AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: May 29, 1990 AGENDA ITEM: Amendments to the Consolidation Agreement COUNTY ADMINISTRATOR'S COMMENTS: BACKGROUND' On February 27, 1990 the Board of Supervisors of Roanoke County, Virginia authorized the execution of the Consolidation Agreement between the County of Roanoke and the City of Roanoke. On March 13, 1990 the Board requested that Roanoke City Council consider several modifications to the agreement. Over the past two months representatives of the County and City have discussed these modifications. On April 10, 1990 the Board voted to amend the proposed Charter for the Roanoke Metropolitan Government and the Consolida- tion Agreement to change the composition of the school board by the addition of two members. Since the "veto" session of the Virginia General Assembly was scheduled to commence in mid-April, it was decided to address this issue at that time. SUMMARY OF INFORMATION: Representatives of the County and City have completed their negotiations with regards to amendments to the Consolidation Agreement. These amendments are as follows: 1) Section 12 Education. Expand the composition of the school board by the addition of two members. AYES: SUPERVISORS EDDY, MCGRAW, JOHNSON, ROBERS NAYS: SUPERVISOR NICRENS 2) The addition of a provision concerning reassignment of school faculty and personnel. SUPERVISOR JOHNSON MOTION TO DELETE. AYES: SUPERVISORS EDDY, MCGRAW, JOHNSON, NICRENS, ROBERS NAYS: NONE STAFF RECOMMENDATION: If the Board concurs with the amendments and modifications discussed above, it is recommended that staff be authorized to publish the appropriate legal notice as required by law and schedule the public hearing on the amendments to the Consolidation Agreement. It is recommended that the Board follow the same procedure in adopting amendments to the Agreement as it followed in adopting the Agreement on February 27, 1990: schedule a public hearing on these amendments, following the publication of appropriate legal notice as provided in Section 15.1-1137 of the Code of Virginia. Legal notice (and a copy of the amendments to the Agreement) should be published once a week for four successive weeks. The public hearing and action to approve and adopt these amendments could be scheduled for July 10, 1990. It is also recommended that these amendments be submitted to the Circuit Court for the entry of an appropriate Order, amending the Order entered April 18. 1990_ Finally, the City and County Attorneys have directed outside counsel to submit the request for approval of the voting changes pursuant to the Voting Rights Act to the Justice Department. ALTERNATIVES AND IMPACTS: STAFF RECOMMENDATION: If the Board concurs with the amendments and modifications discussed above, it is recommended that staff be authorized to publish the appropriate legal notice as required by law and schedule the public hearing on the amendments to the Consolidation Agreement.
