Good afternoon and welcome to our meeting for February 26, 2008. Regular meetings are held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be announced. "this is the twenty third consecutive year that the County has received this prestigious award. The Certificate is a national award which recognizes that the County of Roanoke has published an easily readable and efficiently organized comprehensive annual financial report whose contents surrimarizes financial information about the County and conforms to program standards. Hodge ~~~- ~~ ~~ County Administrator COUNTY ADMINISTRATOR'S COMMENTS: BACKGROUND The citizens along Springlawn Avenue approached Roanoke County and VDOT with concerns of traffic and speeding along their street in January 2005. In November 2005, the citizens along Springlawn Avenue submitted a petition to Roanoke County to close Springlawn Avenue at the intersection of Merriman Road. Rather than close Springlawn to through traffic, Roanoke County began to explore other options including traffic calming. The Springlawn Avenue project was added to the 2006-2007 Revenue Sharing list to include the following traffic calming measures (shown in Exhibit A): 1. Install 6" Modified Raised Median with landscaping on Springlawn Avenue at the intersection of Ranchcrest Drive to restrict travel lanes to ten feet. Pedestrian crosswalk will also be included in this area. 2. Install Speed Table (speed hump) on Springlawn Avenue. Location to be middle of the block between Merriman Road and Ranchcrest Drive. 3. Install 6" Modified Raised Median with landscaping at the intersection of Springlawn Avenue and Merriman Road. The median will restrict turning left onto Merriman and will not allow right turns onto Springlawn Avenue from Merriman Road. Plans for the project have been completed. Prior to construction, the Board of Supervisors must adopt a resolution authorizing the construction of traffic calming measures on Springlawn Avenue. FISCAL IMPACT: None. WHEREAS, the Virginia Department of Transportation (VDOT) has a Residential Traffic Calming Program to provide communities a traffic management tool dealing specifically with speeding in residential neighborhoods; and WHEREAS, the Virginia Department of Transportation requires that the Board of Supervisors adopt a resolution requesting that the VDOT Residential Traffic Calming Program be available to the County; and WHEREAS, a petition has been received by Roanoke County from the citizens of Springlawn Avenue (Route 1682) with signatures of approximately 92% of all property owners; and WHEREAS, Springlawn Avenue (Route 1682) has 24 dwellings and a posted speed limit of 25 mph; and WHEREAS, a speeding problem along Springlawn Avenue (Route 1682) has been noted by residents and identified by VDOT and Roanoke County Department of Community Development; and WHEREAS, the Virginia Department of Transportation performed a speed study along Springlawn Avenue (Route 1682) in May 2005, and the 85th percentile speed of vehicles on Springlawn Avenue was roughly 33 mph and the daily traffic volume along Springlawn Avenue (Route 1682) during the speed study was 970 vehicles per day; NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors does hereby approve and support the implementation of Traffic Calming Devices on Springlawn Avenue (Route 1682) to be completed in 60 days in the spring of 2008 with a budgeted cost of $50,000; NOW, THEREFORE, BE IT FURTHER RESOLVED, that a certified copy of this resolution duly attested be forthwith forwarded to the Virginia Department of Transportation, Salem Residency Office, by the Clerk to the Board of Supervisors. Mahoney County Attorney COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: On July 10, 2007, and October 9, 2007, the Board of Supervisors held work sessions on amendments to Chapter 9 "Fire Prevention and Protection" of the Roanoke County Code. During this work session staff discussed with the Board several issues concerning fire hydrants, improvements to water lines, and extensions of water lines by the Western Virginia Water Authority (WVWA). The purpose of this agenda item submit to the Board an ordinance to address'the following concerns: (i) the adoption of an ordinance and policies concerning the requirements forfire hydrants, (ii) the adoption of an ordinance and policies concerning the flow of water to these fire hydrants, and (iii) the adoption of an ordinance and policies concerning apparatus access roads. The Town of Vinton has adopted the Virginia Statewide Fire Code, and has appointed 'the Roanoke County Fire Marshal as the designated fire official for enforcement within the Town limits. It has adopted as policy the provisions in the attached ordinance. This policy shall remain in effect until Town Council can adopt amendments to the Town Code to incorporate these requirements. Fire Hydrants The proposed ordinance establishes the requirements for the installation of fire hydrants arising from the construction of new buildings or developments or the renovation of existing s~kructures in Roanoke County. § 508.5. Fire Hydrant Systems of the Statewide Fire Protection Code (SFPC) establishes certain minimal requirements for these improvements. The SFPC authorizes local governments to adopt policies or regulations that are more restrictive or more extensive in scope than the SFPC. The proposed ordinance modifies the SFPC to conform to the water system design and water flow capabilities of the Authority. Fire Flow Included in this ordinance are requirements for a minimum flow of waterto supply each fire hydrant so that it functions as intended. These minimum Fire flows are adjusted based upon the type of structures to be protected by the fire hydrant: residential, multi-family, commercial, or indus~krial, and the occupancies of these structures. For example, a minimum flow of 500 gallons per minute (GPM) is recommended for single-family residential property; however, higher flows are required for multi-family, commercial and industrial uses. It may be possible to provide 500 GPM flow from a hydrant but that flow would be inadequate if the development was a commercial structure or apartment bi.ailding. Several situations have recently occurred during the development review process concerning the lack of fire flow to serve a proposed development. The developer is willing and able to install necessary improvements to the public water system to serve his/her development; however, the proposed development will be connecting to older and smaller water lines 'that cannot supply the required quantity and flow of water to support the hydrants in or adjacent to the proposed development. Other developments have been able to satisfy fire flow requirements through the use of higher and more expensive building standards, e.g. the installation of sprinkler systems (Roanoke County Public Safety Building-Cove Road, Cox Communications addition, Vinton Public Safety Building, Blueridge Gardens Apartments-Peters Creek Road). § 508.5.1 provides that fire hydrant systems shall be located and installed as directed by the fire department. Fire hydrant systems shall conform to the written standards of the jurisdiction and the fire department. Roanoke County has not adopted any written standards for fire hydrants and fire flows. Prior to the establishment of the WVWA, the County had standards for domestic water supply and fire flow, and the location of fire hydrants. With the creation of the WVWA, the County repealed these provisions and incorporated by reference the Authority's design and construction standards. However, these standards only apply to extensions of the public water systems. The WVWA standards do not apply to water extensions that will not become part of the WVWA's system. a It is recorrimended that the Roanoke County Board of Supervisors consider adopting an ordinance amending Chapter 9 of the Roanoke County Code to establish specific fire protection standards for the placement of fire hydrants and the establishment of fire Flows in Roanoke County. Without such an ordinance, the Fire Marshal lacks the necessary authority under § 508.5.1 to enforce such standards during the development review process. Access Roads The Apparatus Access Road amendment establishes the requirements for constructing fire or emergency access roads for buildings or developments in Roanoke County. These policies clarify the responsibility and authority of the County for determining when and where access roads shall be required. It is necessary for Roanoke County to adopt an ordinance amending Chapter 9 "Fire Prevention and Protection" of the Roanoke County Code and establisl'iing these public safety requirements for the new construction of or renovations to facilities, buildings and developments in Roanoke County. STAFF RECOMMENDATION: It is recommended that the Board favorably consider the First reading of an ordinance amending Chapter 9 of the Roanoke County Code to establish specific fire protection standards for the placement of fire hydrants and the establishment of fire flows in Roanoke County and for apparatus access roads. AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, FEBRUARY 26, 2008 ORDINANCE AMENDING SECTION 9-21. "AMENDMENTS" OF ARl"ICLE. III. "VIRGINIA STATEWIDE FIRE PREVENTION CODE" OF CHAPTER 9. FIRE PREVENTION AND PROTECTION OF THE ROANOKE COUNTY CODE TO IMPLEMENT FIRE HYDRANT PLACEMENT AND FLOW STANDARDS AND AN APPARATUS ACCESS ROAD STANDARD FOR ROANOKE COUNTY WHEREAS, the Commonwealth of Virginia has adopted the Statewide Fire Prevention Code (SFPC); and WHEREAS, the 2003 edition of the Statewide Fire Prevention Code became effective December 16, 2005; and WHEREAS, § 101.5 of the Statewide Fire Prevention Code provides that any local governing body may adopt fire prevention regulations that are more restrictive or more extensive in scope than the SFPC; and WHEREAS, § 508.5.1 of the SFPC provides that fire hydrant systems shall be located and installed as directed by the fire department. Fire hydrant systems shall conform to the written standards of the jurisdiction and the fire department; and WHEREAS, § 508.1 provides that an approved water supply capable of supplying the required fire flow for fire protection shall be provided to premises upon wl-iich facilities, buildings or portions of buildings are hereafter constructed or moved into or within the jurisdiction; and WHEREAS, § 508.3 of the SFPC provides that fire flow requirements for buildings or portions of buildings and facilities shall be determined by an approved method; and WHEREAS, the Board of Supervisors of Roanoke County hereby finds that by adopting this ordinance it will establish by these written standards approved methods to provide fire protection to the citizens of Roanoke County; and WHEREAS, the Board further finds that this ordinance protects the public health, safety and welfare of its citizens; and WHEREAS, 'the first reading of this ordinance was held on February 26, 2008, and the second reading was held on March 11, 2008. NOW THEREFORE BE IT ORDAINED by 'the Board of Supervisors of Roanoke County, Virginia, as follows: 1 1. That the Roanoke County Code be, and hereby is, amended by the following amendments to § 9-21. "Amendments": ARTICLE III. VIRGINIA STATEWIDE FIRE PREVEN"PION CODE Sec. 9-21. Amendments. ***,~ (20) Fire Hydrant Placement and Flow Standards The purpose of this ordinance is to determine 'the placement of fire hydrants for fire protection to premises for facilities, buildings or portions of buildings in accordance with § 508.1 of the Statewide Fire Protection Code within Roanoke County. It applies to all major subdivisions (as defined in Chapter 29. "Subdivisions" of the Roanoke County Code), new construction, renovations that require a site plan, or changes in use of facilities or buildings. This ordinance shall serve as 'the method of deterrriining the required fire flow in accordance to the Statewide Fire Prevention Code 508.3, and authority for this policy is granted by § 508.5.1 of the Statewide Fire Prevention Code. 1. Minimum Water Main Sizes: A. Fire hydrants shall not be installed on lines less than eight inches (8") in diameter. No plantings or erection or other obstructions shall be made within afour-foot (4') radius of any fire hydrant. The surface shall be level within this same radius. B. For residential districts only, detailed design calculations may be submitted for review and approval by the Fire Marshal, the Western Virginia Water Authority (1NVWA), and the Town of Vinton if the proposed development is within the Town's east Roanoke County utility service area to substantiate line sizes other than as specified above. In any case, the minimum line size acceptable shall be six-inch (6"). For all designs, the published "C" factor shall be reduced to new pipe "C" factor rriinus 10. This reduced "C" factor shall be used to reflect more accurately the future flow in aged pipe. 2. Fire Hydrant Locations: A. In residential areas, at street intersections and at intermediate locations where necessary, as determined by the Fire Marshal's Office. In no case shall the distance between the fire hydrants, measured along the centerline of accessible streets, be greater than one thousand feet (1,000). B. Within one hundred feet (100') of any standpipe or sprinkler system fire department connection, where those systems are required in buildings. Must be located on an approved street/access road. Hydrant must be within 25 feet of street/approved access road. Elevation of street/access road and elevai:ion of hydrant must not have more than a 5% grade. No physical barriers allowed between access road and hydrant. 2 C. As required by the following schedule as given by use group, the distance shall be measured to the most remote part of the structure I:he hydrant will serve. Use Groups. D. All hydrants shall be a minimum of fifty feet (50') away from buildings other than single-family detached dwellings. The Ioca~tion of all new and exis~king hydrants that are to serve the property shall be shown on the plans. 3. Water System Design: Water systems shall be designed to adequately supply normal and peak demands for all customers as required by the Western Virginia Water Authority (WVWA) or the Town of Vinton in the east Roanoke County utility service area. If the WVWA's regulations do not apply, then any water system or lines required by this policy for the installation of a fire hydrant or for fire flows shall maintain a pressure of not less than twenty-five (25) pounds per square inch at all points of delivery, without reducing the service to existing customers below the foregoing requirement, and shall have adequate capacity to deliver not less than the fire flows listed below, for a minimum of two hours, with a residual pressure of not less than twenty (20) pounds per square inch to at least one (1) point within two hundred fifty feet (250') of each building to be served or proposed to be served by an extension. A. Peaking Factors and Demands for Design: a. Peak Hour Factor: 4 b. Maximi.im Day Factor: 2.5 c. Average Day Factor: 1 d. Residential Demand per Equivalent Residential Customer (ERC): 0.5 gallon per minute e. Industrial or commercial demands shall be based upon Best Engineering Judgment B. Fire Flow Requirements for Various Use Groups and Land Uses: a. Residential single-family/duplex: i. Single-family residential property with over 100' between buildings - 500 GPM. 3 ii. Single-family residential property with 31' - 100' between buildings - 750 GPM. iii. Single-family, single-story, residential property with 11' - 30' between buildings - 1,000 GPM. iv. Single-family, 1 '/z-story residential property with 11' - 30' between buildings - 1,000 GPM. v. Single-family, 2-story residential with 11' - 30' between buildings - 1,500 GPM. vi. Single-family, residential property with less than 11' between buildings - 1,500 GPM. b. Multi-familylCommercial/Industrial. i. R-1, R-2, R-3, and R-4 up to 2'/2 stories - 1,500 GPM. ii. R-1, R-2, R-3, and R-4 with 3 stories or more - 2,000 GPM. iii. I-1, I-2, I-3, and I-4 with 3 stories or more - 1,750 GPM. iv. I-1, I-2, I-3, and I-4 with 3 stories or more - 2,250 GPM. v. All A, B, and E use occupancies up to 2 stories - 2,000 GPM. vi. All A, B, and E use occupancies 3 stories or more - 2,500 GPM. vii. All F, H, M, and S use occupancies up to 20,000 sq. ft. - 2,500 GPM. viii. All F, H, M, and S use occupancies over 20,000 sq. ft. - 2,750 GPM. Exceptions: The required fire flow may be reduced by a maximum of 50% if proposed structures are equipped with a sprinkler system that is installed in accordance with Chapter 9. of the Virginia Uniform Statewide Building Code, and NFPA 13 for Commercial (NFPA 13R for residential). The required fire flow reduction shall not allow the total fire flow to fall below a flow of 500 GPM for residential and 750 GPM for commercial/multi-family. In areas of mixed-use development, the higher fire flow shall govern. Fire flows indicated above are for all major subdivisions (as defined in Chapter 29. "Subdivisions" of the Roanoke County Code), new construction, renovations that require a site plan, or changes in use of facilities or buildings. Where size and scope of the development exceeds these requirements, additional flow shall be provided in accordance with ISO (Insurance Services Organiza~kion) requirements as reviewed by the Fire Marshal. 5. Paint scheme and color coding of hydrants: A. Fire hydrants will have two classifications, public and private. Public hydrants will be in the public right of way and maintained by the Western Virginia Water Authority or ~khe Town of Vinton in the east Roanoke County utility service area. Private hydrants will be on private property and will fall under the responsibility of the business owner for the maintenance. To help identify the two types of fire hydrants, the following colors have been assigned to the barrels of the fire hydrants. Please note that the color of the bonnet will be determined by the flow rates and can be found in 103.01-B. 4 1. Public fire hydrants will be identified by a silver colored barrel. 2. Private fire hydrants will be identi~Fied by a white colored barrel. B. Color of the bonnet will be determined by the flow rate of the hydrant. This color designation will be 'the same on both private and public fire hydrants. 1. Black bonnet - 0 to 249 GPM. 2. Red bonnet - 250 - 499 GPM. 3. Orange bonnet - 500 - 999 GPM. 4. Green bonnet - 1,000 - 1,499 GPM. 5. Blue bonnet - 1,500 GPM and up. (21) Apparatus Access Road Standard The purpose of this section is to determine the placement of Fire Apparatus Access Roads for facilities, buildings or portions of buildings that are hereafter constructed or moved into or within the jurisdiction of Roanoke County. It does not apply to roads constructed to Virginia Department of Transportation standards or to roads constructed to County private road standards. This policy was developed in accordance with § 503.1 of the Statewide Fire Prevention Code. Existing facilities and buildings are addressed by § 503.7 of the Statewide Fire Prevention Code and Chapter 9 of the Roanoke County Code, as amended. 1. Location of access roads: A. Fire apparatus access road shall be required to allow access within 150 feet of the most remote portion of the facility or building, in accordance with § 503.1.1 of the Statewide Fire Prevention Code. B. Facilities or buildings equipped with a full sprinkler system installed in accordance with NFPA 13 may increase the distance from 150 feet to 200 feet of the most remote portion of the structure, however, ~l:he fire department connection for the sprinkler system must be accessible for fire apparatus. Additional increase may be granted due to topography, waterways, and non-negotiable grades upon the approval of the Fire Marshal. 2. Construction of access roads: A. Apparatus access roads must be designed and maintained to support the load of the fire apparatus in Roanoke County. Pumpers have a gross weight of 44,000 gvw. B. The width of 'the access road must have rriinimum clear width of 20 feet. C. The minimum overhead clearance of the access road shall be 13 feet 6 inches from finished surface. 5 D. The length of a dead end access road must have an approved area for turning around a fire apparatus if it is greater than 150 feet in length. E. The surface of a fire apparatus access road must be designed and maintained so as to provide all weather driving capabilii:ies. The surface can be made of the following: (1) Gravel (2) Asphalt (3) Concrete Access road may be designed as two-wheel paths such as parallel sidewalks. The pumper width is 99 inches for a Roanoke County fire apparatus. No vegetation f iigher than 8 inches can be planted between the two paths or sidewalks that have been designated an access road. 3. Marking of access road: A. Access roads are to be marked with yellow painted curbs and proper signage as defined in the § 9-21 of the Roanoke County Code. B. Access roads that appear as sidewalks do not have to be marked with paint and signs, with the exception of the entrance to the access road. The beginning of the sidewalklaccess road shall be marked with yellow paint and signs as defined in § 9- 21 of the Roanoke County Code. 4. Security gates and Barricades: A. The gate width of all newly-installed gates shall be approved by the Fire Marshal to make sure fire apparatus can gain access to the access road. B. Gates and barricades that are equipped with locks shall be locked with a key box to assure fire department accessibility in accordance with § 506 of the Statewide Fire Prevention Code. Roanoke County uses the Knox Box system. Ordering informakion may be obtained from the Fire Marshal. 2. Hodge ~~ County Administrator SUMMARY OF INFORMATION: At the January 22, 2008 Board of Supervisors meeting, consideration of this item was delayed for 30 days in order to give staff time to finalize documentation with English Construction related to the acquisition of the land for the Multi-Generational Recreation Center. As stated in previous reports, the multi-gen center will be the anchor for a new 190-acre international-quality corporate business parkin North County and the success of the business park is directly tied to the acquisition of land for the multi-gen center. The following updates on the project will be provided: Doug Westmoreland of Moseley Architects will present updated information on the design of the multi-gen facility, including floor plans, facade renderings, and model images of the outdoor aquatics area. Jim Johnson of Morgan Keegan and Co., the County's financial advisor, will update the Board on the status of the upcoming bond sale and the very favorable AA- ratings received for this bond package from Standard & Poor's and Fitch Ratings. These ratings and Roanoke County's overall AA rating indicate the County's strong financial position and ability to pay. Only eight of Virginia's 95 counties have ratings higher than Roanoke County, and only three match the County's general obligation bond rating. • Doug Dalton, President of English Construction Company, will present an update on the business park master plan. He will also provide the latest information about negotiations with two economic development prospects that have expressed strong interest in locating in the park with the understanding that it is anchored by the multi-gen center. TI-iis is the final Board action required for the multi-gen center. "fhe Board first authorized staff to identify a location for a proposed recreation center within the boundaries of a new business park on September 12, 2006. Since that time, staff has worked with English Construction and Moseley Architects todevelop aMulti-Generational Recreation Centerto anchor a 190-acre corporate business park at the intersection o~F I-81 and I-581. On August 28, 2007, the Board authorized staff to enter into aPublic-Private Partnership Performance Agreement with English Construction Company, Inc. to provide for infrastructure improvements todevelop the business park. In connection with the business park, the Board authorized staff to execute a Comprehensive Agreement with First Choice Public-Private Partners for the construction of aMulti-Generational Recreation Center. Additionally, the Board authorized staff to execute an Option Agreement with English Construction, Inc. to acquire approximately 12 acres of real estate for the proposed Multi- Generational Recreation Center. The Option Agreement identified three tax map parcels (26.18-1-3, 26.18-1-2, and 26.18-1-1) and a portion of a fourth parcel (26.15-1-4). The Option Agreement also provided for the conveyance of approximately 1 acre of County-owned real estate (Tax Map Parcel Number 37.07-1-5.1) to English Construction, Inc. for the widening of Valley Pointe Blvd. The road-widening project is essential for the development of the business park. The first reading of the ordinance to authorize the exercise of this option was held until January 8, 2008, in order to reconfigure the site to accommodate two economic development prospects that expressed strong interest in locating in the business park in close proximity to the multi-gen center. This redesign resulted in the elimination of the acquisition of the portion of the fourth parcel and the acquisition of a portion of a new parcel identified as Tax Map No. 26.19-1-1. The reconfiguration provides for the relocation of Valley Point Boulevard. Storm water management will be handled on-site. The design of the Multi-Generational Recreation Center is proceeding as planned under 'the Comprehensive Agreement. Plats of the proposed 12 acre site are attached. The environmental report for this parcel is complete. The subdivision of this parcel from the larger tract of real estate owned by English is in the process of review and approval. FISCAL IMPACT: -fhe Option Agreement provided that 'the County would pay English Construction Inc. $150,000 per acre for this property. $1,800,000 is appropriated and available in the Multi- Generational Center account in the County's Capital Fund. It is estimated that title insurance, title examination and other closing costs, fees and expenses required to complete this transaction will be in the amount of $5,000. ALTERNATIVES: 1) Approve the second reading of the attached ordinance authorizing the exercise of an option for the acquisition of approximately 12 acres of real estate (Tax Map Nos. 26.18- 1-2, 26.18-1-3, and part of 26.18-1-1) and the acquisition of parts of Tax Map Nos. 26.15-1-4 and 26.19-1-1 for the proposed Multi-Generational Recreation Center, and to authorize the conveyance of 1 acre of County-owned real estate for road-widening purposes. 2) Decline to authorize the exercise of this Option Agreement, allowing it to lapse. AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, FEBRUARY 26, 2008 ORDINANCE AUTHORIZING THE EXERCISE OF THE OPTION TO ACQUIRE APPROXIMATELY 12 ACRES OF REAL ESTATE FROM ENGLISH CONSTRUCTION, INC. FOR THE PROPOSED MULTI- GENERATIONAL RECREATION CENTER AND TO AUTHORIZE THE CONVEYANCE OF APPROXIMATELY 1 ACRE IDENTIFIED AS TAX MAP PARCEL NUMBER 37.07-1-5.1 TO ENGLISH CONSTRUCTION, INC. FOR ROAD WIDENING PURPOSES WHEREAS, on September 26, 2007 Roanoke County entered into an option to purchase agreement with English Construction Company, Inc. for the purchase of approximately 12 acres in the Hollins Magisterial District for the proposed Multi- Generation Recreational Center ;and WHEREAS, this Option also provided for the conveyance of a one acre parcel of real estate identified as Tax Map Number 37.07-01-05.01 owned by the County; and, WHEREAS, the County now wishes to exercise said option and purchase this real estate; and WHEREAS, the configuration of this property was redesigned to accommodate better opportunities for future economic development of a proposed business park. This redesign resulted in the acquisition of a portion of a new parcel identified as Tax Map No. 26.19-1-1. This reconfiguration provides for the relocation of Valley Point Boi.ilevard. Storm water management will be handled on-site; and WHEREAS, Section 18.04 of the Roanoke County Charter directs that the acquisition and conveyance of real estate interests be accomplished by ordinance; the first reading of this ordinance was held on January 8, 2008, and the second reading was postponed on January 22, 2008 and held on February 26, 2008; and, WHEREAS, Section 16.01 of the Charter of Roanoke County directs that the subject parcel be hereby declared surplus and be made available for other public uses by conveyance to English Construction Company, Inc. for the road widening project involving Valley Pointe Boulevard. NOW, THEREFORE, be it ordained by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the exercise of an option for the acquisition of approximately 12 acres of real estate (Tax Map Nos. 26.18-1-3, 26.18-1-2, and 26.18-1-1) as shown on a preliminary plat prepared by Hurt & Proffitt submitted February 22, 2008, and the acquisition of parts of Tax Map Nos. 26.15-1-4 and 26.19-1-1 located off Woodhaven Road owned by English Construction Company, Inc. for the sum of One Hundred Fifty "thousand Dollars per acre is hereby approved and further that the acquisition of said real estate is hereby authorized and approved. 2. That the conveyance of 1 acre of real estate (Tax Map No. 37.07-1-5.1) to English Construction Company, Inc. for the purpose of road widening and improvements to Valley Pointe Boulevard is hereby authorized and approved. 3. That the expenditure of funds, title examination and insurance, and recordation fees is hereby authorized and approved. 4. That funds will be appropriated into the Multi-Generational Center account from the Major Capital fund to pay all of the costs of this acquisition. 5. We have been notified by the VDOE that Roanoke County will receive a supplemental grant of $14,713 from funds unexpended by other school divisions during the 2006-07 school year. A 15% in-kind local funding match is required. This match will be met by billing the grant for use of facilities, and therefore will require no additional local funding. FISCAL IMPACT: The Adult Education Program budget will be increased by $14,713. ALTERNATIVES: None STAFF RECOMMENDATION: Staff recommends the acceptance and appropriation of funds in the amount of $14,713 as outlined above. ACTION NO. Please note that we are asking for a public hearing to take place at the special meeting on March 18, 2008, in order to meet VDOT's schedule for approval. SUMMARY OF INFORMATION: The following summarizes the changes made to this year's Secondary Roads Six-Year Improvement Plan, including the Revenue Sharing Priority List and Rural Addition Priority List. Roanoke County received $2.68 rriillion in VDOT allocations during this current fiscal year for secondary road improvement projects. Roanoke County's budget for FY 2008-2009 is estimated to be approximately $3.76 million (a 28.7% increase of funds or $1,074,885). Those funds will be divided into two funding categories in the six-year plan: County-Wide Incidental Irriprovements and Numbered Projects, which are both briefly explained below. Countywide Incidental Improvements ($135,000 in FY 2008-2009) include any operation, usually constructed within one year, which changes the type, width, length, location, or gradient of a road, facility, or structure. It could also include the addition of features not originally provided for such road, facility or structure. Some of the services included under this category include subdivision plan review, right-of-way engineering, preliminary engineering and surveys, traffic services, safety projects, and minor drainage improvements. Another item that has historically been included in this category is the Rural Addition Program. VDOT is not allocating any funds to the County for this program due to a balance of $894,648. Staff will be present to answer perkinent questions and discuss the feasibility of several projects on the current priority list, based on the preliminary information obtained From Engineering Concepts, Inc. The bulk of Roanoke County's allocation of funds, approximately $3.62 million, is for Numbered Projects. For clarification, these are the projects commonly referred to as "being in the Six-Year Plan". The following projects are scheduled to receive funding this year: (Boones Chapel Road, McVitty Road, Old Cave Spring Road, Colonial Avenue, Buck Mountain Road, Cotton Hill Road, Catawba Creek Road, Dry Hollow Road, Merriman Road, and Rocky Road). Roanoke County normally handles minor in-iprovement items that can be completed generally within one year, such as drainage improvements, safety enhancements, and pavement overlays through our Revenue Sharing Program. This year due to budget constraint's Roanoke County will only be requesting a $500,000 match of Funds for the FY 2008-2009 Revenue Sharing Program from the Commonwealth of Virginia instead of the maximum allocation of $1 million. As of the date of this request, Roanoke County has not been notified of our allocations. Even though Roanoke County is still waiting on our funding allocation From VDOT, staff would like to take this time to review potential projects for FY 2008-2009. The complete Secondary Roads System Six-Year Improvement Plan for FY 2008-2014 will available for your review and staff will be available to discuss the Plan. Hodge County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: In 2006, the General Assembly passed legislation directing localities to submit to VDOT for review and comment a traffic impact analysis for development proposals that would significantly impact the state transportation system. The objeci:ives of'the legislation are to provide consistent information regarding the traffic impacts of proposed land use decisions to local decision makers and cil:izens, and to ensure that traffic irripacts, both local and regional, are considered when land use decisions are made. A traffic impact analysis may be required for comprehensive plans and amendments, rezoning and special use permit applications, and site plan submittal if certain traffic generation thresholds are met. The regulations are being phased in throughout the state, with the Salem Construction District being in Group 1. Implementation for Group 1 began on July 1, 2007. As part of the implementation process, higher traffic generation thresholds are set for the first 6 months. Lower traffic generation thresholds for the Salem District began on January 1, 2008. VDOT representatives and County staff will review VDOT's Chapter 527 regulations on traffic impact analysis with the Board during the work session.
