The Board of Supervisors of Roanoke County, Virginia, met this day at the
Roanoke County Administration Center, this being the second Tuesday and the first
regularly scheduled meeting of the month of June 2008.
IN RE:
CALL TO ORDER
Chairman Flora called the meeting to order at 3:00 p.m. The roll call was
taken.

REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF
AGENDA ITEMS
Mr. Mahoney requested that a closed meeting be added pursuant to the
provisions of Section 2.2-3711 (A) (29) of the Code of Virginia discussion of the award
of a public contract involving the expenditure of public funds, including interviews of
bidders or offerors, and discussion of the terms or scope of such contract, where
discussion in an open session would adversely affect the bargaining position or
negotiating strategy of the public body, namely Branch Mac. It was the consensus of
the Board to add the item to the closed meeting.

Chairman Flora and Supervisor Altizer presented the certificates of
recognition to Ms. Wheeler, Mr. Snow, and Coach Highfill. Todd McGraw and Brian
Wood were not present. Also in attendance were Dr. Lorraine Lange, School
Superintendent; Fuzzy Minnix, School Board Member; Marlena Hollowell, Assistant
Principal, William Byrd High School; and Coach Krista Martin, Swimming.

3. Certificate of recoanition to Roanoke County Schools for beina
selected one of the Best 100 Communities for Music Education in
America in 2008
Chairman Flora presented the certificate of recognition to School
Superintendent Lorraine Lange and Music Coordinator Barry Tucker. School Board
Member Fuzzy Minnix was also in attendance.
4. Recoanition of the Budaet Department for receivina the
Government Finance Officers Association (GFOA) Distinauished
Budaet Presentation Award for Fiscal Year 2007-2008
Chairman Flora presented the award to Brent Robertson, Budget Director.
Mr. Robertson introduced the Budget Department staff: Holly Salvatore, Budget
Manager; Jimmy Lyon, Budget Analyst; and Nicholas Benne, Intern. The Board
congratulated the Budget Department for receiving this award for the 21st consecutive
year.

NEW BUSINESS

Mr. Mahoney advised that Mr. Hodge is retiring as County Administrator
and the Board needs to formally adopt a resolution accepting this notification of
retirement. He stated that the resolution also designates Mr. Hodge as the County's
representative to the 75th Anniversary of the Blue Ridge Parkway.
Supervisor Flora moved to adopt the resolution and stated that Mr. Hodge
has been a fine County Administrator and wished him well in his retirement. The motion
carried by the following recorded vote:

RESOLUTION 061008-1 ACCEPTING THE RETIREMENT OF ELMER
C. HODGE AS COUNTY ADMINISTRATOR AND APPOINTING HIM TO
SERVE AS THE COUNTY'S REPRESENTATIVE TO THE 75TH
ANNIVERSARY OF THE BLUE RIDGE PARKWAY
WHEREAS, Elmer C. Hodge has advised the Board of Supervisors of Roanoke
County of his intention to retire from the office of County Administrator effective June
30, 2008; and
WHEREAS, the Board has allowed him to defer the effective final date of his
retirement from County employment until his accumulated leave balance is exhausted.
NOW THEREFORE, BE IT RESOLVED, By the Board of Supervisors of
Roanoke County, Virginia, as follows:
1. That the Board hereby accepts the notification of retirement of Elmer C.
Hodge from the office of County Administrator effective June 30, 2008; that it
approves his accumulation of leave in excess of the flexible leave policy; and
that he may defer his effective final date of retirement from County
employment until said leave balance is exhausted.
2. That the Board hereb~ designates Elmer C. Hodge as the County's
representative to the 75t Anniversary of the Blue Ridge Parkway; and that it
authorizes the reimbursement of his actual expenses incurred in such
representation.

2. Reauest to adopt ! resolution appointina an Actina County
Administrator. (Paul Mahonev. County Attornev)

Mr. Mahoney advised that the Roanoke County Charter provides for the
Board of Supervisors to designate a responsible person to perform the duties of the
office of County Administrator on an interim basis until the Board can select a
permanent replacement. He stated that he has drafted a resolution for the Board's
consideration and the Board will need to fill in the name of the Interim County
Administrator on the resolution. He noted that the resolution provides for an increase in
compensation during the term of the interim appointment.
Supervisor Flora advised that there are some outstanding senior staff
members and assistant county administrators that would make excellent interim county
administrators. He stated that the Board's decision was not to appoint anyone in the
interim who may be a candidate for the position of County Administrator. He stated that
the Board has chosen the senior member of the staff, John Chambliss.
There was no discussion.
Supervisor Flora moved to adopt the resolution with the name of John
Chambliss inserted as the Interim County Administrator. The motion carried by the

RESOLUTION 061008-2 APPOINTING AN ACTING COUNTY
ADMINISTRA TOR
WHEREAS, Elmer C. Hodge has advised the Board of Supervisors of Roanoke
County of his intention to retire from the office of County Administrator effective June
30, 2008; and,
WHEREAS, Section 4.05 of the Roanoke County Charter provides that the Board
may designate some responsible person without regard to his or her residence on an
interim basis to perform the duties of this office.
NOW THEREFORE, BE IT RESOLVED, that the Board of Supervisors of
Roanoke County, Virginia, hereby appoints John M. Chambliss, Jr., as interim County
Administrator to fill the vacancy in this office until a permanent replacement is
appointed, and increase his/her compensation by ten percent (10%) during the term of
this interim appointment.
On motion of Supervisor Flora to adopt the resolution, and carried by the

3. Reauest to acceDt non-historic inventory items as full Dayment
for the outstandina balance of Virainia Recreational Facilities
Authority (VRFA) loan. (Diane Hyatt. Chief Financial Officer)

Ms. Hyatt advised that in July 2001, the County loaned VRFA $250,000
with an interest-free promissory note. She advised that there is still an outstanding
balance of $125,000 on this note. She stated that since the park operations are now
closed, the VRFA does not have a way to repay the balance of this loan; however, they
have a sizable inventory of non-historic items that can be used by the County in various
departments. She reported that the list of items was reviewed with the Board at a work

session on May 27, 2008, and these items more than cover the market value of the
outstanding loan and have been identified specifically for use by Parks, Recreation and
Tourism, Social Services and General Services. She stated that additional inventory
will be made available for other County departments. She advised that the VRFA has
approved the transfer of the non-historic inventory to payoff the promissory note and it
is staff's recommendation that the balance of the note in the amount of $125,000 be
written off with the transfer of these inventory items.
Supervisor Altizer made the motion to approve staff's recommendation.
He asked Ms. Hyatt what would happen to items that are not needed in the County
departments. Ms. Hyatt stated they would be listed on the County on-line surplus
auction.

Mr. Haislip reported that the Board considered changes to the park
ordinance at their work session on March 25, 2008, to address issues brought by the
remote control plane community and their concerns about the County requiring a permit
to fly their planes in County parks. He advised that at the work session, the Board
delayed action on the proposed section of the ordinance dealing with remote control
planes so staff could meet with representatives of the flying community to develop
acceptable standards and policies.
Mr. Haislip stated that staff has met with the representatives of the flying
community. He advised that it is being recommended by staff that people who wish to
fly remote control planes, and who wish to obtain a permit from the County to fly the
planes, be required to be a member of the Academy of Model Aeronautics as an Open
Member. He noted that membership in this group provides significant liability and
property damage insurance. He stated that as part of the policy, staff would identify
appropriate places to fly and identify the types of aircraft that would be allowed to fly in
the parks. He noted that for the large gas-powered aircraft, a large amount of space is
needed. He stated that currently Green Hill Park is the only park with designated areas
appropriate for flying the remote control planes.
Supervisor Flora moved to approve the first reading and set the second
reading for June 24, 2008. The motion carried by the following recorded vote:

Chairman Flora announced that staff has requested that the second
reading of this ordinance be deferred until June 24, 2008.
IN RE: APPOINTMENTS
1: Board of Zonina Aooeals (aooointed ~ district)
Chairman Flora advised that the five-year term of Richard L. Jones, Jr.,
Catawba Magisterial District, will expire on June 30, 2008. Supervisor Church
requested that the Clerk contact Mr. Jones to see if he is willing to serve another term.
2. Parks. Recreation and Tourism Advisory Commission (Aooointed
~ District)
Chairman Flora advised that the three-year term of Lee Blair, Cave
Spring Magisterial District, will expire on June 30, 2008.

3. Roanoke Vallev-Alleahanv Reaional Commission
Chairman Flora advised that the three-year term of Elmer Hodge, non-
elected representative, will expire on June 30, 2008. It was the consensus of the Board
to appoint John Chambliss, Interim County Administrator, to serve in this capacity for
the period of time that he is Interim County Administrator and to place confirmation of
the appointment on the Consent Agenda.
4. Social Services Advisory Board (aDDointed ~ district)
Chairman Flora advised that the four-year term of Douglas C. Forbes,
Vinton Magisterial District, will expire July 31, 2008. Mr. Forbes is not eligible for
reappointment as he has served two consecutive terms. Supervisor Altizer stated that
he should have an appointment in the next couple of weeks.
Chairman Flora advised that the four-year term of Janet Green, Windsor
Hills Magisterial District, will expire July 31, 2008. Ms. Green is eligible for
reappointment. As requested by Supervisor McNamara, Ms. Green was contacted and
has indicated her willingness to serve an additional four-year term. It was the
consensus of the Board to place confirmation of this appointment on the Consent
Agenda.
Chairman Flora advised that the representative from the Catawba
Magisterial District has resigned. This four-year term will expire July 31, 2009.
Supervisor Church advised that he is working to find a replacement for this committee
appointment.

5. Western Virainia Water Authoritv
The four-year term of Richard E. Huff, II, member at large, will expire on
June 30, 2008. At-large members are selected by the majority vote of the other six
members of the Board and confirmed by Roanoke City Council and the Roanoke
County Board of Supervisors.

RESOLUTION 061008-4.a URGING GOVERNOR KAINE AND THE
VIRGINIA GENERAL ASSEMBLY TO ENACT A SIGNIFICANT
TRANSPORTATION FUNDING PACKAGE DURING THE
FORTHCOMING SPECIAL LEGISLATIVE SESSION
WHEREAS, an efficient transportation network is crucial to sustainable economic
growth in the Commonwealth, a cleaner environment, and enhanced public safety and
quality of life; and
WHEREAS, the Commonwealth faces a documented transportation funding
shortfall including a recurring and inflating road maintenance funding shortfall resulting
in the Commonwealth Transportation Board eliminating and reducing programmed
project spending totaling $1.1 billion in the new six-year transportation program; and
WHEREAS, the Virginia Department of Transportation is transferring almost
$400 million in fiscal year 2008 from road construction funds to support road
maintenance activities; and
WHEREAS, the eliminated and stalled project monies include primary, urban,
and secondary construction funding reductions to regions and localities of up to 44
percent for fiscal year 2009; and
WHEREAS, funding for new highway and bridge construction is diminished as
the annual road maintenance shortfall continues to escalate, and the estimate to repair
the Commonwealth's 1,700 deficient bridges totals more than $3 billion; and

WHEREAS, regions of economic importance to the Commonwealth, including
Hampton Roads and Northern Virginia, confront major transportation funding challenges
in addition to those shared by all other areas of the Commonwealth; and
WHEREAS, transferring state general funds to transportation neither adequately
supports documented and recurring transportation infrastructure investment needs nor
serves to protect the Commonwealth's additional core services including public
education, health care, mental health and retardation, and public safety; and
WHEREAS, Virginia has the nation's seventh lowest motor vehicle sales tax rate
and the Commonwealth last enacted dedicated, new, significant, and recurring annual
statewide revenues for transportation in 1986 including the last increase in Virginia's
modestly low gas tax rate of 17.5 cents per gallon; and
WHEREAS, since 2006 the Commonwealth has enacted significant reforms to
improve the coordination between transportation and local land-use planning.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia, hereby calls on the Governor of Virginia and the Virginia
General Assembly during the forthcoming transportation special session to enact a
significant transportation funding package to include dedicated, new, significant, and
recurring annual revenues to address the Commonwealth's documented transportation
infrastructure needs.
BE IT FURTHER RESOLVED that the Board of Supervisors urges the Governor
of Virginia and the Virginia General Assembly to enact dedicated, new, significant, and
recurring annual revenues to eliminate the road maintenance shortfall; increase funding
directed to interstate and primary highways, urban and secondary roads, and transit
projects; guard against the transfer of general funds to transportation; and address the
unique transportation needs of specific regions of the Commonwealth including initially
Hampton Roads and Northern Virginia.
And that the Clerk to the Board of Supervisors is hereby directed to send a copy
of this resolution to the Governor, the members of the General Assembly representing
the Roanoke Valley, and the Virginia Association of Counties.

RESOLUTION 061008-4.d REQUESTING ACCEPTANCE OF GANDER WAY
INTO THE VIRGINIA DEPARTMENT OF TRANSPORTATION SECONDARY
SYSTEM.
WHEREAS, the streets described on the attached Addition Form LA-5(A), fully
incorporated herein by reference, are shown on plats recorded in the Clerk's Office of
the Circuit Court of Roanoke County, and
WHEREAS, the representative for the Virginia Department of Transportation has
advised this Board that the street(s) meet the requirements established by the Virginia
Department of Transportation's Subdivision Street Requirements, and
WHEREAS, the County and the Virginia Department of Transportation have
entered into an agreement on March 9, 1999, for comprehensive stormwater detention
which applies to this request for addition,
NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia
Department of Transportation to add the street(s) described on the attached Additions
Form LA-5(A) to the secondary system of state highways, pursuant to 933.1-229, Code
of Virginia, and the Department's Subdivision Street Requirements, after receiving a
copy of this resolution and all outstanding fees and documents required of the
developer, whichever occurs last in time.
BE IT FURTHER RESOLVED, this Board guarantees a clear and unrestricted
right-of-way, as described, and any necessary easements for cuts, fills and drainage,
and
BE IT FURTHER RESOLVED, that a certified copy of this resolution be
forwarded to the Residency Administrator for the Virginia Department of Transportation.

IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Church: (1) He advised that the groundbreaking for the multi-
generational recreation center was held this morning and thanked all those who
attended. He gave a special thanks to Elmer Hodge for his work on the project. (2) He
recognized Roanoke City Police Officer Bryan Lawrence who was seriously injured
while attempting to arrest a suspect. He stated that Officer Lawrence is undergoing
extensive therapy in Atlanta, Georgia, and wants him and his family to know that he and
the Board wish him a speedy recovery.
Supervisor Flora: (1) He extended his congratulations to all the high
school seniors who will graduate in the next few days, especially his granddaughter,
Michelle Flora, a student at Glenvar High School. He stated that he is proud of the
students in the valley.

The work session was held from 4:30 p.m. until 5:40 p.m.
Ms. Hyatt introduced Mr. Johnson and Mr. Roddy with Morgan Keegan &
Company, and stated that Mr. Chittum would give the Board background information on
COAs.
Mr. Chittum advised that CDAs have been used in Virginia for
approximately 15 years and he has followed their use from an economic development
standpoint as a way to finance public infrastructure projects. He stated that with State
budget cuts and less money from the Virginia Department of Transportation (VOGT) to
finance roads, and less money that localities have for water and sewer projects, he has
explored the CDAs as a way to enhance the community. He advised that the staff has

been reviewing the CDAs and advised that Mr. Mahoney will explain to the Board the
steps that will need to be taken to adopt a CDA.
Mr. Johnson narrated the PowerPoint presentation entitled "Roanoke
County - Overview of Community Development Authorities - June 10, 2008" (a copy of
which is on file in the Clerk's Office).
Mr. Mahoney advised that there are three advantages to adopting a CDA:
(1) the County has advisors who are familiar with CDAs; (2) the County's bond counsel
has worked with CDAs throughout the Commonwealth of Virginia; and (3) the County
can look at what others around the State have done and use their experiences in
helping to adopt a CDA for Roanoke County. He explained that if the Board wants to go
forward with creating a CDA, they must adopt an ordinance to elect to assume the
powers to consider petitions for the creation of a CDA. He noted that prior to adoption
of the ordinance, the Board must hold a public hearing. He stated that the staff would
draft a set of guidelines that would establish the criteria for evaluating petitions for the
creation of a CDA. He explained that if the County receives a petition to create a CDA
for a specific project, it has been recommended by bond counsel that a Memorandum of
Understanding (MOU) be provided setting out the details of the project, and before
adopting a second ordinance creating a specific CDA for a specific project. He advised
that the staff could have the first ordinance and the set of guidelines ready for the
Board's review within the month.

The Board directed Mr. Mahoney to prepare an ordinance supporting the
consideration of CDAs, develop guidelines for analyzing potential CDA projects, and to
bring the information back to the Board at the first meeting in July.

WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by
the Board of Supervisors of Roanoke County, Virginia, that such closed meeting was

WORK SESSION
1: Work Session to discuss drainaae proiects and provide an update
reaardina the Stormwater Manaaement Proaram. (Tarek Moneir,

The work session was held from 6:59 p.m. until 7:30 p.m., with Supervisor
Church absent.
County staff present included the following: Arnold Covey, Director of
Community Development; George Simpson, County Engineer; Butch Workman, Storm
Water Operations Manager; Jeff Altice, Storm Water Operations Supervisor; Kafi
Naphlin, Civil Engineer I; and members of the Storm Water Drainage Crew.
Mr. Moneir advised that the staff will give an overview of the Storm Water
Management Program, and discuss the accomplishments and challenges of the
program.
Mr. Workman introduced the members of the Storm Water Drainage Crew
and then narrated a PowerPoint presentation entitled, "Roanoke County Storm Water
Management - Board of Supervisors Work Session - June 10, 2008" (a copy of which
is on file in the Clerk's Office). The following information was provided to the Board
members, a copy of which is on file in the Clerk's Office: "Roanoke County Storm
Water Completed Projects (04-08)"; "Maintenance Responsibility"; "Priority List
Procedures"; and "Exhibit 'B' New Projects P#323 - P#326". Staff advised that new

projects P#323 through P#326, will be brought back to the Board for approval at a future
date.
There was discussion concerning the lack of detention pond maintenance
by some homeowners associations and the difficulty of locating responsible parties
when maintenance is required. The Board directed that the staff bring back possible
solutions to this problem at a future meeting.
