Good afternoon and welcome to our meeting for October 10, 2006. Regular meetings
are held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings
are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this
schedule will be announced. The meetings are broadcast live on RVTV, Channel 3,
and will be rebroadcast on Thursday at 7:00 p.m. and on Saturday at 4:00 p.m. The
meetings are now closed-captioned. Individuals who require assistance or special
arrangements to participate in or attend Board of Supervisors meetings should contact

SUMMARY OF INFORMATION
RAYSAC, the Roanoke Area Youth Substance Abuse Coalition, and the Blue Ridge
Behavioral Healthcare have asked that the Board proclaim October 22 through October 29,
2006, as Red Ribbon Week. The red ribbon has been designated as the symbol of
intolerance of the illegal use of drugs and a commitment to a drug-free lifestyle.
Communities recognize the last week in October as Red Ribbon Week across the country.
In the Roanoke Valley, a number of events are scheduled:
~ Many area elementary, middle and high schools will devote the entire week to the
awareness of substance abuse and its dangers to our communities. There will be
prizes awarded to each school level as well as prizes for winning poster and essay
contests.
~ Sunday, October 29, at 7:00 p.m., at the Hotel Roanoke Conference Center, a
Candlelight Vigil of Remembrance and Hope will be held to remember those whose
lives have been affected by substance abuse.
~ A number of businesses and agencies throughout the region will display banners and
ribbons in support of the campaign.
Ms. Dina Hartley-Hunt, RA YSAC Coordinator, will be present to accept the proclamation at
the Board meeting.

PROCLAMATION DECLARING OCTOBER 22 THROUGH OCTOBER 29,
2006, AS RED RIBBON WEEK IN THE COUNTY OF ROANOKE,
SYMBOLIZING A COMMITMENT TO A DRUG.FREE LIFESTYLE
WHEREAS, the Red Ribbon Campaign was initiated in 1985 by the Virginia
Federation of Communities for Drug-Free Youth; and
WHEREAS, the red ribbon was designated as the symbol of intolerance of illegal
drug use and a commitment to a drug-free lifestyle; and
WHEREAS, a group of concerned citizens, parents, students, teachers, police
officers, business people, judges, drug treatment providers, counselors, ministers, and
other caring individuals have established the Roanoke Area Youth Substance Abuse
Coalition (RA YSAC) to bring better coordination and development of substance abuse
prevention programs and resources; and
WHEREAS, RA YSAC and Blue Ridge Behavioral Healthcare have asked that the
Board of Supervisors recognize Red Ribbon Week in Roanoke County and are promoting
the Red Ribbon Campaign in the Roanoke Valley through a variety of activities.
NOW, THEREFORE, WE, the Board of Supervisors of Roanoke County, Virginia, do
hereby proclaim October 22 through October 29, 2006, as RED RIBBON WEEK in
Roanoke County, Virginia, and encourage all of our citizens to join in the observances and
activities of this event.

SUMMARY OF INFORMATION:
The County of Roanoke has been requested to recognize and proclaim October 8 through
14, 2006, as Fire Prevention Week in the County of Roanoke. During this time, we
encourage citizens to participate in fire prevention activities at home, work, and school. In
keeping with this year's theme "Prevent Cooking Fires: Watch What You Heat", we
encourage all Roanoke County citizens to use proper care when cooking.
Accepting the proclamation will be Rick Burch, Chief of Fire and Rescue, and Captain Gary
Huffman, Fire Marshal.

PROCLAMATION DECLARING OCTOBER 8 THROUGH OCTOBER 14,
2006, AS FIRE PREVENTION WEEK IN THE COUNTY OF ROANOKE
WHEREAS, Roanoke County is committed to ensuring the safety and security of all
those living in and visiting our county; and
WHEREAS, fire is a serious public safety concern both locally and nationally, and
homes are the locations where people are at greatest risk from fire; and
WHEREAS, the nonprofit National Fire Protection Association (NFPA) has
documented through its research that cooking is the leading cause of home fires. One out
of three home fires begins in the kitchen - more than any other place in the home; and
WHEREAS, Roanoke County's first responders are dedicated to reducing the
occurrence of home fires and home fire injuries through prevention and protection
education; and
WHEREAS, Roanoke County's residents are responsive to public education
measures and are able to take personal steps to increase their safety from fire; and
WHEREAS, using proper care when cooking will have a positive effect on the home
fire problem; and
WHEREAS, each cooking fire that is prevented in Roanoke County is an opportunity
to prevent painful injury and costly property damage; and
WHEREAS, the 2006 Fire Prevention Week theme, "Prevent Cooking Fires: Watch
What You Heat", effectively serves to remind us all of the simple actions we can take to
stay safer from fire during Fire Prevention Week and year-round.
NOW, THEREFORE, WE, the Board of Supervisors of Roanoke County, Virginia, do
hereby proclaim October 8 through 14,2006, as FIRE PREVENTION WEEK in the County
of Roanoke and urge the citizens of Roanoke County to heed the important safety
messages of Fire Prevention Week 2006, and to support the many public safety activities
and efforts of the Roanoke County Fire and Rescue Department.

SUMMARY OF INFORMATION:
The Commonwealth Transportation Board (CTB) is holding a public hearing to receive
comments about which essential rail, public transportation, bicycle, pedestrian, and
highway projects (primary and interstate roads) should be included in the fiscal years 2008-
2013 Six-Year Improvement Program (SYIP). This year's public hearing for the Salem
District is scheduled for October 17, 2006, at the Salem Civic Center, Community Room,
beginning at 6:00 p.m. and ending when all comments have been received.
Listed below are:
. Primary and interstate road projects that are currently in the VDOT fiscal year 2006-
2007 SYIP that the County recommends for the continuance of funding for planning
and construction.
. Primary and interstate road projects that are currently not funded in the VDOT 2006-
2007 SYI P that the County has identified as extremely important to its citizens and has
a strong desire to see included in the SYIP.
. Primary and interstate road projects that deserve consideration for spot improvements
and inclusion in the SYIP.

Comments:
In a letter dated June 3, 2001, the Board of
Supervisors encouraged VDOT to work closely
with the impacted citizens to address their
concerns and mitigate any negative impacts to
them. This is in addition to the resolution
120500-2 passed December 5, 2000
reaffirming the Board's support for 1-73. Upon
compretion and approval of the Final
Environmental Impact Statement, FHWA will
issue a Record of Decision.
Roanoke County continues to support VDOT's
proposed plan to widen 1-81 from its present
four lanes. We look forward to continuing our
partnership with VDOT to develop regional
cooperation for storm water detention facilities,
potential utility crossings, and other design
issues that could impact Roanoke County's
future.
Roanoke County continues to support the
ongoing design for improvements in this
important commercial and residential
development area. Improvements will provide
an increase in the level of service, bringing it
up to standards required for the expected
growth. Design has been approved by VDOT
and the target advertisement date is July 2009.
This project had been removed from the SYIP
but was reinstated in FY 05-06. The residential
development that has occurred/expected to
occur within this area will place additional
demands on the road system that is currently
providing an inadequate level of service; safety
issues need to be addressed. Currently no
construction funds are allocated.
The VDOT Salem Residency has notified staff
that the bridge over Back Creek is in need of
repair and we wish to offer our support for
improvements to the approaches and bridge
replacement.
We support continued funding of safety and
mobility improvements and crossover closures
and desire the continuance of that work. First
phase is under construction and scheduled to
be completed at the end of 2006.

Comments:
Portions of Rte 221 have been funded for PE,
County requesting RW and Construction
funding for extension of project; much needed
improvement project due to increasing
residential demands on corridor
Now that Route 11 has been widened from
Plantation Road to Hollins College, this
particular section of three-lane road remains
to be improved. Additionally, the existing
bridge over Carvins Creek does not meet
current standards, and the alignment of Florist
Road with Route 11 creates additional
congestion and safety concerns. The existing
section of road, 1.52 miles, is currently a
three-lane with the center lane used for
turning movements. Ninety percent of the
tracts adjacent to Williamson Road are
developed for commercial use.
This two-lane section of Plantation Road is
approximately 2.43 miles in length with
numerous secondary road connections. Iffull
funding were not available, various spot
improvements, such as turn lanes, alignment
and grade improvements would help with
safety issues. Additional land is available
along the road for future development, which
will increase traffic and construction costs in
the future.
Increasing commercial and residential
development and commuter traffic have
placed transportation demands on this
corridor. Additional lanes, improved vertical
alignment, and/or spot improvements are
needed.
This road is serving the growing commuter
traffic from Franklin County and recreational
traffic to Smith Mountain Lake: need to
improve to provide safety and capacity (there
is funding for the bridge in FY 05-06, need
road improvements, as well).
The continued residential, commercial, and
industrial growth within this corridor has
increased traffic demands.
Need based on existing traffic volume, current
and anticipated economic development, and
accident history. Could focus on operational
improvements (e.g. turn lanes, signal
coordination, etc.) from Salem City limits to
Rte 221; need to add capacity from Rte 221
to US 220.

RESOLUTION REQUESTING THE VIRGINIA DEPARTMENT OF
TRANSPORTATION, VDOT, TO CONTINUE FUNDING PROJECTS
CURRENTLY IDENTIFIED IN THE FISCAL YEAR 2006-2007 VDOT SIX.
YEAR IMPROVEMENT PROGRAM AND TO ADOPT THE PRIORITIZED
LIST OF INTERSTATE AND PRIMARY ROAD PROJECTS HEREIN
IDENTIFIED AS "NOT INCLUDED IN THE FISCAL YEAR 2006-2007 VDOT
SIX.YEAR IMPROVEMENT PROGRAM" FOR INCLUSION INTO THE
FISCAL YEAR 2008-2013 SIX-YEAR IMPROVEMENT PROGRAM
WHEREAS, the Six-Year Improvement Program is the Commonwealth
Transportation Board's plan for identifying funds anticipated to be available for highway
and other forms of transportation construction; and
WHERAS, this program is updated annually to assist in the allocation offederal and
state funds for interstate and primary roads.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia as
follows:
1. That the following projects identified as "included in the Fiscal Year 2006-
2007 VDOT Six-Year Improvement Program" are recommended for
continuance of funding for the planning and construction of said projects.
. Interstate 73 - In a letter dated June 3, 2001, the Board of Supervisors
encouraged VDOT to work closely with the impacted citizens to address
their concerns and mitigate any negative impacts to them. This is in
addition to the resolution 120500-2 passed December 5, 2000 reaffirming
the Board's support for 1-73.
. Interstate 81- Roanoke County continues to support VDOT's proposed
plan to widen 1-81 from its present four lanes. We look forward to
continuing our partnership with VDOT to develop regional
cooperation for storm water detention facilities, potential utility
crossings, and other design issues that could impact Roanoke
County's future.
. Rte. 11/460 (West Main St) - From: Salem City limits, To: 0.10 mi west
Rte 830, Technology Dr. - Roanoke County continues to support
the ongoing design for improvements in this important commercial
and residential development area. Improvements will provide an
increase in the level of service, bringing it up to standards required
for the expected growth.
. Rte. 221 (Bent Mtn Rd) - From: Rte 735, Coleman Rd., To: Rte 688
Cotton Hill Rd. - This project had been removed from the Six-Year
Improvement Program but was reinstated in FY 05-06. The
residential development that has occurred/expected to occur within
this area will place additional demands on the road system that is
currently providing an inadequate level of service.
. BridQe Replacement Rte. 116 (Jae Vallev Rd.) over Back Creek -
The VDOT Salem Residency has notified staff that the bridge over
Back Creek is in need of repair and we wish to offer our support for
improvements to the approaches and bridge replacement.
. Rte. 220 Safety/Mobility Improvements - We support continued
funding of safety and mobility improvements and crossover
closures and desire the continuance of that work.
2. That the following projects identified as "not included in the Fiscal Year 2006-
2007 VDOT Six-Year Improvement Program" have been identified,
prioritized, and selected by the Board of Supervisors as extremely important
to the growth of Roanoke County and/or for safety improvements and are
requested to be included in the Fiscal Year 2008-2013 VDOT Six-Year
Improvement Program.
1. Rte. 221 (Bent Mtn Rd) - From: Rte 688 (Cotton Hill Rd), To: Rte
694 (Old Bent Mtn Rd) - Portions of the Rte 221 corridor have
been funded for Preliminary Engineering. Roanoke County is
requesting Right-of-Way and Construction funding for the
extension of the project to extend to the base of Bent
Mountain. The much needed improvement project is due to
increasing residential demands on corridor.
2. Rte. 11 (Williamson Rd) - From: Rte 117 (Peters Creek Rd), To:
Roanoke City limits - Now that Rte 11 has been widened from
Plantation Road to Hollins College, this particular section of
three-lane road remains to be improved. Additionally, the
existing bridge over Carvins Creek does not meet current
standards, and the alignment of Florist Road with Rte 11
creates additional congestion and safety concerns. The
existing section of road, 1.52 miles in length, is currently a

three-lane road with the center lane used for turning
movements. Ninety percent of the tracts adjacent to
Williamson Road are developed for commercial use.
3. Rte. 115 (Plantation Rd) - From: Roanoke City limits, To: Rte. 11
(Williamson Rd) - This two-lane section of Plantation Road is
approximately 2.43 miles in length with numerous secondary
road connections. If full funding were not available, various
spot improvements, such as turn lanes, alignment and grade
improvements would help with safety issues. Additional land
is available along the road for future development, which will
increase traffic and construction costs in the future.
4. Rte. 220 (Franklin Rd) - From: Rte 419 (Electric Rd), To: Franklin
Co. line -Increasing commercial and residential development
and commuter traffic have placed transportation demands on
this corridor. Additional lanes, improved vertical alignment,
and/or spot improvements are needed.
5. Rte. 116 (Jae Vallev Rd) - From: Roanoke City limits, To:
Franklin Co. line - This road is serving the growing commuter
traffic from Franklin County and recreational traffic to Smith
Mountain Lake. We need to provide safety and capacity to its
users (Note: there is funding for the bridge on Rte 116 in FY
05-06; however need road improvements, as well).
6. Rte. 460 (Challenf/er Ave) - From: Roanoke City limits, To:
Botetourt Co. line - The continued residential, commercial,
and industrial growth within this corridor has increased traffic
demands.
7. Rte. 419 (Electric Rd) - From: Salem City limits, To: Roanoke
City limits (US 220) - The need is based on existing traffic
volumes, current and anticipated economic development, and
accident history. Could focus on operational improvements
(e.g. turn lanes, signal coordination, etc.) from Salem City
limits to Rte 221; need to add capacity from Rte 221 to US
220.
3. That the following projects identified as "not included in the Fiscal Year 2006-
2007 VDOT Six-Year Improvement Program" are recommended for spot

Supervisors to cast its votes at the annual business meeting on TUElsday, November 14.
The voting credentials form must be submitted to VACo by November 1, 2006. All
members of the Board of Supervisors are planning to attend the conference this year.
STAFF RECOMMENDATION:
It is recommended that the Board of Supervisors designate Chairman Wray to serve as
Roanoke County's voting delegate and that the voting credentials form be forwarded to
VACo. If Chairman Wray is unable to attend the business meeting, the Board designates
Vice-Chairman McNamara to serve as its alternate delegate.

SUMMARY OF INFORMATION:
County staff has worked with your legislative liaison to develop a tentative list of items
for the Board's consideration in developing Roanoke County's legislative program for
the 2007 session of the Virginia General Assembly. This list is based upon Board
member comments at the June 27, 2006, work session and from items that have arisen
since that date.
These items are as follows:
1. Law enforcement training academy:
(a) Remove the moratorium on the creation of new independent academies or
provide a waiver for Roanoke County
(b) Amend S9.1-106 to allow the assessment of certain court fees to support a
training academy
2. Explore Park: $300,000 for operating expenses, 2nd year of the biennium
3. Request the Governor to include start-up costs for the Western Virginia Regional Jail
in the budget for the 2008 Session

At the previous work session the Board rejected any consideration of seeking authority
to impose road impact fees on new development. With the failure of the General
Assembly to address transportation issues at the recently concluded special session,
does the Board wish to revisit this issue? Also, the Board rejected seeking authority to
tax tobacco products since the County has been unable to find a local legislator to
patron such legislation on behalf of the County.
I have attached for your review the legislative resolution that the Board adopted last
year for the 2006 session.
STAFF RECOMMENDATION:
It is recommended that the Board review these proposed legislative items and add any
additional items that it deems appropriate. A draft resolution is attached for your review.
If it reflects your priorities, then it shall be placed upon your October 24, 2006, consent
agenda for adoption.

RESOLUTION 102505-3 ADOPTING A LEGISLATIVE PROGRAM FOR
THE 2006 SESSION OF THE VIRGINIA GENERAL ASSEMBLY, AND
PETITIONING THE GENERAL ASSEMBLY TO FAVORABLY
CONSIDER THE TOPICS AND ISSUES ADDRESSED HEREIN
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has identified
major legislative issues of state-wide concern to be considered by the 2006 session of
the Virginia General Assembly; and
WHEREAS, the Board adopts this resolution as its Legislative Program for the
2006 session of the Virginia General Assembly.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, that the following legislative initiatives are submitted for its legislative
program for the 2006 session of the Virginia General Assembly for its favorable
consideration and adoption.
1) Approve an amendment to the Roanoke County Charter as follows:
Sec. 2.02 - Taxing powers. - In addition to the powers granted by other sections
of the charter and general law, the county shall have the additional power to levy and
collect taxes on cigarettes and tobacco products, pursuant to Section 58.1-3832 of the
Code of Virginia.
2) Support the JLARC recommendations to address the shortfall in state
funding for K-12 education and to fully fund the state Board of Education proposals.
The estimated annual cost of funding both the JLARC recommendations and Board of
Education proposals is $870 Million.
3) Support tax restructuring that grants localities additional revenue authority
and increases local revenue diversification. Oppose efforts to Ilmit or restrict local
taxing authority and revenues, whether by restricting assessment authority or tax rates,
exempting portions of fair market value increases, or other property tax limitations.
4) Support amending Sec. 33.1-72.1 to authorize counties to allow private
roads not built to VDOT standards under local subdivision and zoning ordinances and
still participate in the rural addition program with no financial loss or penalty.
5) Support additional state funding for transportation, and in particular,
funding for improvements to 1-81, and funding for passenger and freight rail
improvements.
6) Support Telecommunications Tax restructuring so long as it protects the
long-term fiscal interests of local governments and ensures a modern communications
service tax policy that treats all corporate competitors equitably. Local governments
must be guaranteed expanding communications service tax revenues in exchange for
local right of entry and regulation, adequate consumer protection and services, and
efficient local public safety E-911 call center operations.
7) Oppose the elimination of local cable television franchising authority.
Where competition exists in a locality and where competing services reach a majority of
citizens in a locality, then the competitive free market should be the major regulator of
the quality and price of cable lV services. Basic elements should be preserved,
including revenues to localities, sufficient tools to ensure quality of services expected by
citizens, services such as PEG channels and facilities to provide such channels, and
internet and cable to public facilities

8) Amend Sections 16.1 ~69.48 and 15.2-1716 to provide that the
reimbursement of expenses incurred by localities in responding to DUI and other traffic
incidents may be collected as a fee in the criminal or traffic infraction proceedings, and
that such fee be paid directly into the treasury of the locality.
9) Support amending Section 9.1-106 to allow Roanoke County to charge a
processing fee in criminal or traffic proceedings to support a criminal justice training
academy.
II.
That the Clerk to the Board of Supervisors is directed to send a certified copy of
this resolution to Senator John S. Edwards, Senator Brandon Bell, Delegate H. Morgan
Griffith, Delegate Onzlee Ware, Delegate William Fralin; Mary F. Parker, Roanoke City
Clerk; Members of the Roanoke City Council; Forest Jones, Clerk for Salem City
Council; Members of the Salem City Council; Clerk for the Town of Vinton; Members of
the Vinton Town Council and the Roanoke Valley-Alleghany Regional Commission, and

AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER
ON TUESDAY, OCTOBER 10, 2006
RESOLUTION CERTIFYING THE CLOSED MEETING WAS HELD IN
CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened a
closed meeting on this date pursuant to an affirmative recorded vote and in accordance
with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code otVirginia requires a certification by the
Board of Supervisors of Roanoke County, Virginia, that such closed meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, hereby certifies that, to the best of each members knowledge:
1. Only public business matters lawfully exempted from open meeting requirements
by Virginia law were discussed in the closed meeting which this certification resolution
applies, and
2. Only such public business matters as were identified in the motion convening the
closed meeting were heard, discussed or considered by the Board of Supervisors of
Roanoke County, Virginia.
