The Board of County Supervisors of Roanoke County, Virginia, met this

day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia,
this being the fourth Tuesday and the second regular meeting of the month.
Members Present: Chairman Robert E. Myers, and Supervisors C. Lawrence
Dodson, May W. Johnson and E. Deal Tompkins.
Absent: Vice-Chairman R. Wayne Compton.
Chairman Myers called the meeting to order at 7:05 p.m. and recognized
Reverend D. N. McGrady, West Salem Baptist Chirch, who offered the invocation.
The Pledge of Allegiance to the flag was given in unison.
IN RE:
HIGHWAY DEPARTMENT - ANNUAL SECONDARY ROAD HEARING
I
A public hearing was this date held by the Virginia Department of
Highways and Transportation for the purpose of discussing proposed work to be done
on the Secondary System for the year 1977-78. Mr. J. E. Williams, Resident Engi-
neer, was present at the hearing along with other officials. Mr. Williams re-
ceived various requests for road improvements from the Supervisors. There were no
citizens present at the hearing.

0.39 ACRES LOCATED IN THE CATAWBA DISTRICT ON THE *
NORTH SIDE OF ROUTE 778 APPROXIMATELY 0.7 MILE WEST *
OF ROUTE 648 FROM A-I TO R-3 FOR MULTI-FAMILY USE *
FINAL ORDER
NOW, THEREFORE, BE IT RESOLVED AND ORDERED, at this regular meeting of
the Board of Supervisors of Roanoke County, Virginia, held on the 22nd day of
March, 1977, that the County Zoning Ordinance be and the same is hereby amended so

as to change the classification of the westerly part of the property described in
said petition from its present classification of A-I to R-3 in order that the pro-
perty and the building thereon may be used for multi-family use as defined in the
County Zoning Ordinance.
The property hereby reclassified and rezoned from A-I to R-3 to permit
multi-family use is described as follows:

Located in the County of Roanoke, in the Catawba District, on the
north side of Route 778 approximately 0.7 mile west of Route 648,
and described by metes and bounds as follows, to-wit:
Beginning at a point on the north side of Route 778 and extending
N 430 34' 35" E 130.94' to a point; thence S 650 24' 25" E 68.78'
to a point; thence S 470 23' 37" W 113.92' to a point on the
northern side of Route 778; thence with the right of way of Route
778 N 710 04' 10" W 26.69'; thence continuing with the road right
of way N 640 21' 10" W 78.74' to the point of Beginning.
Being the westerly part containing 0.24 acre of plat of survey con-
taining 17,279 square feet (0.39 acre) made by E. Staley Clements,
Jr., Certified Land Surveyor, dated January 31, 1974, and attached
to the deed dated the 12th day of March, 1974, from Madge B. Twine
and Charles }1. Twine to Eva Clark, recorded in the Clerk's Office
of the Circuit Court of the County of Roanoke, Virginia, in Deed
Book 1008, page 386.

And it is further resolved and ordered that the Clerk of the Board
forthwith certify a copy of this Resolution and Order to the Secretary of the
Roanoke County Planning Commission and a copy to Murray A. Stoller, Attorney for
the petitioner.
The foregoing Resolution and Order was adopted on the motion of Super-
visor Johnson, and on a recorded vote the Supervisors voted as follows:

The communication from Roanoke Valley Cablevision, Inc. submitting the
Quarterly Progress Report covering construction of the Roanoke Valley Cablevision

BINGO PERMIT RENEWAL - OAK GROVE ELEMENTARY SCHOOL P.T.A.
Supervisor Dodson moved that the application of Oak Grove Elementary
School P.T.A. for renewal of their bingo permit be approved effective April 27,

IN RE:
REFERRALS TO PLANNING COMMISSION
The following rezoning petition was referred to the Secretary of the
County Planning Commission:

Petition of Marshall L. and Elizabeth F. Harris for rezoning from A-I to
M-2 of a six-acre tract in the extreme southeast portion of a l4.59-acre
tract. Six-acre tract bounded on the east by a private driveway; on the
south by Recess Lane and the ramp to Interstate 581; on the west by
Interstate 581; and on the north by the boundary line cutting this tract
off from the remainder of the 14.59 acres. Rezoning is requested so land
may be used for construction of facilities for large truck sales and a
garage and repair shop.

RELEASE OF TRUCK TITLE
Supervisor Johnson moved that the Board concur with the request from the
Bent Mountain Volunteer Fire Company for release of title to a 1969 GMC Firetruck,
County Vehicle No. 6926, which vehicle has been taken out of service.

IN RE:
RESOLUTION NO. 1735 WAIVING THE PROVISIONS OF THE COUNTY WATER ORDINANCE
WHEREAS, the Board of County Supervisors of Roanoke County has hereto-
fore adopted an Ordinance governing the construction of water lines and water
systems within the County; and
WHEREAS, said Ordinance included within its provisions the requirement
that new water systems be conveyed to the County and incorporated within the
County water system; and
WHEREAS, said Ordinance further contained provisions that the require-
ments hereinabove set out may be waived by the Board of County Supervisors upon
showing of just cause therefor; and
WHEREAS, the County Executive has recommended that the County water
ordinance be waived as to the property hereinafter described, in which recommen-

dation the Board concurs.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby waives the provisions of the County water
ordinance pertaining to conveyance of the water system to the Board of County
Supervisors as to property situate at the end of Millwood Drive in Section 1 of
Woodbridge Subdivision, the four properties to which this waiver shall apply being
located on Amy Lane and being generally identified as 1710 Amy Lane, 1718 Amy Lane
1726 Amy Lane, and 1737 Amy Lane.

BE IT FURTHER RESOLVED that all other provisions of the County Water
Ordinance shall apply to the water service being provided to the above properties.

The Financial Statement and Report on Delinquent Accounts for the month
of February, 1977, submitted by the Director of Fiannce, were for information of
the Supervisors and are filed with the minutes of this meeting.
IN RE:
RESOLUTION NO. 1736 AUTHORIZING THE LEASING OF PORTABLE TOILETS FOR USE
AT VARIOUS RECREATIONAL AREAS AROUND THE COUNTY
WHEREAS, funds are available in the 1976-77 budget for the leasing of
twelve portable toilets for a period of four months and nine units for seven
months; and
WHEREAS, bids were opened at 2:00 p.m. on Tuesday, March 15, 1977 for

furnishing twenty-one portable toilets to be used at various recreational areas
around the County of Roanoke for use with the summer recreational programs, and
the Director of Finance and the County Purchasing Supervisor, in their report date
March 22, 1977, recommend the award of the bid as hereinafter set out.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that the bid of Churchill's of Roanoke, Virginia, at a cost of
$30.00 per unit, not to exceed $3,330.00 be, and the same is hereby accepted, the
County Executive to notify the bidder of the acceptance of said bid and to complet
the necessary purchase order for said portable toilets.

Sheriff O. S. Foster appeared before the Board and requested permission
to discuss two matters which were not on the Agenda; one dealing with employment,
and the other regarding purchase of police vehicles. The Supervisors concurred
with the Sheriff's request.

IN RE:
RESOLUTION NO. 1737 REQUESTING THE APPROVAL OF THE STATE COMPENSATION
BOARD FOR ADDITIONAL PERSONNEL IN THE SHERIFF'S DEPARTMENT
WHEREAS, under recent guidelines established by the State Compensation
Board pursuant to the directive of the Governor relating to the employment of
personnel in correctional offices, no personnel may be employed without the cons en

of the State Compensation Board; and
WHEREAS, by letter dated March 22, 1977, the Sheriff of Roanoke County
has requested the Board of County Supervisors to request the State Compensation
Board to approve the hiring of an additional Clerk-Stenographer I and two addi-
tional correctional officers effective July 1, 1977, in which request the Board
concurs.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby respectfully reuqests the State Compensation
Board to approve the hiring of one additional Clerk-Stenographer I and two correc-
tional officers in the Roanoke County Sheriff's Department, effective July 1, 1977
BE IT FURTHER RESOLVED that the Clerk transmit a certified copy of this
resolution to the State Compensation Board.

IN RE:
PURCHASE OF POLICE VEHICLES
Supervisor Tompkins moved that the Board concur with the request of
Sheriff o. S. Foster and approve the purse of 10 police vehicles from the State
Department of Purchases and Supplies for delivery after July 1, 1977.

IN RE:
RESOLUTION NO. 1738 AUTHORIZING THE ACQUISITION OF BURLINGTON HEIGHTS
WATER SYSTEM
~IEREAS, the Board of County Supervisors of Roanoke County has hereto-
fore undertaken the establishment of a Countywide water system in order to provide
water service to the citizens of the County; and

WHEREAS, the Roanoke County Public Service Authority, as agent for the
County, has entered into negotiations with the owner of the Burlington Heights
water system, which negotiations have resulted in a recommendation from the
Roanoke County Public Service Authority that said system be acquired pursuant to
the terms and conditions hereinafter set out; and
WHEREAS, the Board of County Supervisors is of opinion that said system
should be acquired in order to provide adequate water service to residents in the
Burlington Heights area.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby authorizes the acquisition of the Burlington
Heights water system from Mr. Joseph Nackley, with the consideration for said
acquisition being that }1r. Nackley will be entitled to free residential water
service to his single family resident for a period of four years and six months,
said free service not to exceed $8.00 per month.
BE IT FURTHER RESOLVED that the Chairman and the Clerk be and they are
hereby authorized and directed to enter into a contract with Mr. Nackley providing
for the acquisition of said water system, said contract to be in a form approved
by the County Attorney.
BE IT FURTHER RESOLVED that the County Attorney petition the Circuit
Court, on behalf of the Board of County Supervisors, requesting approval for the
acquisition of said water system.
BE IT FINALLY RESOLVED that the County Executive be, and he is hereby
authorized and directed to take whatever steps are necessary in order to provide
for the acquisition of said water system.

LOCATION OF JAIL FACILITY

Supervisor Tompkins moved that the County build a new Jail facility in
the City of Salem at a site in the vicinity of the present County Courthouse, and
invite the City of Salem to participate in keeping with the previous agreement wit
Salem, and further that Craig County be invited to use the facility.

Board Chairmay Myers enumerated the various reasons for the Supervisors'
decision to build the Jail in Salem and publicly thanked the City of Roanoke for
the time and effort involved in offering the County use of the proposed Roanoke
City facilities.

IN RE:
RESOLUTION NO. 1739 AUTHORIZING THE ISSUANCE OF $2,900,000.00 OF GENERAL
OBLIGATION BONDS OF ROANOKE COUNTY, VIRGINIA, AND PROVIDING FOR THE SUB-
MISSION OF THE QUESTION OF THE ISSUANCE THEREOF TO THE VOTERS OF ROANOKE
COUNTY
WHEREAS, the Board of County Supervisors of Roanoke County has hereto-
fore recognized the need for the construction of a new jail facility for Roanoke
County; and
WHEREAS, the Board of County Supervisors determines that it is advisable
to contract a debt and issue bonds of Roanoke County in the aggregate amount and
for the purpose hereinafter set forth and to request the Circuit Court of the
County to make an Order as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby determines that it is advisable to contract

a debt in an amount not to exceed $2,900,000.00 and to issue general obligation
bonds of Roanoke County of the maximum amount of $2,900,000.00, pursuant to the
Public Finance Act to finance the cost of a jail facility for Roanoke County which
is to be located either within the County or within a City surrounded by the
County, including the acquisition of real estate, if any.
BE IT FURTHER RESOLVED that said Board respectfully requests the Circuit
Court of Roanoke County to make an Order requiring the Judges of Election on the
day fixed by the Order to open a poll and take the sense of the qualified voters
of the County on the question of contracting such debt and issuing such bonds.
BE IT FURTHER RESOLVED that the Clerk of the Board is hereby directed to
certify a copy of this Resolution and to present it to the Judge of the Circuit
Court for the County of Roanoke.
BE IT FINALLY RESOLVED that the Clerk of this Board is hereby directed

to file a certified copy of this resolution with the Clerk of the Circuit Court
for the County of Roanoke.

IN RE:
RESOLUTION NO. 1740 CREATING A COURT SERVICE UNIT ADVISORY COUNCIL FOR
ROANOKE COUNTY
WHEREAS, the 1976 Session of the General Assembly enacted legislation
providing for the creation and appointment of Court Service Advisory Councils to
advise the Director of the Local Juvenile and Domestic Relations Probation Staff
WHEREAS, the council, as created, would be an advisory group assisting

on certain matters concerning the needs and programs in the community; and
the chief judge and the Director of the Probation Staff in the development of
policy; and
WHEREAS, the Board desires to create such an advisory council for
Roanoke County.
NO\v, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board does hereby create a Court service Unit Advisory
Council for Roanoke County; said Council to consist of ten (10) members to be
appointed by the Board and to serve for terms as provided by law.

APPOINTMENTS - COURT SERVICE UNIT ADVISORY COUNCIL
The following persons were nominated to serve on the Court Service Unit
Advisory Council:
Supervisor Tompkins nominated Mr. Leonard Hale, Assistant Superintendent
of Roanoke County Schools, Secondary System; Dr. Herbert Keaton, Optometrist; and
Mr. R. Richard Cranwell, Attorney.
Supervisor Johnson nominated Mr. R. Cliff McClellan, Principal, Cave
Spring Jr. High; Mr. John E. Roche, Assistant to President, Rockydale Quarries;
and Mr. Richard Trout, Purchasing Agent, Roanoke County.
Chairmay Myers nominated Mr. Clarles Van Hoback, Attorney.

Supervisor Tompkins nominated Mrs. May W. Johnson to represent the
Board of County Supervisors.
Supervisor Dodson nominated Mr. Jim Woltz, Realtor.
The above-named persons were appointed by the unanimous voice vote of
the Board.
Vice Chairman Compton was not present at the meeting, and the remaining
position on the Council will be held open for his nomination.

At 8:12 p.m., Supervisor Dodson moved that the Board go into Executive
Session to discuss personnel and legal matters.

At 9:15 p.m., the Supervisors returned to the Civic Center and on the

JAIL AGREEMENT
Supervisor Johnson moved that the County Attorney and County Executive
be directed to meet with the City of Salem officials to prepare a contract regard-
ing the County's Jail facility.

ADDITIONAL SICK LIEAVE - CHIEF DEPUTY R. L. CHEW
Supervisor Dodson moved that the Board concur with the request of Sherif
O. S. Foster and authorize up to an additional 80 days of sick leave for Chief
Deputy R. L. Chew in recognition of the many hours of accumulated compensatory
time which he has earned during his employment with Roanoke County.
