977, has recommended that the above resolution be amended in certain respects i

rder to provide for the more efficient handling of routine matters such as the
urchase of supplies and equipment; and
WHEREAS, the Board is of opinion that Resolution No. 1404 should be
as hereinafter provided.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
oanoke County that Resolution No. 1404, adopted by the Board on January 2, 1976
e and the same is hereby amended in the following respects only:
That checks and payments for administrative expenses incurred by the Welfare
Department may be signed by the County Executive with the counter signature
of the Director of Finance.

Executive with the counter signature of the Director of Finance.
That public assistance checks from the Welfare Department will sti 1 1 be sign
solely by representatives of the Welfare Department in accordance with the

RESOLUTION NO. 1832 ACCEPTING BID FOR COIN-OPERATED COPY MACHINES FOR
USE AT THE LIBRARIES
WHEREAS, bids were opened at 10:00 a.m., June 30, 1977, for furnishing
oin-operated copy machines at out main Library and the two branch Libraries; an
WHEREAS, no funds are involved since the installation and maintenance
ill be free of charge to the County; and
WHEREAS, the Purchasing Supervisor and the Director of Finance in a
report to the Board dated July 12, 1977, have recommended that the bid be awarde
to A. B. Dick Products Company of Roanoke for a twenty-four month contract for
furnishing three coin-operated bond copy machines, provide all supplies necessar ,
give one to four hour maintenance service, and allow free copies of up to ten
percent (10%) of total usage for County purposes with the charge to the General
Public to be ten cents (IO~) per copy.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby awards fhe bid for a twenty-four month con
tract for three coin-operated bond copy machines for use by the Libraries at no
cost to the County and in accordance with the bid submitted to A. B. Dick Produc s
Company of Roanoke, the County Executive to notify the bidder of the acceptance
of said bid and to complete the necessary purchase order therefore.

OF ROANOKE COUNTY FOR TERMS COMMENCING JANUARY 1, 1978
WHEREAS, the Board of County Supervisors of Roanoke County has hereto-
fore implemented a redistricting plan instituted by the annexation of land by th
City of Roanoke; and
WHEREAS, as the result of said redistricting, a special election of
supervisors is required, said election to be held so that the terms of the membe s
to be elected will commence as of January 1, 1978, the effective date of the re-
districting.

RESIGNATION OF JAMES M. COLBY AS A COUNTY REPRESENTATIVE ON THE FIFTH
PLANNING DISTRICT COMMISSION
In a letter to the Board dated July 3, 1977, Mr. James M. Colby announ ed
his resignation as a County representative on the Fifth Planning District Commis
sion. The Supervisors requested that a resolution of appreciation for Mr. Colby s
services as a County representative on the Fifth Planning District Commission be
prepared for the August 9, 1977 Board meeting.
The Supervisors directed the Clerk to schedule a meeting with Mr. Colb
on a weekend in the early part of August if possible.

Due to tie votes on the five applicants for the Cave Spring District
representative on the Roanoke County School Board at the June 28 Board meeting,
consideration of the appointment was continued to this meeting. Supervisor
Johnson asked to be excused, and left the meeting room.
Supervisor Compton nominated Mrs. Jean A. Glontz to serve as the Cave
Spring District representative on the Roanoke County School Board.
There being no further nominations, Mrs. Jean A. Glontz was appointed
to serve as the Cave Spring District representative on the Roanoke County School
Board for a term of four years ending on June 30, 1981, by the following recorde
