OF FAIR HOUSING WITHIN THE COUNTY OF ROANOKE

WHEREAS, the Board of Supervisors of Roanoke County, Vir-
ginia wishes to ensure equal opportunity to all persons residing
in the County of Roanoke to live in decent housing facilities,
and
WHEREAS, discrimination on the basis of race, color, reli-
gion, ancestry, national origin, sex, place of birth, age or
handicap in connection with the sale, purchase, leasing, or
financing of housing facilities is unlawful in Virginia.
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County Board
of Supervisors endorses the concept of fair housing within the
County of Roanoke.
On motion of Supervisor Johnson, seconded by Supervisor
Nickens, and upon the following recorded vote:

County Board of Supervisors unanimously approved the request of
the Loyal Order of Moose Lodge No. 284 for a raffle permit.
The fee has been paid.
You may consider this letter to be your permit, and I
suggest it be displayed on the premises where the Raffle is to be
conducted. The State Code provides that raffle and bingo permits
be issued on a calendar-year basis; therefore, the permit will
expire December 31, 1988. This permit, however, is only valid
for the dates specified on your application.

SUMMARY OF INFORMATION:
At the meeting on March 9, 1988, the Board of Supervisors
directed that a Resolution of Appreciation be prepared honoring
Jack Smith, retiring Executive Vice President of the Roanoke
Valley Chamber of Commerce. Mr. Smith has served in this
capacity for almost thirty years.
Mr. Smith will not be present today to receive this resolution,
but it will be presented at a "roast" honoring him this evening.
RECOMMENDATION:
It is recommended that the attached Resolution of Appreciation be
adopted by the Board of Supervisors.

RESOLUTION OF APPRECIATION TO JACK C.
SMITH UPON HIS RETIREMENT AS EXECUTIVE
VICE PRESIDENT OF THE ROANOKE VALLEY
CHAMBER OF COMMERCE
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
WHEREAS, Jack C. Smith has served with distinction as
Executive Vice President of the Roanoke Valley Chamber of
Commerce since 1960, and
WHEREAS, during that time he has played a prominent
role in the economic development of the entire valley through his
activities in the Roanoke Valley Development Corporation, the
Greater Roanoke Valley Development Foundation, and serving as an
officer in the Airport Advisory Commission, the Virginia
Association of Chamber of Commerce Executives, and Chairman of
the Industrial Development Authority for the City of Roanoke, and
WHEREAS, he was also instrumental in providing
outstanding cultural and social enrichment for valley citizens
through his involvement with the founding of the Mill Mountain
Theatre, Valley Beautiful, the Miss Virginia and Miss America
Pageants, and the Virginia Independence Bicentennial Commission,
and
WHEREAS, Mr. Smith has promoted the Roanoke Valley in
every possible manner for almost thirty years and has served the
citizens of the valley in a unique and special way.
THEREFORE, BE IT RESOLVED that the Board of Supervisors
of Roanoke County, Virginia wishes to express its deepest

SUMMARY OF INFORMATION:
On Sunday, March 20, 1988 the Sesquicentennial Gala was held at
Tanglewood Mall. This week also marks the beginning of events
that will continue throughout the year in celebration of our
150th birthday. Upcoming events include the Sesquicentennial
Festival from March 23rd to March 30; the cutting of the birthday
cake and County Government Day on March 30th. A documentary
spotlighting the County's history will also be aired on March
30th at 8:30 p.m, on WBRA, Channel 15.
Sesquicentennial Director Kathy Davis will be present at the
board meeting to report on the Gala and highlight the plans for
future events. She will also introduce several of the committee
chairmen who have been working during the past year to make
these activities successful.

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
WHEREAS, Jack C. Smith has served with distinction as
Executive Vice President of the Roanoke Valley Chamber of
Commerce since 1960, and
WHEREAS, during that time he has played a prominent
role in the economic development of the entire valley through his
activities in the Roanoke Valley Development Corporation, the
Greater Roanoke Valley Development Foundation, and serving as an
officer in the Airport Advisory Commission, the Virginia
Association of Chamber of Commerce Executives, and Chairman of
the Industrial Development Authority for the City of Roanoke, and
WHEREAS, he was also instrumental in providing
outstanding cultural and social enrichment for valley citizens
through his involvement with the founding of the Mill Mountain
Theatre, Valley Beautiful, the Miss Virginia and Miss America
Pageants, and the Virginia Independence Bicentennial Commission,
and
WHEREAS, Mr. Smith has promoted the Roanoke Valley in
every possible manner for almost thirty years and has served the
citizens of the valley in a unique and special way.
THEREFORE, BE IT RESOLVED that the Board of Supervisors
of Roanoke County, Virginia wishes to express its deepest

Smith for his many years of capable, loyal and dedicated services
to the citizens of the Roanoke Valley; and

SUBJECT.: Third year Fair Housing activity necessary to meet 1988
Compliance of the Community Improvement Grant for the Hollins
Project from the Virginia Department of Housing and Community
Development.
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
Regulations from the Virginia Department of Housing and Community
Development (DHCD) relating to Community Improvement Grants
require the grantees to initiate one affirmative action to
further fair housing each year during the grant project activity.
Roanoke and Botetourt counties have complied during the last two
years.
After review of the DHCD approved activities, #1 of attachment A
is the most appropriate at this time and could be advertised
during April which is National Fair Housing Month. Botetourt
County and Roanoke County would be required to adopt a resolution
endorsing the concept of fair housing and advertise same in the
local newspapers.
FISCAL IMPACT:
Hollins Community Development Project administrative funds will
be utilized to pay the publication costs which will be less than
$150.
RECOMMENDATION:
Adopt in March the attached resolution endorsing the concept of
fair housing and publish the Public Notice (attachment B) in the
Roanoke Times & World-News and the Fincastle Herald during April
1988 to meet the 1988 compliance as a Community Improvement
Grantee with an action to affirmatively further fair housing.

SUMMARY OF INFORMATION:
On February 19, 1988, the County of Roanoke received
proposals from seven area banks to offer a Bank Services Contract
to Roanoke County for a three year period beginning July 1, 1988.
Based upon average transactions for the past calendar
bank was offered a proforma calculation sheet for purposesaof
determining what their average monthly bank service charges would
be and the results are outlined below.

Dominion Bank 1,411.00
Signet Bank 1,411.44
Crestar Bank 1,437.12
Sovran Bank 1,657.08
Central Fidelity 1 743.14
After meeting with representatives from the bank, the
Treasurer and staff believe that First Virginia Bank is cap able
of handling the County's business in an effective and efficient
manner and recommends awarding said three year contract to First
Virginia Bank.
FISCAL IMPACT:
The cost of these services will be offset against the
investment income received by the County on these monies instead
of having a compensating balance sitting idle in a checking
account as we have allowed in the past.
RECOMMENDATION:
The Treasurer & staff recommend that the three
services contract beginning July 1, 1988, be awardedato First
Virginia Bank by the adoption of the attached resolution.

It is requested that the staff be authorized to acquire the
necessary right-of-ways and easements for the following utility
projects along with the estimated completion dates:
1. Valleypointe sewer Phase II (July 1990);
2. Valleypointe water Phase II (July 1990);
3. Glade Creek Interceptor Sub-Main Phase II (January 1989);
4. Roanoke River Interceptor Sub-Main to Route 460/11
(June 1989);
5. Sewer sub-Main from the existing sewer to I-81 at
Hanging Rock including I-81 crossing (January 1989);
6. Sewer line extension from Kingston Court to lands
adjoining Nichols Estates (February 1989);
7. Water line extension from Big Hill water line to
Broadview Subdivision (June 19$8);
FISCAL IMPACT:
No funds will be required for donations or dedications;
however, in the event of an acquisition of a right-of-way or
easement, funds are available in the utility project funding.
RECOMMENDATION:
Staff recommends that the Board of Supervisors authorize
staff to negotiate for the acquisition of the necessary
right-of_-ways or easements for the above projects.

1987, the Board authorized the County Administrator to accept
donations or dedications of any noncontroversial real estate
matters.
Any acquisitions of a right-of-way or an easement for a

adoption of an ordinance upon a first and second reading pursuant
to Section 18.04 of the Roanoke County Charter.

(e) authorizing condemnation and right-of-entry for
Starkey Force Main and Gravity Sewer

SUMMARY OF INFORMATION:
Several properties are involved in easement acquisitions for
the Starkey Force Main and Gravity Sewer in the area of Starkey
Road. Discussions and negotiations are ongoing to acquire the
easements, but at the present time several of the property owners
may not agree to the easement acquisition. These properties
include Atelier Inc. (87.07-1-16), Tanglewood West Parking
(87.07-1-28), private roadway adjacent to 87.07-1-38 and T. R.
Leslie (77.19-1-9). Staff has previously requested condemnation
on several other properties for this project.
While staff is continuing the negotiations and hopes to
acquire the easements, we would request that the first steps
toward condemnation be started. This action could reduce the
time frame on this project, which is an important consideration.
The Starkey Force Main and Gravity Sewer project will allow
elimination of the Starkey Sewage Treatment Plant and provide
long term sewer capacity for the Back Creek sewershed.
FISCAL IMPACT:
All acquisition costs will be covered by Utility Bond for
the project.
RECOMMENDATION:
Staff recommends that a public hearing be set for the
April 26, 1988 Board Meeting to address the subject matter.

BUILDING CODE BOARD OF ADJUSTMENTS AND APPEALS
A. COMPOSITION:
To be comprised of five (5) members; appointed by the Board
of Supervisors. Members may be reappointed, and terms should be
staggered so that less than half of the terms expire in any one
year. The Board of Supervisors may appoint alternate members who
may sit on the Board in the absence of any regular. members, and
shall have the full power and authority of the regular member..
Board members shall be selected on the basis of their ability to
render fair and competent decisions regarding application of the
code, and shall to the extent possible, represent different
occupational or professional fields: At least one member should
be an experienced builder. At least one member should be a
licensed professional engineer or architect..
B. DUTIES:
Shall act on application for appeals ,as required by Section.
36-105 of the Code of Virginia; or it shall enter into an
agreement with the governing body of another county or

A. COMPOSITION
Board to consist of two members from each magisterial

affecting the working of this law and other laws relating to
children, their care and protection and to domestic relations;

Board of Supervisors. Provide a public forum where concerns
about youth may be expressed and to receive recommendations and
raise concerns of public and private organizations at any regular
advisory board meeting upon proper notice. Advocates necessary
legislative amendments to improve community conditions for youth
development and to support the development of needed services
both public and private for youth in the community.

FIFTH PLANNING DISTRICT COMMISSION
A• COMPOSITION
Commission to consist of five (5) representatives of
Roanoke County based on population, three representatives who
shall be elected members of the governing bodies, and two members
who shall be non-elected citizens. The term of office shall be
three years.
One of the members shall also serve on the Executive
Committee .
The r^iftt-, Planning District Commission. represents
participating local governments included in the geographic area
delineated by the Commonwealth of Virginia. The commission is
composed of 21 elected and citizen representatives of the
participating jurisdictions.
B. DUTIES
The purpose of the commission as defined by the Virginia
Area Development Act is ..to promote orderly and efficient
development of the physical, social and economic elements of the
District by planning, encouraging and assisting governmental
subdivisions to plan for the future."
The general management program category provides the
basic organization and management of commission activities and
routine administrative functions. Because general management
supports the entire operation of the commission's work program,
costs allocated to the program activity are generally considered
as administrative or indirect costs an~3 charged to other program
categories in accordance with the Commission's Cost Allocation
Plan .

ADVISORY COUNCIL:.

County appointee; to serve a one (1) year term, and may be

To assure that a system of services for the aging be
developed;
To coordinate and evaluate existing services;
To identify unmet needs of older persons;
To serve as a strong advocate for the aging population;

elderly citizenry;
To advise local planning bodies on all aging issues;

Serve as the Area Agency on Aging:
Provide elderly persons and handicapped persons with
housing facilities, and services specially designed to meet their .

and operate improvements thereon necessary or incident to the
accomplishments of the purposes set forth in the Articles.

manner consistent with the Articles of Incorporation and Bylaws.
Create committees and delegate authority to the committees for
carrying out the objectives of this organization.

COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The developer of Woodbridge, Section 9, Westclub Corporation
has requested that Roanoke County accept the deed conveying the
water and sewer lines serving the project along with all
necessary easements.
The water and sewer lines are installed as shown on as-built
plans prepared by T. P. Parker and Son entitled Woodbridge
Section 9 dated January 25, 1988, which are on file in the Public
Facilities Department. The water and sewer line construction
meets the specifications and the plans approved by the County.
FISCAL IMPACT:
The values of the water and sewer construction are
$25,236.00 and $40,213.00 respectively.
RECOMMENDATION:
The staff recommends that the Board of Supervisors accept
the water and sewer facilities serving the subdivision along with
all necessary easements, and authorize the County Administrator
to execute a Deed for the transfer of these facilities.

This application is made subject to all County and State laws,
ordinances, rules, and regulations now in force, or that may be
enacted hereafter and which are hereby agreed to by the under-
sig ned applicant and which shall be deemed a condition under
which this permit is issued.

and raffles are strictly regulated by Title 18.2-340.1 et. seg.
of the criminal statutes of the Virginia Code, and by Section
4-86 et. seq. of the Roanoke County Code. These laws authorize
the County Board of Supervisors to conduct a reasonable investiga-
tion prior to granting a bingo or raffle permit. The Board has
sixty days from the filing of an application to grant or deny the
permit. The Board may deny, suspend, or revoke the permit of any
organization found not to be in strict compliance with county and
state law.
Any person violating county or state regulations concerning these
permits shall be guilty of a Class 1 misdemeanor. Any person who
uses any part of the gross receipts from bingo or raffles for any
purpose other than the lawful religious, charitable, community,
or educational purposes for which the organization is specifi-
cally organized, except for reasonable operating expenses, shall
be guilty of a Class 6 felony.

SUBJECT: Recognition of the Employee of the Year
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The Board of Supervisors approved an Employee of the Year
Program in November, 1986, to recognize outstanding employees and
encourage excellence in performance of job duties.
The 1987 Employee of the Year was selected from a group of
departmental nominations. The selection is based on criteria
including; excellence in performance of job duties, display of
service to the public and to fellow employees and contribution of
money-saving or labor-saving ideas.
The employees listed on the attached page were selected as
Employee of the Year within their departments. These individuals
are present and deserve special recognition for their accomplish-
ments. A committee made up of six representatives from the
Employee Advisory Committee, selected one of these departmental
nominees as the 1987 Roanoke County Employee of the Year.
FISCAL IMPACT:
No additional appropriation of funds is required for the
fiscal year ending June 30, 1988. This program is funded through
the Department of Human Resources budget.
RECOMMENDATIONS:
It is recommended that the Board of Supervisors approve the
accompanying resolutions which recognize the departmental
Employee of the Year selections and the individual selected as
1987 Roanoke County Employee of the Year.

Properties Corporation, through its principal officer, Samuel
Lionberger, was contacted by Mr. Elmer Hodge, County Administrator
for Roanoke County. Mr. Hodge indicated that he would like an
opportunity to have County representatives meet with the proposed
developer and representatives of the citizens residing in the area
of the property to be rezoned to see i f there could be further
dialogue concerning the proposed Inland Properties project.
In light of this, and in light of the developer's
willingness to attend and participate in such a meeting, we would
formally like to request a continuance of the public hearing set
for March 22nd until the May 24, 1988, Board of Supervisors'
meeting. This will enable botMti sides to continue their dialogue
in an effort to resolve the differences between them.

1. NATURE OF REQUEST
a. Conditional request to utilize an existing + 2,000 sq.ft.
building to conduct hardware servicing and rental activities.
b. Attached survey and zoning vicinity map describe project more
fully.
2. APPLICABLE REGULATIONS
a. M-1 district permits a wide variety of light industrial and
manufacturing uses. Petitioner has proffered the following
conditions: (1) the use of the property will be limited to the
rental and servicing portion of Brambleton Hardware; (2) that no
outside storage of machines or equipment will occur on the
property; (3) no additional freestanding signage will be
displayed on the property; (4) any expansion of the building
will be to the rear of the existing building.
b. No new VDOT commercial entrance permit is required.
c. Site plan review will be required to ensure compliance with
County regulations.
3. SITE CHARACTERISTICS
a. Topography: Property is flat.
b. Ground Cover: Existing building with paved parking lot; parcel
is completely unvegetated.
4. AREA CHARACTERISTICS
a. Future Growth Priority: Situated within the Cave Spring
Community Planning Area; designated for stabilized growth.
Currently served by urban services.
b. General area is developed along an urban, major arterial
including densely developed mixed commercial, office and
residential outside the immediate area.
5. LAND USE IMPACT ASSESSMENT
Rating: Rate each factor according to the impact of the proposed
action. Use a scale of 1 through 5.
1 = positive impact, 2 = negligible impact, 3 = manageable impact,
4 = disruptive impact, 5 = severe impact, and N/A = not applicable.

3 a. Comprehensive Plan: 1985 Comprehensive Development Plan has
placed this area within a Core land use category. The
petitioner's request is consistent with policies C-2 (arterial
street access) and C-4 (coordinated commercial site design) as
it relates to shared vehicular access and enhanced signage. The
proposal is also consistent with Core land use determinants but
is not consistent with Core land use types or with use
intensities related to Core areas in the compatibility matrix.
3 b. Surrounding Land: General retail and commercial service
facilities adjoin subject property. Existing offices are
located across Brambleton Avenue to the southeast.
3 c. Neighboring Area: In addition to surrounding land comments,
single family residential exists + 300 feet to the south and
multifamily residential 400 feet to the northwest.
3 d. Site Layout: Predetermined by existing structure and integrally
related to hardware business on adjoining lot. Adequate parking
for existing hardware is questionable based on building square
footage.
3 e. Architecture: Existing one story frame building containing +
2,000 sq.ft. Finished facade currently unknown.
3 f. Screening and Landscape: Per ordinance (see natural features>.

is 21,450 vehicles.

hardware facility to the east. Petitioner proposes existing
parking for Brambleton Hardware to serve all customers while
subject property will contain employee parking. The two
combined lots now exhibit three entrances.

compatible with all Core area land use determinants and with the two
Core policies cited previously.
7. STAFF EVALUATION
a. Strengths: (1) With acquisition of proffers for noise and
signage in addition to those already secured, impact should be
minimal on surrounding land use. (2) Minimal impact on current
urban services. (3) Specific land use has been proffered. (4)
Petitioner proposes to make use of an existing vacant building
within 70 feet of related hardware business.
b. Weaknesses: (1) Internal traffic circulation patterns could be
improved and the tendency toward excessive entrances from
Brambleton could be decreased by closing one entrance (see
traffic circulation). (2) Limited amount of parking available.

1. NATURE OF REQUEST
a. Conditional request to operate a lumber drying business
predominantly for petitioner's construction business and
furniture/cabinet making business. Equipment will consist of an
electric kiln which will hold 3,000 board feet and possibly a
cutoff saw. Thirty to sixty days are required to dry one load.
Wood and all equipment will be located inside existing barn.
b. Attached concept plan and vicinity map describe the purpose more
fully.
2. APPLICABLE REGULATIONS
a. M-1 zoning permits a variety of light industrial and
manufacturing uses. Petitioner has proffered that the property
will only be used for a cabinet, furniture, or upholstery shop
which would include a lumber drying kiln.
b. VDOT commercial entrance permit required if service is offered
to others.
c. Site plan review required to ensure compliance with County
regulations.
3. SITE CHARACTERISTICS
a. Topography: Gentle slope.
b. Ground Cover: Cleared with grass and existing barn.
4. AREA CHARACTERISTICS
a. Future Growth Priority: Situated within the Peters Creek
Community Planning Area; designated for stimulated growth.
Urban services available.
b. General area is developed with mixed office, commercial,
industrial and residential uses as well as undeveloped with farm
fields, within 150 yards of VA Primary 115 (Plantation Road).
5. LAND USE IMPACT ASSESSMENT
Rating: Rate each factor according to the impact of the proposed
action. Use a scale of 1 through 5.
1 = positive impact, 2 = negligible impact, 3 = manageable impact,
4 = disruptive impact, 5 = severe impact, and N/A = not applicable.

1 a. Comprehensive Plan: 1985 Comprehensive Development Plan has
placed this area within a Principal Industrial land use category.
Warehousing and light manufacturing activities are encouraged
with high compatibility in Principal Industrial areas. Proposal
is consistent with the following policies: I-1 (maximize the
opportunities for industrial development within Principal
Industrial areas); I-2 (cluster the development of industrial
sites within Principal Industrial); I-3 (expand new locations
for new industrial growth); I-6 (prevent disruptions of the
environment); I-9 (prohibit industrial development adjacent to
residential uses, unless exceptional design measures are applied
to achieve compatibility); and I-12 (encourage the conversion
and redevelopment of existing residential and retail uses in
Principal Industrial areas). Existing barn is compatible with
rural residential neighborhood.
4 b. Surrounding Land: Residential and agricultural. Although
Comprehensive Development Plan has designated area as Principal

Carvin Street or Plantation Road. Easement granted on
Plantation Road access. Since concept plan not proffered,
expansion could take place.

3 f. Screening and Landscape: Per ordinance.
3 g. Amenities: Parking and loading areas adequate for two employees.
No dumpsters on site.
3 h. Natural Features: No significant impact.

? i. Street Capacities: Parcel served by VA Primary 115 and Carvin
Street. Current ADT of Plantation Road is 12,150. Current ADT
of Carvin Street is 100. Proposed use will generate 6.4 trips
per day. Although petitioner states that there will be
intermittent truck traffic, it should be noted that petitioner
uses standard pick up trucks.
3 j. Circulation: Use of immediate access to Plantation Road is
desirable. According to VDOT, Carvin Street, a residential
street, is a 14 foot wide surface treated road with minimal base
and rated as sub-standard.

7. STAFF EVALUATION
a. Strengths: (1) Proposed use is compatible with the Land Use
Plan designation. (2) Proposed use is of limited scale for
existing residential neighborhood. (3) Petitioner has proffered
no outside storage. (4) Petitioner has proffered no signage. (5)
Barn is compatible with adjacent properties. (6) Electric kiln
makes little noise. (7) Petitioner has limited use of property
to a cabinet, furniture, and an upholstery shop.
b. Weaknesses: (1) Although the proposed use is compatible with
the Principal Industrial land use category, the area is
primarily residential. (2) If sale of lumber is offered to
others, traffic generation will be higher and access road should
be upgraded. Petitioner should be encouraged to operate a
delivery business to curb increase in traffic. (3) Carvin Street
access through residential neighborhood should be discouraged
but with only 12-15 truckloads per year, use of Carvin Street is
negligible.

RESOLUTION PURSUANT TO SECTION 15.1-238
(e) OF THE 1950 CODE OF VIRGINIA, AS
AMENDED, SETTING FORTH THE INTENT OF
ROANOKE COUNTY TO ENTER UPON CERTAIN PRO-
PERTY LOCATED IN THE WINDSOR HILLS MAGIS-
TERIAL DISTRICT OF ROANOKE COUNTY AND TO
TAKE A CERTAIN SANITARY SEWER EASEMENT
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the acquisition of a sanitary sewer easement
is being undertaken by the County of Roanoke to allow for the
elimination of an improperly functioning drainfield by extending
public sewer to the property of George McQuarrie; and
2. That in order to complete this project one sanitary
sewer easement is needed and more particularly described as a
fifteen (15) foot wide strip of land across the property of Helen
V. Bryant and more particularly described on the attached apprai-
sal report as being located along the rear property line and con-
taining 3,086.55 square feet, together with a ten (10) foot wide
temporary construction easement. The fair market value of the
aforesaid permanent easement is $593.00 and the estimated dam-
ages, if any, to the residue property is $2,045.00; such compensa-
tion having been offered the property owner; and
3. That it is immediately necessary for the County to
enter upon and take such property on April 22, 1988, and commence
the construction of said sanitary sewer easement in order to ex-
tend public sewer service to said property owner in order to
replace the improperly functioning drainfield, to satisfy the

requirements and recommendations of the State Health Department,
and to provide long-term sewer capacity for the health, safety
and welfare of its citizens and to thereafter institute and con-
duct appropriate condemnation proceedings as to said sanitary
sewer easement.
4. That pursuant to the provisions of Section 15.1-238
(e) of the 1950 Code of Virginia, as amended, and pursuant to
notice and public hearing as made and provided therein, the Board
does hereby invoke all and singular the rights and privileges and
provisions of said Section 15.1-238 (e) as to the vesting of
powers in the County pursuant to Section 33.1-119 through Section
33.1-129 of the 1950 Code of Virginia, as amended, all as made
and provided by law.

COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
Activities funded through the Virginia Housing and Community
Development (CDBG) grant for the Hollins Community Development
Project include housing rehabilitation, construction of private
to state standard roads, installation of private sewer and water
service laterals, and the development of a public park to be
owned by Roanoke County and maintained by the Parks and Recrea-
tion Department.
The property best suited f_or the development of_ the park has
been selected by the staff of the Planning Department and the
Director of Parks and Recreation. The owners of the subject
property, designated as Roanoke County Tax Map Number 27.08-2-10,
are Esther B. Sadler, Robert T. Sadler, and Grace A. Sadler.
They have executed an option agreement to convey to Roanoke
County approximately 3.0-3.5 acres (exact acreage to be deter-
mined by survey before closing). The Hollins project budget
includes funds for acquiring and developing the park. The park
will be developed to scope within the budget of the project.
Final design plans are being developed by the staff of_ the Parks
and Recreation Department. Projected completion date of this
activity is October 31, 1988.
Section 18.04 of the Charter of Roanoke County requires that
the acquisition and acceptance of real property be accomplished
by ordinance. The first reading of this proposed ordinance will
be held on March 22, 1988; the second reading is scheduled for
April 12, 1988.
FISCAL IMPACT:

The Hollins Community Development Project budget includes
the funds for acquiring property and developing a public park
within the project area. The park will be developed to scope
within the project's CDBG budget funds. The acquisition cost is
$9,000 (10 percent deposit has been made in consideration of the
option agreement). This acquisition cost is part of the CDBG
grant funds. Additional maintenance costs and time will be
required to maintain the park. An accurate cost cannot be
determined until completion of final design of the park.
RECOMMENDATION:
Staff makes the following recommendations:
(1) That the Board of Supervisors consider the adoption of
the proposed ordinance;
(2) That the County Administrator 'oe authorized to execute
such documents and take such actions on behalf of Roanoke County
as are necessary to accomplish the acquisition and acceptance of
this property, all of which shall be upon form approved by the
County Attorney.

At the September 8, 1987, meeting, the Board of Supervisors
accepted an offer (Ordinance No. 9887-6) from the Lewis Gale
Building Corporation to purchase 7.3 acres adjacent to the Fort
Lewis Fire Station on U.S. Route 11-460. In consideration for
this real estate, Lewis Gale Building Corporation offered $70,000
and 6.58 acres of real estate located off of State Route 221
across from Back Creek School (Tax Map No. 95-01-1-4) (less and
except that portion of this real estate containing the clinic and
septic drainfield) and the lease of existing ballfields at the
Fort Lewis site through September 1988 for One Dollar ($1.00).
The terms of the real estate transaction have been amended
whereby Lewis Gale Building Corporation would purchase 7.057
acres adjacent to the Fort Lewis Fire Station on U. S. Route 11-
460. In consideration for this real estate, Lewis Gale Building
Corporation would convey 5.1779 acres off of Route 221 and
$60,000. The acreage of real estate off of Route 11-460 at the
Fort Lewis Fire Station was changed to reflect the addition of a
50-foot wide strip to the west. This was done to accommodate
the future expansion of the structure in 1992. This necessitated
changing the terms of the agreement.
In addition, the County will be allowed to lease the ba]_1-
fields presently located on the 7.057-acre tract from Lewis Gale
Building Corporation in the amount of $1.00 per annum through
December 31, 1989.
Section 18.04 of the County Charter requires that any sale
or disposition of public property be accomplished by ordinance.
This first reading of this proposed amended ordinance was held on
March 9, 1988; the second reading is scheduled for March 22,
1988.

After further discussion, the Department of Human Resources recommends
conducting the Employee of the Year presentation at either the March 22
or April 12 Board of Supervisors' meeting instead of the Board of
Supervisors' meeting 'scheduled tomorrow.
Due to short notice, there are some departmental nominees who are not
able to attend the presentation if held tomorrow. In addition, there
appears to be some problem completing the board resolutions for nominees
by tomorrow.
We recommend conducting the Employee of the Year presentation at the
