The Board of County Supervisors of Roanoke County, Virginia, met this da
in open session at the Salem-Roanoke Valley Civic Center in Salem, Virginia, this

being the fourth Tuesday and the second regular meeting of the month.
Members Present: Chairman May W. Johnson, Vice-Chairman E. Deal
Tompkins, R. Wayne Compton, C. Lawrence Dodson and Robert E. Myers.
Chairman Johnson called the meeting to order at 7:05 p.m. and recognized
Reverend Michael D. Bolus, Westminster Presbyterian Church, who offered the invo-
cation. The Pledge of Allegiance to the flag was given in unison.
IN RE: APPROVAL OF MINUTES
On the motion of Supervisor Tompkins and the unanimous voice vote of the
Board, the minutes of the special meeting of October 4, 1976 and the regular meeti

of October 12, 1976 were approved as spread.
IN RE:
APPLICATION OF CARL T. FURROW FOR A SPECIAL
EXCEPTION TO PARK A MOBILE HOME ON A ONE-
ACRE TRACT LOCATED ON THE WEST SIDE OF STATE
ROUTE 622 (BRADSHAW ROAD), APPROXIMATELY 10
MILES WEST OF ROUTE 864 AND PRATTS STORE
APPROVED
Supervisor Myers moved that the application of Carl T. Furrow be approved
subject to the provisions of the County Zoning Ordinance as it pertains to mobile
homes.
IN RE:
AIRPORT ADVISORY COMMISSION
On the motion of Supervisor Compton and the unanimous voice vote of the
Board, consideration of Ordinance No. 23268 adopted by Roanoke City Council
inviting Roanoke County, Botetourt County, City of Salem and Town of Vinton to

appoint one person, each, as liaison members of the Airport Advisory Commission
was continued to the November 9, 1976 meeting of the Board.

IN RE:
HUFFMAN PROPERTY
Mrs. Ogretta D. Bayer appeared before the Board and presented a petition
signed by 225 County residents opposing the condemnation of the Huffman property
located on Route 419 as the site for the proposed County governmental center, which

petition is f-led with the minutes of this meeting.
IN RE:
RESOLUTION NO. 1647 CONCURRING IN THE POSITION OF OTHER LOCALITIES IN
REGARD TO STATE AND FEDERAL MANDATED PROGRAMS
WEHREAS, the Board of County Supervisors of Roanoke County is concerned
with the financial impact of Federal and State Mandated Programs in which the
locality must bear the cost of implementation; and
WHEREAS, the County of Culpeper has requested the Board of County Super-
visors to join with said County in proposing the enactment of legislation by the
General Assembly which would provide that no state mandate should be passed without
the specific provisions for funding from state sources; and
WHEREAS, the Board of County Supervisors is of opinion that such legis-
lation should be enacted and further desires the Virginia Association of Counties

to encourage such legislation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby urges the Virginia Association of Counties
to concur with the request of various localities, including the County of Culpeper
that legislation be enacted by the General Assembly of Virginia providing that no
state mandate shall be enacted without making specific provisions for funding from
state sources and without making known prior to enactment the cost of implementing
the requirements mandated.
BE IT FURTHER RESOLVED that a certified copy of this resolution be trans-
mitted to all area legislators.
On motion of Supervisor Dodson and adopted by the unanimous voice vote
of the Board.

IN RE:
ITEMS REFERRED TO THE PLANNING COM}lISSION
On the motion of Supervisor Tompkins and the unanimous voice vote of the
Board, the following petition was this date received, filed, and referred to the
Planning Commission for recommendation:
Petition of Woodie James Martin, et aI, for rezoning certain lots
situate in the Glenvar area, approximately 350 feet north of U.S.
Route 11 from R-4 to $-1 so that a single-family dwelling may be
erected on Lot No. 7 in the W. R. Cross Subdivision.

IN RE:
RESOLUTION NO. 1648 APPROVING THE DEPARTMENT OF HIGHWAYS AND TRANSPORTA-
TION'S SECONDARY ROAD SYSTEM BUDGET FOR THE FISCAL YEAR 1976-77 FOR
ROANOKE COUNTY
WHEREAS, the Resident Engineer of the Virginia Department of Highways
and Transportation has submitted to the County Executive the proposed secondary
road system budget for Roanoke County for the period commencing July 1, 1976, and

extending through June 30, 1977; and
WHEREAS, the Board of Supervisors is of opinion that said budget should
be approved in order that said Department of Highways and Transportation may accom-
plish the work described therein during said period.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that the Commonwealth of Virginia Department of Highways and Trans-
portation's secondary road system budget for Roanoke County for the period commenci g
July 1, 1976 and extending through June 30, 1977, said budget being in the amount
of $1,459,808.00, be and the same is hereby approved.

DEPARTMENTAL ACTIVITIES REPORTS - SEPTEMBER , 1976
The departmental activities reports for the month of September, 1976, as
submitted by the County Executive, were for information of the Supervisors and are
filed with the minutes of this meeting.

AMENDMENT TO GENERAL APPROPRIATION RESOLUTION NO. 1649
On motion made by Supervisor Tompkins, the General Appropriation Resolu-
tion of Roanoke County, Virginia, adopted June 8, 1976, be, and the same is hereby,
amended as follows to become effective October 26, 1976:

IN RE:
PROPOSED PAYROLL TAX - CITY OF ROANOKE
Since the City of Roanoke dropped its proposal for legislation to levy
a payroll tax on County residents working in the City, the Board took no action
on the report of the County Executive regarding the subject. A full copy of the

County Executive's report is filed with the minutes of this meeting.
IN RE:
RESOLUTION NO. l6S0 AUTHORIZING TIlE ACCEPTANCE OF TWO DEEDS TO A WELL
LOT SITUATE IN WEST COUNTY
WHEREAS, the Board of County Supervisors has heretofore acquired the
assets of the Roanoke County Public Service Authority water system; and
WHEREAS, the Board has been advised that deeds to a certain S.2S-acre
parcel have been prepared and executed, which deeds did convey to the County title
to said tract; and
WHEREAS, no consideration is involved in the transfer of said parcel to
the County; and
WHEREAS, the Board of County Supervisors desires to accept said deeds
and to have the same recorded in the Clerk's Office of the Circuit Court of Roanoke

County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby accepts a quit claim deed dated September
21, 1976 executed by Owens-Illinois, Inc. and a deed dated October 20, 1976 exe-
cuted by the Roanoke County Public Service Authority, which deeds convey unto the
Board of County Supervisors title to a S.2S-acre parcel of land situate in the
Glenvar area of Roanoke County; there being no consideration to be paid by the
Board for said parcel.
BE IT FURTHER RESOLVED that the County Executive be, and he is hereby
authorized and directed to accept said deeds on behalf of the Board of County Super
visors and to record the same in the Clerk's Office of the Circuit Court of Roanoke
County.

On motion of Supervisors Myers and adopted by the unanimous voice vote
of the Board.
IN RE:
RESOLUTION NO. l6Sl AUTHORIZING THE ACQUISITION OF AN EASEMENT THROUGH
THE PROPERTY OF FREDERICK ELLWOOD TYALOR, JR.
WHEREAS, the Board of County Supervisors of Roanoke County has heretofore
undertaken the establishment of a Countywide Water System to serve the needs of the
citizens of Roanoke County; and

WHEREAS, a portion of the program is the construction of the Oak Grove-
Penn Forest Interconnection, which project requires the construction of a water
main to transmit water from wells in the Back Creek area to a storage facility in
Section 9, Penn Forest; and
WHEREAS, to provide for the same, it is necessary to obtain an easement

through the property of Frederick Ellwood Taylor, Jr., the fair market value of
said easement being $300; and
WHEREAS, the Board desires to acquire said easement in order to provide
for the construction of said project.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby authorizes and directs the acquisition of an
easement across the property of Frederick Ellwood Taylor, Jr. for the sum of $300,
which sum is deemed to be a fiar market value for said easement, said easement
being necessary to be acquired for the construction of the Penn Forest-Oak Grove
Transmission main.
BE IT FURTHER RESOLVED that the County Executive be and he hereby is
authorized and directed to accept said deed on behlf of the Board and to record
the same in the Clerk's Office of the Circuit Court of Roanoke County. I

IN RE:
RESOLUTION NO. 1652 AUTHORIZING THE CONVEYANCE OF A PARCEL OF LAND BY
THE SCHOOL BOARD OF ROANOKE COUNTY
WHEREAS, the County School Board of Roanoke County has been requested by
the Catawba Baptist Church to donate a samll parcel of land adjacent to the church's
property to said church; and
WHEREAS, the County School Board has indicated that it has no use for
the land and has, by law, approved the conveyance of said parcel contingent upon
unanimous approval thereof by the Board of County Supervisors of Roanoke County; a d
WHEREAS, the Board desires to concur and approve said transfer in accor-

dance with the School Board's request.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that it hereby approves the transfer and conveyance by the County
School Board of Roanoke County to the Catawba Baptist Church of a small parcel of

land situate adjacent to said church, said parcel being the remainder of a parcel
of land acquired by the S<<hool Board by deed dated March 26, 1877; said Board
approving said conveyance as a donation with no consideration to be paid by said
church.

On motion of Supervisor Myers and adopted by the unanimous voice vote of
the Board.
IN RE:
LIVESTOCK CLAIM - MRS. RALPH E. GRAYBILL, JR.
Supervisor Tompkins moved that the Board concur with the recommendation
of the County Director of Finance and approve the Livestock Claim of Mrs. Ralph E.
Graybill, Jr. for eight turkeys killed by dogs on October 3, 1976, in the total
amount of $3.20.
The motion was adopted by the following recorded vote:

IN RE:
RESOLUTION NO. 1653 DESIGNATING THE NAME OF ROUTE 670 SOUTH OF ROUTE 694
AS LOST MOUNTAIN DRIVE

WHEREAS, the property owners on Route 670 located 1.0 mile northwest of
Route 221 on Route 694 and extending in a southerly direction for a distance of
0.52 mile have requested the Board of County Supervisors to name said road Lost
Mountain Drive, and
WHEREAS, pursuant to Section 15.1-379 of the Code of Virginia, as amended
the governing bodies of any County authorized by resolution duly adopted may name
streets, roads, alleys therein outside the corporate limits of towns except those
primary highways conforming to Section 33.1-12 of the Code of Virginia, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County, Virginia that Route 670 extending in a southerly direction from
Route 694 for a distance of 0.52 mile be and hereby is officially named and desig-

nated as Lost Mountain Drive.
On motion of Supervisor Dodson and adopted by the unanimous voice vote
of the Board.

IN RE:
RESOLUTION NO. 1654 WAIVING THE REQUIREMENTS OF THE ROANOKE COUNTY WATER
ORDINANCE IN REGARD TO CERTAIN PROPERTIES
WHEREAS, certain property owners have approached the Board of County
Supervisors of Roanoke County and requested that the water ordinance heretofore
adopted by said Board be waived in certain respects in order to provide that water
WHEREAS, the Board is of opinion that in these particular instances,

service to said properties may be provided by means other than Roanoke County; and
because of the hardships created, that certain provisions of the water ordinance
should be waived.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby waives the requirements of the Roanoke County
Water Ordinance contained in Section 20.1-5 of the Roanoke County Code in regard to
the following described properties only, said waiver being based upon a demonstrati n
by the property owners that strict compliance with the provisions of the above
section of the water ordinance would impose an undue hardship and burden upon said
property owners:
(a) Lot 5, Block 3, North Hills
Subdivision
1 residential connection only
(b) Roanoke Mental Hygiene
Services, Inc.
1 commercial connection only

BE IT FURTHER RESOLVED THAT this Board shall authorize no further waiver
unless and until it has been demonstrated to said Board that the failure to grant
such waiver would create an undue hardship upon the property owners.
On motion of Supervisor Myers and adopted by the unanimous voice vote of
the Board.
IN RE:
HALLOWEEN
Board Chairman Johnson asked the Supervisors to concur with her recommen-
dation in officially celebrating Halloween on Saturday evening, October 30, 1976.
Mrs. Johnson stated that this would insure uniformity in the Valley since Vinton,
Roanoke and Salem had officially scheduled Halloween for Saturday night. All

members of the Board concurred by a unanimous voice vote.
This concluded the business before the Board at this time, and on the
motion of Supervisor Myers and the unanimous voice vote of the members, the meeting
was adjourned at 8:00 p.m.
