Regular meetings are held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Gardner, Roanoke County Police Department, were dispatched to the Roanoke River at Wayside upon the report of a suicidal subject. A female who was distraught over her husband's military deployment to Iraq had advised a homeowner that she was going to commit suicide. When Officers Vass and Gardner arrived on the scene, they found the female sitting on the river bank. When they started to talk to her, she quickly jumped into the river and went underwater. Officer Vass without hesitation jumped into the river in full uniform and was able to grab her and pull her to the river bank. Officer Gardner who stayed on shore provided assistance to the subject from the river bank and transported herto a hospital for a mental health evaluation. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: ~~.-4 atr~~ \~~, SUMMARY OF INFORMATION: This is a public hearing to secure citizen's comments concerning amending the FY 2007- 2008 budget by adjusting the aggregate amount to be appropriated during the fiscal year. Section 15.2-2507 of the Code of Virginia, as amended, provides that whenever such amendment exceeds 1 percent of the total expenditures shown in the adopted budget or $500,000, whichever is lesser, the County must publish notice of a meeting and public hearing. The notice must state the County's intent to amend the budget and include a brief synopsis of the proposed budget amendment(s). This notice was published on July 13, 2007. 1. Request to appropriate $890,000 to the fleet maintenance facility capital accountfor the acquisition of certain real estate. 2. Request to reallocate $150,000 to the Center for Research and Technology capital account for the acquisition of certain real estate. 3. Request to appropriate $7,100 to the Schools for Title \I educational technology regional training. 4. Request to appropriate $22,500 from the Department of Emergency Management to support the Citizens Corps Program 5. Request to appropriate $91,901 from the Virginia Department of Criminal Justice Services for juvenile justice and delinquency prevention, functional family therapy project FISCAL IMPACT: There is no fiscal impact as a result of the public hearing. Requests for appropriations will occur later on this agenda. STAFF RECOMMENDATION: It is recommended that the Board hold the required public hearing. Board action appropriating funds, as provided in this notice, will occur later during this meeting. 2 ACTION NO. ITEM NO. 'F - \ AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: July 24, 2007 AGENDA ITEM: Request to adopt a resolution authorizing the Southern Rivers grant application for the Western Virginia Water Authority extension of sanitary sewer in Andrew Lewis Place neighborhood, Catawba Magisterial District SUBMITTED BY: Paul M. Mahoney County Attorney COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: This resolution authorizes the application for a grant from Southern Rivers Watershed Enhancement Program in the amount of $797,940 with the Western Virginia Water Authority (WVWA) acting as the County's agent for administering the grant in order to extend sanitary sewer to the Andrew Lewis Place neighborhood. This project is in the western part of Roanoke County just north of the Roanoke River near the Green Hill Park area. The project proposes to install approximately 3,321 feet of 8" PVC sanitary sewer collection system that has the potential to connect 41 existing properties that are currently using aging and failing septic tanks that are typically 50 to 60 years old. This new infrastructure will be installed on Andrew Avenue, Evelyn Drive, McDaniel Drive, and Ellen Drive. This area, which is part of Block Group 2, Census Tract 303 in the County of Roanoke, Virginia, has a median household income of $39,625. This moderate to low income area's median household income is only 83 percent of the typical Roanoke County household, and many of the residents are retired. This built-out residential area consists of single family homes. WVWA was approached by property owners in the area, inquiring about the installation of a sanitary sewer collection system because of issues they were having with their aging septic systems. In response to the inquiry, the Authority held a community meeting on September 20, 2006, followed by a neighborhood survey. Thirty-five residents responded to the survey with the majority expressing interest in connecting to a sanitary sewer system. Most responded that cost would be the deciding factor. These residents want to connect to the sanitary sewer system, but the scope of the project is beyond their financial means. As it is also beyond the financial means of many of these residents to take on the necessary maintenance and repairs on septic systems, this community will experience many more failed systems in the future. This grant will immediately correct a health and safety issue for these 41 potential households, improve the water quality in the immediate area as well as the neighboring Green Hill Park along the Roanoke River and improve the property values in the community as a whole. The County of Roanoke and the WVWA will work together on this project to connect the Andrew Lewis Place homes to the sanitary sewer system and reduce wastewater runoff into the Roanoke River. WVWA will serve as the agent for Roanoke County to design and facilitate the construction of this project. The engineering design is approximately 90 percent complete with no easement acquisition required since the new lines will be installed in the VDOT right of way. Therefore, upon completion of the design plans, the project could be put out to bid. The WVWA will bid the project and provide construction administration and inspection services. If the grant is awarded and funds are made available for construction of the project, the WVWA anticipates that the projected bid date would be early Fall 2007. If the County is awarded this grant, the Board will be asked to accept these funds and appropriate them to WVWA after an advertised public hearing amending the budget. FISCAL IMPACT: There will be no cost to the County. WVWA has agreed to pay the $25,395 local match. Roanoke County is fiscal agent for WVWA. STAFF RECOMMENDATION: It is the staff's recommended that the Board adopt the attached resolution authorizing the Southern Rivers Grant Application for the WVWA extension of sanitary sewer in Andrew Lewis Place neighborhood. 2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, JULY 24,2007 RESOLUTION AUTHORIZING THE SOUTHERN RIVERS GRANT APPLICATION FOR THE WESTERN VIRGINIA WATER AUTHORITY EXTENSION OF SANITARY SEWER IN ANDREW LEWIS PLACE NEIGHBORHOOD WHEREAS, Roanoke County, with the Western Virginia Water Authority acting as its agent, wishes to apply for a grant through the Southern Rivers Watershed Enhancement Program (SRWEP) for the Andrew Lewis Place, Roanoke, Virginia, Sanitary Sewer Extension; and WHEREAS, homes in the Andrew Lewis Place neighborhood located in western Roanoke County are experiencing problems with failing and underperforming septic systems with the cost to remediate these systems being a hardship to the neighborhood residents; and WHEREAS, the Roanoke River experiences water quality impairments and has been placed on the Commonwealth's list of impaired waters for bacteria contamination; and WHEREAS, it is possible to extend the Western Virginia Water Authority's sewer system to connect the homes in the Andrew Lewis Place neighborhood thereby eliminating the need for septic tanks and improving water quality in the Roanoke River. THEREFORE BE IT RESOLVED that the Roanoke County Board of Supervisors requests grant funds in the amount of $797,940 through the Southern Rivers Watershed Enhancement Program with $25,395 in local match being provided by the Western Virginia Water Authority so that sanitary sewer can be extended to 41 homes in the Andrew Lewis Place neighborhood allowing the septic tanks serving these homes to be replaced; and BE IT FURTHER RESOLVED that the County Administrator or any assistant county administrator is hereby authorized to execute such documents and take such actions as may be necessary to obtain the grant and to accomplish the purposes of this resolution. 2 ACTION NO. Staff is working with the architects on the initial design of the facility. The Board has already appropriated $500,000 to this project through the funded portion of the Capital Improvements Plan. Ancillary costs for various studies, including environmental site assessments, geotechnical, soil tests and soil borings, survey, title insurance, and recordation fees incurred to date total $43,799.66. The funds that are currently being spent can be reimbursed to the County at a later date with bond proceeds if the County declares its intention to do so before the funds are spent. The attached resolution will allow the County to reimburse itself at a later date. This resolution does not authorize the bond sale or appropriate any additional funds to the project at this time; it merely gives the flexibility to include current expenditures in the future bond sale if the County chooses to do so. FISCAL IMPACT: This resolution gives the County the option to include expenditures currently being made in the future bond sale. STAFF RECOMMENDATION: Staff recommends approving the attached reimbursement resolution for the fleet maintenance facility. 2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, JULY 24,2007 RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF ROANOKE, VIRGINIA, DECLARING ITS INTENTION TO REIMBURSE ITSELF FROM THE PROCEEDS OF A FINANCING FOR CERTAIN COSTS OF A NEW FLEET MAINTENANCE FACILITY The Board of Supervisors of the County of Roanoke, Virginia, (the "County") has determined that it may be necessary or desirable to advance money to pay the costs of designing, acquiring, constructing, and equipping a new fleet maintenance facility (the "Project"). NOW THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. The Board of Supervisors adopts this declaration of official intent under Treasury Regulations Section 1.150-2. 2. The Board of Supervisors reasonably expects to reimburse advances made or to be made by the County to pay the costs of designing, acquiring, constructing, and equipping the Project from the proceeds of its debt or other financing. The maximum amount of debt or other financing expected to be issued for the designing, acquiring, constructing, and equipping the Project is $7,500,000. 3. This resolution shall take effect immediately upon its adoption. STAFF RECOMMENDATION: Staff recommends as follows: 1. That the Board approve and adopt the first reading of these rezoning ordinances for the purpose of scheduling the second reading and public hearing for Auqust 28, 2007. 2. Since that initial meeting, our church has grown to a membership almost 200 members strong. Our current building, 2222 Wildwood Road, has presented some special and logistical obstacles that have motivated our church to actively pursue an alterative location. This alternative location has been identified as 4505 and 4625 West Main Street sold as two lots for a combined total of 11 acres. Our preliminary needs analysis, based on church growth statistics and internal growth trends, seem to justify a 15,140 square foot, multi -purpose building. This building (see attached breakdown), will house Sunday school classrooms, an open area that will serve as a fellowship hall, gym and sanctuary, a kitchen, vestibule and restrooms. This building will easily accommodate 300 people. In regard to the aesthetics, our building will most certainly compliment the area and provide a very pleasing and impressive structure. While we are primarily leaning to a metal structure, we plan on investing in some sort of fa~ade that will be visible to the community, leaning towards brick. Landscaping will be another priority for our new church site. Working on my Masters degree in Church Growth, I understand the importance and power behind beautification and first impressions. So, from the landscaping to interior and exterior of this project, we will consider the impact this project will have, from an aesthetic perspective, on the local community. In regard to our purpose, mission, vision and community involvement, CommUNITY Church has endeavored to positively impact our local community and collaterally the economy. This request is being made to allow the location of the retail building and the Bojangles Restaurant to be switched. On the previously approved plan, the restaurant was located on the northern comer of the property and the commercial building was pushed into the hillside on the southern portion of the property. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: ~J' ~'\\,~ a19~J ~~n SUMMARY OF INFORMATION: The Appalachian Power Company; in conjunction with a request from the Roanoke County Department of Parks, Recreation, and Tourism; is requesting that the Board of Supervisors convey a right-of-way easement within Camp Roanoke in the Catawba Magisterial District, as follows: As shown on the proposed right-of-way plan prepared by the Appalachian Power Company, the new 40-foot wide right-of-way easement would contain approximately 14,240 square feet to be granted within Camp Roanoke in order to move an existing power pole away from the main pavilion to a location that is more conducive to camp activities within Camp Roanoke on property owned by Roanoke County and designated as Tax Map Number 083.00-01-16.00-0000. Camp Roanoke staff has met on site with representatives from Appalachian Power Company and have approved the right-of-way easement locations as identified on the attached plan. Relocation of the electrical line will require the removal of one power pole and existing overhead power lines located within the Camp's main activity area and installation of two new poles and approximately 356 feet of overhead electrical line in a location outside of the Camp's main activity area. Since the request for the electrical line relocation originated from the Department of Parks, Recreation, and Tourism in order to improve operations at Camp Roanoke, staff recommends that there be a nominal charge of one dollar ($1.00) payable by the Appalachian Power Company associated with the granting of this right-of-way easement to the Appalachian Power Company. Costs associated with the electrical line relocation will be approximately $4,000 and will be paid out of the Department of Parks, Recreation, and Tourism capital maintenance budget for Camp Roanoke. FISCAL IMPACT: The Department of Parks, Recreation, and Tourism recommends that a fee of one dollar ($1.00) be paid by the Appalachian Power Company in association of the granting of this right-of-way easement to the Appalachian Power Company. The electrical line relocation that necessitates the granting of this right-of-way easement to the Appalachian Power Company will improve operations at Camp Roanoke as the relocation of the electrical line with occur outside of the Camp's main activity area. AL TERNATIVES: 1. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: ~~ aJ~~ (h P SUMMARY OF INFORMATION: The current Roanoke County garage facility was constructed in the 1980s, and is not large enough for servicing the current county fleet. A satellite facility was opened in 2006 for smaller vehicles and is in leased space near the County garage in Salem. Vehicles are also serviced at the Public Service Center on Kessler Mill Road in the Communications shop and the General Services welding and small engine repair shop as well as at outside vendors. The Board of Supervisors has approved the concept of a new fleet maintenance facility, which would include a larger garage, the communications shop, and the welding shop. Staff anticipates that combining the operations and bringing outside repairs in house will allow fleet operations to be more efficient and cost effective by reducing travel time and costs. Additionally, the Western Virginia Water Authority will also be using this facility under a long-term contract with the County which will help defray the cost of construction and operation. The County has hired an A&E firm and begun the schematic design process for this project. Based on comments from the Board of Supervisors at a work session at the June 12,2007, meeting and input from staff, the architects are currently refining the design and will continue with that process through the end of August. Construction documents will be prepared in the fall, and it is anticipated that the bidding process will begin in December, with the contract awarded in January. The project will be bid with several alternate scenarios to contain costs while allowing for later expansion as funding becomes available. The current schedule calls for construction to begin in February of 2008 with an opening planned for May 2009. Two pieces of property at the intersection of Hollins Road and Carlos Drive have been identified as suitable for this project, and option to purchase agreements were entered into between the County and the owners of the properties in February, 2007. The options were extended in May and will expire on August 15, 2007. The purchase price for these properties is $100,000 per acre, and the owners of each piece of property have already received $6,000 as an option fee which is credited against the purchase price. Property A is located at 5253 Hollins Road (Tax Map No. 39.05-2-4), and is owned by Ted A. Garrison, Jr. It consists of 4.02 acres and is zoned 1-1 which is suitable for operation of a vehicle maintenance facility. Property B is located at 1132 Carlos Drive (Tax Map No. 39.05-2-5), and is owned by Carl D. Jannay and Pamela H. Jannay. It consists of 5 acres and is also zoned 1-1. FISCAL IMPACT: The total cost of the properties is $902,000. The owners have already received $12,000, leaving an amount due of $890,000. Funding is available in the County's major capital account. Approve the second reading of the attached ordinances exercising the options on Properties A and B, and appropriate $890,000 from the County's major capital fund for payment of the remaining purchase price to the owners of the properties. 2. After an extensive search throughout the Valley for appropriate sites, these properties are the most suitable and convenient for both the County and the Western Virginia Water Authority. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: (j)u~ alr,q~ \~~, SUMMARY OF INFORMATION: In 2003, the Economic Development Authority (EDA) purchased approximately 25 acres of land fronting Prunty Road in the Dixie Caverns area of West County for the purpose of expanding the Center for Research and Technology (CRT). Existing EDA funds in the amount of $150,000 were utilized and additional funds needed to complete the purchase were provided by the Board of Supervisors to the EDA. Recently the Board of Supervisors adopted a revised Master Plan for the CRT which included incorporating the 25 acre EDA tract into the business park, rezoning it from Residential to Planned Technology Development and making the tract subject to new Covenants and Conditions which will regulate the development of the site. The 25 acre tract is now a portion of a larger 40 acre site shown on the new Master Plan thus creating dual ownership of the proposed new site, with the remaining acreage owned by the Board of Supervisors. It has been determined by staff that to enhance the marketability of the new site, it is desirous to have all of the land within the boundaries of the CRT under one ownership. Therefore, the EDA has agreed to transfer ownership of the 25 acres to the Board of Supervisors in return for $150,000 which will reimburse them for the original amount they invested in this property. FISCAL IMPACT: $150,000 is available in the Public Private Partnership Capital Account forthe purchase of this property. STAFF RECOMMENDATION: Staff recommends acquisition of the property and reallocation of $150,000 from the Public Private Partnership Capital Account to the Center for Research and Technology Capital Account for the purpose of purchasing the 25 acre tract of land from the EDA identified as Tax Map No. 63.00-01-01.00. 2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, JULY 24, 2007 ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN REAL ESTATE FROM THE ECONOMIC DEVELOPMENT AUTHORITY (FORMERLY THE INDUSTRIAL DEVELOPMENT AUTHORITY OF ROANOKE COUNTY) CONSISTING OF APPROXIMATELY 25 ACRES (TAX MAP NO. 63.00-01-01.00) LOCATED IN THE CENTER FOR RESEARCH AND TECHNOLOGY (CRT), CATAWBA MAGISTERIAL DISTRICT WHEREAS, in 2004 the Economic Development Authority (formerly the Industrial Development Authority of Roanoke County) purchased approximately 25 acres of real estate fronting on Prunty Road in the Dixie Caverns area of the County for the purpose of expanding the Center for Research and Technology; and WHEREAS, the Board of Supervisors recently adopted a revised Master Plan for the CRT which included incorporating this 25-acre tract into the business park, rezoning this parcel, and making it subject to the covenants and conditions regulating the development of the CRT; and WHEREAS, in order to further facilitate the marketability of this 25-acre tract, the Economic Development Authority has agreed to transfer ownership of this parcel to the Board of Supervisors of Roanoke County; and WHEREAS, Section 18.04 of the Roanoke County Charter directs that the acquisition and conveyance of real estate interests be accomplished by ordinance; the first reading of this ordinance was held on July 10, 2007, and the second reading was held on July 24,2007. NOW, THEREFORE, be it ordained by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the acquisition of approximately 25 acres of real estate (Tax Map No. 63.00-01-01.00) fronting on Prunty Road and located in the Center for Research and Technology from the Economic Development Authority for the sum of one hundred fifty thousand dollars ($150,000) is hereby authorized and approved. 2. That funds are available in the public private partnership capital account to pay all of the costs of this acquisition. 3. That the County Administrator or Assistant County Administrator are hereby authorized to execute such documents and take such actions on behalf of Roanoke County in this matter as are necessary to accomplish the acquisition of this real estate, all of which shall be approved as to form by the County Attorney. 2 ACTION NO. Hodge County Administrator APPROVED BY: COUNTY ADMINISTRATOR'S COMMENTS: ~t~ aNQ~ '~~, SUMMARY OF INFORMATION: Roanoke County Fire and Rescue, in cooperation with the American Red Cross (ARC) and other localities in the region, has participated in the implementation of the Community Emergency Response Team (CERT) training in the past. Over 550 citizens have graduated since the training began. The acceptance and appropriation of these funds will allow future classes to be funded which will allow for additional citizens to complete the course and past participants to be offered refresher classes. The CERT initiative is designed to prepare citizens to help themselves and others during times of catastrophic events until emergency responders can arrive or to provide further assistance along with emergency responders. Several trained members utilized their skills when they assisted with the shelter operations during a neighborhood evacuation last year. Additionally, members have assisted ARC on various other projects such as standbys at large events. Citizens trained in the past years programs are offered opportunities to update or recertify their training, and a significant number are taking advantage of these offerings. FISCAL IMPACT: The program is fully funded through grant monies appropriated to Fire and Rescue. No matching funds are required; however, staff time is necessary to the successful completion of the classes. ALTERNATIVES: None STAFF RECOMMENDATION: Staff recommends the acceptance and appropriation of $22,500 in grant funds from the Virginia Department of Emergency Management to the Fire and Rescue Department's budget. 2 ACTION NO. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: ~t~ dJ~ JJ6 SUMMARY OF INFORMATION: The County has received notification of a grant award from the Department of Criminal Justice services (DCJS) in the amount of $91 ,901 to continue a functional family therapy program for Roanoke County families in need. The award is the fourth year of a five-year program. The grant is renewable for 1 additional year. The goal of this program is to provide intensive in-home therapy services for juveniles who otherwise would be faced with out-of home placements at a far greater cost. This is an evidence-based program that has proven successful in other localities. Blue Ridge Behavioral Healthcare will be providing the counseling services and the County will serve as fiscal agent. There is a 50 percent local match for fiscal year 2008. The program does, however, have a source of income as Blue Ridge Behavioral Healthcare is able to bill insurance and/or Medicaid for a portion of the services provided. All of the local match will be paid from fees for service billed by Blue Ridge Behavioral Healthcare; no County funds will be needed for the match. This program will be coordinated with the Community Policy Management Team (CPMT) process. FISCAL IMPACT: As the match will be provided by Blue Ridge Behavioral Healthcare there is no direct fiscal impact for the County. However, because the intent of the program is to decrease the costs of out-of-home placements, there could be an indirect positive fiscal impact for the County. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: ~~.~ alf~~ \~7>' SUMMARY OF INFORMATION: On June 12 2007, the Board of Supervisors approved a performance agreement with Virginia Air Distributors, Roanoke County, and the EDA. It awarded an economic development grant to the company in return for certain investments to be made in a new industrial facility in North County. The agreement called for the completion of the new facility by December 31, 2007. Due to delays in finalizing site and building plans with regards to on- and off- site storm drainage easements, the company has asked to amend the agreement to reflect a June 31,2008, completion date (letter attached). It should be noted that the company has cooperated with Roanoke County on these issues and will be constructing improvements to Walrond Park as a result. FISCAL IMPACT: No funding is needed for this action. July 17, 2007 Dear Roanoke County Board of Supervisors, I had originally requested and received approval for a Performance Agreement in relation to our new facility at 1905 Walrond Drive in Roanoke County. We have been working diligently to fmalize site and building plans since late last year. We have however experienced delays in regards to storm water drainage and have had to engineer considerable improvements off out site and on County park land to gain site plan approval. These off site improvements are worth approximately $75K. They have been approved but we are still awaiting the legal recording of the required easements before we can proceed. While we originally had expected to complete the building by the end of this year the above complications have caused us to forecast our new expected completion date for sometime next Spring, worst case scenario by June, 2007. Section 2, paragraph #D, page 4 ofthe Performance Agreement contains terms pertaining to the completion of the building by the end of this year. With the extension of a new water line to Franklin County, we expect the Corridor Study and 2232 process will show areas on both sides of Route 220 as either transition or development. We wish to make the Girl Scouts aware of this so the organization can plan accordingly for any future development in the area. B. CITIZEN COMMENTS Five citizens spoke. Jack Pay of Yellow Mountain Road voiced concerns about fire protection and traffic, specifically the left turn lane on southbound US 220. Carolyn Holland of Hillside Road voiced concerns about increased traffic, well and septic needs of the camp, and the use of the facility by other groups. Deborah Smith of Yellow Mountain Road suggested "No Parking" signs along Yellow Mountain Road, near the camp entrance. She also voiced concerns about fire safety and environmental impacts of new septic drainfields. Rupert Cutler of South Jefferson Street spoke in support of the petition, the environmental education benefits for Girl Scout programs, and potential conservation easements for the forest and open space of the camp property. Helen Ruth Birch of Grandin Road Extension spoke in favor of the petition, and as a Girl Scout leader, stressed their emphasis on the safety of the girls at the camp. C. SUMMARY OF COMMISSION DISCUSSION Mr. Holladay presented the staff report. Mr. Natt, counsel for the petitioners, reviewed the petitioners' plans, programs, and issues from the community meeting held on June 11, 2007. Mr. McNeil asked for further discussion and clarification of traffic issues, rental of the property to outside groups and fire protection for the facility. Ms. Hooker asked about the supervision of the facility and the possibility of public use of the camp. Mr. Natt offered further details in response to the above inquiries. Mr. McNeil inquired about septic system capability. Mr. Azar commented about the function of shuttle service to the camp for large events, and also commented on lighting and signage for the camp. Mr. McNeil commented that he was satisfied that many of the issues were discussed and resolved, and that the forthcoming traffic impact analysis was the only issue remaining, and that he felt comfortable with the level of detail in the plans. Mr. McNeil made two separate motions to first revoke the existing special use permit issued through Ordinance 111400-8, and then to recommend approval of the special use permit with the suggested two conditions. Mr. Azar suggested two more conditions relating to signage and lighting. D. CONDITIONS 1. The property shall be developed in substantial conformance with the following three documents submitted with the application: a. They are requesting to revoke the existing special use permit for Rising Stars, and obtain a new special use permit to operate a girl scout camp. The subject property includes the 13.42 acre site of the existing camp, plus the adjacent 49.7 acres to the east. The proposed girl scout camp would conform to policies and guidelines of the Roanoke County Community Plan by providing a regional recreational use while protecting a significant amount of riparian area along Back Creek, as well as a significant amount of woodlands and open space. In addition to a concept plan, the petitioner submitted a detailed facility schedule that includes descriptions ofthe proposed facilities, as well as phasing of construction. Information was also provided that further describes certain activities such as girl scout troop activities, day camp, overnights, special events, training and staff meetings, community use, amphitheater, and maintenance and security. Staff suggests that the Planning Commission incorporate not only the concept plan into a condition of the special use permit, but also the facility schedule and narrative description of activities. Staff also suggests as a condition an effective date of September 30, 2007. 1. APPLICABLE REGULATIONS Camps are allowed by Special Use Permit in the AG-3 zoning district. Zoning Ordinance Use and Design Standards in Section 30-83-0.5 address screening of outdoor 1 activity areas adjoining residential uses, minimum site acreage, setbacks of structures, internal driveway access for emergency vehicles, and provisions for a caretaker's/security residence. Site development review will be required Virginia Department of Transportation (VDOT) approval is required for any improvements to the existing commercial entrance and any construction in the state right-of-way. Any additional well and septic permits will require approval by the Virginia Department of Health/Roanoke County Health Department. 2. ANALYSIS OF EXISTING CONDITIONS Background - Rising Stars Sports Camp began operations at the site in 1998. In July, 2000, the a Roanoke County Circuit Court found that some of the activities operated by Rising Stars were a violation of the Roanoke County Zoning Ordinance. Later that year, C&H Enterprises and Rising Stars Sports Camp applied for special use permits for a camp and day care center, in order to continue their current operations, and define and allow the expansion of some of their programs. In November, 2000, the Roanoke County Board of Supervisors approved the request, with detailed conditions describing the operations of the camp and day care programs. Rising Stars Sports Camp is currently operating a summer camp. If the Planning Commission recommends approval of this request, staff suggests an effective date of September 30, 2007. This would allow Rising Stars to complete their summer camp schedule, and also would follow the anticipated September 15 closing of the property sale. TopographvNegetation - The topography of the central camp development slopes down to the south from Yellow Mountain Road toward the flood plain of Back Creek. Vegetation includes open meadows, wooded areas, and the riparian areas along Back Creek. The eastern portion of the property consists of a wooded knoll extending from Yellow Mountain Road south toward Back Creek. Back Creek flows through the southwestern portion of the property, and along the southern property line. Surrounding Neighborhood - Surrounding land uses include rural single family homes, on tracts ranging from around 2 - 12 acres. Other larger acreage tracts in the vicinity have single family homes as well as agricultural land uses and mature timber. Adjoining property to the east is wooded and undeveloped, and is zoned AG-3 AgriculturallRural Preserve District. Adjoining property to the southwest, across Back Creek, is wooded and undeveloped, and is zoned AG-1 AgriculturallRural Low Density District. Adjoining property to the west is zoned AG-1 and contains a single family residence and wooded areas. Property to the north is also zoned AG-1 and contains a single family residence. The subject property is zoned AG-3S and AG-3. The existing special use permit for Rising Stars Sports Camp was granted for the 13.42 acre property zoned AG-3S. 3. ANALYSIS OF PROPOSED DEVELOPMENT Site LayoutJArchitecture - In April, 2007, the Girl Scouts Skyline Council sold Camp Dark Hollow on Catawba Valley Drive in Roanoke County. They are in the process of developing a new camp site, and are contract purchasers of 63.12 acres at and near 5488 Yellow Mountain Road. 2 The petitioner's concept plan shows most of the program center located where Rising Stars Sports Camp currently operates. The plan shows a new site manager's residence near the entry road, and two new camper lodges along the driveway. The existing camp building would be used as the main program center. The existing large athletic field would continue to be used. The upper (smaller) field would be used for other sports facilities such as basketball/tennis courts and a swimming pool. A 300-seat rustic amphitheater would be constructed near Back Creek. Per the Girl Scouts Council, the amphitheater would have wooden benches and a fire ring. The amphitheater would not have any electronic amplification, and would not operate during quiet time from 10:00 pm to 7:00 am. On the hillside to the east of the main camp area, the petitioner proposes several overnight camping sites, with tent platforms, seasonal cabins, and a camp pavilion. The concept plan also shows an "Existing AEP Easement (dirt road)" serving the upper camp pavilion. Per the drawing, the dirt road starts on the adjacent property, and winds on, off and then back on the subject property. County staff have informed the petitioner that since the adjacent property is not subject to the requested special use permit, the road could not be used for camp activities. An internal service driveway/trail would need to be constructed to link the main program center to the upper pavilion and overnight camping areas to the east. The concept plan shows a significant amount of open space on the site, but does not specifically delineate how much area would be preserved. In addition to a concept plan, the petitioner submitted a detailed facility schedule that includes descriptions of the proposed facilities, as well as phasing of construction. Information was also provided that further describes certain activities such as girl scout troop activities, day camp, overnights, special events, training and staff meetings, community use, amphitheater, and maintenance and security. Staff suggests that the Planning Commission incorporate not only the concept plan into a condition ofthe special use permit, but also the facility schedule and narrative description of activities. Access/Traffic Circulation - The facility would use the existing driveway from Yellow Mountain Road that serves Rising Stars Sports Camp. VOOT staff have recommended that additional information be gathered and analyzed regarding existing traffic on Yellow Mountain Road, build- out traffic conditions, any necessary turn lane construction on Yellow Mountain Road and enhancements to the existing entrance. The Roanoke County Traffic Engineering Manager has recommended that the petitioners conduct a Traffic Impact Analysis to address morning and evening peak hour traffic generation on weekdays and Saturdays. The Engineering Manager also expressed concerns about the future operation of U.S. 220 and Yellow Mountain Road intersection. The petitioners are in the process of conducting the Traffic Impact Analysis. Internal driveways would generally follow the existing driveway patterns, with additional parking spaces added. A total of 96 parking spaces are shown on the concept plan. In their program descriptions, the petitioners have stated that, for large special events, the organization would use buses to shuttle participants from off-site parking facilities. Fire & RescuelUtilities - Fire and rescue service would be provided from the Clearbrook Station, with the closest municipal fire hydrant located on U.S. 220 in Clearbrook, about 1.5 miles away. Fire and Rescue staff also noted the next available water source for firefighting purposes would be a dry hydrant on Yellow Mountain Road, approximately 1.2 miles from the site. They also noted that adequate water for fire protection will need to be provided either on site, or closer than the currently available sources. An outdoor swimming pool is shown on the concept plan, and 3 could possibly aid as an emergency water source during the months that the pool is filled. Back Creek runs through the property, and could possibly serve as another emergency source. Private well and septic systems are proposed. Public water and sanitary sewer services exist in Clearbrook. Public water service is planned for the U.S. 220 corridor within the next few years. That project may result in a fire hydrant along Franklin Road, bringing fire fighting water service closer to the site. Community Meeting - A community meeting was held on June 11 to introduce the project to the neighborhood. Approximately 10 citizens attended, along with the Cave Spring supervisor and planning commissioner, Vinton supervisor, representatives from the Girl Scouts and county staff. The petitioners discussed their development plans, including site layout, phasing of development and program plans. Those citizens attending inquired about traffic, the size of the proposed amphitheater, well and septic needs, lighting and noise. They also voiced concerns about other proposed rental uses of the property by community groups, and asked for clarification of that Issue. 4. CONFORMANCE WITH ROANOKE COUNTY COMMUNITY PLAN The site is designated Rural Preserve in the Roanoke County Community Plan Future Land Use Guide. The Rural Preserve areas are mostly undeveloped, outlying lands. These rural regions are generally stable and require a high degree of protection to preserve agricultural, forest, recreational and remote rural residential areas. Parks and outdoor recreational facilities are encouraged land use types in the Rural Preserve areas. The Community Plan encourages large regional parks and other recreation facilities that are designed to preserve environmentally sensitive lands and protect them from more intense land uses. The proposed girl scout camp would conform to these policies by providing a regional recreational use while protecting a significant amount of riparian area along Back Creek, as well as a significant amount of woodlands and open space. s. PROGRAM CENTER Tax Map Parcels 99.00-2-6.2 and 99.00-2-6.3 Girl Scouts of Virginia Skyline Council, Inc. ("Girl Scouts") is the contract purchaser of the referenced 63.57+/- acres on Yellow Mountain Road. The Girl Scouts propose to use the property as its Program Center to serve Girl Scouts in the Western part of Virginia. The existing improvements on the property would be utilized and additional facilities would be added in phases, A Facility Schedule and Phasing Schedule are included with the Application. All parking would be on the property. Activities would include the following: Girl Scout Troop Activities: Girl Scout Troop activities involve approximately 10 - 12 girls per troop with the possibility of more than one troop using the facility at any given time. Activities would include environmental education, wildlife counts, basic skills for backpacking and camping, fitness, computer lab, archery, animal track identification, tree and plant identification and gardening. All of the activities would be supervised by adults. Day Camp: The Day Camp would serve 50 - 150 girls per week for 10 weeks in the summer beginning in 2008. Activities would include Badge Days, camping skills, performing arts workshops, environmental education activities, talent shows and fitness. All activities would occur under adult supervision. Overnights: Overnights would occur once per month during the school year and more often during the summer. Campers would perform service proj ects for the community, learn about healthy living and be involved in arts and crafts such as basket weaving, pottery and art workshops, All activities would be supervised by adults. Special Events: It is anticipated that there will be approximately 6 special events during the year. These would include cultural days, career day, safety day (fire, bike, water, canoe, first aid, emergency preparedness and CPR), medical day (working with nursing program) and Camporees. These activities may generate 500 participants, Transportation would be provided by shuttle buses from other parking locations. Tt'aining and Staff Meetings: The existing building on the property would be utilized for volunteer training, staff meetings, the Council's annual meeting and other meetings. Community Use: The Girl Scouts plan to make the facility available for rental to religious, corporate and community groups on a daily basis when it is not being used for Girl Scout activities. Ampitheater: The ampitheater would be used by Girl Scouts for skits, talent shows and award ceremonies. Maintenance and Security: A residence will be built near the entrance to the property for the Site Manager. The Site Manager will be responsible for the maintenance and security of the property. ARTICLE III, DISTRICT REGULATIONS Page 1 of 3 SEC. 30-32. AG-3 AGRICUL TURALlRURAL PRESERVE DISTRICT. Sec. 30-32-1. Purpose. (A) The AG-3, agricultural/rural preserve district consists of land primarily used as farmland, woodlands, and widely scattered residential development located within the rural service area, Also found in these areas are lands with steep slopes, and groundwater recharge areas. Many of the county's unique natural and scenic resources are found in this district. The purpose of this district is to maintain these areas essentially in their rural state, and attempt to protect sensitive and unique land resourcesfrom degradation as recommended in the rural preserve land use category of the community plan. This may be accomplished by maintaining the existing agricultural lands and preventing the encroachment of incompatible land uses. Non-farm residents should recognize that they are located in an agricultural environment where the right- to-farm has been established as county policy. This district is also intended to minimize the demand for unanticipated public improvements and services, such as public sewer and water, by reducing development densities and discouraging large scale development. WHEREAS, Girl Scouts of Virginia Skyline Council, Inc, has filed a petition for a special use permit to operate activities, meetings, day camps, after-school programs, and overnight camping to be located on 63.12 acres at 5488 Yellow Mountain Road (Tax Map Nos. 99,00-2-6,2 and 99.00-2-6.3) in the Cave Spring Magisterial District; and WHEREAS, on November 14, 2000, the Board of Supervisors granted special use permits to C & H Enterprises, LLC and Rising Star Sports and Adventure Camp to operate a camp and a day care center on this property; and WHEREAS, it will be necessary to revoke or repeal the numerous conditions imposed on the operation of the camp and day care center; and WHEREAS, the Planning Commission held a public hearing on this matter on July 9, 2007; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia, held a first reading on this matter on June 26, 2007; the second reading and public hearing on this matter was held on July 24,2007. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Board finds that the granting of a special use permit to Girl Scouts of Virginia Skyline Council, Inc, to operate activities, meetings, day camps, after- school programs, and overnight camping to be located on 63,12 acres at 5488 Yellow Mountain Road in the Cave Spring Magisterial District is substantially in accord with the adopted 2005 Community Plan, as amended, pursuant to the provisions of Section 15.2-2232 of the 1950 Code of Virginia, as amended, and that it shall have a minimum adverse impact on the surrounding neighborhood or community, and said special use permit is hereby approved with the following conditions: (1) The property shall be developed in substantial conformance with the following three documents submitted with the application: a. In March 1992, a slope easement was dedicated to Roanoke County by Roanoke College Investment Corporation for the extension of Edgebrook Road, Virginia Secondary Route 1150, to guarantee the stability of the right-of-way for the extension of Edgebrook Road, Said easement is shown and designated as a slope easement upon plat recorded in the Clerk's Office of the Circuit Court of Roanoke County, Virginia, in Plat Book 14, Page 27, Graham-Thomas, LLC, the developers/owners of The Fairways at Hanging Rock, are requesting that a portion of the existing slope easement recorded on Plat Book 14, Page 27, dedication for the extension of Edgebrook Road, Virginia Secondary Route 1150, be quitclaimed and released as shown in Exhibit "A". In order for Pine Valley Lane, Sawgrass Court, Valhalla Court, and Cascades Court dedicated in Plat Book 24, Page 52, The Fairways at Hanging Rock, to be accepted into the state secondary road system; the Virginia Department of Transportation (VDOT) requires that the right-of-way be free and clear of any third-party rights or encumbrances, The subject portion of the slope easement within Pine Valley Lane as shown in Exhibit "A" is no longer necessary due to the construction of Pine Valley Lane.
