The Board of County Supervisors of Roanoke County, Virginia, met this
day in open session at the Salem-Roanoke Valley Civic Center in Salem, Virginia,
this being the second Tuesday and the first regular meeting of the month.
MEMBERS PRESENT: Chairman May W. Johnson, Vice Chairman E. Deal Tompkins
R. Wayne Compton and Robert E. Myers. ABSENT: C. Lawrence Dodson.
Chairman Johnson called the meeting to order at 7:00 p.m. and recognized
Reverend Robinson H. McAden, Cave Spring United Methodist Church, who offered the
invocation. The Pledge of Allegiance to the flag was given in unison.
On the motion of Supervisor Compton and the unanimous voice vote of the
members present, the minutes of the regular meeting of December 23, 1975 were
approved as spread.

IN RE: OFFICIAL POLICY OF THE BOARD OF SUPERVISORS
Supervisor Compton moved that the policy statement previously read by
Supervisor Myers at the January 2 Organizational meeting be adopted and confirmed
as the official policy of the Board of Supervisors; and further that said policy
statement be sent to all departments of the County.
The motion was adopted by the unanimous voice vote of the members present.

In relation to the application of Josiah D. Richards for a permit to

park a mobile home on property located in Roanoke County, Mr. Charles
Attorney, appeared on behalf of'the applicant. Mr. Osterhoudt stated that the
trailer was first placed on the property in question in 1967. In 1974, Mr.
Richards' daughter applied for a permit at which time, the permit was revoked due
to Miss Richards not complying with all of the stated conditions placed upon the
permit by the Board of Supervisors. Mr. Osterhoudt further stated that
Mr. Richards now occupies the trailer, not his daughter and further that the
applicant would comply with any and all conditions of the permit imposed by the
Board, if the permit is approved. Mrs. C. W. Eddy, area property owner, appeared

in opposition to the request. Mrs. Eddy referred to the application of Miss
Richards stating that she did not comply with the conditions of the permit.
Chairman Johnson asked Mrs. Eddy if she would object to Mr. Richards parking a
mobile home on the property if all of the conditions are met. Mrs. Eddy stated
that she had no objections to Mr. Richards parking a mobile home as long as he
complied with all of the conditions imposed by the Board of Supervisors.
Supervisor Tompkins moved that the application of Josiah D. Richards
for a special exception to park a mobile home on a 1.46-acre tract located on
the east side of Jae Valley Road (Route 116), approximately 1,000 feet south of
Mayfield Drive (Route 659) in the Mount Pleasant area be approved subject to the
provisions of the County Zoning Ordinance as it pertains to mobile homes.

WHEREAS, the Wesleyan Church-Virginia District petitioned this Board and
requested that certain property described in said petition be rezoned and
reclassified, which petition was filed at a regular meeting of this Board and
is filed with the minutes of this meeting and was referred to the Roanoke County

Planning Commission for recommendation; and
WHEREAS, the Planning Commission by resolution adopted at its meeting
held on the 16th day of December, 1975, after hearing evidence touching on the
merits of said petition recommended to this Board that the County Zoning
Ordinance be amended as requested in said petition; and
WHEREAS, the Board of Supervisors did order that the Clerk of this Board,
upon receipt of said recommendation from the Planning Commission, forthwith set
the same down for a public hearing at the next permissible regular meeting of this
Board and give notice thereof by publication in accordance with law; and
WHEREAS, the Clerk of this Board did set the regular meeting of this
Board held on the 13th day of January, 1976 at 7:00 p.m. as the date and time for

a public hearing on the aforesaid proposed amendment to said County Zoning
Ordinance and gave notice and advertised the same by publication in accordance
wi th 1 aw; and
WHEREAS, said public hearing was this date had on the said proposed
amendment to the County Zoning Ordinance; and
WHEREAS, this Board after giving careful consideration to said petition
and to the recommendation of the Planning Commission and after hearing evidence
touching on the merits of said proposed amendment to the County Zoning Ordinance
being of the opinion that said County Zoning Ordinance should be amended as
requested in said petition and as recommended by said Planning Commission.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED that at this meeting of the
Board of Supervisors, the Roanoke County Zoning Ordinance be and the same is

hereby amended so as to classify as B-1 all that tract or parcel of land described
as follows: 1.032 acres located on the southeast side of U. S. Route 11, approxi-
mately 1/2 mile east of Lamarre Drive.

WHEREAS, Jean M. and Ethel H. Waldron did petition the Board of Super-
visor of Roanoke County to rezone certain property described in said petition, and
to amend the County Zoning Ordinance so as to provide that certain property
described in said petition be rezoned from Residential District R-l to Residential
Estates RE, which petition was filed at a regular meeting of this Board and is
filed with the minutes of this meeting and was referred to the Roanoke County
Planning Commission for recommendation; and
WHEREAS, said Planning Commission by resolution adopted at a meeting held
on the 16th day of December, 1975, after due advertisement and after hearing

evidence touching on the merits of said petition recommended to this Board that
said County Zoning Ordinance be amended so as to change the classification of the
property described in said petition from Residential District R-l to Residential
Estates RE; and
WHEREAS, the Board of Supervisors did order that the Clerk of this Board

WHEREAS, application has been made to the Board of Supervisors of
Roanoke County to have .34 acres of land located on the south side of State Route
897 along Back Creek, approximately 1200 feet west of Merriman Drive (Route 613)
rezoned from B-2 to M-l; and
WHEREAS, the Roanoke County Planning Commission has recommended that
the heretofore described property be rezoned from B-2 to M-l; and
WHEREAS, notices required by the Roanoke County Zoning Ordinance and
the Code of Virginia relating to the zoning have been published and mailed as
required and for the time provided in the Roanoke County Zoning Ordinance and the
Code of Virginia of 1950 as amended; and
WHEREAS, the hearing provided for in said Notice was held on January 13,
1976, at 7:00 p.m. before the Board of Supervisors, at which hearing all parties

IN RE: MENTAL HEALTH SERVICES OF THE ROANOKE VALLEY
Mrs. Verla Jo Wirth appeared before the Board and presented a progress
report of the Mental Health Services of the Roanoke Valley including some
photographic slides of the various programs operating under Mental Health Services.
Supervisor Compton moved that two or more members from the Mental Health
Association, which is a citizen volunteer organization, be appointed to work with
the Mental Health Services Board to act as advisors to the Board of Supervisors
during budget study in relation to the County contributing funds to the Mental
Health Services of the Roanoke Valley.
The matter was continued to the January 27th Board meeting due to the
following recorded tie vote:

approving the applications for cable television in the Roanoke Valley, which

IN RE:
BINGO PERMIT RENEWAL - FORT LEWIS RESCUE SQUAD
Mr. George H. Altice, Jr., Captain of the Fort Lewis Rescue Squad,
appeared before the Board and gave a brief report on equipment, etc., that the
Rescue Squad had been able to purchase and maintain due to the proceeds received
from last year's bingo games.
Supervisor Myers moved that the application of Fort Lewis Rescue Squad
for renewal of their Bingo Permit be approved effective this date for a period

of one year.

The communication from the Resident Engineer of the Virginia Department
of Highways and Transportation regarding Federal Forest Highway funds previously
requested by the Board to improve Route 311 was received by the Board and is
filed with the minutes of this meeting.
The Board took no action on the request of Cherokee Hills Water Company
to operate a public service water system at Cherokee Hills pending receipt of
the Public Service Authority recommendation on same.
Pursuant to the request of W. H. Fralin, Attorney, Supervisor Tompkins
moved that the Board reconsider the Ollie E. Fralin rezoning which has been grante

from B-2 to B-3 and hold a new public hearing on same at the January 27, 1976
meeting of the Board.

IN RE:
ITEMS REFERRED TO THE PLANNING COMMISSION
On the motion of Supervisor Myers and the unanimous voice vote of the
members present, the following petitions were this date received, filed and
referred to the Roanoke County Planning Commission for recommendation:
Petition of Harold and Shirley Horn for rezoning a 2-acre portion
of a 24.09-acre tract located west of the City of Salem line between
the Old Virginia Railway tracks and the Norfolk and Western Railway
tracks and lying on State Route 639 from M-2 to R-l in order that a
residence may be constructed thereon.
Petition of Daniel H. and Myrtle Joan Munsey for rezoning 0.51
acre located on the west side of U. S. Route 220, south of the
City of Roanoke from B-2 to B-3 and the issuance of a Special
Exception so that a used automobile car lot may be operated
thereon.

IN RE:
LEASE OF DWELLING, NORTH COUNTY PARK PROPERTY
In regard to the report of the County Executive on termination of the

vacant, vandalism occurs and raised the question of restoring the dwelling unit.
Mr. Richardson, area resident, also stated that vandalism occurs when
the property is left unattended.
The County Executive advised that the cost estimate of restoring the
existing dwelling unit would not justify the expense and that each time the
dwelling unit is reinspected, more work is found that needs to be done in order
to keep it liveable.
It was the concensus of the Board to extend the lease for about a six
month period provided that the tenants sign a waiver of liability due to the
condition of the dwelling unit.

IN RE:
RESOLUTION NO. 1413 TERMINATING THE LEASE WITH
THE TENANT OF THE NORTH COUNTY PARK PROPERTY
WHEREAS, the Board of Supervisors recently purchased a 40-acre parcel of
land situate in north County and thereafter entered into a lease agreement pro-
viding for the occupancy of a dwelling unit on said property; and
WHEREAS, the condition of such dwelling unit is such that the County
Executive, in his report dated January 13, 1976, has recommended that the lease
be terminated due to the fact that maintenance and repair work on said dwelling
unit has become increasingly expensive and further work is unjustified.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that the County's lease with Alexander and Ruth Hennesy, which
lease provided for the rental of a dwelling unit on the north County park property
I
be, and the same is hereby terminated not later than July 1, 1976, in accordance
with the provisions of the lease agreement.
BE IT FURTHER RESOLVED that the County Executive be, and he is hereby
authorized and directed to notify the tenants of the termination of the lease and
to further permit the tenants to remain on the premises for said period provided
they execute a waiver of liability for all damage and injury on said property.

IN RE: RESOLUTION NO. 1414 AUTHORIZING THE RENEWAL OF
THE COUNTY'S CONTRACT WITH BLUE CROSS/BLUE SHIELD
OF SOUTHWESTERN VIRGINIA

WHEREAS, the Board of County Supervisors has heretofore entered into a
contract with Blue Cross/Blue Shield of Southwestern Virginia to provide for group
hospitalization and medical insurance for County employees; and
WHEREAS, said contract contains a renewal provision, which renewal
provision must be executed prior to March 1, 1976; and
WHEREAS, the County Executive, in report dated January 13, 1976, has
recommended that said contract be renewed for a period of one year.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors that
said Board hereby approves the renewal for a period of one year of the County's
contract with Blue Cross/Blue Shield of Southwestern Virginia, which contract
provides for group hospitalization and medical insurance for County employees.

BE IT FURTHER RESOLVED that the County Executive be, and he is hereby
authorized and directed to execute the necessary documents renewing said contract
for a period of one year.

IN RE: RESOLUTION NO. 1415 GRANTING WORKMEN'S COMPENSATION
INSURANCE BENEFITS TO THE COUNTY VOLUNTEER FIREMEN
AND RESCUE SQUAD MEMBERS
WHEREAS, the County has many dedicated volunteer firemen and rescue

squad members who on many occasions risk their lives in performing the duties
connected with membership in said organizations; and
WHEREAS, the Board of County Supervisors is of opinion that members of
said organizations should be included within the County workmen's compensation
insurance program.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that said Board hereby extends workmen's compensation insurance
benefits to the hereinafter specified volunteer firemen and rescue squad members
of all County volunteer fire companies and rescue squads.

BE IT FURTHER RESOLVED that only such qualified members as are listed
on membership rosters maintained in the office of the County Executive shall be
eligible for such workmen's compensation benefits.

of Roanoke County, Virginia, adopted June 10, 1975, be, and the same is hereby

appropriation of $8,875 is hereby made from the General Operating

IN RE: STUDY COMMITTEE - COUNTY REFUSE COLLECTION PROGRAM
On the recommendation of the County Executive, Chairman Johnson appointed
the Board of Supervisors to act as a Committee of the Whole along with the County
Executive, County Attorney and County Engineer to study and investigate refuse
collection and disposal throughout Roanoke County.

The communication from the Circuit Court Clerk concerning salaries of
the Clerk and Deputies was received by the Board and is filed with the minutes of
this meeting.
IN RE: ROANOKE COUNTY FARM BUREAU - REQUEST FOR BOARD MINUTES
The request of the Roanoke County Farm Bureau to be sent copies of all
Board of Supervisors' minutes was before the Board.
Supervisor Tompkins moved that the request be denied since the Board
did not want to set a precedent and all Board minutes are public record and are
available to the public during the normal working hours of the County.
The motion was adopted by the unanimous voice vote of the members
present.
IN RE: STREETS IN SPRING VALLEY HIGHLANDS SUBDIVISION
Pursuant to the report of the County Attorney, Supervisor Myers moved
that the Administration be authorized to proceed with pursuing the matter regardinc
the upgrading of streets in Spring Valley Highlands Subdivision in court, if
necessary.
The motion was adopted by the unanimous voice vote of the members present.

STREETS IN PONDEROSA PARK AND PONDEROSA
PARK ADDITION
On the motion of Supervisor Myers and the unanimous voice vote of the
members present, the Virginia Department of Highways and Transportation was this
date requested to accept the following streets in Ponderosa Park and Ponderosa
Park Addition into the State Secondary System of Highways in Roanoke County:
Barbara Circle from Cartwright Drive to end, a distance of 0.03
mile.
Ponderosa Circle from Cartwright Drive to end, a distance of 0.17
mile.

On the motion of Supervisor Myers and the unanimous voice vote of the

WHEREAS, property owners on State Route 888 and a private road extending.
Route 888 in a westerly direction from Cotton Hill Road (Route 688) have petitione

the Board of County Supervisors to name said road Raintree Road; and
WHEREAS, pursuant to Section 15.1-379 of the Code of Virginia, as
amended, the governing body of any county is authorized and by resolution duly
adopted may name streets, roads, and alleys therein outside the corporate limits
of towns except those primary highways conforming to Section 33.1-12 of the Code
of Virginia.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of
Roanoke County that Route 888 for a distance of 0.24 mile and the private road
extending from the end of Route 888 for a distance of 0.30 mile in a westerly
direction from Cotton Hill Road (Route 688) be and hereby is officially named and
designated as Raintree Road.
On the motion of Supervisor Tompkins and adopted by the unanimous voice

IN RE:
JAIL FACILITY
Chairman Johnson requested that the County Executive correspond to the
Craig County Board of Supervisors inviting Craig County to meet and discuss with
the Board the question of joint participation in and use of jail facilities.
I
Vice-Chairman Tompkins requested the County Executive to correspond with
the City of Roanoke declining the City's invitation to Roanoke County to consider
using the former Federal building for County governmental offices.
Vice-Chairman Tompkins raised certain questions regarding sites for the
County's Jail/Courthouse/Administrative facilities. Mr. Tompkins stated that he
wanted it clarified for the public that the Board has not at this time taken any
action or officially discussed sites for the County's facilities or the holding of
a bond referendum regarding same.
The request from the Regional Health Services Planning Council for
nominations of persons to serve on the Western Virginia Emergency Medical Services

Council was continued to the January 27 meeting of the Board.
IN RE:
EMPLOYMENT OF PERSONNEL
Supervisor Myers moved that the Board continue with its "no hiring of
new employees" policy previously adopted on January 2, 1976.

expires on January 1, 1979.
