The Board of County Supervisors of Roanoke County, Virginia, met this
day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia,
this being the fourth Tuesday and the second regular meeting of the month.
Members Present: Chairman Robert E. Myers, Vice-Chairman R. Wayne
Compton, Supervisors C. Lawrence Dodson, May W. Johnson, and E. Deal Tompkins.
Chairman Myers called the meeting to order at 7:05 p.m. and recognized
Reverend William C. Eicher, Poages Mill Church of the Brethren, who offered the
invocation. The Pledge of Allegiance to the flag was given in unison.

On motion of Supervisor Johnson and the following recorded vote, the
minutes of the regular meeting of October 25, 1977 were approved as spread:

Supervisor Johnson moved that the renewal application of Carl Taylor be
approved beginning October 14, 1977, subject to the provisions of the County Zoning

Supervisor Johnson moved that the renewal application of Lazarus Simmons
be approved beginning September 9, 1977, subject to the provisions of the County
Zoning Ordinance pertaining to mobile homes.
The motion was adopted by the following recorded vote:

IN RE:
APPLICATION OF OTHA LEE WHEELER FOR RENEWAL OF
MOBILE HOME PERMIT - REFERRED TO BOARD OF ZONING APPEALS
In relation to the renewal application of Otha Lee Wheeler for a mobile
home permit, County Executive William F. Clark advised the Board that the applicant
is building an addition to the mobile home, which is in violation of the County
Zoning Ordinance as it pertains to mobile homes unless the applicant first secures
a variance from the Board of Zoning Appeals. Mr. Clark further advised that the
request had been advertised for public hearing prior to County staff being aware of
the addition being built. Mr. Clark stated that the applicant had been notified
by phone that he would have to obtain a variance and that it would be his

responsibility to follow up on the necessary procedure to obtain such a permit.
No one was present at the public hearing, either for or against the
request. There being no further comments, Supervisor Tompkins moved that the
application of Otha Lee Wheeler for renewal of his mobile home permit be referred
to the Board of Zoning Appeals. The motion was adopted by the unanimous voice vote
of the Board.

NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the Board of Supervisors of
Roanoke County that pursuant to the provisions of law, the present zoning of B-2 be
changed to B-3 for that property located in Roanoke County, Virginia described as
follows:
BEGINNING at a point at the intersection of a 20' private road easement
granted in Deed Book 415 at page 48 and Route 117 thence along said privat
road N 310 54' W 138.40' to a point thence N 480 59' 00" E 150.93' to a
point thence with a new division line 53]0 541 E 2]0.87' to a point on
Route ]]7 thence along Route ]17, ]75.00' to the point of beginning and
containing 0.696 acres and
BEING a portion of the same property conveyed to Dona]d J. and Charlotte
H. Ridenhour by Deeds dated August 8, 1974 and of record in the Clerk's

BE IT FURTHER RESOLVED AND ORDERED that the Clerk transmit a certified

IN RE: ORDINANCE NO. ]916 AMENDING SECTION ]7-]7 OF THE ROANOKE COUNTY CODE
WHEREAS, the Board of County Supervisors of Roanoke County deems certain
amendments to the Roanoke County Code to be necessary in the best interests of the
health, safety, and genera] welfare of the citizens of Roanoke County; and
WHEREAS, a notice of intention to amend the Roanoke County Code as propos d
and the public hearing thereon have been advertised and posted in accordance with
law.

NOW, THEREFORE, BE IT ORDAINED by the Board of County Supervisors of
Roanoke County that the Roanoke County Code be amended as follows:
Section ]7-]7. Insta]]ation of improvements or fi ling of performance bond require
prior to recording.
A]] physical improvements required by the provisions of this article for the sub-
division as platted sha]] have been installed therein the thereon at the expense 0
the subdivider prior to the recordation of the final plat, provided, however, that
in lieu of the actual installation of the physical improvements, the subdivider
shall have submitted and have approved an acceptable form of agreement and bond
with corporate surety, or in lieu of said bond an acceptable letter of credit to
be an amount equal to the total cost of such improvements and guaranteeing that th
required improvements wi]] be installed within a designated length of time. The
form of agreement, designated length of time, bond and surety, letter of credit,
and choice of guarantee shall be prescribed by the Board of County Supervisors, as
it may require, according to the nature and extent of the improvements to be made.
The County Attorney explained why this amendment to the County Code is
being recommended stating that after research of appropriate statutes, it is his
opinion that the letter of escrow does not consittute an absolute guarantee for th
County as should be required by Section ]7-]7 of the Roanoke County Code, insuring
the installation of subdivision improvements in case of developer default. Chairm n
Myers asked if there was anyone present opposed to this amendment.

There being no oppostion, the foregoing ordinance was adopted on motion of
Supervisor Compton and the following recorded vote:

IN RE: PROCLAMATION - THANKS FOR GIVING
Pursuant to a letter from Mr. Robert D. Saul, President, Goodwi]] Industrie
of Greater Virginia, Inc., Chairman Myers signed a proclamation declaring November,
]977 as "Thanks for Giving Goodwi]]" month in and for Roanoke County. A copy of th
proclamation is filed with the minutes of this meeting.

IN RE: IIROANOKE VALLEY ] 978" CALENDAR
Mrs. Carol B. Dalhouse, Executive Director, Roanoke Valley Arts Council,
appeared before the Board and presented the Council IS "Roanoke Valley 1978" calenda
to Chairman Myers.
IN RE: RESOLUTION NO. 19]7 ACCEPTING BIDS FOR THE PURPOSE OF FURNISHING MICROFILM
EQUIPMENT FOR USE IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT
WHEREAS, on November 21, 1977, at 2:00 p.m., bids were received and opened
in the Department of Finance, Purchasing Division, for the purpose of furnishing
microfilm equipment for use in the Office of the Clerk of the Circuit Court; and
WHEREAS, the Purchasing Supervisor has, in report to the Board dated
November 22, 1977, recommended that the acts hereinafter set out be accepted; and
WHEREAS, the funds for said microfilm equipment hereinafter accepted are
included in the 1977-78 budget.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok
County that the following bids for microfilm equipment for use in the Office of the

The County Executive is hereby directed to no t i fy sa i d bidders of the acceptance of
their said bids and is authorized to execute the necessary contracts for these pur-
chases.
Considerable discussion took place on the subject of microfilm equipment fo
the Circuit Court Clerk's Office. Copy of a report from E] izabeth W. Stokes, Circu t
Court Clerk, with a difference of opinion from recommendations made by County staff
on awarding of bids for the equipment is filed with the minutes of this meeting.
Representatives from 3M Business Products Sales and Eestman Kodak were present at
the meeting. Mrs. Stokes was also in attendance. A lengthy question and answer
session among the Supervisors, Mrs. Stokes, County staff, 3~ and Eastman Kodak
occurred, following which Supervisor Tompkins moved adoption of the foregoing reso
]ution. Chairman Myers stated that he felt that this is not in keeping with the
recommendation of the Clerk, who is responsible for the equipment. Supervisor
Dodson agreed with Mr. Myers. Supervisor Tompkins stated that, in his opinion, the
C]erkls recommendations are not justifiable.

This concluded the discussion, and Supervisor Tompkins I motion was adopted

IN RE: REFERRALS TO PLANNING COMMISSION
I
In a report to the Board, the County Executive advised that the following
petitions for rezoning have been referred to the County Planning Commission since
the Supervisors' meeting on November 9, 1977:
Petition of John M. Oakey, Inc. for rezoning from R-l to B-2 of 14.32 acres
on the west side of Route 419 between Castle Rock Road (Route 702) and Sout
McVitty Road (Route 1662) so that a funeral chapel may be built thereon.
Petition of Edward Roll in Graham and Doris B. Graham for rezoning from A-I
to M-l of less than 1 acre of land in the Della Pendleton Subdivision
(unrecorded) located on the south side of U.S. Route bl, 1,250 feet east
of the Roanoke/Montgomery County line so the land may be used for repair
of tractors and trucks and the sale of used farm machinery.

IN RE: RESOLUTION NO. 1918 ACCEPTING A BID FOR THE PURPOSE OF PROVIDING ARCHITEC-
TURAL SERVICES TO BE USED IN THE SHERIFF'S DEPARTMENT NEW YOUTH BUREAU
WHEREAS, on November 14, 1977, at ]0:00 a.m., bids were received and opened
in the Department of Finance, Purchasing Division, for the purpose of providing
architectural services to be used in the Sheriff1s Department New Youth Bureau; and
WHEREAS, the Purchasing Supervisor has, in report to the Board dated
November 22, ]977, recommended that the acts hereinafter set out be accepted; and
WHEREAS, the funds for said architectural services hereinafter accepted are
included in the 1977-78 budget.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok~
County that the bid for said architectural services of William G. Wells & Associate
in the amount of $5,295.00 be accepted, said architectural services to be used in
the Sheriff's Department New Youth Bureau; and the County Executive is hereby
directed to notify said bidder of the acceptance of their said bid and is authorizej
to execute the necessary contracts for this purpose.

IN RE: DEPARTMENTAL ACTIVITIES REPORTS - OCTOBER, 1977
The departmental activities reports for the month of October, ]977, were
for information of the Supervisors and are filed with the minutes of this meeting.
Supervisor Tompkins asked the Clerk of Circuit Court about the sale of
hunting and fishing licenses. She advised him that she wi]] resume the practice
the beginning of the next calendar year.
IN RE: RESOLUTION NO. ]9]9 ACCEPTING A BID FOR MONITORS TO BE USED IN THE ROANOKE
COUNTY FIRE DEPARTMENT, CAVE SPRING STATION
WHEREAS, .on November 9, ]977, at 10:00 a.m., bids were received and opened
in the Department of Finance, Purchasing Division, for the purchase of fifty (50)
monitors to be used in the Roanoke County Fire Department, Cave Spring Station; anc
WHEREAS, the Purchasing Supervisor has, in report to the Board dated
November 9, ]977, recommended that the acts hereinafter set out be accepted; and

WHEREAS, the funds for said fifty (50) monitors hereinafter accepted are
included in the 1977-78 budget.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok

Roanoke in the amount of $13,000.00 be accepted, said monitors to be used by the
Roanoke County Fire Department, Cave Spring Station; and the County Executive is
hereby directed to notify said bidder of the acceptance of their sawd bid and is
authorized to execute the necessary contracts for this purchase.

IN RE: ITEMS NOT ON THE AGENDA
The County Executive requested permission to bring up several items not on
the agenda. The Supervisors concurred with the request.
IN RE: WATER NOTICE EXPLANATION
The County Executive advised that in accordance with new Federal and State
Drinking Water Standards, the Publ ic Service Authority has sent out a water notice
to customers of the Arlington Forest and Longridge Water systems because water bein
served to its customers in said systems did not comply with a Primary Maximum Con-
taminant Level for bacteriological presence during the three month period beginning
on July 1, 1977. A full copy of the notice is filed with the minutes of this
meeting.

On motion of Supervisor Johnson and the unanimous voice vote of the Board,
the following items were this date received and filed:
(1) The results of the General Election held on November 8, 1977.
(2) Reappointment of William E. Cundiff as a member of the Board of
Zoning Appeals.
IN RE: RESOLUTION NO. 1920 ACCEPTING THE PROPOSAL OF DANIEL A. ROBINSON AND
ASSOCIATES FOR A TURNOVER AUDIT
WHEREAS, it is necessary to conduct a turnover audit as of December 31,
1977, because of the change of responsibi lity and accountabil ity from the present
Director of Finance, to an incoming Director of Finance as a result of the resig-
nation of the present Director of Finance, effective December 31, 1977; and
WHEREAS, the firm of Daniel A. Robinson and Associates has submitted a
proposal to conduct said turnover audit, at a cost to the County not to exceed
$28,000; and
WHEREAS, the County Executive and the Director of Finance have, in their
report dated November 22, 1977, recommended that said proposal be accepted, in
which recommendation the Board concurs; and
WHEREAS, it wi 11 be necessary to close the Office of the Director of Financ
from January 3 through January 6, 1978, in order that said audit may be accompl ishe
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok
County that the proposal of Daniel A. Robinson and Associates to conduct a turnover
audit as of December 31, 1977, be, and the same is hereby accepted, the cost of sai
turnover audit not to exceed $28,000 without prior approval of the Board of Super-

of the Office of the Director of Finance from January 3 through January 6, 1978, in
order that said audit may be accomplished.

IN RE: NOTICE OF INTENTION TO AMEND SECTION 9.1 OF THE ROANOKE COUNTY CODE
BE IT RESOLVED by the Board of County Supervisors of Roanoke County that a
public hearing be held on December 27, 1977 at 7:00 p.m., at a regular meeting of
the said Board at the Salem-Roanoke County Civic Center, at which time it will be
moved that the third paragraph of Section 9.1-5, entitled "Coin machine operator",
be amended to read in its entirety as follows:
Coin machine operator. Every person, firm or corporation sell ing,
leasing, renting or otherwise furnishing a coin-operated machine or coin-
operated machines to others or placing a coin-operated machine or coin-
operated machines with others; provided, however, the term "operatorll shall
not include a person, firm or corporation owning less than three coin
machines and operating such machines on property owned or leased by such
person, firm or corporation.
BE IT FURTHER RESOLVED at said publ ic hearing, at which time it will be
moved that Section 9.1-40 of the Roanoke County Code be amended by inserting betweer
"Collection agency, any and all typesll and IICorrespondence schooP' the following:
Coin machine operators of coin-operated machines or devices - that
operate on the coin-in-the-slot principle to produce music or other per-
sonal service, including coin-operated washing machines, drying machines
and dry cleaning machines. The operation of ironing machines, car wash
machines or self-service car washing establishments and soap or detergent
vending machines or change making machines used in connection with any
self-service laundromat or self-service car wash establ ishment shall be
considered a personal service occupation and subject to the same tax as
other personal service occupations. The operation of coin operated machine~
or devices that operate on the coin-in-the-slot principle to vent any and
all kinds of merchandise on goods not listed shall be considered a business
service occupation and subject to the tax for business service occupations.

This section shall not apply to coin machine operators of coin-oper-
ated machines or merchandise vending machines when:
(1) They are candy vending machines under the ownership or supervisioh
of any state commission or state agency;
(2) They are used solely for the purpose of selling individual sani-
tary drinking cups, natural water or sanitary napkins;
(3) They are sponsored by or under the auspices of, a local reI igious,
educational or military organization or civic club when at least fifteen
percent of the gross intake of such machine is exclusively devoted to the
needs or objectives of such an organization, civic club or some elderly
charitable purpose.
BE IT FURTHER RESOLVED at said public hearing, at which time it will be
moved that Section 9.1-47 of the Roanoke County Code be amended to read in its
entirety as follows:
Section 9.1-47. Coin-operated machines and operators.
(a) There shall be imposed on each coin machine operator as defined
in Section 9.1-5, in addition to the license tax imposed by Section 9.1-40,
a tax of $200.
(b) The coin machine operator's 1 icense tax imposed in this section
and Section 9.1-40, however, is not applicable to operators of weighing
machines, automatic baggage or parcel checking machines or receptables,
nor to vending machines which are so constructed as to do nothing but vend
merchandise or postage stamps or provide service only, nor to operators of
coin-operated musical devices that operate on the coin-in-the-slot princi-
ple, nor to operators of viewing machines or photomat machines, not to
operators of devices or machines affording rides to children or for the
delivery of newspapers.
(c) This section shall not apply to coin-operated machines or mer-
chandise vending machines when:
(1) They are candy vending machines under the ownership or supervi-
sion of any state commission or state agency;
(2) They are used solely for the purpose of selling individual sani-

(3) They are sponsored by or under the auspices of, a local religious,
educational or mil itary organization or civic club when at least fifteen

These amendments to take effect on December 27, 1977.
The Clerk of this Board is directed to publish the proposed amendments and
notice of hearing thereon as required by law, pursuant to Section 15.1-504 of the
Code of Virginia, as amended, once a week for four consecutive weeks in the Roanoke
Times World News, a newspaper having a general circulation in Roanoke County.
Said proposed amendment and notice of hearing thereon shall be published
and posted at the front door of the Roanoke County Courthouse.
A copy of the proposed amendment is on file in the Clerk's Office of Dhe
Circuit Court of Roanoke County and at the County Executive's Office at 302 East
Main Street, Salem, Virginia.

IN RE: RESOLUTION NO. 1928 AMENDING RESOLUTION NO. 1841 WHICH PREVIOUSLY AMENDED
THE POLICIES RELATING TO NON-COUNTY RESIDENTS PARTICIPATING IN COUNTY
ATHLETIC PROGRAMS
WHEREAS, the Board of County Supervisors has heretofore established a
pol icy relating to participation in County athletic programs by residents outside
the boundaries of Roanoke County; and

WHEREAS, the Board by Resolution No. 1841, adopted August 9, 1977, revised
and amended said pol icy in order to provide the opportunity for certain non-County
residents to participate in County athletic programs upon certain terms and condi-
tions, to-wit:
That the youth who reside outside County boundaries as of January 1, 1976,
and who participated in County athletic programs prior to said date be,
and they hereby are, permitted to particpate in the County athletic program~
upon the following conditions:
(1) That each individual participant pay a fee of $12.00 per sport to the
County.
(2) That the individual seeking to participate must, prior to the above
date, have participated in that particular sport in the County athleti~
program, even if in a different league.
(3) That the County Executive, upon the advice of County Recreation Depart
ment staff, shall have the right to deny such participation if, in his
sole judgment a County resident would otherwise be unable to partici-
pate in that athletic program.
(4) That the pol icy for youth participation only shall remain in force and
effect from the date of its adoption through the football/soccer 1977
season, provided further that the pol icy shall be deemed to be imme-
diately rescinded if non-County municipal ities and the County mutually
agree on a recreation pol icy affecting the citizens of both jurisdic-
tions.

(5) That the policy presently in effect regarding the North Salem/Glenvar
Little League Baseball Program remain in full force and effect.
NOW, THEREFORE, BE IT RESOLVED that Paragraph (4) of the above terms and
conditions of Resolution No. 1841 be amended to read in its entirety as follows,
the reaminder of Resolution No. 1841 to remain in full force and effect:
(4) That the pol icy of the youth participation shall remain in force and
effect and shall provide that non-County youths who participate on a
continuous basis in any particular sport for any recreation club shall
be permitted to continue such participation until they leave the pro-
gram upon the following conditions:

No new teams are created to allow for participation
County residents;
The participation must be continuous in that sport;

(D) That non-County residents would not be permitted to participate if

APPOINTMENT - INDUSTRIAL DEVELOPMENT AUTHORITY
Supervisor Johnson moved that Mr. Billy H. Branch be appointed to serve as
a member of the Roanoke County Industrial Development Authority with her term of
office to expire September 26, 1981.
The motion was adopted by the unanimous voice vote of the Board.

IN RE: REQUEST OF SHERIFF O. S. FOSTER FOR SALARY INCREASE
Supervisor Dodson moved that the Board increase the salary of Sheriff O. S.
Foster $2,000 annually beginning December 1, 1977, due to the Sheriff having
assumed additional responsibilities upon the death of former Chief Deputy, R. L.
Chew.
