The Board of County Supervisors of Roanoke County, Virginia, met

this day in open session at the Salem-Roanoke County Civic Center in Salem,
Virginia, this being the second Tuesday and the first regular meeting of
the month of August.
Members Present: Chairman Lawrence E. Terry, Supervisors Robert
E. Myers and Paul B. Matthews.
Members Absent: Supervisors Edward C. Park Jr. and May W. Johnson.

CALL TO ORDER
Chairman Terry called the meeting to order at 6:00 p. m. and
Supervisor Myers immediately moved to go into Executive session to discuss
real estate, legal and personnel matters, which was approved by unanimous

voice vote.

On motion of Supervisor Matthews and a unanimous voice vote, the

IN RE:
HEARING OF CITIZENS
William F. Clark, County Administrator, reported to the Board
I
on a meeting with Mr. Webster and other Appalachian Power Company officials,
as requested by the Board at the July 22nd meeting. He stated that engineers
are making a circuit study but have found no troubles to date. There is
also a plan to make a couple of fusing points to divide the circuit and
possibly isolate outages but this would not help the situation if the main
line is affected. A letter from Appalachian to Mr. Freeman, a citizen of
the area, is to be mailed in the next few days.
Several residents of the North Beverly Heights area were present
to again discuss the continuing problem of power outages for their subdivisiou
and bring up-to-date information to the Board on recent meetings and
conversations with Appalachian Power Company personnel.
Supervisor Myers suggested to Mr. Freeman and the area residents,
that if the aforementioned letter did not contain satisfactory explanations,

then they should contact the State Corporation Commission with their problem.

1. That the County of Roanoke bet and it is hereby authorized to
enter into a certain sewer participation agreement with Branfour LTDt
Partnershipt for extension of a sewer line from the existing County
line to the Branch property; this agreement calling for an estimated
cost to the County of $32t233.40 plus a fifteen (15%) percent contingency

liability as a result of its entry into said easement agreement, and
said easement agreement to be otherwise approved as to from by the
County Attorney.

Administrator William F. Clark informed the Board of the above
prepared resolution to enter into said contract whereby the County will
acquire a sewer line which traverses the property of Josephine and George
Ellis; upon approval as to the form of agreement by the County Attorney,
said agreement shall be executed by the Administrator.

REQUEST OF W. H. REED FOR WAIVER OF COUNTY SEWER ORDINANCE * APPROVE
RESOLUTION NO. 2643 WAIVING CERTAIN REQUIREMENTS OF THE
ROANOKE COUNTY SEWER RULES AND REGULATIONS IN REGARD TO
CERTAIN PROPERTY.

BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows:
1. That the Board hereby waives the requirements of the Roanoke County
sewer rules and regulations relating to the requirement that properties which
adjoin streets in which are located public sewer must connect to said sewer,
as it pertains only to the right to provide sewer service in regard to approxi
mately 7 acres situate, lying and being on Woodhaven Road adjacent to North
Lakes Subdivision, this waiver being based upon a demonstration by the propert
owner that strict compliance with the provisions of such rules and regulations
would impose an undue hardship and burden upon the property owner, the constru -
tion standards set forth in said rules and regulations to, however, remain in
full force and effect; and
2. That this Board shall authorize no further waiver unless and until
I
it has been demonstrated to this Board that the failure to grant such waiver
shall create an undue hardship upon the property owners.

IN RE:
COUNTY ATTORNEY
County Attorney James Buchholtz requested an Executive session
at the end of the meeting to discuss pending and potential litigation.
IN RE:
DIRECTOR OF FINANCE
Les Johnson, Assistant Director of Finance, submitted a report
of Accounts Paid for the months of June and July which were received in file.
Mr. Johnson informed the Board of a request from the Roanoke Valley
Council of Community Services, Inc. for the County to act as agency for the
local match required by a grant from the State Welfare Department. 7here
would be no expense to the County since the funds are 100% reimbursable.
RESOLUTION NO. 2644 AUTHORIZING THE COUNTY OF ROANOKE TO
ACT AS A FISCAL AGENT FOR THE ROANOKE VALLEY COUNCIL OF COMMUNITY
SERVICES, INC.
BE IT RESOLVED by the Board of Supervisors of Roanoke Ccunty as
follows:
1. That the County of Roanoke be, and it is hereby authorized to
serve as the fiscal agent for the Roanoke Valley Council of Community
Services, Inc., and in so doing act as pass-through agency for the local
match of this agency required by a grant from the State Welfare Department;
and
2. That the County Administrator be, and he is hereby directed to
execute, upon a form approved by the County Attorney, a donor agreement
between Roanoke County and the Virginia Department of Welfare specifying
that Roanoke County will pass-through unto the State Welfare Department
a donation of $7,498.77, which amount represents the local share provided
by the Roanoke Valley Council of Community Services, Inc. and which
amount will pass-through the County of Roanoke to the State Welfare
Department.

Mr. Johnson further informed the Board of a necessity to establish
Petty Cash funds for three departments which routinely purchase small items,
such as stamps, etc. in order to eliminate writing small checks frequently.

RESOLUTION NO. 2646 AUTHORIZING THE ESTABLISHMENT OF PETTY
CASH ACCOUNTS.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That the following petty cash accounts be established: County
Administrator -$50.00, Purchasing - $50.00, Utility Operations and
Maintenance -$100.00; and
2. That these accounts will be periodically reimbursed through the
normal check-writing process of Accounting and will be subject to audit
by the Department of Finance and the County's independent auditors.
3. This action requires no new outlay of monies and may be revoked
at the direction of the Board of Supervisors.

AWARDING SALE OF $8,500,000 BONDS
James Buchholtz, County Attorney, informed the Board it would not
be necessary to act on this item since approval of the minutes for the
recessed meeting is sufficient.

RESOLUTION NO. 2647 AUTHORIZING THE COUNTY OF ROANOKE TO RENEW
THE PRESENT AIR CONDITIONING AND HEATING CONTRACT WITH MECHANICAL
MAINTENANCE, INC. OF ROANOKE, VIRGINIA.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as
follows:
1. That the County of Roanoke be, and it is hereby authorized to
renew the present air conditioning and heating contract with Mechanical
Maintenance, Inc. of Roanoke, Virginia, for a period of one year beginning
September 1, 1980 and ending August 31, 1981, for a total contract sum of
$3,252.00, upon all and singular the terms, conditions and provisions to
be more fully set out in said contract; and
2. That the County Administrator be, and he is hereby directed to
execute, upon form approved by the County Attorney, said contract on
behalf of the County of Roanoke.

UTILITY DEPARTMENT UPON CERTAIN TERMS AND CONDITIONS AND AUTHORIZING
THE COUNTY ADMINISTRATOR TO EXECUTE SAID CONTRACT ON BEHALF OF THE
COUNTY OF ROANOKE
BE IT RESOLVED by the Board of Supervisors of Roanoke County as

1. That the County of Roanoke be, and it is hereby authorized to
enter into a one year contract for the purchase of approximately seven
hundred twenty (720) water meters at a unit price of $26.50 each, upon
all and singular the terms, conditions and provisions to be more fully
set out in said contract; and

Mike Turner, Purchasing Supervisor, informed the Board of a bid
received for printing tax mailers to be used in the Treasurer's office and
requested the Board's approval for this bid.
RESOLUTION NO. 2649 ACCEPTING A CERTAIN BID MADE TO THE
COUNTY OF ROANOKE FOR THE PRINTING OF TAX MAILERS TO BE USED
IN THE TREASURER'S OFFICE UPON CERTAIN TERMS AND CONDITIONS
AND AUTHORIZING AND DIRECTING THE COUNTY ADMINISTRATOR TO
ENTER INTO A CONTRACT WITH THE SUCCESSFUL BIDDER.
Virginia, for the printing of tax mailers to be used in the Treasurer's
Office for the collection of real estate and personal property taxes, in
the amount of $6,088.50, upon all and singular the terms and conditions
of the invitation to bid, the specifications of the County of Roanoke,
Virginia, the bidder's proposal and the provisions of this resolution,
be, and the same is hereby APPROVED; and
2. That the County Administrator be, and he hereby is authorized
and directed to enter into a contract with Dominion Business Forms for
this purpose; and
3. That all other bids for said project are hereby REJECTED and
the County Clerk is directed to so notify such bidders and express the

County's appreciation for such bids.

IN RE: COUNTY ENGINEER
RESOLUTION NO. 2650 DESIGNATING THE COUNTY ENGINEER
AS ROAD VIEWER FOR THE PROPOSED ESTABLISHMENT OF A
NEW ROAD.
On application of the below named petitioner:
I
(1) Benjamin H. Bohon, et ux., et al. - Request for
a new road extending Route 670 0.25 mile - 40
foot right of way in Windsor Hills Magisterial
District.
who has filed a request for inclusion in the Secondary Highway System of Roano e
County.
This Board of County Supervisors orders that the County Engineer view the
grounds and report to this Board the convenience and inconvenience that will
result to individuals as well as the public if such road shall be opened to
the public and especially whether any yard, garden, orchard, or any part
thereof will in such cases have to be taken and that no road or landings
shall be established on or through the lands of any cemetery or through
the lands of any seminary of learning without the consent of the owners
thereof; and the said County Engineer shall also ascertain and report to
I
this Board whether the said road will be of such mere private convenience
as to make it proper that said road should be kept open and kept in order
by the person or persons for whose convenience they are desired. He shall
also assess and report what damages, if any, the landowners are entitled to
and accompany his report with a plat or diagram of said roads.
And it further ordered that the Clerk of this Board be, and hereby is
directed to notify the State Highway Commissioner of Virginia as to these
road proceedings. Notification may be given to the Resident Engineer of the
Department of Highways and Transportation of Virginia having supervision of
maintenance and construction of highways in Roanoke County.
And these proceedings are continued.

Chairman Terry asked Mr. Buchholtz if the County Engineer could,
by resolution, be designated as permanent Road Viewer for the County in order
to eliminate approval for each request. The County Attorney informed the
Board that it can be done and he would prepare a resolution to that effect
for a future meeting.

RESOLUTION NO. 2651 APPROVING CHANGE ORDER NO. 1 TO THE
COUNTY'S CONTRACT WITH OWENS PLUMBING AND HEATING FOR THE
INSTALLATION OF SEWER FACILITIES AT WALROND PARK AND
AUTHORIZING THE COUNTY ADMINISTRATOR TO EXECUTE SUCH CHANGE
ORDERS ON BEHALF OF THE COUNTY OF ROANOKE.
BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows:
1. That Change Order No.1 to the County's contract with Owens Plumbing
and Heating for the installation of sewer facilities at Walrond Park be, and
it is hereby approved as herein set forth in the following words and figures,
to-wit:

Mike Turner, Purchasing Supervisor, reminded the Board that at
the meeting July 22, 1980, the Board requested he check into the cost of
furniture which Judge Clemens requested for his office. A resolution of
$625.00 appropriating funds to cover the cost of furniture was presented
for approval.
