Good afternoon and welcome to our meeting for January 9, 2007. Regular meetings are held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be announced. AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, JANUARY 9,2007 RESOLUTION OF APPRECIATION TO MICHAEL A. WRA Y FOR HIS SERVICE AS CHAIRMAN OF THE BOARD OF SUPERVISORS IN 2006 WHEREAS, Michael A. Wray served as Chairman of the Roanoke County Board of Supervisors during 2006; and WHEREAS, during Mr. Wray's term as Chairman, the following noteworthy achievements took place: )- Investment of $156 million dollars in Roanoke County by new and existing businesses resulting in the creation of 600 new jobs for the region; and )- Began the process of developing a new 200-acre premiere business park in North Roanoke County that will function as a gateway to the Valley; and )- Consideration of a proposal to develop a multi-generational recreation center that will offer indoor recreational opportunities and fitness programs for residents of all ages; and )- Implemented a pilot recycling program in the Cave Spring Magisterial District; and )- Recognition of Roanoke County Schools for being the first school system in the State of Virginia to receive district accreditation by the Southern Association of Colleges and Schools Council on Accreditation and School Improvement; and )- Approved a new state-of-the-art library for citizens in Southwest Roanoke County designed for patrons of all ages and utilizing the latest technology; and )- Broke ground for the Western Virginia Regional Jail which will incorporate many green features designed to make the faCility more compatible with the environment and reduce energy usage; and )- Completed the new Public Safety Center and successfully relocated the County's technology infrastructure without interruptions in service; and )- Selection of Roanoke County as the site for the 2006 BG US Challenge, a corporate team building event in which Team Roanoke County qualified and participated in the World Team Challenge held in Malta; and )- Received a third consecutive Digital Counties Award from the Center for Digital Government and the National Association of Counties for the County's proactive use of technology to improve the delivery of services to its citizens; and )- Developed a Parks and Recreation Master Plan to serve as a guide for enhancing and developing recreation facilities and services to meet the future needs of the community; and WHEREAS, Chairman Wray worked diligently during his term to represent the citizens of Roanoke County by promoting economic development initiatives and supporting the uses of technology to provide advanced services to our residents. L\ AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: January 9, 20007 AGENDA ITEM: Request for authorization to execute a performance agreement between the County of Roanoke, the Roanoke County Economic Development Authority, and Plastics One, Incorporated SUBMITTED BY: Jill Loope Assistant Director Economic Development Elmer C. Hodge ~!f~ County Administrator APPROVED BY: COUNTY ADMINISTRATOR'S COMMENTS: ~~~ SUMMARY OF INFORMATION: Established in 1949, Plastics One specializes in the manufacture of custom cable assemblies and connector systems for the medical and communications markets. Their operation in Roanoke has played a critical role in advancing Virginia's presence in the medical device and plastics industry sectors, and they have been an important contributor toward the Roanoke regional economy for more than 57 years. Plastics One has grown their workforce and their revenues by five times in less than 20 years. Currently, they are planning a $1.7 million expansion, which includes the addition of 30 new employees. Due to significant infrastructure improvement required, Plastics One has requested assistance with this expansion in accordance with the County's Public Private Partnership Policy. Therefore, a three party performance agreement has been negotiated between Roanoke County, Roanoke County Economic Development Authority, and Plastics One. This agreement will promote and encourage the expansion and retention of this important company, while encouraging increased employment and corporate investment in Roanoke. The agreement allows for an economic development grant in an amount equal to three years of new local tax revenue to be reimbursed to the company after the new facility is built. New local tax revenue is defined as new real estate and Machinery and Tools taxes generated annually by the project, not to exceed to $50,000 in total. This is consistent with the County's Public Private Partnership Policy. If the company generates less than the estimated new local tax revenue, then the actual grant for that year shall be less. FISCAL IMPACT: Per the performance agreement, the grant will be calculated as a reimbursement based on new tax revenues generated by the project; therefore, the fiscal impact will be in the form of foregone revenue. No new funding is needed for this project. STAFF RECOMMENDATION: Staff recommends authorizing the execution of a performance agreement between the County of Roanoke, the Roanoke County Economic Development Authority, and Plastics One, Inc. 2 PERFORMANCE AGREEMENT THIS PERFORMANCE AGREEMENT (the" Agreement") is made as of this ~ day of , 2006, by and between ROANOKE COUNTY, VIRGINIA, a political subdivision of the Commonwealth of Virginia, (hereafter, the "County"), the ECONOMIC DEVELOPMENT AUTHORITY OF ROANOKE COUNTY, VIRGINIA, a political subdivision of the Commonwealth of Virginia, (hereafter, the" Authority"); and PLASTICS ONE INCORPORATED, a Virginia corporation, (hereafter, the "Company"). WITNESSETH WHEREAS, the Roanoke County Board of Supervisors and the Economic Development Authority of Roanoke County, Virginia, desire to promote and encourage the economic development and vitality of Roanoke County and the Roanoke Valley through the construction of new business and the retention and expansion of existing business in order to provide for retained and increased employment and corporate investment in Roanoke County; and WHEREAS, the Company, desires to construct an expansion to its existing facility (the "Project") located at Merriman Road in Roanoke County (the "Property"), and WHEREAS, the County and the Authority expect that Company will maintain its high quality employment opportunities for the citizens of the Roanoke Valley with 1 the completion of this Project which will promote economic development and generate new local tax revenues for Roanoke County; and WHEREAS, this increased employment and inveshnent constitutes a valid public purpose for the expenditure of public funds. NOW, THEREFORE, in consideration of the premises and the mutual covenants contained herein, the parties agree to the following: 1. Site Development by the Company. A. The Company will cause this new Project in Roanoke County to be made and developed, subject to obtaining ordinary and necessary governmental approvals from the County, and any other governmental agency. B. The Company shall construct an approximate 15,150 square foot expansion to its existing facility with a construction cost of at least $1.1 million on the Property, and install new equipment therein with a value of at least $578,000 by December 31, 2007. After this new construction the Company will employ an additional 30 people (being defined as employees scheduled for full time employment by the Company and eligible for Company benefits) at the Property and by operations emanating from the Property. C. The Company agrees to provide the County and the Authority any and all documentation that may be required to verify the investment and employment figures for the duration of this Agreement. 2. Procedures for the reimbursement of Authority funds to the Company. 2 A. Beginning in calendar year 2009, the County shall appropriate to the Authority in three annual installments sums sufficient, for an Economic Development Incentive Grant for the benefit of the Company. These sums sufficient amounts will equal a total of three years of "New Local Tax Revenues." The term, "New Local Tax Revenues," means the total of local real estate taxes and machinery & tools taxes generated annually by the Project. The total amount of the Economic Development Incentive Grant shall not exceed $50,000. If the Project generates less than the estimated New Local Tax Revenues, then the Grant shall be less than the estimated total of $50,000 for all three years. Such payments will be made over a three (3) year period in accordance with this Agreement. The three-year period will commence on January I, 2009. B. Within sixty (60) days of the end of each calendar year beginning January 1, 2009, the Company shall provide such employment, financial and tax revenue data relating to the Project as may be reasonably required by the Authority so that the Authority may calculate the actual grant amounts. The Company hereby authorizes the Commissioner of the Revenue for Roanoke County and the Commonwealth of Virginia to release to the Authority and the County the Company's confidential tax information and data so that the Authority may calculate the actual reimbursement amounts. The Authority shall pay the annual reimbursement amount to the Company at an address designated by the Company within thirty (30) days after receipt by the Authority of the data. 3 C. If the Company terminates this Project or fails to complete the construction of this development by December 31, 2007, then the Authority shall be relieved of any obligation to the Company for any Economic Development Incentive Grant. 3. The Company shall have the right to assign this Agreement to a separate entity provided that any such assignment shall not relieve the Company of its obligations herein. 4. If any party is unable to perform its commitments under this Agreement by reason of force majeure, then that party shall not be deemed to be in default of its obligations under this Agreement, and any deadlines for the performance of its obligations and, if applicable, the deadlines for the performance of the other party's obligations shall be extended for a time equal to the time period of the force majeure event, plus ten days. The term a Ii force majeure" as used herein, shall include without limitation acts of God: hurricanes, floods, fire, tornadoes, earthquakes, storms; strikes or other industrial disturbances; acts of public enemies; orders of governmental authorities; insurrections; riots; epidemics. 5. This Agreement shall be governed by and all disputes related hereto shall be determined in accordance with the laws of the Commonwealth of Virginia. 6. This Agreement and any payments of public funds are subject to future appropriations by the Board of Supervisors to the Authority. Hodge &~ /I ePy County Administrator AGENDA ITEM: SUMMARY OF INFORMATION: Oppidan, Inc. has informed Roanoke County that it will decline $1 million in grant funds for infrastructure improvements previously sought from the County as part of a $35 million commercial development at the Hollins exit of 1-81 (see Attachment 1). The decision was made by Oppidan after consultation with Gander Mountain, the developer's primary occupant, citing the retailer's preference to decline public incentives. As part of a performance agreement authorized December 19, 2006, Roanoke County agreed to provide a $1 million public-private partnership grant through the County's Economic Development Authority to support the construction of $3 million in public infrastructure improvements, including new public road construction and improvements at the intersection of Friendship Lane and Plantation Road. Oppidan has assured the County that the Gander Mountain project and improvements will proceed as planned. Oppidan has agreed to absorb the cost that would have been incurred by the County. Roanoke County is pleased that Oppidan is willing to move forward with the project. County staff will continue to work with Oppidan on future phases of the project, anticipating the opening of a new 40-acre business park in Hollins anchored by Gander Mountain. Board action is required to withdraw the performance agreement. FISCAL IMPACT: The $1,000,000 in grant funding previously reallocated to a special account for this project will be returned to the Public Private Partnership account. ALTERNATIVES: 1. Withdraw the performance agreement with Oppidan, Inc. and return the $1,000,000 grant allocation to the Public Private Partnership account. 2. As you know Gander Mountain is an integral part in this exciting retail development. We have been informed by Gander Mountain that they have a strict policy which does not allow them to accept public assistance in any form. As such Oppidan can not accept this grant for the Gander Mountain phase of the project. We are reviewing the overall economics for this project in light of this development. Fortunately there is very good interest in this project from other national retailers and we are confident that this project will proceed as planned. Hodge ~ If~ County Administrator APPROVED BY: COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Mountain Brook Development, Inc. is requesting that the Board of Supervisors convey the following easement for the purpose of providing a mainline sanitary sewer connection from the proposed Mountain Brook Subdivision located within the City of Roanoke corporate limits to the Glade Creek sanitary sewer interceptor located along the south side of the Norfolk & Western Railroad right-of-way within Vinyard Park, in the Vinton Magisterial District as follows: As shown on engineerIng plans prepared by Balzer and Associates, the design engineering firm for Mountain Brook Development, Inc., the new 20' wide public sanitary sewer easement would contain approximately 400 square feet to be granted from the edge of the railroad property to the existing sewer main located on property owned by the County at Vinyard Park and designated as Tax Map Numbers 61.05-02-01 AND 61.05-02-02. Staff has met on-site and has approved the easement location as identified on the attached plat. In addition, staff has met on-site with representatives from Balzer & Associates and together determined that there will be some impacts to the adjacent soccer field in Vinyard Park outside of the new easement that is being requested associated with installation of the new sanitary sewer manhole shown on the Balzer & Associates plans as "S.S MH. lA'''. The soccer field is irrigated to provide a high quality, natural-turf playing surface for soccer tournaments. Staff, utilizing the Roanoke County standard formula of 40% of assessed value of the easement requested (400 sq. ft.) and including the costs associated with required restoration of the high quality, natural-turf soccer field playing surface, has determined the fair market value of this easement and associated construction impacts to park land to be $1,500.00. Staff further requests that the necessary sewer project construction on park land be completed by March 1, 2007 so as not to interfere with scheduled soccer tournaments in this portion of Vinyard Park. FISCAL IMPACT: The fair market value of this easement along with costs associated with required restoration of the high quality, natural-turf soccer field playing surface is $1,500.00. These funds will be placed in the Department of Parks, Recreation and Tourism capital maintenance fu nd to be used for the restoration of the impacted soccer field and for other needed improvements at Vinyard Park. ALTERNATIVES: 1. Authorize the conveyance of an easement to Mountain Brook Development, Inc. for the purpose of providing a mainline sanitary sewer connection to the Glade Creek sanitary sewer interceptor located on property owned by the County at Vinyard Park and appropriate fair market value payment of $1,500.00 to the Department of Parks, Recreation & Tourism capital maintenance fund. Request that the necessary sewer project construction on park land be completed by March 1, 2007 so as not to interfere with scheduled soccer tournaments in this portion of Vinyard Park. 2. Decline to authorize the requested easement conveyance. STAFF RECOMMENDATION: Staff recommends Alternative 1, authorize the conveyance of an easement to Mountain Brook Development, Inc. for the purpose of providing a mainline sanitary sewer connection to the Glade Creek sanitary sewer interceptor located on property owned by the County at Vinyard Park and appropriate fair market value payment of $1,500.00 to the Department of Parks, Recreation & Tourism capital maintenance fund. Staff recommends that the necessary sewer project construction on park land be completed by March 1, 2007 so as not to interfere with scheduled soccer tournaments in this portion of Vinyard Park. 2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELDATTHE ROANOKE COUNTY ADMINISTRATION CENTER, TUESDAY, JANUARY 9,2007 ORDINANCE AUTHORIZING CONVEYANCE OF AN EASEMENT TO MOUNTAIN BROOK DEVELOPMENT, INC. THROUGH PROPERTY OWNED BY THE ROANOKE COUNTY BOARD OF SUPERVISORS AT VINYARD PARK (TAX MAP NO. 61.05-02-01 AND 61.05-02-02) TO PROVIDE A MAINLINE SANITARY SEWER CONNECTION FROM THE PROPOSED MOUNTAIN BROOK SUBDIVISION LOCATED WITHIN THE CITY OF ROANOKE CORPORATE LIMITS TO THE GLADE CREEK SANITARY SEWER INTECEPTOR LOCATED ALONG THE SOUTH SIDE OF THE NORFOLK & WESTERN RAILROAD RIGHT-OF-WAY IN VINYARD PARK, VINTON MAGISTERIAL DISTRICT WHEREAS, the Board of Supervisors of Roanoke County, Virginia, is the owner of two parcels of land containing 53.038 acres off Berkley Road in the County of Roanoke, Virginia, designated on the Roanoke County Land Records as Tax Map Nos. 61.05-02-01 and 61.05-02-02; and, WHEREAS, Mountain Brook Development, Inc. has requested the conveyance of an easement across this property to provide for a mainline sanitary sewer connection from the proposed Mountain Brook Subdivision located within the City of Roanoke corporate limits to the Glade Creek sanitary sewer interceptor located along the south side of the Norfolk & Western Railroad right-of-way within Vinyard Park; and WHEREAS, Section 18.04 of the Roanoke County Charter directs that the acquisition or conveyance of an interest in real estate, including easements, shall be accomplished by ordinance; the first reading of this ordinance was held on January 9, 2007; and the second reading was held on January 23, 2007. NOW THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1 1. The Virginia General Assembly provides a small funding allotment for school divisions each year for state equipment funds. The actual appropriation for Roanoke County was increased from $7,903 to $20,427.74 resulting in a total increase of $12,524.74. 2. Roanoke County Schools and Virginia Western Community College have an agreement whereby the college provides college level courses which are taught by Roanoke County Teachers who meet the college's criteria for adjunct professors. The school system collected $142,975 in tuition from 1,249 students. The college will reimburse $218,164.38 for services rendered. The school division owes the college $290,885.84 for tuition and technology and college service fees. The difference between the amount collected and the amount spent is $70,253.54. FISCAL IMPACT: The Career and Technical Education department budget will be increased by $12,524.74. The 100 percent local match will require no additional local funding since our local contribution already exceeds the state allocation. The Instruction Program budget will be increased by $70,253.54. Hodge ~ f/~ County Administrator APPROVED BY: COUNTY ADMINISTRATOR'S COMMENTS: ~~ SUMMARY OF INFORMATION: The Virginia Recreational Trails Fund Program is a reimbursement grant program established for the purposes of providing and maintaining recreational trails and trails- related facilities. It is funded through the Federal Highway Administration (FHWA) under the Transportation Equity Act for the 21st Century and administered in Virginia by the Department of Conservation and Recreation (DCR). As a reimbursement program, Roanoke County should be capable of financing the project while requesting periodic reimbursements. The program requires a 20% (minimum) matching share from the project sponsor. The maximum grant award for 2007 is $100,000 and the minimum grant award is $20,000. In previous grant awards, the average grant award has been $55,000. The Department of Parks, Recreation and Tourism would like to apply for grant funding to assist us in the construction of a new walking, hiking and biking trail system at Walrond Park in the Hollins Magisterial District. The grant request from the Department will not exceed the $100,000 grant request threshold established by DCR. Part of the application process requires a resolution of support from the local jurisdiction that includes an assurance that required matching funds are available from the local jurisdiction. Adopting the attached resolution will satisfy this requirement. FISCAL IMPACT: Roanoke County's share of the required match is available in the Department of Parks, Recreation and Tourism capital improvements budget and through in-kind construction services that will be provided by parks and recreation staff. ALTERNATIVES: Alternative 1: Adopt the attached resolution of support for a grant application to the Virginia Department of Conservation and Recreation for a Virginia Recreational Trails Fund Program grant to help finance trail development in Walrond Park. Alternative 2: Do not adopt the attached resolution resulting in scaling back of the project.
