The Virginia Department of Transportation has an allocation of $800,000 in federal entitlement funds if there is $200,000 in local matching funds available. This money would be used for the planning, engineering and environmental impact statement for the creation of the Roanoke River Parkway, a ten-mile extension of the Blue Ridge Parkway from Tinker Creek to Hardy Ford Bridge. The Explore Project has asked that Roanoke County request the State to approve $200,000 in recreational funds for this purpose. The County has an annual entitlement of $200,000 each fiscal year, of which we are in the process of requesting $70,000 for Happy Hollow Park, $26,000 for Vinyard Park, and $30,000 for Whispering Pines Park, This totals $126,000, leaving a balance of $74,000 available for future requests. Staff at the Explore Project also plan to ask neighboring localities to allot unused portions of their recreational access funds. If they agree, Roanoke County's share will be reduced and this will lessen the impact on previous requests. ~~ FISCAL IMPACT: None. RECOMMENDATION• Staff recommends that the Board approve the prepared resolution requesting $200,000 from this year's entitlement for recreational access funds for the Explore Project, with the understanding that within the next sixty days, neighboring localities will be asked to participate. The Staff further recommends that if these localities participate, the prepared resolution will be amended to reflect the decreased amount that Roanoke County is requesting. ? ~ } ~ ~ _ Elmer C. RIPLEY DIRECTOR OF PLANNING AND PROGRAMMING Explore Project MEMORANDUM TO: The File On November 24, I had a discussion with Mr. Elmer Hodge, County Administrator for Roanoke County, in relation to Recreational Access Funds for the Explore Project in Roanoke County, Bedford County and Franklin County. We have gotten down to a close time frame and we need to proceed with this project to the Department of Conservation and Historic Resources, along with the Commonwealth Transportation Board. We are in need of the authorization of $200,000 of Recreational Access Funds for this project. I told Mr. Hodge that if the Roanoke County Board would adopt a resolution on December 1, 1987, agreeing to use their $200,000 eligibility for FY 87-88 for the Explore Project, we would proceed to the Conservation and Historic Resources, along with our Board, to receive approval of-the $200,000 at the December 17 Beard meeting. Subsequently, Mr. Hodge is to talk with the County of Bedford and the County of Franklin to obtain a commitment from them, by resolution, to charge a portion which I believe will be one-third of the Recreational Access Fund; that is, $200,000 against their eligibility for FY 87-88. In the final analysis, if this works, we would be charging against the eligibility of each of the three counties in the amount of $66,666. The funding was with the understanding that the residents in the two (2) areas would donate easements allowing the installation of various facilities. For your review and direction, we have described each phase of both projects with bid prices and status. A. Sun Valley/Palm Valley ($55,526): 1. Provides a 15 inch concrete storm sewer to drain the sinkhole adjacent to Return Road (Bid Price: $14,526); we have received commitments from all property owners for necessary easements. This project has been authorized by Staff. 2. Improve the outlet channel for the 60 inch storm sewer originating from Roanoke City. (Bid Price: $41,000); At the Board's direction, staff has contacted Roanoke City about participating in the cost of improving the concrete flume. Staff has and is continuing to discuss with Roanoke City cost participation on the project. 3. Use the Roanoke County Drainage Crew to clean debris from the banks of Carvins' Creek (Bid Price: n/a); The County Crew is working in this area. r~s; ^--...... s Mme'-...: B. South Park/Willowlawn ($39,579): 1. Replace the existing 15 inch culvert from South Park Circle to Mudlick Creek with a 54 inch culvert and enlarge the existing roadside ditch upstream from the culvert. (Bid Price: $32,570); During our negotiations with property owners along the roadside ditch, we found out that we would have sanitary sewer lateral conflicts if we were to enlarge the ditch. Based on this information, we have modified the project to consist of replacing the existing culvert with a 42 inch concrete culvert. All adjoining property owners have committed to the necessary easements. 2. Provide a paved ditch from Willowlawn Road to the existing drainageway adjacent to South Park Circle. (Bid Price: $7,000); The county staff continues to negotiate with adjacent property owners as to a final location for the paved ditch. 3. Use the Roanoke County Drainage Crew to clean debris from the Bank of Mudlick Creek (Bid Price: n/a); the County Crew is scheduled to begin work at the conclusion of their work on Carvins Creek. FISCAL IMPACT: Funding for these projects are included in the current drainage budget. To date, the crew has completed five (5) of the seven (7) projects (See Attachment A). The two (2) remaining projects (cleaning streambanks in the vicinity of South Park Circle and Palm Valley Road) have been started but could take one (1) additional month to complete. Since July, staff as directed by the County Administrator contracted with Rockbridge Excavating Company to improve a drainageway near the Fort Lewis Fire Station. In addition, staff. has included drainage improvements along Cove Road and Burnt Quarter Circle in the preliminary Secondary Highway Six Year Construction Plan. All of the drainage projects, including these two, which will be completed using Secondary Highway Funding are shown on Attachment B. Staff is preparing an overall project listing based on the Community Meetings and the Drainage Complaint Process. In January, staff will make a presentation to identify these projects, and will recommend funding alternatives. Even though the drainage crew has two (2) activities scheduled for the next month, approval of additional projects is needed from the Board. Several weeks are generally required for preliminary engineering and acquiring easements in advance of the drainage crew. Therefore, we recommend that the Board approve the projects shown on the attached priority list (See Attachment C. L~` - FISCAL IMPACT: Funding for the maintenance projects is in the approved Drainage Budget for F.Y. 87-88. PROJECT DOCUMENT The purpose of this agreement between Lingerfelt Development Corporation (the Developer) and the County of Roanoke (the "County") is to cause the development of a mixed use business park in the vicinity of the southeast intersection of Interstate Routes 81 and 581 in Roanoke County, Virginia (Valleypointe) comprising one or more of the following uses: light industrial, warehousing, office, hotel, retail and multi-family residential. I. Site. Valleypointe will include approximately 250 acres substantially as shown on the site plan attached as Exhibit A. It is contemplated that Phase I will include approximately 50 acres of developed lots and Phase II will include aproximately 160 acres of developed lots. II. Use. Although Valleypointe will be mixed use develop- ment, Developer has agreed with the County that the completed design of Valleypointe will provide no more than twenty-five percent (25$) of the developable land area for residential use, and that the residential use which becomes part of the project, if any, is multi- family as opposed to single family residential. It is understood that Phase I will not consist of any new residential use. III. Property Assemblage. The Developer will have the primary responsibility for assembling the real property for Phase I and Phase II. 1 E-'~ The County's responsibility is to acquire land from the Regional Airport Commission for the Phase I access road. IV. Roads. The Developer will prepare a final site plan for Phases I and II showing the circulation concept. The County will obtain land for an access road to Phase I (as shown on Exhibit A) The access road and proposed traffic signal at an intersection on Peters Creek road may be eligible for industrial access funds through the Virginia Department of Highways. The project's affect on traffic circulation on roads on the immediate area will be addressed in the Secondary Highway Plan to improve and reconstruct secondary roads as necessary. The County may utilize general fund dollars as an annual budget item through the capital improvement program process to finalize other road improvements as agreed. upon by the County and Developer. V. Utilities. The County will provide public sewer and water to the project property line for Phase I and II. VI. Quality of Development. The Developer shall ensure that quality development occurs within Phase I and II of Valleypointe. Actions which will be taken to confirm the quality of development include: a. Preparation of overall site plans for Phase I and II including a landscaping plan. 2 . ,~ ~~ ...Y. .~ b. Inclusion of 10 year storm design criteria as part of the drainage plan for on-site detention facility. c. Establishment of a project architectural review team which will include two Roanoke County represen- tatives. d. Restriction against the subdivision of any lot of less than four (4) acres. VII. Roanoke County participation. Roanoke County will allocate up to $2 million dollars for utility (water and sewer) extensions and acquisition of road access, details to be finalized at a later date by the Developer and the County. VIII. Marketing. The Developer has the responsibility to prepare a marketing plan to conform to the proposed uses for Phase I and II. The County will recruit prospects to locate in the site with a priority towards obtaining qualifying industries for industrial road purposes. IX. The road right-of-way will be obtained from the Roanoke Regional Airport Commission in exchange for approximately 8 acres of land from the Ida Mae Holland estate along Thirlane Road in the City of Roanoke. The new access road will provide for improved access to Smith's Transfer, Overnite Transfer, Carolina Trucking, and Truck Enterprises, which currently use Kenworth Drive as it enters Peters Creek Road in a non-signalized intersection. A proposed signalized intersection on Peters Creek would not only serve the Valleypointe project but also the existing truckin and provide better access to Thirlane as it extendsginto the City of Roanoke adjacent to the Airport. Roanoke County's Commitment The entire cost of all proposed access improvements for Valleypointe is estimated as listed below: Intersection at Peters Creek Access road (Peters Creek to loop road) $507,548 Loop road Kenworth extension/relocation 252,233 88,234 $1,087,892 Roanoke County's proposed agreement with Lingerfelt Development, Inc. states that the access road may be eligible for industrial access funds. The developer is requesting that Roanoke County obtain industrial access funds through the Virginia Department of Highways (VDOT) in the amount of $507,547 to construct the access road as shown on the attached map. The cost of the new access road is estimated by the Developer's engineers to be $507,547. $171,500 is available in the FY 87-88 industrial access fund allocation. The County is requesting matching funds from VDOT of $150,000 to match dollar for dollar for the County's $150,000. An additional $36,047 is recommended to be obtained from local funds. FISCAL IMPACT: Roanoke County and the developer will bond the industrial access road for two years by utilizing a letter of credit in the amount of $321,500 at a cost of $12,890 (including $50 fee) to Roanoke County. In order to obtain a maximum of $321,500 in VDOT Industrial Access Funds, the County must contribute $150,000 in matching funds. In addition, the County must contribute $36,047 to cover the difference between the estimated cost of industrial access improvements from Peters Creek Road to loop road extension (refer to attached map), of $507,547 and $471,500 of industrial access funds with matching contributions. Total County fiscal impact for Phase I industrial access at Valleypointe is estimated at $150,000 + $36,047 + $12,890 = $198,937. RECOMMENDATION: It is recommended that the Roanoke County Board of Supervisors take the following action: 1. Request industrial access funds in the amount of $321,500 from VDOT by resolution. 2. Share in one half the cost of obtaining a letter of credit to bond the construction of the industrial access road. 3. Provide $150,000 matching contribution to provide for maximum allocation of $321,500 in VDOT Industrial Access funds ($150,000 matching funds and $171,500 remaining 1987-88 FY industrial access funds) and an additional $36,047 for additional road improvements. That Roanoke County guarantees any expense of acquisition of all necessary right-of-way and the vesting thereof in the public agency, and does further guarantee any adjustment of utility expenses necessary for the project, and does hereby assure the Virginia Department of Transportation that such Department shall incur no expense for such items nor for any preliminary engineering or plan development should the industry fail to locate at the proposed site; and i - 3. It is sug- gested that the Board consider addressing significant issues of statewide impact through the Virginia Association of Counties and Virginia Municipal League, specific issues of interest through general law amendments, and specific, unique issues of interest to Roanoke County through Charter amendments. (1) The Board discussed responding to the significant state- wide issues through VACo and VML: (a) The recommendation of the Commission on Local Gov- ernment Structures; (b) COT-21 alternatives to enable local governments to address transportation related problems (e.g. im- pact fees on developers, off-site improvements, transportation districts, airport funding); (c) Funding needs of constitutional officers; (d) JLARC recommendations concerning the formula for distributing state funds to localities for educa- tion. (e) 1/2~ local option sales tax (f) funding needs for parks and other recreational purposes (2) The Board discussed responding to specific issues of interest through general law amendments or the appropriation leg- islation: ~Ml (a) State funding for the EXPLORE Project, and expand the Board of Directors for the River Foundation to include elected local officials. (b) Amend Section 46.1-267 to allow refuse collection trucks to be equipped with flashing, blinking or alternating combination emergency lights. (c) Amend Section 42.1-70 to allow an increase in the law library fee from $2.00 to $3.00. (d) Support Roanoke City's request for State funding for a convention center. ITEM NUMBER '~~-~ AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANORE COUNTY ADMINISTRATION CENTER MEETING DATE: December 1, 1987 SUBJECT: Approval of funding method for County share of Starkey Road Improvements COUNTY ADMINISTRATOR'S COMMENTS: ~~~ir~/ ~/~~T SUMMARY OF INFORMATION: At the November 17 meeting, the Board authorized the Virginia Department of Highways (VDOT) to proceed with the $3.2 million improvements to Starkey Road and Penn Forest Blvd. Staff recommended that the $72,300 local share for curb and guttering be distributed to the property owners along those roads as a special tax assessment. The Board then instructed staff to meet with the property owners to advise them of their share of the cost and to get their support for the assessment. Notices were sent to each property owner and meetings were held on November 25 and November 27. The attendees were advised of the project and their share of the cost, which computed to be $9.37 per linear road foot for curb of guttering. Most of the people agreed to participate in the cost of the project on that basis, with the understanding that the amount would be spread evenly over the next three tax years. It was more difficult to allocate the cost of drainage improvements in this manner because those properties contributing to the problem and those properties benefiting from the improvements cover a much larger area. Some of the owners suggested that the County have a public hearing on the subject since this is the first time the concept has been applied in Roanoke County. The concept of allocating costs to property owners who benefit is not a new one. Towns and cities in Virginia have f or many years been required to pay 5$ of the total cost of highway projects. Many have done so by allocating the cost to the property owners on the basis of the amount of road frontage through special tax assessments. This is the same concept and methodology recommended by the County staff for the Starkey project. This has only become necessary in Roanoke County and many of other counties in Virginia because of growth and urban development. There are several reasons why these costs should not be borne by all taxpayers through general assessments. The Board has frequently heard from citizens in the more rural areas that they should not be taxed for services which they do not receive or which they receive to a lesser degree. Secondly, the properties along those roads being improved will themselves be improved in ~~. appearance, safety and value. Other urgently needed road improvements should not be delayed because funds are reduced to provide curb and guttering on some roads. RECOMMENDATION Staff recommends that VDOT be authorized to proceed immediately with improvements to Starkey Road and Penn Forest Blvd. with the understanding that the County will be responsible for the $72,300 local share for curb and guttering. Drainage improvements will require further study and should not hold up the project. Staff further recommends allocating that cost to the property owners on the basis of road frontage through a special tax assessment over the next three years. A public hearing should be scheduled for the second meeting in January for the purpose of receiving citizen input, and so the decision, should it be agreed to by the Board, can be adopted by ordinance. Staff further recommends applying this methodology to the improvements to Ogden Road which have been previously approved by the Board. Elmer C. The landowners will be presented with their prorated share of the cost based on road frontage, and be given the opportunity to choose between two options of participation, or they may also choose not to participate. Option A - Allows the installation of curb and guttering along with the road improvements at a projected total cost of $72,300. It has been recommended that this cost be allocated on the basis of front footage of the current property owners. Option B - Includes the curb and gutter improvements recommended in Option A and also provides for additional drainage improvements in the form of a detention pond to reduce the adverse impact of drainage as a result of this project. The total cost of this improvement would be the $72,300 of Option A and $184,000 for construction of the detention facility for a total cost of $256,300. SPECIFICALLY, STATE PARTICIPATION WAS REQUESTED ICJ A 13 MILLION DOLLAR RUNWAY EXTENSION AT THE ROANOKE REGIONAL AIRPORT WE NOW KNOW THAT WITH SOUND LOGIC, PATIENCE AND PERSIS- TENCE THE ROANOKE VALLEY WAS ABLE TO SUCCEED IN ALL OF THESE PROJECTS, THOUGH THEY WERE DIVERSE, NO ONE CONSIDERED THEM TO BE IN COMPETITION WITH EACH OTHER, IT WAS FELT THAT EACH WOULD STAND ON ITS OWN MERIT AND EVENTUALLY ALL WOULD PREVAIL. IN 1986 TWO CAPITAL INTENSIVE PROJECTS CAPTURED THE IMAGINATION OF CITIZENS OF THE ROANOKE VALLEY, THEY WERE THE EXPLORE CONCEPT AND THE NEW TERMINAL FOR THE ROANOKE REGIONAL AIRPORT, MUCH PUBLIC CONCERN WAS EXPRESSED THAT PERHAPS IT WAS UNREALISTIC TO EXPECT THAT THE ROANOKE VALLEY WOULD EVER RECEIVE FUNDING FOR BOTH. SUMMARY OF INFORMATION: At a meeting of the County School Board of Roanoke County held on January 10, 1980, the School Board approved the transfer of 37.863 acres of real estate located off of Roanoke Boulevard and Hemlock Road, behind the U.S. Army Reserve Center and Camelot Nursing Home in the City of Salem, Virginia, Tax Map No. 194-1-1, to the Board of Supervisors of Roanoke County. Pursuant to Resolution No. 2495, the Board of Supervisors of Roanoke County accepted the conveyance of the subject parcel from the School Board. The County has received an offer to purchase the entire 37.863 acre tract. Staff believes that it is in the best inter- est of Roanoke County to dispose of the property. Section 18.04 of the County charter requires that any sale of public property be accomplished by ordinance. The first read- ing of this proposed ordinance was held on November 17, 1987; the second reading is scheduled for December 1, 1987. The Board's policy for the sale of real estate provides that any person may submit an offer in writing for the purchase of property. Any written offer should be received by the County on or before November 30, 1987. ~/ FISCAL IMPACT: Sales price to be determined from the best offer. You will also recall that I mentioned that we allow two false alarms per month at no cost, which can be changed in the event that this does not have the impact that we feel it should have in decreasing false alarms. I concur that a provision should be added to discontinue the services if the fines are not paid within thirty days after receipt. May I suggest that you discuss this matter with. iir. Hodge and Mr. Mahoney so that an appropriate order can be drafted similar to the one in Roanoke City. I will be happy to appear before the Board in support of the proposal; however, we must act quickly if it is to be completed while I am in office. I would not want to initiate this matter any later than the first meeting in December, as I .feel that it would be inappropriate for me to do so as a last minute gesture. If you f~~l this is a matter that should be handled by Sheriff-Elect Mike Kavanaugh, it is agreeable with me. Hodge Date: November 12, 1987 Subject: County-owned property being set aside for recreational use in the AMP/Hollins Road area County Administrator Elmer Hodge and Economic Development Specialist Brent Sheffler met at 4:30 p.m, this date with Messrs. George Penney, Ray Otey, and Virgil Bailey, residents of the area around the County-owned property who were appointed as an informal committee to protect the neighborhood's interests. The other two members of that committee, Messrs. Paul Mazey and Mel Mayfield, were not present. Listed below are the items that had been agreed upon at the end of today's meeting: [1] The County will get the closing documents on the sale of land to the Shimchocks, copy them, and send a copy to the committee members. [2] The County is to complete the Ballfield Use agreement with Ingersoll Rand describing access, parking, and field maintenance. The draft agreement is to be amended and executed. When finalized, copies of the agreement are to be sent to Human Resources Manager Steve Goldfarb at Ingersoll-Rand and to the committee members. [3] Messrs. Penney and Otey desire heavy screening between their properties and the subject County property. They have requested that Roanoke County meet with Plantation Nursery to have dead trees replaced and new screening planted. The new plantings, when mature, should reach a maximum height of fifteen feet. P.O. BOX 29800 ROANOKE. VIRGINIA 2 4018-07 9 8 (703) 772-2004 -2- Elmer Hodge stated that County Director of Procurement Jack Council would meet with one of the committee members on the site Monday or Tuesday (November 16 or 17) with a Plantation Nursery representative. (4] The County presently has a resolution dedicating to public use the eight acres in question. The County is to have the County Attorney modify the deed on the remaining eight acres and re-draft our existing resolution to read as follows: "That the property is to remain as is until such time that, as the need arises, the property be used only for recreational purposes if necessary." The Board of Supervisors is to be asked to allow for this change in the deed at their December 1, 1987, meeting. It was also asked that the County include a history of the actions on the property to date and the reason for the change. [5] There was a request to rezone the eight-acre tract (dedicated for public use) from its present Industrial M-1 zoning to a classifica- tion which would assist in maintaining its use for recreational purposes. There was some question as to whether this likely would be Residential, Rural Preserve, or Agricultural A-1. [6] Referring to point (4], included in the amendments should be a description of access to the park such as "access to public use park shall be made through State-maintained road off of Hollins Road rather than through Meadewood Drive, even if Meadewood Drive becomes a part of the State secondary system."
