A-102787-1 ITEM NUMBER ~` AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANORE COUNTY, VIRGINIA HELD AT THE ROANORE COUNTY ADMINISTRATION CENTER MEETING DATE: October 27, 1987 SUBJECT: Park Bond appropriation transfers for funding of Starkey Park athletic fields COUNTY ADMINISTRATOR'S COMMENTS: ~~~ ~~ SUMMARY OF INFORMATION: The development of the Starkey (South County) Park baseball field, soccer field and associated parking was not scheduled as part of the 1985 Starkey Park Bond appropriation of $250,000. However, the 1985 Park Comprehensive Plan showed that the South County area had a greater shortage of park facilities when compared to the rest of the County. As a result, the Board approved the development of a baseball field, soccer field, and associated parking at Starkey Park. The staff previously discussed the necessity to transfer funds with the Board members. The Recreation Advisory Commission has reviewed this and are in support of the transfer of funds. Work on the fields and associated parking has been completed. Additional funds in the amount of $67,010 were needed to complete the development of the fields and parking area at Starkey Park. It is requested that Bond funds from Walrond Park ($32,044) and Vinyard Park ($34,966) be used to fund this additional amount needed for Starkey Park. Walrond Park Bond obligations have been met and Vinyard Park will have a sufficient balance to complete all planned projects with the exception of one soccer field. FISCAL IMPACT: Funding of this request will require Bond Project transfers from Walrond and Vinyard Parks to Starkey Park in the amount of $67,010. No additional appropriations will be required. Phase I of the project will be a line extension from the Glade Creek Interceptor to Route 460 at Perimeter East (Trail Drive-In). Phase II of the project would cross 460 and serve the property along West Ruritan Road. A sewer line along the Phase I route is being planned by the developers of Perimeter East; however, to provide for future development, the line should be installed deeper and the pipe size increased from 8 inch to 15 inch diameter. Phase I construction would be in participation with the developer of Perimeter East. Phase II would be installed to provide sewer service to a potential industrial site along West Ruritan Road. Phase I of this project would consist of 3,200 feet of 15 inch sewer line. Phase II would consist of 2,400 feet of 15 inch sewer line and a crossing of Route 460. The total County cost for Phase I and Phase II would be $175,600. FISCAL IMPACT: ~~~' Funding for this project would be from sewer revenue bonds to provide sewer service to industrial sites. In order to encourage growth in this area, staff feels that sewer should be extended from the existing Glade Creek Interceptor to Route 460 at Carson Road. This project would consist of 1, 000 feet of 21 inch sewer line, 2,100 feet of 18 inch sewer line, and a 100 foot crossing of Route 460 as shown on the attached map. The estimated project cost is $141,600. FISCAL IMPACT : ~(? ~S- Funding for this project would be from the 1974 sewer bonds. At that time the Board of Supervisors tabled action on that request until its November 17, 1987 meeting, Since that time, Dr. Nickens has met with representatives from Valley Metro and Radar and they have indicated a necessity to approve at least the extension of the route to the facility to be occupied by the Office of Rehabilitative Services prior to November 1, 1987. This particular extension will be at no cost to the County, since there has been a significant ridership from this location, County staff, members of the Board of Supervisors, Brambleton Avenue merchants, and Valley Metro, will continue to proceed toward a satisfactory resolution for the request to extend service to Cave Spring Corners or to the area along Postal Drive, so that a formal recommendation can be made to the Board of Supervisors at your November 17 meeting. Discussions and negotiations are ongoing to acquire the easements, but at the present time six of the property owners may not agree to the easement acquisition. While staff is continuing the negotiations and hopes to acquire the easements, we would request that the first steps toward condemnation be started. This action could reduce the time frame on this project, which is an important consideration. The Starkey Force Main and Gravity Sewer project will allow elimination of the Starkey Sewage Treatment Plant and provide long term sewer capacity for the Back Creek sewershed. FISCAL IMPACT : ~~ Cost of advertisement will be covered by Utility Bond for the project. Assist in conducting an assessment of the needs of youth every five years and to assist in developing an annual Delinquency Prevention Plan, further to participate in evaluating the implementation of the plan and making a report thereon to the Board of Supervisors. Provide a public forum where concerns about youth may be expressed and to receive recommendations and raise concerns of public and private organizations at any regular advisory board meeting upon proper notice. Advocates necessary legislative amendments to improve community conditions for youth development and to support the development of needed services both public and private for youth in the community. Lewis Civic League of Roanoke County of Salem, Virginia Article I Name The name of this organization shall be Ft. Lewis Civic League. Article II Object The object of this Civic League shall be to promote the citizens' awareness of their rights, to assure equitable use of our tax dollars, to promote safety, well being of citizens, community improvement, recreational facilities, neighborhood watch and to be nonpartisan. Article III Dissolvement Section 1: In case of dissolvement of this Ft. Lewis Civic League, Robert's Rules of Order Newly Revised, will apply. Section 2: Any remaining funds and equipment will be donated to the Ft. Lewis Rescue Squad and Fire Department, Salem, Virginia. Article IV Membership Section 1: Any adult residents living in the area bordered on the north by Ft. Lewis Mountain, south by Roanoke River, east by Texas Hollow Road and West Salem city limits and west by Allegheny Drive shall be eligible for membership. Additional areas may be considered in the future . Section 2: The annual dues shall be payable at the annual meeting in December. Yearly dues amount to be established by the 2nd regularly scheduled Civic League meeting upon two-thirds affirmative vote of those voting. There shall be no proration of dues for partial years. A delinquent member is one whose dues are unpaid at the end of the March meeting; if unpaid at the close of the June meeting he is automatically dropped from membership. Article VI Duties of Officers Section 1: The Fresident shall preside at all meetings of this Civic League and the Executive Board and can call special meetings when deemed advisable or upon written request of four members--the business confined to the call. The Fresident may appoint committees as requested (except the Nominating Committee) and shall be ex officio on all committees (except the Nominating Committee), and also shall perform such other duties as are incidental to the office and shall enforce strict observance of the bylaws. Section 2: The First Vice-President shall in the absence of the President (or if the President vacates the chair), perform the duties thereto, assist the Fresident as requested and be in charge of program. Section 'i: The Second Vice-President shall assist the President if need be and be in charge of Ways and Means and may select assistants. Section 4: The Third Vice-President shall be in charge of Community Improvements and may select assistants. Section ': The Recording Secretary shall keep accurate minutes of the proceedings and transactions of all League meetings and of the Executive Board, notify absent committee members of their appointment, and is custodian of all papers and records. Section 6: Corresponding Secretary will conduct the correspondence of the League, file copies of correspondence sent and received; be in charge of publicity, send dues notices and other such duties as required. Section '7: The Treasurer shall receive and deposit all funds to the Civic League's own account, disburse funds by check (only when authorized by vote of the League), shall notify the Membership Chairman of the names of the members delinquent in their dues as specified in Section 2 of Article IV. The Treasurer shall close out books at the end of the calendar year and turn over to the new Treasurer by January 5. Books shall be submitted to the Auditing Committee prior to January 5 for their review and approval and reported on no later than the February meeting. An itemized report shall be given at each monthly meeting and a summary included in each Newsletter. A year-end report shall be given in approved format. Article VII Meetings Section 1: The regular meetings of this Civic League shall be held each month unless otherwise ordered by the Executive Board or the League. Section 2: The regular meeting in December shall be known as the Annual Meeting and shall be for the purpose of electing officers, receiving reports of officers, and Standing Committee Chairmen, installing officers and for any urgent business. Section 3: A quorum shall be at least six members for the general meeting. Each committee sets its quorum. ~~ Article XII Parliamentary Authority The rules contained in the current edition of Robert's Rules of Order Newly Revised shall govern this Civic League in all cases to which they are applicable and in which they are not inconsistent with these bylaws and any special rules the League may adopt. Article XIII Amendment of Bylaws These bylaws can be amended once a year. Any amendment to the bylaws shall be submitted to the League in writing by the first meeting date in September. The proposed changes will be advertised in the September Newsletter, read at the October meeting and voted on at the regular November meeting. Atwo-thirds affirmative vote is needed for bylaw changes. All amendments will take effect on December 1. Article XIV Statements by Civic League Any issue being brought before the Civic League must have both sides of the issue presented before the league can take a stand either in public or in private. The installation of the pipe requires a crossing of the Norfolk Southern tracks which run parallel to Kessler Mill Road. Prior to granting permission for pipe installations, Norfolk Southern requires the owner to execute a license for pipe line facility. FISCAL IMPACT: ~~ No additional funding is a mutual benefit to both fore Norfolk Southern has for this crossing. Funding was previously allocated as RECOMMENDATION: is required. This easement, which was properly recorded, exceeded the required 15 foot width and included the remaining portion of the lot as a matter of survey convenience. A potential buyer of this lot has asked the owner, Boone, Boone, & Loeb, Inc., to have the easement changed to the required 15 foot width so that use restrictions would not apply to the remaining lot. This report is the result of the owners request. The proposed 15 foot sanitary sewer easement shown on the attached plan is as required by current County standards. The vacation of the remaining area, originally accepted, will not affect the ability to maintain or repair the sewer line. FISCAL IMPACT: „~~ ~~ There are no County funds required for this change. Cundiff to rezone an approximate 19.4 acre tract from M-2, Industrial to R-E, Residential Estates to construct single family homes, located on the east side of Route 758 approximately one mile south of its intersection with Route 460 in the Hollins Magisterial District. 1. NATURE OF REQUEST a. Conditional request to rezone approximately 20 acres to R-E, Residential Estates to allow for the construction of 80 single family dweling units on a parcel of 47 total acres. Submitted concept plan indicates that 10 units would be constructed on the 20 acre portion included within the rezoning petition. The remaining acreage is to be used for grazing. The existing house will be occupied and, if the rezoning is approved, will no longer be nonconforming. The overall density of the project is approximately 1.6 units per acre. The density of the portion to be developed is approximately 3 units per acre. It should be noted that the f ront 27 acres is already zoned R-E, Residential Estates and may be developed for the proposed use without rezoning the rear portion of the parcel to R-E. b. Open space is -shown on the proffered concept plan. Petitioner has indicated that no residential-units will be placed within the flood hazard area. The Resource Protection Guide of the Roanoke County Land Use~Plan discourages unsuitable development of floodplains and natural drainage corridors. Policy D-1 states that the rate, location and amount of new residential growth should be managed according to the capacity and availability of public services and facilities, particularly water, sewer, streets and schools. The petitioner's proposal will produce approximately 30 trips per net acre. VDOT Road and Bridge Standards Manual states that for average daily traffic in the range of from 400 to 999 vehicles per day, a street with a width of 18 feet is necessary. Policy D-9 states that where a residential project has a significant increase in density from a surrounding neighborhood, the project should provide direct access to a collector or arterial street, rather than share the local street network of an adjoining neighborhood. Petitioner's concept plan shows that 18 feet is being reserved to provide for additional right-of-way to accommodate future road widening. 3 j. Unconditional request to rezone approximately 52 acres for the eventual construction of offices on five separate development parcels consisting of approximately 7 to 14 acres each. This 52 acres is a portion of a larger 252 acre proposed mixed use commercial park that will also include retail uses, a hotel, corporate uses, multifamily and recreational uses. b. Attached concept plan and zoning vicinity map describe proposal more fully. 2. APPLICABLE REGULATIONS a. M-1 zoning district unsecured by conditions permits a variety of manufacturing and industrial activities. M-1 with a special exception (assuming approval by the Board of Supervisors on October 13 of second reading of proposed amendment) will permit B-2 general commercial and B-1, office uses that are supportive of principal industrial area needs. Developer is proposing specific convenants that will be recorded with the deed and will restrict the type, appearance, and effect of development. These convenants will be prepared subsequent to rezoning and prior to construction. b. A Special Exception Permit will be required for office uses within the M-1 zoning district.
