WHEREAS, Elmer C. Hodge has advised the Board of Supervisors of Roanoke
County of his intention to retire from the office of County Administrator effective June
30, 2408; and

retirement from County employment until his accumulated leave balance is exhausted.
NOVI! THEREFORE, BE IT RESOLVED, By the Board of Supervisors of Roanoke
County, Virginia, as follows:
~ . That the Board hereby accepts the notification of retirement of Elmer C. Hodge
from the office of County Administrator effective June 30, X008; that it approves
his accumulation of leave in excess of the flexible leave policy; and that he may
defer his effective final date of retirement from County employment until said
leave balance is exhausted.
2. That the Board hereby designates Elmer C. Hodge as the County's
representative to the l5th Anniversary of the Blue Ridge Parkway; and that it
authorizes the reimbursement of his actual expenses incurred in such
representation.

WHEREAS, Elmer C. Hodge has advised the Board of Supervisors of Roanoke
County of his intention to retire from the office of County Administrator effective June
30, 2008; and,
WHEREAS, Section 4.0~ of the Roanoke County Charter provides that the Board
may designate some responsible person without regard to his or her residence on an
interim basis to perform the duties of this office.
NOW THEREFORE, BE IT RESOLVED, that tl~e Board of Supervisors of
Roanoke County, Virginia, hereby appoints John M. Chambliss, Jr., as interim County
Administrator to fill the vacancy in this office until a permanent replacement is
appointed, and increase his/her compensation by ten percent (10%) during the term of
this interim appointment.

SUMMARY of INFORMATION:
In July 2001, the County of Roanoke loaned Virginia Recreational Facilities Authority
(VRFA) $250,000 with an interest-free promissory note. There is still an outstanding
balance of $125,000 on this note.
The park operations are now closed down, and the VRFA does not have a way to generate
additional funds to paythe remainderof the loan. However, the park does have a sizable
inventory of non-historic items that can be used by the County in various departments.
VRFA would like to give the County this non-historic inventory, in entirety, for full payment
of the loan. The fair value of this inventory exceeds the remaining balance of the note.
Several Countydepartments have alreadyexpressedinterest inthe attached items, which
totals $138,710, and is not the complete inventory.
We would like to give the other County departments a chance to look at the remaining
items and see whatthey would like to use in their areas. After all useful items have been
ider~tified we will declare the balance as surplus property and sell it through our on-line
auction process.
FISCAL IMPACT:
The County would write off the balance of the promissory note to VRFA ($125,000) in
exchange for the non-historic inventory.
STAFF RECOMMENDATION:
Staff recommends accepting the non-historic inventoryfrom Explore Park as full payment
of the loan to VRFA.

RESOLUTION 06008-4.a URGING GGVERN~R KAINE AND THE
VIRGINIA GENERAL ASSEMBLY T4 ENACT A SIGNIFICANT
TRANSP~RTATI~N FUNDING PACKAGE DURING THE
FGR'I•HCOMING SPECIAL LEGISLA'~IVE SESSIGN
WHEREAS, an efficient transportation network is crucial to sustainable economic
growth in the Commonwealth, a cleaner environment, and enhanced public safety and
quality of life; and
WHEREAS, the Commonwealth faces a doci~~mented transportation funding
shortfall including a recurring and in~l~lating road maintenance funding shortfall resulting
in the Commonwealth Transportation Board eliminating and reducing programmed
project spending totaling $1.1 billion in the new six-year transportation program; and
WHEREAS, the Virginia Department of Transportation is transferring almost
$400 million in fiscal year 2008 from road construction funds to support road
maintenance activities; and
WHEREAS, the eliminated and stalled project monies include primary, urban,
and secondary construction funding reductions to regions and localities of up to 44
percent for fiscal year 2009; and
WHEREAS, funding for new highway and bridge construction is diminished as
the annual road maintenance shortfall continues to escalate, and the estimate to repair
the Commonwealth's 1,100 deficient bridges totals more than $3 billion; and
WHEREAS, regions of economic importance to the Commonwealth, including
Han~ipton Roads and Northern Virginia, confront major transportation funding challenges
in addition to those shared by all other areas of the Commonwealth; and
WHEREAS, transferring state general funds to transportation neither adequately
supports documented and recurring transportation infrastructure investment needs nor
serves to protect the Commonwealth's additional core services including public
education, health care, mental health and retardation, and public safety; and
WHEREAS, Virginia has the nation's seventh lowest motor vel~~icle sales tax rate
and the Commonwealth last enacted dedicated, new, significant, and recurring annual
statewide revenues for transportation in 1986 including the last increase in Virginia's
modestly low gas tax rate of 11.5 cents per gallon; and
WHEREAS, since 2006 the Commonwealth has enacted significant reforms to
improve the coordination between transportation and local land-use planning.
NaW, THEREFORE, BE IT RESGLVED that the Board of Supervisors of
Roanoke County, Virginia, hereby calls on the Governor of Virginia and the Virginia
General Assembly during the forthcoming transportation special session to enact a
significant transportation funding package to include dedicated, new, significant, and
recurring annual revenues to address the Commonwealth's documented transportation
infrastructure needs.
BE IT FURTHER RESOLVED that the Board of Supervisors urges the Governor
of Virginia and the Virginia General Assembly to enact dedicated, new, significant, and
recurring annual revenues to eliminate the road maintenance shortfall; increase funding
directed to interstate and primary highways, urban and secondary roads, and transit
projects; guard against the transfer of general funds to transportation; and address the
unique transportation ~~eeds of specific regions of ~rhe Commonwealth including initially
Hampton Roads and Northern Virginia.
And that the Clerk to the Board of Supervisors is hereby directed to send a copy
of this resolution to the Governor, the members of the General Assembly representing
the Roanoke Valley, and the Virginia Association of Counties.

SUMMARY ~F INF4RMATIGN:
Earlier this spring Roanoke County's Informatian Tecr~nology Department and Emergency
Communications Center joined forces to submit a grant application to the State Wireless
Board. This grant will provide updated building footprints and address points on the
County's Geographic Information System.
Roanoke County needs to complete the maintenance and clean up of our building
footprints and address point creation or correction. We will use these funds to purchase
building footprints from Virginia Geographic Information Network ~VGIN} corresponding to
our aerials, as ourfootprints are from 1995 and the aerials are from 2006. With corrected
building footprints, we will contract for address point creation. There are about 8000
address points which need point location correction.
The County must have this information updated before the Computer Aided Dispatch
software upgrade scheduled to occur during the 2008 calendar year.
FISCAL IMPACT:
Matching funds of $30,000 will be required and these funds will come from several
departmental budgets including the Information Tecr~nology Department. "there are no
recurring funding requirements, such as maintenance, etc.
ALTERNATIVES:
1) Accept and appropriate the grant funds of $120,000 to the Information Technology
Department.
2) Do not accept the grant funds of $120,000.

Staff recommends alternative 1, accept and appropriate the grant in the amount of
$120,000 to the Information Technology Department.

Since July 2004, the Commonwealth Attorney's office has been providing service to the
Town of Vinton through a contractual arrangement. -fhe Town pays a fee to the Gounty,
which is then distributed as a supplement to the Assistant Attorneys in the Commonwealth
Attorney's office. In return, they handle the prosecution of the Town of Vinton's criminal
cases, including traffic infractions, misdemeanors, and preliminary hearings of felony
cases.
This arrangement has worked well for both parties, and they would like to renew the
contract again, with the same terms as the current contract. A copy of the contract is
attached .
FISCAL IMPACT:
The Town will paythe County $8,200 to provide legal services forthe 2008-09 fiscal year.
This money will be paid to the five Assistant Cornmonwealth's Attorneys, as a supplement
of $58.60 per pay period. The $8,200 will also coverthe employerportion ofthe FICAtax
for these employees.

1. Approve the attached contract for the County Commonwealth's Attorney office to
provide legal services to the Town of Vinton for the 2048-04 fiscal year.

CGNTRACT FGR PR~FESSIQNA.L LEGAL SERVICES
BE IT KNOWN THAT this agreement is entered into by and between the Town of Vinton,
Virginia thereinafter sometimes referred to as "Town"} and Roanoke County Commonwealth's
Attorney thereinafter sometimes referred to as "Counsel"}.
Counsel hereby agrees to furnish the following services:
Representing the Town in the prosecution of criminal cases, including but not limited to traffic
infractions, misdemeanors, civil and mental hearings, and preliminary hearings of felony cases,
as well as cases in Juvenile and Domestic Relations Court, and in the Court of Appeals of
Virginia on petitions for writ of error. Counsel will also act as a legal advisor on criminal issues
for the local law enforcement Town of Vinton Police Department}.
The scope of this contract does not include litigation or proceedings arising out of or involving
tort or worker's compensation.
These legal services are to be provided under the immediate supervision of the Roanoke County
Commonwealth's Attorney, Edwin Randy Leach, III.
In consideration of services described hereinabove, the Town hereby agrees to pay the Counsel
$8,200 per annum to be used as follows;
1. Each of the five attorneys listed in Attachment A will receive a pay supplement of $58.60
per pay period. Based on 26 pay periods per year, this amounts to an annual supplement
of $1640 each including the employer portion of FICA tax at $4.49 per pay period}.
2. Any amounts remaining, due to turnover in the office, may be used by Counsel for other
office expenses, related to Vinton cases.
Upon execution of the contract, the Town should mail a check in the amount of $8,200 to the
County of Roanoke, Attention Ms. Diane D. Hyatt, PD Box 29800, Roanoke, VA 24018,
At least semi-annually, Council will provide a summary of cases handled by Council, showing a
breakdown of the cases handled on behalf of the Town of Vinton.
The County of Roanoke will include the pay supplement on the County payroll checks for the
attorneys listed on Attachrent A. Any change in attorneys will require an amendment to
Attachment A, which will need to be signed by the County Chief Financial Officer, in order to
insure that the payroll change is made. A copy of this amendment will by mailed to the Town of
Vinton, Attention Mr. Kevin Boggess, 311 South Pollard Street, Vinton, VA 24179,
This contract is for a one year period only, commencing July 1, 2008 and ending on June 30,
2009. This contract may be renegotiated on an annual basis, This contract should be
renegotiated thirty days before the beginning of the new fiscal year in order to insure the
continuation of the payroll supplement to the individual attorneys.
All records, reports, documents and other material delivered or transmitted to Counsel by Town
shall remain the property of Town, and shall be returned by Counsel to Town, at Counsel's
expense, at termination or expiration of this contract. All records, reports, documents, pleadings,
exhibits ar other material related to this contract andlor obtained or prepared by Counsel in
connection with the performance of the services contracted for herein shall become the property
Town, and shall, upon request, be returned by Counsel to Town, at termination or expiration of
this contract.
The Town and Counsel acknowledge and agree that the Department of Justice has the right to
review all records, reports, worksheets or any other material of either party related to this
contract, The Town and Counsel further agree that they or either of them will furnish to the
Department of Justice, upon request, copies of any and all records, reports, worksheets, bills,
statements or any other material of Counsel or Town related to this contract,
Counsel agrees to abide by the requirements of the following as applicable: Title VI and VII of
the Civil Rights Act of 194, as amended by the Equal Opportunity Act of 1972, Federal
Executive Order 1124G, the Federal Rehabilitation Act of 1973, as amended, the Vietnam Era
Veteran's Readjustment Assistance Act of 1974, Title I~ of the Education Amendments of 197,
the Age Act of 1975, and counsel agrees to abide by the requirements of the Americans with
Disabilities Act of 1990,
Counsel agrees not to discriminate in its employment practices, and will render services under
this contract without regard to race, color, religion, sex, national origin, veteran status, political
affiliation, ar disabilities.

RESOLUTION Ofi~00S-4.e REQUESTING ACCEPTANCE OF THE REMAINING
PORTION OF CRUTCHFIELD STREET INTO THEVIRGINIA DEPARTMENTOF
TRANSPORTATION SECONDARY SYSTEM.
VIIHEREAS, the streets described on the attached Addition Form LA-54A}, fully
incorporated herein by reference, are shown on plats recorded in the Clerk's Office of the
Circuit Court of Roanoke County, and
V1lHEREAS, the representative for the Virginia Department of Transportation has
advised this Board that the streets} meet the requirements established by the Virginia
Department of Transportation's Subdivision Street Requirements, and
1NHEREAS, the County and the Virginia Department of Transportation have entered
into an agreement on March 9, 1999, for comprehensive stormwater detention which
applies to this request for addition,
NOVA, THEREFORE, BE IT RESOLVED, this Board requests the Virginia
Department of Transportation to add the streets} described on the attached Additions
Form LA-5~A} to the secondary system of state highways, pursuant to X33.1-229, Code of
Virginia, and the Department's Subdivision Street Requirements, after receiving a copy of
this resolution and all outstanding fees and documents required of the developer,
whichever occurs last in time.
BE IT FUR-f HER RESOLVED, this Board guarantees a clear and unrestricted right-
of-way, as described, and any necessary easements for cuts, fills and drainage, and
BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to
the Residency Administrator for the Virginia Department of Transporka~kion.

easement 20 feet in width to receive storm and surface water drainage from the
County's multi-generational recreatian center to a creek. The deed of easement is
attached to this Board report.

documents to signify the County's acceptance of this donation.

WHEREAS Grantor is the owner of Parcel A as shown on the Plat, containing

WHEREAS Grantor has agreed to provide Grantee an easement across Parcel A for
storm and surface water drainage facilities;
NOW, THEREFORE, Grantor hereby gives grants and conveys unto Crrantee a
nonexclusive easement 20 feet in width over, under and across Parcel A ~"Drainage Easement"}
for the construction, installation, maintenance, inspection, replacement and repair of suitable
facilities for stogy and surface water drainage, including pipes, ditches and culverts and the right
of ingress and egress thereto, the center line of which is as follows:
Beginning at a point that is N. 83° 52' 48" E. 62 feet from the
northwesterly corner of Parcel B; thence leaving the beginning
point S. 57° 33' 16" E. 126.53 feet to a point; thence N. a~° 07'
47" w', 273.23 feet to a point; thence in a northeasterly direction
N. 26° 06' 35" E. 29x.00 feet to a point; thence N.12° 48' Q2" E.
70,04 feet to a point at a creek; and
Together with a temporary construction easement 15 feet in width over, under and
across Parcel A ~"Tempvrary Easement"} as reasonably required to construct and
install the drainage facilities, including the right to stockpile top soil and the right
to excavate and grade the area adjoining the Drainage Easement, ~vhieh
Temporary Easement shall adjoin the easterly boundary of the Drainage

Upon completion of construction and installation of the drainage facilities, Grantee will
cause the Temporary Easement area to be smoothed and restored as nearly as feasible to its
original condition, and the Temporary Easement will terminate.

Roanoke County Schools requests that the Board accept and appropriate the following:
Certain personnel of Roanoke County Public Schools are requiredto maintain certifications
andlor licensures in orderto be eligible to bill for Medicaid services. `these expenses are
paid by the employee.
Roanoke County Public Schools has collected approximately $77,000 from Medicaid
Administrative Claiming and would like to request that $1,937.50 of the funds be
appropriated to reimburse those certification costs for the 2007-08 school year.
FISCAL IMPACT:
The special education budget will be increased by $1,937.50.

SUMMARY OF INFORMATION:
Roanoke County Schools requests that the Board accept and appropriate the fallowing:
The Virginia Department of Transportation recently paid the Roanoke County Public
Schools $51,950 for an easement to the property bordering West Main Street (U.S. Route
11) in front of Fort Lewis Elementary School. The staff recommends that these funds be
appropriated in a separate capital account to be used by Fort Lewis Elementary School for
campus improvements when West Main Street is widened in front of the school.
FISCAL IMPACT:
The Capital Account will be increased by $51,950.

STAFF RECOMMENDATION:
Staff recommends the acceptance and appropriation of funds in the amount of $51,950.
