While there is no requirement for the County to implement such a program, there are many reasons to do ortunit ies ototywo en mandd progress in providing employment opp minorities but more can be done in promoting, recruiting and training of these employees. The attached plan was prepared by Mary Hicks of the County Administrator's Office. Guidance was provided by the Department of Human resources and the plan was reviewed by an outside consultant. At this time, the Board will be asked to review the proposed plan. Questions and suggestions can be incorporated in a final document which should be brought to the Board fo o ram eshould be the next meeting. DISSEMINATION OF EEO POLICY When the Affirmative Action Plan has been approved, copies of the complete text shall be distributed to every County department. Roanoke County department headartmentewh~chlwouldobe maintaining a current plan within their dep available to their employees. All County officers, department heads, anduoreartolattend a management or supervisory positions will be req briefing session during which the Director of Human Resources will explain the Plan and the preliminary work that will accompany goal setting and implementation. Several briefing sessions shall be held to ensure that all management-level employees are able to attend. RESPONSIBILITY FOR IMPLEMENTATION While final accountability for this Affirmative Action Plan remains with the Roanoke County Administrator, overall responsibility for its implementation and success is assigned to the Director of the Human Resources Department. This responsibility includes ensuring that classification, discipline, educational reimbursement, hiring, layoff and return from layoff, pay, placement, posting, promotion, recruiting, selection, termination, testing, training, transfer, and all other formal or informal County benefits and activities are free of discrimination. This responsibility also includes ensuring that all County-owned facilities are available to employees °and non-discriminatory basis and that all educational, social, recreational programs sponsored for employees are open to participation by all employees. Secondary responsibility for successful implementation of this Affirmative Action Plan belongs to the entire o°tnof administrative and managerial staffressotoward meeting the affirmative action and demonstrable prog affirmitive action goals set annually shall be factors in the evaluation of every management-level employee's job performance. IDENTIFICATION OF PROBLEM AREAS The composition of the County workforce as of June 1989, is ~- shown in Appendices A, B, and C. Appendix A, Workforce Analysis, provides information on County employment of females and minorities for the years 1987, 1988 and 1989. As indicated, County employment of these two groups has remained stable with a one percent overall net increase in employment of females and a one percent overall net decrease in employment of minorities, for this three-year period. Appendix B, Utilization Analysis, provides information on the current composition of the County workforce. Females and minorities are grouped according to the eight broad cateortunitf employment used by the federal Equal Employment Opp Y Commission (EEOC). Females and minorities are further grouped by specific occupational category. Appendix B shows a comparison of the percentage of females and minorities in the occupational categories with the percentage of females and minorities currently available in the community. The EEOC refers to this comparison as utilization. The Utilization Analysis shows that the County meets or exceeds the available community percentage of females in twelve occupational categories, and meets or exceeds the available community percentage of minorities in eight occupational categories. The County does not meet the available community percentage of females in eleven occupational categories, and does not meet the available community percentage of minorities in fifteen occupational categories. This is referred to as under utilization. Appendix C, Establishment of Goals, identifies goals for increasing County employment of females and minorities. Appendix B identified eleven occupational categories of females and fifteen occupational categories of minorities where county employment does not meet available community percentages of these groups. Includes child support workers, eligibility workers, home health aides, homemaker aides, laboratory assistants, library assistants, personnel assistants, police auxiliary, recreation assistants, research assistants, title investigators, welfare case aides, and kindred workers. Office/Clerical Occupations in which workers are responsible for internal and external communication, recording and retrieval of data and/or information, and other paperwork required in an office. Includes accounting clerks, bookkeepers, clerks, clerk-typists, court transcribers, customer service representatives, data entry operators, dispatchers, hearing reporters, license distributors, messengers, office machine operators, payroll clerks, secretaries, statistical clerks, stenographers, tellers, and kindred workers. Skilled Craft Workers Occupations in which workers perform jobs which require special manual skills and a thorough and comprehensive knowledge of the processes involved in the work, which is acquired through on-the-job training and experience or through apprenticeship or other formal training programs. The goals established are goals which we feel could reasonably be attained if business were to remain at its present level. Each of the goals which have been set are, significant and we believe attainable by putting forth our good faith effort to make the overall program work. The goals which have been set in each of the underutilized categories are not to be considered rigid and inflexible. Each of the goals has been set in relation to the underutilization compared to the labor market availability in each of the job categories. Thus, each affirmative action commitment shown within this report has been designed to correct identifiable deficiencies within the job categories of the organization as compared to the labor market figures. Our ultimate goal is to eliminate any area where we are under- utilized in any job category. However, our work force may undergo temporary layoffs/recalls due to changing economic conditions. Roanoke County presently provides no formal career counseling program nor are in-house, County-sponsored training or educational programs available on a regular basis. Without counseling and guidance, those employees can only choose, at will and at random, the classes, seminars, or programs which they hope will prove beneficial. Staff believes that this period of time should be sufficient to receive a response from the Division of Waste Management concerning the Part A application for a permit for a solid waste disposal facility in this area. If the permit is granted, then the County could exercise the option. If the permit is not granted, the County would forfeit the option deposit. If the Board determines to exercise the option, it would have to adopt an ordinance authorizing the acquisition of this real estate. This program provides a dispositional alternative to the judges of this court for individuals before the court on traffic- related offenses. The judges of that the Juvenile and Domestic Relations Court have found this program to be a success. SUMMARY OF INFORMATION: The Judges of the General District Court for the Twenty-Third Judicial District, which encompasses Roanoke County, have requested the Board to establish such a Driver Improvement Program in this court as authorized by Section 46.1-16.1 of the Code of Virginia, 1950, as amended. If such a program is adopted by the Board of Supervisors for this jurisdiction as required by law, it will be administered by the Chief Judge of the District and operated through the Roanoke Valley Alcohol Safety Action Program. The program will be limited in participation to those individuals referred by the General District Court as a result of violations of Articles 1 through 6 of Chapter 4 of Title 46.1 of the Code of Virginia or any ordinance of Roanoke County regulating traffic. Lumsden & Associates, dated March 15, 1979, was thought by County staff to have come within the possession of Roanoke County. Subsequently a storm drain was constructed under Starmount Avenue terminating in an 18-inch pipe emptying into the back yard of the owner of this property, John D. Kelly. In April 1988, Mr. Kelly called the County to complain about stormwater run-off into his yard and damage to a brick retaining wall located within the area assumed by the County to be part of its easement. SUMMARY OF INFORMATION: In March of 1989, the County received a claim from Mr. Kelly's legal counsel in the sum of $9,820.00 for damages attributed to Roanoke County and the Virginia Department of Transportation from surface water drainage onto this land. Subsequent investigation has revealed that, in fact, Roanoke County has no easement for drainage across this property. Virginia law clearly establishes that a private property owner has been damaged by a taking without just compensation where drainage of a public nature occurs across property which could lawfully be condemned for such public use. This homeowner would appear to have a legally enforceable claim for damages in a suit for inverse condemnation or implied contract. Extensive negotiations with Mr. Kelly including at least two site visits have resulted in a settlement agreement for the purchase of a 10-foot drainage easement for $5,000 in lieu of any damages and the County's undertaking to construct an underground storm drain from the current open terminus to the existing drainage easement at the eastern edge of this lot. The County has agreed use all reasonable efforts to complete this construction within 90 days from July 1, 1989. ALTERNATIVES AND IMPACTS: ;..,~ The estimate cost of the installation of an underground drain at this location is approximately $12,500 which would come out of the current drainage fund. The $5,000 for purchase of this easement will come out of the Board's contingency fund. The alternative is to deny the claim and proceed to litigation upon the property owner's claim for taking without just compensation and related damages. A judgment against the County might be several times the current settlement figure. STAFF RECOMMENDATION: Staff recommends acceptance of the settlement negotiated with the property owner for purpose of an easement and construction of an underground storm drain. Michael Lazzuri, Director of Court Services has contacted the present members of the Court Service Unit Advisory Council/Youth and Family Services Advisory Board to determine whether they wished to continue serving. The following terms expired in 1988 or will expire in 1989. Appointments to this committee are not made by magisterial district; however, the magisterial district is listed for each member. Two-year term of James L. Trout, Vinton Magisterial District, will expire March 22, 1989. Mr. Trout has not responded to Mr. Lazzuri's letter. Two-year term of Ted R. Powell, Cave Spring Magisterial District, will expire March 22, 1989. Mr. Powell would like to be reappointed. Two-year term of Hoyt C. Rath, Vinton Magisterial District, will expire March 22, 1989. Mr. Rath does not wish to serve another term. Two-year term of Dr. Andrew Archer, Vinton Magisterial District expired March 22, 1988. Dr. Archer does not wish to be reappointed. In addition to the appointments listed above, it is necessary to appoint four youth members, one each from Cave Spring High School, Northside High School, Glenvar High School, William Byrd High School. Mr. Lazzuri recommends that these appointments run from September through September. WE CONVINCED THE ROANOKE HISTORICAL SOCIETY BOARD (LOCATED AT CENTER IN THE SQUARE), AND THE BOARD OF DIRECTORS OF THE VIRGINIA ASSOCIATION OF VOLUNTEER RESCUE SQUADS (VAVRS) TO SIGN A CONTRACT WHEREIN THEY SPEECH/ROANOKE CITY COUNCIL -3- WOULD MUTUALLY AGREE TO WORK TOWARDS ESTABLISHING A MUSEUM EXHIBIT IN OUR EXPANDED CENTER IN THE SQUARE. THE VIRGINIA ASSOCIATION OF VOLUNTEER RESCUE SQUAD BOARD OF DIRECTORS PUT UP $8,000 TO PAY FOR THE SERVICES OF A MUSEUM CONSULTANT TO OUTLINE A SUGGESTED MUSEUM CONFIGURATION, AND TO HELP ESTABLISH AN ESTIMATED BUDGET. 3. FOLLOWING THIS WORK, THE VCR TAPE YOU JUST WATCHED WAS CREATED, AND THIS SHOW, MUSEUM CONFIGURATION, AND BUDGET WAS SHARED WITH CITY OFFICIALS - MAYOR TAYLOR, MR. HERBERT, AND OTHERS. 4. CONCURRENT TO THE FOUNDATION BOARD BEING ORGANIZED, WE TURNED OUR ATTENTION TO THE #1 TASK OF RAISING 1.8 MILLION DOLLARS BUDGETED BY THE CONSULTANTS, AND APPROVED BY THE HISTORICAL SOCIETY BOARD, AND ULTIMATELY OUR FOUNDATION BOARD. INCIDENTALLY, THE 1.8 MILLION DOLLARS BREAKS OUT (IN BROAD TERMS) AT APPROXIMATELY $800,000 FOR THE ESTABLISHMENT OF THE MUSEUM, AND $1,000,000 FOR AN ENDOWMENT FUND ADEQUATE TO PERPETUATE THE MUSEUM. SPEECH/ROANOKE CITY COUNCIL -4- 5. PRIOR TO A FORMAL, FULL-BLOWN FUND-RAISING EFFORT, OUR BOARD CONCLUDED BOTH STATE AND LOCAL MONIES WERE ESSENTIAL. A DELEGATION OF OUR BOARD WENT TO SEE DELEGATE RICHARD CRANWELL TO SEEK HIS ADVICE AND GUIDANCE IN SECURING STATE MONEY FOR OUR CAUSE. TO MAKE A LONG STORY SHORT, HE CONVINCED GOVERNOR BALILES, IN THE LAST SHORT SESSION OF THE LEGISLATURE, TO INCLUDE IN HIS BUDGET A FIGURE OF $500,000 IN MATCHING FUNDS. TO OUR GOOD FORTUNE THESE FUNDS WERE APPROPRIATED AND MAY BE DRAWN BEGINNING JULY 1, 1989, UT THE FUND TERMINATES JUNE 30, 1990. THESE FUNDS MAY BE DRAWN IN ANY AMOUNT, BUT ARE RESTRICTED TO CAPITAL EXPENDITURES, ARCHITECT FEES, ETC. IN ADDITION TO FAVORABLE DISCUSSIONS WITH BOTH SALEM AND VINTON TOWN MANAGERS, WE HAVE ALSO APPEARED BEFORE BOTH COUNCILS, AND HAVE BEEN ASSURED OF FINANCIAL SUPPORT. WE HAVE ALSO FAVORABLY DISCUSSED SUPPORT WITH COUNTY ADMINISTRATION. LASTLY, A LOCAL BANK AND HEALTHCARE INSTITUTE HAVE EACH PLEDGED $25,000 TOWARDS THIS CAUSE. SPEECH/ROANOKE CITY COUNCIL -5- 6. TO FURTHER BOLSTER OUR OPTIMISM, ROANOKE CITY FATHERS WERE KIND ENOUGH TO PAY FOR A PRELIMINARY FUND-RAISING STUDY - THE NET RESULTS OF WHICH WERE FAVORABLE. CERTAINLY WE WOULD NOT BE STANDING BEFORE YOU TODAY WITHOUT THIS ASSISTANCE. I UNDERSTAND YOU HAVE RECEIVED AND REVIEWED A COPY OF THE STUDY. 7. THE EXECUTIVE COMMITTEE OF OUR BOARD OF DIRECTORS HAS REVIEWED A PROPOSED CONTRACT WITH GEOFF WHITTAKER, THE SAME FUND-RAISER THAT SUCCESSFULLY WORKED WITH CENTER IN THE SQUARE. WE HOPE TO EXECUTE THIS CONTRACT DURING JUNE. 8. A MUSEUM ARCHITECT WILL HAVE TO BE SELECTED TO DESIGN THE MUSEUM, AND TO HELP WITH ITS CONSTRUCTION. 9. Monday, May 22, 1989 Group plans rescue squad museum toad By JOEL TURNER MUNICIPAL WRITER The Julian S. Wise Foudation will try to raise more than S 1 million to help pay for a proposed museum for the volunteer rescue squad movement and to create an endowment fund for the museum. The General Assembly has appropriated SS00,000 for a proposed state-of-the-art exhibit of rescue squads that will be a wing in the Roanoke Valley History Museum in Center in the Square. I.B. Heinemann, president of the Wise Foundation, said today that consultants have estimated that the museum would cost about 5800,000. The foundation also hopes to raise at least S 1 mil- lion for an endowment for the museum, he said. The state money can only be used for plans, equip. meat and capital outlay cost for the museum, Heine- mann said, not as part of the endowment. The pnccise amount of the fund-raising campaign will depend on final cost estimates for the museum, he said. Roanoke was the logical play for the museum, he said, because the city was the birth- place of the volunteer rescue squad movement. WHEREAS, the Board of Supervisors is desirous of authorizing the "General District Court Driver Improvement Program", in cooperation with the Roanoke Valley Alcohol Safety Action Program; and, WHEREAS, the "General District Court Driver Improvement Program" to be established by the General District Court, Twenty-third Judicial District, will be self-supporting, operating from money collected as fees from program participants, and will not involve expenditure of any funds appropriated by the County of Roanoke. THEREFORE, BE IT ORDAINED by the Board of Supervisors of the County of Roanoke as follows: 1. The establishment of the "General District Court Driver Improvement Program" by the General District Court, Twenty-third Judicial District, be and is hereby ratified, confirmed and approved. 2. Such program shall be administered by the Chief Judge of the General District Court, Twenty-third Judicial District, through the Roanoke Valley Alcohol Safety Action Program in accordance with the provisions of the Code of Virginia, as amended, with participation restricted to referrals from the General District Court. 3. The "General District Court Driver Improvement Program" shall be self-supporting and operated wholly from funds collected as fees from program participants, with each person participating in the program to be required to pay a fee of $30.00, or such other sum as may be fixed pursuant to law for participating in this program. 4. In order to provide for the usual daily operation of the municipal government, an emergency is deemed to exist, and this ordinance shall be in full force and effect upon its passage. Failure to pay the required fee as ordered by the Court. PART IV, FEE COLLECTIONS A. The collection of the $30.00 fee will be assumed by the RVASAP. PART V, RESCHEDULING FEE A. Any participant,after having been returned to the Court as an unsuccessful Compliant, will be required to pay an additional fee of $20.00 (unless otherwise directed by the Court). PART VI. PROVISIONS FOR INDIGENTS/PARTIAL FEES A. Any individual deemed by the Court to be indigent or otherwise under fiscal duress and so ordered, will be processed and afforded the same treatment as any standard referral. PART VII. ATTENDANCE A. All participants will be required to attend the entire Driver Improvement Program. Failure to complete the program in its entirety will result in the case being returned to the Court as Non-Compliant. B. Excused Absences. 1. The following reasons are acceptable as excused absences: a. Death in the immediate family (Father, Mother, Brother or Sister, Aunts and/or Uncles) verified by official or public record. b. Sickness or illness verified by a physician, in writing. C.
