The Board of County Supervisors of Roanoke County, Virginia, met
this day in open session at the Salem-Roanoke County Civic Center in Salem,
Virginia, this being the fourth Tuesday and the second regular meeting of
the month of June.
MEMBERS PRESENT:
Chairman Lawrence E. Terry, Vice-Chairman Edward C.
Park Jr., and Supervisors May W. Johnson, Robert E. Myers and Paul B. MatthewE

Chairman Terry called the meeting to order at 6:00 and upon motion
of Supervisor Matthews and a unanimous voice vote, the Board went into
Executive session to discuss real estate and potential litigation.

INVOCATION
Invocation was offered by Rev. Jeffrey Jones, St. Paul's Episcopal
Church, Salem, Virginia, and the pledge of allegiance to the Flag was
recited in unison.

APPROVAL OF MINUTES
Upon motion of Supervisor Johnson and a unanimous voice vote, the
minutes of June 10 meeting were approved as submitted.

At this point I-:;hairman Terry informed the citizens that Supervisor
Matthews would be leaving the meeting at 8:30 p. m. and he would like to
bring up the items of the Hollins Park and fiscal year 1980-81 budget.

PARK IN HOLLINS DISTRICT
Supervisor Matthews stated that property being considered for a

park in the Hollins District is the Oldfield school property on State
Secondary Route 648 and is valued at $2,500. Improvements for this park
would cost $10,000. After some discussion the following resolution was
adopted and motion made to purchase said property.

Supervisor Myers stated that, in his opinion, this budget was

FISCAL YEAR 1980-81 BUDGET
inflationary and would require a tax increase next year but since the
school budget portion has been adopted, the remainder should also be approved.
Supervisor Matthews stated he had looked carefully at the school
budget and felt he could not support a cut in the budget if we are to maintain
our present school programs.

Robert Logan, Planning Technician, informed the Board that Staff
recommends denial of this request since the subdivision covenants prohibit
commercial use of property. Supervisor Johnson moved to deny this request
which was adopted by unanimous voice vote.
Mrs. Harris informed the Board that subdivision owners have not

conformed to all of the restrictions of record and that she had talked with
her neighbors and no objection has been expressed regarding her request.
James Buchholtz, County Attorney, stated that the Board may grant
her request for a permit and it would be up to the subdivision owners to
bring suit for non-conforming restrictions of use.
Supervisor Johnson moved to reconsider the request of Mrs. Harris
which was approved by unanimous voice vote.
On motion of Supervisor Johnson and a unanimous voice vote, the
request was approved on the following conditions: Permit for a one-year
period, hours of operation be from 9:00 a. m. to 2:00 p. m. and no more than
3 customer cars in the driveway and permit to be valid beginning September
1, 1980.

WHEREAS, after full consideration, the Board of County Supervisors
is of the opinion that the request should be approved subject to a proffered
condition.
NOW, THEREFORE, BE IT ORDERED that the aforementioned tract of
land, more particularly described below, be rezoned from Residential
District RE to Agricultural District A-l: Subject to the condition that
there be no new hog farms established.
A tract of land containing approximately 183.4 acres
in separate parcels, lying in Roanoke County and
fronting approximately 5,000 feet on either side of
State Route 643 in the Catawba Magisterial District.

ORDINANCE NO. 2607 TO AMEND SECTION 21-11 OF THE ROANOKE
COUNTY CODE BY REPEALING SECTION (d) - FILING FEES AND ADDING
SECTION (e) - FILING FEES TO PROVIDE FOR THE BOARD OF SUPERVISORS
TO FROM TIME TO TIME ESTABLISH FEES AND CHARGES TO BE PAID PURSUANT
TO THE ROANOKE COUNTY ZONING ORDINANCE BY RESOLUTION OF THE BOARD.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That Chapter 21, Zoning, Article I, In General, Section 21-11,
Amendments to Chapter, Section (d), Filing Fees as adopted pursuant to
Ordinance dated June 12, 1973 be, and it hereby is repealed; and
2. That Chapter 21, Zoning, Article I, In General, Section 21-11,
Amendments to Chapter be amended and re-enacted by the addition of a new
section to be designated (e) and entitled Filing Fees ,to read and proy~de
as follows, to-wit:

Filing fees shall be imposed upon each petitioner filing with the
governing body a petition for a zoning change or filing a petition
pursuant to the zoning ordinance in which one or more public hearings
are required to be held, such filing fees to be in such amounts as
may from time to time be hereafter established by the Board of
Supervisors by resolution duly adopted setting forth such fees.

Administrator William Clark informed the Board that since adopting
the Ordinance No. 2607 regarding the filing fees, it is necessary to adopt
a resolution setting various fees which the Board may change or reschedule
at their discretion.
RESOLUTION NO. 2608 ESTABLISHING CERTAIN FEES TO BE CHARGED
FOR FILING OF PETITIONS RELATING TO ZONING CHANGES OR MATTERS
PURSUANT TO THE ROANOKE COUNTY ZONING ORDINANCE WHICH REQUIRE
ONE OR MORE PUBLIC HEARINGS.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That there be and there hereby is imposed the following fees to be
charged for filing of petitions relating to zoning changes or matters pursuant
to the Roanoke County Zoning Ordin8nce which require one or more public
hearings, to-wit:
(a) Rezoning to Agricultural District A-I, Residential Estates
District RE, or Residential District R-l - $60.00
(b) Rezoning to Residential District R-2, Residential District
R-3, or Office and Residential District B-1 - $75.00, plus $5.00
for each acre or portion thereof;
(c) Rezoning to Mobile Home Courts District R-4 - $125.00 plus
$5.00 for each acre or portion thereof;
(d) Rezoning to Business District B-2 or Business District B-3 -
$125.00 plus $5.00 for each acre or portion thereof;
(e) Rezoning to Industrial District M-l, Industrial District M-2
or Industrial District M-3 - $100.00 plus $5.00 for each acre or
portion thereof;
(f) Use not provided for permits - $25.00
(g) Variance requests - $35.00
(h) In addition to the fees hereinabove specifically imposed there
shall be upon the filing of any requests pursuant to the Roanoke
County Zoning Ordinance which requires one or more public hearings
to be held a fee of $25.00.

IN RE:
PETITIONS AND COMMUNICATIONS
IN RE:
LAW ENFORC&~ENT OFFICERS ON BEHALF OF THE OFF-DUTY
EMPLOYMENT FOR OFFICERS
Paul McElvein, Deputy Sheriff, spoke on behalf of the deputies
of the County Sheriff's department favoring the off-duty employment of
officers using County equipment and police powers in order to supplement
their income. He read aloud a statement which he had prepared citing the
need for this additional employment. Several other deputies also spoke

in favor of this request.
Mr. Raymond Setchel, owner of a skating rink, informed the Board
that he used deputies on a regular basis at the rink and they perform a
valuable service to him and other businessmen and he favored the~r employment
and was willing to pay extra taxes, if necessary, in order to be provided
with their extra services.
Mr. Jim Dickie, representing Tanglewood Mall Merchants Association,
presented a petition from merchants at the mall favoring the use of off-duty
deputies for security at Tanglewood Mall.
Mr. Phillip Ferro, Ferro's Pizza, also spoke in favor of this
request and stated he frequently used their services at his business.
James Buchholtz, County Attorney, explained his report (filed,

with the minutes of this meeting) which the Board requested, regarding the
liability and insurance coverage for officers using their police powers and
equipment for private gain in off-duty employment.
Marjorie O'Roark, President, Shenandoah Intelligence Agency, stated
her objection to the employment of these officers and cited taxes paid by
security agencies which would not be paid by deputies.
After some discussion Supervisor Matthews moved to approve the

off-duty employment for law enforcement officers, which was adopted by the
following recorded vote.
ORDINANCE NO. 2609 AUTHORIZING LAW ENFORCEMENT OFFICERS AND
DEPUTY SHERIFFS EMPLOYED BY ROANOKE COUNTY TO ENGAGE IN OFF-
DUTY EMPLOYMENT WHICH MAY OCCASIONALLY REQUIRE THE USE OF
THEIR POLICE POWERS IN THE PERFORMANCE OF SUCH EMPLOYMENT.
BE IT ORDAINED by the Board of Supervisors of Roanoke County as
follows:
1. That the law enforcement officers and deputy sheriffs employed
by the County of Roanoke shall be, and they hereby are authorized to
engage in off-duty employment which may occassionally require the use of
their police powers in the performance of such employment; and
2. That while engaged in such off-duty employment the use of such
police powers by such off-duty law enforcement officers and deputy
sheriffs employed by Roanoke County shall at all times be subject to
strict compliance to the reasonable rules and regulations governing same
as from time to time promulgated by the Sheriff of Roanoke County.
3. That such rules and regulations promulgated by the Sheriff of
Roanoke County shall be in full force and effect from and after the date
that such rules and regulations are concurred in by the Board of Supervisors
of Roanoke County.

COUNTY ADMINISTRATOR
The Departmental Activities Report for May was submitted and
received in file.
IN RE:
SCHOOL ADMINISTRATION:
Bayes Wilson, Director of Finance, requested the Board to
appropriate funds amounting to $5,000 to develop a program of study of food
marketing, specifically of jobs of that area and requirements for employees
in that field. This program would be reimbursed 100% from State funds.

GLEN COVE ELEMENTARY
Mr. Wilson informed the Board that funds in the amount of $5,000
were budgeted in the 1979-80 budget to install school zone signs with
flashing lights at Glen Cove Elementary and Roanoke County Occupational

Schools and the School Board requests that funds be carried over in the

Mr. Wilson informed the Board that certain schools which sold
snack foods and juice used those funds to support various school programs

for support of programs. Mr. Wilson also stated that the School Board
would not again appear to request funds regarding this program.

Gene Robertson, County Engineer, submitted a report, filed with the
minutes of this meeting, which states that Clinton Poff, a native of Bent
Mountain, originally offered to the volunteer firemen to allow fill dirt
to be taken from his property to be used in the construction of the Bent

Mountain fire station. Upon the knowledge of the amount of dirt required,
Mr. Poff withdrew his offer to supply same. He has now requested a price
of $2.00 per load. At this point, however, the dirt has already been tested,
etc. and there is an immediate need. Therefore, Mr. Robertson recommends
the County accept Mr. Poff's price.

1. That the Virginia Department of Highways and Transportation has
previously submitted its proposed schedule of fiscal year 1980-81 Construction
Fund priorities for the secondary system of State highways in Roanoke
County to the Board of Supervisors; and
2. That after two successive weeks of publication of notice of
intention to hold a public hearing on the aforesaid study on April 8,
1980, public inspection of said document and receipt of public comments
at said public hearing, all as required by law, the Board of Supervisors
is of opinion that the schedule as submitted to the Board should be
approved; and
3. That the schedule of fiscal year 1980-81 Construction Fund
