Regular meetings are held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be announced. The meetings are broadcast live on RVTV, Channel 3, and will be rebroadcast on Thursday at 7:00 p.m. and on Saturday at 4:00 p.m. Our meetings are now closed-captioned, so it is important that anyone addressing the Board speak directly into the microphones at the podium. Kaine, Governor of the Commonwealth of Virginia, has declared the week of May 11 through May 17, 2008, as Business Appreciation Week. This week commemorates all business community partners for their daily contributions to the Commonwealth and their leadership throughout four centi.iries of commerce. The week's theme for 2008 is "The State of Small Business." Locally, each community is encouraged to participate iri Business Appreciation Week, and Roanoke County continues this tradition during this week and throughout the year. Governor Kaine will begin the recognition week by hosting a breakfast in Richmond thatwill honor the state's existing businesses. Roanoke County wishes to take this opportunity to officially recognize the contributions of our business partners who are the cornerstone for our citizens' quality of life. This year's theme, "Building Safety-Where You Live, Work, and Play", raises awareness of the importance of all aspects of building safety, encourages the development of appropriate steps to ensure that the places where we live, work and play are safe, and serves as reminder that countless lives have been saved due to the implementation of safety codes by local and state agencies. Hodge ~~,.~' County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The Marine Corps Mud Run continues to be one of the Roanoke Valley's signature running and fundraising events. This event is one that draws the interest of many individual and its team competition has become popular with school groups, athletic teams, as well as teams made up of friends and neighbors. The event represents a long running partnership, lead by the Marine Corps League and the Marine Corps Reserve Unit, Company B, 4th Combat Engineer Battalion, in cooperation with the Roanoke County Department of Parks, Recreation, and Tourism and many other corporate sponsors. The beneficiaries of this event are the nationally recognized Marine Toys for Tots program and on the local level, Camp Roanoke. This year there were over 1,500 participants and well over 4,500 spectators. We are proud of our partnership with the Marines and look forward to working with them for years to come. This year's $3,000 contribution brings the total amount contributed over the years to $60,200. These funds will be used for facility improvements at the carrip. A visit to Camp Roanoke will document the many improvements these funds have made over the years. Our record camp registrations for this summer are a testament to these improvements! The presentation will be made by Marine Corps League Commandant Gene Narvo; Junior Vice Commandant Moses Stevens; Paymaster James Stokes, III; and Mud Run Treasurer Frank Kristoff. FISCAL IMPACT: The funds will be appropriated to the Camp Roanoke Fee Class Account for improvements at the camp. Mahoney County Attorney COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Design Telecommunications, Inc. is requesting a noise ordinance waiver to perform maintenance work on nTelos PCS cell site equipment at night (between 9:00 p.m. and 7:00 a.m. the next morning) at approximately 15 locations in Roanoke County. This work must be done at night since it impacts service. Each site must be taken off the air to do this work. Each site will be completed in one night's work, so there will not be multiple nights of noise at each site. This project should be completed within 80 days; however, to avoid any extension of time for the waiver, it is recorrimended that the waiver run through August 31, 2008. The maintenance work will be completed by a crew using a large crane truck and generators. Attached to this report is a listing of all of the locations in the region. Design Telecommunications Inc. has been contracted by Ntelos PCS to do maintenance work on their cell site equipment. 'I'bis work has to be completed at night due to the fact that it is service: impacting work. The sites have to be taken off of the air for this work. The work is to commence around the hour of 9 pm and would be complete at or near 7 am the next morning. Each site will only require one night for the night portion of the work so there will not be multiple nights of noise al each site only one. `The majorities of sites are not in heavily populated areas and over all sl~oul.d not present a noise issue too many residents as a result. The project is projected to last for about 80 calendar days. I have included a list of sites this work will need to be done at as well as the contract between Ntelos and Design Telecommunications lnc. Design Telecommunications Inc. will make every effort to keep the noise to a minimum each night keeping in mind that there is a noise ordinance for a reason. Contractor will be responsible far e-mailing the scanned data to IVfI:LOS. t. Verify the packing slip identifies the speafic site, is signed and dated by the contractor. d. The Contractor wilt need to install a GPS Mount when the existing mount does not work.. 9. Contractor will test new temporary jumpers before connecting to existing BT5 and weatherproof when finished. 10. Contractor will be responsible for relocation of Mac cabinet when required. 13. Gantractor will be responsible far installing a surge protector on sites where there is no protection in the existing Mac Cabinet or PPC. Surge Protector will be provided by NTELOS. 12. Contractor wilt be responsible for pulling new A/C wire if existing is too short or wrong size an runs less than 50 feet. On runs longer than 5Q feet spiking will be allowed by either compression lugs or splicing blocks. 13. Contractor will be responsible far adding any additional grounds, conduits, seat tight or additional support far bath temporary and permanent RF jumpers that are required. 14. Contractor wilt be responsible for pulling in four Cats cables to the new BTS with RJ 45 jack on the DEMARC end and a5 many as required to the old BTS. The Pour Cats wilt Consist of red, biue, white, and yellow. Each run of CATS must be tested to ensure the jack was installed properly. 1S. Contractor will be responsible far making any arrangements necessary to overcome weather or site conditions (does not apply to roads thafi require are impassable due to erasion}. 1&. In making its determination as to whether to grant the requested waiver to Design Telecommunications, Inc. from the County's noise ordinance, the Board of Supervisors has considered the following factors: a. The time of day the noise will occur and the duration of the noise: Beginning at approximately 9:00 p.m. on Wednesday, May 14, 2008, and ending 7:00 a.m. on August 31, 2008; b. Whether the noise is intermittent or continuous: The noise produced di.iring the process of performing maintenance work on cell site equipment at numerous locations in the Roanoke Valley is done in order to minimize impacts on service. This work requires taking each site off the air for this maintenance work. c. The extensiveness of the noise: Each site will only require one night for the night portion of the work. There will not be multiple nights of noise at each site. Further many of the sites are not in heavily populated areas. d. The technical and economic feasibility of bringing the noise into conformance with the noise ordinance: This work has to be completed at night due to the fact that it is service impacting work, that is, the site must be taken off the air for this work. e. Other matters related to the impact of the noise on the health, safety, and welfare of the community and the degree of hardship resulting from enforcement of the ordinance: Work will commence at each site approximately 9:00 p.m. and will be completed by 7:00 a.m. the next morning. f. The extent to which the noise is necessary and incidental to the commercial and industrial use generating the sound: The noise to be generated by this maintenance work is limited to one night for each site. It consists of a large crane truck and generator. 2. The Board of Supervisors makes the following finding: Compliance with the provisions of the County's noise ordinance concerning the specific act of noise disturbance by construction machinery or operations under subsection (1) of Sec. 2 13-21. Specific acts as noise disturbance. or under the provision of Sec. 13-20. General prohibition. would produce serious economic hardship for Ntelos PCS and Design Telecommunications, Inc. without producing any substantial benefit to the public. 3. A public hearing was held on April 22, 2008 to receive written and oral comment from the public concerning the proposed budget and fiscal year 2009-2013 Capital Improvements Program. Attached for your approval is the Budget Appropriation Ordinance for fiscal year 2008-09. The total County budget is $383,155,528. This includes all inter-fund and intra-fund transfers. The budget net of transfers is $284,789,303. STAFF RECOMMENDATION: The format of the appropriation ordinance conforms to the reporting basis used at year-end in the Comprehensive Annual Financial Report. TI-iis presentation allows the same level of budget comparison as is required by Generally Accepted Accounting Principles for financial reporting purposes. This format will also consistently apply the appropriation on a fund basis for County funds as has been used to appropriate School funds in the past. Staff recommends approval of the first reading of the 2008-2009 fiscal year budget appropriation ordinance. That the County Administrator may authorize or delegate the authorization of the transfer of any unencumbered balance or portion thereof from one department to another. 3. That all funded outstanding encumbrances, both operating and capital, at June 30, 2008, are re-appropriated to the 2008-09 fiscal year to the same department and account for which they are encumbered in the previous year. 4. That appropriations designated for capital projects will not lapse at the end of the fiscal year but shall remain appropriated until the completion of the project or until the Board of Supervisors, by appropriate action, changes or eliminates the appropriation. Upon completion of a capital project, staff is authorized to close out the project and transfer to the funding source any remaining balances. This section applies to appropriations for Capital Projects at June 30, 2008, and appropriations in the 2008-09 budget. 5. That all school fund appropriations remaining at the end of the 2007- 08 fiscal year not lapse but shall be appropriated to the School Capital Fund in fiscal year 2008-09 as follows: a.) Two-thirds of the year end balance in the school operating fund will be allocated to the Major School Capital Reserve; b.) One-third of the year end balance in the school operating fund, not to exceed $1,000,000, will be allocated to the Minor School Capital Reserve; c.) If the one-third allocation to the Minor School Capital Reserve exceeds $1,000,000, the excess will be added to the Major School Capital Reserve. 6. That all General Fund unexpended appropriations at the end of the 2007-08 fiscal year not lapse but shall be re-appropriated, as provided by Resolution 122104-4, as follows: a) 40% of these unexpended appropriations shall be transferred to the un- appropriated Minor County Capital Fund Reserve; b) 60% of these unexpended appropriations shall be re-appropriated to the same department for expenditure in fiscal year 2008-09. 7. That all General Fund revenues collected in excess of appropriated revenues shall be re-appropriated, as provided by Resolution 122104-5, as follows: a.) Revenues in excess of budget will first be allocated to the General Fund Un-appropriated Balance, until the maximum amount for the current year is met, as specified in the General Fund Un-appropriated Balance Policy, as adopted by Resolution 122104-2; b.) The remainder of revenues in excess of budget will then be allocated to the Major County Capital Fund Reserve 8. Rescue fees collected by the Fire & Rescue Department in excess of budgeted amounts will be re-appropriated and allocated to the Fire and Rescue Capital Reserve. 9. In a previous board action on March 11, 2008, the Board of Supervisors approved a request to accept 0.08 miles of Brentwood Court (VA Sec. Rte. 1983) into VDOT's Secondary Road System and vacate a residue of existing right-of-way located on the east side of Brentwood Court. This request involves a portion of right-of-way (1,326 square feet) located on the west side of Brentwood Court and adjacent to Lot 1, Block 3, and Section 3 o~F Kingston Court, owned by C. Allen and Debra L. Wilkerson DB1609, P.G.867. County Staff has reviewed this request and recommends the right-of-way be retained as a public utility easement because utilities presently exist in the right-of-way. Once this right- of-way is vacated, the property will be combined with abutting property, as provided in Section 15.2-2274 of the Code of Virginia. Wilkerson; and WHEREAS, Appalachian Power Company, Roanoke Gas Company, Verizon and the Western Virginia Water Authority have requested that a public utility easement be retained for their utilities presently occupying the existing right-of-way; and WHEREAS, the above-described portion of street or road is more clearly indicated as "PROPOSED ABANDONMENT IN GREY" on plat designated as "ABANDONMENT OF 1,326 S.F. In no event shall one penalty exceed a total of three thousand dollars ($3,000) for a separate offense except that a series of violations arising from the commencement of land-disturbing activities without an approved plan for any site shall not result in civil penalties which exceed a total of ten thousand dollars ($10,000). The 2007 session of the Virginia General Assembly amended Section 10.1-562.J for local erosion and sediment control programs authorizing an increase in civil penalties. The civil penalty shall not be less than $100 nor more than $1,000. Staff is recommending an increase less than the maximum allowed by statute. The civil penalties process has been an effective tool in the enforcement of erosion and sediment control in Roanoke County. Because of the administrative cost associated with the enforcement of this ordinance, staff is recommending that the following civil penalties be increased: a. Increase each offense from $100 per day per violation to $300 per day per violation b. Increase failure to obey a stop work order from $100 per day to $1,000 per day c. Increase failure to stop work order when permit revoked from $100 per day to $1,000 per day d. Increase the no event series of specified violations arising from the same operative set of facts from $3,000 to $10,000 Effective date of this ordinance is July 1, 2008. PENALTIES, INJUNC"I"IONS, AND OTHER LEGAL ACTIONS A. Violators of this ordinance shall be guilty of a Class I misdemeanor. B. Civil Penalties: 1. A civil penalty in the amount listed on the schedule below shall be assessed for each violation of the respective offenses: a) Commencement of land disturbing activity without an approved plan as provided in Section 8.6-1 shall be $1,000 per day. b) Vegetative Measures -failure to comply with items 1, 2 and 3 of the Minimum Standards shall be $300 per violation per day. c) Structural Measures -failure to comply with items 2, 4, 9, 10, 11, 15 and 17 of the Minimum Standards shall be $300 per violation per day. d) Watercourse Measures -failure to comply with items 12, 13, and 15 of the Minimum Standards shall be $300 per violation per day. e) Underground Utility Measures -failure to comply with item 16(a) and/or (c) shall be $300 per violation per day. f) Failure to obey a stop work order shall be $1,000 per day. g) Failure to stop work when permit revoked $1,000 per day. 2. Each day during which the violation is found to have existed shall constitute a separate offense. However, in no event shall a series of specified violations arising from the same operative set of facts result in civil penalties which exceed a total of $10,000, except that a series of violations arising from the commencement of land- disturbing activities without an approved plan for any site shall not result in civil penalties which exceed a total of $10,000. The assessment of civil penalties according to this schedule shall be in lieu of criminal sanctions and shall preclude the prosecution of such violation as a misdemeanor under Subsection A of this section. C. The Director of Corrimuriity Development or his assignee may apply to the Circuit Court of the County of Roanoke to enjoin a violation or a threatened violation of this ordinance, without the necessity of showing that an adequate remedy at law does not exist. D. In addition to any criminal penalties provided under this ordinance, any person who violates any provision of this ordinance may be liable to the County of Roanoke in a civil action for damages. E. Civil Penalty Enumerated: Without limiting the remedies which may be obtained in this section, any person violating or failing, neglecting, or refusing to obey any injunction, mandamus or other remedy obtained pursuant to this section shall be subject, in the discretion of the court, to a civil penalty not to exceed $2,000 for each violation. A civil action for such violation or failure may be brought by the County of Roanoke. Any civil penalties assessed by a court shall be paid into the Treasury of the County of Roanoke, except that where the violator is the locality itself, or its agent, the court shall direct 'the penalty to be paid into the State Treasury. F. With the consent of any person who has violated or failed, neglected or refused to obey any regulation or condition of a permit or any provision of this ordinance, the County of Roanoke may provide for the payment of civil charges for violations in specific sums, not to exceed the limit specified in Subsection B(2) of this section. Such civil charges shall be instead of any appropriate civil penalty which could be imposed under Subsection B or E. G. The County's Attorney shall, upon request of the County of Roanoke or the permit issuing authority, take legal action to enforce the provisions of this ordinance. H. Compliance with the provisions of this ordinance shall be prima facie evidence in any legal or equitable proceeding for damages caused by erosion, siltation or sedimentation that all requirements of law have been met, and the complaining party must show negligence in order to recover any damages. 2. That the provisions of this ordinance shall be in full force and effect from and after July 1, 2008. ACTION NO. This section of the State Code and Section 3.07 of the County Charter require that any increase in Supervisors' salaries be accomplished by ordinance after public hearing between May 1 and June 30. Any increase is limited to an annual five (5%) percent inflation factor. The first reading of this proposed ordinance was held on May 13, 2008, the second reading and public hearing will be held on May 27, 2008. The current salary for Board members is $15,947.94. There is an additional annual compensation for the Chairman of the Board at $1,800 and for the Vice-Chairman at $1,200. This ordinance increases salaries by 4 percent. FISCAL IMPACTS: A 4 percent increase would cost $3,189.60 ($637.92 each). The new salary for each Board member would be $16,585.86. The appropriation request is to approve funding received from an anonymous donor in the amount of $10,000 to be used in the special education program at one of the elementary schools. 3. Roanoke County Schools and Virginia Western Con'imuriity College have an agreement whereby the college provides college level courses in English, US History, AP Calculus and certain technical and science subjects. These courses are taught by Roanoke County teachers who meet the college's criteria for adjunct professors. Monies that have been collected exceed the expenses; therefore, there is a request for these additional funds to be appropriated. Roanoke County Schools collected $138,980.00 tuition From 1005 students. VWCC will reimburse $189,187.23 for services rendered (teachers, administrating expenses, rooms, utilities, and maintenance). Roanoke County Schools owes VWCC $252,249.64 for tuition and technology fees and college service fees. The difference between what was collected and what was spent is $75,917.59. FISCAL IMPACT: Adds $26,000 to the Regional Alternative School Fund for FY 2007-08. 2. Adds $10,000 to the special education program for use at an elementary school. 3. When the business park is developed in the future, a commercial association will take over the responsibility for maintenance of the easement and retention pond. Hodge ~'-i~ County Administrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: Rocky Road, Route 744, was added to Roanoke County's Secondary Six Year Road Plan prior to 1994. Improvements to Rocky Road were to include widening, surface treatment and replacing existing culverts along a 0.52 mile portion of the road. (See Exhibit "A"). In 2002, the General Assembly passed House Bill 659 which established a Rural Rustic Road Program. The Rural Rustic Program (section 33.1-70.1 of the Code of Virginia) allows counties to make improvements to roads that have limited funds available, doing so with no or rr~iriimal encroacriment beyond existing ditches and without corriprorriising the safety of the road. The road must also be a priority in the County Six-Year Plan and must carry at least 50 but no more than 1,000 vehicles per day. The road must also be predominately used for local traffic and have minimal anticipated traffic growth. In order to participate in the Rural Rustic Road Program, the County has to pass a resolution designating a portion of Rocky Road as a rural rustic road (resolution attached). This is consistent with the information the staff shared with the Board in work session on April 22, 2008. SIIMMARY OF INFORMATION: Roanoke County is in the process of constructing a new fleet service center at the intersection of Carlos and Hollins Roads in North Roanoke County. The facility will serve both Roanoke County and the Western Virginia WaterAuthority, and bonds for financing of the project have already been approved. The estimated total project cost for the new Center is $7,701,390, with the construction portion estimated at $5,305,440. The County issued a request for bids for the construction of the center in March 2008, and the bids were received on April 21, 2008. The bid documents provided for either athree- or four-bay heavy truck area, and bidders were requested to provide pricing for each. Four bids were received, and the lowest bid for four bays was submitted by Thor Construction, in the amount of $5,314,500. The lowest bid for three bays was submitted by Avis Construction in the amount of $5,215,000. At a work session with the Board of Supervisors on April 22, 2008, the Board reviewed the bids and the plans for the center, and the consensus was to proceed with construction of the facility by Thor Construction, with a four bay heavy truck area. FISCAL IMPACT: The total cost of this project is approximately $7.7 million and funding is available through the bonds which have already been approved and a capital contribution from the Western Virginia Water Authority. STAFF RECOMMENDATION: Staff recommends that the Board approve the award of the contract for construction for the Roanoke County fleet service center to Thor Construction in the amount of $5,314,500. Overall the results advocated or supported by the County were generally positive. 1. $1.7 million operating funds for the training of correctional officers in anticipation of the opening of the new regional jail. "the regional jail is scheduled to open in March 2009 and approximately tl-iree months of training for up to 190 new correctional officers will be required before it opens. The State typically commences its funding with the opening of a new facility. Since Franklin, Montgomery, and Roanoke counties will keep their existing jails open (functioning in effect as "holding facilities"), the hiring and training of new correctional officers will be necessary. We hope to convince the Governor to include this amount in his budget; however, if he does not, we will then request the members of the local delegation to patron and support a budget amendment for this purpose. Mr. James and other County staff dedicated a significant amount of time to this initiative. We were unsuccessful is securing start-up funding; however, we were successful in recovering $1.4 million cut from the Compensation Board budget for personnel costs. 2. Funding for mental health services under the Comprehensive Services Act (SB1332). "this legislation (which was co-patroned by Delegate Fralin) and an opinion of the Attorney General (AG) substantially expands the pool of children eligible for funding for mental health services. We are concerned that by expanding this pool of potential eligible children that the budget dollars will be insufficient to satisfy the demand for services. The Governor's office is developing regulations to irriplement the legislation 1 and the Attorney General's opinion. The State pays a percentage of the cost of mandated services. There is concern that State funds will be insufficient and that the localities will be required to shoulder a significantly greater share of these costs. Senate Bill 1332 will become effective only if it reenacted by the 2008 Session. Numerous bills were introduced to address mental health issues in the wake of the Virginia Tech tragedy. The State Executive Council is directed to develop data collection standards, performance measures and management reports to evaluate child and family outcomes. Although several attempts were made during the process to amend the bill to codify the AG's opinion, local government efforts were successful in holding off efforts to further expand the pool of those eligible for mandated services. 3. Funding for pre-kindergarten education. This may have significant operational and capital fiscal impacts on Roanoke County. The General Assembly must provide local governments with the resources necessary to adequately meet the requirements of this new program. The final budget and appropriation act includes some funds for this initiative. 4. Homestead exemption constitutional amendment (SJ 354) and its adverse impact upon local governments and education. Staff previously briefed the Board on the adverse fiscal impacts if this Constitutional amendment were adopted. It is recommended that the General Assembly reject this proposal. Defeated. 5. "f he General Assembly should fully fund its unfunded liabilities in the Virginia Retirement System and restore VRS to an actuarially sound status. Not addressed. 6. Support for funding of a joint venture of Carillon and Virginia Tech for a medical school and research institute at the Riverside Corporate Center in the City of Roanoke. Roanoke City and the Alleghany Regional Plaririing District Commission have recommended that the General Assembly provide financial support for the construction and operation of a new medical school and research institute in Roanoke. The final budget and appropriation act includes bond issue funding for this project. 2 7. Annexation Moratorium. Even though Roanoke County has been granted total immunity from city-initiated annexations, this issue arose as a result of the Governor's veto of a bill extending the statewide moratorium on city- initiated annexations or the creation of new cities. We believe that it will be necessary to closely monitor this issue in the 2008 Session. Moratorium still ends 2010, but it would not expire earlier if appropriations to local governments for law enforcement expenditures were less than the amount statutorily required (S742, Ch. 347). We expect this issue to receive more attention from the Governor over the coming months and potentially through the rest of his administration. 8. Impact of the transportation legislation (HB3202), and its effect on road projects and funding in the Roanoke Valley. In addition, we would seek funding for the widening of I-81, construction of I-73,and improvements to U.S. Routes 11/460, 220, and 221 No additional funding for these road projects. 9. Support for $100,000 funding annually for three years to celebrate the 75tH Anniversary of the Blue Ridge Parkway in 2010. The State of North Carolina has already appropriated funds for this celebration. "fhe Blue Ridge Parkway is requesting the Commonwealth of Virginia to do the same. No funding was provided. 10. In 2002, the General Asserribly passed a law that gave Payday lenders an exception to state laws that capped interest rates that banks can charge on most loans at 36%. These lenders do not have to meet the same standards and regulations that other lenders must follow. They charge on average 386 percent on small, short term loans. The General Assembly should repeal the Payday Loan Act and cap interest rates on such loans to no more than 36%. Payday Loan Act was amended to cap interest rates at 36% and to impose additional requirements to protect consumers. (H 12, Ch.849) 11. Roanoke County is requested to support the designation of a driving route to be called the Wilderness Road: Virginia's Heritage Migration Route from Winchester to Cumberland Gap including two spurs of the Carolina Road and the Fincastle/Cumberland Turnpike. This driving route is being developed to promote the history, heritage, and culture of the early pioneer settlement and migration through Virginia and the role that Virginia played in this migration and the development of our nation. This 3 designation would help develop a new tourism product to increase economic growth and tourism spending in the region. Wilderness Road designation (Ch.687). During the Session, County staff also supported SB 614 which would have allowed localities to contract with the Virginia Retirement System to manage and invest funds used to pay for post employment benefits. For the second year in a row this bill died in committee. 2009 Legislative Issues 1) Explore Park's future may be a major concern if Virginia Living History does not exercise the lease option. Funding of the park, reversion of the land to the State, and other options for the use of the park will need to be determined. HB 1142/Chapter 655 extends the term of the reversion of the VRFA to the Commonwealth in the event it ceases to operate a project until July 2009. 2) VRS management and investment of funds for localities for post employment benefits. 3) Dr. McCrary advises that the Federal government is requiring that monthly visits to every foster child and every CPS case begiririing by Oct. 2011. There has been no allocated money for these increased expenses or money for increased staff to meet this need. The bill for more staff funding was introduced for a second time this year, and again defeated. 4) SB 768 would abolish the cash proffer system and replace it with capped impact fees for roads, schools, and public safety facilities only. Regional funding for transportation and other public i.ases after Virginia Supreme Court ruling striking down the taxing authority by unelected regional entities. 5) Changes in the match rates for CSA. 6) A Joint Study Committee will be looking at how to improve the ability of local government to implement the land use changes embodied in HB3202 (2007). This 2-year study is charged with making interim recommendations for the 2009 session. We believe the committee's work should be monitored closely for potential recorrimendations impacting local land use authority both positive and negative and as appropriate provide comment to the committee on behalf of the county. Hodge ~~~ ~~- County Adn-~inistrator COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: On April 22, 2008, the Board held a work session on the proposed changes to the Roanoke County retiree health insurance bene~Fit. After the presentation, the Board requested a second work session, so that they could study the issue further before making a decision. Roanoke County first set up a retiree health insurance care benefit in 1986. This program was added at the request of retired employees and was intended to supplement Medicare benefits as well as provide a benefit for retirees who were not yet eligible for Medicare. In recent years, adrriinisterir~g health care benefits has become increasingly complex and costly. This is a national problem, and one that is being addressed by governments and corporations everywhere. We have reviewed this benefit because of recent changes in national accounting standards requiring all state and local governments to change the way they report retiree benefits. In 'the past, we recorded these expenses on a "pay as you go" basis which only recognized that year's actual cost for health insurance claims and premiums. Starting inFiscal year 2007-2008, we will be required to account for the accumulated cost of a retiree's future benefits before that employee reaches retirement. This change greatly increases the overall liability shown on the County's financial statement as well as the amount that must be budgeted to fund the program. The County formed a committee made up of current and retired employees and staff from Finance and Human Resources to examine our options and provide recommendations. Our goal was to maintain as much of the retiree health care benefit as possible while still being financially responsible. We had to find ways to make the program more affordable due to the financial liabilities imposed by the Governmental Accounting Standards Board (GASB) 45. In an effort to do this, we surveyed other localities, all of which are making changes to health care programs for retirees. The Retiree Health Insurance Focus Group has been meeting since December 2007. "fhe Focus Group has reached consensus, and the recommendations accomplish our goals in the following ways: • Much of the retiree health insurance benefit will be preserved by incorporating IVledicare Advantage plans into the program for retirees who are Medicare eligible. The consensus of the Focus Group was to use the Individual Medicare Advantage Plans; however, several of the members felt more comfortable with the Group Medicare Advantage Plan. • Eligibility requirements and premium contributions will be modified to give preference to the longer-term employees. • The Virginia Retirement Health Insurance Credit will be extended to all employees. • Implement the new plan effective January 1, 2009, so that we have adequate time to make the transition. Meetings were held with both retirees and employees over the past several weeks to explain the plan options and answer questions. We received feedback from the meetings, mostly involving transitional issues, which we have incorporated into the presentation. This time has been set aside for staff to make a full presentation to review the options for consideration of the Retiree Health Focus Group. Attachment A is a summary that highlights the recommended changes to the Retiree Health Insurance. Attachment B shows the impact on GASB 45. Members from the Retiree Health Focus Group will also be present at the meeting.
