3.1.3 Classrooms and auditoriums.
3.1.4 Lobbies, hallways, elevators, and restrooms.

3,2.1 Individual work areas will be designated as "smoking areas"

3.3 Based on unique characteristics in structure and authority of the
Courthouse and County Jail, those buildings are specifically
excluded from this policy. It is expected that a clean air policy
will be developed in order to provide nonsmoking employees, guests,
inmates, and visitors with an environment as free from tobacco
smoke as possible.
4,0 RESOLUTION OF DISPUTES AND ENFORCEMENT:

4.8.2 Designated smoking areas will be determined by personnel
working in a facility or by a committee seleroediatemsigns

4.8.3 Signs prohibiting smoking in areas specified in paragraph

4.8.4 Employees who desire assistance with smoking cessation or

include smoking cessation classes provided by the County.

On June 23, 1987, the Board of Supervisors approved an
ordinance allowing Roanoke County to regulate the installation of
septic tanks by requiring any person desiring to install a septic
tank to secure a permit at a cost of $50.
When the General Assembly passed House Bill 418 at its 1988
session which authorizes the State Board of Health to establish
fees for applications for permits tothe State tBoardlof Health
disposal systems and private wells,

WHEREAS, by ordinance adopted on June 23, 1987, the
Board of Supervisors of Roanoke County, Virginia, amended Chapter
18, Sewers and Sewage Dis osal, to require that any person desir-
ing to install a septic tank secure a permit to do so and pre-
scribed reasonable fees for the issuance of such permits; and
WHEREAS, legislation adopted by the 1988 session of the
General Assembly, Acts of the Assembly 1988 Session, Chapter 203
(House Bill 418), authorized the Board of Health to establish

disposal systems, not to exceed Fifty Dollars ($50), and private
wells, not to exceed Twenty-five Dollars ($25); and
WHEREAS, the State Board of Health meeting on May 10,
1988, has adopted emergency regulations to implement a fee system
for applications for permits for both on-site sewage disposal
systems and private well construction effective July 1, 1988; and
WHEREAS, it is necessary for the County to modify its
procedures to achieve coordination between the County and the
Department of Health as to the processing of application for and
payment of both County and State permit fees for on-site sewage
disposal systems and state permit fees for private well construc-
tion.

BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, that Chapter 18, Sewers and Sewage Disposal, of
the Roanoke County Code be, it hereby is, amended to read and
provide as follows:
1. All building in the County in those areas where
septic tanks are permitted shall have an on-site sewage disposal
system or septic tanks installed for the disposing of sewage and
other human waste.
2. Before any on-site sewage disposal or septic tank
systems or private wells are constructed or installed, it shall
be the duty of the landowner upon whose land the construction or
installation ~s- to shall take place to secure a permit
€~ex~ to be issued by the Health Department. Application for
such ermit(s) shall be made to the Count 's De artment of Devel-
o ment and Inspection, or its successor, upon forms prescribed by
the Health Department.
3. There is hereby established a Count permit fee of
fifty dollars ($50.00) for each on site sewage disposal system or
septic tank. This permit fee, along with the state permit fee of
fifty dollars ($50.00)_ shall be paid to the Treasurer at the time
a lication is made for a ermit and before the a lication will
be rocessed b the Health De artment. The state ermit fee of
twent -five dollars ($25.00) for construction of a rivate well
likewise shall be aid to the Treasurer at the time a lication
is made for such ermit and before rocessin b the Health
Department. The Treasurer shall not collect the state fee(s)

from owner's whose family income is at or below the applicable
Income Guidelines as provided under state regulation.
4. The Health Department shall review this permit
request application based upon the requirements and regula-
tions promulgated pursuant to Title 32.1 of the Code of Virginia.
Any septic tank permit issued under this section shall be valid
for a period of fifty-four (54) months from the date of issuance
unless there has been a substantial, intervening change in the
soil or site conditions where the septic system is to be located.
The availability of a public sewer system shall constitute a sub-
stantial intervening change in the site conditions to void a per-
mit.
5. In the event the Health Department denies a permit
on the land on which the owner seek to construct his principal
place of residence, the county's portion of the state application
fee shall be refunded to the owner. Such fee shall not be re-
funded by the County until final resolution by the Health Depart-
ment of an a eals made b the owner from such denial.
6. A lications shall be limited to one site specific
ro osal When site conditions change, or the needs of the a pli-
cant chan e or the a licant ro oses and re nests another site
be evaluated, and a new site evaluation is conducted, a new appli-
cation and fee is required.
7. Any person, firm, or corporation violating any pro-
visions of this ordinance shall be subject to a Class 3 misdemean-
or for each offense; and a separate offense shall be deemed com-
mitted on each day during or on which a violation occurs or con-

tinues. Further, any violation or attempted violation of this
ordinance may be restrained, corrected, or abated by injunction
or other appropriate proceeding.

AGENDA ITEM: Easement for APCO at the Fire and Rescue Training Center
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND:
The Board of Supervisors approved the concept of a regional fire
and rescue training center at the Public Service Center in June of 1985.
The Fire and Rescue Department has been able to move forward with this
program and has completed phase I of the Center. Phase I included the
construction of a 2 1/2 story burn building. Phase II of the project
has just begun. This phase includes all site work and improvements.
One section of this phase includes providing complete electrical service
and lighting for the site. In order for APCO to provide this utility,
an easement is required. This easement will allow APCO to construct and
maintain the electrical service lines into the Fire and Rescue Training
Center.
ALTERNATIVES AND IMPACTS:
1. Approve the easement for APCO to provide and maintain electrical
service to the Fire and Rescue Training Center.
STAFF RECOMMENDATION:
The first reading was held on July 26, 1988. Staff recommends
approval following the second reading.

BUILDING CODE BOARD OF ADJUSTMENTS .AND APPEALS
A. COMPOSITION:
To be comprised of five (5) members; ::appointed by the Board
of Supervisors. Members may be reappointed, and terms should be
staggered so that less than half of the terms expire in any one
year. The Board of Supervisors may appoint alternate members who
may sit on the Board in the absence of any regular members, and
shall have the full power and authority of the regular member.
Board members shall be selected on the basis of their ability to
render fair and competent decisions- regarding application of the
code, and•shall to the extent possible, represent different
~~•occupational or professional .fields. At least one member should
be an experienced builder. At least one member should be a
licensed professional engineer or architect.
B. DUTIES-

Shall act on application for appeals as required by Section
36-105 of the Code of Virginia; or it shall enter into an
agreement with the governing body of another county or

approved by the Virginia Department of Housing and Community

COURT SERVICES UNIT ADVISORY COUNCIL/YOUTH AND
FAMILY SERVICES ADVISORY BOARD
A. COMPOSITION
Board to consist of two members from each magisterial
district, and one youth member from each high school. Governing
bodies of each county and city served by a"court service unit may
appoint one or more members to a citizen advisory council.
B. DUTIES:
Advises and cooperates with the court upon all matters
affecting the working of this law and other laws•:relating to
children, their care and protection and to domestic relations;
Consults and confer with the court and director of the
court service unit relative to the development and extension of
•the court service program; --
Encourage the members selected by the council to serve on
the central advisory. council to visit as often as the member
conveniently•can, institutions and associations receiving
children under this law and to report to the court the conditions
and surroundings of the children received by or in charge of any
such persons, institutions or associations.
The Council should make themselves familiar with the work
of the court. Makes an annual report to the court and the
participating governing bodies on the work of the council.
Rs the Youth and Family Services Advisory Board:
Establish goals and priorities for County-wide youth
services; assist in coordination and plannipg for comprehensive
youth services within the private sector. Serve in an advisory
capacity and to otherwise assist the Board of Supervisors to
establish goals and objectives in compliance with all "minimum
Standards of the Delinquency Prevention and Youth Development Act
of 1979". Assist in conducting an assessment of the needs of
youth every five years and to assist in~-developing an annual
Delinquency Prevention Plan, further to participate in evaluating
the implementation of the plan and making a report thereon tb the
Board of Supervisors. Provide a public forum where concerns
about youth may be expressed and to receive recommendations and
raise concerns of ..public and private organizations at any regular
{ advisory board meeting upon proper notice. Advocates necessary
legislative ainendme~nts to improve community conditions for youth
- development and to support the development of needed services
both public and private for youth in the community.
C. MEETING SCHEDULE:
One a quarter, the third Tuesday, beginning January; time
and place determined at meetings.

County's personnel policies, rules and regulations.. The panel
shall select for each hearing a panel chairman, set a time for
the hearing which shall be held as soon as practical, but no
later than fifteen (15) full working days after the grievant
appeal..

and Lloyd G. Lazarus that Woodmont Drive be accepted and made a
part of the Secondary System of State Highways under Section
33.1-229 of the Virginia State Code.
2. That it appears to the Board that drainage easements
and a f i f ty ( 50 ) foot right-of -way for said road have been
dedicated by virtue of a certain map/maps known as Woodmont
Manor, Section 3 Subdivision which map was recorded in Plat Book
10, Page 59, of the records of the Clerk's Office of the Circuit
Court of Roanoke County, Virginia, on May 11, 1987, and Woodmont
Manor, recorded in Plat Book 6, Page 87, on May 12, 1967, and

SUMMARY OF INFORMATION:
James H. Buckland and Lloyd G. Lazarus, the developers of
Woodmont Manor, Section 3, request that the Board of Supervisors
approve a resolution to the Virginia Department of Transportafrom
requesting that they accept 0.08 miles of Woodmont Drive,
its intersection with Cave Spring Lane to its terminus at the
cul-de-sac.
The staff has inspected this road along with representatives
of the Virginia Department of Transportation and find the road is
acceptable.
FISCAL IMPACT:
No County funding is required.
RECOMMENDATIONS:
The staff recommends that the Board approve a resolution to
the Virginia Department of Transportation requesting that they

Estates to the new APCO Service Center.
At the July 26, 1988, meeting, the County staff requested
that the Board of Supervisors schedule a
acquisition of the easements required fore Ybisicroeectng for the
necessary due to the tight time frame of this project and the
possibility of not being able to negotiate a successful agreement
with the property owners.
SUMMARY OF INFORMATION:
During construction of I-81
an 8 inch diameter carrier pipe 1,100 fe tuacrosssthe interstate.
It is planned to use this i e as a Paid to install
being extended to the APCO serf ce centeortion of the sewer line
The staff has negotiated with Mr.
acquisition of this pipe and an easement through the remaindert of
his property. Mr. Huffman has agreed to accept $30,000 as
payment for the pipe and damages to his corn field.

BACKGROUND-
The Board of Supervisors has previousl a

that the Board of Supervisors schedule a

SUMMARY OF INFORMATION:
The County staff has been negotiating with the executors of
the Harris Estate and have reached agreement on the location of
the line. The purchase price must still be agreed on and
approved by the Board of Supervisors.
The total land area involved in the easement is 0.86 acres.
The property is presently assessed at a
acre resulting in a value of pproximately $3,500.00 per
requested payment in the amount of $4,300.000($5000e00 wners have

a. White Eagle Lane, a section of road extending from
Cherokee Hills Drive (Route 1161) in a northeasterly
direction to Buffalo Circle for a distance of 0.06
miles .
b. Buffalo Circle extending in a northwest - southeast
direction from a T-turn around to a cul-de-sac and
intersecting with White Eagle Lane for a distance of
0.15 miles.
c. Blackhawk Circle extending from Buffalo Circle in a
southwest direction to a cul-de-sac for a distance of
0.04 miles.
d. Tee-Pee Lane extending from Cherokee Hills Drive (Route
1161) in a southerly direction to Warrior Drive for a
distance of 0.07 miles.

the Virginia Department of Transportation Secondary
Road System.
COUNTY ADMINISTRATOR'S COMMENTS:
SUMMARY OF INFORMATION:
The residents of Section 1, Cherokee Hills Subdivision
request that the Board of Supervisors approve a resolution to the
Virginia Department of Transportation requesting that they accept
the above noted roads into the State Secondary System. The roads
have been inspected by County and VDOT personnel and necessary
right of way and easements have been acquired.
FISCAL IMPACT:
The cost for these road improvements were included in the
Roanoke County 1985 Road Bond. The preliminary estimated cost
for these improvements is $185,000 dollars.
RECOMMENDATIONS:
The staff recommends that the Board of Supervisors approve a
resolution to the Virginia Department of Transportation
requesting that they accept White Eagle Lane, Buffalo Circle,
Blackhawk Circle, Tee-Pee Lane, Warrior Drive, Buckskin Lane,
Canoe Circle, Warbonnet Road, Tomahawk Circle, and Scout Circle
into the Secondary Road System.

RESOLUTION REQUESTING ACCEPTANCE OF
WHITE EAGLE LANE, BUFFALO CIRCLE, BLACKHAWK CIRCLE, TEE
PEE LANE, WARRIOR DRIVE, BUCKSKIN LANE, CANOE CIRCLE,
WARBONNET ROAD, TOMAHAWK CIRCLE, AND SCOUT CIRCLE INTO
THE VIRGINIA DEPARTMENT OF TRANSPORTATION SECONDARY
ROAD SYSTEM
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That this matter came this day to be heard upon the
proceedings therein and upon the application for:
a. White Eagle Lane, a section of road extending from
Cherokee Hills Drive (Route 1161) in a northeasterly
direction to Buffalo Circle for a distance of 0.06
miles .
b. Buffalo Circle extending in a northwest - southeast
direction from a T-turn around to a cul-de-sac and
intersecting with White Eagle Lane for a distance of
0.15 miles.
c. Blackhawk Circle extending from Buffalo Circle in a
southwest direction to a cul-de-sac for a distance of
0.04 miles.
d. Tee-Pee Lane extending from Cherokee Hills Drive (Route
1161) in a southerly direction to Warrior Drive for a
distance of 0.07 miles.
e. Warrior Drive extending in a northwest - southeast
direction from a T-turn around to a cul-de-sac and
intersecting with Tee-Pee Lane for a distance of 0.20
miles.

f. Buckskin Lane extending from Cherokee Hills Drive
(Route 1161) in a northerly direction to a cul-de-sac
for a distance of 0.08 miles.
g. Canoe Circle extending from Cherokee Hills Drive (Route
1161) in a northerly direction to a cul-de-sac for a
distance of 0.07 miles.
h. Warbonnet Road extending from Cherokee Hills Drive
(Route 1161) in a northerly direction to a cul-de-sac
for a distance of 0.10 miles.
i. Tomahawk Circle extending from Warbonnet Road in a
westerly direction to a cul-de-sac for a distance of
0.09 miles.
]• Scout Circle extending from Cherokee Hills Drive (Route
1161) in a southwesterly direction to a cul-de-sac for
a distance of 0.09 miles.
Pursuant to Section 33.1-72.1, Paragraph C-1 and funded pursuant
to Section 33.1-75.1, Paragraph A of the Code of Virginia, of
1950 as amended.
2. That this Board does guarantee the Commonwealth of
Virginia an unrestricted right-of-way of 50 feet with necessary
easements for drainage as recorded in Plat Book 9, page 59, dated
February 13, 1976, and deeds of later dates, of record in the
Roanoke County Circuit Court Clerk's Office.
3. That this Board does certify that this road was open to
public use prior to July 1, 1978, at which time it was open to
and used by motor vehicles.
4. That this Board does certify that speculative interests
are not involved.

5. That said roads known as White Eagle Lane, Buffalo
Circle, Blackhawk Circle, Tee-Pee Lane, Warrior Drive, Buckskin
Lane, Canoe Circle, Warbonnet Road, Tomahawk Circle and Scout
Circle and which are shown on a certain sketch accompanying this
resolution be, and the same is hereby established as public
roads to become a part of the state secondary system of highways
in Roanoke County, only from and after notification of official
acceptance of said street or highway by the Virginia Department
of Transportation.

WHEREAS, from 1973 to 1980, certain oil companies
overcharged for their products and a fund was established
allowing these companies to refund these monies, and
WHEREAS, The Greater Roanoke Transit Company has applied
for these funds from the Virginia Department of Transportation,
to allocate them to the RADAR/CORTRAN, and
WHEREAS, RADAR/CORTRAN will use these funds for
a $56,310 project which involves the computerization of vehicle
data collection devices.
THEREFORE, BE IT RESOLVED by the Board of Supervisors of
Roanoke County, Virginia as follows:
1. That the Board of Supervisors supports the request
of the Greater Roanoke Transit Company to receive Oil Overcharge

The cost for installing
approximately $9,000 as estimated by the Director of General Services.
In addition to the cost of air filtering devices provided by the county,
the Director of General Services also estimates that approximately
$1,000 will be required for necessary signs in implementing and
informing employees and the public on this policy.

The total estimated cost for the air filtering devices and signal will
be approximately $10,000.
Enclosed is the Roanoke County smoking policy recommended by the Smoking
Policy Committee.
We would like to present this policy to the Board of Supervisors for its
consideration and recommend the appropriation of funds required to place
this policy into effect.

RE: Estimated Cost for Signage and Air Filtering Devices
For County Buildings and Leased Space
I have compiled an estimated cost from the information furnished
by members of the Smoking Policy Committee for signs and air
filtering devices for County owned buildings and leased space.
There will be approximately 275 signs needed to indicate
"Smoking" or "No Smoking" if these signs are placed throughout
offices, breakrooms, lunchrooms, hallways, etc., and entrances to
each County-owned building and leased space, except the Roanoke
County Courthouse.
r 275 signs 2" x 8" @ $3.00 each = $ 825.00
275 signs 2" x 10" @ $3.75 each = $1,031.25
These prices were quoted to me from Roanoke Stamp and Seal.
The Smokeeter air filtering devices needed in Roanoke County-
owned and leased buildings would be used in common areas only.
These units vary in price from $445 to $1,295 + delivery and
installation and maintenance fees.
Based on the information received from committee members, there
will be a need for 8 units a t an approximate cost of
$ 8,860. This amount includes delivery and installation.
Service c ontracts are available for these units at an annual rate
or units can be serviced and charged per visit.
The above Smokeeter prices are subject to negotiation depending
on the number of units purchased.
An estimated cost for 275 - 2"x8" signs and 8 air filtering
devices is $ 9,685.
Estimated cost for 275 - 2"x10" signs and 8 air filtering devices
is $9,891.
I have enclosed a copy of the revised Smoking Policy to be sub-
mitted with the Board report for the June 28th Board meeting.

1. 0 PURPOSE: ~~''=
The purpose of this Roanoke County Smoking Policy is to establish
a policy for County owned buildings and facilities, including
leased space, that will protect the rights of the nonsmokers for
for an environ ment as free from secondhand and sidestream smoke
as possible, and to provide those who choose to smoke, the
opportunity to do so.
The County plans to provide employees and the public with an
example of health promoting behavior, by maintaining an
environment as clean and healthful as possible and to reduce the
discomfort of employees and the public whose tolerance for
tobacco smoke is limited. Furt}zer, sidestream smoke contains
higher concentrations of carcinogenic and toxic gases and
c}zemicals shown to affect the healt}z and comfort of nonsmokers
,oho come in contact with the smoke.
It is believed that a spirit of thoughtfulness and cooperation
among employees and the public in County buildings and facilities
is normally adequate to resolve any disputes which might arise
under the policy. It is part of tlz.is policy that where disputes
cannot be resolved, the rights of the nonsmoker for clean air
s}Zell be giveci precedence.
2.0 DEFINITIONS:
2.1 Smoking...Carrying or possessing any lighted tobacco
products, to include: cigars, pipes, and cigarettes.
2.2 Designated Smoking Area...Any area within a County facility
w}iere smoking is specifically permitted and shall be so
situated as to allow nonsmoking individuals reasonable
opportunity to conduct normal activity in an area as smoke
free as possible.
3.0 POLICY:

indicated in 3.2.1.

4.1 Smoking will be prohibited in any work area if one employee
who is assigned to that area, or who is a victim of environ-
mental tobacco smoke emanating from that work area,
registers a confidential complaint to his/her super-
visor about smoking, asks that smoking be prohibited, and

through the employee health program - "Heart at Work"
which will include smoking cessation classes provided

4.8.2 Designated smoking areas will .be determined by per-
sonnel working in a facility or by a committee
selected from the smokers and nonsmokers of the
facility. Appropriate signs will be installed.
4.8.3 Signs prohibiting smoking in areas specified in
paragraph 3.1 will be installed.
4.8.4 Employees who desire assistance with smoking cessa-
tion or reduction will be provided information about
available methods and programs. The specifics of the
employee incentives will be addressed and developed
through the employee health program - "Heart at Work"
which will include smoking cessation classes provided
by the County.
