IN RE: CALL TO ORDER Chairman Flora called the meeting to order at 3:00 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Richard C. Flora, Vice-Chairman Michael W. The Pledge of Allegiance was recited by all present. 364 May 13, 2008 IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS, AND AWARDS .1: Proclamation declarina the week of Mav 11 throuah 17. 2008. as Business ADDreciation Week in the County of Roanoke Doug Chittum, Director of Economic Development, and Neil Wilkin, President and Chief Executive Officer of Optical Cable Corporation, accepted the proclamation. Proclamation declarina the week of Mav ~ throuah ~ 2008. as Buildina Safety Week in the County of Roanoke Tarek Moneir, Deputy Director of Development, and Joel Baker, Building Commissioner, accepted the proclamation. Mr. Baker advised the Board that his May 13, 2008 365 division within Community Development would now be known as the Office of Building Safety to emphasize the division's focus on safety issues. IN RE: NEW BUSINESS 1: Presentation from the U. S. Marine Corps Reserve Unit and the Marine Corps Leaaue and appropriation of J3.000 proceeds from the 12th annual Marine Mud Run. (Pete Haislip. Director of Parks. Recreation. and Tourism) A-051308-1 Mr. Haislip reviewed the event's history and the improvements to Camp Roanoke that have been undertaken as a result of past donations. The check was presented by Marine Corps League Commandant Gene Narvo and Paymaster James Stokes, III, who received certificates of recognition from Chairman Flora. The Board commended the Marine Corps Reserve Unit and the Marine Corps League for their hard work and offered its thanks for the many generous donations through the years. Supervisor Flora moved to approve the staff recommendation (accept and appropriate the $3,000 contribution from the twelfth annual Marine Corps Mud Run to the Camp Roanoke fee class account). Reauest to adopt! resolution arantina ! waiver under Section 13- 23 of the Roanoke County Code to the provisions of the County's noise ordinance. Article !h Noise of Chapter 13: Offenses : Miscellaneous of the Roanoke County Code. Desian Telecommunications. Inc. and nTelos PCS. (Paul Mahonev. County Attorney) Mr. Mahoney advised that Design Telecommunications Inc., a contractor based in Charlottesville, Virginia, was hired by nTelos to perform equipment maintenance at nTelos cell phone tower sites. He displayed a map showing the fifteen locations in Roanoke County where this work will be performed. He reported that Design Telecommunications has requested a waiver from the County noise ordinance in order to perform this maintenance from 9:00 p.m. until 7:00 a.m. However, based on citizen complaints, the bulk of the work seems to be undertaken between 12:00 a.m. and 5:00 a.m. He stated that the company will be replacing equipment in the boxes located at the base of the towers which requires the use of a large diesel boom truck and a generator. He added that the generator is used to test the new equipment after it is installed. He advised that the work is being performed at night to minimize service disruptions. Mr. Mahoney advised that the project is expected to be completed in approximately 80 days; however, in order to avoid having to bring the matter back to the Board if the work takes longer than expected, he has extended the wavier through the May 13, 2008 367 month of August. He stated that the work will be performed at locations throughout the region as shown in the documentation provided to the Board and that staff in Community Development provided the location map. Supervisor Flora inquired what the level of noise in decibels is on a typical installation. Mr. Mahoney responded that he did not have that information; however, he advised that this waiver request is a consequence of a citizen calling the police as a result of his sleep being disrupted which lead to the work being halted for the night. He added that the boom truck is a diesel and that the officer described the generator's sound as a hammering noise. Mr. Mahoney noted that based on the location map, several of the sites are in areas that are not highly populated. Supervisor Altizer inquired about the duration of the loudest noise. Mr. Mahoney reported that the officer stated that the generator used to test the equipment created the loudest noise but that he did not know how long the generator is run during a typical installation. Supervisor Church advised that the County has not always had the best record in dealing with noise reduction and that he would have preferred that the petitioner had requested the waiver before dispatch was called. He added that it was hard to tell from the available information which sites are located in the County and that he is not inclined to approve the request without additional information. Supervisor Altizer suggested that it would be helpful if the citizens at each location could be notified prior to the beginning of the work and that the petitioner 368 May 13, 2008 provide a work schedule so the waiver could be granted for specific days rather than as a blanket waiver. Supervisor McNamara advised that the appropriate recommendations have been made by the Board and that he also would like to hear from the petitioner prior to making a decision on the request. It was the consensus of the Board to hold a work session on this item at the next meeting prior to reconsidering the item during the evening session. The Board requested that Mr. Mahoney contact the petitioner and request that a representative of their organization attend the work session and Board meeting to answer questions. Supervisor Church moved to defer this item until the May 27, 2008, Board meeting. The motion carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None IN RE: FIRST READING OF ORDINANCES 1. First readina of an ordinance to aoorooriate funds for the fiscal year 2008-2009 budaet and aooroval of the Classification Plan for fiscal year 2008-2009. (Brent Robertson. Director of Manaaement and Budaet) Mr. Robertson advised that the fiscal year (FY) 2008-2009 budget was presented to the Board of Supervisors on April 22, 2008, and a public hearing was held on that date. He reported that the total County budget is $383,155,528 including all May 13, 2008 369 inter-fund and intra-fund transfers and the School Board's budget. He added that the budget net of transfers is $284,789,303. Mr. Robertson advised that the format of the appropriation ordinance conforms to the reporting basis used at year-end in the Comprehensive Annual Financial Report. He reported that this presentation allows the level of budget comparison required by generally accepted accounting principles for financial reporting purposes. Mr. Robertson recommended approval of the first reading of the FY 2008- 2009 budget appropriation ordinance and the FY 2008-2009 Classification Plan. He advised that the second reading of the ordinance and the resolution adopting the budget are scheduled for May 27, 2008. Mr. Hodge advised that the state balanced its own budget by reducing aid to local governments in both FY 2009 and 2010. He reported that the County's share of the reduction is estimated to be $550,000 or $1.1 million over the two-year period. He added that these reductions in funding are in addition to the state's previously announced reductions. He stated that there were three methods of handling this reduction and that staff was recommending the third method although the Board may direct staff to do otherwise. He reported that the first option is to take the reductions out of one or more of the programs included in the state funding list. The second method is to reduce multiple state aid programs proportionally or by a specific percentage 370 May 13, 2008 reduction. The third method is to reimburse the state in total for the County's share of the reductions. Mr. Hodge advised that staff prefers the third method to maintain the original base-line funding for each program at a higher level for future budgets. He reported that other localities are taking the same approach which will require making a lump-sum payment to the state. He added that this payment has been incorporated in the budget which has been balanced with that reduction in place. He noted that some of the programs that appeared on the state's cut list are programs mandated by the state. He stated that staff is concerned that these cuts could be continued beyond the next two fiscal years and suggested that the Board discuss this during the work session on the County's legislative program. Supervisor Altizer stated that this is a big backdoor tax increase for the citizens; and, although he concurs with staff's recommendation, it is sad that the County has to subsidize the state. Supervisor Church commended staff for their fine job preparing the budget. He added that he agreed with Supervisor Altizer regarding the state's reductions. Supervisor Flora advised that making a lump-sum payment to the state is the method being used by a majority of jurisdictions and is the method also recommended by the Virginia Association of Counties. He added that the concern is May 13, 2008 371 that the reductions could become permanent and that the County now has a line item in the budget for support for the Commonwealth. Supervisor Flora moved to approve the first reading and set the second reading for May 27,2008. Windsor Hills Maaisterial District. (Arnold Covey. Director of Community DeveloDment) Mr. Covey advised this is a housekeeping item as a result of a previous board action on March 11, 2008, when the Board approved a request to accept 0.08 miles of Brentwood Court into VDOT's Secondary Road System and vacate a residue of existing right-of-way located on the east side of Brentwood Court. He added that once this right-of-way is vacated, the property will be combined with abutting property. He reported that staff has reviewed this request and recommends that the right-of-way be retained as a public utility easement because utilities presently exist in the right-of-way. He advised that all costs will be borne by the petitioner and that staff is recommending approval of the first reading. 372 May 13, 2008 There was no discussion on this item. Supervisor McNamara moved to approve the first reading and set the second reading and public hearing for May 27, 2008. The motion carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None 3. First readina of an ordinance amendina Section 8.1-9 Penalties. Iniunctions. and other Leaal Actions of Chapter 8.1 Erosion and Sediment Control of the Roanoke County Code. (Tarek Moneir. Deputy Director of Development) Mr. Moneir advised that on January 27,2004, the Board adopted a County ordinance repealing Chapter 8 - "Erosion and Sediment Control' and adopting a new Chapter 8.1 entitled "Erosion and Sediment Control" of the Roanoke County Code. He stated that this ordinance contained a subsection 8.1-9 titled "PENALTIES, INJUNCTIONS, AND OTHER LEGAL ACTIONS" which outlines various civil penalties. He advised that since the adoption of this ordinance, staff has been working with local developers and home builders to protect the environment and water courses in the County. Mr. Moneir stated that the 2007 session of the Virginia General Assembly amended Section 10.1-562.J for local erosion and sediment control programs authorizing an increase in civil penalties. He reported that the civil penalty shall not be May 13, 2008 373 less than $100 or more than $1,000 and that staff is recommending an increase less than the maximum allowed by statute. Mr. Moneir advised that the civil penalties process has been an effective tool in the enforcement of erosion and sediment control in Roanoke County. He stated that because of the administrative costs associated with the enforcement of this ordinance, staff is recommending that the following civil penalties be increased: (a) increase each offense from $100 per day per violation to $300 per day per violation; (b) increase failure to obey a stop work order from $100 per day to $1,000 per day; (c) increase failure to stop work order when permit revoked from $100 per day to $1,000 per day; and (d) increase the no event series of specified violations arising from the same operative set of facts from $3,000 to $10,000 Mr. Moneir advised that the effective date of this ordinance will be July 1, 2008, and there will be no fiscal impact as a result of this item. He requested that the Board set May 27,2008, for public hearing prior to the second reading. There was no discussion on this item. Supervisor McNamara moved to approve the first reading and set the second reading and public hearing for May 27, 2008. First readina of an ordinance to increase the salaries of the members of the Board of SUDervisors of Roanoke County Dursuant to Section 3.07 of the Roanoke County Charter and Section 15.2-1414.3 of the Code of Virainia. (Paul M. Mahonev. County Attornev) Mr. Mahoney advised that the State Code and Section 3.07 of the County Charter establish a procedure for increasing the salaries of local governing bodies including the Board of Supervisors. He reported that the proposed ordinance would increase the salaries of the Board members by approximately 4 percent, an increase that is similar to the salary increases that the Board is contemplating for County employees and staff. He stated that if the ordinance is adopted by the Board, it would increase the Board's salaries by $637.92 per member. He reported that it would also establish an additional salary for the Chairman and Vice Chairman. He advised that the second reading and public hearing are being advertised for 7:00 p.m. on May 27,2008. In response to Supervisor Church's inquiry, Mr. Mahoney reported that the increase was an annual one rather than per pay period. Supervisor Flora moved to approve the first reading and set the second reading and public hearing for May 27, 2008. SCOTT, TREASURER'S OFFICE, ON THE OCCASION OF HER RETIREMENT AFTER FOURTEEN YEARS OF SERVICE WHEREAS, Mildred H. Scott was first employed part-time by Roanoke County on April 13, 1994, as a Clerk in the Treasurer's Office; and became a full-time employee on October 15, 1997; and WHEREAS, Ms. Scott retired from the Roanoke County Treasurer's Office on April 1, 2008, after fourteen years and six months of service; and WHEREAS, Ms. Scott has served as an active member of the Roanoke County Employee Advisory Committee (EAC) since 1999; and WHEREAS, Ms. Scott was instrumental in establishing the first Annual Employee Appreciation Picnic in May 2004 sponsored by the County and the EAC, and continues to give of her time and talents to support the annual picnic which will be held on May 17, 2008; and WHEREAS, during her tenure in the Treasurer's Office, Ms. Scott demonstrated the highest standards of professionalism and positive customer service; and WHEREAS, Ms. Scott, through her employment with Roanoke County, has been instrumental in improving the quality of life for its citizens. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to MILDRED H. SCOTT on the occasion of her retirement after more than fourteen years of capable, loyal, and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. On motion of Supervisor Altizer to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None May 13, 2008 379 RESOLUTION 051308-2.e REQUESTING THE VIRGINIA DEPARTMENT OF TRANSPORTATION TO DESIGNATE A PORTION OF ROCKY ROAD (ROUTE 744) AS A RURAL RUSTIC ROAD. WHEREAS, Section 33.1-70.1 of the Code of Virginia, permits the improvements and hard surfacing of certain unpaved roads deemed to qualify for designation as a Rural Rustic Road; and WHEREAS, any such road must be located in a low-density development area and have a minimum of 50 vehicles per day (vpd), and have no more than 1,000 vehicles per day; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia ("Board") desires to consider whether Rocky Road, Route 744 From: 1.24 miles from the intersection with Bent Mountain Road. Route 221 To: Bottom Creek Road. Route 607 should be designated a Rural Rustic Road; and WHEREAS, the Board is unaware of pending development that will significantly affect the existing traffic on this road; and WHEREAS, the citizens that utilize this road have been made aware that this road may be paved with minimal improvements; and WHEREAS, the Board believes that this road should be so designated due to its qualifying characteristics and will endeavor to retain these characteristics through its comprehensive planning process; and WHEREAS, this road is in the Board's six-year plan for improvements to the secondary system of state highways. NOW, THEREFORE, BE IT RESOLVED, that the Board herby designates this portion of Rocky Road as a Rural Rustic Road, and requests that the Residency Administrator for the Virginia Department of Transportation concur in this designation. BE IT FURTHER RESOLVED, that the Board requests that this road be hard surfaced and, to the fullest extent prudent, be improved within the existing right of way and ditch-lines to preserve as much as possible the adjacent trees, vegetation, side slopes, and rural rustic character along the road in their current state. BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Residency Administrator for the Virginia Department of Transportation. Proclamations sianed ~ the Chairman IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor McNamara: (1) He congratulated the winners of the recent local elections adding that he was looking forward to working with the newly elected. He extended his appreciation to those who did not win their races since their participation is crucial to the democratic process. (2) He stated that the Board is a strong advocate of regionalism, and he advised that he is looking forward to working with the County's neighboring localities. Supervisor Moore: (1) She advised the residents of Penn Forest that Ford Mennel has ordered silencers for the roof vents at Mennel Mill and that they will be installed in approximately 6 weeks. (2) She thanked the youths who play in the Cave May 13, 2008 381 Spring National Little League and South County Softball Association. She stated that she was proud to attend their kick off a few weeks ago and wished the participants good luck. Supervisor Flora: He advised that he and Supervisor Church had recently attended the ribbon cutting ceremony for the new Gander Mountain Store. He added it was a great event, and he welcomed Gander Mountain to the County. IN RE: CLOSED MEETING At 4:25 p.m., Supervisor Flora moved to go into closed meeting following the work sessions pursuant to the Code of Virginia Section 2.2-3711 A (1) discussion or consideration of the employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining or resignation of specific public officers The motion carried by the following recorded vote: AYES: Supervisors Moore, Church, Altizer, McNamara, Flora NAYS: None IN RE: WORK SESSIONS 1.: Work session to review the 2008 General Assembly session and oreyiew the 2009 session. (Paul Mahoney. County Attorney: Eldon James. Leaislative Liaison) The work session was held from 4:41 p.m. until 5:17 p.m. Mr. Mahoney and Mr. James reviewed the status of the County's 2008 legislative program. Mr. Mahoney requested that the Board begin identifying priorities 382 May 13, 2008 for the County's 2009 legislative program. Mr. James advised that the shrinking economy will be a key factor in the General Assembly's future actions and advised the Board that frequent meetings with the local state delegation will be the most effective method of promoting the County's legislative program. As a result of discussion, the following issues were identified: (1) funding for transportation and roads; (2) the state balancing its budget by reducing aid to local governments; (3) land uses issues including impact fees; (4) the status of the annexation moratorium; (5) the future of Explore Park; (6) VRS management of retirement investments; (7) unfunded or partially funded state mandates; (8) energy and environmental issues; and (9) funding for the Blue Ridge Parkway 75th anniversary celebration. Mr. Mahoney requested that the Board continue to develop the County's legislative program throughout the summer and plan to meet with Mr. James and the local state delegation in August before finalizing the legislative program in November. Mr. James advised that he would also meet with the members of the local state delegation on a one-on-one basis. He reported that this practice was effective when the County was pursuing funding for the regional jail. It was the consensus of the Board to proceed accordingly. 2. Work session to review the retiree health insurance proaram. (Diane Hvatt. She advised that staff would not recommend utilizing a trust to fund the program initially if the Board chose to implement individual plans but would recommend using a trust if a group plan was implemented due to the increased financial impact that a group plan would have. After a general discussion, it was the consensus of the Board to implement the program with individual retirement plans, and staff was directed to bring this item back for approval at the May 27,2008, Board meeting. 3. After a general discussion, it was the consensus of the Board to make the following changes in charitable donations: Economic Development Partnership-an additional 4 percent; Roanoke Valley Convention and Visitor's Bureau-an additional $20,000; Virginia Western Community College-increase to $40,000; Vinton Chamber of Commerce- increase to $4,500.
