The Board of Supervisors of Roanoke County met this
day at the Courthouse in Salem, Virginia, in the County Court-
room, being the second Tuesday, and the first regular meeting
of the month.
MEMBERS PRESENT: John G. Seibel, Vice-Chairman,
J. Thomas Engleby, III, Richard C. Flora, R.E. Hilton, Jr.
ABSENT: Chairman C. Lawrence Dodson. Mr. William F. Clark,
County Administrator, and Mr. Edward A. Natt, County Attorney,
were also in attendance.
In the absence of Chairman Dodson, Vice-Chairman
Seibel called the meeting to order at 1:00 p.m., recognized
The Reverend James V. DeFoe, Pastor of the Melrose Baptist
Church, who offered the invocation. The Pledge of Allegiance
to the flag was given in unison, led by Supervisor Hilton.
On the motion of Supervisor Hilton and the unanimous
voice vote of the Board, the minutes of the regular meeting of
September 11, 1973, were approved as spread.

PETITION OF ANDREWS-PITZER-BUTLER
FUEL OIL CORPORATION FOR REZONING
1.081 ACRES LOCATED IN THE CAVE
SPRING MAGISTERIAL DISTRICT
FINAL ORDER
WHEREAS, Andrews-Pitzer-Butler Fuel Oil Corporation
petitioned this Board and requested that the Roanoke County
Zoning Ordinance be amended so as to provide that certain
property described in said petition be rezoned and reclassified
as Industrial District M-2 which petition was filed at a regu-
lar meeting of this Board held on August 14, 1973, and by order
entered that day was referred to the Planning Commission for
its recommendation; and

hereby amended so as to reclassify the property from Industrial
District M-l to Industrial District M-2 in order that said
property might be more fully and reasonably used, the said
property so classified being more particularly described as
follows, to-wit:
1.081 acres located in Cave Spring Magisterial
District and bounded on the east by Virginia
Highway Route 419 (Starkey Road), on the south
by Virginia Highway Route 753, and on the west
and south by the property of John A. Hall and
Company, Inc. as shown on the attached plat.

BE IT FURTHER RESOLVED AND ORDERED that the Clerk of
this Board shall certify a copy of this resolution to the
Secretary of the Planning Commission and a copy to Gentry,
Locke, Rakes & Moore, attorneys for the petitioners.

and requested that the public hearing on the petition of
International Funeral Services, Inc. for rezoning 2.97 acres
located on the west side of Route 419 be continued.
Supervisor Engleby moved that the public hearing on

amendments to the Roanoke County Code to be necessary in the

citizens of Roanoke County; and
WHEREAS, a Notice of Intention to amend the Roanoke

County Code as proposed, and Public Hearing thereon, have been
advertised and posted in accordance with law;
NOW, THEREFORE, BE IT ORDAINED by the Board of
Supervisors of Roanoke County, that the Roanoke County Code be
amended as follows:

Section 3.1-1 - Short Title
This Chapter shall be known and may be cited as the
"Air Pollution Control Ordinance of Roanoke County."
Section 3.1-2 - Definitions
Unless otherwise expressly stated or
indicates a different intention, the following
the purposes of this Chapter, have the meaning
section:
Air Pollution. The presence in the outdoor atmosphere of one or
more substances which are or may be harmful or injurious to
human health, welfare or safety, to animal or plant life, or to
property or which interfere with the enjoyment by the people of
life or property.
Air Pollution Control Officer. The Medical Director.
Air Pollution Control Coordinator. The Air Pollution Control
Director.
Air Pollution Control Director. The Air Pollution Coordinator
designated or appointed in the Health Department of the County
of Roanoke.
Air Pollution Episode. Meteorological conditions, generally
temperature inversions, that reduces the effective volume of air
in which the contaminants are diluted and as a result air
pollution may reach levels that would cause imminent and sub-
stantial endangerment to the health of persons.
This amendment to take effect on October 9, 1973.

ADOPTION OF AN ORDINANCE RECOGNIZING
CERTAIN PERSONS AND GROUPS AS INTEGRAL
PARTS OF THE OFFICIAL SAFETY PROGRAM
OF ROANOKE COUNTY
WHEREAS, the Board of Supervisors deems certain
ordinances to be necessary in the best interests of the health,
safety and general welfare of the citizens of Roanoke County;
and
WHEREAS, Chapter 3, Article 1.1 of the Code of
Virginia, of 1950, as amended, is known and designated as the
"Line of Duty Act;" and

WHEREAS, said Act provides for payment for benefi-
ciaries of persons whose death occurs as a direct or proximate
result of the performance of his duty as a law enforcement
officer of this State or any of its political subdivisions; and
I
WHEREAS, the afore-mentioned Act defines person or
persons as a law enforcement officer of the County, a sheriff,
deputy sheriff, or a member of any fire company or department,
or rescue squad, which shall have been recognized by an ordi-
nance of any county, city or town of this state as an integral
part of such safety program of such county, city or town; and
WHEREAS, in order for the sheriff, deputy sheriffs,
county police, animal control officer, deputy animal control
officer, and all other duly empowered law enforcement officers,
members of any fire company or department, or rescue squad for
Roanoke County to be insured by the "Line of Duty Act," they
must be recognized as a part of the official safety program of

Roanoke County; and
WHEREAS, a Notice of Intention to adopt and Public
Hearing thereon have been advertised and posted in accordance
with law;
NOW, THEREFORE, BE IT ORDAINED by the Board of Super-
visors that the following ordinance be adopted:
1. That the following person or persons are
integral parts of the safety program of Roanoke
County as defined by Chapter 3, Article 1.1 of
the Code of Virginia, 1950, as amended, and known
and designated as the "Line of Duty Act."
(a) All law enforcement officers to include,
but not be limited to, the sheriff, deputy sheriffs,
county police, animal control officer, deputy
animal control officer, and all other duly empowered
law enforcement officers of Roanoke County.

(b) The following volunteer fire departments:

WHEREAS, the Board of Supervisors deems certain amend-
ments to the Roanoke County Code to be necessary in the best
interests of the health, safety, and general welfare of the
citizens of Roanoke County; and
WHEREAS, a Notice of Intention to amend the Roanoke
County Code as proposed, and Public Hearing thereon, have been
advertised and posted in accordance with law;
NOW, THEREFORE, BE IT ORDAINED by the Board of Super-
visors of Roanoke County, that the Roanoke County Code be
amended as follows:

Section 8-12. Office continued; qualifications
generally.
The office of electrical inspector as now
constituted is hereby continued, subject to
removal at any time for cause by the Board
of Supervisors. Each electrical inspector
shall have a high school education or its
equivalent and shall be licensed as a
master electrician in Roanoke County.

A RESOLUTION SEEKING CONGRESSIONAL
SUPPORT FOR FUNDING OF THE WILMINGTON
DISTRICT CORPS OF ENGINEERS' FLOOD
CONTROL STUDY FOR THE UPPER BASIN
OF THE ROANOKE RIVER
WHEREAS, the Board of Supervisors desires to express

its support for the enactment by the Congress of the united

States of legislation appropriating funds sufficient to com-
plete the U. S. Army Corps of Engineers' flood control study
of the upper basin of the Roanoke River.
THEREFORE, BE IT RESOLVED by the Board of Supervisors
of Roanoke County that said Board does hereby most strongly
express its support for the enactment by the Congress of an
appropriation of sufficient federal funds to complete the U. S.
Army Corps of Engineers', Wilmington District, flood control
study of the upper basin of the Roanoke River.
BE IT FURTHER RESOLVED by the Board of Supervisors of
Roanoke County that said Board calls upon the members of
Congress, particularly those members of Congress representing

the Commonwealth of Virginia and several Congressional District
and localities, to employ and use their good offices, influence
and strongest efforts to obtain in the Congress, early passage
of said legislation, and, to that end, the Clerk is directed to
forthwith transmit certified copies of this measure to Senator
Harry F. Byrd, Jr., to Senator William C. Scott, and to all
of the members of the United States House of Representatives
from Virginia.

FOR THE POSITION OF ASSISTANT REGISTRAR
AND CLASSIFYING SAID POSITION WITHIN THE
COUNTY PERSONNEL AND PAY PLAN
WHEREAS, the Board of Supervisors has heretofore
adopted a position classification and pay plan for Roanoke
County, which pay plan prescribes the procedure for including
new positions within said plan; and
WHEREAS, the Board of Supervisors has heretofore
approved the position of Assistant Registrar for Roanoke
County; I

WHEREAS, the Board is desirous of adopting a job
description for said position and setting the pay scale for
said position.
NOW, THEREFORE, BE IT RESOLVED by the Board of Super-
visors of Roanoke County that the following be, and the same is
hereby adopted as the job description for the Assistant Registra .
Nature of Work
This is moderately difficult clerical work in the
maintenance of voter registration records and assisting ln
conducting elections.
Duties include the registration of voters, main-
tenance of voting lists, answering questions regarding
voting rules, and other duties as directed by the Registrar.
Also, participates in the preparatory work in the conducting
of elections as prescribed by the Registrar and in accordance
with established rules and procedures. This employee gives
information by personal interview and telephone and must
possess knowledge of local, State, and Federal laws as they
apply to voter registration. Daily office routines are per-
formed under the direction of the Registrar and work is
reviewed through personal observation and accomplished results.

Examples of work
Registers voters, answers inquiries concerning voter
registration laws, does clerical work to establish and maintain
current voter registration records.
Performs a variety of clerical tasks in office unit
of keeping .files and records, preparing office reports,
receiving calls and callers, providing information. Operates
typewriter, key punch equipment, and other related office
machines.
Assists in the setting up of voting stations; pub-
lication of notices in accordance with rules; and assists, as
necessary, in providing adequate space and equipment at voting
stations.
Provides assistance in aiding citizens to vote
absentee ballots and verifies registration cancellations of
registered voters who have moved elsewhere.
Keeps abreast of changes in election laws and
regulations.
Acts for the Registrar in her absence.
Performs related work as required.
Required knowledge, abilities and skills
Considerable knowledge of Federal, State, and
municipal voter registration laws and regulations.
Considerable knowledge of voting procedures, and
maintenance and protection of voting registration lists and
records. Some knowledge of general office procedures and
office makeup. Skill in the use of standard office equipment.
Ability to establish and maintain effective work
relationships with fellow employees, County officials, and
general public.
Desirable training and experience
Graduation from a standard high school and some
experience in work providing a knowledge of registration and
election rules and procedures, any equivalent combination of
training and experience.

IN RE:
AN ORDINANCE SETTING FORTH THE REQUIREMENTS
FOR PHYSICAL EXAMINATIONS FOR ALL COUNTY
FIREMEN AND POLICEMEN AND PROVIDING FOR
THE EMPLOYMENT OF PHYSICIANS TO CONDUCT
SAID PHYSICAL EXAMINATIONS
WHEREAS, Section 27-40.1 and Section 27-40.1:1 of the
Code of Virginia, 1950, as amended, provides that the governing
body shall prescribe the laboratory and diagnostic studies WhiC1
shall be conducted by physicians who have been employed by the II
governing body to conduct physicals for all firemen; and
WHEREAS, the Board of Supervisors is desirous of
having all County policemen undergo said physical examination
pursuant to the provisions of Section 15.1-134 of the Code of
Virginia; and
WHEREAS, an emergency is hereby declared to exist in
order that this ordinance take effect upon its passage.
NOW, THEREFORE BE IT ORDAINED by the Board of Super-
visors of Roanoke County that any physician qualified to
practice medicine in the Commonwealth of Virginia be authorized
to conduct physical examinations herein required for all County
policemen and firemen.
BE IT FURTHER ORDAINED that the physical examination
will include the following:
1. Complete blood count
2. Urinalysis
3. Chest X-ray - PA and Lateral
4. Pulmonary Function studies (firemen only)
5. Electrocardiogram
BE IT FURTHER ORDAINED that the Chairman and the Cler
be, and they are hereby authorized and directed to enter into
any necessary requisite contract with Lewis-Gale Clinic for the
performance by said clinic of the physical examinations herein
prescribed.
BE IT FURTHER ORDAINED that the Clerk publish this
ordinance in a newspaper having general local circulation in
accordance with the provisions of the Code of Virginia.

ASSOCIATION OF COUNTIES TO INDLUDE
IN ITS LEGISLATIVE PROGRAM FOR 1974
LEGISLATION PERTAINING TO OPERATION
OF ANY SELF-PROPELLED VEHICLE ON
PRIVATE PROPERTY
WHEREAS, Section 18.1-173 of the Code of Virginia

provides that it shall be unlawful for any person to go upon
the lands of another after having been forbidden to do so; and
WHEREAS, the Board of Supervisors of Roanoke County
feels that legislation should be enacted which would require
written permission from the owner before one is entitled to
operate any self-propelled vehicle on the property of the owner;
and
WHEREAS, the Board of Supervisors is desirous of
having the Virginia Association of Counites include legislation
which would accomplish the above in said Virginia Association of
Counties legislative program for 1974.
NOW, THEREFORE, BE IT RESOLVED by the Board of Super-
visors of Roanoke County that the Virginia Association of

Counties is respectfully requested to include in its legislative
program for 1974 legislation which would require the written
permission of the owner before going upon the lands of the
owner for the purpose of operating any self-propelled vehicle
thereon.

Executive Session to discuss matters involving personnel.
At 4:23 p.m., the Supervisors returned to the Courtroon

vote of the members, the Board reconvened in open session.

Supervisor Flora moved that Mr. Paul James, Fire
Coordinator, be authorized to make an inventory study of all
facilities of the County Fire Departments and also a personnel
