The staff was directed to proceed with the clean-up operations and report back to the Board when all expenditures had been accumulated. A-1990-2 ITEM NO . ~ - -Z - AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: January 9, 1990 AGENDA ITEM: Extension of contract to purchase Lloyd Property COUNTY ADMINISTRATOR' S COMMENTS : ~~~vc~-~"'t-,"t,~ ~^~~yn~ BACKGROUND' On June 27, 1989, the Board of Supervisors of Roanoke County adopted Ordinance No. 62789-6 accepting an offer for and authoriz- ing the sale of 37.86 acres of real estate, The eurchasespriceafor in the City of Salem (the Lloyd property). P this property is Five Hundred Sixty-eight Thousand Four Hundred Dollars ($568,400). This contract is subject to several condi- tions, namely availability of public utilities, zoning, and completion of a satisfactory environmental investigation. Closing is subject to satisfaction of these conditions. SUMMARY OF INFORMATION: The purchaser has been unable to resolve to its satisfaction one or more of these conditions; however, the purchaser is still interested in proceeding with the transaction. The contract 1989• provides for closing to occur on or before October 30, however, the purchaser previously requested and received a two- month extension. The purchaser is attempting to obtain the necessary engineering and other work needed to determine whether a septic system can be used for its proposed development. Therefore, the purchaser has requested an extension of t da sfor performance of this contract for an additional sixty (60) y ALTERNATIVES AND IMPACTS: 1. Grant the purchaser's request for a sixty (60) day extension of this contract. 2. ITEM NUMBER ~- 3 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: January 9, 1990 AGENDA ITEM: Resolution of Support for increased state funding for community based services for the mentally ill, mentally retarded and substance abusers COUNTY ADMINISTRATOR'S COMMENTS: SUMMARY OF INFORMATION: The Mental Health Association of Roanoke Valley, Inc. on behalf of the Roanoke Valley Chapter of the Virginia Coalition for the Mentally Disabled is requesting support for increased state funding for community-based services for the mentally ill, mentally retarded and substance abusers. Increased funding would provide additional adequate housing, more outreach and emergency services. These organizations have requested that the Board of Supervisors adopt a resolution of support for increased funding from the 1990 General Assembly, and that the resolution be sent to area state legislators. When CES was questioned when it could begin work, it responded in two to four_ weeks time because the employees CES would hire needed to give their notice. Later, CES said that it could sub-contract the work and start sooner. 5. Bayse Transportation Service, Inc. submitted the specified documents: Certificate of Insurance showing general liability, automobile liability, workers' compensation and employer's liability, and motor truck cargo all insured to Bayse Transportation Service. SCC licensing of fourteen (14) trucks. On December 18, 1989, CES, through its attorney, filed a protest of this bid award pursuant to Section 17-129 of the County Code (see attached correspondence). The protest includes the basis for the protest and the relief requested. CES asserts that this is a tie bid, and according to Section 17-62, the award should be decided by lot. As stated in the County Code, a copy of which is attached, price is not the only factor to consider when determining the lowest responsible bidder. Although the bid initially appears to be a "tie" based on price per gallon, when considering all of the facts in this transaction, it was the conclusion of the Procurement and Engineering Departments that Bayse Transportation Service, Inc. was the lowest, responsible bidder, in accordance with the bid evaluation requirements of Section 17-60 of the County Code: 1. The County has utilized Bayse Transportation Service, Inc. to perform this work in the past and has been satisfied with the quality of its performance of these previous contracts or services. 2. Bayse Transportation could begin the work immediately. 3. Bayse Transportation submitted the required licensing and insurance certificates. 4. CES could not begin work immediately unless it was sub- contracted. It had no employees and no equipment. It did not meet specifications by failure to submit the proper insurance and licensing certificates. It is my understanding that my client's bid was submitted in the same amount as that of the successful bidder. Section 17-62 of the Roanoke County Code provides that, - "In the case of a tie bid, preference shall be given to goods, services and construction produced in the county or provided by county residents and thereafter to goods, services and construction produced in Virginia or provided by Virginia residents, if any of such choices are available; otherwise the tie shall be decided by lot." (Ord. No. 3350, §2-31, 12-14-82) In this particular case, even though there was a tie bid, the bid award was made to the second bidder, rather than to my client. It is our position that since it was a tie bid, the matter should have been decided by lot pursuant to §17-62. In talking with representatives of the County, it is my understanding that they considered other factors in making their decision. However, §17-62 does not give latitude in that area. The Code does permit other factors to be considered in the bid evaluation, but the factors that were considered had no bearing on this particular bid. In this particular case, the bid ~--1 - was awarded to the other bidder on the basis that he had been in business and had performed this service before, that he already owned equipment and had in effect all of the insurance and licenses required. My client was in a position to have the equipment available and obtain the necessary insurance and licenses immediately upon being notified that he was the successful bidder. Our position is that the proper procedure was not followed and that the award of the contract should have been made "by lot". That is all that we can ask for; but that is what we are asking. A lease has been negotiated with College Avenue Building Limited Partnership, owners of the facility, for the 13,267 sq. ft. of office space currently utilized, for a five year period commencing March 1, 1990. Following the expiration of this five year period, there are options to renew for a three year renewal term and afterwards a two year renewal term with the square footage cost as specified in the agreement. During the first year of this lease, the cost per square foot would be $7.10. This rate would increase 25~ annually over the life of the lease. It should also be noted that the tenant will be responsible for its own janitorial service and electricity costs during the life of this lease. The Social Services Board respectfully requests favorable consideration of this lease, so that the operations of the department may be continued without interruption. It has been suggested that the five year term would be appropriate, even in light of consolidation, since the consolidation would not occur until July 1, 1993, and also there are no facilities which could provide the 13,000 sq. ft. of space currently being utilized by this department. In the event of consolidation, it has also been suggested that the City of Salem may be interested in continuing the contractual arrangement for Social Service activities as currently experienced with the County, and also that satellite operations making the office reasonably available to the clientele might be appropriate. The Board made the decision to resume publication of the newsletter last year, based on the variety and complexity of issues which are currently facing the County; i.e., the new landfill, consolidation, Spring Hollow Reservoir, and most recently, the police department. Nothing has changed since this decision was made, and the reasons for publication of Roanoke County Today still exist. Newsletters are very useful methods of communication, particularly when the audience has a common interest, and Roanoke County Today offers an opportunity for our citizens to know more about the operation of the County, and to feel better about how tax dollars are spent. The cost of the publication is extremely low; we reach 31,000 households at an annual cost of .85 per household. There is no other printing and distribution method which would provide a lower cost per copy. I recommend that we continue publication of Roanoke Countv Todav, so that our citizens can receive the information they need about the vital issues which are facing them in the upcoming year. I believe this is an appropriate time to conduct a survey of county citizens to assess their acceptance of this publication as a worthwhile endeavor. Therefore, I plan to propose, at the January 9 Board meeting, that the County Administrator and his staff conduct a representative telephone survey and report the results to the Board at our January 23 meeting. This would be a logical follow-up to the survey conducted by staff last fall, whose results were reported with the December 19, 1989 agenda package. I suggest that the survey questions generally be along the following lines: (1) Do you receive the afternoon edition of the Roanoke Times and World-News? Yes - No. (2) Are you aware that Roanoke County publishes a newsletter entitled "Roanoke County Today" as a newspaper supplement on the first Wednesday of each month? With the publicity surrounding the most recent reassessments and the upcoming budget deliberations, it would seem appropriate at this time to address the age-old dilemma of tax relief by granting a five cent reduction in real estate tax rates. It would appear that the most recent reassessments could generate in excess of $2 million in revenue. While I understand that we are faced with "big ticket" items in the coming budget, if we are serious about tax relief, perhaps we should consider the following: 1. Adopt a philosophy of cutting the tax rate on real estate by one cent each year for four successive budgets until such time as our tax rate for real estate if $1.10 per $100 evaluation. 2. Instruct the County Administrator to-prepare the FY91 budget based on a tax rate of $1.14 per $100 assessed value of real estate. By taking this action at this time, the staff would be better equipped to deal with departmental requests and Roanoke County would be moving its tax rate toward that of the suburban section of the proposed new regional government. I plan on bringing this up at Tuesday's board meeting, and trust we can discuss it fully at that time. Any person who uses any part of the gross receipts from bingo or raffles for any purpose other than the lawful religious, charitable, community, or educational purposes for which the organization is specifi- cally organized, except for reasonable operating expenses, shall be guilty of a Class 6 felony. There have been some members who have been interested in a tax reduction. I believe that we need to use caution at this point in suggesting any changes in revenues or expenditures 'oeyond the "let's take a look at" point. We are all committed to making this our best year ever, but it will be detrimental if we get employees' expectations up and not be able to fulfill them. I am just beginning to get into the budget process and will share with you revenue projections and expenditures, as we have agreed in the past, all at the same time. It might seem that an 8.5 per cent average increase in assessments would provide considerable additional funds, but that is not the case. For the past few years, we have had one-time infusions of revenue, i.e., proration of personal property tax, annual real estate assessment, and the meals tax, that we do not have this year. At this point, I think it is safe to say that we will be able to maintain status quo. This should not be interpreted as a pessimistic or optimistic position at this time, it is simply a word of caution. I am asking that we let the process work. I should have revenue projections for the Board's retreat, and we need to come to some consensus on what the Board's budget priorities are for the upcoming year. His term will expire 2/10/91. However, the Roanoke Regional Airport Commission Act states: "The governing body of each political subdivision shall be empowered to remove at any time, without cause, any Commissioner appointed by it and appoint a successor Commissioner to fill the unexpired portion of the removed Commissioner's term." NICKENS VIN TON MAGISTE RIAI DISTRICT SUBJECT: Board of Supervisors Retreat After numerous discussions with board members, it appears the best time for the retreat is the weekend of January 20th. It will probably take two days to get through the issues that each of you want to discuss. I am proposing that we start early on Saturday, January 20 at 8:00 a.m. This should accommodate any of the activities you may have scheduled for Friday. As we have done in the past, I am requesting that each board member submit proposed agenda items and we will combine these into a packet for you to review. I think it would be interesting and helpful to start with a few hours of Myers-Briggs testing. I have spoken to several of you about this. The Management Team took the Myers-Briggs test at their retreat and found it very helpful in seeing how different people approach problem solving. In addition to suggested agenda items, I would like your suggestions on a location and whether you would like to use a facilitator. The Holiday Inn-Tanglewood worked well before and I recommend that location or some other location in the County. Please let me know your recommendations next week so we can begin definite preparations for the retreat. Everyone seems enthusiastic so this should be a good opportunity to plan the priorities and activities for the upcoming year. Hodge County Administrator DATE December 11, 1989 RE Retreat - Board of Supervisors As you may recall from the last training retreat, the Board expressed interest in a follow-up retreat in January. We would recommend scheduling the retreat over a weekend in January beginning on Friday evening and ending mid-day Sunday. We have contacted Bernards Landing and they can accommodate us the weekends of January 12-14 or January 19-21. As an alternative, we could possibly hold the retreat at Hollins College.
