The Board of County Supervisors of Roanoke County, Virginia, met this
day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia
this being the fourth Tuesday and the second regular meeting of the month of
October.
Members present: Chairman Lawrence E. Terry, Vice Chairman Edward
C. Park, Jr., and Supervisors May W. Johnson, Robert E. Myers and Paul B.
Matthews.

Chairman Terry called the meeting to order at 7:00 p.m.

Pledge of Allegiance to the Flag was recited in unison.

stated that since this request was heard at the meeting October 14th, Herbert
Bowling who originally opposed the request, is no longer in opposition. He
further stated he had a letter, which he read aloud, from Mr. and Mrs. Jerry
Custer who object to the placement of this trailer on said property. There
were no others present in opposition to this request. Supervisor Johnson
stated she viewed the area and there are 5 other trailers in the area.

IN RE:
RESOLUTION # 25345 ADOPTED BY THE CITY OF ROANOKE REGARDING A
JOINT ROANOKE VALLEY INDUSTRIAL FACT FINDING COMMISSION
This resolution regarding the newly created Fact Finding Commission
to attract new businesses and industry to Roanoke was received in file on
motion of Supervisor Johnson and a unanimous voice vote of the other members
present.

REPORT - HIDDEN VALLEY COURT, SECTION 3 -- ACCEPTANCE OF
DEED FOR WATER AND SEWER LINES
RESOLUTION NO. 2704 ACCEPTING THE DONATION OF WATER AND
SEWER LINES INSTALLED WITH THE DEVELOPMENT OF HIDDEN VALLEY
COURT, SECTION 3, AND AUTHORIZING THE COUNTY ADMINISTRATOR TO
DULY AUTHENTICATE SUCH ACCEPTANCE AS MADE AND PROVIDED BY LAW.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That the offer of Ernmel Development Corporation to donate the
water and sewer lines installed with the development of Hidden Valley
Court, Section 3, to the Board of Supervisors of Roanoke County be, and
it hereby is accepted; and
2. That upon receipt of a duly executed deed, upon a form approved
by the County Attorney, from Ernmel Development Corporation conveying
the hereinabove mentioned water and sewer lines to the Board of Supervisors
of Roanoke County, the County Administrator is hereby authorized to
authenticate the acceptance thereof, as made and provided by Section
15.1-286 of the Code of Virginia, 1950, as amended.

RESOLUTION NO. 2705 ACCEPTING THE DONATION OF WATER

1. That the offer of TMJ Partnership to donate the water and sewer lines
installed with the development of the Timberview Subdivision in Roanoke County
to the Board of Supervisors of Roanoke County be, and it hereby is accepted; an

REQUEST OF W. P. WALLACE TO WAIVE COUNTY SEWER ORDINANCE
RESOLUTION NO. 2706 WAIVING CERTAIN REQUIREMENTS OF THE
ROANOKE COUNTY SEWER RULES AND REGULATIONS IN REGARD TO
CERTAIN PROPERTY.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That the Board hereby waives the requirements of the Roanoke
County sewer rules and regulations relating to the requirement that
properties which adjoin streets in which are located public sewer must
connect to said sewer, as it pertains only to the right to provide sewer
service to Lots 2, 3, 4, and 5 in the proposed Castle Rock West Subdivision;
this waiver being based upon a demonstration by the property owner that
strict compliance with the provisions of such rules and regulations
would impose an undue hardship and burden upon the property owner, the
construction standards set forth in said rules and regulations do,
however, remain in full force and effect; and

2. That this Board shall authorize no further waiver unless and
until it has been demonstrated to this Board that the failure to grant
such waiver shall create an undue hardship upon the property owners.

APPALACHIAN POWER COMPANY REQUEST FOR POWER EASEMENT
ACROSS BROOKLAWN WELL LOT
RESOLUTION NO. 2707 AUTHORIZING THE COUNTY OF ROANOKE TO
EXECUTE A DEED OF EASEMENT GRANTING APPALACHIAN POWER COMPANY
AN EASE}lENT ACROSS THE COUNTY'S BROOKLAWN WELL LOT.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That the County of Roanoke be, and it hereby is authorized to
grant an easement allowing a power line to overhang the well lot of
Brooklawn Well No.3; provided however, that the County of Roanoke shall

incur no financial liability as a result of its execution of this deed
of easement, and this deed of easement to be otherwise approved as to
form by the County Attorney; and
2. That the Chairman of this Board be, and he hereby is authorized
and directed to execute the aforesaid deed of easement on behalf of the
County of Roanoke.

THE U. S. NAVAL AND MARINE CORPS RESERVE CENTER FOR THE DEPARTIIENT
OF PARKS AND RECREATION; AND PROVIDING FOR EXTENSION THEREOF
UPON CERTAIN TER}1S AND CONDITIONS.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That a certain lease agreement between the United States of
America Department of the Navy and the County of Roanoke, said lease
providing for the rental by the County of Classrooms I and 2 and drill
hall athletic areas of the U. S. Naval and Marine Corps Reserve Center

located at 5301 Barns Avenue, N. W., Roanoke, Virginia, for use by the
Department of Parks and Recreation for a period of one year beginning
November 15, 1980 and ending November 14, 1981 according to the terms
and conditions contained in said lease agreement; provided however, the

County Administrator is hereby authorized to extend the said lease from
year to year after the termination of the initial term set out herein
upon the same terms and conditions set out in the original lease upon
the Board's appropriation of funds for such rent from year to year; and
2. That supervisory personnel for the building leased from the
Reserve Center will be paid at the rate set for building supervisors;
and
3. That the County Administrator be, and he is hereby authorized
and directed to execute said

County Administrator Clark requested an Executive session at the end
of the meeting to discuss legal matters.
IN RE:
FIRE STATION BIDS
Mr. Dan Bolt of VVKR Partnership was present and informed the Board
that bids were received on Thursday, October 23, for construction of the North
11 and Fort Lewis Fire stations and recommended that a contract be awarded to
Thor, Inc. for both projects. A letter of recommendation is filed with the
minutes of the meeting.
RESOLUTION NO. 2709 ACCEPTING A CERTAIN BID MADE TO THE
COUNTY OF ROANOKE FOR CONSTRUCTION OF CERTAIN FIRE STATIONS IN
ROANOKE COUNTY UPON CERTAIN TERMS AND CONDITIONS.

At this point Supervisor Myers asked if there was a time limit for
completion of the fire stations construction. He was informed that the contrac
did state "time is of the essence." County Attorney James Buchholt<!: -explaine
to the Board what "time is of the essence" in a contract implies. Supervisol!
Myers then stated he would like the County Attorney to look at all future
contracts for construction to allow the County some recourse of action if
projects are not completed on time. Mr. Myers further stated he would like a
letter from Thor Company whereby they understand the time limit and are aware
of possible action by the County if not completed on time.

enter into a contract with Cott Indexing Company of Columbus, Ohio for a

IN RE: RESOLUTION NO. 2713 ACCEPTING A CERTAIN BID MADE TO THE
COUNTY OF ROANOKE FOR THE PURCHASE OF BULLET PROOF VESTS FOR
THE ROANOKE COUNTY SHERIFF'S DEPARTMENT.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That that certain bid of Hub Uniform Company for the purchase
of thirty (30) bullet proof vests at $162.50 each for a total cost of
$4~875.00 for use by the Roanoke County Sheriff's Department be~'and the I
same hereby is ACCEPTED~ upon all and singular the terms and condi'tions
of the invitation to bid~ the specifications of the County of Roanoke~
the bidder's proposal and the provisions of this resolution; and
2. That the County Administrator be~ and he hereby is authorized
and directed to execute the necessary documents for this purchase; upon a

BE USED WITH EXISTING EMS ADVANCED LIFE SUPPORT EQUIPMENT.

1. That the purchase of one Motorola Q02034 Mem Com Mobile Radio
at an estimated cost of $7~200.00 and the purchase of one Apcor SP
587108199 Portable Radio at an estimated cost of $5~800.00 from ~10torola
Communications to be used with existing EMS Advanced Life Support Equipment
be~ and hereby is approved; and
2. That the County Administrator be~ and he hereby is authorized
and directed to execute the necessary documents for the purchase of this
equipment~ upon a form approved by the County Attorney.

Bob Monroe, Fire & Rescue Coordinator, informed the Board that the
above mentioned equipment is EMS advanced life support equipment slotted for
Clearbrook Rescue #7 which does not have this life support equipment presently
I
and is much needed at that location.
Supervisor Johnson stated that some radio equipment is available for
purchase from the State and that it might be advantageous to purchase some of
the radios. Administrator Clark informed Mrs. Johnson that we have authorized
purchase of some of this equipment previously.
IN RE:
ROAD IMPROVEMENTS
Gene Robertson, County Engineer, informed the Board that this is
a 70/30 project and a bid from S. R. Draper covers the three streets in
question as a lump sum bid. In the event citizens from Mountain Heights Drive
do not pay their share to the County by November 7th then, a contract for

Dorset Drive and North Garden Lane only must be obtained. A fee of $612.00
which covers the Maintenance donation fee and bond required by the State
Highway Department is not reflected in the total figure.
RESOLUTION NO. 2715 ACCEPTING A CERTAIN BID MADE TO THE
COUNTY OF ROANOKE FOR ROAD IMPROVEMENTS TO CERTAIN COUNTY

BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That the bid of S. R. Draper Company in the amount of $57,263.00
for road improvements, seventy percent to be paid from County funds and
thirty percent to be paid by citizens who own property along these
roads, be accepted contingent upon the County Engineer receiving the
citizens' contributions, as follows:

BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:

That the County of Roanoke be, and it hereby is authorized' to
renew a contract with Hall and McChesney, Inc. for a one year period
commencing July 1, 1980 and ending June 30, 1981, for microfilming of
records in the Circuit Court Clerk's Office for the approximate amount
of $12,000.00; and
2. That the County Administrator be, and he hereby is authorized
and directed to execute, upon a form approved by the County Attorney,
this contract on behalf of the County of Roanoke.

1. That the purchase of framed art reproductions at a price of
$7,617.00 from the New York Graphic Society Southern Furniture Market
Center of High Point, North Carolina, to be kept at the various Roanoke
County Libraries for use by Roanoke County citizens be, and hereby is
approved; and
2. That the County Administrator be, and he hereby is authorized
and directed to execute the necessary documents for the purchase of
these framed art reproductions, upon a form approved by the County
Attorney.

ORDINANCE NO. 2719 PROVIDING FOR THE CONDEMNATION OF A
CERTAIN EASEMENT IN ROANOKE COUNTY TO PROVIDE ACCESS TO
WILLIAM BYRD WELL LOT #3.
WHEREAS, the Board of Supervisors of Roanoke County is in need of a
certain well lot and access thereto in order to expand the Roanoke
County water system; and that the needed well lot is commonly referred
to as William Byrd Well Lot #3 which is shown on a plat prepared for
Tempo Homes, Inc., the alleged owner of the property in question, prepared
by Buford T. Lumsden Associates dated February 7, 1980; and being more
particularly described as follows:
S 590 20' 47" W 39.16 feet to a point, thence N 180 56' 25" W
112.56 feet to a point, thence N 710 03' 35" E 100 feet to a
point, thence S 130 56' 25" E 114.61 feet to a point, thence
S 710 03' 35" W 61. 66 feet to the point of beginning; and
I
that the County of Roanoke has entered into an option for purchase agreement
for the above described well lot with the owner of the property described
above; and
WHEREAS, the parties to the option for purchase agreement have not
been able to agree on access to the above described William Byrd Well
Lot #3. The access proposed by Roanoke County is described as follows:

A 20 foot easement beginning at a point on the southeast
corner of Lot 10 on a plat prepared for Tempo Homes, Inc. by
Buford T. Lumsden Associates, February 7, 1980, thence N 180
56' 25" E 146.21 feet to a point, thence S 710 03' 35" W to a
point on the north lot line of Lot 8, thence N 130 56' 25" E
20 feet to a point, thence N 710 03' 35" E to a point, thence
S 180 56' 25" E 166.21 feet, containing 7,513 square feet.

NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of
Roanoke County that the County Administrator is hereby authorized and
directed to offer the owner of the property over which the proposed
easement is to run; an amount for this easement not to exceed $1,382.00
as specified in an appraisal dated September 17, 1980, prepared for
Roanoke County by Earl G. Robertson; and further upon delivery of a deed
acceptable to the County Attorney, the Treasurer of Roanoke County is
authorized to release his draft in an amount not to exceed that specified
herein to the present owner of the property. Should the property owner

not accept the County's offer as specified herein, the County Attorney

is authorized to institute and conduct condemnation proceedings and in
so doing is authorized to make a motion on behalf of the County for

entry of an order pursuant to ~ 25-46.8 of the Code of Virginia, 1950,
as amended, granting to the County a right of entry for the purpose of
commencing its project on the property to be condemned. The County
Treasurer, upon request of the County Attorney, shall be authorized to
draw and pay unto the Clerk of the Circuit Court of Roanoke County the
sum which has been offered to the property owner; and
BE IT FURTHER ORDAINED that the Board of Supervisors, having found
that an emergency situation exists with regard to the acquisition of the
easement referred to herein, exercises its option to adopt this ordinance
as an emergency ordinance pursuant to Virginia Code Section 15.1-504 and
that this ordiance will be in full force and effect immediately upon its
passage by the Board; and
BE IT FURTHER ORDAINED that the Clerk of the Board is directed to

mail a copy of this ordinance to the property owner whose property is
the subject of this ordinance.

EXECUTIVE SESSION
Supervisor Johnson moved to go into Executive session at 8:00 p.m.
Administrator Clark informed the Board that matters to be discussed
in Executive session did not require immediate action and if the Board so
desired they might forego the Executive session for this meeting.
Chairman Terry publicly thanked Supervisor Paul Matthews for serving
in the capacity of Supervisor representing the Hollins District and stated
that after the election November 4th, a new supervisor would be on the Board
from that District.
