The Board of Supervisors of Roanoke County, Virginia, met this day in open

session at the Salem-Roanoke Valley Civic Center in Salem, Virginiat this being
the second Tuesday and the first regular meeting of the month.
MEMBERS PRESENI': Chairman May W. Johnson, Vice-Chairman E. Deal Tompkins,
R. Wayne Compton, C. Lawrence Dodson and Robert E. Myers.
Chairman Johnson called the meeting to order at 7:00 p.m. and recognized
Reverend Paul R. CCXJper, St. Paul's Lutheran Church, who offered the invocation.
The Pledge of Allegiance to the flag was given in unison.
On the motion of Supervisor Tompkins and the following recorded vote, the
minutes of the adjourned meeting of May 14, 1976 and the regular meeting of May
25, 1976 were approved as spread.

WHEREAS, the Board of Supervisors, on a petition filed by Frank Martin and
Larry C. Hartman, at its meeting held on April 27, 1976, referred to the Planning
Corrmission the matter of rezoning the hereinafter described property fran B-2 to
B-3 for the Plannings Ccmnis s ion , s report and recarmendation; and
WHEREAS, the Planning Conmission at a meeting held on May 18, 1976 after an
advertisement as required by law, fully considered the matter and reported to the
Board its reccmnendation that the property be rezoned as hereinabove set out; and

WHEREAS, a public hearing was held by the Board of Supervisors after advertisl -
ment as required by law and a full opportunity was accorded all persons to express
their views concerning the matter; and
WHEREAS, at the conclusion of said public hearing and after full consideratio
of the matter, this Board is of the opinion that the rezoning is proper and would

WHEREAS, the Plarming Ccmnission, by resolution adopted at its meeting held
on the 18th day of May, 1976, after hearing evidence touching on the merits of

said petition, recorrm::mded to this Board that the County Zoning Ordinance be
amended as to the property requested in said petition; and
WHEREAS, this Board, after giving careful consideration to said petition and
to the recorrmendation of the Plarming Ccmnission, and after hearing evidence
touching on the merits of said proposed amendment to the County Zoning Ordinances,
being of the opinion that the said Zoning Ordinances should be amended as recan-
mended by the Plarming Ccmnission.
NCW, THEREFORE, BE IT RESOLVED AND ORDERED that at this regular meeting of
the Board of Supervisors of Roanoke County, Virginia, held on the 8th day of June,
1976, the said Zoning Ordinances be, and the same hereby are amended so as to
reclassify the following property from "Business Space B-2" property to "Business

Supervisor Tompkins moved that the County Attorney be directed to prepare
the necessary papers to hold a public hearing on proposed increased charges for
weekly refuse collection service for cOI!Y!Brical operations.

I
A public hearing of the Board of Supervisors was this date held on the
adoption of the budget for the County of Roanoke for the fiscal year corrmencing
July 1, 1976.

Mr. Cabell Brand, President of TAP, appeared before the Board and stated the
organization's need for an increased contribution fran the County.
Ms. Cindy Trinkle, Director of Planned Parenthood, was present at the hearing
and requested a contribution from the County for the Agency.

Mr. John G. Seibel, resident of the Vinton District and representing a group
of citizens fran that area, objected to the County's proposed doubling of license
tax for autarobiles. The County Executive advised that there will be a public
hearing at a later date on this matter.
There being no further citizens wishing to speak on the proposed budget, this
concluded the public hearing.

1976-77 FISCAL YEAR BUDGET - INCREASED CONTRIBUTION TO TAP
Supervisor Tarrpkins moved that the proposed Roanoke County budget for fiscal
year 1976-77, Contributions to Service Organizations, be amended by increasing
the contribution to TAP fran $25,000 to $27,500.

tribution to Planned Parenthood in the amount of $2,000.

Chief Joe Young and Mount Pleasant Fire Chief Thanas E. Wagner be restored to the

proposed Roanoke County budget for fiscal year 1976-77, thus elinmating the pro-
posal to make these positions unpaid, with the understanding that future holders
of these positions are to be volunteers and not c:x::mpensated.

IN RE:
RESOLUTION NO. 1520 APPROVING THE ROANOKE COUNTY PAY PLAN FOR THE
1976-77 FISCAL YEAR.
WHEREAS, the Board of Supervisors of Roanoke County during its budget delib-
erations determined that the calssification and pay plan should be amended to
include a five percent cost of living increase for all County employees; and
WHEREAS, the Director of Finance has prepared a schedule reflecting said
five percent increase in all steps in the County's classification and pay plan, a
copy of said schedule being attached hereto as Exhibit "A"; which said schedule
the Board desires to approve.
NCW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County
that said anendments to the County's classification and pay plan reflecting a
five percent cost of living increase for County employees as shown on Exhibit "A"

attached hereto be, and the sane is hereby approved, the Director of Finance to
incorporate said changes into the County's classification and pay plan.

RESOLUTION NO. 1521 APPROVING ROANOKE VALLEY CABLEVISION, INC.' S
REQUEST FOR ORGANIZATIONAL CHANGES REIATING TO THE MANAGEMENT AND
OPERATION OF A CAW FRANCHISE IN ROANOKE COUNTY.
WHEREAS, the Board of Supervisors, by Ordinance No. 1178, approved the grant
ing of a CAW franchise for Roanoke County to Roanoke Valley Cablevision, Inc.
upon certain terms and conditions; and
WHEREAS, Roanoke Valley Cablevision, Inc. has, pursuant to Section 21 of the
franchise ordinance, requested the Board of Supervisors to approve certain organ-

izational changes in the management and operation of said CAW system; and
WHEREAS, the Board of Supervisors of Roanoke County is of opinion that said
request should be granted and that said changes should be approved.
NCW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County
that pursuant to Section 21 of Ordinance No. 1178 granting a CAW franchise to

Roanoke Valley Cablevision, Inc., the following organizational changes are hereby
approved by the Board of Supervisors:
(1) Cox Cable Communications, Inc. would surrender all of its stock in

Roanoke Valley Cablevision, Inc. The rermining stockholders in said corrpany woul
acquire said stock and becane the sole owners of the company.
(2) A limited partnership is approved to design, build, operate and manage
the CATV system on a day to day basis. Cox Cable Ccmnunications, Inc. is the
general partner. The limited partners are the individual stockholders in Roanoke
Valley Cablevision, Inc. Cox Cable Cornnunications, Inc. is to have an eighty per
cent equity in the partnership with the individual stockholders of Roanoke Valley
Cablevision, Inc. having a twenty percent equity in the partnership. The capital
required to build the system would be provided by the partners in proportion to
their equity.
(3) Roanoke Valley Cablevision, Inc. is to grant use of its franchise in

Roanoke County to the partnership. I
(4) Roamke Valley Cablevision, Inc. is to retain ownership of the franchi1
and the FCC certificate and is to remain entirely responsible to the Board of I
Supervisors for said system.
BE IT FURTHER RESOLVED that a certified copy of this resolution be transmitt
to Roanoke Valley Cablevision, Inc. and to Cox Cable Carmunications, Inc.

WHEREAS, the Board of Supervisors has heretofore purchased a forty-one acre

tract of land in the north County area with the express purpose of developing a
park for the residents of said area; and
WHEREAS, the Landscape Architecture Class at VPI & SU, as aprt of their
curriculum, agreed to prepare a master development plan for said park, which plan
was presented to the Board of Supervisors at its meeting held on May 11, 1976, by
members of said class; and

WHEREAS, the Board of Supervisors desires to recognize the valuable service
rendered by said class.
NCMT, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County
that said Board hereby recognizes and expresses its sincere appreciation for the

work of the Landscape Architecture Class at VPI & SU in preparing a master develop-
ment plan for the County's Tinker Knoll Park; said plan presenting several alter-
natives which may be utilized by the County in developing a park facility which
will be a source of pride for the citizens of the County.

SOIL SURVEY
The County Executive advised in a report to the Board, which is filed with
the minutes of this meeting, that the County received a corrmunication fran the
Soil Survey Coordinator for the Virginia Soil and Water Conservation Crnmission
indicating that Roanoke County is high on the list of localities being considered

for early implementation of a soil survey.
Supervisor Myers rroved that the matter regarding preparation of a soil class-
ification map for Roanoke County be tabled indefinitely.

IN RE:
ANNEXATION
The County Attorney notified the Board that the County's attorneys in the
annexation proceeding did on May 25, 1976 file a Motion to Reconvene the Court in
order to consider certain matters in which the City of Roanoke is failing to
comply with the terms and conditions of annexation.

IN RE:
MICROFIIMING ANNEXATION EXHIBITS
The County Attorney advised the Board that the annexation exhibits could be
microfilmed in order to allaN for more space in the Clerk of Circuit Court's
office. He advised that the exhibits are very large and take up a considerable
arrount of space, but scrne record of these exhibits should be kept.
The Supervisors requested the County Attorney to report back to the Board on
estimated cost of microfilming the annexation exhibits.

IN'ID THE ROANOKE COUNI'Y SOIL EROSION AND SEDLMENT CONTROL ORDINANCE
AND DECIARING AN EMERGENCY TO EXIST IN ORDER THAT THIS ORDINANCE MAY
TAKE EFFECT JUNE 8, 1976.
BE IT ORDAINED by the Board of Supervisors of Roanoke County that the follow
ing arrendrrents to the Roanoke County Code be, and they are hereby adopted:
CHAPTER 8.1
I
Soil Erosion and Sediment Control
Section 7. B. will be amended by the addition of a new sub-section numbered 11.
to read as follows:
11. Run-off calculations for the property in order to provide for proper
stonn water management.
Section 11. C. will be amended as follows:
C. The County Engineer shall approve any erosion and sediment control pro-
gram or site plan sul::mitted to him within a reasonable period of time not to
exceed forty-five days, consistent with the size of the proposed project.
Section 15. will be amended as follows:
Neither the approval of an erosion and sediment control plan under the provi
sions of this chapter, nor the canpliance with the conditions of such plan shall
be deemed to relieve any person from responsibility for damage to other persons 0]
property in cases where negligence is shown; provided that such approval shall n01
impose any liability on the County for damages to other persons or property.
This amendment to take effect on June 8, 1976.

BE IT FURTHER ORDAINED that pursuant to Section 15.1-504 of the Code of
Virginia, as amended, the Clerk of the Board is directed to publish this ordinancE
in the Roanoke World News, a newspaper having general circulation in Roanoke Count y ,
once a week for two consecutive weeks and that it be posted at the front door of
the Roanoke County Courthouse and that a copy be placed on file in the Clerk's
Office of the Circuit Court of Roanoke County and in the County Executive's OfficE.
BE IT FINALLY ORDAINED that this ordinance shall be in full force and effect
upon its passage.

Following a presentation made by the League of Wanen Voters on May 25, 1976
regarding appointment of and vacancies on the Roanoke County School Board, the
County Attorney advised that the Board of County Supervisors, under the County

Executive form of government, has the responsibility for appointment of School
Board members and may establish whatever procedures it feels are necessary to makE
such appointments.

RESOLUTION NO. 1526 ACCEPTING A GRANT FOR THE HIRING OF AN INTERN
IN THE OFFICE OF THE CCMMJNWF'-ALTH' S ATIDRNEY.
WHEREAS, the Board of Supervisors has been notified that a grant has been
approved for the hiring of an intern in the Commonwealth's Attorney's Office;
with the County to pay $52.92 in matching funds, which sum is included in the
present budget; and
WHEREAS, the County desires to accept said grant in order to provide for
the hiring of said intern.
NCW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County
that Grant No. 75-A3239 for the hiring of an intern for the Commonwealth's
Attorney's office be, and the sane is hereby accepted; the County Executive to
notify the appropriate agencies of the County's acceptance of said grant and to

FIRE lANE ORDINANCE
Supervisor Myers rroved that the County Fire Lane Ordinance, adopted by the
Board on June 10, 1975, be referred back to the County Attorney for further study
and investigation and report back to the Board for its consideration.

RESOLUTION NO. 1527 REQUESTING THE HIGHWAY DEPAR'IMENT TO GIVE
PRIORITY STATUS TO IMPROVING STATE SECONDARY ROUTE 1637.
WHEREAS, the Board of Supervisor is of opinion that State Secondary Route
1637 in the Windsor Hills Magisterial District is very hazardous and is in need
of imnediate improvement in order to make said road safe for vehicular traffic;
and
WHEREAS, the Board of Supervisors desires to request the Virginia Department
of Highways and Transportation to consider giving priority status to making

improvements to said road.
NCW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County
that said Board hereby respectfully requests the Virginia Department of Highways
and Transportation to give priority status to improving State Secondary Route 1637
in the Windsor Hills Magisterial District of Roanoke County in order to make said
road safe for vehicular traffic.
BE IT FURTHER RESOLVED that a certified copy of this resolution be transmitte
to the Virginia Department of Highways and Transportation.

WHEREAS, the Board of Supervisors is of opinion that the bridge over the
Roanoke River on Route 646 in the Catawba Magisterial District is very hazardous
and is in need of irnrrEdiate improvement in order to make said bridge safe for
vehicular traffic in as much as the bridge as it presently exists cannot support
the weight of heavy vehicles crossing and therefore makes it impossible for resi-
dents of the area to obtain certain services; and

of Highways and Transportation to consider giving priority status to making im-
provements to said bridge.
