The Board of County Supervisors of Roanoke County, Virginia, met this
day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia
this being the second Tuesday and the first regular meeting of the month of
October.
Members present: Chairman Lawrence E. Terry, Vice Chairman Edward C.
Park Jr., and Supervisors May W. Johnson, Robert E. Myers and Paul B. Matthews.

Mr. Collins appeared in support of this request. No one appeared in

opposition. Supervisor Myers reminded Mr. Collins that his permit was issued
two years ago and he has not skirted his trailer and, several complaints and
letters have been received. Mr. Myers stated that if he could have the trailer
underpinned within a month, his permit could be renewed but otherwise it could
not be renewed since it violates the zoning restrictions. Mr. Collins stated
that he would try to underpin the trailer but he is not working full time
presently and it may be financially impossible.
On motion of Supervisor Myers and a unanimous voice vote, the request
was held over until November 12th.

PUBLIC HEARING ON QUESTION OF AMENDING SECTION 19-6 OF
THE ROANOKE COUNTY CODE TO PROVIDE FOR INCREASING THE
RATE OF INTEREST CHARGED BY THE COUNTY OF ROANOKE ON
DELINQUENT TAXES FROM THE CURRENT EIGHT (8) PERCENTUM
TO TEN (10) PERCENTUM PER ANNUM.
Fred Anderson, Treasurer, explained that it has become desirable
for citizens to allow their taxes to become delinquent and invest their money
whereby it would draw more interest than the amount of penalty for late payment
of taxes. This is especially true of large developers and property owners.
Therefore, Mr. Anderson requested that the Ordinance submitted for consideratio
be approved.
ORDINANCE NO. 2691 AMENDING SECTION 19-6 OF THE ROANOKE
COUNTY CODE TO PROVIDE FOR INCREASING THE RATE OF INTEREST
CHARGED BY THE COUNTY ON DELINQUENT TAXES.
BE IT ORDAINED by the Board of Supervisors of Roanoke County,

Virginia as follows:
1. That Section 19-6 (b) be amended to read and provide as follows:
(b) In the event any installment of taxes on real estate or
tangible personal property is not paid on or before the date the
same is due and payable, as set forth in the preceding sections,
interest at the rate of ten percent per annum commencing on January
first of the next year following that for which such taxes are
assessed shall be assessed and collected on the principal of and

penalties on all taxes assessed by the county on real estate and
tangible personal property for the 1980 tax year and each tax year
following~ remaining unpaid on the thirty-first day of December of
the year in which such taxes were assessed or due to have been
assessed~ and until paid.

From and after January l~ 1981~ interest at the rate of ten
percent per annum shall be collected upon the principal and penalties
of all such tangible personal property and real estate taxes then
remaining unpaid on the date fixed by general law for the payment
of such taxes.

IN RE:
REQUEST TO ENTER INTO A CONTRACT WITH COMMONWEALTH CHECK
SYSTEMS (VIRGINIA ASSOCIATION WITH THE MERCHANTS ASSOCIATION
OF ROANOKE VALLEY) TO HELP DEFRAY COST OF COLLECTING BAD CHECKS
Mr. Anderson explained to the Board how the system with Commonwealth
Check Systems assists in verifying checks for sufficient funds before they
are accepted as payment to the County. He stated this will save time and
money for the County.

John Chambliss~ Director of Finance, also stated this system will
assist his department since they are responsible for collecting some funds.
RESOLUTION NO. 2692 AUTHORIZING THE COUNTY OF ROANOKE TO
ENTER INTO A CONTRACT WITH COMMONWEALTH CHECK SYSTEMS TO AID
IN THE COLLECTION OF "BAD" CHECKS.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That the County of Roanoke be, and it hereby is authorized to
enter into a contract with Commonwealth Check Systems to assist the
County in the collection of checks returned by the bank for insufficient
funds; and
2. That the County Administrator be, and he hereby is authorized
and directed to execute, upon a form approved by the County Attorney~

TREASURER'S REPORT
Mr. Anderson submitted his report for the month of September, which
was received and filed.
IN RE:
REQUEST OF DONALD L. MUNDY FOR A VARIANCE OF THE COUNTY SEWER
ORDINANCE TO HOOK UP TO A SEPTIC TANK ON HIS PROPERTY LOCATED
ON ALPINE ROAD IN THE CATAWBA MAGISTERIAL DISTRICT.

Mr. Mundy was present to support this request. Supervisor Myers
reminded the Board that his request was denied at a previous meeting to run
sewer lines through his father's property and now the site has been approved
for a septic tank. On motion of Supervisor Myers and the following recorded
vote, the request was approved.

IN RE:
EBENEZER BAPTIST CHURCH - REV. RUFUS PASLEY
Rev. Pasley was recognized by Chairman Terry. Rev. Pasley stated

that at the Church located on Route 626, accidents have occurred and some
injuries resulted. He asked the Board to see if street lights could be
installed, road markings placed on the highway, and speed limits posted. Mr.
Jackson, citizen, also appeared to support the request of Rev. Pasley.
Supervisor Myers informed Rev. Pasley that his request for street
lights could be referred to the Engineering Department for the County but the
Highway Department would be responsible for the markings and speed limit signs.
Supervisor Myers moved to request the Engineering Department to look
into the matter; approved by unanimous voice vote.
IN RE:
SALEM/ROANOKE COUNTY CHAMBER OF COMMERCE
William S. Board, Exec. Vice President, informed the Board of a
report which has been compiled by the Chamber relating to the matter of a

joint venture of Roanoke Valley to attract industry to the area.
Robert A. Craighead, submitted the report and explained that primary
cause of a growing scarcity of good potential industrial sites in Roanoke Count
is attributed to the following: (1) the extensive number of sites occupied
by new industrial facilities during the late forties, fifties, and sixties;

(2) the effect of the severe flood of 1972 and resulting flood plain regula-
tions and (3) the number of potential industrial sites in the County that
have been developed for other than industrial purposes in the past thirty

five year period since the end of World War II. Mr. Craighead further explaine
they had investigated the County's industrial site potential.
He submitted
the report "Potential Industrial Sites in Roanoke County, Virginia."
It was suggested to the Board that area Chambers for Roanoke and
Botetourt Counties, the Cities of Roanoke and Salem and the Town of Vinton
be represented to form a committee to promote the area for potential industry.
Chairman Terry stated he had discussed this venture with some
Roanoke City officials and they had expressed their desire to join with the
County in such a venture.
Supervisor Johnson read aloud a resolution prepared for consideration
which establishes a Fact Finding Commission of members to institute a program
of joint economic development to attract industry to the area.
Supervisor Johnson moved to adopt the resolution as prepared and if

other local governments wish to join this project, the resolution would be
amended to reflect their joinder.
RESOLUTION NO. 2693 PROVIDING FOR THE ESTABLISHMENT OF A
ROANOKE VALLEY INDUSTRIAL FACT FINDING COMMISSION, APPOINTMENT
OF COMMISSION MEMBERS, ITS POWERS AND DUTIES.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That the fullest economic development for the benefit of the
entire Roanoke Valley requires a coordinated and unified effort on the
part of each of the local governments having jurisdiction in the Valley;
and
2. That the Board does hereby concur in principal with the immediate
institution of a program of joint economic development to attract to the

Roanoke Valley businesses and industries not presently located in the
Valley; and
3. That the Board does generally concur in the concept to provide
for the creation and establishment of a Roanoke Valley Industrial Fact
Finding Commission, which Commission shall consider:

(a) Acquisition, development and marketing of a joint
industrial park or parks with site and financing to be considered
at a later date by the appropriate governing bodies;
(b) Establishment and structure of an appropriate agency
to provide for such agreed upon joint economic development, and the
powers and duties to be delegated to said agency; and
(c) Such other matters of economic concern as may appear
relevant to said agency; and
4. That the membership of said Fact Finding Commission shall
consist of five persons appointed by the Council of the City of Roanoke
and five persons appointed by the Roanoke County Board of Supervisors.
In addition, the City Manager and County Administrator, an officer from
the planning or economic development departments of each local government
to be designated by their respective chief administrative officer and a
member of each Chamber of Commerce to be designated by the appropriate
governing body shall be ex officio members of the Commission; and
5. That an invitation to the City of Salem and the Town of Vinton
to participate in said Fact Finding Commision and any such hereinafter
established joint economic development agency should be considered; and
6. That the County Clerk is directed to forward an attested copy
of this resolution to the Clerk of the City of Roanoke.

REPORTS OF DEPARTMENTS, OFFICERS AND COMMITTEES
COUNTY ADMINISTRATOR
William F. Clark, County Administrator, submitted for information
only, the August Departmental Activities Report; received and filed.
IN RE:
COUNTY PURCHASING
Administrator Clark submitted a report County Purchasing which
suggests that since State legislature has amended the limitation on purchases
requiring governing body approval to $10,000, that the County modify its
existing policy regarding purchases in excess of $5,000 be approved by the
Board rather than the current amount of $2,500.
Supervisor Myers asked if the bids would still be received as in the

past if this policy was adopted, and he was informed they would. He stated
that he felt the present policy should not be changed.
Supervisor Park moved to retain the present policy relating to

purchases; adopted by unanimous voice vote.
IN RE:
REFERRALS TO PLANNING CO~1ISSION
Administrator Clark submitted for information only, the report of
rezoning's which have been filed and referred to the Planning Commission
since the last meeting.
IN RE:
WATER AND SEWER CONNECTION FEES
Administrator Clark advised that two developers have approached the
County in regard to connection fees for new businesses. Since the County
does not have a definite plan for such fees, these particular requests would
need to be decided by the Board.

T. L. Plunkett, was recognized by Chairman Terry who explained that
he represents a client who desires to install a four-bay car wash at his
present location whereby he is now operating a used car sales. The water is
already on the property and there is no problem with the zoning. Mr. Plunkett
stated that in view of the water being already there, that his client be allowe
to operate without any additional water fees, except for user's fee.
Supervisor Matthews moved to allow the client to construct the four--
bay car wash and later when fees are established, be charged according to
square footage.
Supervisor Johnson made a substitute motion that the matter be
delayed until the first meeting in November in order that a fence be installed
to shield the view of the lot from nearby property owners, which was not
erected previously to their satisfaction.

Mike Smeltzer, Attorney, who represented H. Lawrence Rice, was
recognized by Chairman Terry. Mr. Smeltzer informed the Board that Mr. Rice
has a new building on Brambleton Avenue and is now operating Dove Florist
and office space in that building. It is now his desire to install a laundro-
mat and would request the Board to allow them to begin operation and when the
County establishes a fee scale that fee would be paid providing, it is in line
with surrounding area rates. Dr. Rice & Mr. Smeltzer both stated that should
the fee be in the neighborhood of $10,000 then, they will not pay the fee but
will terminate operation and remove the laundromat.
Supervisor Johnson moved to allow Dr. Rice to begin operation of the
laundromat and pay the connection fee when County establishes the rate; adopted
by the following recorded vote.

EXECUTIVE SESSION
Administrator Clark requested an Executive Session at the end of the
meeting to discuss legal and real estate matters.

end of the meeting to discuss pending and potential litigation.

DIRECTOR OF FINANCE
John Chambliss, Director of Finance, submitted for information only,
the Accounts Paid report for the month of September; received and filed.
IN RE:
COMMISSIONER OF REVENUE
Wayne Compton, Commissioner of Revenue, submitted a report 1981 PERSO~ ~L
PROPERTY which sets out the scheduled work-load in the Commissioner's office
for the year 1981. He stated a one-time charge for printed forms and materials
will be incurred amounting to $36,050.00 half of which the State will fund. In
order to apply for the State funds, this amount must be included in the
Commissioner's budget, therefore, he asked the Board's concurrence for
appropriating this amount.

SHERIFF'S DEPARTMENT
A report was submitted by Capt. Kavanaugh reminding the Board that
funds were appropriated previously to convert the old PBX Telephone equipment
room into a lunchroom and toilet area for use by personnel of the Communication

center. Engineering designs for this project were inadequate and it is now
necessary to install other water lines to meet Building Code specifications.
An additional $2,822 is needed to complete this project.

IN RE:
ENGINEER
REQUEST FOR AN EASEMENT ON THE NORTH 11 PROPERTY ALONG BARRENS ROAD
Gene Robertson, County Engineer, informed the Board that Roanoke
Gas Company requests an easement along Barrens Road in order to serve the new
proposed fire station on the North 11 site and a prepared resolution with

description was submitted for consideration.
RESOLUTION NO. 2696 AUTHORIZING THE COUNTY OF
ROANOKE TO EXECUTE A CERTAIN DEED OF EASEMENT
GRANTING ROANOKE GAS COMPANY AN EASill1ENT ACROSS
THE COUNTY'S NORTH 11 PROPERTY.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That the County of Roanoke be, and it hereby is authorized
to grant a gas line easement to Roanoke Gas Company across the County's
North 11 property; said easement being 10.64 feet in width and running
along the northwest property boundary of the North 11 site along Barrens
Road, N. W. (Virginia Route 1832) and being more particularly described
on a plat prepared by D. J. Dorn of date September 10, 1980 and as
I
revised October 6, 1980 and being more particularly described in a
deed of easement to be recorded in the Clerk's Office of the Circuit
Court of the County of Roanoke; provided however, that the County of
Roanoke shall incur no financial liability as a result of its execution
of said deed of easement, and said deed of easement to be otherwise
approved as to form by the County Attorney; and
2. That the Chairman of this Board be, and he hereby is authorized
and directed to execute the aforesaid deed of easement on behalf of the
County of Roanoke.

PETITION TO HAVE BABE LOUIS ROAD IN THE BON SACK AREA RENAMED
BON SACK ROAD
A report and petition was submitted to the Board requesting that
Babe Louis Road in the Bonsack area be renamed Bonsack Road. 100% property
owners affected signed the petition for this request and several were in
attendance.

RESOLUTION NO. 2697 CllANGING THE NAME OF BABE LOUIS ROAD IN
THE BON SACK AREA OF THE COUNTY TO BON SACK ROAD.
WHEREAS, the property owners abutting Babe Louis Road in the Bonsack
area of Roanoke County have petitioned the County Engineer to have this

road renamed Bonsack Road; and
WHEREAS, pursuant to Section 15.1-379 of the Code of Virginia, as
amended, the governing body of any county may, by resolution duly
adopted, name streets, roads and alleys therein, outside the corporate
limits of towns, except for those primary highways conforming to Section
33.1-12 of the Code of Virginia, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of
Roanoke County that Babe Louis Road located in the Bonsack area of
Roanoke County be, and hereby is officially renamed Bonsack Road.

the highway system. Section 2 of Cherokee Hills Subdivision is located off
Virginia Secondary Route F-068, Frontage Road in the Catawba Magisterial
District.

RESOLUTION NO. 2701 AUTHORIZING THE COUNTY OF ROANOKE TO
ENTER INTO A CONTRACT FOR EXTERMINATION SERVICES FOR PEST
CONTROL AT VARIOUS COUNTY LOCATIONS.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, as
follows:
1. That the County of Roanoke be, and it hereby is authorized and
directed to enter into a two-year contract with Terminix for a total
cost of $3,792.00 for extermination services for pest control at various
County locations; all the terms, conditions and provisions to be more
fully set out in the contract; and
2. That the County Administrator be, and he hereby is authorized

and directed to execute, upon a form approved by the County Attorney,
this contract on behalf of the County of Roanoke.

GRIEVANCE PANEL MEMBERS
Supervisor Johnson stated that Thomas W. Mason, Alternate member of
the Grievance Panel, has moved from the Cave Spring District and she does not
have a replacement for the Cave Spring District.
On motion of Supervisor Park and a unanimous voice vote of the

members present, Charles L. Jennings, 1112 Jeanette Avenue, Vinton, Virginia,
was reappointed for a two year term as alternate Grievance Panel member
beginning Sept. 10, 1980 and ending Sept. 10, 1982.

INDUSTRIAL DEVELOPMENT AUTHORITY - APPOIN~IENT
Supervisor Myers stated that he does not have a candidate for
appointment to the Authority from the Catawba District.
IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Myers requested the County Attorney to review the
Ordinance covering banners and streamers which some businesses use to
advertise special sales, etc. Some businesses feel this should not be
included in the Ordinance and that the time limit for using these streamers
be 15 to 30 days.
Supervisor Johnson submitted a petition from residents of Parkwood
Drive requesting that street lights and a fire hydrant be installed. The
petition was turned over to the County Administrator for follow-up.

At 9:05 p.m. Supervisor Johnson moved to go into Executive Session
for the reasons heretofore in these minutes set-forth; approved by unanimous

ROANOKE COUNTY PAY PLAN
The following resolution was adopted to clarify a portion of the
County pay plan.
RESOLUTION NO. 2702 CLARIFYING THE INTENT OF THE BOARD OF
SUPERVISORS OF ROANOKE COUNTY IN RELATION TO THE SECOND SENTENCE
CONTAINED IN SECTION 2, PROMOTIONS, CHAPTER III OF THE ROANOKE
COUNTY PAY PLAN.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That the intent of the second sentence of Section 2, Promotions,
Chapter III of the Roanoke County Pay Plan which reads as follows, to-
wit:

"In the case of overlapping ranges, the promoted employee shall be
increased to the step immediately above the present salary."
has been since the adoption of such pay plan intended to mean that
promoted employees who are promoted into a range the pay steps of which
overlap with the range from which promoted shall receive no more than a

one step salary increase above the salary such promoted employee was
receiving on the date immediately preceding the date of promotion; and
2. That in order to remove any question relating to the appropriate
interpretation of the above set out provision same is repealed and re-
enacted to read and provide as follows:
"In the case of overlapping ranges, the promoted employee shall be
placed in the step in the grade to which promoted which represents
the equivalent of no more than a one step pay increase above the
salary such promoted employee was receiving on the date immediately
preceding the date of promotion. Provided however, in cases of
exceptional merit, duly authenticated, the Board of Supervisors
reserves the right to grant to such promoted employee a greater
salary increase than herein above set forth."

RE-ELECTION OF CERTAIN MEMBERS OF THE BOARD OF SUPERVISORS
RESOLUTION NO. 2703 EXPRESSING THE POSITION OF THE BOARD OF
SUPERVISORS ON THE ELECTION OF CERTAIN MEMBERS OF THIS BOARD
RESULTING FROM REAPPORTIONMENT OR CHANGES IN MAGISTERIAL
DISTRICT LINES NECESSITATED BY THE 1980 DICENNIAL CENSUS AS
MADE AND PROVIDED BY LAW.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That it is the position of the Board that any member of the
Board of Supervisors elected to a four-year term for the period commencing
January 1, 1980 through December 31, 1983 should not be required to seek
reelection during such four-year term as a result of the reapportionment
of magisterial districts or a change in magisterial district lines
I
resulting from the 1980 dicennial census; and
2. That in the event that the law of the Commonwealth requires
such members of the Board of Supervisors to stand for reelection during
such four-year period in order to complete the term for which elected on
November 6, 1979, same should be amended and reenacted to remove such
requirement therefrom; and
