The Board of County Supervisors of Roanoke County, Virginia, met this
day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia,
this being the fourth Tuesday and the second regular meeting of the month.
Members Present: Chairman Robert E. Myers, Vice-Chairman R. Wayne
Compton, Supervisors C. Lawrence Dodson (arrived 7:10 p.m.), May W. Johnson, anc
E. Deal Tompkins.
Chairman Myers called the meeting to order at 7:00 p.m. and also
offered the invocation. The Pledge of Allegiance to the flag was given in unisc~.

APPROVAL OF MINUTES
On motion of Supervisor Johnson and the unanimous voice vote of the
members present, the minutes of the special meeting held August 2, 1977, were
approved as spread.
IN RE:
RENEWAL APPLICATION OF JAMES H. MAXEY FOR A SPECIAL EXCEPTION TO PARK
A MOBILE HOME ON A I-ACRE TRACT LOCATED ON THE NORTH SIDE OF THE END

Supervisor Tompkins moved that the renewal application of James H.
Maxey be approved beginning August 12, 1977, subject to the provisions of the

BE IT FURTHER RESOLVED AND ORDERED, that the Clerk of this Board shal
forthwith certify a copy of this resolution and order to the Secretary of the
Planning Commission of Roanoke County, Virginia, and a copy to Rober P. Doherty
Jr., Attorney for Petitioner.
Chairman Myers opened the floor for public comments. Mr. Robert P.
Doherty, Jr., Attorney, appeared on behalf of the petitioners. Mr. Doherty
explained that Mr. Hammond operated a used car lot at 550 Orange Avenue in the
City of Roanoke and is proposing to use the property in question as a storage
yard for the vehicles, not for the sale of parts. He further stated that the
entire area is enclosed by large trees. Mr. Doherty then submitted aerial photc
graphs of the property.
Mr. Cecil Bollinger, resident of Rutrough Road, SE, represented the
opposition. Mr. Bollinger expressed concern of the use of publ ic roads going t<
and from the site and the possible littering of car parts on the road. Mrs.
Virginia Clingenpeel also spoke in opposition to the request. Mrs. Clingenpeel

also stated that the roads were already covered with litter, car parts, etc. fro
surrounding junk yards. Supervisor Tompkins stated that Mr. Hammond should not
be penalized for the activities of others.
There being no further comments, the public hearing was closed and the
foregoing order was adopted on motion of Supervisor Tompkins and the following
recorded vote:

REZONING OF A TRACT OF LAND LYING ON THE NORTHERLY *

NOW, THEREFORE, BE IT RESOLVED AND ORDERED that at this meeting of the
Board of Supervisors of Roanoke County, Virginia, held on the 23rd day of August
1977, the said County Zoning Ordinance be, and the same is hereby amended so as
to reclassify the property described in said petition from Business District B-2
to Business District B-3 (Special), in order that said property might be more
fully and reasonably used, the said property being located in the County of
Roanoke, State of Virginia, and more particularly described on Exhibit (WI

Chairman Myers opened the floor for public comments on the proposed
rezoning. Mr. Michael K. Smeltzer, Attorney, appeared on behalf of the petitior rs.
Mr. Ridenhour was also present. Mr. Smeltzer explained that the property in
question is located at the corner of Mr. Ridenhour~s property which had been
previously rezoned to B-2 last year for a proposed shopping center. Mr. SmeltzE
stated that the petitioner proposes to construct and operate a self-service car
wash. Supervisor Dodson raised a question on water supply. Mr. Smeltzer repliE
that sewer and water availabil ity had been assured by the Public Service Autho-
rity and that eight gallons of water would be used per car. Mr. Myers raised a
question on the status of the proposed shopping center for which the land was
originally rezoned. Mr. Tom Hunter, real estate agent, stated that they have
been working on the shopping center for approximately one year and have not bee
able to secure a grocery chain. Mr. W. H. Vest, resident of Indian Road, spoke
in opposition to the proposed rezoning on the basis of potential traffic hazard~
on Williamson Road. If not for the traffic problems, Mr. Vest stated that he
would have no objections.
There being no further comments, the public hearing was closed and thE

IN RE:
REQUEST FOR CONDITIONAL USE PERMIT - JAMES HICKSON
Supervisor Compton moved that the request of James A. Hickson for a
conditional use permit to operate landfill on two parcels of land located on the
east side of State Route 755 (Skycoe Drive), 9/10 mile off Route 112 for the pur
pose of building a road be scheduled for public hearing on September 13, 1977,
providing the petitioner submits the necessary papers.

IN RE:
DROUGHT - FEDERAL ASSISTANCE PROGRAMS
The communication from Governor Godwin advising that Roanoke County ha
been declared eligible for certain Federal assistance programs as a result of th
severe drought was for information of the Supervisors and is filed with the
minutes of this meeting.
NOTICE OF INTENTION TO AMEND CHAPTER 7, BUILDING, ELECTRICAL, AND
PLUMBING CODES OF THE ROANOKE COUNTY CODE.
BE IT RESOLVED by the Board of County Supervisors of Roanoke County
that at their regular meeting to be held at 7:00 p.m. on Tuesday, September 27,
1977, in the Salem-Roanoke County Civic Center, it will be moved that the
Roanoke County Code be amended by the addition of the following:
IISection 7-38.1. Eligibility of Applicants for Journeyman Examination
Only persons having a minimum of two years' experience as an apprentic
electrician or helper working under a Journeyman or Master Elecqriciar
shall be eligible to apply for a Journeyman's examination.11
This amendment wi 11 take effect on September 27, 1977.
The Clerk of this Board is directed to publ ish the proposed amendment
and notice of publ ic hearing thereon as required by law, pursuant to Section
15.1-504 of the Code of Virginia of 1950, as amended, once a week for two conse
cutive weeks, in the evening edition of the Roanoke Times and World News, a newe
paper having a general circulation in Roanoke County.
Said proposed amendment and notice of public hearing thereon shall ale
be posted at the front door of the Roanoke County Courthouse. Further, a copy
of the proposed amendment is on file in the office of the Clerk of the Circuit
Court of Roanoke County and at the office of the County Executive at 302 East
Main Street in Salem, Virginia.

RESOLUTION NO. 1854 APPROVING AMENDMENTS TO THE DELEGATION AGREEMENT
FOR THE ROANOKE CONSORTIUM FOR MANPOWER SERVICES
WHEREAS the Board of County Supervisors has heretofore entered into ar
agreement providing for the Roanoke Consortium for Manpower Services as the oper
ating entity for the Comprehensive Employment and Training Act of 1973, as
amended, in the Fifth Planning District of the Commonwealth of Virginia; and

WHEREAS amendments to said agreement have been proposed, as more speci
fically outl ined in a report by the County Executive to the Board of County Supe -
visors at their meeting on Tuesday, August 23, 1977; and
WHEREAS the Board desires to approve said amendments in order to provi e
for the proper operation of said agreement;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby approves an amendment to the Delegation
Agreement heretofore approved, said amendment relating various personnel procedu es
between the Consortium and the City of Roanoke; and
BE IT FURTHER RESOLVED that the Chairman of the Board of County Super-
visors is hereby authorized and directed to execute, and the Clerk to the Board
to attest, the amended agreement.

IN RE:
RESOLUTION NO. 1855 AUTHORIZING EXECUTION OF AND THE FORWARDING TO
LOCAL JURISDICTIONS OF AGREEMENTS FOR THE TEMPORARY HOUSING OF ROANOKE
COUNTY PRISONERS
WHEREAS, the County has received offers from several cities and counti s
in the hereinafter designated amounts on a per prisoner per day basis for the
temporary housing of Roanoke County prisoners pending the completion of new jail
facilities for Roanoke County; and
WHEREAS, the County Executive in a report to the Board dated August
23, 1977, has recommended that the Board of Supervisors concur in these agreemer s
with these certain jursidictions; and
WHEREAS, the Board of Supervisors desires to execute these agreements'
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanok
County hereby approves the agreements with the jurisdictions as hereafter set
forth upon the terms and conditions as contained in the form of agreements sub-
mitted to the Board by the Roanoke County Executive on August 23, 1977; and
BE IT FURTHER RESOLVED that the Chairman of the Roanoke County Board
of Supervisors be, and he is hereby, authorized and directed to execute, on
behalf of the Board of Supervisors, the agreements with the following cities
and counties at the following rates:

FRIENDS OF THE LIBRARY

On motion of Supervisor Johnson and the unanimous voice vote of the
members, the Board concurred with the report of the County Executive entitled
"Friends of the Library'1 which is an organization which strives to provide the
best library service for the citizens. Such group would have no direct control
over the policies or finances of the library. A full copy of the report is fi IE j

Supervisor Dodson moved that the Board concur with the concept of the

RELEASE OF TITLE - CLEARBROOK RESCUE SQUAD
On motion of Supervisor Johnson and the unanimous voice vote of the
members, the Board concurred in the request from the Clearbrook First Aid and
Rescue Squad, Inc. for release of title to a 1975 Dodge van, vehicle number 753

RESOLUTION NO. 1856 AUTHORIZING AN AGREEMENT WITH DANIEL A. ROBINSON
AND ASSOCIATES TO PERFORM CONSULTANT SERVICES RELATIVE TO ROANOKE
COUNTY'S CAPITAL IMPROVEMENTS PROGRAM

WHEREAS, the Board of County Supervisors has heretofore entered into
an agreement with the Commonwealth of Virginia Department of Intergovernmental
Affairs accepting a grant in the amount of $8,000 through the U.S. Department 0
Housing and Urban Development 701 Program; and
WHEREAS, it has been determined that $3,000 of this $8,000 grant awar
should be allocated for the performance of consultant services required for the
completion of this study; and
WHEREAS, it has been recommended by the County staff that the firm of
Daniel A. Robinson and Associates is best qualified to perform these consultant
services.
NOW, THEREFORE, BE IT RESOLVED that Roanoke County enter into an agre -
ment with Daniel A. Robinson and Associates for an amount not to exceed $3,000
to perform the above referenced consultant services in accordance with the de-
tai led proposal attached as Exhibit 11A" hereto.
BE IT FURTHER RESOLVED that the County Executive is hereby authorized
to negotiate a contract with said firm in a form approved by the County Attorne

IN RE:
JAIL SURVEY
The County Executive requested permission to discuss an item not liste
on the Agenda. The Supervisors concurred with the request.
Supervisor Compton moved that the Board concur with the recommendation
of VVKR Partnership and accept the proposal from T. P. Parker and Son to perform
the land survey of the Countyts jail site adjacent to the present Courthouse, th
cost of which not to exceed $4,000. Funds were previously appropriated for this
purpose.

The Financial Statement for the month of July, 1977, as submitted by

RELATING TO CHARGE FOR BAD CHECKS TENDERED TO COUNTY

a public hearing be held on September 27, 1977, at 7:00 p.m. at a regular meetin
of the said Board at the Salem-Roanoke County Civic Center, at which time it wi 1
be moved that the Roanoke County Code be amended as follows:
Section 19-6.1. Charge for bad checks tendered to County.
If any check tendered for any amount due the County be not paid by the bank on
which it is drawn as the result of insufficient funds in the account or if there
be no such account, the person by whom such check was tendered shall remain liab e
for the payment of such amount the same as if such check had not been tendered,
and in addition to other penalties imposed by law, be subject to a penalty of
five do 11 a rs .

RESOLUTION NO. 1857 ACCEPTING CERTAIN BIDS FOR PROVIDING STREET
IMPROVEMENTS IN THE COUNTY
WHEREAS, the Roanoke County Board of Supervisors has previously appro
priated funds for street improvements in the County; and

WHEREAS, bids were received and opened by Roanoke County at 10:00 a.m.
on August 5, 1977, for providing miscellaneous street improvements as described
in a report dated August 23, 1977, to the Board of Supervisors by the Director
of Finance; and
WHEREAS, the Roanoke County Board of Supervisors desires to aid the
effected County citizens of those areas to be benefited by these street improve-
ments, the funds for these improvements to be paid on a 30 percent basis by the
citizens effected and the balance to be funded by the County.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County that the five low bids totaling $10,389.00 by L. H. Sawyer Paving Company
and the low bid of $1,039.25 by S. R. Draper Paving Company for miscellaneous
street improvements described and recommended in a report dated August 23, 1977,
to the Board by the County Director of Finance be accepted and the County Execu-
tive is hereby directed to notify the low bidders of the acceptance of their sai

RESOLUTION NO. 1859 WAIVING THE REQUIREMENTS OF THE ROANOKE COUNTY
WATER ORDINANCE IN REGARD TO CERTAIN PROPERTY
WHEREAS, certain property owners have approached the Board of County
Supervisors of Roanoke County and requested that the water ordinance heretofore
adopted by said Board be waived in certain respects in order to provide that
water service to said properties may be provided by means other than Roanoke
County; and

WHEREAS, the Board is of opinion that in these particular instances,
because of the hardships created, that certain provisions of the water ordinance
should be waived.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby waives the requirements of the Roanoke
County Water Ordinance contained in Section 20.1-5 of the Roanoke County Code in
regard to the following described property owners that strict compliance with
the provisions of the above section of the water ordinance would impose an undue
hardship and burden upon said property owners:

RESOLUTION NO. 1861 AUTHORIZING A CONTRACT FOR THE MAINTENANCE OF
CERTAIN PUBLIC BUILDINGS

WHEREAS the Board of County Supervisors did authorize the taking of
bids for the maintenance of certain County-owned buildings; and
WHEREAS said bids were received and opened on July 27, 1977, and are
itemized in a report dated August 9, 1977, to the Board entitled "Bid: Janitorie
Contract" from the Purchasing Supervisor and Director of Finance; and
WHEREAS, in another report dated August 9, 1977, to the Board by the
County Engineer, it is shown that the County can save a substantial sum of mone\
by contracting for the maintenance of certain public buildings; and
WHEREAS the Board of County Supervisors of Roanoke County is desirous
of entering into a contract for such services;
NOW, THEREFORE, BE IT RESOLVED that the Board of County Supervisors 0
Roanoke County hereby accepts the bid of Blue Ridge Janitorial Service in the
amount of $2,800 per month for furnishing contract janitorial service for the
County Courthouse, Courthouse Annex, and Health and Welfare building; and
BE IT FURTHER RESOLVED that the County Executive is hereby authorized
and directed to execute the apprpriate papers entering into such contract for a
twelve-month period commencing September 1, 1977, said contract to be in a form
approved by the County Attorney.

DRILLING PROGRAM

WHEREAS the Board of County Supervisors of Roanoke County has hereto-
fore acquired the water system from the Roanoke County Public Service Authority
and is in the process of developing a County-wide water system; and
WHEREAS the Roanoke County Public Service Authority, by letter ballot
dated July 27, 1977, has recommended that the bid of Nelson-Roanoke Corporation
at unit prices stated in their bid dated June 3, 1977, for drilling new wells or
sites selected by the Authority's consultant engineers (Project 77-5-W) be
accepted; and
WHEREAS funds providing for this construction have been budgeted and
the Board desires to accept said bid;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that the bid of Nelson-Roanoke Corporation dated June 3, 1977, i
hereby accepted, and the County Executive is authorized to execute the necessar
papers providing for the award of said bid to said company for di lling new well

IN RE:
SCHOOL BOARD APPOINTMENT - WINDSOR HILLS DISTRICT
Preceding the regular meeting of the Board of County Supervisors held
on August 9, 1977, the Supervisors held an informal publ ic session to consider
applications for the position of the Windsor Hills Magisterial District represen
tative on the Roanoke County School Board. This position became vacant due to t e
resignation of Mrs. Athena Burton, who moved from the area. Chairman Robert E.
Myers, Vice-Chairman R. Wayne Compton and Supervisor C. Lawrence Dodson were
present during the session and participated in the interviews. Supervisors May
Johnson and E. Deal Tompkins were absent. Mrs. Johnson's absence was due to the
fact that she is an employee of the County School Board and by law must abstain
from voting on appointments to the School Board.
Chairman Myers presided over the informal public session, which began
at approximately 5:30 p.m., and conducted the interviews. All applicants who ha
previously submitted resumes (Mr. Jennings T. Bird, Mr. W. Charles Crow, Mr. Jam s
G. Elliot, Mr. William D. Ergle, Mrs. Lenore A. Holsveig and Mr. Harold E. Woody
Sr.) were presend. A question and answer session among the Supervisors and the
applicants was then held. No decision on the appointment was made at this sessi n.
Several citizens and representatives of the news media were also present.

AUGUST 23, 1977
During the seven o'clock regular session of the Board of County Super-
visors held on August 23, 1977, when consideration of the appointment of the
Windsor Hills District representative on the County School Board occurred, Super
visor Dodson reiterated that the above-mentioned session was held and commended
the applicants who were present at said session for their response to questions
asked by the Supervisors. He stated that all six applicants were qualified cand -
dates for the position and that the decision on the appointment was a difficult

one.
Supervisor Dodson moved that Mr. William D. Ergle be appointed to fill
the unexpired term of Mrs. Athena Burton as the Windsor Hi lIs Magisterial Distri t
representative on the Roanoke County School Board, which term expires on June 30
1978.
