The Board of Supervisors of Roanoke County met this
day at the Civic Center in Salem, Virginia, being the fourth
Tuesday, and the second regular meeting of the month.
MEMBERS PRESENT: C. Lawrence Dodson, Chairman,
John G. Seibel, Vice-Chairman, J. Thomas Engleby, III,
Richard C. Flora and R. E. Hilton, Jr. Mr. William F. Clark,
County Administrator and Mr. Edward A. Natt, County Attorney,
were also in attendance.
Chairman Dodson called the meeting to order at
7:00 p.m., recognized The Reverend Myron W. Arledge, Midland
I
Baptist Church, who offered the invocation. The Pledge of
Allegiance to the flag was given in unison, led by Chairman
Dodson.
On the motion of Supervisor Seibel and the unanimous
voice vote of the members present, the minutes of the regular
meeting of October 23, 1973, were approved as spread.

PETITION OF THOMAS M. DAVIS, JR.
AND CAROLYN C. DAVIS FOR VACATION
OF CERTAIN STREETS AND ALLEYS IN
PINKARD COURT SUBDIVISION
Supervisor Flora moved that the Public Hearing on
the petition of Thomas M. and Carolyn C. Davis for vacation of

certain streets and alleys located in pinkard Court Subdivision
be continued to the December 11, 1973 meeting of the Board.

IN RE:
ADOPTION OF AN AMENDMENT TO CHAPTER 19,
TAXATION, SECTION 19-7. UTILITY SERVICE
TAX, SUBSECTION (j)
WHEREAS, the Board of Supervisor deems certain amend-

ments to the Roanoke County Code to be necessary in the best
interests of the health, safety and general welfare of the
citizens of Roanoke County; and
WHEREAS, a Notice of Intention to amend the Roanoke
County Code as proposed, and Public Hearing thereon, have been
advertised and posted in accordance with law.
NOW, THEREFORE, BE IT ORDAINED by the Board of Super-
visors of Roanoke County, that the Roanoke County Code be amended
as follows:
Chapter 19, Taxation, Section 19-7. Utility
Service Tax, Subsection (j) is amended as
follows:
(j) The following words and phrases when used in this
section shall for the purposes of this section, have
the following respective meanings, except where the
context clearly indicates a different meaning.
(i) Person. The word "person" shall include indivi- I
duals, firms, partnerships, associations, corporations 'I
and combinations of individuals of whatever form and I
character.
I
(ii) Purchaser. The word "purchaser" shall include
every person who purchases a utility service.
(iii) Seller. The word "seller" shall include every
person whether a public service corporation or not,
who sells or furnishes a utility service.
(iv) Utility Service. The phrase "utility service"
shall include local exchange telephone service of
corporations falling within the provisions of Article
8, Chapter 12, Title 58 of the Code of Virginia, 1950,
as amended, and electricity service and gas service
of corporations falling within the provisions of
Article 10, Chapter 12, Title 58 of the aforesaid Code
of Virginia, furnished in the County.
This amendment to take effect on November 27, 1973.

IN RE:
FERNCLIFF AVENUE
Mr. Samuel P. McNeil, Chairman of the Roanoke City
School Board, appeared before the Board and discussed the
possibility of constructing a sidewalk on Ferncliff Avenue from
Hershberger Road to William Ruffner Junior High School.
Supervisor Seibel moved that permission be granted to
Roanoke City to build a curve and gutter on Ferncliff Avenue
providing that there will be no cost to the County or the County
Highway fund.

On the motion of Supervisor Flora and the unanimous
voice vote of the Board, the copy of a resolution adopted by
the City of Roanoke regarding availability of jail facilities
to be constructed in Roanoke City to other parties of the
Corrections Center Agreement was this date received and filed.
IN RE:
REQUEST FOR FUNDS - CITIZENS ENVIRONMENTAL
COUNCIL STEERING COMMITTEE
Mr. Thomas Edwards and other members appeared before
the Board and requested funding from Roanoke County for the
Citizens Environmental Council Steering Committee.
Supervisor Engleby moved that 10~ per capita be
appropriated, based on the 1970 census population, to the
Citizens Environmental Council Steering Committee.
Supervisor Seibel offered a substitute motion that
the matter of appropriating funds for the Citizens Environmental
Council Steering Committee be continued to the December 11, 1973
meeting of the Board for further study and investigation.
The substitute motion was adopted by the following

IN RE:
RECONSIDERATION OF MOBILE HOME
DENIAL - MRS. ELVA W. GORDON
Mrs. Elva W. Gordon appeared before the Board and
requested the Board's reconsideration of her application to park
a mobile home on the east side of Route 668, which permit was

denied on November 15 due to insufficient land. Mrs. Gordon
also submitted evidence that one acre had been leased to her.
On the motion of Supervisor Seibel and the unanimous
voice vote of the Board, the application of Mrs. Elva W. Gordon
was this date reconsidered.
Supervisor Seibel moved that the application of Mrs.
Elva W. Gordon to park one trailer on a one-acre tract on the
east side of Route 668 be approved subject to the conditions set
forth by the Planning Commission.

RECONSIDERATION OF MOBILE HOME
DENIAL - RICHARD A. GRAVELY
Mr. Richard A. Gravely appeared before the Board and
requested the Board's reconsideration of his application to
park a mobile home on a one-acre tract one mile off Route 11 and \
Route 460 on State Route 643, which permit was denied on
November 15 due to area opposition.
There was no motion by the Board to reconsider the
application of Mr. Richard A. Gravely.

Mr. Clarence Overstreet, representing Mr. R. L. Mann,

Mr. R. L. Mann be continued to the December 11, 1973 meeting of
the Board so that the petitioner may be present at the meeting
to state his intentions regarding the mobile home.

Mrs. Claude L. Cunningham, Jr. appeared before the
Board and requested Board's reconsideration of her application
to park a mobile home on Route 789 opposite Route 672 on a one
acre tract owned by Marion C. Roark, which permit was denied on
November 15 due to lack of information.
On the motion of Supervisor Engleby and the unanimous

Cunningham, Jr. was referred back to the Planning Commission.

CLEARBROOK FIRE DEPARTMENT - RENT
Supervisor Engleby moved that the matter of the rent
being raised from $60.00 per month to $100.00 per month on the
Clearbrook Fire Department be referred to the County Administra-
tor for his investigation and recommendation back to the Board
for its consideration.

On the motion of Supervisor Hilton and the unanimous
voice vote of the Board, the following items were this date
received, filed and referred to the Planning Commission for a
recommendation:
Petition of K. B. Graham Builder, Inc. for rezoning
three parcels of land containing 37 acres, more or
less, at the corner of Penn Forest Boulevard and
Chaparral Drive, all located in the Cave Spring
Magisterial District, from R-l to a Planned Unit
Development.
Petition of Fralin and Waldron, Inc. for rezoning
a parcel of land known as Gish Tract from RE to
R-l and R-3.

DISPOSITION OF SURPLUS COUNTY VEHICLES
Supervisor Seibel moved that in the future, all bids
for disposal of County vehicles be considered by the Board of
Supervisors prior to said disposal.

DELINQUENT TAX OFFICE - AUDIT
Supervisor Engleby moved that an audit be performed on
all transactions of the Delinquent Tax Office through December
31, 1973, and that the present County auditors, Daniel A.

Robinson & Associates, be requested to perform this assignment
in connection with ongoing work.

A RESOLUTION AUTHORIZING AND DIRECTING
THE EXECUTION OF A CONTRACT WITH
MECHANICAL MAINTENANCE, INC.
WHEREAS, the Board of Supervisors is of the opinion
that it would be in the best interests of Roanoke County to ente

for heating and air conditioning systems at various County build

WHEREAS, Mechanical Maintenance, Inc. has offered to
provide said services for the sum of $2,400 per year, which

NOW, THEREFORE, BE IT RESOLVED by the Board of Super-
visors of Roanoke County that the County Administrator be
authorized to execute that certain agreement with Mechanical
Maintenance, Inc. dated September 28, 1973, by which agreement
Mechanical Maintenance, Inc. agrees to furnish service and
maintenance on the heating and air conditioning equipment of the
County at the locations described in said proposal; said service
to be provided for the sum of $2,400 per year, payable in equal

monthly installments; said agreement to contain such further
provisions as are set out in the proposal dated September 28,
1973.

Supervisor Seibel moved that the matter of the County
appropriating funds for improvements for the Salem-Roanoke Valley
Civic Center be continued to the December 11, 1973 meeting of the
Board for further investigation and study.
Supervisor Hilton offered a substitute motion that the
County not offer any financial assistance to the Civic Center

until the City of Salem agrees to enter into negotiations with
the County.

RADIO EQUIPMENT MAINTENANCE
Supervisor Hilton moved that each Board member appoint
a citizen member, preferably someone knowledgeable in communica-
tions, to submit a proposed specification for rebidding for
III radio equipment maintenance for the County.
Supervisor Engleby offered a substitute motion to acce t
th recommendation of the County Administratarand award the bid for
Radio Equipment Maintenance to RCA Communications Systems pur-
l suant to the provisions in RCA Communications Systems' bid.
Supervisor Seibel offered a substitute to the substitu e
motion that with the consent of both bidders, to hold and con-
tinue the bids as written for radio equipment maintenance until
the first meeting in January, which consent was given by both
Lucky's Mobile Communications and RCA Communications Systems.
The substitute to the substitute motion was defeated

IN RE:
A RESOLUTION CANCELING THE SECOND
MEETING OF THE BOARD OF SUPERVISORS
IN DECEMBER
WHEREAS, the Board of Supervisors is required to meet

no less than one time each month in regular session; and
WHEREAS, the date of the second regular meeting falls
on the date of a legal holiday; and
WHEREAS, the Board of Supervisors, therefore, desires
I to cancel their regular meeting scheduled for December 25, 1973.
THEREFORE, BE IT RESOLVED by the Board of Supervisors
of Roanoke County that the regularly scheduled meeting of the
said Board set for December 25, 1973, be and it is hereby
canceled.
BE IT FURTHER RESOLVED that any business set for the
aforesaid meeting be continued until the next regularly schedule
meeting of the Board of Supervisors.

BE IT FINALLY RESOLVED that the Clerk of the Board be,
and he is hereby directed to publish the resolution once a week
for two consecutive weeks in the Roanoke World News, a newspaper
having general circulation in Roanoke County.
Said resolution shall also be published and posted at
the front door of the Roanoke County Courthouse.

On the motion of Supervisor Engleby and the unanimous
voice vote of the Board, the following roads in Penn Forest
Subdivision, Section 8 this date became a part of the Secondary
System of State Highways in Roanoke County:

Penguin Drive from Chaparral Drive to 0.33 mile north,
a distance of 0.33 mile.
Pheasant Run Circle from Penguin Drive to end, a
distance of 0.08 mile.
Blue Jay Circle from Penguin Drive to end, a distance
of 0.04 mile.
White Dove Lane from Arcturus Drive to 0.07 mile south
of Penguin Drive, a distance of 0.19 mile.
Arcturus Drive from Merriman Road to 0.06 mile north
of White Dove Lane, a distance of 0.12 mile.
On the motion of Supervisor Flora and the unanimous
voice vote of the Board, the statement of travel expenses
incurred by the Sheriff's Department for the month of October,
1973, was this date received and filed.

On the motion of Supervisor Engleby and the unanimous
voice vote of the Board, the monthly Jail Report was this date
received and filed.
IN RE:
A RESOLUTION APPROVING THE ADDITIONAL
EXPENDITURE OF $7,082.08 FOR THE
HEADQUARTERS LIBRARY
WHEREAS, the Board of Supervisors has heretofore
approved the expenditure of $465,000 of bond funds for the
construction of the new headquarters library for Roanoke County;
and
WHEREAS, the Library Board of Trustees has reported
that an additional $7,082.08 is required in order to complete

payment on said headquarters library; and
WHEREAS, the Board of Supervisors desires to pay said
$7,082.08 out of the present unexpended bond funds.
NOW, THEREFORE, BE IT RESOLVED by the Board of Super-
visors of Roanoke County that said Board of Supervisors hereby
approves the additional expenditure of $7,082.08 for the con-
struction of the headquarters library.

BE IT FURTHER RESOLVED that $7,082.08 be appropriated
out of the unexpended bond fund to make said final payments.

A RESOLUTION APPROVING THE SUPPLEMENT TO
THE SALARY OF THE COMMONWEALTH'S ATTORNEY
AND AUTHORIZING THE FORMATION OF A
COMMITTEE TO STUDY THE SALARY SCALE OF THE
REMAINING OFFICE STAFF
WHEREAS, the Board of Supervisors deems that it would
be in the best interests of the citizens of Roanoke County to
supplement the salary of the Commonwealth's Attorney to an
amount equal to the salaries of the General District Court
Judges; and
WHEREAS, the salary hereinabove mentioned shall be

contingent upon the fact that the Commonwealth's Attorney shall
devote full time to his duties as Commonwealth's Attorney; and
WHEREAS, the Board is desirous of forming a committee
to study the salary structure of the remaining personnel in the
office of the Commonwealth's Attorney.
NOW, THEREFORE, BE IT RESOLVED by the Board of Super-
visors of Roanoke County that the salary of the Commonwealth's
Attorney of Roanoke County be supplemented so that the total
salary of the Commonwealth's Attorney shall be equal to the
salary of the Judges of the General District Court, said supple-
ment being contingent upon the fact that the Commonwealth's
Attorney shall devote full time to his duties as Commonwealth's

Supervisor Flora moved that the County Administrator
be authorized to obtain proposals from qualified consulting
firms regarding a County-wide master plan.

NOW, THEREFORE, BE IT RESOLVED by the Board of Super-
visors of Roanoke County that there be, and there is hereby

committee to study all possible alternatives in providing for
the needs of all such court facilities and administrative offices.

WHEREAS, Mrs. Roger C. Mays petitioned the Zoning
Administrator of Roanoke County for a permit to operate a

WHEREAS, no provision in the Zoning Ordinance of
Roanoke County is made for this type of service; and
WHEREAS, the Zoning Administrator referred this matter
to the Planning Commission for their recommendation; and

WHEREAS, said Planning Commission by a resolution
adopted at a meeting held on the 16th day of October, 1973,
recommended that the request to operate a childcare service at
2020 Brookfield Drive be approved and that a permit be granted
for a period of one year from 2:45 p.m. to 5:30 p.m. on all
scheduled school days to keep not more than six (6) school age
children (other than those normally living at 2020 Brookfield
Drive) ;and
WHEREAS, the Clerk of this Board did set the regular
meeting of this Board to be held on November 27, 1973, at 7:00
p.m., as the date and time for a public hearing on the aforesaid

request and advertised same in the Roanoke World News, a news-
paper having a general circulation in Roanoke County; and
WHEREAS, said public hearing was this date had; and
WHEREAS, this Board has given careful consideration
to the petition and to the recommendation of said Planning
Commission and is of the opinion that said request to operate a
childcare service at 2020 Brookfield Drive, as a "Use Not
Provided For" under the Zoning Ordinance be granted.

At 10:45 p.m., on the motion of Supervisor Flora and
the unanimous voice vote of the members, the Board went into
Executive Session to discuss matters involving real estate and

personnel.
At 11:10 p.m., the Supervisors returned to the Civic
Center, and on the motion of Supervisor Flora and the unanimous
voice vote of the members, the Board reconvened in open session.
IN RE:
BEAUTY SALONS
Mrs. Dorothy Jenkins, 5439 Mayfield Street, S.E.,
appeared before the Board and requested that the Board not issue
licenses to home beauty salons unless they are licensed for
business. Mrs. Jenkins represented a group of hairdressers in
the Roanoke Valley.
Supervisor Flora moved to refer the matter of issuing

licenses to home beauty salons not zoned for business to the
County Administrator and County Attorney for their report back
to the Board on the present procedures now used and any
alternatives that may be taken.
