RESOLUTION 101089-1 CERTIFYING EXECUTIVE
SESSION MEETING WAS HELD IN CONFORMITY WITH THE
CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County,
Virginia has convened an executive meeting on this date pursuant
to an affirmative recorded vote and in accordance with the
provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.1-344.1 of the Code of Virginia
requires a certification by the Board of Supervisors of Roanoke
County, Virginia that such executive meeting were conducted in
conformity with Virginia Law.
NOW, THEREFORE BE IT RESOLVED, that the Board of
Supervisors of Roanoke County, Virginia hereby certifies that, to
the best of each members knowledge:
1. Only public business matters lawfully exempted from
open meeting requirements by Virginia law were discussed in the
executive meeting which this certification resolution applies,
and
2. Only such public business matters as were identified
in the motion convening the executive meeting were heard,
discussed or considered by the Board of Supervisors Of Roanoke
County, Virginia.
On motion of Supervisor Garrett, seconded by Supervisor
Nickens and carried by the following recorded vote:

PROCLAMATION DECLARING THE MONTH
OF OCTOBER, 1989, AS RECYCLING
MONTH IN ROANORE COUNTY
WHEREAS, Gerald L. Baliles, Governor of Virginia, has
proclaimed the month of October, 1989, as Virginia Recycling Month,
to recognize the importance of the recycling efforts of its
citizens; and
WHEREAS, recycling saves natural resources, energy and
land, reduces littering by minimizing the amount of material
improperly discarded; and
WHEREAS, The Commonwealth is committed to a goal of
recycling ten percent of the solid waste stream by 1991, fifteen
percent by 1993, and twenty-five percent by 1995; and
WHEREAS, Roanoke County was the first locality in the
Commonwealth of Virginia to institute a Curbside Source Separation
Recycling Program; and
WHEREAS, the County's efforts have been extremely
successful resulting in increased volunteer participation in
community recycling programs; and
WHEREAS, recycling has already reduced the waste stream
in the Roanoke Valley by seven percent.
THEREFORE, BE IT PROCLAIMED by the Board of Supervisors
of Roanoke County, Virginia, that October, 1989, be designated as
ROANORE COUNTY RECYCLING MONTH

FURTHER, the Board of Supervisors of Roanoke County,
Virginia encourages all businesses, industries and residents to
become more active in recycling and in procuring recycled products
and materials.
PROCLAMATION EXPRESSING APPRECIATION
TO THOSE WHO WORKED TO RESTORE
ELECTRICITY FOLLOWING HURRICANE HUGO
WHEREAS, on Friday, September 22, 1989, at approximately
5:00 a.m., Hurricane Hugo slammed into the Roanoke area, with wind
gusts up to 77 miles per hour; and
WHEREAS, the resulting damage to Appalachian Power
Company facilities was severe, second only to the ice storm in
January, 1979: and
WIiEREAS, at the height of this storm, 40,000 of APCO's
98,592 Roanoke Valley customers were without electricity, and in
the Roanoke Division of Appalachian Power, a total of 64,000
customers lost power; and
WHEREAS, many power lines were broken in multiple
~~,
locations, making even more difficult the restoration of power to
aeople served by those lines.
THEREFORE, BE IT PROCLAIMED that Roanoke County expresses
.ppreciation to the 368 people who worked 20,000 manhours to
-estore electric service; and
BE IT FURTHER PROCLAIMED that as a result of their hard
irk and dedication, 75% of APCO's customers had electricity within
~ hours and 93% were restored within 48 hours.

BACKGROUND'
At the September 12 meeting of the Board of Supervisors, the
staff prepared a brief report on recommendations for a stormwater
management program. One of those recommendations was to adopt
amendments to the existing code to increase stormwater management
requirements for new development.
SUMMARY OF INFORMATION:
The staff has prepared an outline of a complete "Drainage and
stormwater Management" design standard. Several sections of these
standards pertain to stormwater management for new development and
are identified below:
stormwater Management Requirements:
This section provides for increase in detention requirements
from a two-year storm to a 10-year and 50-year storm.
Site Gradina•
Requires site grading plans on all projects to insure proper
drainage to storm water facilities.
Maintenance of stormwater Mana ement Facilities:
Requires maintenance agreements by Ordinance in lieu of by
policy for maintenance of stormwater facilities.
Staff will present at the work session detailed information
on the proposed stormwater management requirements and samples of
the affects of these changes.

This amendment does not address the following:
1. Does not correct existing downstream flooding.
2. Does not address flooding conditions greater than a 50-
year storm.

Ordinance on October 10, 1989, and schedule a Public Hearing and

AGENDA ITEM: Work Session to Establish Drainage Maintenance
Project Priorities
COUNTY ADMINISTRATOR'S COMMENTS:
BACKGROUND
The first list of nineteen drainage maintenance projects was
presented to the Board of Supervisors in February, 1988 for
approval and construction. Nine additional projects were added in
October, 1988. Of these original projects, twenty have been
completed, three are ready for construction, and five are being
pursued in terms of easement acquisition, surveying, and
engineering. In addition to completing $165,000 worth of
improvements on the original list, we have responded to emergency
situations and were responsive to citizen complaints during the
recent heavy rains and flooding conditions.
Staff is now submitting projects P-29 through P-54 for
suggestions, discussion and input from the Board of Supervisors
(see attachment). These projects are also prioritized and
recommended for approval under "New Business." The estimated cost
of these additional projects is $185,000, which with the addition
of the $148,000 from pending projects, will place our committed
costs at $330,000. At current budget levels, the completion of
these projects will be well into the next fiscal year. This cost
projection is comparable to the one expressed to the Board of
Supervisors in October, 1988.

BACKGROUND' ~ ~1~~
The suggested prioritization of drainage maintenance projects
was discussed at this afternoon's work session.
SUNIlKARY OF INFORMATION:
Attached are the exhibits of the previously approved projects
and the proposed projects as prioritized by the staff.
ALTERNATIVES AND IMPACTS:
Alternative 1, would be to approve projects P-29 through P-54
with the realization that we are establishing priority projects
beyond current funding limits. The completion of these projects
could be well into the next fiscal year, but would allow staff to
proceed with design, easement acquisition and scheduling.
Alternative 2, would be to approve only projects P-29 and P-30
which would limit our prioritized project list to current Fiscal
Year 89-90 budget levels. With the rollover of committed funds
from last year's budget, we would be able to finish all projects
through P-30.
No additional funding for fiscal year 89-90 is being requested
for either alternative.
STAFF RECOMI~NDATION : ~~

the understanding that these projects will be completed as funds
become available.

Recreation are in the process of considering requests from
neighboring localities to include several new routes as
Designated Virginia Byways, and
WHEREAS, the Division of Planning and Recreation
Resources and the Department of Transportation have evaluated
these roads and recommend their designation as Virginia Byways,
and
WHEREAS, they have suggested that Route 311 west of I-
81 to the West Virginia state line would also qualify, and are
requesting support for this designation from Roanoke County,
Craig County and Allegheny County.
THEREFORE BE IT RESOLVED that the Board of Supervisors
of Roanoke County endorses the designation as a Virginia Byway of
Route 311 west of I-81 to the West Virginia state line which
would create a byway loop of 100 miles of scenic roadway.

BACKGROUND
The Virginia Byways Program is a state program established to
identify outstanding road segments and to conserve them for the
enjoyment of all Virginians as well as out-of-state visitors.
Certain criteria must be met for a road to be designated a
Virginia Byway. These include scenic value, diversity of
landscape, access to significant sites, and feasibility of
landscape control. No state restrictions are imposed with the
designation, and all land use controls are applied at the local
level. Endorsement by the local governing body of such as
designation is a part of the procedure for designation.
Attached are excerpts from the Guide for Virginia Byway
Management explaining the program further.
SUMMARY OF INFORMATION:
The State Department of Conservation and Recreation is in the
process of considering requests from several neighboring
localities to include several new routes as designated Virginia
Byways. They include Routes 159 and 311 in Allegheny County,
portions of Route 43 in Botetourt County, and portions of Route
606 and 61 in Botetourt and Craig County.
The Division of Planning and Recreation Resources and the
Department of Transportation have evaluated these roads and found
that they qualify as Virgi~.ia Byways. They also note that Route
311 west of I-81 to the West Virginia State line also qualified
for this designation. They have suggested that this- route also
be included as a Virginia Byway which would create a byway loop
of almost 100 miles of scenic roadway. However, such a request
should come from the governing bodies where the roads are
located, and are requesting endorsement of the designation of
Route 311 from Roanoke County, Craig County and Allegheny County.

the 1970 Virginia Outdoors Plan was published, the proposed Virginia Byway
System has been refined to include over 1600 of the more than 50,000 miles
of existing state roads.
In 1973, the first designation came in Fairfax County, when the Board of
Supervisors requested that a historic and scenic segment of Route 193 become
a Virginia Byway.
IV. VIRGINIA BYWAY CRITERIA AND PROCEDURES
The designation process may be initiated by: a) by a locality, through a
citizen's request or governmental action b) by the Department of Conserva-
tion and Historic Resources or c) by the Virginia Department of Transporta-
tion. Once a request has been received, the Department of Conservation and
Historic Resources and the Department of Transportation undertake a field
survey to see if the roadways meet the physical criteria for designation.
The localities should signify that they are interested in the Virginia-Byway
designation before any further steps are taken by the Commonwealth. Usually
the DCHR requests that a letter or a resolution supporting Virginia Byway
designation from the Board of Supervisors be forwarded to Richmond as part
of the record.
Once official assurances are received, DCHR's Divisions of Parks and Recrea-
tion and Historic Landmarks examine the significance of historic sits along
the corridor as well as local zoning and comprehensive plans. If a road
under consideration is found to meet the adopted criteria, the Director of
DCHR then makes a recommendation to the Commonwealth Transportation Board,
which is charged with the legislative responsibility for designation. In
addition, the Department of Transportation staff reviews information and
expresses to the Board its views about designation. The Commonwealth
Transportation Board makes the final determination as to whether a roadway
should receive this designation, the VDOT conducts annual inspections of the
roadway.
A. Adopted Criteria
In order to be considered for designation as a Virginia Byway, a
segment of road must substantially meet the tests of the following
physical criteria:

1. The route provides important scenic values and experiences.
2. There is a diversity of experiences as in transition from one
landscape scene to another.
3, The route links together or provides access to significant scenic,
scientific, historic or recreational points.
4, The route bypasses major roads or provides opportunity to leave
high-speed routes for variety and leisure in motoring.
5. Landscape control or management along the route is feasible.
6. The route is susceptible to techniques to provide for user safety.
7, The route contributes to good distribution within elements of the
scenic highway and Virginia byway system.
8. Preference shall be given to those corridors controlled by zoning
or otherwise, so as to reasonably protect the aesthetic or cul-
tural value of the highway.
If on-site inspection shows that the road(s) meet the physical cri-
teria, the Department of Conservation and Historic Resources' (DCHR)
B. Procedures For Designation
The Department of Conservation and Historic Resources and the
Department of Transportation will jointly:
1. Initiate the study of a potential Scenic Highway or Virginia Byway
as a measure implementing the Virginia Outdoors Plan or upon the
request of a local governing body.
2. Make onsite inspection of the route to determine if it meets the
physical criteria.
3. Request a resolution or other assurance, indicating that the local
governing body (bodies) is interested in scenic designation.
The Director of the Department of Conservation and Historic Resources
will:
4. Coordinate within the Department, with the Virginia Outdoors
Foundation, and with other appropriate state agencies to determine
the location and significance of historic sites and/or other
natural resources in close proximity to the road corridor.

5. Determine that local zoning and comprehensive planning programs of
the locality and the planning district commissions are consistent
with the management objectives established for Scenic Highways or
Virginia Byways.
6. Recommend the designation of the potential scenic highway or
Virginia Byway to the Commonwealth Transportation Board through
the Commissioner of the Department of Transportation.
The Commissioner of the Department of Transportation will:
7. Submit potential scenic highways or Virginia Byways proposals
recommended by the Director of the Department of Conservation and
Historic Resources to the Commonwealth Transportation Board for
their action.
8. Advise the Director of the Department of Conservation and Historic
Resources of Board action.
9. Work with local governing agency to achieve the management objec-
tive(s).
10. Conduct annual inspections of the maintenance and improvements of
the route.
C. Procedures for Designation Revocation
If the Department of Transportation's annual inspection indicates a Scenic
highway or Virginia Byway no longer meets minimum standards, the Common-
wealth Transportation Board will request a joint investigation by the two
Departments. Listed below are the procedural steps which should be fol-
lowed:
1. The two Departments will notify the local governing body, the
planning district commission, interested individuals and organiza-
tions of the requested investigation.
2. In coordination with the local governing body, the Departments
will make an on-site inspection of the route and provide sugges-
tions to the locality for corrections, improvements or restora-
tions as necessary to maintain designation and a recommended time
frame for action.
3. The Directors will recommend to the Co~anonwealth Transportation
Board that the designation be revoked upon finding that the
quality of the road segment cannot be restored to meet minimum
standards.

BACKGROUND•
During the extensive revision of the current Business License
Ordinance adopted on November 22, 1988, no explicit provision was
included establishing criminal liability for failure to apply for
a business license or file a business license tax return. Over the
past nine months, several instances have come to light of
businesses, especially those selling their goods from vehicles,
which are operating in this county without the benefit of a
business license or return.
SUMMARY OF INFORMATION:
Section 58.1-3700 makes it a violation of law to carry on any
business, employment, or profession without first obtaining a
license where the law requires a license and the legislature has
levied a license tax on such business, employment or profession.
Section 58.1-3916.1 attaches criminal penalties for willful failure
or refusal to file a required business license return as well as
for making fraudulent statements in connection with such return.
A recent amendment graduates the penalty based upon the amount of
the lawful tax assessment. A recent addition to Virginia's
criminal code, Section 18.2-248.6, now provides that a business
license shall be forfeited where the entity holding such license
is convicted either of the sale of an imitation controlled
substance under Section 18.2-248 or of laundering of drug related
proceeds under Section 18.2-248.7. A problem which has arisen with
regard to refunds of business license taxes has been addressed by
a change to a quarterly as opposed to a monthly basis for
calculating refunds. However the minimum license tax provided for
by any section of this ordinance would not be refunded.

STAFF RECOMMENDATION:
Staff recommends approval of these amendments in order to
close a significant loophole in the county's business license
ordinance.

WHEREAS, the first reading of this ordinance was held on
October 10, 1989; and the second reading and public hearing was
held on October 24, 1989.
BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. Chapter 10, Licenses, of the Roanoke County Code is
hereby amended as follows:
Sec. 10-4. Application for license; duties of commissioner;

a license, failing to file an application or filing
false statements.
a) All persons embraced by this chapter, unless otherwise
specifically provided, shall make application for licenses to the
commissioner of the revenue by January 31 of each year. The
commissioner of the revenue shall furnish the necessary forms,
which shall be properly filled in with such information as the
commissioner may require. Every applicant for a license to conduct
any business, profession, trade, or occupation under the provisions
of this chapter shall furnish the commissioner of the revenue in
writing with his correct name and trade name; his correct residence
address; the nature of the business, profession, trade, or
occupation to be pursued; the place where it is to be pursued; and
a record of gross receipts verified by oath for the preceding
twelve (12 ) months ; as well as such other information as may be
required by the commissioner of the revenue. The commissioner
shall compute the amount of license tax and after payment shall
issue the license, subject to zoning certification as provided in
section 10-7.
b) It shall be unlawful and a violation of this chapter for
any person to operate a business, profession, trade, or occupation
within the county without having first obtained a license in
accordance with this section and before posting such license as
required b section 10-13. Such violations shall constitute a
class 1 misdemeanor.

c) It shall be unlawful and a violation of this chapter for
any person to make false statements with intent to defraud in any
application, return, or affidavit required by this chapter. Such
violation shall constitute (i) a class 3 misdemeanor if the amount
of the tax lawfully assessed in connection with the return is
$1,000 or less, or (ii) a class 1 misdemeanor if the amount of the
tax lawfully assessed in connection with the return in more than
$1,000. Upon conviction under this section, the commissioner of
the revenue shall revoke all licenses of the business for the
balance of the tax year.
d) AnYt~erson, firm, or corporation holding a license under
this cha ter to o erate an business shall forfeit such license
immediately upon conviction by any court of competent jurisdiction
in the Commonwealth of Virginia of a violation of (i) section 18.2
248 relatinct to an imitation controlled substance or (ii) section
18 2-248 7 relating to money launderinct.
e) No license issued pursuant to this chapter shall be valid
or effective unless and until the tax required shall be paid to the
county treasurer and such payment shall be shown on the license.
f) The commissioner of the revenue shall report monthly to
the treasurer the aggregate amount of license taxes assessed during
the month and placed in the hands of the treasurer for collection.

Sec. 10-15. Certification of erroneous assessment; refunds when
licensee ceases to do business.
a) The commissioner of the revenue is empowered to certify
to the treasurer any instances of erroneous assessments. Upon
receipt of such certificate the treasurer is directed to make a
refund based upon the certificate of the commissioner of the
revenue.
b) Licenses issued under the provisions of article II of
this chapter, except those measured by other than gross receipts
or gross expenditures, shall be subject to refund where the
licensee goes out of business before the end of the current license
year subject to all of the following qualifications:
1) License for the current license year must be based
on gross receipts or gross expenditures obtained
throughout the preceding calendar year.
2) The reason for going-out-of-business is not
connected in any manner with the violation of any
state law or local ordinance or violation of any

rules or regulations made pursuant thereto.
3) The amount of refund shall be determined in the
following manner: If the licensee goes out of
business before the end of any month except
December, the refund shall be calculated by dividing
the tax paid for that year's license by a fraction
in which the numerator shall be the number of months
remaining in the calendar year followina the month
in which business ceases and the denominator is the
number twelve (12): but in no case shall the refund
reduce the tax below the minimum as provided by this
code.

4) No refund shall be made of any minimum flat tax or
of any other flat license fee not based on gross
receipts.
c) Refunds based on licensee going out of business shall be
made in the same manner as herein provided for erroneous
assessments.
d) If any person seeking a refund is indebted to the county
or any department or office thereof, or is indebted to any state
constitutional office of the county for a local levy, the refund,
or so much thereof as is necessary, shall first be applied to such
indebtedness.
e) Any person who has been properly issued a license may
apply for a refund prior to the date upon which the license was to
become effective by providing satisfactory evidence to the
Commissioner of the Revenue that the business was never commenced
or the sale, show, performance, or exhibition will not take place.
Upon being satisfied that such license was never in effect, the

2. That Chapter 10, "Licenses," of the Roanoke County Code

With the increased amount of flooding, in the past several
years, Stormwater Management and Drainage Control has become a
major issue.
The County is presently addressing these issues by:
1. Instituting a drainage program.
2. Recommending detention for rezonings, a 10 year run-off
storm predevelopment to a predeveloped 2 year
condition.
3. Improving enforcement provisions for Erosion and
Sediment Control.
4. The County has identified Stormwater Management as
a valleywide issue.
The proposed standards will require new development (site
and subdivision) to provide adequate detention/retention of
Stormwater to insure that new problems are not created with the
aggravation of old problems.
Further Amendments to the Erosion and Sediment Control
Ordinance, Subdivision Ordinance and the Design Construction
Standards Manual will be necessary as valleywide Stormwater
problems are addressed.

Ordinance.
4. To insure new developments do not create new problems
and aggravate old problems.
This Amendment does not address the folldowing:
1. Does not correct existing downstream flooding.
2. Does not address flooding conditions greater than a 50
year flood storm.
SUMMARY OF INFORMATION:
The first reading of the Ordinance is scheduled for
October 10, 1989; the Public Hearing and second reading is
scheduled for October 24, 1989. The remaining portions of the
Stormwater Management Standards and Specifications will be
presented at a later date.
STAFF RECOMMENDATION:
Staff recommends that the proposed Amendment to the Erosion
Sediment Control Ordinance and the adoption of the Stormwater
Management Criteria be approved.
The Amendments, Additions and Reactments shall be in full
force and affect, from and after October 25, 1989, and the
effective date of this Ordinance and the Stormwater Management
Criteria for the Design and Construction Standards Manual shall

ARTICLE III, DIVISION 2, USE OF VALUE
ASSESSMENT OF CERTAIN REAL ESTATE, OF CHAPTER
21, TAXATION, OF THE ROANOKE COUNTY CODE
WHEREAS, Article III, Division 2, of Chapter 21 of the Roanoke
County Code provides for a use value assessment of certain real
estate in order to preserve agricultural, horticultural, forest and
open space uses within the County's boundaries consistent with the
County's land use plan; and
WHEREAS, the 1989 session of the General Assembly of Virginia
enacted certain amendments to Article 4 of Chapter 32 of Title 58.1
of the Code of Virginia, 1950, as amended, to provide for uniform
standards for real estate taxation to be prescribed by the Director
of the Virginia Department of Conservation and Recreation, the
Virginia Commissioner of Agriculture and Consumer Services, and the
State Forester and other procedurals; and
WHEREAS, pursuant to the provisions of Section 18.04 of the
Charter of Roanoke County, a first reading and public hearing was
held on September 26, 1989; a second reading was held on October
10, 1989, concerning amending Article III, Division 2, of Chapter
21 of the Roanoke County Code pertain to use value assessment and
fee .
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of
Roanoke County, Virginia, as follows:
1. That Chapter 21, Taxation, of the Roanoke County Code be
amended by deleting the present Article III, Division 2 and
reenacting a new Article III, Division 2, Use value assessment of
certain real estate as follows:
Sec. 21-51. Findings.
The County of Roanoke finds that the preservation of real
estate devoted to agricultural horticultural forest and open
s ace uses within its boundaries is in the ublic interest and
having heretofore adopted a land use plan, hereby ordains that such
real estate shall be taxed in accordance with the provisions of
Article 4 of Chapter 32 of Title 58 1 of the Code of Viralnia, the
standards prescribed by the Director of the Virginia Department of
Conservation and Recreation the Vir inia Commissioner of
A ricultural and Consumer Service and the State Forester and this
ordinance.
Sec. 21-52. Applications for special assessment: fees.
ia~ A lications for taxation of real estate on the basis of
use assessment shall be submitted to the real estate assessor on
forms provided by the Virginia Department of Taxation and supplied
b the real estate assessor. The a lication shall include such
additional schedules photographs, and drawings as may be reauired
by the real estate assessor.

which such taxation is sought; or

occurs solely as a result of a conveyance necessitated by

If any tax on the land affected by an application is
delinctuent when the application is filed then the application
shall not be accepted Upon payment of all delinquent taxes,
interest and penalties relating to such land, the application shall
then be treated in accordance with this section.
Sil. Such property owner must revalidate annually with the
real estate assessor any application previously approved. A
revalidation fee of Ten Dollars ($10 00) shall accompany each
application for revalidation every sixth year. Late filing of a
revalidation form must be made on or before the effective date of
the assessment and accompanied with a late filing fee of Twenty
Dollars ($20).
Sec. 21-53. Determination of use value and assessment.

Richmond. VA 23219.
X21 The foregoing requirements for minimum acreage shall
be determined by adding together the total area of contiguous real
estate excludin recorded subdivision lots titled in the same
ownership For purposes of this section, properties separated only
by a public right-of-way are considered continuous.
~_ In addition to meeting the foregoing requirements for
minimum acreage, real estate devoted to open space use shall be.
~ within an agricultural, a forestal, or an
agricultural and forestal district entered into pursuant to Chapter
36 (Sec 15 1 1507 et seq ) of Title 15 1 of the Code of Virginia,
or
~_ subject to a recorded perpetual easement,
restrictive covenant or equitable servitude that is held by a
public body and that promotes the open space use classification
as defined in Sec 58 1-3230 of the Code of Virginia, or
~ subject to a recorded commitment meeting the
standards prescribed by the Director of the Virginia Department of
Conservation and Recreation and entered into by the landowner with
the County.
If the real estate assessor determines that the property
does meet such criteria he shall determine the value of such
ro ert for its alif in use as well as its fair market value.

criteria for "a ricultural use" or "horticultural use" the real
estate assessor may request an opinion from the Commissioner of
A_aricultural and Consumer Services; in determining whether the
subject property meets the criteria for "forest use" he may _request
an opinion from the State Forester; and in determining whether the
subject property meets the criteria for "open space use" he ma
re est an o inion from the Director of Conservation and
Recreation Upon the refusal of the Commissioner of Agriculture
and Consumer Services State Forester or the Director of the
Department of Conservation and Recreation to issue an opinion, or
in the event of an unfavorable opinion which does not comport with
standards set forth by the respective director the party aggrieved
ma seek relief from an court of record wherein the real estate
in question is located If the court finds in his favor it may
issue an order which shall serve in lieu of an opinion for the
,purposes of this ordinance.
Sec. 21-54. Taxation based on qualifying use.
The use value and fair market value of anv aualifvina property
shall be placed on the land book before delivery to the treasurer,
and the tax shall be extended from the use value. Continuation of
valuation, assessment and taxation based upon land use shall depend
on continuance of the real estate in a aualifvina use continued
payment of taxes as required in Section 58 1-3235 and compliance
with other reauirements of Article 4 of Chapter 32 of Title 58.1
of the Code of Virginia, the applicable standards prescribed by the
Director of the Vir inia De artment of Conservation and Recreation
the Vir inia Commissioner of A riculture and Consumer Services and
the State Forester, and this ordinance, and not upon continuance
in the same owner of title to the land.
Sec. 21-55. Indexing and filing of approved applications.
The real estate assessor shall prepare and transmit to the
clerk of the circuit court a list of all applications filed and
approved under this division along with the original copy of such
a lication. The clerk shall index the names in a book entitled
"Land Use Tax Assessment Book" and file each application in this
office. The clerk shall be com ensated at the rate of One Dollar
1.00 for filin and indexin each a lication or revalidation.
Sec. 21-56. Delinauent taxes.
If on June 1 of any year the taxes for anv prior year on a~
parcel of real property which has special assessment as provided
for in this ordinance are delinquent, the County shall send notice
of that fact and the eneral rovisions of Sec. 58.1-3235 of the
Code of Virginia to the property owner by first-class mail. If
after sending such notice such delinquent taxes remain unpaid on
November 1 the treasurer shall notify the real estate assessor who
shall remove such parcel from the land use program.
Sec. 21-57. Change in use zoning or area; roll-back taxes.
There is hereb im osed a roll-back tax and interest thereon
in such amounts as may be determined under Virginia Code Sec. 58.1-
3237 on real estate which has alified for assessment and taxation
on the basis of use under this ordinance upon one or more of the
following occurrences:
~ when the use by which it qualified changes to a more
intensive use;
Sb~ when it is rezoned to a more intensive use as described
in Sec 58 1 3237 of the Code of Virainia; or
~c1 when one or more parcels, lots or pieces of land are
se crated or s lit off from the real estate as described in Sec.
58 1-3241 of the Code of Virainia.
Such additional taxes shall only be assessed against that
portion of such real estate which no lonaer qualifies for
assessment and taxation on the basis of use or zoning.
Sec. 21-58. Failure to report chances; misstatements in
application.
1a1 The owner of an real estate liable for roll-back taxes
shall, within sixty (60) days following a chance in use_, report
such chance to the real estate assessor on such forms as may be
rescribed. The real estate assessor shall forthwith determine and
assess the roll-back tax which shall be paid to the treasurer
within thirty X30) days of assessment by the owner of the property
at the time the chance in use which no lonaer qualifies occurs.
Upon failure to report within sixty (60) days followina such chance
in use or failure to pay within thirty (30) days of assessment or

In addition to such penalty for failure to make required report,
there is hereby imposed interest of one-half (1/2~) percent o_f the
amount of the roll-back tax, interest and penalty, for each month
or failure thereof during which the failure continues.

than a clerical error in any application filed pursuant hereto
shall be liable for all taxes in such amounts and at such times
as if such ro ert had been assessed on the basis of fair market
value as applied to other real estate toaether with interest and
enalties thereon and he shall be further assessed with an
additional penalty of one hundred (100%) percent of such unpaid
taxes. The term "material misstatement of fact" shall have the
same meanin as it has under Sec. 58.1-3238 of the Code of
Virginia.
Sec. 21-59. Application of Title 58 1 of the Code of Virainia.
The provisions of Title 58 1 of the Code of Virainia
a licable to local levies and real estate assessment and taxation
shall be a licable to assessments and taxation hereunder mutatis
mutandis including without limitation, provisions relating to tax
liens and the correction of erroneous assessments and for such
ur oses the roll-back taxes shall be considered to be deferred
real estate taxes.
Sec. 21-60. Effective date.
This ordinance shall be effective for all tax years beainninci
on and after January 1, 1990.

BACKGROUND'
The 1989 Session of the General Assembly of Virginia enacted
certain amendments to the State Land Use Provision in Chapter 32,
58.1 of the Code of Virginia, 1950, as amended, to provide for
uniform standards for real estate taxation. It is necessary to
amend and revise the Roanoke County Ordinance in order to conform
procedurally with the new Commonwealth of Virginia provisions.
SUMMARY OF INFORMATION:
The provision in the proposed ordinance requires written commitment
from the landowners in the "Open Space" Land Use Classification.
Implementation would provide more effective roll back tax
provisions. This ordinance will commit the property owners in the
land use category to preserve the natural resources and the
conservation of land.
It will also further restrict developing the open space land use
category other than in the best interest of the public.
RECOMMENDATION'
Accept and act on staff recommendation to amend and reenact Article
III, Division 2, Use of Value Assessment of certain real estate
following second reading on October 10, 1989

ORDINANCE AMENDING AND REENACTING ARTICLE III,
DIVISION 2, USE OF VALUE ASSESSMENT OF CERTAIN
REAL ESTATE, OF CHAPTER 21, TAXATION, OF THE
ROANOKE COUNTY CODE
WHEREAS, Article III, Division 2, of Chapter 21 of the Roanoke
County Code provides for a use value assessment of certain real
estate in order to preserve agricultural, horticultural, forest and
open space uses within the County's boundaries consistent with the
County's land use plan; and
WHEREAS, the 1989 session of the General Assembly of Virginia
enacted certain amendments to Article 4 of Chapter 32 of Title 58.1
of the Code of Virginia, 1950, as amended, to provide for uniform
standards for real estate taxation to be prescribed by the Director
of the Virginia Department of Conservation and Recreation, the
Virginia Commissioner of Agriculture and Consumer Services, and the
State Forester and other procedurals; and
WHEREAS, pursuant to the provisions of Section 18.04 of the
Charter of Roanoke County, a first reading and public hearing was
held on September 26, 1989; a second reading was held on October
10, 1989, concerning amending Article III, Division 2, of Chapter
21 of the Roanoke County Code pertain to use value assessment and
fee.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of
Roanoke County, Virginia, as follows:
1. That Chapter 21, Taxation, of the Roanoke County Code be

amended by deleting the present Article III, Division 2 and
reenacting a new Article III, Division 2, Use value assessment of
certain real estate as follows:
Sec. 21-51. Findings.
The County of Roanoke finds that the preservation of real
estate devoted to agricultural horticultural, forest and open
space uses within its boundaries is in the public interest and,
having heretofore adopted a land use plan hereby ordains that such
real estate shall be taxed in accordance with the provisions of
Conservation and Recreation the Virginia Commissioner of
A ricultural and Consumer Service and the State Forester and this
ordinance.
Sec. 21-52. Applications for special assessment; fees.
Sad A lications for taxation of real estate on the basis of
use assessment shall be submitted to the real estate assessor on
forms provided by the Virginia Department of Taxation and supplied
b_v the real estate assessor The application shall include such
additional schedules photographs and drawings as may be recruired
by. the real estate assessor.
~b1 Applications shall be submitted:
~_ At least sixty (60) days preceding the tax year for
which such taxation is sought; or
S2 ~ In any year in which a general reassessment is being
made, until thirty (30) days have elapsed after the notice of
increase in assessment has been mailed to the property owner in
accordance with Section 58 1-3330 of the Code of Virginia, or sixty

Dollars (520.00).

acreage of such land previously approved chances; provided however,
that no application fee shall be required when a change in acreage
occurs solely as a result of a conveyance necessitated by
governmental action or condemnation of a portion of any land
previously approved.
If any tax on the land affected by an application is
delinctuent when the application is filed, then the application
shall not be acce ted. U on a en of all delin t taxes

then be treated in accordance with this section.
u Such property owner must revalidate annually with the
real estate assessor anY application previously approved. A
revalidation fee of Ten Dollars (S10 00) shall accompany each
application for revalidation every sixth year Late filing of a
revalidation form must be made on or before the effective date of
the assessment and accompanied with a late filinct fee of Twent
Dollars X520).
Sec. 21-53. Determination of use value and assessment.
Sad Promptly upon receipt of an application, the_real estate
assessor shall determine whether the subject property_meets the
criteria for use value assessment and taxation under this
ordinance Article 4 of Cha ter 32 of Title 58.1 of the Code of
Virctinia, and the applicable standards prescribed thereunder by the
Director of the De artment of Conservation and Recreation the
Commissioner of A riculture and Consumer Services and the State
Forester.
~_ Minimum acreage.
~_ Real estate devoted to:
~1 a ricultural or horticultural use shall consist
of a minimum of five acres;.
forest use shall consist of a minimum of twenty
acres;
Lc1 open space use shall consist of a minimum of
five acres except that real estate adjacent to
a scenic river a scenic hicrhway, a Virainia
Byway or public property shall consist of a
minimum of two acres. A scenic river, scenic

under this paragraph means those which are
listed in the State Comprehensive Outdoor
Recreational Plan, also known as the Virainia
Outdoors Plan a copy of which can be obtained
from the Department of Conservation and
Recreation 302 Governor Street, Suite 203,
Richmond, VA 23219.
~_ The foregoing requirements for minimum acreaae shall
be determined by adding together the total area of contiguous real
estate excludin recorded subdivision lots titled in the same
ownership For purposes of this section properties separated only
by a public right-of-way are considered continuous.
Scl In addition to meeting the foregoing requirements for
minimum acreaae real estate devoted to open space use shall be:
~_ within an agricultural, a forestal, or an
agricultural and forestal district entered into pursuant to Chapter
36 LSec 15 1 1507 et sect ) of Title 15 1 of the Code of Virainia,
or
~_ subject to a recorded perpetual easement,
restrictive covenant or equitable servitude that is held- by a
public body and that promotes the open space use classification
as defined in Sec 58 1-3230 of the Code of Virainia, or
~j_ subject to a recorded commitment meeting the
standards prescribed by the Director of the Virginia Department of
Conservation and Recreation and entered into by the landowner with
the County.
If the real estate assessor determines that the property
does meet such criteria he shall determine the value of such
property for its qualifying use as well as its fair market value.
lei In determining whether the subject property meets the
criteria for "a ricultural use" or "horticultural use" the real
estate assessor may request an opinion from the Commissioner of
Agricultural and Consumer Services; in determining whether the
subject property meets the criteria for "forest use" he may request
an opinion from the State Forester; and in determining whether the
subject property meets the criteria for "open space use" he m~
re est an o inion from the Director of Conservation and
Recreation Upon the refusal of the Commissioner of Agriculture
and Consumer Services State Forester or the Director of the
Department of Conservation and Recreation to issue an opinion, or
in the event of an unfavorable opinion which does not comport with
standards set forth by the respective director the party aggrieved
ma seek relief from an court of record wherein the real estate
in question is located If the court finds in his favor it m~

issue an order which shall serve in lieu of an opinion for the
purposes of this ordinance.
Sec. 21-54. Taxation based on qualifying use.
The use value and fair market value of any qualifying property
shall be placed on the land book before delivery to the treasurer.

on continuance of the real estate in a qualifying use, continued
payment of taxes as rectuired in Section 58 1-3235 and compliance
with other requirements of Article 4 of Chapter 32 of Title 58.1

Director of the Virginia Department of Conservation and Recreation.

Sec. 21-55. Indexing and filing of approved applications.
The real estate assessor shall prepare and transmit to the
clerk of the circuit court a list of all applications filed and
approved under this division along with the original copy of such
a lication. The clerk shall index the names in a book entitled
"Land Use Tax Assessment Book" and file each application in this
office The clerk shall be compensated at the rate of One Dollar
~ 1 00~ for filing and indexing each application or revalidation.
Sec. 21-56. Delinquent taxes.
If on June 1 of any year the taxes for any prior year on any

of+that fact and the general provisions of Sec. 58.1-3235 of the
Code of Virginia to the property owner by first-class mail. If
after sending such notice such delinquent taxes remain unpaid on
November 1, the treasurer shall notify the real estate assessor who
shall remove such parcel from the land use proaram.
Sec. 21-57. Change in use, zoning or area; roll-back taxes.
There is hereb im osed a roll-back tax and interest thereon
in such amounts as may be determined under Virainia Code Sec. 58.1-
3237 on real estate which has qualified for assessment and taxation
on the basis of use under this ordinance, upon one or more of the
following occurrences:
~ when the use by which it qualified changes to_ a more
intensive use:
when it is rezoned to a more intensive use as described
in Sec 58 1-3237 of the Code of Virginia; or
~c1 when one or more parcels lots or oieces of land are
se grated or s lit off from the real estate as described in Sec.
58 1-3241 of the Code of Virginia.
Such additional taxes shall only be assessed against that
,portion of such real estate which no longer qualifies for
assessment and taxation on the basis of use or zoning.

SUMMARY OF INFORMATION:
On December 13, 1988, the Board of Supervisors voted to continue
this Board and appoint new members. Michael Lazzuri, Director of
Court Services has contacted the present members of the Court
Service Unit Advisory Council/Youth and Family Services Advisory
Board to determine whether they wished to continue serving.
The following terms expired in 1988 or will expire in 1989.
Appointments to this committee are not made by magisterial
district; however, the magisterial district is listed for each
member.
Two-year term of James L. Trout, Vinton Magisterial District,
will expire March 22, 1989. Mr. Trout has not responded to Mr.
Lazzuri's letter.
Two-year term of Ted R. Powell, Cave Spring Magisterial District,
will expire. March 22, 1989. Mr. Powell would like to be
reappointed.
Two-year term of Hoyt C. Rath, Vinton Magisterial District, will
expire March 22, 1989. Mr. Rath does not wish to serve another
term.
Two-year term of Dr. Andrew Archer, Vinton Magisterial District
expired March 22, 1988. Dr. Archer does not wish to be
reappointed.
In addition to the appointments listed above, it is necessary to
appoint four youth members, one each from Cave Spring High
School, Northside High School, Glenvar High School, William Byrd
High School. Mr. Lazzuri recommends that these appointments run
from September through September. Therefore, appointment made in

signed applicant and which shall be deemed a condition under
which this permit is issued.
All applicants should exercise extreme care to ensure the accura-
cy of their responses to the following questions. Bingo games
and raffles are strictly regulated by Title 18.2-340.1 et. sec.
of the criminal statutes of the Virginia Code, and by Section
4-86 et. s_e~c. of the Roanoke County Code. These laws authorize
the County Board of Supervisors to conduct a reasonable investiga-
tion prior to granting a bingo or raffle permit. The Board has
sixty days from the filing of an application to grant or deny the
permit. The Board may deny, suspend, or revoke the permit of any
organization found not to be in strict compliance with county and
state law.
Any person violating county or state regulations concerning these
permits shall be guilty of a Class 1 misdemeanor. Any person who
uses any part of the gross receipts from bingo or raffles for any
purpose other than the lawful religious, charitable, community,
or educational purposes for which the organization is specifi-
cally organized, except for reasonable operating expenses, shall
be guilty of a Class 6 felony.

BACKGROUND:
The Board of Supervisors has previously requested that the
Sheriff's Department increase enforcement activities in the
Boxley Hills area.
SUMMARY OF INFORMATION:
The Sheriff has reviewed the cost of this additional
enforcement and concluded that he will be able to provide this
coverage by using off-duty deputies working Friday and Saturday
night from 8:00 p.m, until 2:00 a.m. The cost of providing this
level of service beginning October 1, 1989 for the remainder of
the fiscal year would be $8,850.
FISCAL IMPACT:
During 1988-89 the Sheriff was able to collect fines
and forfeitures revenues in excess of the amount that was
budgeted. He anticipates that this higher collection effort will
continue through the 1989-90 fiscal year. This additional
revenue could be used to offset the expense of the additional
overtime funds needed to cover the Boxley Hills area.

STAFF RECOMMENDATION:
Staff recommends allocating $8,850 to the Sheriff's overtime
budget and increasing revenues anticipated from fines and
forfeitures by an equal amount.

BACKGROUND
Carl R. Catron, Park Maintenance Foreman in the Department of
Parks and Recreation, sustained a job-related injury on June 15,
1989, and approval by the Board of Supervisors for an extension
of Workers' Compensation Leave is requested. Approval of a
Special Leave Request permits regular employees to receive full
pay and County benefits; and, in turn, employees must sign over
any Workers' Compensation checks to the County. Mr. Catron's
Workers' Compensation Leave will expire on October 26, 1989,
unless additional leave is approved by the Board of Supervisors.
Mr. Catron continues to have problems relating to his injury and
is unable to return to work at this time. In accordance with
Section VIII-C of the Employee Handbook, an additional sixty (60)
work days may be granted by the Board of Supervisors.
FISCAL IMPACT
The total salary cost for sixty (60) work days, less Workers'
Compensation payments returned to the County, is $1,781. The
total fringe benefit cost for the sixty (60) days is $1,651. The
total cost for salary and fringe benefits is $3,433. An
appropriation of funds will not be required for this Special
Leave Request.
RECOMMENDATIONS

The Director of Parks and Recreation and the Department of Human
Resources recommend that the Special Leave Request be approved by
the Board of Supervisors in accordance with the Employee Handbook.

County Board of Supervisors unanimously approved the request of the
Botetourt Jaycees for a Raffle Permit. The raffle will be
conducted on October 28, 1989.
The fee has been paid and your receipt is enclosed.
You may consider this letter to be your permit, and I suggest it
be displayed on the premises where the raffle is to be conducted.
The State Code provides that raffle and bingo permits be issued on
a calendar-year basis and such permits issued will expire on
December 31, 1989. This permit, however, is only valid on the date
specified in your application.

performance in recent emergency situation.
I told him I agreed the actual workers did a good'job and worked
hard to restore power but thought the administration needed next
time if an emergency came to put on more phone lines as we answered
a tremendous number. of callers who could not get to APCO.

On December 13, 1988, the Board of Supervisors voted to continue
this Board and appoint new members. Michael Lazzuri, Director of
Court Services has contacted the present members of the Court
Service Unit Advisory Council/Youth and Family Services Advisory
Board to determine whether they wished to continue serving.
The following terms expired in 1988 or will expire in 1989.
Appointments to this committee are not made by magisterial
district; however, the magisterial district is listed for each
member.
